10.1 Charter SELPA Staff for 2016-17
A list of the current Charter SELPA staff members, along with their contact information, is presented as Attachment 10.1.
10.2 Minutes of Executive Committee Meeting Held September 15, 2016 The Minutes of the September 15, 2016 Executive Committee Meeting are presented as Attachment 10.2.
10.3 Review of Executive Committee Membership/Meeting Dates A review of the current membership of the committee will take place. The Executive Committee meets at least four times per year and attempts to have broad representation from CEO Council to include charter representatives from large, small, geographically diverse, etc. members. The Executive Committee provides input to the Charter SELPA leadership team as recommendations are developed for the CEO Council.

10.4 Charter SELPA Partners Recognition
In 2013, the Charter SELPA formally recognized our founding partners, identified as being with us in the first three years of operation. Starting in 2014, we have annually recognized those members who have achieved five years of membership. Our 2016 recognition is for those members who have achieved five years, and not been previously recognized (2013, 2014, 2015).

10.5 2016-17 Fiscal Update

10.7 Professional Learning Update
The Charter SELPA Professional Learning Catalog is now available exclusively on the Charter SELPA website to ensure the information and registration links are current at all times. The Professional Learning Catalog can be accessed at http://www.edcoecharterselpa.org/what-we-do/professional-learning.
10.8 Leadership Academy
The Leadership Academy, a unique professional development program for charter school special education leaders and aspiring leaders, will be held in July, 2017 in Southern California, exact location to be determined. Registration information will be available in April, 2017.
10.9 Special Education Symposium The Special Education Symposium will take place Thursday, February 16, 2017 at the Doubletree by Hilton San Diego Mission Valley Hotel. Registration information will be available in late fall.
11. Low Incidence (LI) Funding
CEO Council took action in May 2016 to address a 2015-16 shortfall in Low Incidence funding and an update of final 2015-16 expenditures is provided as an information item in Attachment 11.
CEO Council approved (May 2016) Allocation Plan language for 2016-17 to ensure predictability of funding. Based on the Allocation Plan guidelines, SELPA Administration set the 2016-17 minimum per student reimbursement level at the state LI per pupil funding rate of $433. Based on claims submitted, a finding will be made in May 2017 to determine if funding could be set at a higher level of reimbursement. This information has been communicated to the field. This is an information item, no action requested.
INDIVIDUAL ITEMS REQUIRING CEO COUNCIL ACTION
12. Educationally Related Mental Health Services (ERMHS) Budget The 2016-17 ERMHS budget of $11.4 M. is presented for CEO Council approval with details provided in Attachment 12.
SELPA leadership (with review/input by CEO Executive Committee) made the following finding of sufficiency of funding for 2016-17:
The maximum per service rate is established at $3,300. $100K will be available for Level 2 transportation reimbursement – outside of
the Level 2 service cap/ADA formula. The intent is to provide 80% funding for

eligible costs. If $100K is not sufficient, funding will be pro-rated based on claims submitted at year end.
Indirect costs will be allowed for Level 2.
Before May 2017, SELPA Leadership will make a finding as to the ability to fund beyond the 80% and 90% parameters established in the Allocation Plan. The significant variables impacting this finding are the January 2017 Level 2 budget requests submitted and the Level 3 NPS budget requests submitted throughout the year.
Recommendation
CEO Council action is requested to approve the 2016-17 ERMHS budget of $11.4 (as shown in Attachment 12), with the primary elements being a Level 2 allocation of $8.1 M and Level 3 allocation of $3 M.

