The HonorableThelton E. Henderson,Federal District Judge

Suzanne Henderson Emerson,South Pacific Region Commissioner, Clan Henderson Society

As a boy growing up poor in Shreveport, Loui-siana and South Central Los Angeles, no one wouldhave guessed that Tholton Henderson would growup to be a federal court judge. Through his hardwork, and application of his quick mind and deepempathy, he excelled - serving as a federal judge for37 yeus, including seven yeals as Chief Judge ofthe U.S. Federal Court for the Northem District ofCalifomia.

For genealogy buffs: Judge Henderson's ma-ternal ancestors, the Herrings, are from FranklinCounty, Mississippi. His Henderson line has gen-

erations ofancestors in and around Shreveport, Loui-siana.

Thelton Henderson was bom in Shreveport in1933 and raised during his early years primarily byhis grandmother. Thelton's mother, who had beenworking fuIl time as a maid since she completed 8fr

grade, was "in service" - a live-in maid, only able tovisit her own family on occasional weekends. Hisgraldmother, mother, and entire extended familymoved to South Central Los Angeles when Theltonwas young,and when he was about seven, his motherwas able to purchase a house and raise Thelton her-seif. Although his father lived with the family inSouth Central Los Angeles for atime, hewas notamajor presence in Thelton's upbringing.

As high school football and baseball team cap-tain and an avid reader, a teacher suggested Theltonapply to the University of Califomia at Berkeley fora college sports scholarship. At Berkeley, Thelton

played both varsity football - he was "small andfast" - and 1ater, after a knee injury, played var-sity baseball. Thelton was the first member ofhis family to attend college. His mother expectedhim to "be somebody," so he applied to and wasaccepted into law school at U.C. Berkeley (BoaltHa11), but was drafted into the military shorllya.fter his college graduation. After serving in thearmy, Thelton was able to begin law school,where he was one of only two black students inhis class.

Immediately after taking the California Barexam in 1962, Thelton began working for theCivil Rights Division of the U.S. Department ofJustice, which was investigating and litigatingcases in which blacks were prevented from leg-istering to vote in the Deep South. Aitirough hestarted out performing voter case research, hisjob soon became more complicated. As the onlyblack Justice Department lawyer in the South,he was soon making connections with civil rightsleaders - ald expected to report back on theiractivities. But living and working in the segre-gated South was dangerous and one run-in with

_ the police left one ofhis hands permanently dis-figured.

- Thelton knew that he was not supposed to

become involved in the political aspect of thecivil rights movement. But in October of 1963,

Dr. Martin Luther King, Jr. and his associate Rev.Nelson Smith, asked to borrow Thelton's car. Theyneeded to drive 88 miies from Birmingham toSelma. Alabama. but were concemed that with thepoor condition of Rev. Smith's car, an auto break-down on rura.l Alabama roads could put them in adeadly position. So Thelton loaned his car to Rev.

Smith who drove Dr. King to Selma. When theState police spotted them and leamed the car hadbeen rented by the Justice Department, the segre-gationists argued that the Justice Department wasinappropriately supporting the civil rights move-ment and Thelton lost his job.

Moving back to Califomia, Thelton developeda local Legal Aid center and seryed as an AssistantDean at Stanford Law School, teaching and devel-oping their minority admissions program.Henderson was appointed as a federal judge in1980.

Judge Henderson's stellar legacy as a judgeis marked by empathy - towards plaintiffs and de-fendants, prison inmates and guards. He is knownfor being inquisitive, soft-spoken, humble, quick-witted, and showing respect towards a1i who ap-pear in his court. According to one of his clerks,"The most important thing for him is that peopleleave feeling they've been heard."l

"Lawyers who have appeared before JudgeHenderson, regardless ofwhether they were on t}tewinning ol losing side, acknowledge his faimess,cornpassion, knowledge, and commitment to therule of law."2

Over a period of 15 years, Judge Hendersonmade a series of rulings enforcing federal laws toprotect dolphins from needless slaughter by thetuna fishing industry. His ruling on Agent Orange

required the Veterans'Administration to feat vets formany ailments caused by exposure to the chemicals.

