Terms of Sale Agreement

1. If any dispute arises between or among two or more bidders, sole authority to settle the dispute is reserved by the auctioneer, and his decision shall be final. The Auctioneer reserves the right to reject any and all bids. 2. All buyers are required to settle their account with Gateway Auction Services Ltd. in full at the end of the auction. Payments are to be in Canadian Funds. We will accept cash, valid cheque, interact, Visa, Mastercard or Discover Cards. Driver’s license or some

sort of positive identification will be required for cheques. N.S.F. or stopping payment of any kind will not be tolerated. 3. Every effort has been made to ensure correctness of the catalog, however, owners, auctioneers and agents will assume no responsibility for

errors or omissions and assume no liability as to any statements, either written or verbal, regarding any animal sold other than the information given was given “in good faith”. Any known correction will be made at sale time and will take precedence over the catalog. After the catalog is printed, any additional lots will be added to the online catalog available at www.gwacountry.com.

4. All sales are final. Under the ‘Public Auctions Act’ the buyer enters into a binding contract when the Auctioneer says ‘SOLD’. The buyer is finan-cially responsible for payment according to the ‘Terms of Sale’. Ownership of the animal(s) passes from seller to buyer when the financial matters are completed at the end of the sale. Liability becomes the responsibility of the buyer at this time.

5. All cattle are sold “AS IS”. There is no guarantee of any kind as to the soundness, condition or quality of any animal sold in this sale, except in the case where the owner makes a specific guarantee. In such a case the guarantee is strictly by the owner and not by the sales management. Buyers are encouraged to contact consignors directly for full details of animals.

6. All buyers are to inspect sale cattle prior to sale. 7. Cattle become the property of the buyer at the fall of the gavel, and the buyer assumes all risk and expense of the animal from this time hence. 8. All cattle are offered for sale according to the laws of the province of Alberta. Some animals may be subject to reserved bid. The auctioneer will

declare the animal either sold or passed at the end of the bidding. 9. Any arrangement for disposition of the cattle, other than immediate removal, must be made with the consignors. 10. Any person attending this auction does so at their own risk, and no liability, duty, obligation and/or responsibility shall be imposed upon the auction company, sale committee, consignors or any of their agents for any accident, injury, mishap, theft, damage and/or harm regardless of the source of the imposition. 11. The sales management, auctioneers and employees act as agents for the seller, but assume no liability for either buyer or seller.

Any representations made by the sales management are on behalf of the seller. 12. All buyers agree to be bound by the above terms of sale agreement.
