WHEREAS by Section 9 of " The Fisheries Act, 1905-21," it is provided that the Governor may by Pro-clamation prohibit all persons from taking any fishwhatsoever in every or any specified portion of WesternAustralian waters by means of fishing nets and fishinglines, or either of such means of capture, or by anyother specified means of capture, for any specified term:Now, therefore I, the said Lieutenant-Governor, by andwith the advice and consent of the Executive Council, dohereby, in exercise of the powers aforesaid and of everyother power enabling me in this behalf, proclaim anddeclare as follows:That all that portion of WesternAustralian waters defined in the Schedule hereto shallbe closed against the use of fishing nets for a term ofthree years as from the 2nd day of March, 1937.

The hunible Petition of the undersigned, being amajority of the electors living in area hereinafter de-fined, showeth as follows:

(1) That your petitioners constitute a majority innumber of the electors living in an area comprisedwithin a circle having a radius of forty chains fromthe centre of all that piece of land situate at the cornerof Labouehere road and Preston street, Como, and beingportion of Swan Location 40, and being Lots 1, 2, 3, 4,and part of Lot 5 on Diagram 8114, the subject of Cer-tificate of Title Volume 1043, Folio 736, and which saidland is situate within the Licensing District of Canning,in the said State.

(2) That there has been an increase in populationin such area and that such increase is likely to be per-manent.

(3) That there are insufficient licensed premises tomeet public requirements within such area.

(4) That it is desirable that a Publican's GeneralLicense should be granted in respect of premises to beerected en the land mentioned and set forth in para-graph 1 hereof.

(a) To rescind the Regulations as from the 31st day of December, 1936, dealingritli the payment of interest on capital as published in the Gazette on the 23rd August,1918, and amended by further publications in the Gazette on the 21st December, 1928,and the 7t1i December, 1934.

(b) To make the following: further Regulation, dealing with the payment ofinterest on capital under the provisions of paragraph three of Section 58 of that Act:-

All dues, charges, rents, and other moneys levied and collected by the Com-missioners under Section 58 of the Act shall, after payment thereout of all fees,salaries, and wages and. other expenditure lawfully incurred by the Commissioners,be charged with the payment to the Treasurer of interest in respect of the value011 property from. time to time vested in or cliaigod against the Commissionersunder Section 56 or Section 57 of the said. Act, at such rate as shall be deter-mined annually from time to time by the Governor hi Council. This Regulation.shall come into force on the 1st day of January, 1937, so that interest shall becharged at the rate hereinbefore mentioned as from the 1st day of January, 1937.

For the purpose of this Regulation interest shall commence to accrue fromthe 1st day of the financial year next following the date when such property ischarged to the Commissioners.

No. 186.WHEREAS Model By-laws have been prepared inaccordance with the provisions of Section 295 of "TheHealth Aet, 1911-35," and published in the GovernmentGazette on the 8th day of April, 1927; the 20th day ofOctober, 1933; the 5th day of October, 1934, and the1st day of February, 1935: And whereas the Municipal.Council of the City of Fremantle, being a Local HealthAuthority under the provisions of the said Act, did byresolution published in the Government Gazette on the2nd day of August, 1935, adopt either wholly or partsuch Model By-laws to be its By-laws: And whereas bythe provisions of the Act aforesaid a Local HealthAuthority may amend, repeal, or alter By-laws so made:Now, therefore, the Municipal Council of the City ofFremantle, being the Local Health Authority for theMunicipal District of Fremantle, cloth hereby amendsuch By-laws in the following manner:

Part VII., Clause 29:Paragraphs (a), (b), (c),(d), and (e) to be deleted and the following paragraphsto be inserted in lieu thereof:

(a) Every vehicle used in transport of meat (except-ing butchers' delivery vehicles used for delivery of cutjoints to householders, and vehicles used by the pro-ducer for the conveyance of carcase meat to the Fre-mantle Meat Market, Newman street) shall conformwith the following:

The vehicle shall be completely enclosed so as toprotect the meat from the weather, and from theflies and dust.

The vehicle shall be constructed of wood or ap-proved metal, and all internal surfaces shall befinished to a smooth surface.

The vehicle shall be properly ventilated.The vehicle shall be provided with rails and

hooks secured to the upper portion thereof, andshall be of ample proportions so that meat hung onsuch hooks shall be clear of the floor.

No meat (except edible offal) shall be placed onthe floor of the vehicle.

Edible offal, when carried on the floor, shall becontained in impervious containers.

The vehicle, edible offal containers, hooks andrails shall at all times be kept in a thoroughly cleancondition.

(h) No vehicle used for the transport of meat shallbe used at any time for the transport of any offensivematter.

(c) No meat shall be carried on any railway, exceptin trucks provided for that purpose, or unless such meatis hung on hooks and is clear of the floor,

(d) Any person engaged or employed in the transportor delivery of carcase meat shall at all times when soengaged wear a cap with a detachable covering, madeof durable washable :material and an overall coat 'or dur-able -washable material which shall completely cover hisclothes,. He shall cause such cap covering and overallto be kept at all times in a thoroughly clean condition,

(o) Butchers' delivery vehicles shall be completely- en-closed to protect the meat from weather, flies and dust.