Judge.Henderson has made politically-un-popular decisions, including rulings defending af-firmative action, supporting the equal rights ofgayemployees, and upholding the rights ofprisoners.In one case, he ruled that inmates had proven theconditions of their confinement in Califomia'sPelican Bay State Prison constituted muel and un-usual punishment. In another case, after a classaction 1ed to years of Court efflorts to let the Cali-fornia Department of Corrections to come up witha plan to improve its prison medical system, JudgeHenderson took the unprecedented action ofplac-ing the entire California prison medical systemunder court receivershio.As he stated in one rul-

ing, "We must be careflrl not to stray into mattersthat our system offederalism reserves for the dis-cretion of state officials. At the same time, we haveno duty more important than that ofenforcing con-stitutional rights, no matter how unpopular thecause or powerless the plaintiff."3

In 1998, Judge Henderson stepped down fromthe Chief Judge position when he assumed seniorstatus, performing one-fourth the work-load insteadof taking full retirement. Judge Henderson said,"I realize I iove thisjob, for many reasons. I love itfor the intellectual challenge and the stimulation, Ilove it because . . . you can actually do some thingsthat I think axe beneficial to society."a He retiredftom the Court in 2017, and now is a DistinguishedVisitor at UC.

Before the story: My grandpar-ents on my mother's side of the fam-ily were Annie Roberta McDonald(1887 - 1960) and RobertBenjamine Bishop (1885 - 1912).

Robert Benjamine Bishop's par-ents were Robert L. Bishop, Jr.,(1856 - 1913) and Mariah FrancesHenderson (1 856-1 931 ).

Mariah Frances Henderson'sparents were David A. Hendersonand Nancy Popwell.

have a little china cup that has written onits side in faded gold and pink lettering,"Think of Me."

The handle is gone and the rim is chipped -and the gilt is wom so thin. Two dainty pink rosesomament my litt1e cup. It doesn't matter that timeand use have dimmed the colors, the words stillremind, "Think of Me."

I can hold my cup - for it is small - in thepalm of my hand; and, when I close my fingersgently about the delicbte porcelain, it speaks to meof long ago. It makes me think of other lives andother loves and another time.

My littie cup has twice been a gift.

First, Roberl Benjamine Bishop brought it, a1l

whole and bright, as a birthday gift to AnnieRoberta McDonald.

He with a wom straw hat on the back of hishead and sky blue eyes that were sparkling in an-ticipation of seeing his beloved, had been awayfor a year and more.

He had made his way through the West Floridawildemess from Madison to Tamoa to leam to bea storekeeper.

Now, he was home at last.Robert Benjamine carefully tied his dappled

gray mare to the post out in front of the house,dusted his broadcloth lapels aad reached behindhis saddle to the wom saddlebags where - swaddledin soft cotton, wrapped in layers ofcushioning tis-sue paper and tied with a real and precious satinribbon, pink to match her cheeks - was his birth-day gift to Annie Roberta...a little china cup thatsaid, t'Think of Me."

Clutching his beribboned offlering, he hur-ried tlrough the clean-swept front yard, throughthe garden fragralt and glorious in its raiment ofrainbow roses and to the wide front steps. He

His trip home through the alligator infestedwilds of the untamed countrv between Tamoa.Florida and MadisonCounty, Florida had notseemed half as long as hisjoumey from his horse tothe front door of his be-loved Berta's front door.

"Has she forgottenme? Will it be the same?

What if she has foundsomeone else?" drummedinside his skull as hadthose same questions forthe last months andmonths.

Soon, he would haveanswers and he would see

her beloved face.

Reaching down for the hat, he encountered a

wagging, slobbering hound. The dog stepped onhis hat with a great splayed dog paw. He lickedour Ben right in the mouth.

Mrs. Zillianne Zaradora Phillips McDonald,descendant of Col.Walter Chiles ofJamestown, Virginiaand the wife of JohnDaniel McDonald whoowned River Bend Plan-tation. He was, himself,descended from "a wee,red-headed Scotsmanwho walked with a cane

and ate fiom goldplates."

Mrs. McDonaldand was tall, elegant, with a

stern and imposingexp(esson on her face,

Sweat dribbled down his cheeks and dorurhis back.

