PRELIMINARY

1.(1)ThisActmaybecalledtheProfessorJayashankar TelanganaStateAgriculturalUniversityAct,1963

(n) “Teacher”includesaprofessor,andAssociateProfessor,anAssistantProfessor,reader,lecturerorotherpersonappointedorrecognizedbytheUniversityforthepurposeofimpartinginstructionorconductingand guiding researchorextensionprogrammes,andanypersondeclaredbythestatutestobeateacher;

(o) “University” means Professor Jayashankar TelanganaStateAgriculturalUniversityconstitutedunderSection3

(p) “University College” means a college established ormaintained by the University and providing courses ofstudy qualifying students for admission to the Universityexaminationsinaccordancewiththeregulations.

CHAPTER –II

THE UNIVERSITY

The University 3.(1)Thereshallbeconstitutedin,andfor,theStateofTelanganaa University by the name of the Professor JayashankarTelanganaStateAgriculturalUniversitywhichshallconsistofaChancellor,aVice-Chancellor,aBoardofManagementandanAcademicCouncil.

(2)TheUniversityshallbeabodycorporatehavingperpetualsuccessionandacommonsealandshallsueandbesuedbysaidname.

(3) Inall suitsandother legalproceedingsbyoragainst theUniversity, thepleadings shallbe signedandveriiedby theRegistrarandallprocessesinsuchsuitsandproceedingsshallbeissuedto,andservedon,him.

(4)TheheadquartersoftheUniversityshallbeatRajendranagarintheHyderabaddistrictanditmayextendtoanyplacewithinacontiguousareaofivemilesaroundit.

ObjectivesoftheUniversity

4.TheobjectsoftheUniversity,amongothers,shallbemakeprovisionfor theeducationmainlyof theruralpeopleof theState of Telangana in agriculture and to promote research,ieldandextensionprogrammesinagricultureandagriculturalproduction.

Universityopentoallpersons

5.TheUniversityshall,subjecttotheprovisionsofthisActand the Statutes, be open to all persons; but nothing in thissectionshallbedeemedtorequiretheUniversitytoadmittoanycourseofstudyalargernumberofstudentsthanmaybeprescribed;

Provided that the Government may reserve seats incollegesundertheUniversityformembersofthesociallyandeducationallyBackwardClasses,theScheduledCastesandtheScheduledTribesinaccordancewithsuchprinciplesasmay,from time to time, bedeterminedby thegovernment in thisbehalf.

PowersandfunctionsoftheUniversity

6. The University shall have the following powers andfunctions,namely:

(a) to provide for instruction, training and research inagriculture.

(b) toprovidefortheadvancementanddisseminationofknowledgeintheieldandextensionprogrammesinagriculture;

(c) toinstitutecoursesofstudyandtoholdexaminationsfor,andtoconferdegrees,diplomasandotheracademicdistinctionsonpersonswhohavepursuedacourseofstudyorcarriedonresearchintheUniversityorinaninstitutionrecognizedinthisbehalfbytheUniversity,asmaybeprescribed;

(d) to confer honorary degrees or other academicdistinctions,asmaybeprescribed;

(e) to create teaching, research and extension postsrequired by the University and to appoint qualiiedpersonstosuchposts:

(f) toinstituteandawardfellowshipsincludingtravellingfellowships,scholarships,studentshipsandprizesinaccordancewiththestatutes

(g) to acquire, hold and dispose of property, and tocontractand todoallother thingsnecessary for,orincidentalto,thepurposesoftheUniversity;

(h) to take over and maintain colleges relating toagricultureandhostelstherefor;

(i) toborrowmoneyfromtheGovernmentofIndia,anyStateGovernmentoranyotheragency;

(j) toestablishandmaintaintheUniversitycollegesandhostelstherefor;

(k) toix,demandandreceivesuchfeesandotherchargesasmaybeprescribed;

(l) to provide such lectures and instructions for andto grant such diplomas to, ield workers, and otherpersons,astheUniversitymaydetermine;

(m) to regulate the conduct of students to maintaindisciplineamongthemandtomakearrangementsforpromotingtheirhealthandwelfare;

(n) to create administrative, ministerial and othernecessarypostsandtomakeappointmentsthereto;

(o) tocooperatewithotherUniversitiesandauthoritiesinsuchmannerandforsuchpurposes,astheUniversitymaydetermine;and

(p) todoallsuchactsandthings,asmaybenecessaryforthefurtheranceoftheobjectsoftheUniversity.

Residence 7.Everystudentshallresideinahostel,orundersuchconditions,aremaybeprescribed.

Visitation 8. (1) The Government shall have the right to cause aninspection to be made by such person or authority, as theymaydirect,of theaffairsandpropertiesof theUniversityoranycollegeorinstitutionmaintainedbytheUniversity,andtocauseaninquirytobemadeinrespectofanymatterconnectedtherewith.

(2)Beforecausingsuchaninspectionorinquiry,intimationthereofshallbegiventotheUniversity,whichshallbeentitledtohaveitsnomineeornomineesatsuchinspectionorinquiryandtomakerepresentationsinregardthereto.

(3)TheGovernmentshallforwardtotheBoardacopyofthereportofinspectionorinquiryforexpressingitsviewsandonreceiptthereof,theymaytendersuchadviceorgivesuchdirection,astheymayconsidernecessary,andixatimelimitforactiontobetakenbytheBoardinthatregard.TheBoardshall,withinthetimesoixed,takenecessaryactionandreportthefacttotheGovernment.

Chapter III

OFFICERS OF THE UNIVERSITY

OficersoftheUniversity

9.ThefollowingshallbetheoficersoftheUniversitynamely;

(i)TheChancellor;

(ii)TheVice–Chancellor;

(iii)TheRegistrar;

(iv)TheComptroller;

(v)TheDeanofStudentAffairs;

(vi)TheDeansofthevariousFaculties;

(vii)TheDirectorofAgriculturalExperimentStations;

(viii)TheDirectorofExtension;and

(ix)SuchotherpersonsintheserviceoftheUniversityasmaybeprescribed.

TheChancellor 10.TheGovernorofTelanganashallbetheChancelloroftheUniversity.Heshall,byvirtueofhisofice,betheheadoftheUniversity,andshall,whenpresent,presideatanyconvocationoftheUniversity.HeshallexercisesuchotherpowersasmaybeconferredonhimbyorunderthisAct.

TheVice-Chancellor

11.(1)TheVice-ChancellorshallbeawholetimeoficerandshallbeappointedbytheChancellor.Heshallbepaidasalaryof three thousands rupeespermensemasmaybeprescribedinclusiveofpension,ifany.

(2)TheVice-Chancellorshallholdoficeforatermofthreeyears and shall be eligible for reappointment for another termofthreeyears.

(3)TheconditionsofserviceotherthantheemolumentsoftheVice-Chancellorshallbesuchasmaybeprescribedandshallnotbevariedtohisdisadvantageafterhisappointment.

(4) TheVice-Chancellormay,bywritingunderhishandaddressedtotheChancellor,resignhisofice.TheresignationshallbedeliveredtotheChancellorordinarilysixtydayspriortothedateonwhichtheVice-Chancellorwishestoberelievedofhisofice,buttheChancellormayrelievehimearlier.Theresignationshalltakeeffectfromthedateofrelief.

(5) In the temporary absenceof theVice-Chancellor onleave,forwhateverreason,oruntilthevacancycausedinanyothermannerisilled,theChancellorshallappointanypersontemporarilytoactasVice-Chancellor.

(6)WherethepostoftheVice-Chancellorfallspermanentlyvacanteitherby resignation orotherwise, thevacancyshallbeilledbytheChancellorinaccordancewiththeprovisionsofsub-section(1)andtheVice-Chancellorsoappointedshallholdoficeforafulltermofthreeyears.

(7)If,intheopinionoftheChancellor,theVice-Chancellorwillfullyomitsor refused to carryout theprovisionsof thisAct or abuses the powers vested in himand if it appears tothe Chancellor that the continuance of the Vice-Chancellorinofice isdetrimental to the interestsof theUniversity, theChancellormay,byorder,removetheVice-Chancellor,aftergivinghimanopportunityofshowingcauseagainsttheactionproposedtobetakeninregardtohim

PowersanddutiesoftheVice-Chancellor

12.(1)TheVice-Chancellor shall be the academichead andprincipalexecutiveoficerof theUniversityandshall, in theabsenceof theChancellor,presideatanyconvocationof theUniversity.

(2) It shallbe thedutyof theVice-Chancellor toensure thefaithfulobservanceoftheprovisionsofthisActandtheStatutesandhemayexerciseallpowersnecessaryforthispurpose.

(3) The Vice-Chancellor shall have power to convene themeetingsoftheAcademicCouncil.

(4) TheVice-Chancellor shall exercise general control overtheUniversityanditsaffairsandshallberesponsiblefortheduemaintenanceofdisciplineintheUniversity.

(5)TheVice-ChancellorshallberesponsibleforthepresentationofthebudgetandthestatementofaccountstotheBoard.

(6)SubjecttothecontroloftheChancellor,inanyemergency,which in the opinion of the Vice-Chancellor, requires,immediateactiontobetaken,heshalltakesuchactionashedeemsnecessary,andshallattheearliestopportunityintimatethe action taken to the oficer, authority or other body whoor which in the ordinary course would have dealt with thematter.

(7)WhereanyactiontakenbytheVice-Chancellorundersub-section(6)affectsanypersoninserviceoftheUniversitytohisdisadvantage,suchpersonmaypreferanappealtotheBoardwithin thirty days from the date on which such person hasnoticeoftheactiontaken.

(8)TheVice-Chancellorshallgiveeffect to thedecisionsoftheauthoritiesoftheUniversitytakeninaccordancewiththepowersconferredbyorunderthisAct.

(9) The Vice-Chancellor shall be responsible for a closecoordination and integration of teaching, research, andextension.

(10)TheVice-Chancellorshallexercisesuchotherpowersasmaybeprescribed

The Registrar 13.(1)TheRegistrarshallbeawhole-timeoficerandshallbeappointedbytheBoardinthemannerprescribed.

(2)ThesalaryandallowancespayabletotheRegistrarandtheconditionsofserviceshallbesuchasmaybeprescribed;

Provided that theconditionsofserviceof theRegistrarshallnotbevariedtohisdisadvantageafterhisappointment.

(3)TheRegistrarshallberesponsiblefortheduecustodyoftherecordsandthecommonsealoftheUniversity.Heshallbeex-oficioSecretaryoftheBoardandoftheAcademicCouncil,andshallbeboundtoplacebeforeitallsuchinformationasmaybenecessaryforthetransactionofitsbusiness.Heshallreceive applications for entrance to theUniversity and shallkeep a permanent record of all courses, curricula and otherinformationasmaybenecessary.

(4)TheRegistrarmay,bywritingunderhishandaddressedtotheBoard,resignhisofice.TheresignationshallbedeliveredtotheBoardordinarilysixtydayspriortothedateonwhichtheRegistrarwishestoberelievedofhisofice,buttheBoardmayrelievehimearlier.Theresignationshalltakeeffectfromthedateofrelief.

(5) In the temporary absence of the Registrar on leave, forwhatever reason, or until the vacancy caused in any othermannerisilled,theVice-Chancellorshallappointanypersontemporarilyforaperiodnotexceedingthreemonths,toactastheRegistrar.

(6) The Registrar shall be responsible for the conduct ofthe examinations and for the due execution of all processesconnectedtherewith.

(7)TheRegistrarshalldischargesuchotherdutiesandperformsuchother functionsasmaybeprescribedor required, fromtimetotime,bytheBoardortheVice-Chancellor.

TheComptroller 14.(1)TheComptrollershallbeawhole-timeoficerandshallbeappointedbytheBoardinthemannerprescribed.

(2) He shall be paid such salary and allowances as mayprescribed.

(3) The provisions relating to conditions of service otherthanemoluments, resignation,illingof temporaryvacanciescontained in sub-sections (3), (4)and (5)of section11shallapplytotheoficeoftheComptrollersubjecttothevariationthatfortheexpressions“Vice-Chancellor”and“Chancellor”theexpressions“Comptroller”and“Board”shallrespectivelybesubstituted.

(4) The Comptroller shall manage the property and theinvestmentsof theUniversityand tenderadvice in regard toitsinancialpolicy.HeshallberesponsibleforthepreparationofthebudgetandstatementofaccountsforpresentationtotheVice-Chancellor.

(5)TheComptrollershallberesponsibleforensuringthatnoexpenditurenotdulyauthorizedisincurredbytheUniversityotherwise thanbywayof investmentandshalldisallowanyexpenditurewhichmaycontravenethetermsofanystatuteorforwhichprovisionisrequiredtobemadebythestatutesbuthasnotbeenmade.

PowersanddutiesoftheRegistrarandtheComptrollerexercisablebyasingleperson

15. TheBoardmaydirect that thepowersanddutiesof theRegistrarandtheComptrollershallbeexercisedandperformedbyasinglepersonforsuchperiodasitdeemsit.

DeanofStudentAffairs

16.(1) The Dean of Student Affairs shall be a whole-timeOficer and shall be appointed by the Board in the mannerprescribed.

(2)ThesalaryandallowancespayabletotheDeanofStudentAffairsshallbeasprescribed.

(3) The Dean of StudentAffairs shall have the followingduties,namely;

(a)tomakearrangementsforthehousingofstudents;

(b)toarrangeaprogrammeofstudentcounseling;

(c) toarrange for theemploymentof students inaccordancewiththeplansapprovedbytheVice-Chancellor;

(d)tosupervisetheextra-curricularactivitiesandtolookaftertheneedsofstudents;

(e)toassistintheplacementofgraduatesoftheUniversity.

(f) to organize and maintain contact with the alumni of theUniversity.

17.Nooficershallacceptanyremunerationfromanysourceotherthantheremunerationtowhichheisentitledunderthestatutes.

CHAPTER-IV

AUTHORITIES OF THE UNIVERSITY

AuthoritiesoftheUniversity

18.ThefollowingshallbetheAuthoritiesoftheUniversity,namely;

(i)theBoardofManagement,

(ii)theAcademicCouncil,

(iii)theBoardsofFaculties,and

(iv)suchotherbodiesasmaybeprescribed.

19.(1)TheChancellorshall,assoonasmaybeaftertheirstVice-Chancellorisappointedundersub-section(1)ofsection11,takeactiontoconstitutetheBoard.

(j) One person nominated by theChancellorfrom amongst the members of the StateChamberofPanchayatRaj

(k) TwopersonsnominatedbytheChancellorfrom among the Agro Industrialistsand other entrepreneurs, including selfemployedgraduates.

(3) The Vice-Chancellor shall be ex-oficio Chairman ofthe Board, and shall conduct the meetings of the Board inaccordancewiththestatutesmadeinthatbehalf.

(4)ThetermofoficeofmembersoftheBoardotherthanex-oficiomembersshallbethreeyears.

ProvidedthatnomemberoftheBoardwhoisnominatedshallcontinuetobeamemberoftheBoardonhisceasingtohold theoficebyvirtueofwhichhehasbeennominatedasmemberoftheBoard.

Providedfurther thatevenifsomeof themembersarenominatedatdifferenttimestotheBoardunderitems(e)to(k)ofsub-section(2),thetermofthreeyearsintheircaseshallbereckonedfromthedateonwhichthenotiicationconstitutingtheBoardwasirstissued.

(5)ThemembersoftheBoardshallbeentitledtoreceivesuchdailyandtravelingallowancesasmaybeprescribedbutnottoanyremuneration.

PowersandfunctionoftheBoard

20.(1) The Board shall exercise and perform the followingpowersandfunctions,namely:

(a) toapprove thebudgetof theUniversitypresentedby theVice-Chancellor:

(b) to appoint the teachers of theUniversity and such otheremployees of the University as may be prescribed on therecommendationoftheselectioncommitteeconstitutedundersection32;

Provided that theBoardmay inviteanypersonofhighacademic distinction and professional attainments to acceptapostofprofessor in theUniversityandappointhimtothatpost.

(c) to acquire any property for the University and hold ordisposeofitsproperties.

(d)toacceptanypropertyonbehalfoftheUniversity.

(e)toprovidefortheadministrationofanyfundsplacedatthedisposaloftheUniversityforthepurposesintended.

(f)toarrangefortheinvestmentandwithdrawalofmoneyoftheUniversity.

(g) to direct the form and use of the common seal of theUniversity.

(h)toappointsuchcommittees,eitherstandingortemporary,astheBoardmayconsidernecessary.

(i)todetermineandregulateallpoliciesrelatingtotheaffairsoftheUniversityinaccordancewiththisActandtheStatutes.

(2)TheBoardshallmeetatsuchtimeandplaceasitdeemsnecessarybutitshallholdameetingatleastonceineverytwomonths,andnotlessthanhalfofthenumberofitsmeetingsinayearshallbeheldattheheadquartersoftheUniversity.

(3)TheBoardmay, forpurposesof consultation, invite anyperson having practical experience or special knowledge ofanysubjectunderitsconsiderationtoattenditsmeeting.Suchpersonshallhaverighttospeakin,andotherwisetotakepartintheproceedingsofsuchmeeting,butshallnotbyvirtueofthissub-section,beentitledtovoteanysuchmeeting.Apersonattendinganysuchmeetingshallbeentitledtosuchallowancesasmaybeprescribed.

TheAcademicCouncil

21.(1)TheAcademicCouncilshallconsistofthefollowingmembersnamely:-

(a)theVice-ChancelloroftheUniversity;

(b)theVice-ChancelloroftheAndhraUniversity,theOsmaniaUniversityandSriVenkateswaraUniversity;

(c)theDirectorofAgriculture;

(d)theDirectorofAnimalHusbandry;

(e)theDirectorofAgriculturalExperimentStations;

(f)theDirectorofExtension;

(ff)theDeanoftheIndianVeterinaryResearchInstitute.

