The uncertainty of a jury's ver-

dict was again shown in the Aren-do-rf

murder trial. Conviction was

not expected by any one who hadwatched the evidence, but thateleven jurors should vote for ac-

quittal is somewhat remarkable.

If the state can produce no betterevidence in the other cases, theprosecutor might as well nolle thewhole business.

Hon. A. J. Weaver died at hisresidence in Falls City Monday

evening of peneumonia, after an

illness of a few days. He was

about 44 years of age and had been

a resident of Nebraska since '69,most of the time having accupied

important public positions. Hewas prosecuting attorney for thefirst judicial district four years,then judge of the same district five

years, and represented the "BigFirst" in Congress two terms. Hewas a self-ma-de man, possessing forabove the average ability. His deathwill be quite noticably felt in Ne-

braska affairs.

minal code is amended by makingthe penalty for the sale or givingaway or keeping in possession for

the purpose of selling or loaningany obscene, lewd, indecent or lascivious book, pamphlet, paper,drawing, lithograph, engraving, picture, photograph, model, cast or anyinstrument or article of indecent orimmoral use, or for the advertisingof the same for sale, or giving information where the same may bepurchased or obtained, a fine notexceeding $ 1,000, or imprisonment

Printing advertisementsof medicines for the cure of venerealdiseases; the sale or giving away ofbooks, papers or magazines made upof criminal news, police reports oraccounts of criminal deeds, or pictures and stores or immoral deeds,lust or crime, or the exhibiting ofthe same within, the view, or whichmav be within the view of anyminor child. These sots are subjectto the same penalties. All magistrates are authorized to seize suchgoods and destroy the same. Thisact does not apply to standard medi-cal works, or to the possession ofmodels by artists.

S. F. 143 Any person who shallintentionally attempt to provoke anassault upon himself or another, byuttering grossly vile or insultingwords to the opposite party, shallbe deemed guilty of a misdemeanorand shall be fined m anv sum notexceeding ten dollars or imprison-ment in the county jail not exceeding ten days.

S. F. 101 Section 47 of chapter7 of the criminal code is amendedso as to make the publication of alibel in a paper of general circulation a crime, punishable- - by impri-sonment in the penitentiary for notmore than three years nor less thanone year.

S. F. 98 This amends sections214 and 215 of the criminal code soas to provide that any person whoshall bet anv monev and nronertvupon any gaming table, bank ordevice whatever, or shall bet uponany game played at or by means ofanv such gammg table, shall uponconviction, thereof be fined in anysum not less than $100 nor morethan 500, or be imprisoned in thepenitentiary not more than twoyears. Any person keeping any ofthe above named gambling devicesshall be fined in any sum not lessthan 300 nor more than $500 or beimprisoned in the penitentiary notexceeding two years.

H. R. 137 Amending section 38,chapter 77, compiled statutes of1885. The section now reads:Each and every insurance companytransacting business in this stateshall be taxed upon the "excess ofpremiums received over losses andordinary expenses incurred" withinthe state during the 3rear previousto the year of listing in the countywhere the agent conduct the busi-ness, properly proportioned by thecompany at the same rate that allpersonal property is taxed," and theagent shall render the list and bepersonally liable for the tax. Incase of his refusal to render the listthe amount may be assessed accord-ing to the best knowledge of theassessor.

S. F. 32 By this act it is madeunlawful for grain and stock deal-

ers to enter into any agreement,contract or combination for poolingthe prices of different and compet-ing dealers to divide between themthe net proceeds of their earnings,or fixing the price which any dealercompany or association shall pay.The violation of the provisions ofthis act shall be deemed a misde-mino- r,

and subject to a fine in anysum not exceeding $1,000 or imprisonment in the county jail notexceeding six months, or . both atthe discretion of the court.

H. R. 318 This act provides thatall oils, or any oil fluid or substancewhich is a product of petroleum orinto which petroleum or any pro-

duct of petroleum enters or is founda constituent element, whethermanufactured in this state or not,shall be inspected before being of-

fered for sale for illuminating pur-poses. The governor is authorizedand instructed to appoint a suitabledisinterested person as inspector,who may appoint assistants not ex-

ceeding five in number, terms ofoffice to be two years. This actmakes it unlawful for any manu-facturer or dealer to sell oil not in-

spected and which has borne thetest, and describes minutely theduties of the inspector. Oil whichshall be stamped as being fit forilluminating purposes must have100 degrees Fahrenheit flash test,and the case or barrel must bebranded by the inspector as havingtested the exact number of degreeswhich his trial showed. The oiltester now in use in Ohio known asthe Foster apparatus, shall be usedby the state inspector and hisdeputies.

S. F. 38 Section 22 chapter 23of the compiled statutes of 1885 isamended as follows: "A widowwho at the time of her husband'sdeath be living therewith, and notowning in her own right a residencesuitable to her condition in life, mayremain in the dwelling house of herhusband after his death, so long asshe remains a widow, without rentcharge, aud shall have her reason-able sustenance out of the estate forthree years."

H. R.3 This act provides that aregister of deeds shall be elected inall counties having a population of18,000 or more, and prescribes theduties of such registers. It providesthat registers shall receive a salaryof $1,500 per year, except in coun

ties with a population of between25,000 and 60,000, where the regis- -ter shall receive $z,uuu per year,and in counties having over 60,000population, a salary of $2.o00 peryear; provided that registers shalldepend upon the receipts of theomce for their salary and clerk hire.

H. &. 88 This act appropriatesto Charles A. Johnson of Burtcounty, Neb., out of any monies inthe treasury not otherwise appropriated the sum or $d,yay.ou, onaccount of losses sustained by himin the destruction of and damage tohis property in said county by firein March, 1886, in the attempt ofofficers and citizens to apprehendan alleged murderer who had takenrefuge in the barn of said Johnson.Passed with emergency clause.

It provides that theassessor of each precinct, townshipor ward shall make and deliver tothe county clerk of their respectivecounties, at the time of makingtheir annual assessment in 1887 andevery two years thereafter, a corrected list of all persons who servedin the United States army, navy andmarine corps during !the war of1812, the Mexican war and the warof the rebellion, designating therank, company, regiment, batteryor vessel in which they served, andtheir present residence and post- -offlce address, which shall be returned with the assessor's books tothe county clerk, who shall on orbefore the first day of June, 1887,certify to the secretary of statea true copy of said lists alphabetic-ally arranged by regiments andstates. The secretary of state shallthen consolidate and arrange thesereturns and publish 10,000 in bookform for distribution as provided;Three copies to each brand Armypost in the state, 100 copies to thestate library for exchange withother, libraries, 50 copies to thecommissioner of pensions and thebalance to be distributed by thesecretary-o- f state. The expenseincured shall be paid from the fundfor printing laws, journals and suchother , printing as is required bycontract.
