What advice do you have for someone considering lawschool? Don’t be intimidated by the stress and pressure; thesecome with the territory, and law school is there to help prepareyou. Instead, have fun! There are so many areas of law to exploreand you only end up practicing in a small fraction.

Favorite local hangouts: Woody’s on Trowbridge, Tasty Twist,City Limits East.

What is your happiest childhood memory? My entire extendedfamily stayed with my aunt and uncle in Maine for a week when Iwas about 10. The coastline there is rocky and my cousins and Ihad a lot of fun exploring the tide pools.

Why did you become a lawyer? I loved to read biographiesgrowing up and my favorites were those of Supreme Court jus-tices. I was inspired by the idea of being fair and impartial whenconfronted with differing perspectives.

What would surprise people about your job? There is a gener-al perception of lawyers talking fast and being manipulative withtheir language, but I think people would be surprised by howmuch listening my job entails.

What do you wish someone would invent? On a blistery Michi-gan winter day, I find myself dreaming of a way to transportmyself without going outside.

What has been your favorite year so far? Honestly, each yearseems to get better.

If you could trade places with someone for a day, who wouldthat be? The president of the United States—just to see whatit’s like.

What’s the most awe-inspiring place you’ve ever been? Forbeauty, nothing beats Up North Michigan. For my love of history,the Egyptian Giza Pyramids made me feel a part of somethingmuch bigger.

What is your proudest moment as a lawyer? As a new lawyer,I feel really great just being able to answer my clients’ questionsand then explain the answer so that they understand. Especiallywhen it took a lot for me to understand it myself.

What do you do to relax? I live close to some trails, so I walkmy dog there almost every day after work. I love to go bowling. Ilove spending time with my two amazing nieces, ages 4 and 18months. I sleep eight hours a night.

What is one thing you would like to learn to do? I quit piano les-sons in high school and I have always wanted to pick it back up.

What is something most people don’t know about you? I’mrenovating my 1950s home. It is slow progress, but I am havingfun and eventually it will be all the more cozy.

What is the best advice you ever received? If it feels good, doit. I take it as trust yourself and the person you are to make theright decision.

Irene Mo remembers whenher parents – immigrants fromCanton (Guangzhou), China,with limited English-speakingskills – struggled to find an attor-ney to help them purchase a Chi-nese restaurant. The experienceleft a big impression on Mo, thenin middle school and now a 2Lstudent at Michigan State Uni-versity College of Law.

“Unless you’re looking in BigLaw or immigration law, there’s alarge disparity of Asian-Ameri-can attorneys in the legal field,”notes Mo, the sole Asian-Ameri-can in her class at MSU Law’sGeoffrey Fieger Trial PracticeInstitute (TPI), where only 32students are selected each year.“It’s a rarity to see an Asian-American litigation attorney,especially in the Midwest, and Iwould like to see more Asian-Americans in that field.”

The criminalization of thepoor is “the civil rights issue ofour time and it’s exciting to see itmove to center stage,” said a keyU.S. Department of Justice offi-cial at a February 19 symposiumin Ann Arbor.

Vanita Gupta, head of theCivil Rights Division at theDepartment of Justice, was the

keynote speaker at a seminartitled, “Innocent Until ProvenPoor, Fighting the Criminaliza-tion of Poverty,” sponsored bythe Michigan Journal of Raceand Law. In her talk at the Uni-versity of Michigan Law School,Gupta said the criminal justicesystem in Ferguson, Mo. is pro-moting loss and distrust amongresidents of the St. Louis suburb.

As an example, Gupta point-ed to the case of a Ferguson

woman who owed $102 in park-ing fines. After missing requiredcourt appearances in the matter,the woman amassed additionalfines and penalties amounting to$1,500, coupled with jail time, alost job, and allegations of childneglect.

Gupta noted that other finesin Ferguson were even more trou-bling, including $302 for a single

Doctors and lawyers mightnot be considered partners inpractice, but students in a newelective at Michigan State Uni-versity recently learned how theycould become allies and learn tobetter communicate with theirpatients and clients.

