PURPOSEThisRequestforProposal(hereafterreferredtoasthe“Proposal”orthe“RFP”)outlinestherequirementsoftheMunicipalityoftheDistrictofLunenburg(hereafterreferredtoasthe“Municipality”or“MODL”)withregardtodesignandbuildservicesbyqualifiedprofessionalfirmsandindividuals(hereafterreferredtoasthe“Proponent”)fornon-motorisedsharedusesingletracktrails.ThesesingletracktrailsmustbebuilttothebestpracticesustainabletrailstandardsoftheInternationalMountainBikeAssociation(“IMBA”)andtheUnitedStatesForestService(“USFS”),andgenerallymeettheIMBATrailClassificationfor“MoreDifficultBlueSquare”trails.TheprojectsiteislocatedontheRiverRidgeCommon(“RRC”)parkproperty,at4668Highway10inNewGermany,NovaScotia.2. BACKGROUNDMODListhethirdlargestruralmunicipalityinNovaScotiaintermsoftotalpropertyassessmentandencompassesageographicarearepresentingover432,000acres.AshortcommutetotheprovincialcapitalofHalifax,theMunicipalityishometoagrowingpopulationofover25,000andisconsideredoneofthe"hotspots"fordevelopmentandgrowthinNovaScotia.TheMunicipalitycurrentlyhasaworkforceof40employeeswhoworkinvariousdepartmentssuchasEngineeringandPublicWorks,EconomicDevelopment,Finance,Administration,PlanningandDevelopmentServices,Building/FireInspection,Recreation,andSolidWasteManagement.GovernanceofMODLisbolsteredbystrongpartnershipswithneighbouringmunicipalunits.RiverRidgeCommonisamulti-year,phaseddevelopmentofvariousparkcomponentsona115acreproperty,dividedbytheSouthShoreAnnapolisValley(rail)Trailinto2distinctparcels.The15acreLowerParkisaformergravelpit,situatedbetweenHighway10andtherailtrail.The100acreUpperParkareaisaformerwoodlot,tothenorthoftherailtrail,andistheprimaryfocusoftheworkdescribedinthisRFP(seeattachedmapsheetsofprojectsite).TheRiverRidgeCommontrailnetworkisintendedtoaccommodatevariousyear-round,non-motorisedactivities.Todate,intheUpperPark,existingformerwoodlotroadsandseveralnewsegmentsoftrailhavebeendevelopedintoanetworkofapproximately1.7kmofnon-motorised,graveltread2mwide,gentle,easy,obstacle-freetrail,whichmeetsthebestpracticeguidelinesfortrailaccessibilityforallusers.Additionaltrailsegmentsofthistypewillbeaddedinthenearfuture,asshownontheattachedtopographicalTrailSystemOverviewmap.TheproposedsingletracktrailsystemshouldbedevelopedandincorporatedintotheoverallRRCtrailnetwork,toinvitemoreadventuroususerstoexploreandexperiencetheparkbeyondtheeasygraveltrails,withasmoothprogressionoftechnicaltrailuseskills.Thesingletrackshouldpromoteapositive,fun,andsafeuserexperience,andencourageneweruserstobecomesingletracktrailaficionados.

SCOPEOFWORKANDLEVELOFEFFORTInthiswork,theMODLisseekingto(A)planaconceptforoverallsingletracktraildevelopmentand(B)constructthefirstsegmentsofsingletracktrailontheRiverRidgeCommonUpperParkparcel.(A)SingletrackConceptPlanworkwillincludeconsultationwiththeRRCProjectManager(anexperiencedmountainbikerandtrailuser)toestablishageneral,high-levelconceptfortheoveralldevelopmentofasingletracktrailsystemintheUpperParkparcel:

• Thissystemiscurrentlytargetedtobeapproximately7-10+kmintotallengthat(future)finalbuildout,constructedinandaroundtheUpperPark’seasygraveltrailsystem.

o Thegentlegraveltrailsystem,asshownontheattachedtopographicalTrailSystemOverviewmap,isdefinedbybothexistingtrailsegmentsandaroutefortheremainderthathasbeenpreviouslymappedandflaggedontheground(tobeconstructedunderaseparatecontract).