The vehicle shall be constructed of wood or approvedmetal, and all internal portions finished to a smoothsurface.

They shall be properly ventilated. The floor of suchvehicles shall lie constructed of or completely coveredwith a smooth -impervious metal.

(f) Butchers' cutting carts shall be constructed in asimilar manner as specified for butchers' delivery carts,but shall be of ample dimensions to permit all carcasemeat to be hung on hooks affixed to the roof of suchvehicle. All carcase meat shall he hung on such hooksin such manner that the meat is clear or the floor. Car-case meat in this clause shall mean any quarter or woreof any carcase.

(g) All carcase :neat conveyed by producers to theFremantle Meat Market, Newman street, shall he com-pletely covered with clean canvas or other wrappingsapproved by the Chief health Inspector of the Council,in such manner as thoroughly- to protect such meat fromflies and dust.

(h) In this By-law the word "producer" shall meana person or persons who delivers to the Fremantle Meat-Market, Newman street, carcases of animals reae,-I orproduced on Ids own farm or property.

This amendment shall, in relation to vehicles now usedin transport of meat, come into operation on the Thirty-first day of December, 1938, provided that any newvehicle, whether in addition to or in replacement of anyvehicle at present in use for this purpose, shall conformwith these By-laws.

THIS Agreement, made in pursuance of "The Indus-trial Arbitration Act, 1912-1935," this Eighteenth dayof January, One thousand nine hundred and thirty-seven, between Milne & Company, Burns Philp &-

Company, Limited, Penfolds Wines, Limited (herein-after called "the employers"), of the one part, and TheMetropolitan Wine & Spirit Warehouse Employees' In-dustrial Union of \Yorkers, W.A. (hereinafter called"the Union "), of the other part, witnesseth that forthe considerations hereinafter appearing the partieshereto mutually covenant and agree the one with theother as follows:

1.Area.This Agreement; shall be limited in its effect to the

area comprised within a radius of fifteen miles from theGeneral Post Office in the city of Perth.

2.Term.The term of this Agreement shall be )lute years from

the date hereof: Provided that, alter I he expiration Oftwelve months from the commencement of this Agree-ment, and after the expiration of any subsequent periodof twelve months during the currency of the Agree-ment, the rates of wages herein prescribed may bevaried by agreement between the parties: Provided also,that any party hereto may, after the expiration oftwelve months from the comntencentent of this Agree-ment, and after the expiration of rate subsequent periodof twelve months during the currency of the Agree-ment, make application to the Court of Arbitration ofWestern Australia to vary the Agreement by increasing.or decreasing the rates of wages herein set forth.

to be worked between the hours of 7.30 a.m. and 5.30p.m., Monday to Friday inclusive, and between thehours of 7.30 a.m. and 1 p.m. on Saturday. Providedthat in any Brine and Spirit Establishment where an-other class of business is also carried on, the hoursusually and customarily worked by that establishmentat the date of this Agreement may continue to beworked.

4.Overtime.All time worked before 7.30 a.m. and after 5.30 p.m.

on the first 'five working days of th6 week, and all timeworked before 7.30 a.m. and after 1 p.m. on Saturdaysshall be deemed overtime, and paid for as such.

Overtime rates shall be as follows:Time and a halffor the first four hours and double time thereafter, onthe first five working days of the week, and double timefor all work required to be done on Saturday afternoonsand on holidays. In the computation of overtime eachday's work shall stand by itself. Nlo employee shall berequired to work on a Sunday.

5.Holidays.(a) The following holidays shall be observed and

paid for at ordinary rates, namely:New Year's Day,Anniversary Day, Good Friday, Easter Saturday, EasterMonday, Anzac Day, Labour Day, Foundation Day,Christmas Day, Boxing Day, and "Union Picnic Day:Provided that Picnic Day shall be held on the same dayas the day upon which Lumpers' Picnic Day is observed.

(b) A holiday of one week on full pay shall begranted to each employee on completion of each yearof service. An employee not completing one year ofservice shall be granted pay in lieu of holiday in pro-portion to the length of his service: Provided that thisclause shall not apply in the case of any employee sum-marily dismissed for misconduct or dereliction of duty.

. 7.Higher Duties.A worker required for a period of two days in any

one week to perform the work of a higher grade underthis Agreement shall be entitled to the minimum wagehereinbefore prescribed for such higher grade for thetime being during which he is so engaged.