“Law and Medicine: Mediationin the Clinical Setting,” a classoffered earlier this year, was ledby MSU Law Associate ProfessorBrian Pappas, along with Eliza-beth Petsche, an assistant profes-sor in the College of OsteopathicMedicine, who is also a lawyer.

“I’m into interprofessionaleducation, but usually that is with-in the health care side,” Petschesaid. “People tend to not considerthe positive relationships that canbe between doctors and lawyersand how much law can impactpatient care when it comes to get-ting resources and things of thatnature. There’s a lot of legal com-ponents to health care.”

Ten osteopathic medical stu-dents and seven law studentsworked in small, mixed groupsduring the four-session courseand focused on skills that areused in negotiation, as well ascommunication tools that canprevent lawsuits from happening.Students completed the course inthe law school’s moot courtroom,where they observed what couldhappen when communicationbreaks down.

“I was surprised with howreceptive the law students werewith receiving medical advice in

terms of explaining the risks ver-sus benefits of medical proceduresor the patho-physiology of certaindiseases,” said Peter Boateng, asecond-year osteopathic student.“I realized that as doctors, we willprovide the legal world with thepractical application of patient-centered medicine.”

Osteopathic medical studentAlfred Nesaraj appreciated learn-ing about how law students aretaught to approach their work andhow it differs from medical train-ing. “I enjoyed working with thelaw students and watching themwork during mediation,” Nesarajsaid. “Their thought pattern isvery different than the linearthinking we’re conditioned to aftertaking countless credit hours ofcore science classes. I think it wasa very valuable experience thathelped me appreciate how similarand different the skills required inour two fields are.”

Petsche watched as the med-ical and law students workedtogether and built joint under-standing of each other’sworlds.“They would engage indiscussions and genuinely listento the other profession’s perspec-tive,” she said. “It was refreshingto see the medical students havefun talking to the law studentsand have either of them stop dur-ing the class and ask, ‘I don’tknow what that means.’”

Boateng found very practicalbenefits from the course.“It wasworthwhile to practice negotia-tions with the law students,” hesaid. “Taking this electiveallowed me to learn alongsideand build connections withfuture lawyers. I believe that thecommunication techniques andideas related to mediation caneasily be translated to taking careof patients in the future.”

In the Feb. 18 article “StateSupreme Court Justices speak atMLaw,” the three justices pre-suppose that judges will beselected through popular elec-tion or appointment by the gov-ernor. There are, however, otherways. I have published threearticles on judicial selection; thelatest is “Judicial Selection InMichigan: A Fresh Approach,”58 Wayne L. Rev. 313 (2012).My proposals involve neithergubernatorial appointment norpopular election.

We must f irst acknowledgethe role of the judge is primarilyto decide individual cases on thebasis of what has already tran-spired. The judicial role is thusdifferent from that of the legisla-tor. Given that difference, themethod of selection of legisla-tors may not be an appropriateone for judges. Also, the judgemay have to enforce constitu-tional limits on legislative andexecutive action – an anti-majoritarian function.

What is the goal of judicialselection? My own view is thatjudicial selection should involvea search for judges of qualitywho are broadly representativeof the citizenry. Quality seemsan obvious goal, though, admit-tedly, it's not a self-def iningterm. Presumably, it shouldinclude basic intelligence, prop-er training, and open-minded-ness. Representativeness, ordiversity, should be a goal, byanalogy to the jury. I am notalone in believing the achieve-ment of diversity is an importantgoal. Justice Sotomayor, forexample, has spoken of the needto have a more diverse judiciary.

The problem with judicialelections is that they provide noassurance of either quality ordiversity. There are, of course,competent judges in Michigan,but, in my opinion, they havebecome judges despite the needto run for office, not because ofit. The need to raise money dis-courages some qualified personsfrom actively seeking judgeships,

and, in any event, the electorateis likely to know very little aboutthe candidates. Solicitation ofcontributions can often give theappearance of corruption.

