AN ORDINANCE VACATING AN ALLEY IN I. N. JAQUESSSUBDIVISION OF THE HYDRAULIC RESERVE

OF THE CITY OF MT. CARMELWHEREAS, there is now located int~e City of Mt. Carmel an

alley approximately 12 feet in width lying adjacent to and Southof Lots 16 and 17 of I. N. Jaquess Subdivision, and Lots 18, 19,20, 21 and 22 of Chipman Subdivision, and North of Lots 10, 11,12, 13, 14 and 150f I. N. Jaquess SubdJvision, all in theHydraulic Reserve in the City of Mt. Carmel, Illinois, accordingto recorded placs of Chipman Subdivision recorded in Plat Book I,Page 110 (Slide 2-254), and I. N. WHEREAS, ~aid alley is not now in general use by the citizensof the City of Mt. Carmel; and

WHEREAS, it is in the public interest that the City no longerbe responsible for or pay the costs of maintenance of said alleymentioned above and hereinafter described. . .

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THECITY OF MT. CARMEL, ILLINOIS, AS FOLLOWS:

Section 1. That the alley lying a~jacent to and South ofLots 16 and 17 of I. N. Jaquess Subdivision and Lots 18, 19, 20,21 and 22 of Chipman Subdivision and North of Lots la, 11, 12, 13,14 and 15 of I. N. Jaquess Subdivision 611 in the'HydraulicRe serve in the City of Mt. Carmel, Ll Linoi s , (Slide 2-202 and2-254, Wabash County, Illinois) is hereky abandoned and vacated bythe City of Mt. Carmel and the same shall be hencefor.th declaredto be no longer a public alley or thoroughfare of the Ci~y.

herein vacated be and the same is hereby vested in the owner orowners of the land abutting said vacated alley as provided by lawwith each adjoining lot owner, owning to the center of said alley.

Section 3. That the City of Mt. Car.mel retains the right tomaintain, operate, repair or replace, by itself or by any licenseeor holder of any franchise from the City, any poles, wires, pipes,conduits, sewer mains, water mains or any other facility orequipment for the maintenance or operation of any utility nowlocated in said segment, or any portion of the alley, vacated bythis Ordinance.

Section 4. A certified copy of th~s Ordinance shall be filedfor record in the Office of the Recorder of Wabash County,Illinois.

Section 5. All Ordinances and Res~lutions, or parts thereof,in conflict with this Ordinance are her~by repealed.
