Conditions1. The highest approved bidder shall be the
purchaser. The Auctioneer reserves theright to refuse any bid, and should anydispute arise between two or morebidders, the lot or lots in dispute shall beput up again, or not, and resold at thediscretion of the Auctioneer, or theauctioneer may declare the purchaser.The Auctioneer reserves the right to bidon behalf of the vendor up to andincluding any reserve price placed on anylot and to alter, divide, group or withdrawany lot or lots either before or at any timeduring the sale.
2. The Auctioneer shall regulate the biddingand no bid shall be retracted.
3. Every purchaser shall give his name andplace of abode, in default of which theAuctioneers shall have the power toresell at once, or afterwards as they maythink fit.
4. Each bidder shall be supposed to haveseen and to be thoroughly acquaintedwith the contents and conditions of the lotor lots on which he may bid, and noallowance whatsoever will be made forany faults, imperfections or errors of anydescription. The measurements andquantities described in the Catalogue arebelieved to be correct and must be takenas such. The purchaser being held tohave satisfied himself as tomeasurements and quantities and otherspecifications in the Catalogue beforebidding, neither will the Auctioneers orthe Vendors be responsible for any lot orparts of any lot after the fall of thehammer, from which time all lotspurchased are at the risk of thePurchaser.
5. The Auctioneers or the Vendors do notguarantee the measurementscatalogued, or the correct description,genuineness or authenticity of any lot.
6. Each purchaser shall pay the wholeamount of his purchase money(Auctioneerʼs Commission payable bypurchaser) for all lots bought by himbefore any lot or lots can be removedand the whole amount due from eachpurchaser must be absolutely paid oneach day of the sale and if not paidwithin such time, all moneys deposited inany part payment shall be absolutelyforfeited and the Auctioneers will be atliberty to resell the lot or lots or any partsthereof remaining un-removed, by PublicSale or otherwise, without giving previousnotice to the purchaser and anydifference or deficiencies which mayarise from, such re-sale, together with allexpenses attending the same shall bemade good by the purchaser.
7. The lots are sold with all faults and errorsof description. No allowance can bemade in any case, nor will the Vendorsbe answerable for any deficiencies inquantities or measurements when thepurchaser, his agent, carrier or manemployed by him has removed any partof his lot or lots from the premises. Alllots purchased must be removedabsolutely in the time specified and if notso removed may be resold by theVendors.
8. The Purchaser shall be answerable for alldamages occasioned by any injury orother lots, by the removal of lotspurchased by them, or to the premisesand to repair or pay damages to theowners of same before the removal oftheir lots from the premises. In the eventof any persons interested in thepremises, claiming the whole or any partof a lot before its removal therefrom or ifin the Auctioneerʼs opinion, the removalof any lot will endanger or permanentlydamage any building, the Auctioneermay, by written notice to the purchaser ofsuch lot delivered to him or his Agent, orsent by post to his abode or place ofbusiness last known to the Auctioneers,rescind the sale of any such lot. Thepurchaser shall then be repaid hispurchase money but shall not have ormake any other claim.
9. Such lot or lots as are not cleared awayagreeably to the condition of this sale,will not only be forfeited and may bedealt with under last condition, but thepurchaser shall pay every expenseattending the removal of any such lot orlots, and the costs of making good anydamage occasioned by such removal.No lots shall be removed until the dayfollowing the last day of sale.
10. If any dispute or difference arises aboutany lot, or any other subject, the sameshall be settled by the Auctioneers, withthe approval of the Vendors, whosedetermination shall be final and bindingon all parties concerned.
11. The Auctioneers nor the Vendors do notaccept any liability for personal injuriesof any description sustained or causedby any reason whatsoever by anyperson while on the premises orotherwise.
12. Purchasers will pay 15% AuctioneersCommission (minimum fee £1) + VAT onthe commission.