(g)theDeansofthevariousFaculties;

(h)theDeanofStudentAffairs;

(i)theHeadsofDepartmentsofthevariousFaculties;

(j)theProfessorsoftheUniversity;and

(k)thePrincipalsoftheUniversitycolleges;

(l)twomembersoftheBoardreferredtoinclauses(e)and(f)ofsub-section(2)ofsection19;

(m)fourpersonsnominatedbytheVice-Chancellorofwhomtwoshallbefromamongsttheteachersforsuchperiodasmaybeprescribed.

(2)TheAcademicCouncilmayco-optasmembersnotmorethantenpersons,forsuchperiodandinsuchmanner,asmaybeprescribedsoastosecureadequaterepresentationofdifferentaspectsofagriculture.

(3)TheVice-Chancellorshallbeex-oficioChairmanoftheAcademicCouncil.

Powers,functionsanddutiesoftheAcademicCouncil

22.(1)TheAcademicCouncilshallbeinchargeoftheacademicaffairsoftheUniversityandshall,subjecttotheprovisionsofthisActandtheStatutes,superintend,directandcontrol,andresponsible for, the maintenance of standards of instruction,educationandexaminationsandothermattersconnectedwiththeobtainingofdegreesandshallexercisesuchotherpowers,performsuchotherfunctionsanddischargesuchotherdutiesasmaybelaiddownbyorunderthisAct.

(2)Inparticularandwithoutprejudicetothegeneralityoftheforegoingpower,theAcademicCouncilshallbeentitledto:

(a)advisetheViceChancellorandtheBoardonallacademicmattersincludingthecontrolandmanagementofthelibraries;

(b)makerecommendationstotheBoard–

(i) for the institution of the professorships,associate professorships, assistant professorships,teachershipsandother teachingpostsandmattersconnectedtherewith;(ii)regardingthepost-graduateteaching,researchandextension;

(c)formulate,modify,reviseorrescindschemesinconnectionwith the constitution or reconstitution of departments ofteaching,researchandextensionand

(d)makeregulations–

(i) regarding the admission of students to theUniversity;

(ii)regardingtheexaminationsandtheconditionsonwhichstudentsshallbeadmittedthereto;

(iii) relating to courses of study for degrees,diplomasandcertiicates.

Faculties 23.(1)TheUniversityshallincludetheFacultiesofAgriculture,VeterinaryScience,HomeScienceandsuchotherFacultiesasmaybeprescribed.

(2)Each faculty shall comprise suchdepartmentswith suchassignmentofsubjectsofstudyasmaybeprescribed

(3)ThereshallbeaBoardofeachFaculty,theconstitutionandpowersofwhichshallbeprescribed.

(4) There shall be a Dean for each Faculty who shall beappointed in such manner and for such period, as may beprescribed.

(5)TheDeanshallbetheChairmanoftheBoardoftheFacultyandberesponsiblefor thefaithfulobservanceof thestatutesandregulationsrelatingtotheFacultyandfortheorganizationandconductof the teaching,researchandextensionworkofthedepartmentscomprisedtherein.

(6) Each department shall have a head whose appointment,powers and duties shall be as prescribed, and who shall beresponsibletotheDeanfortheproperorganizationandworkingofthedepartment.

ConstitutionofCommittees

24.EveryAuthorityshallhavepowertoappointcommitteeswhichmay,unlessotherwiseprovided in thisAct,consistofthemembersoftheAuthorityandsuchotherpersonsasitmaythinkit.

FillingofCasualVacancies

25.Anycasualvacancyamongthemembers,otherthanex-oficiomembers, of anyAuthority shall beilled as soon asconvenientlymaybebytheperson,orAuthoritywhoappointedelected;nominatedorco-optedthememberwhoseplacehasbecomevacantandthepersonappointed,electedorco-optedtoacasualvacancyshallbeamemberofsuchAuthorityfortheresidueofthetermforwhichthepersonwhoseplaceheillswouldhavebeenamember.

RemovalfrommembershipofanAuthority

26.TheBoardshallremoveanypersonfrommembershipofanyAuthorityonthegroundthatsuchpersonwasconvictedofanoffenceinvolvingmoralturpitude

Decisiononquestionastovalidityofmembership,actorproceeding

27.Whereanyquestionariseswhetherapersonhasbeendulyelectedor appointed as, or is entitled to be amemberof anAuthorityotherthantheBoardorwhetheranyactorproceedingofanAuthorityincludingtheBoardisconsistentwiththisActand thestatutes, it shallbereferred to theChancellorwhosedecisionthereonshallbeinal.

ActorproceedingofanAuthoritynottobeinvalidatedbyreasononlyofcertaindefects

28. No act or proceeding of an authority shall be deemedinvalidbyreasononly,ofanydefectintheconstitutionofsuchAuthority,oftheexistenceofanyvacancyamongitsmembersoroftheinvalidityoftheelectionofanyofitsmembers.

CHAPTER – V

RESEARCH AND EXTENSION

AgriculturalExperimentStations

29.(1)TheUniversitymayestablishandmaintainoneormoreAgriculturalExperimentStationsforresearch,bothfundamentalandappliedinallFaculties,inadditiontothemaintenanceofinstitutions which stand transferred to the University undersub-section(8)ofsection(43).TheBoardshallappointinthemannerprescribed,apersonwhohadtraininginagricultureastheDirectorofAgriculturalExperimentStation.TheDirectorshallinitiate,guideandcoordinateallagriculturalresearchandberesponsiblefortheeficientworkingofsuchstations.

(2)TheUniversitymay,atanytime,withtheapprovaloftheGovernment close down, either permanently or temporarily,anyof theAgriculturalExperimentStation speciied in sub-section(1)

AgricultureandHomeScienceExtensionservice

30.(1)TheUniversityshallestablishinAgriculturalandHomeScienceExtensionServiceforthepurposesof-

(a)undertakingextensionprogrammesonaphasedprogrammecoveringtheentireStateofTelanganainsuchmannerasmaybedeterminedbytheGovernmentinconsultationwithBoard.

(b) dissemination of information for solution of problemsrelatingtoagricultureanddomesticields.

(c)establishmentofyouthclubsfordevelopingtheinterestsofyoungpeopleinagriculture,and

(d)suchotherpurposesasmaybeprescribed.

(2)TheBoardshallappointinthemannerprescribedapersonwhohadtraininginAgricultureasDirectorofAgriculturalandHomeScienceExtensionService.Heshallberesponsiblefordisseminationofsuchinformationandplanningandexecutionofaprogrammeofextensionworkbasedupontheresultsofresearch.

CoordinationinResearchandextensionwork

31. The Government shall endeavour to secure propercoordinationbetweenthedepartmentsoftheGovernmentandtheUniversityintheconductofresearchandextensionworkandmaytendernecessaryadvicetotheBoardinthatregard.

CHAPTER –VI

APPOINTMENTSOFTEACHERS,ETC.

ConstitutionofaselectioncommitteeforappointmentofOficersandteachersofaFaculty

32.(1)TheBoardshallconstituteaselectioncommitteeinregardtotheappointmentofteachersforeachFacultywhichshallconsistofthefollowingnamely:-

(i) the Vice-Chancellor who shall be ex-oficioChairmanofthecommittee;

(ii)theDeanoftheFacultyconcerned;

(iii) three experts in the case of selection ofProfessors, twoexperts in thecaseof selectionofAssociate Professors and one expert in the caseof selection of Assistant Professor, the expertsbeing from outside the University, having specialknowledgeofthesubjectsoftheDepartmentintheFaculty. The experts are to be nominated by theBoard.

(2)TheteachersofaFacultyshallbeappointedbytheBoardon the recommendation of the Selection Committee of thatFacultyandtheirremunerationandotherconditionsofserviceshallbesuchasmaybeprescribed.

Constitutionofpension,insuranceorprovidentfund

33.(1) The University shall constitute, for the beneit of itsoficers, teachers, clerical staff and other employees in suchmannerandsubjecttosuchconditionsasmaybeprescribed,such pension, insurance and provident fund as it may deemit.

(2)Whereanysuchpension,insuranceorprovidentfundhasbeen so constituted by the university, the Government maydeclare that theprovisionsof theProvidentFundsAct,1925shallapplytosuchfundsasifitwereaGovernmentProvidentFund.

ProvidedthattheUniversityshallhavepowerinconsultationwith the Finance Committee, to invest the Provident Fundamountinsuchmannerasitmaydetermine

TribunalofArbitrationfordisputesbetweentheUniversityandits staff

34.AnydisputearisingoutofacontractbetweentheUniversityandanyoficerorteacheroftheUniversityshall,ontherequestof the oficer or teacher concerned or at the instance of theBoard, be referred to aTribunal ofArbitration consistingofonemembernominatedbytheBoard,onemembernominatedbytheoficerorteacherconcernedandanumpireappointedbytheChancellor.ThedecisionoftheTribunalshallbeinal.

CHAPTER VII

UNIVERSITYFUNDSETC.,.Generalandotherfunds

35.(1)Theincomefromfeesrealizedby,anycontributionandendowmentreceivedby,andallgrantsmadeto,theUniversity,shallformonegeneralfundtobecalledthe“GeneralFundoftheUniversity”andallmoneysorealizedandreceivedshallbecreditedtoit.

(2) The University may have such other funds and shallmaintain such accounts in respect of every fund as may beprescribed.

Borrowingofmoney

35 (A). The University may accept moneys from theGovernment of India, the State Government, the UniversityGrantsCommissionandalsoborrowmoneyfromaBankoraCorporationforthepurposesoftheUniversity;

ProvidedthatwheretheUniversityintendstoborrowmoneyfromaBankoraCorporationorBothexceedinganamountofiftythousandrupeesatatimeorintheaggregate,itshallobtainthepriorwrittenapprovaloftheGovernmentthereof.

Certainrestrictioninrespectofinancialmatters

35(B).TheUniversityshallnotdivertearmarkedfundsorotherpurposes,orrevisethescalesofpayofitsstafforimplementany schemewhich involves anymatching contribution fromtheGovernmentorwhichimposesarecurringliabilityontheGovernmentaftertheassistancefromthesponsoringauthorityceaseswithoutthepriorwrittenapprovaloftheGovernment.

Provided that the Finance Committee may authorizethecreationandillingupofpostsofteachersforaperiodnotexceedingoneyear,butanysuchpostshallnotbecontinuedorcreatedafreshforanyperiodbeyondthesaidperiodofoneyearwithoutthepriorwrittenapprovaloftheGovernment.

FinanceCommittee

36.(1)TheBoardshallconstituteaFinanceCommitteeconsistingofthefollowingpersons,namely:-

(a)theVice-Chancellor

(b)theComptroller

(c)TwomemberschosenbytheBoardfromamongitsmembers.

(2)Theinancecommitteeshallhavethefollowingpowersandduties,namely:

(a)toexaminetheaccountsoftheUniversityanditsannualbudgetestimatesandtoadvisetheBoardinrespectthereof;

(b)toreviewtheinancialpositionoftheUniversityfromtimetotime;and(c) tomake recommendations to theBoard on allproposals involving expenditure, for which noprovisionorinadequateprovisionhasbeenmadeinthebudget,orinexcessofthebudgetprovision.

AccountsandAudit

37.(1)TheannualaccountsshallbesubmittedbytheBoardtotheGovernmentwhoshallcauseanaudittobemadebysuchpersonsastheGovernmentmayappointinthisbehalf.

(2) The accounts when audited shall be printed and copiesthereofshall, togetherwith thecopiesof theaudit report,besubmittedbytheBoardtotheGovernmentwithitscomments.TheGovernmentshallcausetheauditreporttogetherwiththecommentsof theBoard tobe laidbefore eachHouseof theStateLegislature.

CHAPTER VIII

STATUTES AND REGULATIONS

Statute 38. Subject to the provisions of thisAct, the statutes mayprovideforalloranyofthefollowingmatters,namely:-

(a) the constitution, powers and duties of theAuthorities;

(b) the powers, functions, duties and conditions ofserviceoftheoficersotherthantheChancellor;

(c) themethodsofselectioninrespectoftheAuthoritiesandthemannerofresolvingthedisputesinrespectthereof;

(d) the procedure at meetings of such authoritiesincludingthequorumforthetransactionofbusinessbythem;

(e) thedesignation,mannerofappointment,powersanddutiesoftheoficers;

(f) the classiication and manner of appointment ofteachers;

(g) the holding of convocations to confer degrees anddiplomas;

(h) the conferment of honorary degrees and academicdistinctions;

(i) the establishment, amalgamation, sub-division andabolitionoffaculties;

(j) theestablishmentofdepartmentsofteachinginthefaculties;

(k) theestablishmentandabolitionofhostelsmaintainedbytheUniversity;

(l) the institution of fellowships, scholarships,studentships, bursaries, medals and prizes and theconditionsofawardthereof;

(m) the conditions of registration of graduates and themaintenanceofregisterthereof;

(n) theentranceoradmissionofstudentstotheUniversityandtheirenrollmentandcontinuanceassuch;

(o) thecoursesofstudytobelaiddownforalldegreesanddiplomasoftheUniversity;

(p) theconditionsunderwhichstudentsshallbeadmittedto the degree, diplomaor other courses and to theexaminationsoftheuniversityandshallbeeligiblefortheawardofdegreesanddiplomas;

(q) the conditions of residence of the students of theuniversityandlevyingoffeesforresidenceinhostelsmaintainedbytheUniversity;

(r) the fees which may be charged by the Universityconnectedtherewith;

(s) the conditions and mode of appointment and thedutiesofexaminingbodiesandexaminers;

(t) theconductofexaminations;

(u) the conditions of service, remuneration andallowances,includingtravelinganddailyallowances,to be paid to oficers, teachers and other personsemployedundertheuniversityand

(v) allothermattersnecessaryforcarryingoutalloranyofthepurposesoftheAct.

Statuteshowmade 39.(1) TheFirstStatuteswith regard tomatterssetout inclauses(a)to(m)ofsection38shallbemadebytheGovernment.

(2) Subject to the prior approval of the Government,theBoardmay,fromtimetotime,makeanystatutein addition to the First Statutes referred to in sub-section(1),andmayamendorrepealanystatuteinthemannerhereinafterprovidedinthissection

(3) TheAcademic Council may propose to the BoardthedraftofanystatutetobemadebytheBoardandsuchdraftshallbeconsideredbytheBoardatitsnextmeeting;

ProvidedthattheAcademicCouncilshallnotproposethedraftofanysuchstatute,anyamendmentofastatuteorrepealofastatuteaffectingthestatute,powersorconstitutionofanyexistingauthorityuntilsuch Authority has been given an opportunity toexpressitsviewsonsuchproposalandanyviewssoexpressedshallbeconsideredbytheBoard.

(4) TheBoardmayconsideranysuchdraftasisreferredto insub-section (3)andmake thestatuteor rejectit or return it to the Academic Council for re-consideration,eitherinwholeorpart,togetherwithanyamendmentswhichitmaysuggest.

(5) Any member of the Board may propose to it thedraftofanystatute,any,amendmentofastatuteorrepealofastatuteandtheBoardmayeitheracceptorrejecttheproposalifitrelatestoamatternotfallingwithinthepurviewoftheAcademicCouncil.IncasesuchdraftrelatestoamatterwithinthepurviewoftheAcademic Council, the Board shall refer it forconsiderationtotheAcademicCouncil,whichmayeither report to theBoard that it does not approvethe proposal, which shall then be deemed to havebeen rejected by the Board, or forward such drafttotheBoardinsuchformastheAcademiccouncilmayapprove,andtheprovisionsofthissectionshallapply in the case of a draft so forwarded as theyapplyinthecaseofadraftproposedtotheBoardbytheAcademicCouncil.

(6) Everyirststatutemadeundersub-section(1)shallimmediatelyafteritismade,belaidbeforeeachHouseoftheStateLegislatureifitisinsessionandifitisnotinsessioninthesessionimmediatelyfollowing,foratotalperiodoffourteendayswhichmaybecomprisedinonesessionorintwosuccessivesessions,andif,before the expiration of the session in which it isso laid or the session immediately following, bothHouses agree in making any modiication in thestatuteorintheannulmentofthestatute,thestatuteshall thereafter have effect only in such modiiedformorshallstandannulled,asthecasemaybe;sohowever that any such modiication or annulmentshallbewithoutprejudicetothevalidityofanythingpreviouslydoneunderthestatute.

Regulations 40.(1) The Authorities may make regulations consistentwith thisAct and the Statutes for all or any othermatterswhichbythisActandtheStatutesaretobeprovided for by the regulations, and also for anyothermattersolelyconcerningsuchAuthoritiesandnotsoprovided.

(2) Every Authority shall make regulations providingfor the giving of notice to the members of suchAuthorityofthedatesofmeetingandofthebusinesstobeconsideredatmeetingsandforthekeepingofarecordoftheproceedingsofmeetings.

(3) The Board may direct the amendment, in suchmanner as it may specify, of any regulation madeunderthissectionortheannulmentofanyregulationmadethereunderbyanyauthority.

(4) TheAcademicCouncil,may,subjecttotheprovisionsofthestatutes,makeregulationsprovidingforcoursesof study for thevariousexaminations,degreesanddiplomas of the University after receiving draftsof such regulations from the Board of Facultyconcerned.

(5) TheAcademicCouncilshallnotamendadraftofaregulationreceivedfromtheBoardofaFacultybutmayrejectitorreturnittotheBoardoffacultyforreconsideration either in whole or in part togetherwithanyamendmentwhichitmaysuggest.

CHAPTER IX

MISCELLANEOUS

AnnualReport 41. TheAnnual Report of the University shall be preparedunder thedirectionof theVice-Chancellorandsubmittedbythe Board to the Government one month before the annualmeetingatwhichitistobeconsidered.

TemporaryappointmentofOficers

42.NotwithstandinganythinginthisAct,anduntilsuchtimeastheauthoritiesaredulyconstituted,theVice-Chancellormay,subject to the prior approval of the Chancellor, appoint anyoficer or constitute anyCommittee temporarily to exercise,performanddischargealloranyofthepowers,functionsanddutiesofsuchAuthoritiesunderAct.