The meeting was called to order at 10:00 a.m. at the Doubletree Hotel San Diego Mission Valley – Ballroom at 7450 Hazard Center Drive in San Diego, CA by David Toston, Associate Superintendent, El Dorado County Office of Education/SELPA Programs.
2. Approval of Agenda
David asked for a motion, which was made by member Caprice Young, seconded by member Patti Wilzcek, to approve the agenda as presented. There was no discussion and the motion carried unanimously.
3. Public Hearing (for items not on the Agenda - comments limited to two minutes)
The Public Hearing was opened at 10:10 a.m. and, with no public comment, closed at 10:11 a.m. 4. Welcome/Introductions
David Toston welcomed everyone to the meeting, and CEO Council members and guests present introduced themselves. Lisa Donaldson was recognized and presented with a plaque thanking her for her years of support to the Charter SELPA. Lisa has taken another position within EDCOE supporting the local school districts in El Dorado County.
6. Update from CEO Executive Committee Retreat David Toston reported on the Executive Committee Retreat, which took place the prior evening.
David recognized and acknowledged members of the Charter SELPA Executive Committee and thanked members for their assistance with the important advisory work of the committee. The preliminary results of the annual survey were discussed and it was decided to keep the survey open and available for a short time longer so we can gather additional responses.

7. Dialogue with Trish Boyd Williams – Member, State Board of Education
Trish Boyd Williams, a member of the State Board of Education, was unable to attend the meeting. Gina Plate, chair of the California Commission of Special Education and a Senior Policy Advisor with CCSA, spoke later in the agenda of the current atmosphere and challenges for charter schools in California. She spoke with Vicki Barber in a Q & A format regarding the special education services provided by charter schools in California.

A list of the new members joining and members exiting the El Dorado County Charter SELPA for 2016-17 was presented as Attachment 9.4.2. David shared that this list is subject to change – some of our partners are in the process of expanding for 2016/17. SBE schools as well may join for 2016-17. David thanked those who participated in the application process. He also asked that if any partner anticipates school closures, please notify the Charter SELPA as soon as possible.
9.5 Charter SELPA Financial Update 9.5.1 Fiscal Update Summary An Executive Summary – Financial Update was included as Attachment 9.5.1.
The detailed financial update has been mailed to charter fiscal contacts and will be posted on the Charter SELPA website.
9.6 Charter SELPA Oversight Benchmarks
9.6.1 Report on Pupil Count as % of ADA The Charter SELPA presented the annual (at the May CEO Council meeting) report of special education pupils served as a percentage of the K-12 total population. Attachment 9.6.1, entitled “Percent of Pupils Served Report for

2015-16” shows the December 2015 Special Education Pupil Count compared to 2015-16 enrollment (October CBEDS count).
Charter SELPA views this data as one measurement tool of program
accountability and will review those charters that vary significantly from the Charter SELPA average.
9.7 SELPA Report
David shared a “State of the Union” report on the Charter SELPA, which included:
He introduced the SELPA teammates transitioning out – and reported that we will have additional program specialists placed regionally, both in Southern California and the Bay Area, to provide support.
CARSNet – Organization helping to improve authorizer practices throughout the
state. David is one of the regional leads and reports our presence affects the conversations. The Charter SELPA has also participated in statewide leadership opportunities throughout the year.
David then introduced Gina Plate who, along with Dr. Vicki Barber, held a conversation on where they see charter schools today, their challenges and the importance of their voice in education throughout California. They highlighted the need for charters to showcase the difference they make in children’s lives and also develop a better advocacy plan. The meeting then broke for lunch and returned to watch a video featuring Oakland School of the Arts and the successful return of one of their students from a non-public school placement.
INDIVIDUAL ITEMS REQUIRING CEO COUNCIL ACTION
10. Charter SELPA ERMHS (Educationally Related Mental Health Services) Funding The goal of our Allocation Plan language is to ensure a predictable funding stream, with no surprises. To that end, we have revised the ERMHS Allocation Plan language the past two years to ensure no shortfall in funding. There is sufficient 2015-16 ERMHS (Educationally Related Mental Health Services) funding to increase funding to 100% (no charter match (10% to 20%) is required).
CEO Executive Committee has provided input on the recommendations. Attachment 10 provided additional detail.
Recommendation: CEO Council action was requested on Allocation Plan language as detailed on Attachment 10 and summarized below:
1. Language to allow funding for eligible expenditures exceeding budget requests (20%
above the request and below eligibility). 2. Language to allow a finding in September of each year to increase the funding service
level formula (increase beyond the current maximum of $3,000).
David reviewed the attachment and asked for a motion to approve the recommendation to add ERMHS Allocation Plan language as detailed in Attachment 10. Said motion was made by member Nicole Assisi and seconded by member Jim D’Agostino. No discussion. All approved and the motion passed unanimously.