• Fortheplanningwork,thesuccessfulproponentwillbeexpectedtodeliveraplan(atminimumadigitallyannotatedversionoftheattachedtopographicalTrailSystemOverviewmap),showing:

o Proposedsingletracktrailsystem(incl.developmentzonesandgeneralroutesforproposedtrailsegments),

o Locationsofpositiveandnegativecontrolpoints,o Approximatelocations,characteristics,andcostsofanyproposedstructures,ando Estimatedlengthoftrailandconstructioncostperlinealmetreofeachtrail

segment/developmentzone.

• TheSingletrackConceptPlanmustbereviewedandapprovedbytheRRCProjectManager/MODLbeforeconstructionworkmaycommence.

• Itisemphasizedthatthiscomponentoftheworkisnotadetailedplanningortrailmappinganddesignprocess,butisonlyintendedtoproduceabasicgeneralconceptplanandcostestimatesforthepark’ssingletracktrailsystem.ThiswillserveasareferencetohelptheMODLplantheoverallsingletracktraildevelopmentandconstructionprocessthroughpotentialmultiplephasesoffutureconstruction.

• ThisworkDOESNOTentailANYofthefollowing-publicorstakeholder(otherthanRRCProjectManager)consultation,formal(e.g.municipalplanninglevel)siteevaluation,strategiceconomicdevelopment,marketing,branding,signage,oranyworkotherthanthatdirectlyrelatedtosingletracktrailnetworkconceptplanning.

• Thesegment(s)oftrailtobeconstructedinthisphasewillbebasedontheplanningworkinitem(A)above,tomeettheoverallplanningandconstructionlevelofeffortshownbelow.

• Inlieuofextensivemappinganddesigndocumentationforthisconstructionwork,thesuccessfulProponentwillinsteaddevelopafinallayoutflaggedontheground,tobeapprovedbyRRCProjectManagerbeforeconstructionmaycommence.

• Constructionworkshallincludeclearingofthetrailcorridor,grubbing,shaping,andcompactionofthetrailtread.

Thecombinedtotallevelofeffortforbothcomponents(A)and(B)ofthisworkshallnotexceed$50,000.00(notinclusiveofNovaScotiaHST).Theconstructionworkincomponent(B)isthemainpriorityforthisproject,soitisexpectedthatthiswillcomprisethebulkoftheoveralllevelofeffort.Timeisoftheessence,andprojectconstructionworkmustbesubstantiallycompletedbyMarch6,2020.Anyfinalproofrolling/compactionoffinishedtrailbedmustbecompletedinsuitablydrysoilconditions;intheeventthatthiscannotbeachievedbeforethesubstantialcompletiondeadlineduetoprevailingweatherconditions,thechosencontractorandMODLwillnegotiateamutuallyagreed-uponextensionforthiscomponentoftheworkonly.

GENERALCONSIDERATIONS,TECHNICALSPECIFICATIONS,ANDREFERENCESTANDARDSThefollowinggeneralconsiderationsapplytotheRRCsingletracktraildevelopmentprogram:

• SingletrackdevelopmentmustbeintegratedwiththeremainderoftheRRCtrailprogram,tothecurrentbestpracticesofsustainabletraildesignandconstruction,foroptimaluserexperience.

o Afundamentalplanningparameterisconfiguringthesingletracktrailsystemasaseriesoflinkedloopedsegmentsorzones,withoutersegment/zoneboundariesdefinedbythegraveltrailprogramand/orparkpropertyboundaries.