8.Under-rate \Yorkers.An employee who is unable to earn the minimum rate

hereby prescribed may be employed at a lesser rate,which may be agreed upon in writing between suchemployee and the secretary of the Union. If withinseven days after being notified in writing of such em-ployee 's desire to work at a lower rate of wage thanhat prescribed the said secretary and such employee

are unable to agree upon a lower rate, then the employeemay apply in writing' to the nearest Resident or PoliceMagistrate to fix such lower rate of wage,. The em-ployee shall give such secretary two days' notice inwriting- of his intention to apply to the Magistrate, andthe said secretary or his agent may attend and opposethe application. The Magistrate may fix the rate ofwage, and Ins decision shall be final. Any employeewhose wage shall have been so fixed may work for andbe employed by any employer for such less wage for theperiod of six calendar- months thereafter, and after theexpiration of the said period until fourteen days' noticein writing shall have been given him by the secretaryof the -Union requiring his wage to be again fixed in themanner prescribed by this clause: Provided always, thatan employer shall not be entitled under the provisionsof this Agreement to employ an employee on any classof work hereinbefore referred to at a lower rate of wagethan the minimum rate prescribed by this Agreementfor that particular class of work, unless and until he hasin his service at least one permanently employed em-ployee in receipt of a- wage not less than the prescribedminimum, nor shall he employ more than one such em-ployee for every four or fraction of four permanentlyemployed competent employees in receipt of not lessthan the minimum wage hereinbefore prescribed.

The term "permanently employed" when used in thisclause means employed continuously for' not less thanthree calendar months immediately preceding.

9.Night Work.Notwithstanding the provisions of Clause 4 of this

Agreement, an employee required to perform night shiftduty shall be paid. at the rate prescribed by Clause 6hereof for the particular class of work performed, plustwo shillings per shift.

10.Record Book.Every employer shall keep or cause to be kept a time

and wages book, wherein shall be entered the name ofeach employee, the time he commences and finishes workeach day, the hours worked on each day, the overtimeworked each day, and the wage due therefor.

Such hook shall be entered up from day to day, andshall be initialed weekly (if correct) by each employee.

The employer and employee shall be severally respon-sible for the proper daily posting up of the book, whichshall be open for inspection by a duly authorised repre-sentative of the -Union in a place convenient to the em-ployer during all working hours,

11.Young and Female Workers.No male person under the, age of seventeen years nor

any female person shall be employed in any cellar orroom in which wines or spirits are drawn, broken clown,or bottled.

12.Proportion of Male Junior Workers.Junior workers seventeen years of age and under

twenty-one years of age shall be allowed in the propor-tion of one (1) junior worker to every four (4) orfraction of four (4) adult workers employed. Providedthat this clause shall not operate or be so construed asto require the discharge of any person employed in theindustry on the 7th day of December, 1936.

13.Absence through Sickness.A worker shall be entitled to payment for non-attend-

ance, on the grotind of personal ill-health, for one half-day for each completed month of service: Provided thatpayment for absence through such ill-health shall belimited to six days in each calendar year. Paymenthereunder may be adjusted at the end of each calendaryear, or at the time the worker leaves the service of theemployer, in the event of the worker being entitled byservice subsequent to the sickness to a greater allowancethan that made at the time the sickness occurred. Thisclause shall not apply where the worker is entitled tocompensation under the Workers' Compensation Act.

14.Junior Worker's Certificate.Junior workers, upon being engaged shall, if required,

furnish the employer with a certificate containing thefollowing particulars:

(1) Name in full.(2) Age and date of birth.(3) Name of each previous employer and

length of service with such employer.(4) Class of work performed for each previ-

ous employer.Such of the foregoing particulars as are within the

knowledge of an employer shall be indorsed on the cer-tificate and signed by the employer, upon request of theworker.

No worker shall have any claim upon an employer foradditional pay in the event of the age or length of ser-vice of the worker being wrongly stated on the certifi-cate. If any junior worker shall wilfully misstate hisage in the above certificate he alone shall be guilty ofa breach of this Agreement.

receipt of a report from the Permanent Head in accord-ance with the Public Service Regulations regarding thegood conduct, diligence, and efficiency of the officer.

After attaining the age of nineteen (19) and beforereaching twenty-three (23), all junior clerks will berequired to pass a promotional examination as prescribedin the Public Service Regulations 94 and 96, and, sub-ject to passing such required examination and reachingthe age of twenty-one (21) years, and on appointmentto a position carrying a classification higher than thejunior range, officers will, subject to Regulation 43, bepaid a salary according, to age at date of appointmentto such senior position; subject, however, to the pro-vision that on attaining the age of twenty-one (21)years an officer shall be entitled to be paid an amountequivalent to the basic salary.

2.An officer retained on the maximum salary of two

hundred and seventy pounds (£270) for five (5) yearsshall be paid an allowance of ten pounds (£10) perannum: Provided the Permanent Head certifies thatsuch officer is eligible and would be recommended forpromotion, on the grounds of efficiency and good con-duct; such allowance to cease on promotion to a higherposition, or an officer refusing to accept promotion.

3.Officers appointed under Regulation 90 shall be at

a minimum salary, subject to Regulation 43, based onyears of service, and not on age.

4.The rates of pay for all officers shall be subject to

adjustment in accordance with the basic wage declara-tion made by the Court: Provided that the basic salarypayable for the purposes of this Award shall be thenearest multiple of five pounds (£5) to the resultobtained by multiplying the State weekly basic wage byfifty-two and one-sixth (52k).

Memorandum, of Agreement.(Note.Wherever the Word "Award" occurs herein

it shall be taken to mean and include "Agreement.")

