on Children in Indonesia Tourism ”

A. LAW & REGULATION IN
INDONESIA
Indonesia has developed National Action Plan for the
Eradication of Human Trafficking and Child Sexual Exploitation
(Regulation of Coordinator Minister for Social Welfare No. 25 of
2009).
Indonesia as a part of world citizen against trafficking and child
sex exploitation.
Indonesia has ratified Convention of Children Right based on
Decree of President Number 31/1990
Two of Indonesia/National Laws for children protection are :
1. The Republic of Indonesia Law Number 23 Year 2002 on
Children Protection.
2. The Republic of Indonesia Law Number 21 Year 2007 on Combating of Trafficking in Person.
- It’s also stated in the Republic of Indonesia Law Number 10 Year 2009 concerning on Tourism,
*article 5, that tourism is based on the upholding of human rights principle, and …
*article 23 that the government should monitor and supervise tourism activities in preventing all negative impacts in society.
- Therefore Ministry of Tourism and Creative Economy actively participates in preventing child sexual exploitation in tourism sector and trafficking in persons through its annual programs such as “Tourism Awareness”
B. PROGRAMES AND ACTIVITIES
of the Ministry of Tourism and
Creative Economy (MoTCE)
(2009-2011)
1. MoTCE composes and distributes of information
material/poster, leaflet, standing banner, sticker for
stakeholders and tourism authorities
2. MoTCE puts a special features in printed media for
stakeholders and tourism authorities informing activities
against child sex exploitation in destination areas.
3. MoTCe disseminates of The Regulations of Trafficking in
Persons and Child Protection, incl. the Regulation of
Ministry of Culture and Tourism for Guidance of Prevention
of Sexual Exploitation on Children in Tourism Sector,
through workshop in 52 cities in Indonesia.(Consisting the efforts of
Prevention of Sexual Exploitation in Tourism Sector done by Indonesia Tourism Industries,
Government and Regional Government)
4. MoTCE cooperates with the institutions from the National
Action Plan for the Eradication of Human Trafficking and
Child Sexual Exploitation.
5. Close cooperation with National Police of Republic of
Indonesia on safeguarding in tourism destination
6. Cooperation with ECPAT Indonesia
7. Stipulating the Regulation of Ministry of Tourism and
Creative of Safeguarding Management System in Hotel
Number PM.106/PW.oo6/MPEK/2011 in 2011
1. Ministry of Women Empowerment and Child Protection
a. The foundation of The Regional Task Force for the Eradication of
Human Trafficking and Child Sexual Exploitation in 24 provices.
b. The establishment of regulation of Training of the Assistance for
Witness/Victims of Trafficking in Persons, Early Vigilance and
Prevention of Human Trafficking through Local Wisdom
c. Training and workshop for the facilitator of victim assistance
d. Dissemination the Law Number 21/2007 of the Eradication
of Human Trafficking
C. JOINT COOPERATION IN THE PREVENTION AND
ERADICATION OF TRAFFICKING IN PERSONS AND CHILD
SEXUAL EXPLOITATION WITH OTHER MINISTRIES:
2. Ministry of Social Affairs
a. The foundation of 147 Integrated Centers of the
Empowerment of Women and Children Psychosocial
Rehabilitation Centre (RPTC) to support and empower
the victims
b. Economic empowerment through economic provision
3. Ministry of Foreign Affairs
15 citizen services in Indonesian Embassies and Consulate
General and Consulate General (Tokyo, New York, Los
Angeles, Perth, Darwin, Penang, Sydney, Kuching, Osaka,
Singapore, Malaysia, Brunei Darussalam, Hongkong, South
Korea and Jordania)
JOINT COOPERATION IN THE PREVENTION AND ERADICATION OF
TRAFFICKING IN PERSONS AND CHILD SEXUAL EXPLOITATION
WITH OTHER MINISTRIES:
4. The National Police
a. Training of Trafficking in Persons specialty, woman & children
services specialty,
b. Training for investigator, law enforcement in handling trafficking
in persons
c. Forming the curicullum and modul of Handling Trafficking in
Persons,
d. Together with Ministry of Women Empowerment and Children
Protection and UN held 16 day-campaign to end violence against
women in 25 November-10 December 2011
e. 31 Women and Children Service Units are established and spread
in Provincial Police Stations and 274 Units in Regency/Municipal
Police Stations.

WITH OTHER MINISTRIES:
2010-2011: 1102 CASES OF WOMEN AND CHILD EXPLOITATION 2010-2011: 444 CASES OF WOMEN AND CHILD EXPLOITATION HANDLED 2010-2011: 231 CASES OF TRAFFICKING ARE BEING REPORTED TO THE NATIONAL POLICE
More data is being reported in recent year because the society are more aware of the protection aspect and their rights
Modus of trafficking: young workers being recruited to work in tourism sector by pimp, their age were falsified, but they happened no to work in tourism sector but become trafficking victims

CASES OF SEXUAL EXPLOITATION
AND TRAFFICKING IN PERSONS
1. Most cases in trafficking in persons and child sexual exploitation are not happening in tourism sector.
2. MoCTE continuously disseminates information to prevent and eradicate the trafficking in persons and sexual exploitation of children in destination areas through “Tourism Awareness Program”
3. MoCTE strengthens a partnership, cooperation, and coordination between governmental, non governmental sector and international organizations in preventing and combating the trafficking in persons and the sexual exploitation of children in Indonesia.