PowersofgovernmenttotransfercertaincollegesandinstitutionstotheUniversity

43.(1) Notwithstanding anything contained in AcharyaN.G.Ranga Agricultural University Act, 1963,the Andhra Pradesh Universities Act, 1991, orthestatuesmade thereunder,all thecollegesandpolytechnics, and other research and extensioninstitutions located in Telangana State shalldevolvetoProfessorJayashankarTelanganaStateAgricultural University from the date notiied intheTelanganaGazetteby theGovernment in thisbehalf, be disafiliated fromAcharya N.G.RangaAgriculturalUniversityandshallbemaintainedbytheUniversityasconstituentColleges,polytechnicsandotherresearchandextensioninstitutions:

(2) The control and management of all the colleges,polytechnics and other research and extensioninstitutions speciied in sub-section (1) shall asfrom the date notiied by the government underthatsub-sectionstandtransferredtotheUniversityandallthepropertiesandassets,andliabilitiesandobligationsoftheAcharyaN.G.RangaAgriculturalUniversity and Government in relation theretoshallstandtransferredto,vestin,ordevolveupon,theuniversity.

(3) The compensation payable by the University toAcharya N.G.Ranga Agricultural University inrespectofthetransferandvestingofthepropertiesand assets, and the devolution of liabilitiesand obligations, under sub-section (2) shall besuch, as prescribed in the Andhra Pradesh StateReorganisationAct,2014(ActNo.6of2014)

(4) Notwithstanding anything contained in this Act,and subject to the provisions of sub-section (5),wherethecontrolandmanagementofanycollegehasbeen transferred to theUniversityunder sub-section(2),theUniversityshallemployallteachersand other employees as per the guidelines of theAndhra Pradesh State Reorganisation Act, 2014(ActNo.6of2014)

(5) Notwithstandinganythingcontainedinsub-section(4) every such teacher or other employee of thegovernment or Acharya N.G.Ranga AgriculturalUniversity, as the case may be, shall, withinsuch time as per the guidelines of A.P.StateReorganisationAct,2014(ActNo.6of2014)

(6) Notwithstandinganythinginsub-section(5)everysuchteacherorotheremployeewhohadexercisedhisoptionaspertheguidelinesofAndhraPradeshStateReorganisationAct,2014

(7) Notwithstanding anything contained in this Actor the statutes made thereunder, any student oftheconstituentcollege,whowasstudyingforanyexamination of Acharya N.G.Ranga AgriculturalUniversityshallbepermittedtocompletehiscoursein preparation therefore, and the University shallmake arrangements for holding for such studentsexaminationsforsuchperiodasmaybeprescribed,inaccordancewith thecurriculaofstudiesof theAcharyaN.G.RangaAgriculturalUniversity

(8) Thegovernment shall byorder direct that all theinstitutionsunder thecontrolandmanagementofthegovernmentconductingresearchinthesubjectof Agriculture, Home Science & AgriculturalEngineering Sciences shall be maintained by theUniversity,witheffectfromsuchdateordatesasmay be speciied in the orderwhich shall in anycasebebefore theexpirationof threeyears fromtheappointedday.Thecontrolandmanagementofsuchinstitutionsshall thereuponstandtransferredtotheUniversityandallthepropertiesandassetsandliabilitiesandobligations,ofthegovernmentinrelationtheretoshallstandtransferredto,vestin,ordevolveupon,theUniversity

44. TheBoardmaybystatutesmadeinthisbehalf,delegatetoanyoficerorauthorityof theUniversity anyof thepowersconferredon itbyorunder thisAct,tobeexercisedbysuchoficerorauthority,subjecttosuchrestrictionsandconditionsasmaybespeciiedinsuchstatutes.

NotwithstandinganythinginthePrincipalAct,

(a) the members of the Board and the Academic Council constituted andfunctioning before the commencement of thisAct, shall continued to be suchmembersandfunctiononlyuntilanewBoardorAcademicCouncil,asthecasemaybe,isreconstitutedinaccordancewiththeprovisionsofthePrincipalActasamendedbythisAct.

(b) onthereconstitutionofsuchnewBoardorAcademicCouncilinaccordancewiththeprovisionsofthePrincipalActasamendedbythisAct,themembersoftheBoardorAcademicCouncil,asthecasemaybe,holdingoficeimmediatelybeforesuchreconstitution,shallceasetobesuchmembers.

CHAPTER-I1. Deinitions:-(i)IntheseStatutesunlessthereisanythingrepugnantinthe

CHAPTER –II

OFFICERS OF THE UNIVERSITY

2. Oficers:-InadditiontotheOficersmentionedinSection9,thefollowingshallalsobetheoficersoftheUniversity,namely:

3.General:-Allappointmentsshallbemadestrictlyonthebasisofmerit.

4.MannerofappointmentofVice-Chancellor:-WheneveravacancyofVice-Chancelloristobeilled,theChancellorshallasktheBoardtosuggestaperson,whoinitsopinion,issuitableforappointmentasVice-ChancellorandhemayappointhimasVice-Chancellor:

ProvidedthatiftheChancellorconsidersthatthepersonsuggestedbytheBoardisnotsuitableforappointmentasVice-Chancellor,hemayasktheBoardtosuggestanotherperson:

Provided further that if the Chancellor considers that if the personsuggested second time by theBoard is also not suitable for appointment asVice-Chancellor,hemayappointanyperson,who,inhisopinion,issuitableforappointmentasVice-Chancellor.

5.MannerofappointmentoftheRegistrar,theComptroller,theEstateOficer,theDeanofStudentAffairs,theUniversityLibrarianandtheManageroftheUniversityPress:

The following procedure shall be adopted for the appointment of theRegistrarandtheComptrollerexceptfortheirsttime,theEstateOficer,theDeanofStudentAffairs, theUniversityLibrarianand theManagerof theUniversityPress.

1)Whenavacancyistobeilled,theBoardshallconstituteaSelectionCommitteeconsistingofthefollowing:-

a)TheVice-ChancellorasChairman:

b)OneMemberoftheBoardnominatedbytheBoardfromamongitsownMembers:

c)Oneoutsiderwhoisanexpertinthesubjectconcerningthepostforwhichrecruitmentistobemade;

Provided that if a prescribedmember/members is/arenot available forappoint to the Selection Committee, the Board may appointment any person/personsasasubstitute/substitutes.

The Registrar shall act as the Secretary of the Committee except in acasewhenhehimselfisacandidate.Inthatcase,theBoardshallappointanotheroficeroftheUniversitytoactasSecretaryofthisCommittee;

5-A.PeriodofappointmentofDeanofStudentAffairs:

TheDeanofStudentAffairsappointedinthemannerprescribedinStatute5oftheFirstStatutesshallholdoficeforaperiodofthreeyearsfromthedateofassumptionofcharge:

Providedthatthecandidatewillbeeligibleforanothertermbyselection

6. Manner of appointment of Deans of Faculties, Director ofAgril.,ExperimentStations(DirectorofResearch)&DirectorofExtension.

ThefollowingprocedureshallbeadoptedfortheappointmentofDeansofFaculties,DirectorofResearchandDirectorofExtension.

i)Whereavacancyhastobeilled,theBoardshallconstituteaselectioncommitteeconsistingofthefollowingmembers:

a)theVice-ChancellorasChairman.

b) two members of the Board nominated by the Board from amongthem.

c) twopersonsnotconnectedwiththeUniversityandpreferablyfromotherUniversitiesnominatedbytheBoardontherecommendationoftheVice-Chancellorfortheirspecialknowledgeof,orinterest,inthesubjectwithwhichthepersonstobeappointedwillbeconcerned.

2)TheRegistrarshallactastheSecretaryoftheSelectionCommittee.

3)TheRegistrarshallinviteapplicationsbyadvertisingthevacancyinthemannerprescribedbytheBoardandhemayalsocontactotherappropriateinstitutionsandagenciesforsuggestingnamesofsuitablecandidates.

4) On receipt of the applications and suggestions mentioned in sub-clausesabove,theRegistrar,shallpreparealistofallnamesforscrutiny. The

committeeshallrecommendapaneloftwonamesintheorderofpreferencetotheBoardforconsideration.

5)Notwithstandinganythinginthisstatute,itshallbecompetentfortheBoardtoappointanypersonasDeanofanyfacultyorDirectorofResearchorDirectorofExtensiontemporarilyforaperiodofsixmonthsortillsuchtimeasaDeanorDirector is appointed in themannerprescribed in clauses (1) to (4)whicheverisearlier.

6)Notwithstandinganythinginthisstatute,theBoardmayinexceptionalcircumstances and for reasons to be recorded in writing for not following thenormalprocedureprescribedtherefore,makeappointmenttoavacancyinthepostofDeanofanyfacultyorDirectorofResearchorDirectorofExtensioninanyothermanneritconsidersnecessary.

Provided that the candidates will be eligible for another term byselection.

TheprocedurerelatingtomannerofappointmentofDeansofFaculties,Director ofAgril. Experiment Stations (Director of Research) and Director ofExtension shall apply mutatis mutandis for the post of Director of Research(AnimalSciences)

6-C.PeriodofAppointmentofDirectorofResearch(AnimalSciences).

The provisions of the Statute relating to the period of appointment ofDeansofFaculties,DirectorofAgril.ExperimentStations(DirectorofResearch)andDirectorofExtensionshallapplymutatismutandisforthepostofDirectorofResearch(AnimalSciences).

7-A.MannerofappointmentofPrincipals:

Wheneveravacancyofprincipalistobeilled,theBoardshallappoint,ontherecommendationsoftheVice-Chancellor,oneoftheprofessorsorpersonsof equivalent status in the Faculty concerned, as Principal and the person soappointed as Principal shall be paid an additional allowances of Rs.150/- permonth,inadditiontohisgradepayasProfessororinthePostheldbyhim,asthecasemaybe,fortheadditionaldutiesperformedbyhim.

ii)Leave-(a)TheVice-Chancellorshallbeentitledtoleaveonfullpayforone-eleventhoftheperiodspentonduty.Intheeventofthesameincumbentbeingreappointedforafurthertermortermscontinuouslyheshallbeentitledtotheleaveadmissibleasabove,toleaveonfullpayforsuchun-exhaustedperiodofleaveonfullpaywhichmayremaintohiscreditinanyprevioustermofofice.

b)Heshallalsobeentitled,incaseofillnessoronaccountofprivateaffairs,toleavewithoutpayforaperiodnotexceedingthreemonthsduringanythreeyearstenureofofice,providedthatsuchleavetakenwithoutpaymaybesubsequentlyconverted into leaveonfullpay to theextent towhich itmaybesubsequentlyearnedafterreturntoduty.

iii)TravellingAllowance–TheVice-Chancellorshallbepaidtravellingand halting allowances as per schedule given below when he is to attend aconferenceoranymeetingorundertakesanyjourneyconnectedwithorrelatingtoanyworkoftheUniversity.

8-ANotwithstandinganythinginStatute8,iftheirstVice-Chancellorappointedundertheprovisotosubsection(I)ofSection(II)isreappointedunderthe sub-section for a second or subsequent term, the emoluments and otherconditions of service of theVice-Chancellor so reappointed for the second orsubsequenttermshallbesuchasmaybedeterminedbytheChancellorandshallnotbevariedtotheVice-Chancellor’sdisadvantageonsuchreappointment.

8-BNotwithstandinganythingcontainedinStatute8,theChancellormaydetermine the emoluments and other conditions of service of an oficer in theserviceoftheStateorCentralGovernmentoraMemberofanAllIndiaService-AppointedasVice-Chancellor,inamannernotlessadvantageousthanthetermsandconditionsbywhichthepersonappointedasVice-ChancellorisgovernedasaMemberoftheservicetowhichhebelongs.

ThestatuteshallbedeemedtohavecomeintoforceontheirstofJune,1972.

9.Powersanddutiesof theVice-Chancellor:InadditiontothepowersconferredupontheVice-ChancellorbytheAct,theVice-Chancellormayexercisethefollowingpowers,namely:-

i) He shall be entitled to be present at and address at any stage anymeetingofanyauthorityoftheUniversity:butnottovotethereatunlessheisamemberoftheauthorityconcerned.

ii)Heshallberesponsibleforthemaintenanceofdisciplineamongthestaff,thestudentsandservantsoftheUniversityandshallhavepowersnecessaryforthispurpose.

iii)HeshallhavetherighttoinspectallcollegesandinstitutionsoftheUniversity and hemay express his views thereon to the appropriate oficer orauthorityoftheUniversity.

iv)HeshallhavepowertoinstituteanenquiryinrespectofanymatterconcerningtheUniversity.

v)He shall havepower to interpret theprovisionsof theAct,StatutesandRegulations.AnypersonaggrievedmaysubmitanappealtotheChancellorthroughtheVice-Chancellorwithinninetydaysfromthedateofsuchinterpretationor ruling of the Vice-Chancellor. Any difference of opinion in the matter ofinterpretationbetween theVice-Chancellorandanyauthorityof theUniversityshall,however,bereferredtotheChancellor.ThedecisionoftheChancelloronsuchappealorreferenceshallbeinal.AnysubsequentcommunicationfromtheUniversitytoanypersonorauthorityabouttheinterpretationorrulingshallnotbeconsideredasfreshdecision.

vi)Heshallhavepowertoconstitutesuchad-hoccommitteeashemaydeem necessary to help him in the performance of his duties as the PrincipalExecutiveOficeroftheUniversity.

vii)Wheneveranoficer isabsent fromdutyon leaveor foranyotherreason,orwhenever anyposthasnotbeenilledup, theVice-ChancellormaymakesucharrangementsasmaybenecessaryfortheproperdischargeofdutiesofthatOficerforsuchperiodasmaybenecessary.

viii)Heshallhavepower:

a) to sanction recurring and non-recurring expenditure chargeable tocontingencieswithinthebudgetprovision;

b)tocountersignhisownT.AbillandtheT.AbillsoftheoficersoftheUniversitysubjecttoprovisionsintheseStatutes;

c)tore-appropriatefromonedetailedheadtoanotherinthesameaccountprovidedthatnorecurringliabilityisinvolved;

d)tosanctionthetemporarytransferofamountsfromonefundtoanother,providedthatsuchtransfersarereportedtotheBoardinitsnextmeeting;

e)tosanctionallexpenditureonbuildingsorrepairsthereoftheestimatesforwhichdoesnotexceedRs.50,000/-.

f)tosanctionexpenditureuptoasumofRs.300/-atanyonetimeonitemsofunforeseencharacterforwhichexpenditureshallbereportedtotheBoardofManagementatitsnextmeeting;

g)toopenaccountsonbehalfoftheUniversityinaTreasuryorinaBankapprovedbytheStateGovernment.

10.Powersanddutiesof theRegistrar: Inaddition to thepowersandduties conferred and imposed upon theRegistrar under theAct shall have thefollowingpowersandduties,namely:

i) It shall be the duty of theRegistrar to issue under direction of theBoardortheVice-ChancellorallnoticesconcerningmeetingsoftheBoardandAcademicCouncilandattendthemeetingsandmaintaintheminutesthereof;

ii)HeshallexecuteallprocessesconnectedwiththeelectionofmembersoftheBoardbytheMembersoftheStateLegislatureandtheRegisteredGraduatesoftheUniversity;

iii) He shall, in the execution of his duties, be subject to immediatedirection and control of the Vice-Chancellor and shall generally render suchassistanceasmaybedesiredbyhimintheperformanceofhisoficialsduties.

iv)Heshall,onapplicationpreviouslymadebyanymemberoftheBoardorAcademicCouncilorBoardofFacultyfortheperusaloftheproceedingsoftheBoardorAcademicCouncilorBoardofFacultyrespectively,ixwiththeapprovaloftheVice-Chancellororaconvenienthouranddatewhichshallordinarilybewithintendaysofthereceiptoftheapplication,andarrangefortheperusalofthesaidproceedingsandanydocumentsconnectedwithsuchproceedingatthe

saidhourdate.If,however,thereisanydificultyinfurnishinganyrecordaskedforbythemember,heshouldinformtheBoardorAcademicCouncilorBoardofFacultyasthecasemaybeaccordinglyatthemeetingoftheconcernedauthorityfollowingthemember’srequisitions. v) Subject to the provisions of theAct and theStatutes theRegistrarshallconductcorrespondencerelatingtotheUniversityandberesponsibleforthepropermaintenanceofalltherecordsoftheUniversity. vi)HeshallbethecustodianofoficelibraryoftheUniversity. vii)HeshallberesponsibleforthegeneraldisciplineoftheUniversityOficeandshallhavedisciplinarycontrolovertheemployeesoftheUniversityOfice. viii) He shall be in charge of registration of theUniversity and shallmaintainaregisterofalldegreesanddiplomasconferredbytheUniversity. ix)HeshallberesponsibleforadmissionofstudentstotheUniversityincludingthesupervisionoftheentranceexamination. x)Heshallprepareandmaintainaregisterofallregisteredgraduatesintheprescribedform. xi)Heshall,withrespecttotheemployeesworkingunderhim,exercisepowersdrawing,disbursingandcollectionofmoneyunderrelevantstatutesandregulations. xii)HeshallhavethepowertocountersigntheTravellingAllowancebillsandsanctionleaveoftheemployeesworkingunderhim. xiii)Heshallhavepower:

a) toincurexpenditurechargeabletocontingenciesasunder:i)Non-recurringexpenditureuptoRs.10,000/-ineachcase.ii)recurringexpenditureuptoRs.1,200perannumineachcaseb)tosignchequesforpaymentofsanctionedpayandallowancesofthe Comptroller.

