Please note that the last published edition of the Vacancies Gazette
There is no longer a requirement for Agencies to publish the vacancy positions
in the Vacancies Gazette as per the Public Service Commission
Recruitment and Selection Directive 1/10 as issued in January 2010.
However, the requirement to publish the appointment of advertised
vacancy positions in the Gazette remains in place.
Therefore, all appointment notice submissions received from Monday, 8th November 2010
will be published in the Queensland Government General Gazette .
All existing subscriptions to the Vacancies Gazette will be transferred to the
General Gazette, i.e. from the week ending Friday, 12th November 2010 all Vacancies
Gazette subscribers will receive the General Gazette for the duration of their subscription.

NOTIFICATION OF APPROVAL OF STANDARD ENVIRONMENTAL
CONDITIONS
1. Authorising law
The Minister, pursuant to section 549 of the EnvironmentalProtection Act 1994 has approved the standard environmentalconditions for carrying out the environmentally relevant activity(ERA) outlined in the following code of environmentalcompliance (the Code).
2. Title of the code containing standard environmental conditions
“Code of environmental compliance for certain aspects ofextractive and screening activities (ERA 16) – Version 5”
3. Commencement date
This notification commences on 26 November 2010.
4. Availability of codes
The code is available from the Department of Environmentand Resource Management’s (DERM) head office located at400 George Street, Brisbane during office hours on businessdays; the DERM website http://www.derm.qld.gov.au/ ; orby contacting the Permit and Licence Management unit(PALM) on 1300 130 372.

Ministerial declaration pertaining to continuity of eligibility for membership of the State Public Sector Superannuation Scheme
for employees of Port of Brisbane Pty Ltd (ACN 143 384 749) after it ceases to be a unit of the State public sector
Pursuant to section 13AA(1)(c)(iii) of the Superannuation (State Public Sector) Act 1990 (Qld) (Act), I, Andrew Fraser, Treasurer andMinister for Employment and Economic Development, do each of the following:
(a) declare that on the date on which Port of Brisbane Pty Ltd (ACN 143 384 749) (POBPL) ceases to be a wholly-owned subsidiaryof Port of Brisbane Corporation Limited on the sale of the shares in POBPL to a purchaser (Cessation Date), that all personswho are employees of POBPL at that time and were employees of POBPL immediately prior to the Cessation Date, keep alltheir existing and accruing rights relating to superannuation in respect of their membership of the State Public SectorSuperannuation Scheme; and
(b) declare that, if the Cessation Date is prior to the date of gazettal of this notice, then this notice has retrospective operation tothe Cessation Date pursuant to section 13AA(5) of the Act.

TRANSFER NOTICE
Port of Brisbane Corporation Limited – Completion
1. Pursuant to section 9 of the Infrastructure Investment(Asset Restructuring and Disposal) Act 2009 , I, AndrewFraser, Treasurer and Minister for Employment andEconomic Development, do each of the following:
a) agreements for lease
Transfer from POBCL to POB Pty Ltd all of:
(i) POBCL's rights, title, interests, obligations andliabilities under or relating to:
(A) any obligations of POBCL to grant any licenceor permit to occupy;
(B) any obligations or liabilities of POBCL toperform any capital works or expend money,
under:
(C) the Brisbane Container Terminals Agreementfor Lease;
(D) the Chalmers Industries Pty Ltd Agreement forLease;
(E) the Ampol Refineries Limited and SunstateCement Ltd Agreement; and
(F) the Neumann Petroleum Pty Ltd Agreement forLease,
but excluding any obligations of POBCL to grant orvary or accept surrender of any lease and the rightsof POBCL to any payment, and the benefit of anywarranty, disclaimer, acknowledgement or release,in respect of the grant or variation of leases.
b) capital works contracts
Transfer from POBCL to POB Pty Ltd all of POBCL's rights,title, interests, obligations and liabilities under or relatingto:
(i) the contracts described in Schedule 1 of the TransferStatement; and
(ii) any other contract relating to the performance ofany capital works, including consultancy servicescontracts relating to capital works or major or minorconstruction contracts relating to capital works.