11. Charter SELPA Budget Update and Rate Smoothing Pool Allocation Plan language requires CEO Council to review 2015-16 rates, set 2016-17 rates, and
receive a report on the status of the rate-smoothing pool that is implemented in 2015-16. State level deficits in special education have made funding projects difficult to predict. The rate smoothing pool concept was established in 2014-15, with 2015-16 being the first year of implementation.
CEO Executive Committee has provided input on the recommendations. Attachment 11
provided additional detail. Recommendation: CEO Council action was requested to set rates as follows:
2014-15 deficit restoration of $1.17 M be placed in the rate-smoothing pool. 2015-16 $505 state rate projection will be maintained, using funds from the “rate- smoothing” pool as needed. 2016-17 $505 state rate projection established. This assume ongoing deficit of 2.3%, and hopefully no augmentation needed from the “rate-smoothing” pool. If the June 2015-16 deficit certification is higher than projected, the 2016-17 rate maybe revised to $501. The balance in the rate smoothing pool at the close of 2015-16 is estimated to be approximately $930K. CEO Council will review the balance in May of 2017, after assessing 2015-16 final deficit and 2016-17 deficits. At that time, we anticipate a comfort level in developing recommendations for use of these one-time funds. David reviewed the attachment and then asked for a motion to approve the recommendation to set rates as outlined above and in Attachment 11. Said motion was made by member Caprise Young and seconded by member Phil Beaumont. No discussion. All approved and the motion passed unanimously.
12. Charter SELPA Set-Aside Risk Pool The set-aside Allocation Plan language, established over 10 years ago, no longer meets the needs of the SELPA. The pool is larger than needed and lacking in flexibility to meet the needs of the organization. The member owned set-aside, declining over time from 5% ($25 per ADA) to 1% ($6 per ADA), is proposed to be revised to be a $5 per ADA one-time contribution in the first year of entry, and $2.50 per ADA for members prior to 2016-17, and a shared set-aside risk pool. CEO Executive Committee had provided input on the recommendations. Attachment 12 provided additional detail.
Recommendation: CEO Council action was requested on the Allocation Plan language change to the set-aside with key elements listed below and detailed Allocation Plan revisions set forth in Attachment 12.
1. Establish a shared risk pool of approximately $500K.
Eliminate current model which provides for a declining contribution that is vested in the
charter with no shared risk.
One-time contribution from the legal risk pool of $200K.
2. 2015-16 Members Returning members in 2016-17 will pay $2.50 per 2015-16 P2 ADA up to a maximum of
$25K.