Regarding gubernatorialappointment, the governor inMichigan is entirely uncon-strained in making appointmentsnecessitated by death or retire-ment, and is likely to appointlawyers who share the gover-nor's beliefs, attitudes, and val-ues; hence, appointment is not away to promote diversity. Thereis also no institutional guaranteeof quality.

The first of my four propos-als calls for the creation of anominating commission consist-ing of: “two lawyers, elected bythe State Bar Association; sixpersons elected by proportionalrepresentation, of whom onemust be a lawyer and five mustbe nonlawyers; two judges,elected by all judges of courts ofrecord in the state; one full-timemember of a faculty of a lawschool in the state accredited bythe American Bar Association,elected by all full-time membersof the law school faculties ofaccredited law schools in thestate; and one full-time memberof a nonlawyer faculty of anaccredited university within thestate, elected by all nonlawyerfull-time professors in accredit-ed universities in the state.”

Each member of the commis-sion would nominate one candi-date. Any one commissionercould veto the choice of anothercommissioner. Final selectionwould be by lot from among thenominees. Here again is theanalogy to the jury, which is notelected or appointed and whichis intended to broadly representthe community.

The commission is designedto be as diverse as possible –hence, the inclusion of membersof the public elected through pro-portional representation.

Selection by lot is not anentirely novel concept. Officialswith judicial duties were selected

by lot in Athens in the 5th and4th centuries B.C.E.

Regarding the giving of a vetopower to each member of thecommission, my assumption isthat each commissioner would, ineffect, say to each other commis-sioner, “I will refrain from veto-ing your choice of a well-quali-fied candidate if you will refrainfrom vetoing my choice of awell-qualified candidate.”

The presence of academics isnot entirely unprecedented. In atleast two states a law school fac-ulty member is a member of amerit selection nominating com-mission. (One of the problemswith current forms of meritselection is that the governor, thestate’s chief politician, makes thefinal choice among candidatesput forward by the nominatingcommission. The governor islikely to choose the one candi-date whose beliefs, attitudes, andvalues most closely resemblethose of the governor.)

My modest hope in offeringproposals for a different form ofjudicial selection is that discus-sions of judicial selection willnot be limited to the argumentsbetween those who support pop-ular election and those who sup-port some form of gubernatorialappointment. Realistically, Idon’t expect many to accept myideas, at least at present. Iremember once when I lived inTexas I had a conversation withsome lawyers about the Texassystem of partisan election ofjudges. They all agreed it was aterrible system, but they didn'twant to change it – perhapsanother instance of “the devilyou know.” Possibly that’s theway many Michigan lawyersfeel. Having spent 43 years awayfrom Michigan, however, andhaving practiced criminal lawprincipally in the military, inFlorida, and in Illinois, I'm lesscommitted to the status quo.

Mo has been an InnovationAssistant for MSU Law’s Legal-RnD – The Center for LegalServices Innovation – since lastMay, a work undertaking sheterms her most rewarding todate. With her passion for pro-viding eff icient, quality legalservices, this position has givenher numerous opportunities tomeet thought-leaders in thelegal innovation and technologyfield.

“For example, I’ve been ableto work under second-generationlean senseis to improve processesfor non-prof it legal organiza-tions,” she says.

LegalRnD also has earned herkudos. In June 2015, she and herteam won the challenge at Lex-Hacks in Chicago to create anemail application to detect per-sonally identifiable information.After every team submitted theirsolutions for different challenges,participants were given an oppor-tunity to privately present theirsolutions to each challengejudge.

“My team had developed ane-mail add-on to detect personal-ly identifiable information at thepoint of distribution and I believeit was our private presentation ofthat application that won us thechallenge,” says Mo, who after-wards wrote an article, “Execu-tion Plus: Selling Why YourSolution is The Solution.”

For the “Code the Deal LegalHackathon” last October in LosAngeles, Mo and her team builtan Android application to inform

tenants of potential legal issueswith their leases. The projectwon the HP Haven on DemandPrize, Real Estate Prize, andGrand Prize.

“This event was differentfrom LexHacks as our team hadcommitted to building a solu-tion for only one challenge andwent into the weekend withmore preparation,” she says. “Iwas able to apply the projectmanagement skills I had devel-oped during my second year atMSU Law by overseeing fourother law students and two pro-grammers in building theAndroid application.”