11. Powers and duties of the Comptroller:- In addition to the powersconferred and duties imposed upon the Comptroller by or under theAct, theComptrollershall:

i) bethecustodianofallpropertiesoftheUniversity;ii) SignallcontractsmadeonbehalfoftheUniversity;iii) AdviseinregardtotheinancialpolicyoftheUniversityandtake

measurestodevelopitsresources;iv) PurchaseallmaterialsandpropertiesrequiredbytheUniversityand

itsvariousunitsexceptasotherwiseprovidedbytheAct,StatutesorRegulations;

v) PlacetheinancialpositionoftheUniversitybeforetheBoardthroughtheVice-Chancelloratitsmeeting;

vi) Subject to the acceptance by the Board, receive all contributionsgrants,giftsandendowmentsmadeinfavouroforforthepurposeoftheUniversity;

vii) Ensurethat:a) TheaccountsoftheUniversityareproperlykeptandaudited;b) The budget of the University is prepared and submitted to the Vice-

Chancellorandthattheinancialsanctionsareobtainedintime;andc) TheincomeandfeesduetotheUniversityarecollectedandthesalaries

andotheramountsduetothestaffandothersarepaidpromptly;viii) Devise and install suitable system of accounting and business

procedure and keep an accounts manual for use in all Universityoficers;

ix) Developandoperateaninternalauditsystemsothattherecordofalloficersandemployees,responsibleforthereceiptandexpenditureofmoneys,maintenanceofaccountsandcustodyofproperty,maybe,veriiedbytheaudit;

x) Maintain service records of all members of the staff of theUniversity;

xi) PrescribeinancialformstobeusedintheUniversity;xii) Havepowerstopassbillsandsignchequesforpaymentofcontingent

charges, pay and allowances of all the oficers, teachers and otheremployeesoftheUniversityandotherchequeswithinthebudgetedamount;

xiii) Withrespecttotheemployeesworkingunderhim,exercisepowersdrawing,disbursingandcollectionofmoneysunderrelevantStatutesandRegulations;

xiv) Have powers to countersign T.A. bill and sanction leave of theemployeesworkingunderhim,and

xv) Performsuchotherdutiesasmayberequiredfromtimetotime,bytheBoardortheVice-Chancellor;

ProvidedthatalloranyofthepowersreferredtoaboveshallbeexercisedbyanyotheroficerauthorizedinthisbehalfbytheBoardofManagement.12. Powers and duties of the Dean of StudentsAffairs: In addition to the

dutiesmentionedinsub-section(3)ofSection16oftheAct,theDeanofStudentAffairsshallhavethefollowingpowersanddutiesnamely:

i) Heshallorganizemessingarrangementsforstudents.ii) Heshallobtainmedicaladviseandassistanceforstudents.iii) He shall make arrangements for scholarships, stipends part-time

employmentsandothersuchassistance.iv) Heshallarrangetravelfacilitiesforstudentsonholidays.

v) He shall communicate with guardians of students concerning thewelfareofthestudents.

vi) He shall exercise general control over the physical educationprogrammeandtheUniversitymedicalandhealthservices.

vii) Heshallberesponsibleforstudentdiscipline.viii) Heshall,inconsultationwiththeDirectorofAgril.ExperimentStations

andDirectorofExtensionprepareaprogrammeforemploymentofstudentsintheExperimentStationsandtheextensionieldandputituptotheVice-Chancellorforapproval.

ix) Heshallexplorethepossibilitiesofindingsuitableemploymentforgraduatesandarrangetheirinterviewwithprospectiveemployers.

x) Heshallwithrespecttotheemployeesworkingunderhimexercisepowersofdrawingdisbursingandcollectionofmoneysunderrelevantstatutesandregulations.

xi) He shall have powers to countersignT.A. bills and to sanction allkindsofleaveoftheemployeesworkingunderhim.

xii) HeshallperformsuchotherdutiesasmaybeassignedtohimbytheBoardortheVice-Chancellor.

13.PowersanddutiesoftheDeanofFaculties:

i) TheDeanofaFacultyshallbetheChiefExecutiveOficeroftheFacultyandresponsibletotheVice-Chancellorforitsadministration.

ii) TheDeanofa facultyshallhave the followingpowersandduties,namely:-

a) He shall be responsible for the organization and conduct of teachingresearchandextensionworkofthedepartmentscomprisedintheFacultyand for that purpose shall pass such orders as might be necessary inconsultationwiththeHeadoftheDepartmentconcerned.

b) WithoutprejudicetotherightofanymembertoprescribeanymattertotheBoardofFacultyheshallformulateandpresentpoliciestotheBoardoftheFacultyforitsconsideration.

c) He shall make reports to the Vice-Chancellor on the work of theColleges.

d) He shall supervise the registration and progress of the students in theColleges.

e) Heshallpreparethebudgetforthefaculty.

Heshallhavethepowerstoallotsuchofhisfunctionsbedischarged,subjecttohisdirectionsandcontrolbysuchofsubordinateoficersashemayfromtimetotimedecide.

He shall with respect to the employees working under him exercisepowersofdrawing,disbursingandcollectionofmoneyunder relevantstatutesandregulations.

14. Powers and duties of the Director of Agricultural ExperimentStations.

TheDirectorofAgriculturalExperimentStationsshallhavethefollowingpowersandduties,namely:-

i) He shall co-ordinate the planning and prosecution of researchconducted by the University, excepting research done by studentsto meet degree requirements and by teachers of the University toimproveteachingabilities.

ii) HeshallprepareannualbudgetestimatesforsuchresearchasmayberequiredbytheUniversity.

iii) HeshallassisttheappropriateDeanstomeettheirresponsibilitiesfordirect supervisionof themembersof theCollege staff engagedonapprovedresearchprogrammes.

iv) He shall require and supervise the compilation and publication ofresearchresults.

v) He shall be responsible to the Vice-Chancellor in exercise of thepowersanddischargeofdutiesundertheActandStatutes.

vi) Heshallwithrespecttotheemployeesworkingunderhim,exercise,powers of drawing, disbursing and collection of moneys underrelevantStatutesandRegulations.

vii) HeshallhavepowerstocountersignT.A.Billsandtosanctionleaveofanynatureadmissibletotheemployeesworkingunderhim.

14-A.PowersanddutiesoftheDirectorofResearch(AnimalSciences).

i) Heshallco-ordinatetheplanningandprosecutionofresearchintheieldofAnimalSciencesexceptingresearchdonebystudentstomeetdegree requirementsandby teachersof theUniversity to improveteachingabilities.

ii) HeshallprepareannualbudgetestimatesforresearchintheieldofAnimalSciences.

iii) HeshallassisttheDeanFacultyofVeterinarySciencestomeethisresponsibilitiesfordirectsupervisionofthemembersoftheCollegeStaff engaged on approved research programmes in the ield ofAnimalSciences.

iv) He shall require and supervise the compilation and publication ofresearchresultsinAnimalSciences.

v) He shall be responsible to the Vice-Chancellor in exercise of thepowersanddischargeofdutiesundertheActandStatutes.

vi) Heshall,withrespecttotheemployeesworkingunderhim,exercisepowersofdrawing,disbursingandcollectionofmoneyunderrelevantstatutesandregulations.

vii) HeshallhavepowerstocountersignT.A.Billsandsanctionofleaveofanynatureadmissibletotheemployeesworkingunderhim.

15.PowersanddutiesoftheDirectorofExtension:

TheDirectorofExtensionshallhave the followingpowersandduties,namely:

i) He shall prepare yearly programmes and budget needs for theeducationof cultivators andother non-students in connectionwithExtensionSchemes.

ii) Heshallsuperviseoff-campusprogrammesoftheUniversitydealingwithagriculturalcooperatives,ruralyouthprogrammes,shortcoursesforcultivators,trainingofnon-studentsetc.

iii) Heshallco-operatewiththeDeansofFacultiesindevelopingcoursesandinteachingstudentsinvariousformsofextensioneducation.

iv) Heshalldirect thedevelopmentof informationalmaterialssuchaspublications,ilms,etc.foruseinallphasesoftheextensionwork.

v) He shall be responsible to the Vice-Chancellor in the exercise ofpowersanddischargeofdutiesundertheActandStatutes.

vi) Heshallwithrespecttotheemployeesworkingunderhimexercisepowerofdrawing,disbursingandcollectionofmoneyunderrelevantStatutesandRegulations.

vii) HeshallhavepowerstocountersignT.A.billsandsanctionleaveofanynatureadmissibletotheemployeesworkingunderhim.

15-A.PowersanddutiesofthePrincipals:-APrincipalshallhavethefollowingpowersandduties,namely:-

i) He shall subject to the overall control of the Dean of the Facultyconcerned, exercise control over the college of which he is theadministrative and academic head in respect of all employees,studentsandfacilities.

ii) Heshallsupervisetheteaching,researchandextensionworkofthestaffoftheCollegeandberesponsiblefortheworkandconductofallstudentsoftheCollege.

iii) He shall exercise such powers and discharge such duties as otheroficersmaywith respect to themaintenance and operation of theCollegeunderhiscontrol,delegatetohimwiththeapprovaloftheDeanofthefacultyconcerned.

iv) HeshalldischargesuchotherdutiesasmaybeassignedtohimbytheDeanofthefacultyconcerned.

v) HeshallberesponsibletotheDeanforeducationaluseofthebuildingsandroomsassignedtotheCollegeandforthegeneralequipmentoftheCollege.

vi) He shall be entitled to grant casual leave to the teachers of theCollege.

vii) Heshallwithrespecttotheemployeesworkingunderhimexercisepowers of drawing, disbursing and collection of moneys underrelevantstatutesandregulations.

viii) HeshallhavethepowersofcountersignT.A.billsandsanctionleaveoftheemployeesworkingunderhim.

ActSection38(e)

16.PowersanddutiesoftheEstateOficer:(i)TheEstateOficershallworkunderthecontrolandsupervisionoftheVice-Chancellorandshallberesponsibleforthe–

(a) Execution and maintenance of the buildings, roads, fencing, play-grounds, parks and lands of the University other than the landscomprisingtheAgriculturalandLivestockFarms;

(b) Maintenanceoftheutilityservices;

(c) MaintenanceofFireProtectionServices;

(d) Maintenance of architectural and planning services for theUniversity.

(e) Preparationof theannualbudgetof theUniversityforconstructionandmaintenanceofthebuildingsandperiodicalreportsshowingtheprogressofworksunderconstruction;

(f) Maintenanceof theaccounts relating to theworks inhischarge informsprescribedbytheComptroller;

(g) AllotmentsandmaintenanceofthequartersandaccommodationforthestaffoftheUniversity;and

(h) AllrepairsandconstructionoftheUniversitybuildings.

(ii) HeshallalsoperformsuchotherdutiesasmaybeassignedtohimbytheVice-ChancellorortheComptroller.

(iii) Heshall,withrespecttotheemployeesworkingunderhim,exercisepowers of drawing, disbursing and collection of moneys underrelevantStatutesandRegulations.

(iv) HeshallhavepowerstocountersignT.A.billsandsanctionallkindsofleaveofemployeesworkingunderhim.

17. The powers and duties of the University Librarian:- The UniversityLibrarianshallhavethefollowingpowersandduties,namely:

(i) He shall maintain all the libraries in the University Campus andorganizetheirservicesinthemannermostbeneicialtotheneedsofteaching,researchandextension.

(ii) SubjecttothegeneralcontroloftheVice-Chancellor,heshallexerciseallpowersinrelationtotheoficeroutine,thecontrolofthelibrarystaff and the eficient organization and working of the UniversityLibrary.

(iii) He shall have powers to purchase catalogue, cards, lables andother library requisitesoutof theprovision in theBudget for suchpurposes.

(iv) Heshallberesponsibleforthepropercareandupkeepofallbooks,manuscripts, periodicals and back-numbers of periodicals in thelibraryoftheUniversity.

(v) HeshallconductannuallyinthemonthofApriladetailedcheckingof all books,manuscripts andperiodicals in the libraries and shallsubmithisreporttotheVice-ChancellorthroughtheRegistrar.

(vi) HeshallsubmittotheVice-Chancellorattheendofeachacademicyear,anannualreportandstatisticsshowingtheprogressofthelibraryintheUniversityCampus.

(vii) He shall seek the guidance of the Vice-Chancellor in all mattersrelating to the general policies, development and working of thelibraries.

(viii) HeshallpreparetheannualbudgetfortheUniversitylibraries.

(ix) HeshalldischargesuchotherdutiesasmaybeassignedtohimbytheVice-ChancellororAcademicCouncil.

(x) Heshallwithrespecttotheemployeesworkingunderhimexercisepowers of drawing, disbursing and collection of moneys underrelevantStatutesandRegulations.

(xi) HeshallhavepowerstocountersignT.A.billsandsanctionallkindsofleaveofemployeesworkingunderhim.

18.PowersanddutiesoftheManageroftheUniversityPress:-TheManageroftheUniversityPressshallhavethefollowingpowersandduties,namely:-

(i) He shall design, print and distribute the publications of theUniversity

(ii) HeshallnotinterferewiththerightofCollegeorDepartmentoftheUniversity–

(a) Toreproducematerialsbymeansotherthanprintingandtodistributethesame;

(b) To distribute any materials as a part of the University ExtensionService;and

(c) Toapproveforpublicationresearchmanuscriptsinsuchgeneralformandinsuchnumbersastheymaydetermine.

(iii) HeshallberesponsibleforthesecrecyofthepapersgiventohimbytheUniversityforprinting.

(iv) Heshallwithrespecttotheemployeesworkingunderhimexercisepowers of drawing, disbursing and collection of moneys underrelevantStatutesandRegulations.

(v) Heshallhavethepowers tocountersignT.A.billsandsanctionallkindsofleaveofemployeesworkingunderhim.

CHAPTER III

AUTHORITIES

ActSection38(a)

19.PowersanddutiesoftheBoardoftheManagement: InAdditiontothepowersandfunctionsmentionedinsection20oftheAct,theBoardshallexerciseandperformthefollowingpowersandfunctions,namely:-

(i)todeclarebyStatutethattheUniversityshallincludeanyotherFacultyundersub-section(1)ofsection23;

(ii)topublishanannualreportcontainingthereviewoftheprogressmadeindifferentspheresofactivitiesoftheUniversity;

(iii)tosubmittotheGovernmentlegislativeproposalswhichitconsidersnecessaryforthebettermentandpromotionofAgriculture;and

(iv)toconsidertheproposalsoftheBoardsofFacultiesfortheinstitutionofFellowships,Scholarships,Bursaries,MedalsandPrizes.

20. Term of the teachers nominated by the Vice-Chancellor to theAcademicCouncil:ThetermoftheteachersnominatedbytheVice-ChancellortotheAcademicCouncilshallbetwoyearsfromthedateofnominationorfromthedateofoccurrenceofthevacancywhicheverislater.

21.PowersanddutiesoftheAcademicCouncil:Inadditiontothepowers,functionsanddutiesmentionedinSection22theAcademicCouncilshallhavethefollowingpowers:-

(vi) to propose rules to the Board for the award of scholarships,Fellowships,Medals,etc.

(vii) To make proposals for the consideration of the Board regardingdistributionofnewgrantsbytheGovernmenttotheCollegesforthedevelopmentof higher teaching and research whenever the University is consulted by theGovernmentonsuchmatters.

(viii) topromoteresearchwithintheUniversityandtorequirereportsonsuchresearchfromthepersonsemployedthereon;

(ix) to recommend to the Board the making of Grants to sections orcolleges,whichcontributetoUniversityteachingandresearch;

(x) tomakeregulationsregardingtheholdingofconvocation;and

(xi) to constitute a Committee on student discipline with the Dean ofStudentaffairsastheex-oficioChairman.

(b)todrawthecurriculaandcoursesandrecommendedtotheAcademicCouncilbookstobeprescribedastextbooks;

Provided that no book shall be recommend unless the report of themembersoftheBoardofFacultiesisobtainedthereon;

(c) to recommend to the Academic Council conditions under whichstudentsshallbeadmittedtotheDegrees,DiplomasandCertiicates;

(d) to recommend to the Academic Council the establishment,amalgamation,Sub-divisionandabolitionofDepartments;

(e) to propose the fellowships, Scholarships, Studentships, BursariesMedalsandPrizestobeinstitutedbytheBoard;

(f) to recommend to theAcademic Council for the recognition of thedegrees, diplomas and other certiicates of the recognized Universities anddetermine their equivalence to the corresponding Degrees, Diplomas andcertiicatesoftheProf.JayashankarTelanganaStateAgriculturalUniversity;

ProvidedthatiftheBoardofFacultiesandexaminersdonotagreeuponthecoursetobeadopted,thedecisionoftheBoardofFacultiesshallbesubjectto theconirmationof theVice-Chancellorandif theVice-Chancellordoesnotconirm decision of the Board of Faculties the matter shall be referred to theAcademicCouncilwhosedecisionthereonshallbeinal.

(ii)TheBoardsofFacultiesshallhavepowertoappointeitherstandingortemporarycommitteesastheyarenecessaryfortheirdeemproperfunctioning.

CHAPTER IV

MEETINGS

Procedure at meetings of Board of Management

ActSection08(d)

24.General: (i) MeetingsoftheBoardofManagementshallbeofthreekinds,viz., (a) Ordinary,(b) Urgentand(c)Special.

(ii) ThedatesandhoursandvenueforthemeetingsoftheBoardshallsubjecttotheprovisioninsub-section(2)ofsection20,beixedbytheVice-Chancellor.

(iii) IntheabsenceoftheChairmanfromanymeetingthememberspresentatthemeetingshallchooseoneoftheirmemberstopresidethereat.

(iv)SixmembersoftheBoardincludingthepresidingmembershallformthequorumatanymeeting(ordinary,urgentorspecial)oftheBoard.

(v) If the quorum is not present within thirty minutes after the timeappointedforameeting,themeetingshallnotbeheldandtheRegistrarshallmakearecordofthefactandtherecordshallbesignedbytheChairmanorpresidingmember.

(vi) If at any timeduring theprogressof ameetinganymember shallcallattentiontothenumberofmemberspresent theChairmanor thepresidingmember shall within a reasonable time count the number of members presentandifaquorumbenotpresentheshalldeclarethemeetingasdissolvedandshallleavetheChair.AllsuchdissolutionsshallberecordedbytheRegistrarandtherecordshallbesignedbytheChairmanorthepresidingmember.

(vii) Non-receiptofnotice,agendaandotherpapersconnectedwithanymeetingoftheBoardbyanymembershallnotinvalidatetheProceedingsofthemeeting.

25.Ordinary Meetings : (i) TheRegistrarshallunderthedirectionoftheVice-Chancellorgivenoticenotlessthantendaysbeforethedateofanordinarymeeting.