All new charters (starting in 2016-17) pay a one-time non-refundable contribution of $5 per ADA upon the first year of entry into the Charter SELPA.
A new charter is defined as a new charter/partner (single or organization) and expansion
charters of existing partners.
David reviewed the attachment and asked for a motion to approve the recommendation to change the set-aside with the key elements listed above and detailed Allocation Plan revisions as set forth in Attachment 12. Said motion was made by member Caprise Young and seconded by member Phil Beaumont. No discussion. All approved and the motion passed unanimously.
13. Charter SELPA Legal Risk Pool
The Charter SELPA legal risk pool budget update was provided. The primary source of funding for the legal risk pool is modified funding from charters who were not able to spend all of their allocation.
CEO Executive Committee had provided input on the recommendations. Attachment 13 provided additional detail. Recommendation: CEO Council action is requested to:
Continue the legal due process reimbursement under the current parameters (50% of legal costs associated with a due process filing, up to $10,000) and allocate $100K budget for 2016-17.
Approve a transfer of $200K from the legal risk pool to the newly created set-aside risk
pool. Transfer to be done in 2016-17. David reviewed the attachment and then asked for a motion to approve the recommendation to continue the legal due process reimbursement as outlined above and in Attachment 13. Said motion was made by member Lynne Alipio and seconded by member J.J. Lewis. No discussion. All approved and the motion passed unanimously.
14. Charter SELPA Low Incidence Funding Legislation in 2013-14 expanded the use of Charter SELPA low incidence funding to include services as well as materials. Charter SELPA timelines are in place to help ensure a predictable level of funding, with a requirement that all budget requests for low incidence services and materials be submitted by May 1. There was a significant increase from the previous year in the number of claims submitted on May 1, 2016, and the good news is that charters in the SELPA are providing services to students. Unfortunately, the funding stream is not keeping pace with the expenditure requests and a modification is necessary in order to meet current funding commitments. CEO Executive Committee has provided input on this issue. A final recommendation and course of action was proposed in Attachment 14. Recommendation: CEO Council action was requested to revise low incidence funding parameters to avoid shortfalls (detail provided in Attachment 14): 2015-16 Potential Shortfall
Charter SELPA will honor the maximum reimbursement of $3,000 per student in 2015-16. Utilize $31 K grant received from CDE in April 2016. If further funds are needed, a recommendation will come to the September meeting for
CEO Council approval.

15. Charter SELPA Policy Revisions 15.1 Charter SELPA Policy 28/AR 28 - Maintenance of Effort Policy
The revision of CEO Policy 28/Administrative Regulation 28 on Federal Maintenance of Effort Requirement is now presented to CEO Council for approval. The current Charter SELPA federal maintenance of effort policy is being updated with new federal interpretations released to the field in 2015. California previously interpreted MOE such that an LEA could pass any of four tests in any given year:
1. The combination of state and local funds 2. Local funds only 3. The combination of state and local funds on a per capita basis 4. Local funds only on per capita basis
At the close of 2014-15 fiscal year, CDE advised SELPAs based on federal
guidance that you must compare to the previous time you passed that specific test. Our business team has communicated this information to the field. This policy revision brings us in alignment with current practice.
CEO Executive Committee had provided input on the recommendations. A copy of the
proposed revised CEO Policy 28/AR 28 is included as Attachment 15.1.
Recommendation: CEO Council action was requested to revise CEO Policy 28 and AR 28, as set forth in Attachment 15.1.

15.2 Charter SELPA CEO Policy 22/AR 9 - Membership Process Revisions The Charter SELPA is in conversation with CDE to streamline the process for admitting
new LEA members into the Charter SELPA. Current policies need to be revised to achieve this goal.
CEO Executive Committee had provided input on the recommendations. The
proposed revisions to CEO Policy 22 and Administrative Regulation 9 were included in Attachment 15.2. Recommendation: CEO Council action is requested to revise CEO Policy 22 and
Administrative Regulation 9 to reduce the timeline to revise the Local Plan due to membership changes. Details are included in Attachment 15.2, along with the proposed additions to CEO Policy 22 and AR9.

16. Areas of Focus in 2016-17
David shared that our areas of focus will include more strategic communication; highlighting best practices and connecting the great things you’re doing and having a voice in the SELPA. We will also be highlighting the ten year celebration of the Charter SELPA. We will be hosting a hospitality night social event at the CCSA Conference in Sacramento in early 2017.