1.Scope.This Award shall apply to the industries mentioned

in the first column of the Schedule hereunder and tothe industries conducted by the respondents in thesecond column hereunder and similar industries con-ducted by other persons, firms, or companies in respectof workers following the vocations mentioned herein:Provided that it shall not apply to workers who areat present provided for in any Award of the Court ofArbitration of Western Australia, or in any IndustrialAgreement registered in accordance with " The Indus-trial Arbitration Act, 1912-1935."

2. Area.This Award shall be limited in its effect to the area

comprised within a radius of twenty-five (25) milesfrom the General Post Office in the city of Perth.

3.Term.The term of this Award shall -be three (3) years from

the date hereof.4. Definitions.

(a) "Shop assistant" shall mean a worker substan-tially performing one or more of the following dutiesin retail establishments:

Selling goods, weighing, assembling and/or pre-paring goods for sale, attending to stock, receivingcash, and dressing out for display of goods. Theterm shall include carpet planners, lino layers,workers engaged in erecting- window treatments, wirescreens or duck blinds, and soda fountain and/ormilk bar assistants and assistants in country orderdepartments.

(b) "Storeman" shall mean a worker substantiallyperforming one or more of the following duties:

Receiving, storing, assembling, weighing, brand-ing, stacking or unpacking or distributing goods ina shop, store, or warehouse, or delivering goodsfrom a shop, store or warehouse for transit.

(c) The term "Head storeman" means a person per-forming the duties of a storeman and who is in chargeof one or more men.

(d) The terns "Storeman working singly" shallmean a storeman working where no other storeman isemployed in the establishment.

(e) "Despatch hand" shall mean a worker who issubstantially engaged in handling or receiving goodsfrom departments for despatch, or who passes themover to the packing room or prepares and hands overpackages to carters for delivery and who, if required,shall be responsible for the proper checking off of suchpackages and for the proper branding and markingthereof and keeping necessary records, such as rail notesand cart notes.

(f) "li"ead despatch hand" shall mean a worker whois placed by his employer in charge of ,one or more de-spatch hands.

(g) "Packer" shall mean a. worker who packs goodsfor transport by rail or ship. A worker who packsgoods for delivery by road transport where the destina-tion of such goods is beyond the area covered by thisAward shall be classed as a packer.

(It) "Casual hand" shall mean a worker engaged bythe hour and who may be put off or leave the employer'sservice at any moment without notice: Provided thatthe minimum engagement of all shop assistants engagedas casual hands shall not be less than one day. Theminimum engagement of all other workers shall be four(4) hours, to be worked in one continuous period.

A worker engaged and not permitted to commencework shall receive two (2) hours' pay at the prescribedrate of pay.

(i) "Adult."For the purpose of this Award theword "adult" shall mean a worker twenty-one (21)years of age and over, or a worker who is in receiptof the prescribed adult rate of pay.

(j) The term "Weekly hand" shall mean a workerengaged by the week and whose employment shall beterminable by not less than one week's notice on eitherside. Such week's notice cannot be continued fromweek. to week: Provided that any worker employed fora. period of four (4) consecutive weeks or less shall beclassed as a casual band and paid not less than the

minimum rate of wages herein prescribed for a casualhand, but this proviso shall not apply in cases wherea worker employed as a weekly hand had been dispensedwith for incompetence or unsuitableness or any causereferred to in Clause 18 hereof.

(k) "Wholesale establishment" shall mean any ware-house or place where goods are exclusively or principallysold for resale and/or where goods are sold for con-sumption and/or use in another business.

(1) "Department" shall mean a section of an estab-lislunent in or from which classified goods are sold oroffered for sale by retail.

5.Chemist Shops.Any worker employed in a chemist shop shall be sub-

ject to the terms of this Award up to the time he orshe becomes indentured to the profession.

6.Hours.The hours of work shall be as follows:

(a) Retail Establishments other than Fourth ScheduleShops

(i) Shop assistants:Forty-eight (48) hours formales sixteen (16) years of age and over, andforty-four (44) hours for all females and formales under sixteen (16) years of age shallconstitute a week's work. The hours of workshall be :Monday to Friday inclusive, be-tween 8.20 a.m. and 6 p.m.; on Saturday, be-tween 8.20 a.m. and 1 p.m.

(ii) Storemen, packers, and despatch hands:Thehours usually and customarily worked prior tothe 1st day of December, 1936, shall continueto be worked: Provided that such hours shallnot exceed forty-eight (48) per week in re-spect of males sixteen (16) years of age andover, and forty-four (44) per week in the caseof juniors under sixteen (16) years of age.Such hours shall be worked between 7.20 a.m.and 6 p.m. on Monday to Friday inclusive andbetween 7.20 a.m. and 1 p.m. on Saturday: Pro-vided that no day's work shall exceed a spreadof nine (9) hours forty (40) minutes, Mondaysto Fridays inclusive, and four (4) hours forty(40) minutes on 'Saturdays, to be worked inone continuous shift,

(b) On the day mutually agreed upon by the partieshereto to be observed as Christmas Eve for the purposeof a late shopping night, the ordinary hours of workmay be extended by agreement between the parties.

