Since CHEO opened its doors in 1974, it has continuously evolved into its world-class status that it enjoys today. Dr. Dave Kenny was the first dental clinic director, opening the clinic’s doors in 1977, and the original team of clinicians included Dr.’s Ian Carpenter, John Cox, and Harry Biewald. Shortly thereafter, Dr.’s Steve Fremeth, Ian Milne, John Roberts, Joel Ublansky and Ernst Jacobsen joined the team. Many clinicians have followed over the years, too many to mention here. Future clinic directors included, amongst others, Dr. Arlie Dungy, Dr. Carol Janik, and currently Dr. Stephanie Lauziere.

The clinic has gradually introduced every paediatric dental service and specialty, including Oral and Maxillofacial Surgery (OMFS). Dr. Sam Kucey established the OMFS specialty at CHEO in 1977, and only recently retired from over 40 years of outstanding care. OMFS providers over the years have included Dr. Sam Kucey, Dr. Gerry Cimone, Dr. Gary Cousens, Dr. Rick Biewald, Dr. Kevin Butterfield, Dr. Taylor McGuire and most recently, Dr. Andrew Lee.

Over the years, the OMFS services which are provided to our patients has evolved. Currently, we provide the entire spectrum of paediatric OMFS services, including:

Dr. Butterfield and Dr. Lee provide clinic coverage, which includes the management of our cleft and craniofacial patients, while Trauma treatment is provided by Dr.’s Butterfield, McGuire, and Lee. Our OMFS team is simply a part of a much larger overall treatment team in the CHEO dental clinic, which includes the specialties of Paediatric Dentistry, Orthodontics, Prosthodontics, Periodontics, and Endodontics. We also work very closely with our medical specialties, including Anesthesiology, Plastic/Reconstructive Surgery, Otolaryngology, Rheumatology, and Respirology.

The clinic is a provider for the Ministry of Health-based Cleft Lip/Cleft Palate (CLCP) program, which provides financial support to our Craniofacial/Cleft paediatric patients to ease the financial burden often associated with the management of these clinically challeng-ing patients. Our CLCP coordinator at Argyle Associates is Ashley Pritchard, who does a fantastic job organizing and facilitating patient care.

Dr. McConnachie received his B.Sc and D.D.S. from the University of Toronto and his M.S. in Pediatric Dentistry from the University of Michigan in 1980. He is an Ottawa Pediatric Dentist recently retired from clinical practice after 43 years, including 34 years at the Children’s Hospital of Eastern Ontario. He conti-nues to also volunteer on committees with the Ontario Dental Association, the Royal College of Dental Surgeons of Ontario and the Canadian Academy of Pediatric Dentistry. He has been very involved in orga-nized dentistry throughout his career, including as Past-President of the Ontario Dental Association.

Dr. McConnachie has published extensively in the dental literature and is a nationally recognized speaker on issues in pediatric dentistry. Through his association work, clinical care and lecturing, he has focused energies on improving access to care for less advantaged populations and advancing the acceptance and benefit of risk-based care in dentistry. He has also volunteered internationally with 8 trips providing care in Central America and Haiti.

Dr. McConnachie is an honorary fellow in the Pierre Fauchard Academy, the Academy of Dentistry Interna-tional and the International College of Dentists.

Robert Carmichael was born in Powell River on Canada’s West Coast. He completed his dental training at the University of British Columbia in 1981. Following a 3-year residency in the department of masticatory disorders and removable prosthodontics at the University of Zurich, he attended the University of Toronto where he completed a diploma in prosthodontics. While a fellow of the Medical Research Council of Canada at the University of Toronto, he received his masters of science in oral biology. Presently he serves as chief of dentistry and director of the Ontario Cleft Lip & Palate/Craniofacial Dental Program at Holland Bloorview Kids Rehabilitation Hospital in Toronto. He is also chairman of the International Team for Implantology (ITI) Scholarship Center at Holland Bloorview, coordinator of prosthodontics at Toronto’s Hospital for Sick Children and assistant professor at the University of Toronto. In 2015 Robert was a recipient of the Ontario Dental Association Service Award.

Dr. Jurencak completed his medical degree and postgraduate training at Masaryk University in the Czech Republic. Thereafter, he pursued Pediatric Rheumatology at the Hospital for Sick Children at the University of Toronto. He joined the Division of Pediatric Rheumatology at CHEO as full time rheumatologist 2008.