1. Educationally Related Mental Health Services (ERMHS) Budget Update
CEO Executive Committee was updated on the 2016-17 ERMHS budget to assure a
transparent and predictable level of funding for Charter SELPA Partners. The September
update included:
a. Sufficient funding in 2016-17 - Information Item
Charter SELPA leadership made findings of sufficiency of ERMHS funding by September
15, 2016 for the 2016-17 year. Attachment 1, entitled “ERMHS Funding” provided
additional information regarding the following:
The maximum per service rate is established at $3,300. $100K will be available for Level 2 transportation reimbursement – outside of the
Level 2 service cap/ADA formula. The intent is to provide 80% funding for eligible

costs. If $100K is not sufficient, funding will be pro-rated based on claims submitted at year end.
Indirect costs will be allowed for Level 2.
Before May 2017, SELPA Leadership will make a finding as to the ability to fund beyond the 80% and 90% parameters established in the Allocation Plan. The significant variables impacting this finding are the January 2017 Level 2 budget requests submitted and the Level 3 NPS budget requests submitted throughout the year.
David reviewed the attachment detail and shared that we try to keep the fund balance at 10 – 15% - it is now over 30%. Our Level 3 placement costs came in lower than anticipated due to fewer placements and/or lower cost placements. Given the variables, we determined there is enough money to raise the per service amount from $3,000 to $3,300. Consensus was reached by the Executive Committee members – all supported these findings. Questions were asked on variability of individual charter’s access to ERMHS – the cap of $250 per ADA in the formula has significantly changed the variability factor. We feel we have sufficient protections in place. A question was asked if the state would ask for the money back – recapture of unspent funds – use it or lose it – at this time, no. The Allocation Plan does have a reasonable reserve level in place. Vicki added that this is one of the reasons we maintain strong connections with State SELPA, State Leadership (CDE, State Board, other), Legislature (through the support of Capitol Advisors and other connections). A discussion was held on AB 884 currently on the Governor’s desk – one of the components of the legislation is a one-time audit of MH funds – one component looks at outcomes. Audit would be limited to data that CDE already collects – burden would be on CDE to collect data and see outcomes. May be difficult to determine outcome from only mental health services – keep in mind they receive other services – OT, SAI, etc. Must pass the reasonableness test.
2. Low Incidence Funding
CEO Council approved (May 2016) the use of one-time federal funds to be allocated to the
Low Incidence pool. At that time, we identified a possible need to return to CEO Council in
September, for additional funding to honor the 2015-16 $3,000 maximum. There is no need
to allocate additional dollars, as was originally anticipated. Attachment 2, entitled “Low
Incidence Funding” provided additional information. No action is required at this time.
Last year, based on the requests received, we determined we would have a shortfall. We are
honoring for 15-16 – we had a higher reimbursement rate in place. We are still awaiting final
expenditure reporting around 18K that will allow us to get to our final number. We urge schools
to submit requests as soon as possible. We have lowered the per person reimbursement rate for
2016-17 and plan to monitor this throughout the year. We want a consistent level for all
requests.

3. SELPA Leadership Report
Membership Report Each year we let Executive Committee know of membership issues affecting member
charters. David shared the following: o Authorizer provided a notice of revocation and attempted to revoke the charter’s
petition. Charter school is fighting this. o Independent study charter and ADA issue.
The Charter SELPA continues to grow – we now have 138 Partners operating 295 schools. 67% of all applications were approved last year for membership for 2016/17. We will ask Executive Committee members to help review the paperwork with the
potential partners for 2017/18. We’ve added the ability for a charter to upload a video file to add additional warmth and color to their application. We will be announcing the timelines later in the fall. We will emphasize at CEO Council the importance of adhering to timelines.
4. Next Meeting Date
The next regularly scheduled meeting of the Charter SELPA Executive Committee will take place Thursday, November 10th, 2016 at 10:00 a.m. via Adobe Connect teleconferencing. Meeting adjourned at 10:40 a.m.