(ii) TheRegistrarshallunderthedirectionoftheVice-ChancellorsendtoeverymemberoftheBoard,agendapaperspecifyingtheplace,.dayandhourofthemeetingandbusinesstobebroughtbeforethemeeting,providedthattheVice-Chancellormaybringanybusinesswhichinhisopinionisurgentbeforeanyordinarymeetingwithshorternoticeorwithoutplacingthesameontheagendapaper.

26.Urgent Meetings: (i)TheVice-Chancellormay,wheneverhethinksnecessary, convene an urgent meeting of the Board for the transaction of anyurgentbusiness.

(ii)TheRegistrar,underdirectionoftheVice-Chancellor,shallordinarilygivethreedaysnoticeoftheUrgentmeetingandforwardwiththenoticetoeachmembertheagendapaperforthemeeting.TheVice-Chancellormayconveneameetingatashorternoticeincaseofurgency.

(iii) ItshallbeopentotheVice-Chancellortobringbeforeanurgentmeetinganyurgentbusinesswithorwithoutplacingitontheagendapaper.

27.Special Meeting : (i)ASpecialMeetingoftheBoardshallbeconvenedbytheVice-ChancelloronreceiptofrequisitioninwritingsignedbynotlessthaneightmembersoftheBoardandsenttotheRegistrar.Allsuchrequisitionsshallcontainthetermsoftheresolutionorresolutionstobemovedtogetherwithnameof themoverof each resolution.Nobusinessother thanconsiderationof suchresolutionor resolutionsshallbe transactedataSpecialmeetingprovided thattheVice-Chancellormaybringanyurgentbusinessbeforesuchspecialmeetingwith orwithout notice.A specialmeetingmay also be convened by theVice-Chancellorforconsiderationofanyspecialsubjectwhich,intheopinionofVice-Chancellor,isnecessary.

(ii) IssueofnoticeandagendapaperandotherrequisitesfortheconductofspecialmeetingshallsofarastheyareapplicablebethesameasthoseprescribedandapplicableforurgentmeetingsoftheBoard.

CHAPTER V

REGISTRATION OF GRADUATES

ActSection38(m).

28. Registration of Graduates : (i) The Registrar shall maintain theRegisterofRegisteredGraduatesinaccordancewiththeprovisionsmadeintheseStatute.

(ii)Thefollowingpersonsshallonpaymentoffeesprescribedinclause(iii) below,beeligibleforregistrationasgraduatesoftheUniversityandenjoyallprivilegesofregistration:-

(a) AllgraduatesoftheUniversity;

(b) AllpersonswhohavetakendegreesinAgriculture,VeterinaryScienceandHomeScienceprior tothedateof theirstconvocationof theAgriculturalUniversityandwhoaredomiciledorresidentsinTelangana.

Note : (1)ResidentforthepurposeofthisStatutemeans,apersonwhoisresidentinTelanganaatthetimeoftheapplicationforregistrationandhasbeenresidentinthatStateforacontinuousperiodoftwoyearsatleastpreceding;

(2)The date of theConvocation onwhich a person is admitted to hisdegreeeitherinpersonorinabsentiashallbedeemedthedayonwhichhehasgraduatedortakenhisdegree.

(iii)Ifanyquestionarisesastowhetheragraduatecomingunderclause(ii) aboveisdomiciledorresidentintheStateornot,thequestionshallbedecidedbytheBoardofManagementandsuchdecisionshallbeinal.

(iv)Anygraduatewhowishestoregisterhimselfasaregisteredgraduateof the University shallpaya feeofRs.5 (rupeesive)andapply in the formprescribedbytheUniversitytotheRegistrarwhichwillentitlehimtohavehisnameenteredandretainedintheregisterforlife.

Note:- ThepersonswhosenamesarefoundonthedateoftheestablishmentoftheProf.JayashankarTelanganaStateAgriculturalUniversityintheRegistersof the Registered Graduates of the Andhra, Osmania and Sri VenkateswaraUniversitiesshallpayafeeofonlyRs.3(rupeesthree).

(v)OnreceiptoftheapplicationtheRegistrar,ifheindsthattheapplicantisdulyqualiiedtoberegisteredandowesnomoneytotheUniversity,shallcausethenameoftheapplicanttobeenteredintheRegister.

(vi) (a) Anupto-dateandcorrectedlistofRegisteredGraduatesasonthe1stdayofJanuaryshallbepublishedeveryyearandapplicationsforcorrectionsintheRegisterofRegisteredGraduatesshouldreachtheRegistraratleast15cleardaysbeforethe1stJanuaryeachyearforthispurpose.

Provided that in the year in which elections are to be held to elect arepresentativeoftheRegisteredGraduatestotheBoardofManagement,thelistshallbebroughtupto-dateseventycleardaysbeforethedateofpoll.

(b) Agraduatewhogetshimself registerednot less than seventy cleardaysbeforethedateofpollshallbeeligibletoparticipateintheelection.

(c)NotwithstandinganythingcontainedinthisStatutethegraduatesinAgriculture,VeterinaryScienceandHomeSciencewhohavetheirnamesintheregister of registered graduates of theAndhra, SriVenkateswara andOsmaniaUniversitieson4thMay,1964(thedateonwhichtheActhasbeenbroughtintoforce)shallbeeligibletotakepartintheirstelections.

(vii) AgraduatewhosenameisintheregistershallbeentitledtoinspectitduringoficehoursonapplicationtotheRegistrarandshallbeentitledonpaymentofRs.5(rupeesiveonly)tohaveacopyofit,subjecttoitsbeinginstock,eitherinpersonorbypost,correcteduptothedateoflastrevisionunderclause(vi)above.TheUniversityreservestoitselftherightorreprintingthelist.SupplementallistofsuchgraduatesshallbesuppliedtoanygraduatewhomakesarequestforitinwritingtotheRegistrar,providedhehadpreviouslypurchasedthelatestprintedcopyoftheoriginallistofregisteredgraduatesoftheUniversity.

(viii)(a)WhenanycommunicationispostedtoaregisteredgraduatetohisaddressasregisteredintheregisterofregisteredgraduatesandisreturnedtotheRegistrarundeliveredwithanendorsementbythePostalDepartmentthattheperson is reporteddead, thenameofsuchgraduateshallbe removedfromthelist.

(b) If theVice-Chancelloronenquiry issatisiedthatagraduate in thelistisdeceasedheshallgiveitsuchpublicityandinsuchmannerashedecidesandafteralapseofthreemonthsfromsuchpublicityremovethenameofsuchdeceasedgraduatefromthelist.

(c)Ifatanytimeafterregistrationasaregisteredgraduateanypersonforanyreasonisdeprivedinanymannerofhisdegreeordegreeswhichentitledhimtoregistrationassuch,heshallbearegisteredgraduateoftheUniversityfromthedate.

(ix) A registeredgraduateshallhavethefollowingprivilegesnamely:-

(a)heshallbeeligibletostandforelectiontotheBoardofManagementfromthegraduatesconstituencyprovidedthathehascompletedtwenty-oneyearsofage.;

(b) heshallbeentitledtoelectmemberstotheBoardinaccordancewithprovisionoftheProf.JayashankarTelanganaStateAgriculturalUniversityAct;

(c)he”shallbeentitledto”theuseoftheUniversityLibraryonsuchtermsasmayfromtimetotimebeprescribedbytheBoard;and

(d) he shall have priority of admission over unregistered graduatesto all lectures delivered by the University oficers and teachers and to theConvocation.

35. Convocation:- (i)All Degrees, diplomas honorary degree shall beconferredbytheUniversityeitherataconvocationorinabsentia.

(ii)AConvocation for conferringdegrees shallbeheldatleastonce ineveryyearonadatetobeixedbytheChancellor.

CHAPTER XIII

HOSTELS

Act.Sec.7Sec.38(K)

36.Establishment andabolitionofHostels: (i)TheBoard shall on therecommendationoftheVice-ChancellorestablishhostelsforallstudentsoftheUniversity.NohostelsshallbeabolishedwithoutpriorapprovaloftheBoard.

(ii)NostudentoftheUniversityshallbepermittedtoresideoutsidethehostelmaintainedbytheUniversityexceptwiththepermissionoftheDeanofStudentAffairs.

Note:-Thisclauseshallnotapplytothestudentswhoresideintheownhousewiththeirparentsorunderaproperguardian.

CHAPTER XIV

ELECTION OF A REPRESENTATIVE FROM THE REGISTERED GRADUATES

Act.Sec.19(2)(B)Sec.38(C)

37.General:(i)TheVice-Chancellorshallbethereturningoficerandshalldirect theholdingofelectionsandshallhavepower(a) toix thedateofelections, (b) to determine the formofnotice,nomination, letterof intimation,declarationpaper,ballotpaper,ballotpapercover(smallercover)andtheoutercover (envolope) for the election and the instructions to be contained in thenotiicationtobepublishedintheTelanganaGazette,(c)todecidethevalidityorinvalidityofeachballotpaperand(d)todeclaretheresultsoftheelection:

Provided that it shall be competent for the Vice-Chancellor to deputeeithertheRegistraroranyotherpersontoactinhisplaceinrespectofscrutinyofnominationsortheconductoftheballotorthedeclarationoftheelectionandalloranyofthestagesoftheelection.Thepersonsodeputedshallexerciseforalltheabovestagesorforthespeciiedoneintheelectionthefunctionsandpowersofthereturningoficer.

(ii) Subjecttosection27,thedecisionoftheVice-Chancelloronanyquestionrelatingtoelectionsshallbeinal.

(iii) Notwithstandinganythingcontainedinclauses(ii), (iii), (iv) (b)and(vii)ofStatute38,itshallbecompetentfortheVice-Chancellortoixthetimelimits for (l)-iling nominations (2) withdrawal of nominations and (3) returnofballotpapersandotherwisevary thedetailsofprocedurefor theconductofelectionsforconstitutingtheirstBoardofManagementoftheUniversity.

(iv) AnycandidateintheelectionintendingtoappealtotheChancellorunder section 27 against any declaration made by the Vice-Chancellor or thepersondeputedbyhimtoactinhisplaceinrespectofnominations,ortheconductoftheballotorthedeclarationoftheresultsthereofshalllodgehisappealwiththeChancellorthroughtheVice-Chancellorwithinsevendaysafterthedateofsuchdeclarationtowhichhetakesobjection,excludingthedateofsuchdeclaration.Appealsreceivedaftertheperiodixedaboveshallnotbeconsidered.

(v)Theelectionsshallbeheldbythemethodofpostalvoting.

(vi) The election shall not be invalid by reason of any loss duringtransmissionofanynoticeorballotpapers.

(vii) TheresultsoftheelectionshallbepublishedintheTelanganaGazetteand shall have the effect in the caseof anticipatoryelections from thedateofoccurrenceofthevacancyandinothercasesfromthedateofdeclarationoftheresultoftheelection.

(viii) The ballot papers, to gether with the declaration papers, of the

electionshallbepreservedintheUniversityoficeofthereturningoficerforaperiodofthreeweeksfromthedateofelectionorifanyquestionarisesastotheelectionuntilitisdisposedof.

(ix) NopersonshallbequaliiedforelectionornominationasamemberofanyoftheAuthoritiesoftheUniversityifhe-

(a) isonthedateofelectionornomination,ofunsoundmind,aminor,adeaf-muteorissufferingfromleprosy:or

(b) appliestobeadjudicatedasinsolventorisanundischargedinsolvent;or

(c)hasbeenconvictedandsentencedbyaCriminalCourttotransportationforlifeorimprisonmentforaperiodofmorethanoneyearforanoffenceinvolvingmoralturpitudeunlesssuchsentencehasbeenreversedortheoffencehasbeenpardonedoraperiodofiveyearshaselapsedfromthedateoftheexpirationofthesentence;or

(d) isastatutePulilaryoftheUniversity.

38.Procedure for election by Postal Voting: (i) WhenanyvacancyoftherepresentativeoftheregisteredgraduatesintheBoardoccursorisabouttooccur,notiicationofthefactshallbepublishedintheTelanganaGazetteinthemannerprescribedbytheVice-Chancellor.

(ii)Eachelectorshallbeatlibertytonominateaqualiiedpersontoillthevacancy.EverynominationshallbeintheformprescribedbytheVice-Chancellorandshallbemadebyanelectorinwritingandshallbesecondedinwritingbyanother elector. Every such nominations shall be accompanied by a statementsignedbythenomineeagreeingtoservetheonauthority,ifelected,anddeclaringthatheisnotalreadyamemberoftheauthoritytowhichheseekselection,orifheisalreadyamember,thathistermofoficeassuchwouldexpirebeforethemembership forwhich he is seeking election takes effect, and the nominationpapermustreachtheRegistrarwithinthedateandhourixedwhichshallbenotearlier (than fourteen clear days after the publicationof the notiication in theGazetteandinaccordancewiththeinstructionscontainedtherein.

(iii) (a) All nomination papers shall be scrutinised by the ReturningOficerorotheroficerauthorisedbyhiminthisbehalfontheandhourdateandattheplaceappointedandnotiiedinthenoticeofvacancy.

(b) Candidatesandarepresentativeofeachcandidateappointedinwritingby him and approvedby theReturningOficer,maybe present at the timeofscrutinyofnominations.

(iv)TheReturningOficerorotherpersonauthorisedbyhimtoscrutinizeshallexaminethenominationpapersandshalldecideallobjectionswhichmaybemadetoanynominationpaperonthegroundthatitisnotvalidandmayrejecteither on his own motion or on such objection of any nomination paper.The

decisionof theReturningOficeror thepersonauthorisedbyhimtoscrutinizeshall in every casebe endorsedbyhimon thenominationpaper in respect ofwhichsuchdecisionisgiven.

(a)A list of candidates whose nomination papers have been declaredvalid,shallbepublishedbyafixingthesameonthenoticeboardintheoficeoftheReturningOficeronthesameday,andacopyofthesameshallbeforwardedtoeachofthecandidatesnominatedforelection.

(b) Any candidate may withdraw his candidature by notice in writingsubscribedbyhimandeither,sentbyregisteredpostordeliveredinpersonorbymessengertotheReturningOficerorotherpersonauthorisedbyhim,notlaterthan4P.M.onthedayixedforwithdrawal,whichshallbeivecleardaysafterthelastdateforthereceiptofnominations.Acandidatewhohaswithdrawnhiscandidature,shallnotbeallowedtocancelthewithdrawalorbeeligibletobere-nominatedasacandidatureforthesameelection.

(c)TheReturningOficerorotherpersonauthorisedbyhimshallpublishonthesamedayafterthetimeforwithdrawalofnominationshaslapsed,ainallistofcandidatesvalidlynominated.

(d)(1)Ifonlyonecandidateisvalidlynominatedandifhehasnotwith-drawnhis candidature in themannerandwithin the time speciiedhe shallbedeclareddulyelected.

(2)Ifthereisnocandidatewhoisvalidlynominatedtheconstituencyshallbecalledupontoelectapersontoillthevacancy.

(3)IftherearemorethanonevalidlynominatedcandidatestheelectionshallbeproceededwithinthemannerprescribedinthefollowingStatutes:

(v)TheRegistrarortheReturningOficershallsendtoeachelectorbypost(1)anumbereddeclarationpaper(2)aballotpaperwhichshallcontainthenamesofthecandidateswiththeiraddressesarrangedinalphabeticalorderandwhichshallalsobearonittheRegistrar’sortheReturningOficer’sinitialsandthedateofposting(3)aballotpapercover(smallercover)(4)anumberedenvelopeaddressedtotheRegistrarortheReturningOficerand(5)aletterofintimationstatingthenumberofvacanciestobeilled,thedateandhourixedforthepoll,andtheplace,thedayandhourixedforthescrutinyandcountingofvotes.TheBallotpapersshallbesentbyposttotheaddressenteredagainstthenameoftheelectorintheelectoralrolloriftheelectorhassincethepublicationorpreparationoftherollchangedhisaddressandintimatedthefactinwritingtotheRegistrarorthereturningOficernotlaterthanfourteendaysbeforethedateixedforthedispatchofballotpapers,totheaddresssogiven.

(vi)Thedateixedforthepollshallbenotlessthanfourteencleardaysafterthedateofpostingoftheballotpaper.

(vii) Theelectorshallafterillingupthedeclarationpaperandtheballotpaperinaccordancewiththedirectionsgivenintheletterofintimation(1)enclosetheballotpaper inballotpapercover (smaller cover) and stock it, and (2)puttheballotpapercoverandthedeclarationpaperintheenvelopeaddressedtotheRegistrarortheReturningOficerand(3)sendtheenvelopebyregisteredpost,soastoreachtheRegistrarortheReturningOficer,notlaterthanthedayandthelatesthourixedforthepoll:

Provided that, at his option the elector,may either in person or by anagent,depositorcausetobedepositedtheenvelopeaddressedtotheRegistrarortheReturningOficerintheballotboxprovidedforthepurposeonthedayandduringthehoursixedforthepoll.

(viii) Ifanelectorisincapacitedfromblindnessorotherphysicalcausefromvotinginthemannerprescribed,itshallbecompetentforhimtorecordhisvotebythehandofanyofthepersonsenumeratedbelowandsuchpersonshall,on the declaration paper, attest the incapacity and the fact of his having beenrequestedbytheelectortomarktheballotpaperforhimandofitshavingbeensomarkedbyhiminthepresenceoftheelector.

(ix) Anelectorwhohasnotreceivedhisballotandotherconnectedpaperssentbypost,orwhohaslostthem,orwhosepapers,beforetheirdespatchbacktotheRegistrarortheReturningOficerbyhim,havebeeninadvertentlyspoilt,maytransmitadeclarationtothateffectsignedbyhimselfandrequesttheRegistrarortheReturningOficertosendhimnew(duplicate)papersinplaceofthosenotreceived,lostorspoilt;andifthepapershavebeenspoilt,thespoiltpapersshallbereturnedtotheRegistraror theReturningOficerwhoshallcancel themonreceipt.Ineverycasewhennewpapersareissued,theyshallbesuperscribedas“Duplicate”andamarkshallbeplacedagainstthenumberoftheelector’snameintheregisterofelectoralroll todenotethatnew(duplicate)papershavebeenissuedinplaceofthosenotreceived,lostorspoilt.