• Trailshouldgenerallybefocussedonclassicintermediatesingletrackcrosscountrymountainbikeriding,enjoyablyrideableinbothdirections,withoutanytechnicaltrailfeatures(suchaselevatedbridges,jumps,drops,etc.).AfterbecomingfamiliarwiththeRRCsingletracktrailsystem,mountainbikeusersofintermediateskillshouldbeabletogenerallyenjoythetrailswithoutoftenhavingtoputafootdownforsupportorwalkovermoretechnicalsections.

• Trailmayhaveamixed“hybrid”styleofoveralltrailflow(e.g.IMBA,2004,p.97),ablendof“openandflowing”and“tightandtechnical”styles,whichcanvarybetweensegments.Trailshouldbedesignedtoallownomorethanlowtomoderateratesofbikespeed,throughappropriateuseofcorralling,chokes,andturns.Thiswillhelpreducetheriskofhigh-speed,injuriouscollisionsorcrashes.

• Trailmustaccommodateshareduseforyear-roundactivitiesincludingwalking,running,mountainbiking,andsnowshoeing.

• Ifdeemedfeasible,overallplanningshouldincludesometrailsegmentsthatforman“UpperParkBoundaryTrail”thatgenerallyparallelstheperimeterofthesubjectUpperParkproperty.

• Trailshouldgenerallyworkwithlocaltopographyandterrainfeatures,andavoidflatand/orwetlocations,tominimiseoreliminaterequirementsforraisedtreadconstruction,culverts,retainingwalls,bridges,orotherassociatedbuilt-uptrailstructures.Anyrequiredstructuresshouldbesitedanddesignedtominimizeoverallsegment/zoneconstructioncosts.

• Trailshouldgenerallyberollingcontouralignmentwithflatorclimbingturns,outslopedtread,andappropriatelyspacedgradereversals/draindipsfordrainage.

• TrailmustgenerallymeetthetheIMBATrailClassificationfor“MoreDifficultBlueSquare”trails(seeattacheddocument).

• Treeclearingshouldgenerallybeminimisedbysensible,low-impact,trailcorridorlayoutandsensitivitytotheecologicalvalueoftheprojectsite.Corridorlayout,includingtreeclearing,mustbeflaggedandapprovedbytheRRCProjectMangerbeforeagivensegmentmaybeconstructed.

• TheartificiallandformsoftheexistingErosionControlareamaybedesirableforinclusionintothesingletracktrailsystem.ThiscanbeexploredinconsultationwiththeRRCProjectManager.

ThefollowingspecificationsandreferencestandardsarearequirementoftheRFP:

• Trailmustbedesignedandconstructedtocurrentbestpracticeforsustainabletrails,astypifiedby:o “TrailConstructionandMaintenanceNotebook”,UnitedStatesForestService,

currentversion.(https://www.fhwa.dot.gov/environment/recreational_trails/publications/fs_publications/07232806/toc.cfm).

o “TrailSolutions:IMBA’sGuidetoBuildingSweetSingletrack”,InternationalMountainBicyclingAssociation.BoulderCOUSA,2004.

• TrailmustmeetcriteriaforuptoIMBA“MoreDifficult/BlueSquare”levelofdifficulty(IMBA,2004,p.75)-seeattachedreferencetable.

• Trailcorridortohavemin.0.6mtreadwidth,2-2.5mvegetationclearingwidth,and3.0mvegetationclearingheight.

• Allpruningofvegetationshallbedonetoaboriculturebestpractices.

• Trailsurfaceconstructedofcompacted,firm,stablenativemineralsoil.

• Trailincorporatesappropriatetrailway,positivedrainage,andothertrailstructuresasneeded.

• Trailsonsteepersideslopesmustbefullbenchcuttonativemineralsoil.

• Clearedvegetationandsurficialorganicmaterialwithintrailrightofwaytoberemovedandplacedrandomlyoutsidetrailcorridor.