2016-17 Charter SELPA Executive Committee Meetings
DescriptionThe Executive Committee serves as an informal advisory body to the Charter SELPA Administrative Unit. Executive Committee members review policies and procedures to make recommendations to the CEO Council for action items on the September and May meetings. An invitation to participate in the Exec-utive Committee is issued annually at the first CEO Council meeting for the current fiscal year to all of SELPA’s partners. Summaries of the Executive Committee meetings shall be transmitted to the full mem-bership of the Charter SELPA CEO Council.
ParticipantsThe Executive Committee shall be comprised of all Charter SELPA CEO Council members who have an interest in participating as a committee member. Committee participation shall be at the discretion of individual members who shall be free to attend, or not attend, meetings as they choose.
General InformationMeetings will be held via the “Adobe Connect” videoconferencing platform. You can view, hear and participate using your computer with audio capability and an internet connection. Log-in information to participate, along with meeting agenda and supporting documents, will be made available one week prior to the meeting.

2015-16 CLOSING DATA
The certified 2015-16 P-2 ADA for the Charter SELPA was 120,543. The final income distributions have been
updated with P-2 ADA and are available on the Charter SELPA website. The final state rate was $505.00 per ADA
(before administrative fee and set aside). This rate is after a 2.7% deficit applied by the state. The final federal
rate was $125.30 per prior year enrollment (before administrative fee and set aside). Additional state funding of
$9.29 per ADA was distributed to those partners that were in the SELPA in 2013-14 and were eligible to receive
additional funds. Our appreciation goes out to all for timely submission of data!
MAINTENANCE OF EFFORT (MOE)/UNSPENT FUNDS UPDATE
MOE measures the expenditure of state and local funds from year to year by LEAs and by SELPA. In order for an
LEA to continue to receive federal IDEA funds, each LEA and in turn the SELPA must increase the level of
state/local expenditures from year to year (with some exceptions). We are in the process of reviewing the year
end data to compile the required MOE reports and analyze overall SpEd expenditures. A report on MOE
compliance and unspent funds will be brought to the Executive Committee in November.
CASH FLOW UPDATE 2016-17
The individual charter cash flow amounts have been updated based on 2015-16 P-2 ADA. The schedule is posted
to the Charter SELPA website. Charters new to the Charter SELPA have been notified of the optional Cash
Advance Program. This program allows charters that were not a part of the Charter SELPA in 2015-16 to advance
approximately 25% of estimated revenues at a 3% interest rate, since the charter won’t be receiving cash
distributions until February 2017, when CDE begins to include them in the apportionment.
SET-ASIDE RISK POOL UPDATE CEO Council (May 2016) approved the following changes to the set-aside formula in 2016-17:
Conversion from a member owned/vested contribution to a “risk-pool” with one time non-refundable contributions by all Charter SELPA members in 2016-17
A one-time $200,000 transfer from the Legal Risk Pool
Charters new to the SELPA in 2016-17 will contribute $5 per 2016-17 P-2 ADA (one-time non-refundable contribution).
2015-16 Charters returning in 2016-17 will have interest earnings applied to their Set-Aside balance and will be sent an amount net of a one-time non-refundable contribution of $2.50 per 2015-16 P-2 ADA. These funds will be sent in October 2016. A summary of these transactions appears below.

2016-17 BUDGET
The Governor’s enacted 2016-17 budget includes a 0% COLA. The estimated deficit for 2016-17 is 2.7% (2015-16
June certified deficit). The following rates are prior to the admin fee and set-aside contribution for new charters:
Estimated federal rate = $125 per prior year enrolled (CBEDS).
Preliminary estimated state rate assuming 2.7% deficit = $503 per P2 ADA.
In March 2017, SELPA Leadership will review the preliminary 2016-17 deficit projection by CDE and the balance in
the Rate Smoothing Pool in order to determine if the $503 rate could be increased to $505.
EDUCATIONALLY RELATED MENTAL HEALTH SERVICES (ERMHS)
Final expenditures filed for 2015-16 resulted in Level 2 and Level 3 costs lower than estimates, which resulted in
the following:
Level 2 requests (197) funded at 100% for a total of $5.4M (up from original 80%).
Level 2 transportation requests funded at 100%.
Level 3 funding (NPS residential, NPS ERMHS, site based structured therapeutic) funded at 100% for a
total of $1.4 M.
ERMHS reserves at the close of 2015-16 = $2.7 M. (32%).
CEO Council (May 2016) approved modifications to the ERMHS Allocation Plan for 2016-17. Most significant is the
ability for SELPA administration to set a Level 2 service level formula rate higher than $3,000. September 2016
rate set at $3,300.
LEGAL RISK POOL
Funds previously allocated to the Legal Risk Pool remain sufficient for 2016-17 to cover attorney costs associated
with a due process filing up to $10,000 on a 50% reimbursement basis.
Claims in 2015-16 totaled $44,121.
$100,000 budgeted for 2016-17 claims
An updated budget will be provided to CEO Executive Committee in November and will include a report
of unspent funds that will be allocated to the Legal Risk Pool.