(x) Onthedayandatthehourappointedforthescrutinyandcountingofvotes,theenvelopesreceivedthroughpostfromtheelectorsbytheRegistrarsortheReturningOficerandthosedepositedintheballotboxshallbescrutinised.

Theenvelopeswillberejected:

(i)if,havingbeensentbyregisteredpost,donotreachtheRegistrarortheReturningOficerwithinthetimeixed,or.

ifnotdepositedintheballotboxduringthetimeixed,and

(ii) ifmorethanonceenvelopeaddressedtotheRegistrarortheReturningOficeraresentinasingleregisteredcoverorparcel.

N.B:- If twocoversbearingthesameserialnumbers(originalandduplicate)arereceivedbothshallberejected.

Ineachcaseofrejectiontheword“Rejected”shallbeendorsedontheenvelope.Envelopesnotsorejectedshallbearrangedseriallyaccording to thenumbersenteredonthemandcounted.Thecoversshallthenbeopenedandthedeclarationpapersandtheballotpapercoversexamined.

(xi) Aballotpapercoverwillberejected:-

(a) iftheenvelopecontainsnodeclarationpaperoutsidetheballotpapercover;or

(b) ifthedeclarationpaperisnottheonesentbyRegistrarorReturningOficer;or

(c)ifthedeclarationorattestationisnotinaccordancewiththeStatutes;or

(d) iftheballotpaperisplacedoutsidetheballotpapercover;or

(e)Ifmorethanonedeclarationpaperorballotpapercoverhavebeenenclosedinoneandthesameenelope.

Ineachcaseofrejection-theword“Rejected”shallbeendorsedontheballotpapercoverorthedeclarationpaper.

(xii) Candidates and a representative of each candidate appointed inwritingbyhimandapprovedbytheReturningOficer,maybepresentatthetimeofscrutinyandcountingofvotes.

(xiii) Theballotpapercovers,otherthanthoserejectedunderclause(xi) aboveshallbeopenedandtheballotpaperstakenoutandmixedtogetherinthepresenceoftheReturningOficer.Theballotpapersshallthenbescrutinisedandthevalidvotessecuredbyeachcandidatecounted.

(xiv)Aballotpaperwillbeinvalid:

(a) ifitdoesnotbeartheinitialsoftheRegistrarortheReturningOficerasthecasemaybe;or

(b) ifavotersignshisnameorwritesanyword,ormakesanymarkonit,bywhichitbecomesrecognisable;or

(c)ifnovoteisrecordedthereonbyplacingacrossmarkthus“X”againstthenamesofthecandidateorcandidatesforwhomthevoterwishestovote;or

(d) if the number of votes recorded thereon exceeds the number ofvacanciestobeilled;or

(e)ifitisvoidforuncertainity;or

(f)ifitviolatesanyotherstatutes:

Providedthatwheremorethanonevotecanbegivenonthesameballotpaper,ifoneofthemarksissoplacedastorenderitdoubtfultowhichcandidatesitisintendedtoapply,thevoteconcernedbutnotthewholeballotpaper,shallbeinvalidonthataccount.

(xv) The nominee who secures the largest number of votes shall bedeclared duly elected. When two or more nominees receive an equal numberofvotestheinalelectionshallbemadebydrawinglotsinsuchmannerastheReturningOficermaydetermine.

ELECTIONSOFMEMBERSFROMTHETELANGANALEGISLATIVEASSEMBLYANDTELANGANA

LEGISLATIVE COUNCIL

39.TheprocedureshallbethatprescribedinStatutes37and38(i)to(iv)(c)andalsothefollowingStatutes.

40.(i)Ifthenumberofcandidateswhoarevalidlynominatedandwhohavenotwithdrawntheircandidatureinthemannerandwithinthetimespeciied,doesnotexceedthenumberofvacanciestobeilled,allsuchcandidatesshallbedeclaredulyelected.

(ii) Ifthenumberofsuchcandidatesislessthanthenumberofvacanciestobeilledallsuchcandidates.Shallbedeclareddulyelected;andtheconstituencyshallbecalledupontoelectapersonorpersons,asthecasemaybe,toilltheremainingvacancies.

(iii) Iftheconditionsstipulatedinclauses(i)and(ii) abovearesatisiedandsubjecttothestipulationthatthecandidateorcandidatesexpressinwritingatorbeforethetimeofscrutinyofthenominations,theirintentionnottowithdrawtheircandidature,theReturningOficerorotherpersonauthorisedbyhim,may

declare, on the last day and hour ixed for scrutiny of nominations, all suchcandidatesdulyelected.

(iv) If thenumberofsuchcandidatesexceedsthenumberofvacanciestobeilled,theelectionshallbeproceededwithinthenumberprescribedinthefollowingStatutes.

(v) The Registrar or the Returning Oficer shall send to each electorbypost(1)anumberdeclarationpaper,(2)aballotpaperwhichshallcontainsthenamesofthecandidateswiththeiraddressesarrangedinalphabeticalorderandwhichshallalsobearonittheRegistrar’sortheReturningOficer’sinitialsandthedateofposting,(3)aballotpapercover(smallercover)(4)anumberedenvelopeaddressedtotheRegistrarortheReturningOficer,and(5)aletterofintimationstatingthenumberofvacanciestobeilled, thedateandhourixedforthepoll,andtheplace,thedayandhourixedforthescrutinyandcountingofvotes.The ballotpapersshallbesentbyposttotheaddressenteredagainstthenameoftheelectorintheelectoralroll,oriftheelectorhassincethepublicationorpreparationof therollchangedhisaddressandintimatedthefact inwritingtheRegistrarortheReturningOficernotlaterthanfourteendaysbeforethedateixedforthedespatchoftheballotpaper,totheaddresssogiven.

(vi)Thedateixedforthepollshall,benotlessthanfourteencleardaysafterthedateoftheballotpaper.

(vii) Theelectorshall,afterillingupthedeclarationpaperandtheballotpaperinaccordancewiththedirectionsgivenintheletterofintimation,(1)enclosetheballotpaperintheballotpapercover(smallercover)andstickit,and(2)puttheballotpapercoverandthedeclarationpaperintheenvelopeaddressedtotheRegistrarortheReturningOficerand(3)sendtheenvelopebyregisteredpost,soastoreachtheRegistrarortheReturningOficer,notlaterthanthedayandthelatesthourixedforthepoll.

Provided that, athisoption, theelector,mayeither inpersonorbyanagentdepositor causetobedepositedtheenvelopeaddressedto theRegistrarortheReturningOficerintheballotboxprovidedforthepurposeonthedayandduringthehoursixedforthepoll.Thenumberforwhomeachelectormayvotemaybelessthan,orequalto,butshallnotbemorethan,thenumberofvacanciestobeilled.

(viii) An elector who has not received his ballot and other connectedpaperssentbypost,orwhohaslostthem,orwhosepapers,beforetheirdispatchbacktotheRegistrarortheReturningOficerbyhim,-havebeeninadvertentlyspoilt,maytransmitadeclarationtothateffectsignedbyhimselfandrequiretheRegistraror theReturningOficer tosendhimnew(duplicate)papers inplaceofthosenotreceived,lostorspoilt;andifthepapershavebeenspoilt,thespoiltpapersshallbereturnedtotheRegistrarortheReturningOficershallcancelthemonreceipt.Ineverycasewhennewpapersareissued,theyshallbesubscribedas“Duplicate”andamarkshallbeplacedagainstthenumberoftheelector’snameintheregisterofelectoralroll todenotethatnew(duplicate)papershavebeenissuedinplaceofthosenotreceived,-lostorspoilt.

(ix) OnthedayandatthehourappointedforthescrutinyandcountingofvotestheenvelopesreceivedthroughpostfromtheelectionsbytheRegistrarortheReturningOficerandthosedepositedintheballotboxshallbescrutinisedandforthispurposetheprocedureprescribedinclauses,(xi)and(xii) ofstatute38shallbeapplicable.

(x) All voters shall be entitled to vote. Each voter shall have onetransferablevote.

(xi) Theballotpaper cover,other than those rejectedunder clause (ix) above shall be opened and the ballot papers taken out and mixed together inthepresenceoftheReturningOficer.Heshallthenproceedtocountthevotes,rejectingasinvalidandballotpaper.

(a) ifitdoesnotbeartheinitialsoftheRegistrar,or

(b) ifavotersignshisnameorwritesanyword,ormakesandmark,bywhichitbecomesrecognizable;or

(c)iftheigureIisnotmarked;or

(d) iftheigureIissetoppositetothenamesofmorethanonecandidate;or

(e) iftheigure1andsomeotherigurearesetoppositetothenameofthesamecandidate,or

(f)ifitisvoidforuncertainity;or

(g) ifitviolatesanyotherstatute.

Oneverypapersorejected,theReturningOficershallendorsetheword“Invalid”andsuchpapershallbekeptinaseparatebundle.

(xii) The Returning Oficer shall arrange the ballot papers (other thaninvalidpapers) inparcelsaccording to theirstpreference recorded therein foreachcandidate.Heshallthencountthenumberofpapersineachparcelandcrediteachcandidatewithonevoteinrespectofeachpaperonwhichairstpreferencehasbeen recorded forhim.TheReturningOficer shallalsoascertain the totalnumberofvalidpapersinalltheparcelssoarranged.

(xiii) TheReturningOficershall thendivide the totalnumberofvalidpapersinalltheparcelsbyanumberexceedingbyonethenumberofvacanciestobeilledandtheresultincreasedbyone,disregardinganyfractionalremainder,shall be the number of Votes suficient to secure the return of a candidate(hereinaftercalledthe“Quota”).

(xiv) If,atanytime,anumberofcandidatesequaltothenumberofpersonstobeelected,hasobtainedthequota,such,candidatesshallbedeclaredasdulyelectedandnofurtherstepsshallbetaken.

(xv) Ifatanytimethenumberofvotescreditedtoacandidateisequaltoorgreaterthanthequota,thatcandidateshallbedeemedelected.

(xvi) Ifthenumberofthepapersintheparcelofsuchacandidateisequaltothequota,thepapersshallbesetasideasinallydealtwith.

(xvii) (1)Ifthenumberofvotescreditedtoanelectedcandidateisgreaterthanthequota,thesurplusshallbetransferredinaccordancewiththeprovisionsofthisStatutestothecontinuingcandidates,indicatedontheballotpapersintheparceloftheelectedcandidateasbeingnextinorderofthevoter’spreference.

(2)(a) Ifthevotescreditedtoanelectedcandidateconsistoforiginalvotesonly,theReturningOficershallexamineallthepapersintheparceloftheelectedcandidatewhosesurplus is tobe transferredandshallarrange theunexhaustedpapersinsub-parcelsaccordingtothenextpreferencesrecordedthereon.

(b) If thevotescredited toanelectedcandidateconsistoforiginalandtransferredvotesoroftransferredvotesonly,theReturningOficershallexaminethepaperscontainedinthesub-parcellastreceivedbytheelectedcandidateandshallarrangetheunexhaustedpapersthereininfurthersub-parcelsaccordingtothenextpreferencesrecordedthereon.

(c)Ineithercase,theReturningOficershallmakeaseparatesub-parcelof the exhaustedpapers and shall ascertain thenumberofpapers in each sub-parcelofunexhaustedpapersandinthesub-parcelofexhaustedpapers.

(3)Ifthetotalnumberofpapersinthesub-parcelsofunexhaustedpapersisequaltoorlessthanthesurplus,theReturningOficershalltransfereachsub-parcelofunexhaustedpaperstothecontinuingcandidateindicatedthereonasthevoter’snextpreference.

(4) (a) If the total number of unexhausted papers is greater than thesurplus,theReturningOficershalltransferfromeachsub-parcelthenumberofpaperswhichbearsthesameproportiontothenumberofpaperswhichbearsthesameproportiontothenumberofpapersinthesub-parcelasthesurplusbearstothetotalnumberofunexhaustedpapers.

(b) Thenumberofpaperstobetransferredfromeachsub-parcelshallbeascertainedbymultiplyingthenumberofpapersinthesub-parcelbythesurplusanddividingtheresultbythetotalnumberofunexhaustedpapers.Anoteshallbemadeofthefractionalparts,ifany,ofeachnumbersoascertained.

(c) If, owing to the existence of such fractional parts, the number ofpaperstobetransferredislessthanthesurplus,asmanyofthesefractionalpartstakenintheorderoftheirmagnitude,beginningwiththelargest,asarenecessarytomakethetotalnumberofpaperstobetransferredequaltothesurplus,shallbereckonedasthevalueofunity,andtheremainingfractionalpartsshallbeignored.Iftwoormorefractionalpartsareofequalmagnitude,thatfractionalpartshallbedeemedtobethelargerwhicharisesfromthelargersub-parcelandifthesub-parcelsinquestionareequalinsizepreferenceshallbegiventothecandidatewhoobtainedthelargernumberoforiginalvotes.

(d)Theparticularpaperstobetransferredfromeachsub-parcelshallbethoselastieldinthesub-parcel.

(e)Eachpapertransferredshallbemarkedinsuchamannerastoindicatethecandidatefromandtowhomthetransferismade.

(5)(a) Ifmorethanonecandidatehasasurplusthelargestsurplusshallbeirstdealtwith.

(b) Iftwoormorecandidateshaveeachthesamesurplusregardshallbehadtothenumberoforiginalvotesobtainedbyeachcandidateandthesurplusofthecandidatecreditedwiththelargestnumberoforiginalvotesshallbeirstdealtwithandifthenumbersoftheoriginalvoteareequal,theReturningOficer,athisdiscretion,shalldecidewhichsurplushewillirstdealtwith.

(c) The Returning Oficer need not transfer the surplus of an electedcandidatewhenthatsurplus,togetherwithanyothersurplusnottransferred,islessthanthedifferencebetweenthetotalofthevotescreditedtothetwocontinuingcandidateslowestonthepoll.

(xviii) (1)If,atanytime,nocandidatehasasurplus(orwhenundertheproceedingStatute anyexisting surplusneednot tobe transferred) andoneormorevacanciesremainunilled,theReturningOficershallexcludefromthepoll,the candidate creditedwith lowest number of votes, and shall examine all thepapersofthatcandidate,andshallarrangetheunexhaustedpapersinsub-parcelsaccordingtothenextpreferencesrecordedthereonforthecontinuingcandidates,andshall transfereachsub-parcel to thecandidateforwhomthatpreferenceisrecorded.TheReturningOficershallmakeaseparatesub-parceloftheexhaustedpapers.

(2)Ifthetotalofthevotesofthetwoor‘morecandidate-lowestonthepoll,togetherwithanysurplusvotesnottransferredislessthanthevotescreditedto thenexthighest candidate, theReturningOficer, inoneoperation, excludethose candidates from the poll and transfer their votes in accordancewith theprecedingclause.

(3)If,whenacandidatehastobeexcludedunderthisStatute,twoormorecandidateshaveeachthesamenumber-ofvotesandarelowestonthepoll,regardshallbehadtothenumberoforiginalsvotescreditedtoeachofthosecandidatesand the candidatewith fewest original votes shall be excluded, andwhere thenumberoftheoriginalvotesareequal,regardshallbehadtothetotalnumberofvotescreditedtothosecandidatesattheirsttransferatwhichtheyhadunequalnumberofvotesandthecandidatewiththelowestnumberofvotesatthattransfershall be excluded andwhere the number of votes credited to those candidateswereequalatalltransfers,theReturningOficershalldecidebycastinglotswhichcandidateshallbeexcluded.

(xix) (1) Whenever any transfer is made under any of the proceedingclauses,eachsub-parcelofpaperstransferredshallbeaddedtotheparcel,ifany,ofthepapersofthecandidatetowhomthetransferismade,andthatcandidate

shallbecreditedwithonevoteinrespectofeachpapertransferred.Suchpapersasarenottransferred,shallbesetasideasinallydealtwithandthevotesgiventhereonshallthenceforth,notbetakenintoaccount.

(2)If,afteranytransfer,acandidatehasasurplus, thatcandidateshallbedeclaredelectedandthesurplusshallbedealtwiththemannerhereinbeforeprovidedbeforeanyothercandidateisexcluded.

(xix) (a)(1)Whenthenumberofcontinuingcandidatesisreducedtothenumberofvacanciesremainingunilled,thecountingcandidatesshallbedeclaredelected.

(2)Whenonlyonevacancy remainsunilled,and thenumberofvotesofacountingcandidateexceedsthetotalofallthevotesoftheothercontinuingcandidates,togetherwithanysurplusvotesnottransferred,thatcandidateshallbedeclaredelected;

(3)Whenattheendofanycount,onlyonevacancyremainsunilledandthereareonlytwocontinuingcandidatesandeachofthemhasthesamenumberofvotesandnosurplusvotesremaincapableoftransfer,thereturningoficershalldecidebylotwhichofthetwocandidatesshallbeexcluded;andafterexcludinghiminthemanneraforesaid,declaretheothercandidatetobeelected.

(xx) TheReturningOficershallthendeclarethenamesofthecandidateswhohavebeendulyelected.

(xxi) Anycandidateorhisagentmayat. any timeduring thecountingofvotes,eitherbeforethecommencementoraftercompletionofanytransferofvotes(whethersurplusorotherwise),requesttheReturningOficertoreexamineandrecountthepapersofalloranycandidate(notbeingpaperssetasideatanyprevioustransferasinallydealtwith),andtheReturningOficermayalsoathisdiscretionrecountvoteseitheronceormoreoften,inanycase,inwhichheisnotsatisiedastotheaccuracyofanypreviouscount,providedthatnothinghereinshallmakeitobligatoryonthepartoftheReturningOficertorecountthesamevotesmorethanonce.

Intheabovestatutes:

(1) “Continuing Candidate” means any candidate not elected or notexcludedfromthepollatanygiventime.

(2)“Firstpreference”meanstheigure“1“,Secondpreference”meanstheigure“2”“thirdpreference”meanstheigure“3“andsoon,setoppositetothenameofanycandidate.