WARRANTYThewarrantyperiodof12monthswillcommenceonthedatetheprojectreceivesaConstructionCompletionLetteridentifyingthateachofthesitesaresubstantiallycompleteandreadyforuse.TheOwnerwillestablishthiscompletiondate.6. STEERINGCOMMITTEEThisprojectwillbemanagedbyaSteeringCommitteeconsistingofMODLRecreationServicesstaffandtheRRCProjectManagerordesignate.7. DELIVERABLESReportingtotheRRCProjectManager(orMODLTrailsandOpenSpaceCoordinator/otherMODLdesignate),thesuccessfulProponent’sprojectworkwillentail:

1. ConductastartupsiteinspectionwiththeProjectManagerordesignate,toreviewpotentialareasforsingletrackdevelopmentonthesubjectpropertyandidentifyanyspecificconcernsorrequirements.

2. SubmitdraftSingletrackConceptPlan(asdescribedinSection3)toProjectManagerfor

reviewandapproval.

3. FollowingapprovaloftheSingletrackConceptPlan,layoutoftheinitialsegment(s)of

singletrackforconstruction,flaggingtheproposedtrailcorridorontheground.

4. ConductaflaggedtrailcorridorwalkthroughwiththeProjectManagerordesignatefor

approvalbeforecommencingclearingandconstructionactivities.

5. Constructthetrails.PeriodicallyreviewprogressandqualitywiththeMODLProject

Manageronsite,onamutuallyagreed-uponschedule.

6. Conductanas-builtwalkthroughwiththeProjectManagerordesignateforsubstantial

completioncertification.

.1 ReviewCommitteeInaccordancewiththeMunicipality’sPurchasingPolicy,theRequestforProposalwillbeevaluatedbyaReviewCommittee.TheReviewCommitteewillmakearecommendationtoMunicipalCouncilontheawardoftheProposalandsubsequentcontract.EvaluationofProposalsshallbecompletedusingthebestvaluedeterminationinaccordancewiththefollowingcriteria:.2 MandatoryCriteriaSubmissionswillfirstbeevaluatedtoestablishcompliancewiththemandatoryclausesofthisRFP.Submissionsnotmeetingthemandatoryrequirementswillreceivenofurtherconsiderationduringtheevaluationprocess.Thefollowingarethemandatoryrequirements:

• Proposalsshallbesubmittedbythedeadline.

• ProposalsshallbesubmittedasperSection10ofthisRFP.

.4 EvaluationCriteriaAllproposalsmustcomplywithallrequirementsoutlinedinthisdocumentandallsubmissionswillbeevaluatedandrankedagainstthefollowingcriteriaandassociatedweights.40%Design/BuildTeamInformation:

.5 RiskEvaluationTheMunicipalityreservestherighttodeductpointsfromtheProposalEvaluationCriteria(AppendixA),basedonanassessmentofrisk.Riskevaluationcategoriesareasfollows:

• Lowrisk:exceptionsoromissionstoRFPtermsandconditionsand/orformatindicatenoriskorlowrisktosuccessfulcompletionofproject;(-0)to(-5)points.

• Mediumrisk:exceptionsoromissionstoRFPtermsandconditionsand/orformatindicatearisktosuccessfulcompletionofprojectthatcanbemitigatedusingMODLresources;(-5)to(-25)points.

• Highrisk:exceptionsoromissionstoRFPtermsandconditionsand/orformatindicatearisktosuccessfulcompletionofprojectthatcanbemitigatedbutwillrequiresignificantMODLresources;(-26)to(-50)points.

• Unacceptablerisk:exceptionsoromissionstoRFPtermsandconditionsand/orformatindicateahighprobabilityofprojectfailure;(-50)to(-100)points.

.6 CostEvaluationTheMunicipalityreservestherighttodeductpointsfromtheProposalEvaluationCriteria,basedonanassessmentofthecostproposal.Unlessotherwisestatedinthisdocumentoritsaddenda,theproposalwiththelowestcostshallreceivethemaximumpointsallowed.Allotherproposalsshallreceiveacostscorebasedontheircostrelationshiptothelowest.Thepointsforthefinancialevaluationwillbeallocatedasfollows:

.7 OtherCriteriaAsperSection12.1theMunicipalityreservestherighttochoosetheproposalthatprovidesthebestoverallvaluetotheMunicipalityintermsofmeritandpriceratio.TheMunicipalitymay,initssolediscretion,choosetorejectanyorallProposals.