(c) Fourth Schedule Shops:Workers employed inshops comprised in the Fourth Schedule of "The Fac-tories and Shops Act, 1920-1932" (whose hours of workshall not exceed forty-eight (48) per week for malessixteen (16) years of age and over and forty-four (44)per week for females and males under sixteen (16)years of age) shall be worked to suit the convenienceof the employer's business: Provided that, from weekto week, the worker shall be notified by the employerof the half day, which shall be granted in the afternoon,upon. which his or her services will not be required ineach week.

(d) Wholesale Establishments:The number of hoursper week usually and customarily worked prior to the1st day of December, 1936, shall be observed duringthe currency of this Award, but shall not exceed forty-eight (4S) hours per week for males sixteen (16) yearsof age and over and forty-four (44) hours per weekfor males under sixteen years of age: Providedthat the starting time shall not be earlier than 7.30 a.m.and the finishing time not later than 6 p.m. from Mon-day to Friday inclusive, and 7.30 a.m. to 1 p.m. onSaturday: Provided that no day's work shall exceed aspread of nine (9) hours forty (40) minutes on Mon-days to Fridays inclusive and for (4) hours forty (40)minutes on Saturday, to be worked in one continuousshift.

(e) The spread of hours for females bound by thisAward shall not exceed nine (9) hours.

7.Meal Times.(a) Retail Shops other than Fourth Schedule Shops:

One hour for any meal shall be given and taken. Lunchhour shall be between 12 noon and 2.15 p.m. Tea hourshall start within fifteen (15) minutes after the pre-scribed finishing time.

(b) Fourth Schedule Shops:Meal hours in FourthSchedule Shops shall be taken at the times most con-venient to the employer's business: Provided that onehour shall be given and taken for each meal and thatnot more than five (5) or less than three (3) hourinterval shall be worked without an interval for a mealbeing taken.

(c) All other workers:One hour shall be given, andtaken for a meal. Lunch hour shall be taken between12 noon and 2.15 p.m. Tea hour shall start withinfifteen (15) minutes after the usual finishing time.

(d) Where work is performed outside the ordinaryworking hours one hour's break for a meal shall beallowed between 12 'clock midnight and 1 o'clock a.m.and between. 7 a.m. and 8 a.m.

The meal hours referred to in this clause shall be takenin one continuous period.

Notwithstanding anything contained in this clause,the lunch hour for workers in retail establishments,other than Fourth Schedule Shops, shall, -during the firsttwo (2) days of each of the three sales per annum,and during Christmas week, be given and taken betweenthe hours of 11.30 a.m. and 2.30 p.m.

S.Meal Money.With the exception of all workers whose duties are

usually performed after 6 p.m. from Monday to Fridayand after 1 p.m. on Saturday, all other workers shall,if required to work after the usual finishing time fromMonday to Friday, or after the usual finishing time onSaturday, be paid one shilling and sixpence (1s. 6d.) formeal money: Provided that meal money shall not bepayable where a worker continues to work on after theprescribed finishing- time for one half-hour or less.

9.Overtime.(a) Excepting as provided hereunder, all overtime

worked shall be paid for at the rate of time and a halffor the first four (4) hours and double time thereafter.In the computation of overtime each day shall standby itself.

(i.) Where overtime is worked in Fourth ScheduleShops the worker shall be paid overtime as provided in(a) after the prescribed weekly hours of work havebeen exceeded. Work performed on Sundays and/orprescribed holidays shall be paid for at the rate ofdouble time.

(ii.) Where workers a-re required to work continuouslyafter the first four (4) hours of overtime have beenworked (except on Saturday) they shall be paid at therate of double time up to the time they finish work:Provided that hour shall not be later than the prescribedstarting time the next day.

(b) All time worked in establishments other thanthose prescribed in (i) hereof, before the usual startingtime or after the usual finishing time, shall be paid forat overtime rates. Work performed on Saturday after-noons, Sun-days, and/or prescribed holidays shall bepaid for at double time.

10.Holidays.(a) The following days shall be observed as holi-

days and paid for, namely:New Year's Day, Anni-versary Day, Good Friday, Easter Saturday, EasterMonday, Labour Day, Anzac Day, Foundation Day,Christmas Day, and Boxing Day.

(h) A holiday of one week on full pay shall begranted to each worker on completion of each year ofservice. A worker not completing one year of serviceshall be granted -pay in lieu of holidays in proportionto the length of his or her service.

Provided that, when a worker is entitled to holidaysunder this clause, he shall receive at least two (2)weeks' notice from his employer of the date when itwill be convenient to the employer that such workershould take his holidays: Provided further, that thisclause shall not apply in the case of any worker sum-marily dismissed for misconduct or dereliction of duty.

11.Wages.The minimum rate of wage payable to any male

worker employed as a shop assistant who is of the ageof twenty-one (21) years or upwards, or to any femaleworker employed as a shop assistant who is of the ageof twenty-one (21) years or upwards shall be asfollows:

Provided always, it shall be competent for an em-ployer or a worker to refer the matter to theBoard of Reference as provided in Clause 22herein, which shall fix a rate per mile for theparticular motor vehicle under review sufficientto cover the actual cost of petrol and oil used onthe employer's business. The rate shall alsoinclude an allowance for depreciation, registra-tion, and insurance, to be calculated in theproportion -to the number of miles actuallytravelled on the employer's business to thetotal mileage for the year. Each worker underthis clause shall enter in the record provided bythe employer for the purpose before starting andupon-finishing duty each day, the reading of thespeedometer attached to his vehicle.