Since joining MSU Law, Mohas developed a passion forincreasing access to legal servic-es by applying lean processimprovement, project manage-ment, and technology and inno-vation – and has put these Legal-RnD principles in practice as co-chair of the “Help 150 FamiliesCampaign,” an AlternativeSpring Break program that pro-vides free tax preparation servic-es to low-income taxpayers inrural Michigan.

“By running our AlternativeSpring Break program efficient-ly, we’ll be able to help morelow-income taxpayers than inprevious years,” she says. “Pro-viding this free service is impor-tant because low-income taxpay-ers are often victims of identitytheft and fraud.”

Last February and March, theprogram assisted 120 taxpayers.Ten volunteers, supervised bytwo licensed tax attorneys, eachdonated more than 40 service

hours. Mo raised more than$1,000 over the course of 30 daysfor the program, but that onlycovered one third of the costs.This year, as co-chair, she has seta personal goal of raising $2,500through the end of March, moneythat will allow up to 10 MSULaw students to assist taxpayers.

“As the child of Chineseimmigrants, I’m forever thankfulfor the helping hands thatallowed me to be in my currentposition,” she says. “My parentshad to turn to me for almostevery interaction that requiredthem to use English. I’ll neverforget organizations, similar tothe Help 150 Families Campaign,which reached out to my familyand helped us become moreindependent.”

A member of Phi Alpha Delta,Mo serves as president of theMSU Law American ChineseAttorneys Club, vice president ofthe Intellectual Property LawSociety, treasurer of the AsianPacific Law Students Associationand treasurer of LegalLaunch-Pad, as well as American BarAssociation liaison to the MSULaw Student Bar Association.

She has been a Student Navi-gator for ZeekBeek since lastApril, helping State Bar ofMichigan members claim theirprof iles and grow their onlinepresence; providing feedback toZeekBeek regarding the expan-sion of directory features andproducts; and representing Zeek-Beek at State Bar events andtechnology showcases.

“Working for a start-up isexciting,” she says. “Student

Navigators are constantly askedabout their opinion on Zeek-Beek’s strategies for reaching outto law students and practition-ers.”

Last summer, Mo clerked atLegal Services of South CentralMichigan in Ann Arbor, whereshe gained practical client-facingand litigation skills; and at theMichigan Poverty Law Program,where the majority of her workwas spent on public policyresearch for clean and affordablewater legislation.

“It’s been interesting to watchsome of the policy issues Iresearched play out as the mediacoverage of the Flint Water Crisishas increased,” she says.

Mo started her academiccareer by graduating in the topfive percent of her class at Ply-mouth High School, then earningher two undergrad degrees ineconomics and mathematics,with distinction, from the Uni-versity of Michigan-Dearborn,where she tutored at the MathLearning Center. She also servedin student government as Inaugu-ral Chief Justice of the StudentJudiciary, Director of InternalRelations, Director of Researchand Development, Speaker of theSenate, Senator, and Fellow, andserved on several student govern-ment committees.

“I love learning so when itcame time to pick a major, I hadtrouble picking just one,” shesays. “I loved the challenge ofmathematics and the rigor thatwas needed to be successful.Economics was a strong comple-ment to mathematics because it

uses data analytics and statisticsto explain market behavior.”

An Introduction to Cryptogra-phy class piqued her interest ininformation privacy and securitylaw, a field in which she wouldlike to practice.

“I’m fascinated with the ideathat the most widely used cryp-tosystems are based on theassumption that there is no effi-cient algorithm to factorize verylarge prime numbers,” she says.

During her undergrad years,Mo worked as a legal clerk atBodman PLC in Detroit, whereshe drafted legal documents andclient correspondence and assist-ed in document retrieval andretention to support paralegalsand attorneys.

“I enjoyed the experience oflearning to work in a Big Lawenvironment,” she says. “Every-one I had the opportunity to dowork for always made it a pointto tell me, ‘Thank you. I appreci-ate it.’”

