The process of unwinding a develop-ers agreement between Kohls Corporationand the village of Menomonee Falls willinclude the company paying back $2 mil-lion while the village will go ahead andkeep a distribution center that it will plan todevelop into a Public Works facility,Menomonee Falls Village Manager MarkFitzgerald told the Village Board Dec. 16.
Kohls Corporation and the village hadreached an agreement in 2012 to have thecompany locate its new corporate head-quarters at the Woodland Prime develop-
ment north of Good Hope Road and north-east of Appleton Avenue. As part of theagreement, the village would obtain the
companys distribution center building eastof Lilly Road and south of Woodale Drive.
The company announced Nov. 21 thatwas dropping those plans and insteadexpanding operations near its current head-quaters just north of Silver Spring Drive. Thevillage provided $2 million to the companyas part of the expansion. Fitzgerald said thecompany will repay the $2 million by Jan.31.
Fitzgerald said that when Kohlsannounced it would not expand atWoodland Prime, there was initial discus-sion between the company and the villageabout using $2 million to expand trafficcapacity at its current site.
Frankly, it never went very far,Fitzgerald said. He explained thatWoodland Prime is in a tax incremental
finance (TIF) district, and it is dif ficult to takefunds outside of a TIF. As a result, both par-ties agreed that the $2 million would berepaid to the village.
It frankly never got much traction andwe moved off of it, Fitzgerald said.
He then explained other portion of theagreement, which included transferring anoffice complex in Woodland Prime to Kohlswhile the village would obtain the Kohlsdistribution building on Lilly Road.Fitzgerald said Kohls will keep the officebuilding while the village will keep the dis-tribution building, with everything elseunwinding.
Kohls will move out of the distribution
building by Oct. 31, 2015, Fitzgerald said.He then explained plans to move the vil-lages public works operation to that site.He said that half t he building would be usedfor public works while the other half wouldbe rented or leased. He added the villagewill seek to develop vacant land in theWoodland Prime area and will use therefunded $2 million to pay off current debtin the TIF district.
The deal is solid, the deal was wellthought out in advance, the $2 million wasnever really an issue, Fitzgerald said.
During questioning by the board,Trustee Sharon Ellis asked if a planned roadto that would connect to Fond du LacAvenue would go ahead. Fitzgerald saidthe proposed road was dependent on ahigh development, large corporation sce-nario. If the lower development scenariowere to happen for the area, the roadwould not likely occur.
It may never be necessary and we maynever be able to afford it, Fitzgerald said
of the planned road. With Kohls not coming to Woodland
Prime, Fitzgerald said I think our best strat-egy and our best scenario is to get this landback in the hands of a private developer asquickly as we can and allow them to marketand develop it.
He added that the village has notworked through issues related to WoodlandPrime yet, and that will be a significant pri-ority for the village in first half of next year.

Shutouts are a part of hockey, but shut-ting out your opponents for an entire tour-nament is a feat all its own and one that isshared by the Washington County YouthHockey Association's Squirt "B" team aftertheir tournament championship in MosineeDecember 14-15.
"This team is really rolling and hasgelled very nicely," said Tom Postulka,Assistant Coach for the Squirt "B" Ice. "Thisis phenomenal achievement for any team, let alone it being these kids first ever tour-nament."
The Ice opened up tournament playwith a convincing victory over the tourna-ment hosts the Mosinee Pride 10-0. In semi-final play, the Ice was pitted against atough Green Bay Bobcats team. some of rest of these guys. They've done a greatjob and we hope to keep making you guys proudand making you guys happy and keep this thinggoing."
Afterward, Coach Showalter explained thedifferent reaction between continuing a winningstreak during the regular season as opposed towinning a state championship.

The Menomonee Falls Village Board Dec.16 approved a motion to amend land betweenPilgrim Road, Chateau Drive and WildflowerDrive to the low density residential classification
on the Comprehensive Plan. The land is currently in the park and open
space classification. Trustee Steve Raymondssaid the village owned the land at one time forthe purpose of eventually creating a park. However, the village swapped the land withAero Park LLC for property in the southwest por-tion of the village.
While the developers had recommended amedium density residential classification as partof plans for 82 lots on 32 acres, a petitionsigned by 20 residents and two letters from res-
idents was submitted opposing the request.Raymonds said that residents recognized
the property will be developed "but thought thebuildings and density should flow with what's
around there."Trustee Jeremy Walz added that land east
of the property has a low density classification.Director of Community Development Matt
Carran said that the medium density classifica-tion allowed between two to six units per acre.Carran said there would be issues with watercapacity if the current proposal was changed toallow for higher densities. The low density clas-sification limits density to less than two units peracre

Volunteer in Waukesha County
The downtown experienceI recently drove through the downtown area
this evening and I was once again please to seehow beautiful it looks. (Holiday) lights on light
poles, lights on the buildings, lights by Ninos, lights on the Village Square, a Christmasparade.
My compliments to the BID (BusinessImprovement District) manager Bard Watters, the BID board, the village staff and the VillageBoard who continue to work on the downtownand make it as village-y as it looks. Yes, thereare some vacancies, but each year there arefewer and fewer. It takes a great deal of time, energy and money to make this all work. ButMenomonee Falls, Cedarburg, Greendale andWauwatosa are among the few communities
that have a downtown. We continue to compete with the malls andthat is why each person who lives in the villageshould, as the old saying goes, Shop the FallsFirst. You hear the complaint that there is noparking yet these folks will walk miles at themalls. There is parking if you read the signs andwalk as you would in the malls. Yes, it is outside, but that is what Wisconsin weather is all aboutand you may just have to dress a little bitwarmer.
To all who make this downtown magic hap-pen, keep up the good work as it does not gounnoticed.
