SASKATCHEWAN REAL ESTATE COMMISSION — REGULATORY BYLAW AMENDMENTSTHAT the Saskatchewan Real Estate Commission approves that Bylaw 219.2 be amended to read
as follows:
“219.2(1) After the last day for the receipt of the signed nomination forms and prior to April 1st of each year, the Registrar shall cause to be sent to each registrant at his/her brokerage’s address as shown in the records of the Commission:
(a) a ballot paper listing, in alphabetical order, the names of all candidates in the region in which he/she is entitled to vote and stating the number of members to be elected in that region;
(b) biographical profiles and candidates;
(c) instructions respecting the marking of the ballot paper and of its return to the Commission;
(d) a ballot envelope; and
(e) a mailing envelope.
(2) The Registrar may include in the voting materials sent to registrants, information and instructions to facilitate an electronic voting process”.
THAT the Saskatchewan Real Estate Commission approves the addition of the following bylaw:
“219.4.1(1) Electronic processes, including the internet, or a combination of current processes and electronic processes, may be used for.
(a) circulating election notices, forms, ballots, documents and other materials;
(b) voting; and
(c) counting and recording votes.

(2) Any electronic process must preserve the clarity, accuracy and confidentiality of the voting process”.
THAT the Saskatchewan Real Estate Commission approves that Bylaw 219.5 be amended to read as follows:
“219.5(1) Unless specifically provided for, “ballot” refers to a paper ballot or an electronic ballot, as the case may be.
(2) Every registrant voting by paper ballot shall vote by marking his or her ballot paper, placing the ballot into the ballot envelope and sealing the ballot envelope.
(3) The registrant must complete the reverse side of the envelope by printing and signing his or her name in the appropriate spaces.
(4) The ballot envelope must be placed into the mailing envelope, which is then sealed and delivered to the Registrar no later than Election Day.
(5) Votes may be cast by paper ballot or electronic ballot, but not both.
(6) A registrant voting in an election by way of electronic ballot shall cast the electronic ballot in accordance with the instructions distributed by the Registrar.
(7) An electronic vote may be cast any time after receipt by the registrant of the voting materials and until the deadline specified.
(8) An electronic ballot shall not be counted:
(a) if it is cast after the specified deadline; or
(b) if it is not marked in accordance with the instructions distributed by the Registrar.
(9) A registrant shall not:
(a) use another registrant’s identification information to vote electronically; or
(b) permit another person to use his or her identification information to vote electronically”.
THAT the Saskatchewan Real Estate Commission approves that Bylaw 219.6 be amended to read as follows:
“219.6(1) The ballots will be counted as soon as practicable after the Election Day. The Registrar shall appoint at least two scrutineers.
(2) The scrutineers shall record each registrant who votes to ensure that each registrant only votes once.
(3) The Registrar and the appointed scrutineers shall cause the paper ballots to be opened and deposit ballot envelopes containing marked paper ballots into a ballot box to be counted.
(4) A ballot shall not be counted if:
(a) it is not an original ballot; or
(b) the ballot was delivered or submitted after the Election Day.
(5) Candidates and agents of the candidates are entitled to be present at the opening of the paper ballots.
(6) The Registrar and the appointed scrutineers shall cause the electronic votes to be counted and the number of electronic votes cast for each of the candidates to be recorded.
(7) Candidates and agents of candidates are entitled to be present during the transfer from the service provider of the results of the counting and recording of electronic votes.
(8) Where both paper and electronic ballots are used in election, the Registrar and the appointed scrutineers shall cause the total number of votes from the paper ballots to be added to the total number of votes from the electronic ballots.

Pursuant to subsection 15(2) of The Registered Nurses Act, 1988, the regulatory bylaws of the Saskatchewan Registered Nurses’ Association are hereby amended as follows:
Bylaw VIII Subsection 1(1) is amended to read:
“(1) As of January 1, 2015, to be eligible for registration and the issuance of a licence to practice registered nursing in the general practice category, a person must write and pass the National Council Licensure Exam for Registered Nurses, (hereafter NCLEX®-RN) within three years of the date of completion of the registered nursing program. A person admitted as an internationally educated nurse must write and pass the NCLEX®-RN exam within three years of the date of becoming eligible to write the exam”.
Bylaw VIII Subsection 1(2) is deleted.
Bylaw VIII Subsection 1(3) is renumbered as new subsection 1(2) and is amended to read:
“(2) A person who does not pass the NCLEX®-RN exam within the three years as provided in paragraph (1) shall no longer be eligible to write the exam until that person satisfactorily completes an approved or recognized registered nursing education program”.
Bylaw VIII Subsection 1(4) is renumbered as new subsection 1(3).

PLEASE NOTE: The deadline for submissions to The Saskatchewan Gazette is 5 p.m. on the Monday of the week of publication. If a holiday occurs within the week of publication, the deadline is set back to 5 p.m. of the previous Friday. Please allow yourself at least one full week to ensure mail delivery of Gazette submissions. Publication of any material received late will be delayed until the following week’s issue.
All material for publication in The Saskatchewan Gazette must be submitted electronically (MS Word or WordPerfect) accompanied by a signed hard copy to the Office of the Queen’s Printer, Saskatchewan Justice, B19-3085 Albert St., Regina SK S4S 0B1, tel. (306)787-2367, or by E-mail: [email protected].
Each document or disk must be complete in the form required for publication and must be separate from the covering letter. Signatures on all documents must be typewritten or clearly printed immediately below the written signatures.
Prepayment is required for ALL notices placed in The Saskatchewan Gazette by non-government clients. Cheques or money orders must be made payable to the Queen’s Printer Revolving Fund. Please include the GST in addition to regular charges at the rate of 5% each for those items listed below under “GST Payable”.
The minimum charge for publication of notices not specified below is $16.00 for each notice, which sum shall accompany the material when forwarded for publication.

SACHEZ QUE: La date de tombée pour les soumissions à la Gazette de la Saskatchewan est le lundi à 5 p.m., la semaine de la parution. En cas de jour férié à l’intérieur de la semaine de parution, la date de tombée sera remise un jour avant, soit le vendredi à 5 p.m. Pour les envois de soumissions à la Gazette par la poste, veuillez prévoir une semaine au complet. La parution de tout matériel reçu en retard sera remise au numéro de la semaine suivante.