The heavy lace at the door twitched.Clearing his throat and taking his straw hat

from his head, hejuggled the package and the hatand sidestepped a big Bluetick Coonhound.

He raised his free hand to knock, just as thedoor opened wide.

"Miz McD-d-onald!" he said. mortified tohear his own voice break like that of a lad.

"Ben Bishop! It's a surprise to see you heretoday!" she said with a smile in her voice.

"Yes, ma'am. I mean, I'm not surprised tosee me, but I did just ride into home late last night,"he said, struggling to keep his voice manly andstrong.

He reached to shake her hand as was proper,

but realized he had both his hat and his gift for

She saw the blush begin at Ben's celluloidcollar and spread over his perspiring face into hissoft blonde hair. She saw him take a big breathand saw his white-knuckled grip on a package tiedwith a pink ribbon. She smiled and said, "Won'tyou come in, our Ben. Welcome home!"

"Thank you, ma'am," Ben said as he followedMiz McDonald down the wide and cool hall intothe splended Sunday Parlour. He only tripped onceon the soft Persia carpet that had come to WestFlorida by way of a sailling ship around the Homof Africa.

"At least," he thought, "the big-footed andslobbering Bluetick Coonhound is left behind onthe front porch!"

Ben was not normally so tongue-tied andclumsy. Today was special. It was the day he wouldsee his beloved once again and it was also July 11,

her birlhday!"I would surely like to see Berla," he said.

Ian Carter passed away on July 5ft, and was anupstanding member.of the Clan Henderson Society.

He and his wife, Robia regularly attended and as-

sisted in the Stone Mountain Highland Games. Hewas also very active in the community and was oneof the founding members of the Druid Lakes Youthlacrosse Association as well as an active member ofthe St. Andrews Society ofAtlanta.

He is a member of the Regional Bodyguardand has assisted during emergencies at the High-land Games. He has also recruited members ofthe Oklahsma State Bodyguard.

SFC Ian Mitchel Carter, US Army (ret.) age 54 ofDecatur, Georgia passed away Sunday, J.uly 5,2020, inhis home.

Ian was bom in North Kingston, Rhode Island. Hehad a very active military career. After retirement, he be-came an EMT or Prop Master on movie sets, even doingsome SAG related stunts and background work.

Ian was active in the community and was one of thefounding members of Druid Lakes Youth Lacrosse Asso-ciation, an active volunteer to Stone Mountain HighlandGames, and a member of St. Andrews Society ofAtlanta.He was also a member of the Clan Henderson Society.

He also had a big heart and always checked in onothers to make sure they were ok during these trying times.

Ian is survived by his wife Robin Carter of Decatur

Georgia, and their three children Keenan Carter (26), Caddock Carter (14), and Keely Carter(12). He also leaves behind four siblings and their families: Shaughn Carter (Georgia), Shan-

non Carter (Rhode Island), Nancy Ray (Georgia), and Jennifer Ward (Georgia). He was prede-

ceased by both parents Nannie and Grayden Carter.It was Ian's desire to be buried in Arlington National Cemetery. There is at least a seven-

month wait before interment. A memorial to celebrate his life will be planned in a couple ofmonths, further information is to follow. A. S. Tumer & Sons of N. Decatur Road will handlethe arrangements.

the package from Ben's trembling and nervelessfingers.

She uniied the real pink satin ribbon and re-tired it on her own long, dark silken braid. She

carefi;lly unwrapped the tissue paper and removedthe cotton wadding.

Finally, she held her gift in the palm of herhand - the little china cup, colors all bright andnew - it's rim unchipped and the handle whole.The little cun said to her. "Think of Me."

They had lovedeach other all oftheirlives, as children, as

neighbors, asfriends.

They were mar-ried on 28th March1907 in the littleWest Florida town ofMadison.

The little chinacup had a place ofhonor in their ownparlour in the homein town that hadbeen a wedding giftto the couple from her parents.

They, in time, had two little girls - one blondeand petite and one dark and iovely - Miidred Loisand Elizabeth Clyatt - the Bishop girls.

As a special treat, the litt1e girls were some-times allowed to hold the little cup when they hadtheir doil tea parties with imagined royalty. Oneday, the rim was chipped, although no one everknew from which little hand it had slipped.