Dr. Jurencak’s research has focused on the prognosis of children with chronic arthritis. He has published papers describing disease course, characteristics of flares and the emotional impact of having a child with arthritis on parents. He is also part of a team developing clinical tools to predict the course of arthritis in children.

Dr Jurencak is also very active in the field of medical education. He completed the Healthcare Education Scholars Program at the Academy for Innovation in Medical Education and is a member of the Distin-guished Teacher Program at University of Ottawa.

Ignoring Duty to Accommodate Employees

Can Prove to Be Very Costly toDental Professionals

In previous articles, we have discussed the circumstances in which a dentist can terminate an employee. For the most part, an employer can terminate any employee at any time and for any reason provided that the employer gives the employee appropriate notice or pay in lieu of notice as per the employment agreement, and if there is no employment agreement, then according to the common law (which generally speaking, requires notice or termination pay of 2 to 4 weeks per year of service depending on such factors as age, level of responsibility, ability of the employee to find other comparable employ-ment, etc.) The employment agreement will not be enforceable if it breaches any of the terms and conditions of the Employment Standards Act which, among other things, establishes mini-mum termination pay of one week per year of service up to a maximum of 8 weeks.

HUMAN RIGHTS CLAIMS

There is a very important exception to the above rule. An employer cannot terminate an employee, regardless of the amount of termination pay offered, if the termination is due to factors that amount to discrimination under the Ontario Human Rights Code. The Code requires an employer to accommodate the needs of employ-ees that are protected by the Code, short of undue hardship.

The nature of the accommodation required will vary according to the employee’s unique needs. Some examples of accommodation could include:

An employer’s duty to accommodate is not unli-mited. The dental professional is not required to accommodate an employee’s needs beyond the point at which the accommodation would cause “undue hardship” to the practice.

The onus is on the employer to prove undue hard-ship. Generally speaking, one of two factors will establish undue hardship:

Flexibility in work hours or break times

Job restructuring or break times

Allowing an employee to not work on certain religious holidays or during certain times of the week

Retraining

Acquiring or modifying equipment

Tolerating absences

It should be noted that a dental professional cannot claim “undue hardship” just because making changes to the office or acquiring new equipment would be very expensive. Indeed, it is expected that accommodation may require some amount of financial hardship. The employer would have to prove that the cost was so high that it would actually impair the ability of the dental professional in running the practice. In short, proving “undue hardship” can be very diffi-cult and onerous.

Factors such as inconvenience, resentment or hostility from other co-workers are not relevant in the accommodation process. For instance, if a dental assistant asks to leave work every Fridaysdf

afternoon because of her religious beliefs or an employee with a certain illness needs a 15 minute break every two hours, the employer cannot fire the employee because other staff members com-plain that they have to take on extra work as a result.

FINANCIAL CONSEQUENCES OF IGNORING THE DUTY TO ACCOMMODATE

In the absence of any human rights claim, when an employee is terminated, generally speaking, the sole issue to be decided is the appropriate amount of notice or termination pay. Courts or tribunals may order employers to pay additional termination pay if the amount offered was inadequate. The situation is very different for human rights claims. If a human rights tribunal finds that the employer breached its duty to accommodate, it will often award:

In one recent Ontario case, a school board supervisor was awarded $420,000 in lost wages plus interest, $339,000 in legal fees and $30,000 for loss of dignity and reinstatement after it took 9 years for the tribunal to conclude that the school board had failed to accommodate her disability of anxiety and depression.

Needless to say, dental professionals are strongly encouraged to seek legal assistance before terminating any employee who might potentially claim human rights discrimination.

The cost to the employer is extreme and there are no outside sources of funding available to mitigate the costs.

The employee’s wages from the time she was terminated until the date the decision has been made (note it can take a tribunal two plus years to hear a case and provide a decision);

Require that the employee be reinstated;

Legal fees; AND

Mandate the employer to incur the costs necessary to accommodate the reinstated employee appropriately.

If an employee can no longer perform his or her job in the same way because of one or more of the factors outlined in the Code, the employer cannot fire them without first providing reason-able opportunities for rehabilitation or alterna-tive work.

Pregnancy

Religious Beliefs

Caregiving responsibilities (family status)