c) bank guarantees relating to capital works contracts
Transfer from POBCL to POB Pty Ltd all of POBCL'srights, title, interests, obligations and liabilities underor relating to:
(i) the instruments described in Schedule 2 of theTransfer Statement; and
(ii) any other instruments of guarantee associated withany contract relating to the performance of any capitalworks, including consultancy services contractsrelating to capital works or major or minor constructioncontracts relating to capital works.
d) licences
Transfer from POBCL to POB Pty Ltd all of POBCL'srights, title, interests, obligations and liabilities underor relating to:
(i) the licences and permits granted by POBCL describedin Schedule 3 of the Transfer Statement; and
(ii) any other licences or permits to occupy land (that isnot an estate or interest in land) granted by POBCL toany person in relation to that area of land the subjectof the leases between POBCL and POB Pty Ltd dated1 July 2010.
e) Development Permits, Registration Certificates and otherStatutory Licences and Permits
(i) Transfer from POBCL to POB Pty Ltd all of POBCL'srights, title, interest, obligations and liabilities underor relating to:
(A) the ERA 16 Permit;
(B) any development permit, registration certificatefor an environmentally relevant activity, permit,licence, approval or other authority required forPOB Pty Ltd to perform the obligations under thecontracts described in Schedule 1 of the TransferStatement that are transferred to POB Pty Ltd byparagraph 1(b) of this Transfer Notice; and
(C) any development permit, registration certificatefor an environmentally relevant activity, permit,licence, approval or other authority that wasexpressly excluded from transfer under theRestructure Transfer Notice by virtue of paragraph(d) of the definition of "Development Permits,Registration Certificates and other StatutoryLicences and Permits" under the RestructureTransfer Notice.

(ii) Provide that from the Effective Date, all of POBCL'srights, title, interest, obligations and liabilities underor relating to all development permits, registrationcertificates for an environmentally relevant activity,permits, licences, approvals or other authoritiesreferred to in paragraph 1(e)(i) of this TransferNotice, including the ERA 16 Permit, are taken to beissued to and held in the name of POB Pty Ltd and:
(A) those development permits, registrationcertificates for an environmentally relevantactivity, permits, licences, approvals and otherauthorities apply to POB Pty Ltd; and
(B) any applications by POBCL for anydevelopment permit, registration certificate foran environmentally relevant activity, permit,licence, approval or other authority required forPOB Pty Ltd to perform the obligations underthe contracts described in Schedule 1 of theTransfer Statement that are transferred to POBPty Ltd by paragraph 1(b) of this TransferNotice are taken to have been made by POB PtyLtd in the name of POB Pty Ltd; and
(C) any applications by POBCL for renewal of anydevelopment permit, registration certificate foran environmentally relevant activity, permit,licence, approval or other authority transferredby this Transfer Notice are taken to have beenmade by POB Pty Ltd in the name of POB Pty Ltd.
f) insurance and indemnities
(i) Transfer from POBCL to POB Pty Ltd all of POBCL'srights in respect of and benefit of contracts ofinsurance and WorkCover Indemnities to the extentthey relate to any property, liabilities or LegalProceedings transferred to POB Pty Ltd under thisTransfer Notice or any Prior Transfer Notice.
(ii) Provide that to the extent that any instrument ofinsurance or indemnity provides a right or benefittransferred under paragraph 1(f)(i) of this TransferNotice:
(A) POB Pty Ltd will replace POBCL as a party to thatinstrument;
(B) each reference to POBCL as a party in thatinstrument will be taken to be a reference toPOB Pty Ltd:
(C) the benefits and right provided by such instrumentto, by or in favour of POBCL are taken to have beengiven to, by or in favour of POB Pty Ltd;
(D) an amount that is or may become payable to or byPOBCL under such instrument is payable to or byPOB Pty Ltd; and
(E) POB Pty Ltd will be entitled to all of the rights,and assume all of the liabilities of POBCL arisingunder or relating to that instrument (includingany rights and liabilities which arose prior to theEffective Date),
but only in relation to, and to the extent of, the rightor benefit transferred.
g) Records
Transfer from POBCL to POB Pty Ltd all of POBCL'sdocuments and records (including electronic documentsand records) used exclusively in connection withanything transferred to POB Pty Ltd under this TransferNotice that are in the possession or control of POBCL(other than the Excluded Records and duplicatedocuments and records).