Ben stili had his unforgettable smile and hisblue eyes were alight with happiness. He still hadhis o1d straw hat and he had his Berta and his girls.To him, life was complete and good.

Each year, on Berta's birthday, they wouldtake the little china cdp and share a cup ofhome-made elderberry wine. Ben would always say,

"Ah, my Berta, do always think of me."Berta would lisht his world with her own

On her birthday, in 1912, they buried Ben. Hehadn't been il1 but a day or two. Today, we wouldtake an antibiotic and go back to life...but, backthen, you died from a simple kidney infection.

My mother, Elizabeth, was only two anddidn't remember.

My Aunt Mildred, at four, had ground-itchand had to go to her father's funera.l barefootedand embarrassed and heartbroken.

She rememberedand wouid cry about it- until her own deathat the age of 107.

That night, shesaid, her mother tookdown the little cupand fi11ed it with thelast of their elderberrywine - as had beentheir custom on herbirthday. She smiledthrough her tears andnodded her head...andtook a sip in remem-brance ofher Ben.

When I camealong, and I can remember back and see plain inmy mind, that little cup, rim chipped, but other-wise whole - on the mantle in my grandmother'sliving room. The colors weren't new, but that littlecup always held a place of honor.

I will never, ever forget the day my two littiebrothers put a box on a chair and a book or two ontop of the box and climbed up and brought downthat little cup to examine in their small boy play.

They played at gamos and the little cup wassoon forgot. In their rough-housed way, the cupwas knocked awry - and the sudden, sharp crackof breaking china brought our world to a stop.

My grandmother, who almost never cried,cried that day. She took soft cotton and wrappedthe little cup. She then covered it with tissue pa-

On my own birlhday, when I was 21, my Grannycooked liver and onions - a lrreat only we two en-joyed. She served it in the old flowerdy china tueenand put upon the table a litt1e package wrapped incushioning cotton and tissue paper and tisd with apink satin bow -just like her own cheeks, still so softand pink.

She gave that package to me - although ofcourseI could not know it then, but it was the iast of myown birthdays that we two would share.

I untied the bow and retired the ribbon aroundmy own long braid. I unwrapped the cotton and tis-sue and rediscovered the little china cup, now chippedwith the handle gone and the colors betraying theyears.

She told me this story then, ofher beloved Ben.

We two. my grandmother and I. fiiled thelittle cup with some secret elderberry wine fromthe high shelf in her closet and shared a sip.

My grandmother said then to me, "Ah, mydarling grandchild, always think ofme and thinkof the life and love we've al1 shared. Think ofme and my Ben...and of my own love for you."

Thatwas June 18. My beloved grandmotherdied that October 30.

Ever since then and for as long as I am onthis earth. on my owrr binhday. I fill rhat linlecup with some not so secret eiderberry wine andhold the cup in the palm of my hand ard think ofBen and his Berta. I always, not only on thatday but every day, think of my grandmother'sendless love.

Here is parl of their interesting story.The Clydesdale is a breed of draft horse de-

rived from the farm horses of the Clydesdale re-gion of Scotland now known as Lanarkshire.

The breed developed as a result of breedingwith Flemish stallions which were bigger and stron-ger than the Scottish horse.

Thought to be over 200 years old and bredextensively for pulling heary loads in rural, indus-trial aad urban settings, the Clydesdales made aninvaluable contribution to both the indushia.l aadagricultwal revolution not only in Scotland but al1

over the world.At one time therQ were at least 140,000 Cly-

desdales known in Scotland. By 1949,just 80 ani-mals were licensed in England. Clydesdales have

since seen resurgence in popularity and population,

with an estimated global population of around10,000 horses. Clydesdales are now most numer-ous in the United States where many foals are bomeach year.

Clydesdales are noted for grace and versatii-ity; they stand on average between 16 - 17 handsin height (Multiply by 4 inches to get their height.)and can weigh up to one ton.

A Clydesdale has an elegant head, with a

straight profile, smali ears, large, dark eyes aad aheavy forelock. The neck is long and slightlyarched, the chest deep, the shoulders are wellsloped and muscular. The hindquarters are well-muscled and have a distinctively rounded silhou-dtte. Perhaps the most widely recognised featureof tho Clydesdale's appearance is the abundanceof feather, the long hairs that fall from j ust belowthe knees and hocks to cover the hooves.