(3) “Unexhausted papers” means ballot papers on which a second orsubsequentpreferenceisrecordedforacontinuingcandidate.

(4)“Exhaustedpapers”meansballotpapersonwhichnosecondorsubsequentpreferenceisrecordedforacontinuingcandidate.

Providedthataballotpapershallalsobedeemedtobeexhaustedinanycaseinwhich:-

1.TheseStatutesshallapplytoalloficersoftheUniversityotherthantheVice-Chancellorsubjecttotheprovisionsofsub-section(6)ofsection43oftheProfessorJayashankarTelanganaStateAgriculturalUniversityAct,1963.

2.Deinitions:- (i)IntheseStatutes,unlesscontextother-wiserequires:

a) ‘Appointing authority’ means the authority competent to makeappointmenttothepostsofanoficeroftheUniversity.

b) ‘Cadre’meansthestrengthofaserviceorapartofaservicesanctionedasaseparateunit.

c)‘Duty‘includesserviceasaprobationerprovidedthatsuchserviceisfollowedbyconirmation.

d) ‘Earnedleave‘meanstheleaveearnedinrespectoftheperiodspentonduty.

e) ‘ Lien ‘ means the title of an oficer of the University to holdsubstantivelyeitherimmediatelyorontheterminationofaperiodorperiodsofabsents,apermanentpost,includingatenurepost,towhichhehasbeenappointedsubstantively.

f)‘Oficer’meansanoficeroftheUniversityasdeinedinsection9ofthePJTSAUAct,1963.

g) ‘ Pay‘meanstheamountdrawnmonthlybyanoficeras(i)thepaywhichhasbeensanctionedforthepostheldbyhim,inasubstantiveoficiatingortemporarycapacity,(ii)specialpayorpersonalpay,ifany;and(iii)anyotheremolumentswhichmaybespeciallyclassiiedaspay.

h) ‘Permanentpost’meansapostcarryingadeiniterateofpaysanctionedwithoutalimitoftime.

i)‘Temporarypost’meansapostcarryingadeiniterateofpaysanctionedforalimitedtime.

j) ‘Tenurepost’meansapermanentpostwhichanindividualoficermaynotholdformorethanalimitedperiod.

(ii) WordsandexpressionsnotdeinedintheseStatutesandusedintheActortheFirstStatutesshallhavethemeaningassignedtothemintheActortheFirstStatutesasthecasemaybe.

3.Temporary appointment:- (i)WhereitisnecessaryintheinterestoftheUniversitytoillemergentlyavacancyinanypostandiftheillingofsuchvacancyinaccordancewiththeStatutesislikelytoresultinunduedelay,theappointingauthoritymayappointapersontemporarilyotherwisethaninaccordancewiththesaidStatutesunlessotherwiseprovided.

(ii)Noappointmentunderclause(i)shallordinarilybemadeofpersonwhodoesnotpossessthequaliications,ifany,prescribedforthesaidpost.Everypersonwhodoesnotpossesssuchqualiicationsandwhohasbeenorisappointedunderclause(i)shallbereplacedassoonaspossiblebyapersonpossessingsuchqualiications.

4. Medical Certiicate of itness:- a) NopersonshallbeappointedtoapostwithoutamedicalcertiicateofHealthintheformprescribedinAppendixfromaGazettedMedicalOficerorHonoraryMedicalOficerofequalstandingoraRegisteredMedicalPractitioner:

ProvidedthatifanoficerhasalreadyproducedamedicalcertiicateofitnessatthetimeofhisirstappointmenttoanypostintheUniversityServiceno further medical certiicate should ordinarily be required for subsequentappointmenttoanyotherpost.

b) The following classes of Oficers shall be exempt from producingMedicalCertiicatesofFitness:

i)OficersondeputationwiththeUniversity;and

ii)Oficersappointedintemporaryvacanciesforaperiod;notexceedingsixmonths.

5.Probation: a) Exceptinthecaseofappointmentsmadeontenureoroncontractorondeputationorontemporarybasis,alloficersoftheUniversityshallonappointmenttoanypost,beonprobationforaperiodofoneyearondutywithinacontinuousperiodoftwoyears.

b) Commencement of probation: If a person having been appointedtemporarilytoapost,otherwisethaninaccordancewiththeStatutesgoverningappointment thereto, is subsequently appointed to the post in accordancewiththeStatutes,heshallcommencehisprobationfromthedateofsuchsubsequentappointment or from such earlier date as the appointing authority maydetermine.

c) Extension or termination of probation :Ifwithintheperiodofprobation,aprobationerfailstoacquirethespecialqualiicationsortopassthespecialtests,ifany,aslaiddownintheStatutesorintheorderoftheappointment,theappointingauthoritymay,eitherreverthimtotheformerpost,ifany,orbyorderdischargehimfromservicewith-outnoticeorextendtheperiodofprobation,providedthatnoprobationershallbecontinuedonprobationformorethantwoyears.

d) Discharge of a probationer:NotwithstandinganythingintheseStatutesthe appointing may, at any time before the expiry of the period of probation,suspendtheirprobationofaprobationeranddischargehimforwantofavacancyor at its discretion by order extend the period of probation of the probationerin case theprobationhasnotbeen extendedunder clause (c), or terminatehisprobation and discharge him from service after giving one month’s notice orpayingonemonth’spayinlieuofsuchanotice.

Note: Incasewherethedischargeofaprobationerismaderevertinghimtohisloweroficiatingorsubstantivepost,thepayinlieuofonemonth’snoticeshallbelimitedtothedifferenceinpaybetweenthe oficiating post and of the lower oficiating or substantiveposttowhichheisreverted.

Probationer’s suitability for full membership:

a) Attheendoftheprescribedorextendperiodofprobation,asthecasemaybe, theappointingauthorityshallconsidertheprobationer’ssuitabilityforfullmembershipoftheserviceforwhichhewasselected.

b) Iftheappointingauthoritydecidesthataprobationerissuitableforsuchmembership,itshall,assoonaspossible,issueanorderdeclaringtheprobationerto have satisfactorily completedhis probation.On the issueof suchorder, theprobationershallbedeemedtohavesatisfactorilycompletedhisprobationonthedateofexpiryoftheprescribedorextendedperiodofprobation.

c) Iftheappointingauthoritydecidesthattheprobationerisnotsuitableforsuchmembership,byreasonsofconductorunsatisfactoryworkoranyothergoodreason,itshall,unlesstheperiodofprobationisextendedunderStatute(5)(c),byorder,dischargehimaftergivinghimonemonth’snoticeorpayingonemonth’spayinlieuofsuchanotice.

Note: (i)Anydelayintheissueofanorderdischargingaprobationerunder clause (c) or under clause (v) of Statute 5 above shallnot entitle him to be deemed to have satisfactorily completedhis probation or shall not be deemed to be an extension ofprobation.

ii)Incasewherethedischargeofaprobationerismaderevertinghim to lower oficiating post or substantive post, the pay inlieuofonemonth’snoticeshallbe limited to thedifference inpaybetweentheoficiatingpostandoftheloweroficiatingorsubstantiveposttowhichheisreverted.

7.Oficers absent from duty: Theabsenceofanoficerfromdutywhetheronleaveoronforeignserviceorforanyotherreasonsandwhetherhislieninapostissuspendedornot,shallnotifheisotherwiseit,renderhimineligibleinhisturnforreappointmenttoasubstantiveoroficiatingvacancyinthepostinwhichhemaybeaprobationeroranapprovedprobationer.

8.Pension-cum-provident fund:Theoficersof theUniversity shall beentitledtosuchretirementbeneitsasmaybeprescribedundersection33ofthePJTSAUAct,1963.

9. Penalties: i) The following penalties may, for good and suficientreasonsbeimposeduponanyoficeroftheUniversity,namely:

a) Censure:

b) withholdingofincrementsincludingstoppageatanyeficiencybar,ifany;

c) reductiontolowerpost;

d) recoveryfrompayofthewholeorpartofanypecuniarylosscausedtotheUniversitybynegligenceorbreachoforder;

e) suspension to the extend contemplated in clause (v) of Statute 11below:

f)removalfromtheserviceoftheUniversitywhichdoesnotdisqualifyhimforfutureemployment;

g) dismissalfromtheserviceoftheUniversitywhichordinarilydisqualifyhimforfutureemployment.

Providedthatwhereitisproposedtotakeactionasmentionedinitems(f)and(g)above,incaseofanoficerinforeignservicewiththeUniversity,arecommendation to that effect shall bemade to the lending authority for suchactionasitconsidersnecessary.

ii)AnoficermaybeplacedundersuspensionfromtheUniversityservicepending investigationor enquiry intograve charges,where such suspension isnecessaryintheinterestoftheUniversity;

iii)The authoritywhichmay imposeon anoficer thepenalties of (a)censure (b) withholding of increments or stoppage of eficiency bar and (c)suspension,shallbetheVice-Chancellor.

iv) The authority which may impose on an oficer the penalty of (a)reductiontoalowerpost,or(b)recoveryfrompayofthewholeorpartofanypecuniarylosscausedtotheUniversitybynegligenceorbreachoforders,or(c)removal from service of theUniversitywhich does not disqualify from futureemploymentor(d)dismissalfromtheserviceoftheUniversitywhichordinarilydisqualiiesfromfutureemployment,shallbetheappointingauthority;

v) No penalty shall be imposed unless the oficer has been given areasonableopportunityofshowingcauseagainsttheactionproposedtobetakenagainsthim.

vi) The grounds on which it is proposed to take action under clause(iv)shallbereducedtotheformofadeinitechargeorchargeswhichshallbecommunicatedinwritingtotheoficerconcernedandshallberequiredwithinareasonabletimetostateinwritingwhetherheadmitshetruthofalloranyofthecharges,whatexplanationordefence,ifany,hehastoofferandwhetherhedesires tobeheard inperson. Ifhe sodesiresor if thecompetentauthority sodirectsanoralenquiryshallbeheldatwhichallevidenceshallbeheardastosuchofthechargesasarenotadmitted.Thepersonschargedshallbeentitledtocross

examinethewitnesses,tohavesuchwitnessescalledashemaywish,providedthattheOficerconductingtheenquirymayforreasonstoberecordedinwritingrefusetocallanywitness.Theproceedingsshallcontainsuficientrecordofthisevidenceandastatementoftheindingsandthegroundsthereof.

vii)Nooficerwhoiscalledupontoproducehisdefenceastochargeswhich form thesubjectofanyenquiryagainsthimshallbeallowed toengagecounsel.

viii)Aftertheenquiryagainstanoficerhasbeencompletedandafterthepunishingauthorityhasarrivedataprovisionalconclusioninregardtothepenaltytobeimposedisdismissalorremovalfromservicebesuppliedwithacopyofthereportoftheenquiryauthorityandhewillbecalledupontoshowcausewithina reasonable time, not ordinarily exceeding one month, against the particularpenalityproposedtobeinlicateduponhim.Anyrepresentationsubmittedbytheaccused in this behalf shall be taken into considerationbeforeinal orders arepassed.

10.Appeal: AnappealagainsttheorderpassedbytheVice-Chancellorunderclause(iii)ofstatute9shalllietotheappointingauthority,providedthatitispreferredwithinaperiodofninetydaysfromthedateoftheorderappealedagainst.

11. Allowances and leave during suspension : (i) An Oficer undersuspensionshallbeentitledtosubsistenceallowanceatanamountequaltoleavesalaryanddearnessallowance,ifany,whichanoficerwouldhavedrawnIfhehadbeenonleaveonhalfpay;

Providedthattheretheperiodofsuspensionexceedstwelvemonths,theauthority which passed or is deemed to have passed the orders of suspensionshall be competent to vary the amount of subsistence amount for any periodsubsequenttotheperiodoftheirsttwelvemonthsasfollows:

a)theamountofsubsistenceallowancemaybeincreasedbyasuitableamount not exceeding ifty per cent of the subsistence allowance admissibleduringtheperiodofirsttwelvemonths,ifintheopinionofthesaidauthority,theperiodofsuspensionhasbeenprolongedforreasonstoberecordedinwriting,notdirectlyattributabletotheOficer.

b) the amount of subsistence allowancemay be reduced by a suitableamount, not exceeding ifty percent of the subsistence allowance, admissibleduringtheperiodoftheirsttwelvemonths,if,intheopinionofthesaidauthoritytheperiodof suspensionhasbeenprolongeddue to reasons, tobe recorded inwriting,directlyattributabletotheOficer.

c)therateofdearnessallowancewillbebasedontheincreasedor,asthecasemaybe,thedecreasedamountofsubsistenceallowanceadmissibleundersub-clauses(a)and(b).

(ii)Nopaymentunderclause(i)shallbemadeunlesstheOficerfurnishes

acertiicatethatheisnotengagedinanyotheremployment,business,professionorvocation.

(iii)AsuspendedOficershallnotbeentitledtoanyleavefortheperiodofsuspension.

(iv)Arrearsofsubsistenceduetoanoficershallnotbewithheld,butitshallbepaidtohimafteradjustingthesameagainstthefollowingamounts,ifany,duebyhimtotheUniversity.

(a)houserentandalliedcharges,i.e..Electricity,Water,Furnitureetc.

(b)repaymentofloansandadvancestakenfromtheUniversityatsuchratesastheUniversitymayix;

(c)overpaymentshavingdueregardtothecircumstancesofeachcase.Recoveries of over payments from the Oficer under suspension should notordinarilybemadeatarategreaterthanonethirdoftheamountofsubsistenceallowance,exclusiveofdearnessallowance, ifany,admissibleunderclause(i)above,

(v)Ifanoficerundersuspensionisdismissedorremovedfromservice,arrearsofsubsistenceallowance,ifany,duetohimuptothedateofterminationofproceedingsshouldbepaidtohim.

12. Pay on reinstatement after suspension: When an Oficer whowas suspended is inally reinstated, he shall get full pay unless the competentauthorityhasexpresslyorderedadeductiontobemadeforsuspensionperiodasapunishment.

13. Increments and eficiency bar :

1)Anincrementshallordinarilybedrawn,asamatterofcourse,butthecompetentauthoritymaywithholdtheincrementiftheconductoftheoficerhasnotbeengoodorhisworknot foundsatisfactory.Whereaneficiencybarhasbeenprescribedinatimescale,theincrementnextabovetheeficiencybarshallnotbegivenwithoutthespeciic,sanctionoftheappointingauthority.

2)Alldutyinatimescalecountsforincrementsinthattimescale.

3)Serviceinanotherpost,whetherinasubstantiveoroficiatingcapacity,carryingthesameorhighertimescaleofpayandtheserviceonforeignserviceandleaveotherthanextraordinaryleavecountsforincrementsinthetimescaleapplicabletothepostonwhichtheoficerholdsalienorshouldhaveheldalien,hadhisliennotbeensuspended.

Providedthatextraordinaryleavetakenforforeignstudyshallcountforincrement.

4)TheBoardofManagementmay,foradequatereasonsrecorded,grantprematureincrementstoanoficeronatimescaleofpay.

14) Conduct and Discipline:

i)AcceptanceofworkoutsidetheUniversity:AnOficershallordinarilydevote his whole time to the service of the University and shall not withoutexpresspermissionoftheVice-ChancellorengagedirectlyinanytradeorbusinesswhatsoeveroranyotherworkwhichintheopinionoftheVice-Chancellormayinterferewiththeproperdischargeofhisduties.

ii) General Conduct: NooficershalltakepartinanyactormovementcalculatedinthejudgementoftheVice-ChancellortobringtheUniversityintodisrepute.ItshallbethedutyofeveryoneoftheOficerstohonourtheconidencereposed inhimby theUniversity andnot todivulgeany informationobtainedbyhiminthecauseofhisoficialdutiestooutsidersortomakeanyusethereofwhichwouldbeimproper.

iii) Discussion of the policy or action of the University :

TheOficersoftheUniversityshallnotindulgeinanypubliccriticismof the University Administration in such manner as savours of deiance andInsubordinationorcauseorislikelytocauseembarrassmenttotheadministrationinitsrelationtoitsstafforstudentsoftheColleges.Norshallitbepermissibleforthemtoindulgeincriticisms,whichwillembarrasstheUniversityadministrationin its relation tomembersof thedifferent communities among the staffor thestudents.

iv) Taking part in politics :(a)AnOficeroftheUniversityshallnottakepartinpoliticsorstandforelectionsunlessBoardofManagementissatisiedthatintheirconductanddemeanourtheywillobservetherestaint,dignityandcourtesyenjoinedbytheUniversitytraditionsandunlesstheBoardofManagementisfurthersatisiedthattheirpoliticalandotherpublicactivitiesdonotconlictorinterferewiththeirdutiestotheUniversity.ThedecisionoftheBoardofManagementinthesemattersisinal.

b)IfanOficeroftheUniversitybyspeechesorotherwiseseekstomisleadthestudentsintoactivitieswhichinthejudgementoftheBoardofManagementareobjectionable,heispunishableforderelictionofduty.

v) General Discipline :AllOficersoftheUniversity,whetherpaidasalaryornotorwhetherinreceiptofhonorariaorallowancesandwhetherfulltimeorparttime,beheldtobeundertheGeneralinternaldisciplineoftheUniversityandsuchrulesofdisciplinesasareenforced,orasmaybemade,fromtimetotime.

vi) Lending and Borrowing :Nooficershall-

a)directlyorindirectlyengagedinthebusinessofmoneylending;

b)saveintheordinarycourseofbusinesswithabankorcorporationorairmofstanding,borrowmoneyfromorotherwiseplacehimselfunderpecuniaryobligationtoanypersononwhomhecanexerciseoficialauthority;

ix) Movable and immovable property :(a)NoOficershallexceptafterpreviousintimationtotheVice-Chancellor,acquireordisposeofanymoveableproperty in the shape of shares, securities or debentures of any immovableproperty,byloansmortgage,sales,giftorotherwiseeitherinhisownnameorinthenameofanymemberofhisfamily.