h) Legal Proceedings
Provide that from the Effective Date, any LegalProceedings relating to anything transferred to orgranted or imposed on POB Pty Ltd under this TransferNotice are to be continued or taken by or against POBPty Ltd, with the intent that any proceedings, orders orjudgments that would otherwise be taken or madeagainst or for the benefit of POBCL be instead taken ormade against or for the benefit of POB Pty Ltd.
i) Cash Securities
Transfer from POBCL to POB Pty Ltd the Cash Securities.
j) Port of Brisbane Future Port Expansion Agreements
Transfer from POBCL to POB Pty Ltd all of POBCL's rights,title, interests, obligations and liabilities under orrelating to:
(i) clauses 8.4 to 8.6 (meetings) and clauses 8.7 to 8.11(information, art and displays) of the Port of BrisbaneFuture Port Expansion Agreement (Jagera); and
(ii) clauses 8.3 to 8.6 (employment and business) andclauses 8.7 to 8.10 (information and art) of the Portof Brisbane Future Port Expansion Agreement(Quandamooka).
k) consideration
Provide that in relation to transfers from POBCL to POBPty Ltd under this Transfer Notice:
(i) the consideration for the transfer of an item providedfor in this Transfer Notice is nil, or as otherwisedetermined by me in accordance with the Act;
(ii) the transfer of an item provided for in this TransferNotice is to be designated as a contribution byPOBCL, and adjusted against contributed equity ofPOB Pty Ltd; and
(iii) the value to be ascribed for the transfer of an itemprovided for in this Transfer Notice is the book valueof that item recorded in the books of POBCLimmediately prior to the Effective Date.
l) Amendment of Perpetual Leases
Provide that the terms and conditions of each of thePerpetual Leases is amended to provide that:
"The lessee may, and may permit its sublessees andlicensees to, construct, alter, remove add to and/ordemolish any improvements. Any proceeds from thesale by the lessee of improvements removed by thelessee, its sublessee or licensee may be retained bythe lessee, sublessee or licensee as the case may be."
m) other provisions
Provide that:
(i) without limiting the above paragraphs, in respect ofany instruments transferred (or purported to betransferred) to, or deemed (or purported to be deemed)to be issued or held or made in the name of POB Pty Ltdby reason of paragraph 1 of this Transfer Notice, to theextent of such transfer or deeming described in theabove paragraphs:
(A) POB Pty Ltd is a party to each such instrumentin place of POBCL;
(B) the benefit and rights provided by such instrumentto, by or in favour of POBCL are taken to have beengiven to, by or in favour of POB Pty Ltd;
(C) a reference to POBCL in such instrument is areference to POB Pty Ltd;
(D) an amount that is or may become payable to orby POBCL under such instrument is payable toor by POB Pty Ltd;

(E) anything to be transferred to or by POBCL undersuch instrument is to be transferred to or byPOB Pty Ltd; and
(F) all rights, title, interests, obligations and liabilitiesof POBCL under such instrument are held or owedby POB Pty Ltd;
(ii) each transfer and provision under paragraphs 1(a)to 1(m) of this Transfer Notice is to take effect at theEffective Date.
2. Excluded assets and liabilities
Notwithstanding any other paragraph of this TransferNotice, paragraphs 1(a) to 1(m) of this Transfer Notice donot apply to the Excluded Assets and Liabilities.
3. Pursuant to section 11 of the Act, I, Andrew Fraser, Treasurerand Minister for Employment and Economic Development,direct and require that:
a) POBCL website
POBCL and its Board must ensure that POBCL removesany information posted on the website located atwww.portbris.net.au within 10 business days after theEffective Date.
b) instruments not capable of transfer
POBCL and POB Pty Ltd and their respective Boards must doall things (including the execution and delivery ofinstruments) necessary, incidental or ancillary to effect thetransfer from POBCL to POB Pty Ltd of all rights, title,interests, obligations and liabilities under or relating to anyassets, liabilities or instruments purported to be transferredunder this Transfer Notice that are not capable of beingtransferred under this Transfer Notice, including withoutlimitation the transfer from POBCL to POB Pty Ltd of anysuch instrument issued, deemed to be issued or held in thename of POBCL under laws of the Commonwealth.
c) payment of Cash Securities
POBCL must do all things (including the execution anddelivery of instruments) necessary, incidental orancillary to effect the payment of the Cash Securitiesfrom POBCL to POB Pty Ltd.