The King's conduct after the event is not re-assuring. The citizens would not believe his state-ment that the conspiracy was the act of Gowrie,and to such an extent did this feeling prevail, thathe had to wait inside GowrieHouse on the fatal day till it wasdark, and then disappear clan-destinely with his escort tcFalkland, in order to save

his 1ife.When he arrived at

Falkland, the first thing he didwas to dismiss on the spot twoof Gowrie's sisters who wercmaids of honour to the Queen.

He made a bold effon topacifi' the people of Perth by granting them char-ters and all kinds of privileges; visiting Perth onmany occasions, eventually becoming a burgessand signing his name in the book of the GuildryIncorporation and afterwards becoming Provost -

The purpose of all this is too hansparent, wethink, to mislead any one. But the question remains,

what was his obj ect in committing this crime, if hedid commit it.

He was ajealous man. He was Gowrie's debtorfor the sum off80,000; he could not bear a rival tohis popularity, while his throne might possibly be

Gowrie, on the other hald, was a scholar, oneof the most accomplished men of his time, afavourite at the Coult of England, a general

favourite in Scotland and, as

Provost ofPe(h was beloved bythe people; so much so. thatwhen he left to complete hiseducation in Padua, the TownCouncil of Perth, kept him inthe Provostship during his ab-sence (six years). and wouldhave no other.

This is a compliment thatnever was paid to a Provost ofPerth outside of the Ruthvenseither before or since and it in-

dicates to what extent they were respected in theFair City. How far the Raid of Ruthven was re-sponsible for this conspiracy it is impossible toconjectue.

If the King was ar innocent man, why did heorl the 23'd August execute, after a mock trial, thethree confidential servants of Gowrie.-Cranston.Craigengelt and Macgregor,-all of whom wereeye-witnesses of the event. The explanation evi-dentiy is that he was determined to remove every

The Gowrie Conspiracy, continued from pqge 2lperson who would, or could, give evidence inGowrie's favour, and the testimony of these threemen was not only of the highest importance butwould have settled the guilt or innocence of theKing.

The event, as might be expected, created animpression over Scotlandwhich was appalling andan inspection of the correspondence ofthe periodteveals one conspicuous point, and that is that notone ofthe recorded lefiers condemns Gowrie.

It must be kept in vieW that, as the King wasinvolved in this matter, noone was safe to writemuch about it unless theytook his part Nicolson'sletters are noticeable; theyare with one exceptionaddressed to Sir RobefiCeci1, Elizabeth's PrimeMinister, and strangethough it may seem, wehave not been able to dis-cover any of Cecil's re-p1ies. Nicolson wasElizabeth's envoy in Scot-land, and, unlike some ofhis predecessors, he was aman of integrity and highprinciple.

Every word that hehas written about this con-spiracy may be accepted.In his estimation, the gen-

eral opinion was that itwas a conspiracy of the King to slay the Gowries.His letter of August 11 to Sir Robert Cecil is ofgreat importance. He was compelled to send theKing's version of the deed to England because"the King caused it to be written." In his positionhe had no altemative but he goes on to tell Cecilthat there are great doubts ofthe truth ofthe King'sreport and that these dbubts are greatly increasing.

"Unless the King bring the conspirators to thescaffold, the people will form dangerous opinionsabout him; they will believe him guilty ard Gowrie

innocent."But the most serious charge in this letter is

that the reports ofthe conspiracy coming ftom theKing differ. This is probably the strongest pointrecorded against the King, a point from which hecannot escape.

An irurocent mal could only have given oneversion and, whatever the King's intentions were,we fear he must stand convicted in the eyes ofpos-terity. Nicolson is careful and guarded in his lan-guage about tle King. He tells us that Alexander

Ruthven wore on the oc-casion a silk cut doubletwithout armour; whetherwith or without weapon hedoes not seem to know.Gowrie himself, he al-leges, was without arms,save two rapiers, which hehad to borrow.

Nicolson's referenceto the attitude ofthe clergyis very cautiously put; but,reading between the lines,these were not at all con-vinced ofthe bona fides ofthe King's narrative. Andin view of the Ruthvensbeing both defenseless,this is a strong argumentin their favour.