12.Any person, whether a junior or adult, employed as

a canvasser and/or collector shall be paid the fulladult minimum wage.

13.Where an employer usually has more than six (6)

workers engaged under the terms of this Award, heshall provide his workers with a suitable room forkeeping their hats and clothing and to use as a roomfor taking their meals. Such room to be situatedwithin a reasonable distance of his place of businessand to be kept in a proper state of cleanliness.

14.Nothing herein contained shall entitle an employer

to reduce the wage of any worker who at the date ofthis Award was being paid a higher rate of wage thanthe minimum prescribed for his or her class of work.

15.Higher Duties.A worker who is required to do work which is en-

titled to a higher rate under this Award than thatwhich he or she usually performs, shall be entitled topayment at the higher rate while so employed.

16.Mixed Functions.Where a worker is called upon to perform more than

two (2) classes of work on any one day he shall, forthe purpose- of ascertaining the wages to be paid, bedeemed to have worked the day at the class for whichthe higher rate is prescribed: Provided that, where thestarting and finishing time of work done in the highergrade is entered in the time and wages book and suchwork done in the higher grade is under two (2) hours inany one week no extra payment shall be made. In theevent of no record being made in the time and wagesbook, the provisions of the first paragraph of this clauseshall apply.

17.Proportion of Juniors.(a) The number of male juniors, with the exception

of junior packers, shall not exceed the proportion ofone to one for the first five (5) male adults, and there-after one junior to every two (2) male adults or frac-tion thireof.

Provided that the number of junior packers shall notexceed the proportion of one junior to every four (4)adult packers.

(b) Where no adult shop assistant is employed, onejunior shop assistant may be employed.

(c) 'Where one adult female assistant is employedtwo (2) junior female assistants may be employed.

Where two (2) adult female assistants are employedthree (3) junior female assistants may be employed.

Where three (3) adult female assistants are em-ployed four (4) junior female assistants may be em-ployed.

Where four (4) adult female assistants are employedfive junior female assistants may be employed.

And thereafter the proportion shall not exceed five(5) junior female assistants to four (4) adult femaleassistants.

18.Engagement.One week's notice on either side shall be accessary

to terminate the engagement: Provided that an em-ployer at any time may dismiss a worker for refusalor neglect to obey orders or for misconduct, or if, afterreceiving one week's notice, such worker does notcarry out his or her duties in the same manner as heor she did prior to such notice.

19.Time and Wages Record.The employer shall keep and enter up, or cause to

he kept and entered up, a record containing the namesof each of his workers to whom this Award applies,the class of work performed by and the wages paid toeach worker, the age of each junior worker and thetime during which each worker has been employed.Such record shall be open to inspection by a repre-sentative of the Union between the hours of 10 a.m.and 4 p.m. on any working day from Monday to Fri-day inclusive,

20.--Uniforms and Overalls.Should any dispute arise between the parties as to the

compulsory wearing of uniforms or overalls, the dis-pute, howsoever originating, and any mattes: arisingthereout, including the matter of the laundering ofuniforms and overalls, shall be determined by the'Board of Reference.

21.Under-Rate Workers.Any worker who by reason of old age or infirmity

is unable to en I'll the minimum adult wage prescribedby this Award may be employed at such lesser wage(if any) as may be agreed upon in writing betweenthe worker and the secretary of the applicant Union.If within twenty-four (24) hours after the worker hasnotified the secretary of his or her desire to work at alesser wage than the said minimum the secretary andthe worker do not agree as -aforesaid, then the workermay apply to the most convenient Resident or PoliceMagistrate for a permit to work at such lesser wage.The worker shall give to the said secretary at leasttwenty -four (24) hours' notice in writing of his or herintention to make such application to the Magistrate,and the secretary or his agent shall be entitled toattend before the Magistrate and, pending the decisionthereon in either case, the worker shall be entitled towork and be employed by an employer at the proposedlesser rate. The Magistrate may grant such workera permit to work for such wage and for such periodnot exceeding six (6) calendar months, as he thinksfit, and his decision in the matter shall be final. Thepermit shall entitle the worker to work at the wagetherein mentioned for such period as may be thereinstated, until the wage shall have again been settledby the Magistrate on the application of the saidsecretary.

22.Board of Reference.The Court appoints, for the purpose of the Award,

a Board or Boards of Reference. Each Board shallconsist of a chairman and two (2) other representa-tives, one to be nominated by each of the parties. Thereare assigned to each such Board in the event of noagreement being arrived at between the parties tothe Award, the functions of:

(i) adjusting any matters of difference which mayarise between the parties from time to time,except such as involve interpretations of theprovisions of the Award or any of them;

(ii) classifying and fixing wages, rates, and con-ditions for any occupation or calling notspecifically mentioned in the Award;

(iii) deciding any other matter that the Court mayrefer to such Board from time to time.