d) POBCL - execution of project documents
POBCL and its Board must cause POBCL to execute anddeliver:
(i) the Port Leases, as required by the Sale and PurchaseAgreement;
(ii) any instrument that the Sale and Purchase Agreementrequires POBCL to execute and deliver; and
(iii) any instrument the Port Leases (or any sublease ofany Port Leases) requires to be executed or deliveredby POBCL for the purposes of the Sale and PurchaseAgreement.
e) POB Pty Ltd - execution of documents
POB Pty Ltd and its Board must cause POB Pty Ltd toexecute and deliver any instrument that the Sale andPurchase Agreement requires POBCL to procure to bedelivered after execution by POB Pty Ltd.
f) other instruments
POBCL and its Board must cause POBCL to execute anddeliver, and POB Pty Ltd and its Board must cause POB PtyLtd to execute and deliver any instrument provided tothem by or on behalf of the Under-Treasurer or the ProjectDirector in connection with the transactions contemplatedby this Transfer Notice.
g) provision of information
Prior to the Effective Date:
(i) at the request of POBCL or the State, POB Pty Ltdand its Board must, to the extent permitted byCommonwealth law, make available to POBCL orthe State information in POB Pty Ltd's possessionwhich relates to anything transferred to POB Pty Ltdunder this Transfer Notice or transferred to theState under this or any Prior Transfer Notices; and
(ii) POB Pty Ltd must provide to POBCL, and POB Pty Ltd'sBoard must procure that POB Pty Ltd provides toPOBCL, an electronic copy of any records heldelectronically by POB Pty Ltd.
h) further assurance
POBCL, POB Pty Ltd and their respective Boards must doand procure all such things (including the execution ofinstruments, including but without limiting the generalityof the foregoing documents required to record or registerthe transfer of any lease, licence, contract, statutorypermit or other instrument or thing) necessary, incidentalor ancillary, to give effect to this Transfer Notice.
4. Definitions
In this Transfer Notice:
Act means the Infrastructure Investment (Asset Restructuringand Disposal) Act 2009 .
Ampol Refineries Limited and Sunstate Cement LtdAgreement means the arrangements between POBCL,Ampol Refineries Limited (now named Caltex Refineries(Qld) Pty Ltd) and Sunstate Cement Ltd dated 8 July 1983.
arrangement includes a deed, contract, commitment,agreement or understanding.
Board means a board of directors.
Brisbane Container Terminals Agreement for Lease meansthe agreement for lease arrangements between POBCL andBrisbane Container Terminals Pty Ltd, Hutchison PortsAustralia Pty Ltd and Hutchison Port Holdings Limiteddated 2 August 2010.
Cash Securities means cash balances or similar forms ofcash equivalent securities (if any) held by POBCL as asecurity or bond in connection with the contracts listed inSchedule 1 of the Transfer Statement, including the cashdeposits described in Schedule 4 of the Transfer Statement.
Chalmers Industries Pty Ltd Agreement for Lease meansthe arrangements between POBCL and Chalmers IndustriesPty Ltd relating to the consolidation of leases.
Effective Date means the end of the day of 29 November 2010.
ERA 16 Permit means the Certificate of Registration for ERA16 relating to the navigational channels, Port of Bundaberg,Bundaberg QLD 4670 (reference number ENRE01386710).
Excluded Assets and Liabilities means Excluded Records.
Excluded Record means a Record of POBCL:
a) which is required by law to be kept and maintainedafter the Effective Date by POBCL (including, withoutlimitation, under the Corporations Act 2001 (Cth));
b) in respect of which POBCL will have, immediately afterthe Effective Date, a contractual obligation to keep ormaintain;
c) which relates to POBCL's Office of Transport Securityapproved security plan;
d) which is legal, accounting or financial management advicerelating to the Project; or
e) which relates to Excluded Assets or Liabilities,
and includes:
f) minutes of a meeting of the board (or any committee ofthe board) of POBCL;

g) board papers and board working papers and boardcommittee papers and working papers; and
h) correspondence with POBCL's shareholding ministers.
instrument includes any lease, licence, contract, statutorycontract, statutory licence or permit, security, guarantee,indemnity, contract of insurance, form, application or otherdocument.
lease includes a concurrent lease, sublease, any derivativeunder lease and a concurrent lease of any derivative underlease and lessor and lessee have corresponding meanings.
