Action Requested: Permission to install a backup pump in the Gora Estate Well (Well No. 2359-10) for domestic use. The water system consists of the well, two in-line pumps, a pressure tank, and pipelines supplying six homes. There is no Board of Water Supply service in this area.
Analysis: The well has an authorized use in the Pearl Harbor Water Management Area "equal to the existing pump capacity." The backup pump is necessary to provide water in case of failure of the primary pump or when maintenance of the primary pump is necessary. The applicant will be required to install a flowmeter and to report monthly pumpage. There are other similar water systems in the area providing water for domestic uses. The area is unsewered so contamination from cesspools is possible. The applicant will be advised not to use the water for drinking unless properly tested and treated, if necessary.
RECOMMENDATION:
That the Commission approve the issuance of a pump installation permit for the Gora Estate Well, subject to the following conditions:
(1) The Division of Water Resource Management (DWRM) shall be notified before work commences.
(2) A flowmeter shall be installed and pumpage from the well shall be reported to DWRM monthly.
(3) A Well Completion Report shall be submitted to DWRM within 30 days after completion of the work.

(4) The proposed use shall not adversely affect existing legal uses in the area.
(5) The applicant shall comply with all applicable laws, rules, and ordinances.
(6) Water from the well shall not be used for drinking water unless it is properly tested and treated if necessary.
(7) The permit may be revoked if work is not started within six months of the date of issuance or if work is suspended or abandoned for six months. The work shall be completed within two years of the date of issuance.

Certification of Water Withdrawals' and Uses Pearl Har-bor Ground Wllter Control Area; Oahu
The- Pearl Harbor Ground Water Control Area (GWCA) -whichlncludes the Ewa and Wahiawa judicial districts, was deslgnatea for State regulation by the Board of Land and Naturai Resources (BLNR) in September 1979 under authority of Chapter 177, BRS, and the Department of Land and Natural Resources (DLNR) Regulation 9. The regulatory procedures call for the BLNR to certify existing water withdrawals and uses and to Issue permits for new ground water developments in the Pearl Harbor Ground Water Control Area.
The users of water within the Pearl Harbor Ground Water Control Area have submitted records of pumpage to the Department and from these submittals the annual withdrawals and maximum dally pumpage for individual wells and/or well fields are· tabulated as shown in the attached ·Certification of Water Withdrawals and Uses· which is made a part hereof. As a result, the following is recommended for certification of existing uses:

Oahu Sugar Company submitted figures which exceeded the 115 mgd listed above but because their submission represents unmeasured pumpages, the Department's staffis recommending that 115 mgd be certified. Oahu Sugar. !n the meantice. will investigate the matter and. if d.eemed. necessary will request that the Board. hold. a hearing as is allowed. under Section 4. 4 of Regulation 9 of the Department of Land and Natural Resources.
~COMMENDATION:
That the Board certify the existing uses and quantity of withdrawal for each well as indicated in the attached ·Certification of Water Withdrawals and Usesn dated April 11, 1980 which reflects the recommended withdrawal quantity as follows: Board of Water Supply at 78.95 mgd: U.S. Navy. 21.35 mgd: U.S. Army. 5.455 mgd: Private. 5.658 mgd; and Oahu Sugar Company. 115.0 mgd; subject to the provisions of applicable laws and rules and regulations.

SUBJECT: PUMP INSTALLATION PERMIT APPLICATION GORA ESTATE WELL STATE WELL NO. 2359-10 WAIAWA, OAHU
Thank you for the opportunity to review and comment on the subject application. We have examined the application and have the following comments to offer:
1. The application indicates that the subject well is for domestic use. If the well serves 25 or more individuals at least 60 days per year or has a minimum of 15 service connections, the applicant will be required to comply with the Department's Administrative Rules, Title 11, Chapter 20, "Potable Water Systems."
2. Section 11-20-29 of Chapter 20 requires that a source of potable water serving a public water system be approved by the Director of Health prior to its use. Such an approval is based primarily upon the submission of a satisfactory engineering report which addresses the requirements set in Section 11-20-29.
3. The proposed well is situated above the Underground Injection Control (UIC) line. Land areas above the UIC line are considered to contain underground sources of drinking water. Thus, it is essential that the well be designed and constructed to prevent the possibility of groundwater contamination. For example, the well should have a concrete well pad and full grouting to prevent seepage or floodwaters from migrating down the well shaft.
4. The operation of the proposed well should not be allowed to adversely affect the water quality of nearby drinking water wells.

5. In the event that Chapter 20 does not apply, we would highly recommend that well owner or operator routinely test the water for nitrates and microbiological contaminants to ensure that there is no wastewater contamination in this unsewered area.

On December 6, 1979 I visited 4 well owners to discuss the Declaration of Existing Water Withdrawal and Use forms. I obtained the following data:

The above wells are not metered and no records are kept. The water is used for domestic purposes only. The Board of Water Supply does not tave service connections in the area.
Rule 2.1 of Regulation 9 (attached) states that "individual household uses shall mean the use of water not provided through multiple-service or public facilities." If wells supplying more than a single household are considered "multiple-service or public facilities" then uses of water from them cannot be classed as individual household uses.

MEMO FOR THE RECORD 2 December 26, 1979
Department of Health Chapter 49 Section 1.1.3 (attached) states that a public water system, whether publically or privately owned, is a system which has "at least 15 service connections or regularly serves an average of at least 25 individuals daily at least 60 days out of the year.
I recommend that we consider individual household use as the use of water not provided through multipleservice or public facilities, the definition of "multiple-service or public facilities" to coincide with the Department of Health's definition of "public water system."
The reasons for the above recommendation as applied to the Waiawa wells are as follows:
1. Though serving more than one household, the actual use of the water is for Domestic use as defined in Chapter 177 Section 177-3 (4) (attached) .
2. The use of the water would be considered as individual household use so the owner would be exempt from the certification requirements.
3. Certification would be difficult since the~e are no records of withdrawals.