Mo, who served as FinanceDirector for Democrat DavidKnezek’s successful 2014 bid torepresent the 5th District in theMichigan State Senate, enjoysliving in East Lansing.

“With my previous experiencein politics, it’s exciting to live soclose to Michigan’s Capitolwhere laws and policies aremade,” she says.

In her limited leisure time sheenjoys doing CrossFit workouts.“I love the challenge of continu-ously improving to achieve per-fect technique in my Olympiclifts and increasing my personalrecords,” she says.

She said that many violationsrequired court appearances – 229of 376 municipal offenses are“must appears,” including dognuisance, failure to remove leafdebris, and equipment violations.The court dates are scheduled attimes that are difficult for peopleto appear because of work orchild care responsibilities, whichthen resulted in arrest warrantsand further fines.

A Depar tment of Justicereport last year showed that, asof December 2014, the BostonMunicipal Court System, for acity of 645,000 people, issuedsome 2,300 criminal warrants.The Ferguson Municipal Courtissued 9,000, for a population1/30th the size of Boston’s.Experts noted that a large partof the population of Fergusonhad an outstanding warrant fortheir arrest.

And with 6,500 municipalcourts nationwide, Gupta saidFerguson likely is not the onlyproblem area.

Although Gupta told the audi-ence that she “sees these prob-lems every day, I do believe we

are seeing a different opportuni-ty. We could be on the cusp ofmajor change, across differentpolitical perspectives, and oneshared sense that we need tocome together and fix what hasbeen a terrible wrong in our jus-tice system.

“We at the Justice Depart-ment feel we need a more effec-tive system, more fair, withmore prudent spending,” Guptasaid. “No mater how long anddeeply rooted, we can makeprogress.”

Gupta added that a sense ofurgency is necessary, but that “thelaws we are working to end havebeen built over 40 years withpoliticization over these issues.

“Change won’t happen overnight but we are at a tippingpoint and we can anticipatetremendous change,” she said.

Gupta outlined several criticalissues around the criminalizingof the poor during her presenta-tion. In addition to court f inesand fees that can devastate thepoor, she cited other legislativeefforts to punish the poor includ-ing criminalizing basic humanactivities such as sitting, sleepingor camping in public places, inessence criminalizing homeless-ness; inadequate court represen-tation for indigents; unfair pretri-al systems and bail practices; andunfair sentencing issues.

Citing her belief that criminal-izing homelessness violates the

Eighth Amendment, she said that,“Beyond the constitutional issues,criminalizing homelessness ispoor public policy. It does nothingto break the cycle of poverty.”

She noted the same concernfor bail practices that are oftenbased on wealth status and notthe protection of the community.

“This year is the 50thanniversary of the Bail ReformAct of 1966 which fundamental-ly changed federal bail practices.The act required an individual-ized assessment of the likelihoodof a defendant to reappear incourt as the only basis for bail sothat no one is needlesslydetained before trial,” she said.

“But some systems still linkjail time with the insufficiency ofmoney and accused can’t affordto pay for their release. Pre-trialdetention should be designed toprotect the community and notbe based on wealth status. It is afact that many in jail can’t affordtheir freedom. This causes a dev-astating impact on our most vul-nerable communities.”

Regarding representation,Gupta noted that “too many facebarriers to justice denying thepromise of Gideon v. Wainwright.

“In too many communities,there are insufficient funds forindigent representation,” Guptasaid. “Attorneys serve in nameonly due to high caseloads andlack of funding for defenseinvestigation and experts.”

She noted that all these prac-tices can cause people to losetheir homes, jobs, and familymembers, as they struggle tocope with inadequate funds andincarceration.

“There’s a common thread, alot of interconnectedness. Peoplewho are punished for the size oftheir wallets raise serious constitu-tional concerns. It does not pro-mote public safety and it under-mines our criminal justice systemand threatens the foundation of

our democracy. Too many see jus-tice as for the wealthy only.”