(iv) An appeal shall lie from any decision of suchBoard in the manner and subject to the con-ditions prescribed in "Tine Industrial Arbi-tration Act, 1912-1935," which for this pur-pose are embodied in this Award.

23.Country Work and Travelling Time.(a) When a worker is engaged on outside work, the

employer shall pay all fares, and a proper allowance atcurrent rates shall be paid for all necessary meals.Pares shall be second-class, except when travelling bycoastal boat, when saloon fares shall be paid.

(h) When a. worker is engaged at such a distancethat lie cannot return at night, suitable board andlodging shall be found at the employer's expense.

(c) Travelling time outside ordinary working hoursshall be paid for at ordinary rates up to a maximumof twelve (12) hours in ally twenty-four (24) hourperiod, from the time of starting on the journey: Pro-vided that, when the travelling is by boat, not morethan eight (8) hours shall be paid for in such period.

24.Junior Worker's Certificate.Junior workers shall furnish the employer with a

certificate showing the following particulars:(I) Name ih full.(ii) Age and date of birth.

(a) The certificate shall be signed by the worker.(b) No worker shall have any claim upon the em-

ployer for additional wages, in the event of his agebeing wrongly stated on this certificate: Provided that

this subelanse shall operate only for the first three (3)months from the date, of the worker's first engagement,thereby enabling the employer, if he so desires, to ob-tain proof of the junior worker's age.

25.Provided always, and it is hereby expressly agreed

and declared, that nothing in this Award shall applyto workers in :tny wholesale. business (excepting whole-sale hardware) other than the following:Head store-men, storemeu, storemeu working singly, packers, juniorpackers, junior storemen, junior despatch hands, casualpackers, despatch hands, casual storemeu, casual despatchhands (junior and adult), junior and adult messengers.

I certify, pursuant to Section 63 of ' The IndustrialArbitration Act, 1912-1935," that the foregoing is acopy of the Agreement arrived at between the partiesmentioned above.

hind the bar counter liquor for sale by retail in anyestablishment permitted to retail liquor under a pub-lican's general, hotel, or wine and beer license, andwhose duties shall also include the putting on of beer,stacking bars, and keeping clean and orderly the barcounter and behind the bar, excepting the flour and/orwindows or any other portion of the licensed premises:Provided always, that the terms "Barmaid" or "Bar-man" shall not include any person who assists or re-lieves behind the bar for not more than two (2) hoursin any day, which hours shall be worked as following:one hour unbroken between the hours of 12 noon and2 p.m., and/or one hour unbroken between the hours of5 p.m. and S p.m., or two hours unbroken between thehours of 5 p.m. and S p.m.: Subject to the further pro-viso, that the number of persons permitted to assist orrelieve behind the bar at any one time shall not exceedone where three (3) or less +barmaids and/or barmenare employed, and two (2) where over three (3) bar-maids and/or barmen are employed.

Provided that, hi respect to any basic, wage variationwhich may occur :from time to time, the total wage pre-scribed for a barmaid shall be increased or decreased bythe same amount that the basic wage for barmen is in-creased or decreased as a result of such variation, inorder that the rates for a barmaid and a barman shallremain equal. Wages shall be paid weekly.

(iii) Where the Board of Reference or the Uniongrants a permit for the worker to lodge and/or hoardon the premises of the employer, the sum one poundone shilling and ninepence (-.411 is. 9d.) within a. 15-mileradius from the General Post Office, Perth, and onepound one shilling. and elevenpence ls. 11(1.) out-side a 15-mile radius but within a 20-mile radius fromthe General Post Office, Perth, may be deducted fromthe hereinbefore stipulated wages for hoard and lodg-ing charges.

(iv) The Board of Reference shall consist of theSecretary of the Licensed 'Victuallers' Association, theSecretary of the Western Australian Barmaids andBarmen's Union, with the Clerk of the ArbitrationCourt as Chairman.

3.Residence.(i) Except as hereinafter provided, no barmaid or

harman shall board and/or reside upon the licensedpremises of her or his employer. No employer shallgive or sell, and no worker shall take or buy a mealor meals on the licensed premises where she or he isemployed, without first obtaining the assent in writingof the secretary of the Union.

(ii) The above shall not apply to(a) Any barmaid or barman who is the son or

daughter of the licensee of the hotel in whichshe or' he is working.

(b) Any hotel to which, in the opinion of the Boardof Reference, or the Union, it is inexpedientthat this condition should apply.

4.Hours.(i) All work done in excess of forty-eight (48)

hours in any one week, or of eight (8) hours in anyone day, excepting as provided in (ii) hereof, or out-side a daily spread of thirteen (13) hours, to be workedin not more than three (3) periods, shall be paid. forat the rate of time and a third, such overtime rates tostand alone and be paid for separately and apart fromthe ordinary week's wages.

(ii) On Fridays and Saturdays nine (9) hours maybe worked without incurring the payment of overtime.