.8 ContractNoticeinwritingtotheProponentoftheacceptanceofitsproposalbytheMunicipalityandthesubsequentfullexecutionofawrittencontractandPurchaseOrderwillconstituteacontractforservices.NoProponentwillacquireanylegalorequitablerightsorprivilegestothegoodsorservicesuntiltheoccurrenceofbothevents.

13. GENERALTERMSANDCONDITIONS

.1 AcceptanceofProposalsTheMunicipalityreservestheright,atitssolediscretion,torejectanyandallProposals.TheRequestforProposalsshouldnotbeconstruedasacontractforthepurchaseofgoodsorservices.TheMunicipalityreservestherighttoacceptanyProposalthatitconsiderstobeinitsbestinterestortorejectanyorallProposals,astheMunicipalitydeemstobeinitsbestinterest.PricewillonlybeonefactorwhichMODLwillconsiderinselectingaProponent.OtherfactorsmayincludebestvalueforMODL;theamountoflocalproducts/servicesprovidedbytheProponent;thesafetyrecordoftheProponent;thequalificationsoftheProponent;andpreviousperformancehistoryinrelationtoMODL.

Notermsorconditionsshallbeimplied,basedonanyindustrytradepracticeorcustom,anypracticeorpolicyoftheProposalorMunicipalityorotherwise,whichisinconsistentorconflictswithprovisionscontainedinthisdocument.TheMunicipalityalsoreservestherighttowaiveformality,informalityortechnicalitywiththeacceptanceofaProposalforthiscontract.MODLreservestherighttodevelopall,some,ornoneoftheprojectthatis

thesubjectofthisproposal.AnyProposalnotsupportedbytheinformationrequestedinthisRequestforProposalsmayberejected.MODLalsoreservestherighttonegotiatewithanyProponentwhohassubmittedaProposal.TheMunicipalitymaywaiveminordifferencesintheProposals,providedthedifferencesdonotviolatetheProposalintent.Notermsorconditionsshallbeimplied,basedonanyindustrytradepracticeorcustom,anypracticeorpolicyoftheProposalorMunicipalityorotherwise,whichisinconsistentorconflictswithprovisionscontainedinthisdocumentTheMunicipalityalsoreservestherighttowaiveformality,informality,ortechnicalityinanyProposal.

.2 LiabilityofErrorsWhileMODLhasmadeconsiderableefforttoensureanaccuraterepresentationofinformationinthisRFP,theinformationcontainedinthisRFPissuppliedsolelyasaguidelineforProponents.TheinformationisnotguaranteedorwarrantedtobeaccuratebyMODL,norisitnecessarilycomprehensiveorexhaustive.NothinginthisRFPisintendedtorelieveProponentsfromformingtheirownopinionsandconclusionswithrespecttomattersaddressedinthisRFP.

.3 InformationCollectedTheProponentisadvisedthatallinformationcollectedandmaterialdevelopedinregardtoallworkcarriedoutbyMODLshallbecomethepropertyofMODL.

.4 ConfidentialityAlldocuments,information,andmaterialdevelopedbytheProponentshallbetreatedasconfidentialunlessdeterminedotherwise,inwriting,byMODL.ProponentsareadvisedthatanyinformationprovidedbyMODListobetreatedasconfidentialandshallnotbeprovidedtoathirdpartywithoutpriorwrittenapprovaloftheChiefAdministrativeOfficeroftheMunicipality.