Gupta concluded that “manyeyes are looking at this problemand we can’t let the moment goby and miss our window ofopportunity. If we don’t reach forreform, we should be ashamed ofourselves. It has taken too manyyears to get to this point and wehave to work to make sure equaljustice and fundamental fairnessare accessible to everyone andnot just a few.”

years ago, I bought $25,000 ofthe Arizona Sports and TourismAuthority bonds maturing in2036. These bonds financedUniversity of Phoenix Stadium,where the Arizona Cardinalsplay their home football games.Now the Arizona court systemclaims that the bonds are notentitled to receive taxes fromrental car revenues. How willthis affect my bonds? Where doesthis stand now? Should I sell?

Dear HM: The 63,408-seatUniversity of Phoenix Stadiumopened in 2006 and only cost$485 million. And there musthave been a whole lot of porkdelivered with that amount. Theresult of this legislative influ-ence is that quite a few localpolit icians may have extra-cushy retirements soon.

According to my daughter,Hilary, an attorney (one of thegood ones) in Phoenix, theSuperior Court of Arizona inMaricopa County issued an"advisement ruling" in June2014. The ruling holds that carrental tax revenues relate to theoperation of automobiles onhighways and streets; therefore,those taxes can only be used forpublic highways or streets asset forth in the state constitu-tion. Makes sense to me! Thecourt's final judgment should beannounced soon. According toHilary, whether or not theadvisement ruling holds,appeals will be filed on numer-ous issues, so the ArizonaSports and Tourism Authoritywill be paying high-pricedlawyers in bespoke suits mil-lions of dollars all the way upto the Arizona Supreme Court.It could be years before a final

determination is made.Fitch Ratings downgraded

the bonds for the OrlandoMagic's Amway Center to junkstatus in 2010 because touristrevenues were insufficient, andthat voided the indenture of thebonds. The bonds crashed butwere rescued much later. Fitchwill tell you that if car rentaltax revenues are "estopped" bythe court, your bonds will alsobe given a junk status ratingand may temporarily fall inprice. It could be sooner thanlater because the managementauthority overseeing the stadi-um was $48 million short inmeeting i ts voter-approvedobligations. That's concerning!

Phoenix, Atlanta, Houston,Chicago, St. Petersburg, Miamiand other cities have issued sta-dium bonds that depend upontourist taxes to pay the interestand debt obligations. And thosebonds tend to be lower-ratedbecause of their reliance on see-sawing entertainment andtourist taxes for revenues. Theyalso are very sensitive to thehealth of their local economiesand can be volatile if the touristtrade begins to wane. Withouttourists, many of the amenitiesthat cities like to brag about(arts, public parks, conventionand entertainment centers,museums, etc.) would not beaffordable. So those amenitiescome with a price.

Municipali t ies that musthave tourist dollars to pay offtheir bonds are courtingtourists, aggressively and with-out shame. But in some locales,tourists are a niggling nuisanceto year-round residents. Somepeople are offended at theirintrusions on their normal dailyamenities. St. Petersburg, Flori-da, jingoistically courts tourists

as politicians seek campaignmoney. And those touristsdescend on the city's infrastruc-ture like locust plagues, smoth-ering local golf courses, restau-rants, shopping malls, movie the-aters, beaches, medical practi-tioners' offices and marinas.Then they clog the roads, sub-sume parking spaces and areresponsible for the seasonalspike in traffic accidents. Andthis angers UPS, FedEx and taxidrivers, one of whom told me ofvarious intersections on his routewhere making a left turn duringthe tourist season can take aslong as six minutes. Another ofthose fellows told me that on hisday off, he fantasizes aboutwalking St. Petersburg's mainstreets while holding a big plac-ard that says, "Tourists, stayhome." I suggested that he couldbe fired and arrested for disturb-ing the city's peace.

Phoenix is in MaricopaCounty, and the county's treas-urer, Charles "Hos" Hoskins,says there are millions in thecounty's many slush funds,emergency funds and specialfunds to keep the bond interestcurrent. Certainly, Phoenixwould not want the negativepublicity of a defaulting bond,and Hos would be quick as abunny with money to avoid anyhint of default. Those bonds aregood to hold.