Legal Proceedings means any:
a) disputes or claims that have been or may be made ortaken by or against POBCL; or
b) other current, pending or threatened litigation, arbitrationor government proceedings relating to POBCL.
Neumann Petroleum Pty Ltd Agreement for Lease meansthe agreement for lease between POBCL and NeumannPetroleum Pty Ltd dated 22 April 2010.
Perpetual Leases means the perpetual leases held byPOBCL under the Land Act described in Schedule 5 to theTransfer Statement.
POB Pty Ltd means Port of Brisbane Pty Ltd ACN 143 384 749.
POBCL means Port of Brisbane Corporation LimitedACN 124 048 522.
Port of Brisbane Future Port Expansion Agreement (Jagera)means the agreement between the State of Queensland,Port of Brisbane Corporation Limited and Kenneth HenryBonner, Clarence William Bonner, Caroline Joyce Bonner-Bray, James Bonner and others on their own behalf and onbehalf of the Jagera People dated 22 December 2009.
Port of Brisbane Future Port Expansion Agreement(Quandamooka) means the agreement between the Stateof Queensland, Port of Brisbane Corporation Limited andIan Delaney on his own behalf and on behalf of theQuandamooka People dated 22 December 2009.
Port Leases has the meaning given in the Sale and PurchaseAgreement.
Prior Transfer Notices means the following transfer noticesunder the Act:
a) the transfer notice gazetted on 30 June 2010 with aneffective date of 1 July 2010 entitled "Port of BrisbaneCorporation Limited – Port of Brisbane Pty Ltd";
b) the transfer notices gazetted on 1 June 2010 entitled "Portof Brisbane Corporation Limited – Legacy Land assets","Port of Brisbane Corporation Limited – City Reach andGardens Point assets" and "Port of Brisbane CorporationLimited – Boat Harbours assets"; and
c) the transfer notices gazetted on 9 April 2010 entitled"Port of Brisbane Corporation Limited – NorthshoreHamilton" and "Port of Brisbane Corporation Limited –Northshore Hamilton Multiplex transaction".
Project means the disposal of all or part of POBCL'sbusinesses, assets and liabilities.
Project Director means the person from time to timenominated as such by the Under-Treasurer in relation tothe Project.
Record of POBCL means a record owned by, or in thepossession or under the control of, POBCL immediatelyprior to the Effective Date.
Restructure Transfer Notice means the transfer notice underthe Act gazetted on 30 June 2010 with an effective date of 1July 2010 entitled "Port of Brisbane Corporation Limited –Port of Brisbane Pty Ltd".
Sale and Purchase Agreement means an agreement betweenPOBCL, the State, QPH Port Acquisition Co Pty Limited andothers for the sale and purchase of the issued shares in POBPty Ltd dated 10 November 2010.
State means the State of Queensland.
sublessee includes a person who holds a lease.
Transfer Statement means the document entitled “Port ofBrisbane Corporation Limited –Completion – TransferStatement” which is signed by me for identificationpurposes and which shall be kept available for inspectionby persons to whom this Transfer Notice relates at theTreasury Department, Executive Building, 100 GeorgeStreet, Brisbane.
TIA means the Transport Infrastructure Act 1994 (Qld).

Short title
1. This notice may be cited as the Amending Balance Port Land Notice (No.1) 2010 .
Amendment of balance port land
2. The Balance Port Land Notice (No.1) 2010 published in the Gazette on 1 June 2010 at pages 313 - 314 is amended as set out insection 3.
3. In the notice-

1. Short title
This notice may be cited as the Port of Brisbane – Exempt Project Dealings Notice (No. 1) 2010 .
2. Definitions
In this notice:
Port Lease means any lease from the Port Lessor to the Port Lessee;
Port Lessor has the meaning given under the TIA;
Port Lessee has the meaning given under the TIA;
Port Sublease means any derivative under lease of a Port Lease:
TIA means the Transport Infrastructure Act 1994 (Qld).
3. Declaration of exempt project dealings
The following project dealings are declared to be exempt project dealings under section 15(1) of the Infrastructure Investment(Asset Restructuring and Disposal) Act 2009 :
(a) any Port Lease; and
(b) any Port Sublease.