Provided that this restriction shall not apply in the case of moveableor immoveable property whose value does not exceed Rs. 1,000 (Rupees onethousandonly.)

b)TheBoardmay, at any timebygeneralor special order, require itsOficerstosubmitwithinaperiodspeciiedinthesaidorder,afullandcompletestatementofsuchmoveableorimmoveablepropertyheldoracquiredbyhimorbyanymemberofhisfamilyasmaybespeciiedintheorder.Suchstatementsshall,ifsorequiredbytheBoard,includedetailsofthereasonsbywhichorthesourcefromwhichsuchpropertywasacquired.

Note: Forpurposesofthisstatute,‘family’includesthewifeorhusbandandchildrenincludingadoptedsonandstepchildrenofanoficerresidingwithorwhollydependentonhim.

x) Vindication of acts and character of the Oficers of the University,NoOficershall,without theprevioussanctionof, theBoard,haverecoursetoanyCourt or to thepress for vindicationof his public acts or character fromdefamatoryattacks.IngrantingsanctiontotherecoursetoacourttheUniversity,willineachcase,decidewhetheritwillitselfbearthecostsoftheproceedingsorwhethertheoficerwillinstitutetheproceedingsathisownexpenseandifso,whetherintheeventofadecisioninhisfavourtheUniversitywillreimburseto

NothinginthisstatutewilllimitorotherwiseeffecttherightofanyOficertovindicatehisprivateactsorcharacter.

(xi) Taking part in strikes or similar activities :NoOficershalltakepartinanyactormovementsuchasstrike,incitementtheretoorasimilaractivityinconnectionwithanymatterpertainingtohisserviceortoanyothermatter,whichtendstobringtheUniversitytodisrepute.

xii) Inluencing superior authorities for furtherance of Interest: NoOficer shall bringor attempt tobring anykindof inluence tobearuponanysuperioroficeroramemberofanyUniversityauthoritytofurtherhisinterestsinrespectofmatterspertainingtohisserviceintheUniversity.

15. Lien: i)An Oficer when appointed substantively to a permanentpost,acquireslienonthatpostandceasestoholdanylienpreviouslyacquiredinanyotherpost;

ii)An Oficer shall not be appointed substantively to a post in whichanotheroficerholdsalien;

iii)TwoormoreUniversityemployeesshallnotbeappointedsubstantivelyonthesamepermanentpostatthesametime.

iv) Suspension of lien :TheBoardmay,atitsoption,suspendthelienofanoficeronapermanentpostwhichheholdssubstantivelyifheistransferredwhetherinasubstantiveoroficiatingcapacitytoapostinanothercadreandifthereisreasontobelievethathewillremainabsentfromthepostonwhichheholdsalienforaperiodofnotlessthanthreeyears.

16. Declaration of Age : AnOficerappointedbydirectrecruitmentshallmake a declaration of age to the appointing authority at the time of his entryinto theserviceof theUniversitybasedonhisS.S.L.C Registerorsuchotherdocumentaryproofasmaybeacceptabletotheappointingauthorityuponwhichtheagewillbeadmitted.Afterthedeclarationofageandacceptanceofthesamebytheappointingauthority,itshallbebindingonhimandnorevisionofsuchageshallbeallowedtobemadeatalaterdateforanypurposewhatsoever.

17. Termination of Service or Resignation :i)TheServicesofatemporaryoficerwhohasnotbeenappointedinaccordancewiththeprocedureprescribedintheActortheStatutesareliabletobeterminatedatanytimewithoutnoticeandwithoutassigninganyreasonstherefor.

ii)ApermanentOficershallberequiredtogivethreemonthsnotice,incasehedesirestoberelievedorheshallpaytotheUniversitythreemonthssalaryinlieuofsuchnotice,unlessotherwisedirectedbytheBoardofManagement,

iii)AnOficerbeforeleavingtheUniversityserviceshallhandoverthechargeofhisposttoadulyauthorisedOficerandshallreturntotheuniversityallbooks,apparatus,furniture,etc.,issuedtohimforhispersonaluseandshallpay

upinfull,allthechargesduefromhimforoccupationofresidentialquarteretc.Ifhefailstodoso.theamountduefromhimontheaboveitemsshallberecoveredfromhislastsalaryortheProvidentFundoranyothersumsduetohim.

iv)AnOficerwhoisintheoccupationofresidentialaccommodationoftheUniversity shall, on leaving serviceof theUniversity,vacate the residenceallottedtohimbytheUniversity.

18. Leave: Leave cannot be claimed as of right.When the exigenciesofservicesorequired,discretiontorefuseorrevokeleaveofanydescriptionisreservedtotheauthorityempoweredtograntit.

19. Authority to Grant Leave : TheVice-ChancellorshallbethecompetentauthoritytograntleavetoallOficers.

20. Earned leave: (i)The earned leave admissible to an oficer of theuniversity shall be 1/11th of the period spent in the service of theUniversity,providedthathewillceasetoearnsuchleavewhentheearnedleaveaccumulatesto300daysandprovidedfurtherthatthislimitof300dayswillnotbeapplicableinthecaseofOficers!ondeputationwiththeUniversityonforeignserviceterms,whowillcontinuetobegovernedbytherulesapplicabletothemintheirparentdepartment.

21. Medical Leave and Leave on Private Affairs : Leave on medicalcertiicateandleaveonprivateaffairsmaybegrantedtoanOficeratanytimeaccording to the rules of the Government of Telangana and subject to suchlimitationasthecompetentauthoritymay,ineachinstanceinwhichsuchleaveisappliedfor,determine.

22. Extraordinary Leave: Thecompetentauthoritymayinitsdiscretion,foranyspecialreasongrantanOficerextraordinaryleaveofabsence,butsuchleaveshallbewithoutpayandshallnotordinarilyexceedsixmonthsatatimeandshallalsonotcounttowardsgratuity.

Provided that themaximum total period forwhich such leavemaybegrantedshallnotordinarilyexceedtwoyears.

23. Maternity Leave:Subjecttotheconditionsherein-afterspeciied,thecompetentauthoritymaygranttomarriedwomen,maternityleaveforaperiodwhich may extent upto two months. Non-permanent Oficers should take formaternitypurposestheearnedleaveforwhichtheymaybeeligible.Ifhoweveranon-permanentOficerisnoteligibleforanyearnedleaveoriftheleavetohercreditislessthantwomonths,maternityleavemaybegrantedforaperiodnotexceedingtwomonths,orfortheperiodthatfallsshortoftwomonths,asthecasemaybe.

Note: 1)Approvedprobationersmayalsobegrantedmaternityleaveasfor permanentemployees;

3.AstudentforadmissionshallnotbepermittedtoattendclassesuntilallthefeesprescribedbytheUniversityandotheramountsduearepaid.

4.AnyfeeoncepaidshallnotberefundedexceptinaccordancewiththerulesestablishedbytheUniversitywithrespecttocoursetransfersanddrops.

5.TheBoardmaymakeregulationsregardingtheexemptionofstudentsfrompaymentofanyofthefeeseitherinwholeorinpartongroundsofpovertyand/ormerit.

The conditions of service, remuneration and allowances including travelling and daily allowances to be paid to oficers, teachers and other persons employed under the university :

6.Thescalesofpayandotherallowancesforvariouspostsofoficers,teachersandotheremployeesoftheUniversityshallbeasmaybedeterminedbytheBoardintheRegulationswiththepriorwrittenapprovaloftheGovernment.

Provided that in ixing the scales of pay of the posts of teachers therecommendationsoftheUniversityGrantsCommissionshallbekeptinview.

ProvidedfurtherthatthesanctionedemolumentsofanypostsshallnotbevariedatanytimetothisdisadvantageoftheoficerorteacherorotheremployeeoftheUniversityholdingapost.

7.UntilthescalesofpayandotherallowancesaredeterminedbytheBoardinaccordancewithStatute6above,theOficers,teachersandotheremployees,whobecametheemployeesoftheUniversitywithreferencetotheprovisionsofsub-section(6)ofSection43oftheAct,shallcontinuetobegovernedbytherulesregardingpayandotherallowancesbywhichtheyweregovernedimmediatelybeforethe10thJuly,1964.

8.Thestartingsalaryofanypersonappointedtoapostshallordinarilybetheminimumofthetimescaleofthatpost.TheBoardmay,inappropriatecases,grantahigherstart.

9.TheconditionsofserviceoftheteachersandotheremployeesoftheUniversityshallbesuchasmaybedeterminedbytheBoardofManagementandlaiddownintheRegulation.

Provided that the conditions of service shall not be varied to theirdisadvantageaftertheirappointment.

10.Until the conditionsof service aredeterminedby theBoardunderStatute9aboveanduntil theoptionprovidedunder sub-section (6)ofSection

43oftheAct,isexercisedbytheteachersandotheremployees,whobecametheemployeeswithreferencetosub-section(6)ofSection43,theyshallbegovernedbytheconditionsofserviceapplicabletothemimmediatelybeforethe10thJuly,1964.

11.TheteachersandotheremployeesappointedbydirectrecruitmentintheUniversityshalluntiltheserviceconditionsandpayscalesareprescribedbytheBoard,begovernedbythoseapplicabletotheemployeesoftheGovernmentofTelanganainthecorrespondingcategories.

12.NotwithstandinganythinginthoseStatutes,theOficers,teachersandother employees,whose service are borrowed from theStateGovernment, theCentralGovernmentoranyotherbodiesonthetermsandconditionsprescribedbythemforoficersonforeignserviceoroncontractbasisshallbegovernedbythetermsoftheirappointment.

13.AllOficers,teachersandotheremployeesoftheUniversityarefulltimeemployeesof theUniversityand theyshallnotbeentitled,asamatterofright,toanyextraremunerationforanyextraworkallottedtothem.TheBoardshallhave,however,powerstoixanyremunerationthatmaybepayabletotheOficers, teachers and other employees of the University for any extra workallottedtothem.TheBoardmayalsomakeRegulationsdelegatingitspowersofixingremuneration,totheVice-Chancellororanyotheroficer.

14.Theoficers,TeachersandotheremployeesmayacceptremunerationinrespectofthefollowingitemsafterobtainingthepriorpermissionoftheVice-Chancellor.

(a) asexaminersinotherUniversitiesandinstitute;

(b) asUniversityCommissionMembers;

(c)suchotheritemsasmaybeapprovedbytheVice-Chancellor.

CHAPTER III

(OTHERMATTERS)

15.Cooption of Members to the Academic Council :

(1)MembersoftheAcademicCouncilasconstitutedundersubsection(1)ofSection21oftheAct,shallsendtheirsuggestionsforcooptiontotheRegistrarbefore suchdates asmaybeixedby theVice-Chancellor.After considerationofthesuggestions,theVice-ChancellorshallplacehisrecommendationsbeforetheAcademicCouncilforapprovaloftheAcademicCouncilshallordinarilybeobtainedatameeting,unless for special reasons, theVice-Chancellor requestsapprovalbycirculation.

(2)Aco-optedmembershallholdoficeforaperiodofnotmorethantwoyearsfromthedateoftheirstmeetingoftheAcademicCouncilprovidedthattheAcademicCouncilshallhavepowerstocooptthesamepersonagainforanotherterm.

16. Daily and Travelling Allowances to the Members of the Board of Management:

ThemembersoftheBoardofManagementshallbeentitledtothedailyandtravellingallowancesforattendingmeetingsoftheBoardortheCommitteesthereofandforperformingotheroficialduties,atsuchratesasmaybelaiddownbytheBoard.

17.Procedure at the Meetings of Academic Council:

The procedure at the meetings of the Academic Council including the quorum for the transaction of business by it shall be laid down by the Board.

4. Procedure for recruitment: The following procedure shall be followed forrecruitmenttovariouscategoriesofteachers,namely:—

b)TheSecretaryoftheSelectionCommittee,underdirectionoftheChairman,mayalsoprocuresuggestionsfromsuchpersons,institutionsandagenciesasmaybedeemedit.

c)When theapplicationsandsuggestions, ifany,mentionedundersub-clauses(a)and(b)havebeenreceived, theSecretaryof theSelectionCommitteeshallpreparealistofallnamesforscrutiny.

d)Afterthepreparationofthelistinsub-clause(c),thecandidatesshallbescreenedby theSelectionCommitteeon thebasisof theirqualiicationsexperienceandotherrelevantrecordsandalsoonthebasisoftheperformanceintheinterviewwhenever considered necessary. iv) (a) The rule of reservation for Scheduled Castes, Scheduled Tribes andBackwardClassesshallbemadeapplicablefordirectrecruitmenttothepostsofTeachersasdeinedinclause(n)ofsection2ofthePJTSAUAct,1963uptothelevelofAssociateProfessor.ThepercentagesofpoststobereservedshallbeaslaiddownbyGovernmentfromtimetotime.

b) The roster system of appointment and the principle of carrying forward ofvacanciesaslaiddownbyGovernmentinRule22oftheTelanganaStateandSubordinateServiceRulesshallbefollowedfordirect recruitment to thepostsmentionedundersub-clause(a).

c)Eachfacultyshallbe treatedasaseparateunit forpurposesofapplying theaboveprincipleofreservation.

d) ThenamesofthecandidatesbelongingtoScheduledCastes,ScheduledTribesandBackwardClasseswhocomeupforselectionasperthenormsfollowedbytheSelectionCommitteebutdonotindplaceinthepanelspreparedaspersub-clause(d)ofclause(i)aswellassub-clause(d)ofclause(ii)ofStatute4shallbeaddedtothepanelsasextranamesattheend,toenabletheappointmentbeingmadeasperroster.

5.Teaching, Research and Extension Wings constitute one unit: TheTeaching,ResearchandExtensionWingsoftheUniversityconstituteoneunitforpurposeofrecruitmentorpromotionsandthetransferofateacherfrompostinonewingtoanequivalentpostinotherwingshallnotbetreatedasrecruitmentorpromotion.These Statutes shall not be applicable for such transfers.TheVice-Chancellorshallbecompetenttotransferateacherfromapostinonewingtoanequivalentpostinanyotherwing.

NOTIFICATION

Inexerciseofthepowersconferredbysection101oftheAndhraPradeshRe-organisation Act, 2014 (Central Act No.6 of 2014), the Government ofTelanganaherebymakesthefollowingOrder,namely:-

4. IntheAcharyaN.G.RangaAgriculturalUniversityAct,1963(ActNO.24of1963),-:

(1) ThroughouttheAct,theexpression“theAcharyaN.G.RangaAgriculturalUniversity Act, 1963”, wherever it occurs, shall be substituted withthe expression “Professor Jayashankar Telangana State AgriculturalUniversity”;

(2) Throughout theAct, the words “Andhra Pradesh” shall be substitutedwiththeword“Telangana”;

(3) Section43shallbesubstitutedwiththefollowing:

“43.PowersofGovernmenttotransfercertaincollegesandinstitutionstothe University :

(1) NotwithstandinganythingcontainedinAcharyaN.G.RangaAgriculturalUniversityAct,1963,theAndhraPradeshUniversitiesAct,1991,orthestatues made there under, all the colleges and polytechnics, and otherresearch and extension institutions located in Telangana State shalldevolvetoProfessorJayashankarTelanganaStateAgriculturalUniversityfromthedatenotiiedintheTelanganaGazettebytheGovernmentinthisbehalf,bedisafiliatedfromAcharyaN.G.RangaAgriculturalUniversityand shall be maintained by the University as constituent Colleges,polytechnicsandotherresearchandextensioninstitutions:

(2) Thecontrolandmanagementofallthecolleges,polytechnicsandotherresearchandextension institutions speciied in sub-section (1) shall asfrom the date notiied by the government under that sub-section standtransferredtotheUniversityandallthepropertiesandassets,andliabilitiesandobligationsof theAcharyaN.G.RangaAgriculturalUniversityandGovernment in relation thereto shall stand transferred to, vest in, ordevolveupon,theuniversity.

(3) The compensation payable by the University to Acharya N.G.RangaAgricultural University in respect of the transfer and vesting of theproperties and assets, and the devolution of liabilities and obligations,undersub-section(2)shallbesuch,asprescribedintheAndhraPradeshStateReorganisationAct,2014(ActNo.6of2014)

(4) Notwithstanding anything contained in this Act, and subject to theprovisions of sub-section (5), where the control and management ofanycollegehasbeentransferredtotheUniversityundersub-section(2),theUniversityshallemployallteachersandotheremployeesaspertheguidelines of theAndhraPradeshStateReorganisationAct, 2014 (ActNo.6of2014)

(5) Notwithstandinganythingcontainedinsub-section(4)everysuchteacherorotheremployeeofthegovernmentorAcharyaN.G.RangaAgriculturalUniversity,asthecasemaybe,shall,withinsuchtimeaspertheguidelinesofA.P.StateReorganisationAct,2014(ActNo.6of2014)

Provided that, the service renderedby any such teacheror otheremployeeunderthegovernmentortheAcharyaN.G.RangaAgri-culturalUniversity as the casemay be, upto the date notiied asaforesaidshallbedeemedtobeserviceundertheUniversityandheshallbeentitledtocountthatserviceforthepurposeofincrements,leave,pensionorprovidentfundandgratuityaspertheguidelinesofAndhraPradeshStateReorganisationAct,2014.

(6) Notwithstandinganythinginsub-section(5)everysuchteacherorotheremployeewhohadexercisedhisoptionaspertheguidelinesofAndhraPradeshStateReorganisationAct,2014

(7) Notwithstanding anything contained in this Act or the statutes madethereunder, any student of the constituent college, who was studyingfor any examination of Acharya N.G.Ranga Agricultural Universityshallbepermitted tocompletehiscourse inpreparation therefore,andthe University shall make arrangements for holding for such studentsexaminationsforsuchperiodasmaybeprescribed,inaccordancewiththecurriculaofstudiesoftheAcharyaN.G.RangaAgriculturalUniversity

(8) Thegovernmentshallbyorderdirect thatall the institutionsunder thecontrol and management of the government conducting research inthe subject ofAgriculture, Home Science &Agricultural EngineeringSciencesshallbemaintainedbytheUniversity,witheffectfromsuchdateordatesasmaybespeciiedintheorderwhichshallinanycasebebeforetheexpirationof threeyears from theappointedday.