But Nicolson, thoughhe makes no comment,makes it clear to Cecil

what he means.

"The matter is believed to be otherwise thanthe King reporls it: all parts ofthe country so faras I can leam, are in great suspicion at the King'sattitude. It would appear.that, before the con-spilacy a Convention of some impofiance \ as sum-moned by the King, at which he made a demandfor money for his honourably entering on theCrown ofEnglaad after Elizabeth, and in order to

The Earl of Gowrie made a speech about theextravagant proposal of the King, expressing hisstrong dissatisfaction with it, at which the Kingfell into a rage and dismissed the Convention.

The King made his position more ludicrousby his desperate and persis-tent efforts to break the ob-stinacy ofBruce, one oftheministers of Edinburgh,and those who stood byhim. Bruce refused to thankGod for the King's deliver-ance, as he believedGowrie to be imocent

Then came this scene.

The King asked Bruce:"Now are ye yet per-suaded? Ye have heard me,ye have heard my minis-ters, ye have heard myCouncil, ye have heard theEarl of Mar, touching thereport of this treason : areye yet firlly persuaded ornot?"

The Backyard RebellionScottish Festival

in Lebanon, Tennessee

August 1",2020 - In spite ofthe Covid situ-ation that has forced the cancelation of so manygames and festivals this year, a.group ofrebel-lious athletes descended upon the small town ofLebanon, Tennessee just East ofNashville. Therewere more than 60 men and women competingin 7 different divisions.

Although this was labeled as a "Festival" dueto the need for keeping safe distance it was a sanc-tioned games only consisting of the athletes,judges and their family members.

Luckily the Highland Games are structured so

that maintaining a safe distance isn't very difficult.In that group of Rebels were 2 brothers com-

peting and representing Clan Henderson. TheOwens brothers Eric and Scott who proudly rep-resented Clan Henderson in a group of Men'sMasters that included the likes of TrevorMcMurray and Pro Master Braidy Miller who,despite the rain that day, set a new World Recordin sheaf for men 50yrs and up of 35' 6". (Theheight and bag weight were verified by 2judges and recorded on the NASGA database)

This was Eric's second competition andScott's first.

New Zealand Manuka honey has long beenheld up as a powerful natural antibiotic with heal-ing properties but it seems it's facing competitionfrom bees in Scotland.

According to new research, Scottish heatherhoney is even more effective for treating infectionsthan its New Zealand-based cousin Manuka.

The honey from the Inverness area effectivelykills the strains of bacteria that cause MRSA andthree other types of bacteria, the GlasgowUniversity's School ofVeterinary Medicine found.

Dr. Patrick Pollock, an equine surgeon whoconducted the research, said the new findings sug-gest that now the honey could be used for treatinghumans and animals.

Up until now, the most lamous honey usedfor medical purposes was Mannka honey from New

In future, it may be possible to identifii hon-eys with activity against specific bacteria. Thiswould allow a clinician to select the most appro-priate honey tlpe for a specific infection.

Researchers tested 11 kinds of honey andfound that eight were effective against all the bac-teria at concentrations ranging from two per centto six per cent.

But heather honey from the Invemess area wasshown to be particularly effective - killing MRSAmicrobes and three other types ofbacteria at con-centrations of two pe1 cent.

to replace the emptiness in our heafts. Recently, I have competed in the Hebridean challenge online inAustrailia. It consisted of a Scottish Dance World Wide celebration broken up between 7 World WideRegions. Points are given to each region based on each dancers submission.

I am happy to report that I was 3 of20 USA online submissions for this choreography challenge.The USA had chosen intricate steps for the F1ing, Swords, Sean I and Reel Choreo. They were mostfinr as well as challenging. I would like to share my submission videos with you via YouTube. Pleaseenj oy the three Choreo dances i was able to participate in wi-th this challenge.

On aaother note.....I am still awaiting my scheduled day and time with the Scottish Adjudicatorsregarding my members exam. However, I am assured that it will be officially scheduled within the nextfew weeks. I will look forward to sharing that experience with all of you as well as my exam resultswhen they are processed.