.5 OwnershipofProposalsandFreedomofInformationAlldocuments,includingProposals,submittedtoMODLbecomethepropertyofMODLandaresubjecttodisclosureundertheNovaScotiaFreedomofInformationandProtectionofPrivacyAct(FOIPOP).BysubmittingaProposal,theproponenttherebyagreestopublicdisclosureofitscontentssubjecttoFOIPOPcriteria.AnyinformationtheProponentconsiders“personalinformation”becauseofitsproprietarynatureshouldbemarkedas“Confidential”andwillbesubjecttoappropriateconsiderationasdefinedwithintheNovaScotiaFreedomofInformationandProtectionofPrivacyAct.

.6 Proponent’sExpensesMODLisnotliableforcostsincurredbytheProponentinrespondingtothisRFP.Proponentsaresolelyresponsiblefortheirownexpensesinpreparation,delivery,orpresentationofProposalsandforanysubsequentnegotiationswithMODL.

.7 ChangesandAmendmentsAllProponentswillbenotifiedinwritingregardinganychangesmadetotheRFPoranyappendices,oranychangeintheclosingdateortime.WhenchangesoccurwithinfivebusinessdaysofthecloseoftheRFP,theclosingdatemaybeextendedtoallowforasuitablenumberofpreparationdaysbetweentherevisedclosingdateandtheissuanceofthechange..8 PaymentPaymentsforprojectworkshallbebasedonmonthlyprogressinvoices,submittedasapplicationforpaymentbythesuccessfulProponentforapprovalbytheRRCProjectManagerordesignate.Progresspaymentsshallbesubjecttoa10%holdbackasprescribedbytheBuilder’sLienActofNovaScotia.TheprojectpaymentschedulewillbedevelopedfromtheprogressscheduleandcostbreakdownsubmittedbythesuccessfulProponentaspartoftheirresponsetothisRFP,andagreeduponbyallpartiespriortotheexecutionofawrittencontractforthiswork..9 PerformanceMODLreservestherighttoremoveProponentsduetoqualityofworkand/orservice.ProponentswillbenotifiedofanyproblemsinwritingfromMODLandbegiventheopportunitytorespond.MODLcanthendetermineiftheProponentshouldberemovedfromthequalifiedcontractorslistforthoseservices.MODLshallbethesolejudgeinthismatter.MODLmayterminatethePurchaseOrderinwriting,andwithoutfurtherliability,intheeventMODL,initssolediscretion,determinesthattheProponenthasneglected,failed,orrefusedtoproceedsafelyandpromptlywiththeworktobeprovidedbytheProponentpursuanttothePurchaseOrderorcontravenedanyoftheProponent’sobligations.

.10 IndemnificationTheProponentshalldefend,indemnifyandsaveharmlessMODLitselectedofficials,officers,employeesandagentsfromandagainstanyandallclaimsofanynature,actions,causesofaction,losses,expenses,fines,costs(includinglegalcosts),interestordamagesofeverynatureandkindwhatsoever,includingbutnotlimitedtobodilyinjury,sickness,diseaseordeathortodamagetoordestructionoftangiblepropertyincludinglossof

revenueorincurredexpenseresultingfromdisruptionofservice,arisingoutoforallegedlyattributabletothenegligence,acts,errors,omissions,misfeasance,nonfeasance,fraudorwillfulmisconductoftheProponent,itsdirectors,officers,employees,agents,contractorsandsubcontractors,oranyofthem,inconnectionwithorinanywayrelatedtothedeliveryorperformanceofthisContract.ThisindemnityshallbeinadditiontoandnotinlieuofanyinsurancetobeprovidedbytheSupplierinaccordancewiththisContract,andshallsurvivethisContract.TheProponentagreestodefend,indemnifyandsaveharmlessMODLfromandagainstanyandallclaimsofanynature,actions,causesofaction,losses,expenses,fines,costs(includinglegalcosts),interestordamagesofeverynatureandkindwhatsoeverarisingoutoforrelatedtotheProponent’sstatuswiththeWorkers’CompensationBoardofNovaScotia.ThisindemnityshallbeinadditiontoandnotinlieuofanyproofofWorkers’CompensationBoardofNovaScotiastatusandcompliancetobeprovidedbytheProponentinaccordancewiththisContract,andshallsurvivethisContract.