3. Jmas Day, Good Friday, Sunday, LabourDay and Anzac. Day.

All work_ dune on (_11rist.ruas hay, Good Friday, andSunday shall be paid for at the rate of three shillings(3s.) per hour or portion of an hour, in addition to theweekly wage. All work done on Anzac Day and LabourDay shall be paid for at the rate of one and a halftime: .Provided that Anzac Day remains as at presentvirtually a Sunday in the trade. Should the presentconditions under which it is honoured be altered, thenthe provision for payment of one and a half time forthat day be discharged automatically from this Award.

0.Casual, Race, Show, and Sports Hands.(i) A casual barmaid or barman may be employed

between the hours of 7 p.m. and 9 p.m. at the rate offive shillings (5s.) per hour; or for not less than eight(8) hours per day at one pound (1). For the purposeof this subclause a casual barmaid or barman shallmean a barmaid or barman whose services are termin-ated by the employer before the completion of five (5)days continuous employment.

(ii) A barmaid or barman employed in booths atcricket matches or as an extra hand at hotels for foot-ball matches for not more than two (2) hours continu-ously shall be paid ten shillings (10/-), but if employedfor more than two (2) hours the provisions of the firstparagraph of the clause shall apply.

(iii) A barmaid or barman employed at the TrottingGrounds or other night sports shall be paid ten shillings(10/-) for work up to 9 p.m. If work proceeds after9 p.m.. two shillings_ and sixpence (2/6d.) per hour shallbe paid. The time for starting work shall be the timeshe or he is told to he at the grounds.

(iv) All work done in excess of eight (8) hours inany one day shall he paid for at the rate of time andone third..

7. Uniform.Where the employer insists upon a barmaid or bar-

man wearing a uniform whilst at work, the employershall provide it and maintain it in a reasonable stateof cleanliness.

8.Meal Time.A barmaid or barman shall be allowed one hour be-

tween the hours of 12 noon and 3 o'clock in the after-noon for dinner, and one hoar between the hours of fiveand eight o'cloek in the evening for tea: Provided that,with the consent of the Union secretary, some otherarranitentent inure suitable to the employer's businessmay be adopted.

9.Weekly Half Holiday.The weekly half-holiday shall commence not later than

1.30 p.m. on souse one week clay in each week irrespec-tive of whether' there are full day's holiday providedfor under Clause 5, excepting' Christmas week: Pro-vided that, should it be agreed that barmaid or barmanshall work during their usual half-holiday, then theyshall receive payment of one day's wage over and abovethe usual weekly wage.

10.Holidays and Annual Leave.A barmaid or barman shall be entitled to two (2)

weeks' leave on full pay after the expiration of eachtwelve (12) months' service. Such leave shall be grantedwithin two (2) months of its becoming (Hie, failingwhich the employer shall pay double time for all worrtdone after that date, and in no case shall the money bepaid instead of the holiday. A barmaid or barmanwhose services have been terminated before twelve (12)months have expired shall be entitled to payment forone day for each calendar month worked.

For the purpose of calculating holiday pay the secondor any subsequent year's service shall be deemed to com-mence on the day and the month corresponding to theoriginal commencement of the barmaid's and barman's

leave.irrespective of the time of grant of annual

11.Notice.Except in the case of casual barmaids or barmen,

twenty-four (24) hours' notice of termination of em-ployment shall be given by either side.

12.Term.This Award shall operate for a period of three (3)

years from its date.

13.Record Book.(i) Each employer shall keep or cause to be kept at

his business premises Record Books in which shall beentered the name of each worker, the time each Workercoinmences and ceases work each day, the total numberof hours, and the amount of overtime Worked, the timeworked on Christmas Day, Good Friday, Anzac Day,Labour Day, and on any Sunday, and the amount ofwages and overtime paid, and the worker's signaturefor the same.

(ii) The worker and the employer shall be jointlyresponsible for the proper posting of the Record Booksdaily.

(iii). Such Record Books shall be so kept as to beopen to and available for inspection by an accreditedrepresentative of the Union during business hours..

(iv) A roster of the working hours of all barmaidsand barmen shall be kept in the principal bar.

(v) For the purpose of calculating payment and ros-tering, the time of ceasing work shall be and mean thetime when the barmaid or barman has completed allwork behind the bar, whether such cessation is laterthan the statutory closing time or not.

14.Schedule of Wages and Working Conditions.Each employer shall keep on some portion of his busi-

ness premises a copy of this Award, where it shall beopen to the. inspection of the worker at all reasonabletimes.

15.--l'ayment for Sickness, etc.A worker shall be entitled to payment for non-attend-

ance on the ground of personal ill-health for one half-dayfor each completed 111011th Of service: Provided thatpayment for absence through such ill-health shall belimited to six (6) days in each calendar year. Pay-ment hereunder may be adjusted at the end of eachcalendar year or at the time the worker leaves the ser-vice of the employer, in the event of the worker beingentitled by service subsequent to the sickness to a greaterallowance than that made at the time the sicknessoccurred. This clause shall not apply where the workeris entitled to compensation under the 'Workers' Com-pensation Act.

Holiday pay shall not accrue during a worker's ab-sence from his or her employment for any cause what-soever.

16.Area.This Award shall apply to the area comprised within

a radius of twenty (20) miles from the General PostOffice, Perth, and any portion of the Fremantle Licens-ing District situated beyond that radius.