LOW INCIDENCE
The SELPA receives Low Incidence funding for materials and services related to students with hearing or vision
impairments or who are orthopedically impaired. CEO Council approved recent amendments to the Allocation
Plan to include criterion of a $600 minimum expenditure before reimbursement may be requested and a
minimum $433 reimbursement (equal to state per-pupil Low Incidence funding) will be made. Based on a year-
end determination of sufficiency, the reimbursement rate may be increased to a maximum of $3,000. We
recommend partners budget for the $433 minimum per student reimbursement in 2016-17. Request forms are
available here. A final determination of maximum funding will be made in May 2016 based on reimbursement
requests received to date.
AUTOMATIC CHECK DEPOSIT (AUTOMATED CLEARING HOUSE ACH)
ACH payments not only enable receipt of payments in a more timely fashion, but are much more secure, as well.
Currently, 78 charters are participating in the electronic funds transfer program. Charters are strongly
encouraged to convert from paper checks to this system. The ACH authorization form can be found here: ACH
Form.
FALL PROGRAM/BUSINESS ROUNDTABLES
Our leadership team will be available for roundtable meetings around the state in October & November. Charters
may register for one of two 2-hour sessions at the most convenient location. The Charter SELPA team will be
ready to provide individualized fiscal and program level support in an informal Q&A format. Registrations are
open on our website under Professional Learning or in the 2016-17 Professional Learning Catalog.

LOW INCIDENCE FUNDING UPDATE

ISSUE
CEO Council took action in May 2016 to address a shortfall in Low Incidence funding and an update of final 2015-
16 expenditures is provided as an information item.
BACKGROUND
Based on budget requests submitted as of May 1, 2016, Low Incidence (LI) funding requests were projected to
exceed available funding by an estimated $70K. Final expenditure reports filed by charter members have
resulted in a shortfall; however, the shortfall is less than was projected in May.
Based on final expenditure reports submitted to date, expenditures ($131K) exceed revenue ($97K) by $34K.
Included in the $131K total expenditures are $18K in pending 2015-16 claims for which we are awaiting final
documentation.
The $2K beginning balance (carryover from last year) plus an
unexpected one-time grant received in April 2016, is allocated to
the LI pool to cover the shortfall.
In 2016-17, estimated revenue is $117K. Funding is based on the
December 2015 LI pupil count multiplied by a rate of $433. Per
student reimbursements to charters for eligible LI expenditures is
established at a minimum rate of $433 and, based on available
funding, may be increased to an amount not to exceed $3,000.
CEO Council approved (May 2016) the use of one-time federal
backfill funds from the state to be allocated to the LI pool. At that time, we identified a possible need to return to
CEO Council in September, for additional funding to honor the 2015-16 $3,000 maximum. There is no need to
allocate additional dollars, as was originally anticipated.
CEO Council approved (May 2016) Allocation Plan language for 2016-17 to ensure predictability of funding. Based on the Allocation Plan guidelines, SELPA Administration set the 2016-17 minimum per student reimbursement level at the state LI per pupil funding rate of $433. By May 2017, a finding will be made regarding the ability to fund beyond the established minimum. Funding beyond the minimum rate will be determined as follows:
Total requests submitted plus estimated additional requests compared to total available funding.
Funding beyond the established minimum will not exceed $3000 per eligible student.
RECOMMENDATION