.11 InsuranceTheProponentand/ortheProponent’sconsultingdesignfirmshalltakeoutandkeepinforceProfessionalLiabilityinsuranceintheamountof$2,000,000/occurrenceprovidingcoverageforacts,errorsandomissionsarisingfromtheirprofessionalservicesperformedunderthisAgreement.ThepolicySIR/deductibleshallnotexceed$100,000perclaimandifthepolicyhasanaggregatelimit,theamountoftheaggregateshallbedoubletherequiredperclaimlimit.ThepolicyshallbeunderwrittenbyaninsurerlicensedtoconductbusinessintheProvinceofNovaScotiaandacceptabletotheMODL.Thepolicyshallberenewedfor2yearsaftercontracttermination.AcertificateofinsuranceevidencingrenewalistobemaintainedeachandeveryyearbytheProponentandprovidedtotheMODLuponrequest.Ifthepolicyistobealtered,reducedincoverage,cancelledornon-renewedforanyreason,30daynoticeofsaidcancellationornon-renewalmustbeprovidedtoMODL.MODLhastherighttorequestthatanExtendedReportingEndorsementbepurchasedbytheProponentattheProponent’ssoleexpense.MODLshallbenamedasadditionalinsured.Thepolicyshallcontainaprovisionforcrossliabilityinrespectofthenamedinsured.

TheProponentshalltakeoutandkeepinforceStandardFormAutomobileLiabilityInsurancethatcomplieswithallrequirementsofthecurrentlegislationoftheProvinceofNovaScotia,havinganinclusivelimitofnotlessthan$2,000,000peroccurrenceforThirdPartyLiability,inrespectoftheuseoroperationofvehiclesowned,operatedorleasedbytheContractor.

TheProponentshalltakeoutandkeepinforce-ownedautomobilecoveragewithalimitofatleasttwomilliondollars($2,000,000)withadeductiblenotexceeding$2,000includingcontractualnon-ownedcoverage.

.12 Worker’sCompensationIfrequested,theProponentandallsubcontractors,ifany,shallholdaClearanceLetter/LetterofGoodStandingfromtheWorker’sCompensationBoardofNovaScotia,validforthedurationoftheperiodtheyperformworkforthisproject.ItshallbetheresponsibilityoftheProponenttoensurecoverageisinplacefortheiremployeesand/ortheirsubcontractors.

.13 SafetyTheProponentwillberesponsibleforworkplacesafetyfortheScopeofWork,pertheNovaScotiaOccupationalHealthandSafetyActanditsRegulations,andtheMunicipality’sSiteSafetyPolicyandManualofProcedures.Allsub-contractors,ifany,shallholdavalidCertificateofRecognitionasissuedbyoneofthefollowing:NovaScotiaConstructionSafetyAssociation,NovaScotiaTruckingSafetyAssociation,oranoccupationalhealthandsafetyorganizationwithasafetyauditprocedurerecognizedandapprovedbytheWorker’sCompensationBoardofNovaScotia.Thesub-contractor(s)shallmaintaintheCertificateofRecognitionduringthecourseoftheproject.TheProponentshalltakeallnecessaryprecautionstoensurethesafetyofthepublicandshallprovideandmaintainanyrequiredsignage,barrierguards,etc.TheProponentshallensurethepublicdoesnotcomeintocontactwiththeproject.TheProponentshallberesponsibleforensuringalltrafficcontrolsareincompliancewiththemostrecentversionoftheTemporaryWorkplaceTrafficControlManual..14 SubstitutionsNosubstitutionsfortheteammembersinrelationtotheworktasksoutlinedintheproposalshallbepermittedwithoutwrittenpermissionfromMODL.