ISSUE
The 2016-17 ERMHS budget is presented for CEO Council approval.
BACKGROUND
Charter SELPA leadership must make findings of the sufficiency of ERMHS funding by September 15, 2016 for the 2016-17 year.
Per the Allocation Plan: By September 15 of each year Charter SELPA administration will make a finding of sufficiency of Level 2 funding based on the following variables:

Projected current year Level 2 service counts
Based on these findings, the service level formula amount will be established Maximum rate = $3,000 OR a higher amount may be established each year if the prior year ending balance is sufficient to assure SELPA members of predictable funding with no shortfalls. Minimum rate = $2,000
By September 15, if there is a finding of sufficiency of funding, $100K will be available for Level 2 transportation reimbursement – outside of the Level 2 service cap/ADA formula. The intent is to provide 80% funding for eligible costs. If $100K is not sufficient, funding will be pro-rated based on claims submitted at year end.
By September 15, if there is a finding of sufficiency of funding, indirect costs will be allowed for Level 2.
2015-16 ENDING BALANCE ESTIMATE
The goal is to maintain an ERMHS ending balance (reserve) in the 5% to 10% range. The 2015-16 ERMHS ending balance is 32% or $2.7M. This is over $1.8 M beyond the upper range reserve of 10%. The ending balance was higher primarily as a result of final Level 3 reimbursement requests of $1.4 M, which is significantly below the $2.2 M budget estimate.
2016-17 PROJECTED ADA
SELPA ADA is expected to increase by over 20,000 ADA in 2016-17, which generates approximately $1.2M additional ERMHS funding. Funding is based on approximately $60 per current year 2016-17 ADA (state) and $11 per prior year ADA (federal).
2016-17 PROJECTED LEVEL 3 COSTS
2015-16 final Level 3 costs were $1.4 M. The 2016-17 budget is projected to be $1.5M with an additional $1.5M contingency. $1.5M is a healthy contingency and should provide protection for any potential issues that might arise. Should the costs not materialize, the contingency could be used for Level 2 reimbursements.

2016-17 PROJECTED LEVEL 2 ERMHS SERVICE COUNTS
The major indicator of Level 2 costs is the ERMHS service counts. Trend data is shown below. The projected 4,000 count as of December 1, 2016 is conservative (line 8), and therefore a sound data point to determine budget parameters.
2016-17 PROJECTED LEVEL 2 BUDGET REQUESTS
In 2015-16, approximately 72% of the maximum eligibility was requested for reimbursement (line 5). For 2016-17 budgeting purposes, we are assuming 75% eligibility requested for reimbursement and an increased service level count of 4,000.
These assumptions result in a need to augment the 2016-17 budget (line 8) by $700K to fund 80% of Level 2 projected requests (line 9). If the projection was further augmented by increasing the rate to $3,300, the overall augmentation from ending balance would be $1.4M. The budget for 2016-17 assumes $1.5M in Level 2 augmentation is available. Based on this, sufficient funding is available to increase eligibility to $3,300 for 2016-17.
Please note that Level 2 was funded at 100% in 2015-16. In 2016-17, based on the following budget parameters, increasing from 80% to 100% funding is a cost of approximately $2M.

SELPA leadership (with review/input by CEO Executive Committee) makes the following finding of sufficiency of funding for 2016-17 to support the following budget decisions:

Indirect costs will be allowed for Level 2.
Before May 2017, SELPA Leadership will make a finding as to the ability to fund beyond the 80% and 90% parameters established in the Allocation Plan. The significant variables impacting this finding are the January 2017 Level 2 budget requests submitted and the Level 3 NPS budget requests submitted throughout the year.
RECOMMENDATION
CEO Council action is requested to approve the 2016-17 ERMHS budget of $11.4 (as shown in the chart above),
with the primary elements being a Level 2 allocation of $8.1 M and Level 3 allocation of $3 M.
