CONSTITUTION AND BY-LAWS
CONSTITUTION
Preamble
WE, the student members of Gambang Organization of Tertiary Students, in order to
initiate and coordinate student activities; to promote the opportunity to develop individual
leadership qualities and an understanding of group action; to reasonably characterize student
interest, needs, and general welfare; to recognize and support the diversity of needs and views
of students; to represent and foster harmonious and progressive student relations do hereby
promulgate this constitution.
ARTICLE I
NAME AND DOMICILE
SECTION 1. This organization shall be known as the GAMBANG ORGANIZATION OF TERTIARY
STUDENTS or otherwise known as GOTS, hereinafter referred to as students organization.
SECTION 2. The Organization shall be addressed at Barangay Gambang, Bakun, Benguet.
ARTICLE II
MEMBERSHIP and ADVISERS
SECTION 1. Any students who are currently enrolled in tertiary level shall be eligible to be an
active member and may hold office.

SECTION 2. Must be a resident of Gambang, Bakun, Benguet.
SECTION 3. Eligibility for membership or appointed or elected student officer positions in the
organization may not be limited on the basis of race, sex, color, age, religion, national origin,
marital status, sexual orientation, physical or mental handicap, ancestry or medical condition.
SECTION 4. An adviser to be qualified must be of good standing and must be of at least 20
years of age.
SECTION 5. Selection of adviser/s shall be upon the concurrence of the majority of general
membership.
ARTICLE III
ELECTION and RECALL OF OFFICERS
A. ELECTION OF OFFICERSSECTION 1. The officers of this organization are the president, vice president, treasurer,
secretary, auditor, public relation officers, business managers, sitio representatives and the
committee chairs.
SECTION 2. Officers will be elected through hand vote, with each active member casting avote. A majority of votes will constitute a victory.
SECTION 3. Election of the new set of officers will take place during the 2nd
Sunday of June.
SECTION 4. Officers will assume office for the period of one year.
B. RECALL OF OFFICERSSECTION 5. Officers are subject to recall for any of the violations enumerated in Article XIhereof.
SECTION 6. Recall procedures will be initiated through a petition by any member filed to the
grievance committee.
SECTION 7. A hearing will be conducted at a special meeting of all the members for the
presentation of evidence from all concerned parties.
SECTION 8. A majority of those active members voting in a recall at the end of the hearing is
necessary to remove any officer.

ARTICLE IV
POWERS and DUTIES OF OFFICERS
SECTION 1. Powers and Duties of the Adviser/s
The Adviser/s shall:
(a) Act as consultant for projects and standing committees of the Organization.(b) Attend social activities sponsored by the Organization (mandatory).(c) Provide useful guidance to help the student organization identify and attain its goals.(d) Be aware of the groups finances and budget, as his approval may be needed for financial
transaction and shall counter-sign all organization financial forms.
(e) Maintain ongoing contact with club officers.
SECTION 2. Powers and Duties of President
The President shall represent the organization:
(a) Supervise and direct the affairs of the organization and convene committee chairmembers in accordance to the activities of the organization.
(b)Perform all duties incident to his/her office and such other duties as may berequired, by the Articles of this organization, or which may be prescribed from time
to time by the activities of the organization.
(c) Prepare and report annual activities of the organization to members twice a schoolyear.
(d)Unless another person is specifically appointed as Chairperson, he/she shall presideand call for general meetings as needed, as well as meetings with the officers of the
organization.
(e)Approved orders covering the applications or expenditures of GOTS funds beforepayment or disbursement is made by the Treasurer with concurrence majority by
the members.
(f) Except as otherwise expressly provided by law or the articles of this constitution,he/she shall, in the name of the organization, execute such deeds authorized by its
directives.

SECTION 3. Powers and Duties of Vice-President
The Vice-President shall:
(a) Have other powers and perform such other duties as to support the activities of theorganization and coordinate the work of the different committees of the
organization.
(b)Perform all the duties of the President in his/her absence, and when so acting shallhave all the powers of the office.
SECTION 4. Powers and Duties of Secretary
The Secretary shall:
(a) Certify and keep an original or a copy of this Constitution as amended or otherwisealtered to date.
(b)Maintain minutes of meetings, the names of those present or represented at themeeting, and the proceedings thereof; as well as maintain continuity of other
records (including web page), and files to guarantee the perpetuity of the
organization.
(c) See that all notices are duly given in accordance with the provisions of theorganization.
(d)Be custodian of the records of the organization.(e) In general, perform all duties incident to the office of Secretary and such other
duties (such as relating to public relations) as may be required.
SECTION 5. Powers and Duties of treasurer
The Treasurer shall:
(a) Have charge and custody of, and be responsible for, all funds of the organization,and deposit all such funds in its name.
(b)Receive, and give receipt for, monies due and payable to the organization from anysource whatsoever.
(c) Disburse the funds of the organization as may be directed by the President, througha resolution initiated by any member and was approved via majority vote, taking
proper receipts for such disbursements.

(d)Keep and maintain adequate and correct accounts of the organization's businesstransactions, including accounts of its assets, liabilities, receipts, disbursements,
gains and losses.
(e)Keep and maintain the account books of financial records to be presented to allmembers twice a school year.
(f) Render to the President or proper Committee, whenever requested, an account ofany or all of his or her transactions as Treasurer and of the financial condition of the
organization.
(g) Prepare and certify the financial statements to be included in any required reports.(h) In general, perform all duties incident to the office of Treasurer and such other
duties as may be required.
SECTION 6. Powers and Duties of Auditor
The Auditor shall:
(a) Audit, verify, and examine all financial accounts of the Organization.
(b)Shall supervise the entries in the books of accounts of the Organization.(c) Analyze and monitor various types of financial documents to ensure that members
are compliant with Organizations regulations. These documents may include various
types of financial information about assets, liabilities, surplus, income and expenses.
(d)Verify the efficiency and effectiveness of the organization by looking for any fraud ormismanagement
(e)Analyzing documents and creates detailed reports and discusses their findings withthe President and the proper committee.
SECTION 7. Powers and Duties of Public Relation Officers (PROs)
The Public Relation Officers (PROs) shall:
(a) Monitor public opinion about an organization or particular issues: advisemanagement on policy issues and communication strategies.
(b)Plan public relations programs including preparing cost budgets.(c) Assist in preparing organizational documents such as semestral reports, organization
profiles and submissions.

(d)Write speeches, prepare visual aids and make public presentations.(e)Oversee production of visual (film or video) and audio electronic material, including
managing an internet website.
(f) Organize special events such as open days, visits, exhibitions and functions.(g) Evaluate communication activities and recommend future actions.
SECTION 8. Powers and Duties of Business Managers
The business Managers shall:
(a) Sets goals for the organization, and decides what work needs to be done to meetthose goals.
(b)Divides the work into manageable activities, and selects members to accomplish thetasks that need to be done.
(c) Establishes appropriate targets and standards, and analyzes, appraises andinterprets performance.
SECTION 9. Powers and Duties of Committee Chairs
In coordination with other members of the organization, committee chairs will:
(a) Have the powers to perform such duties that support the activities of theorganization and coordinate the work of the different members of the organization
in accordance to its objectives.
(b)Committee chairs will schedule committee meetings at their discretion and publicizecommittee meeting times and activities to all members.
(c) Committee chairs, when preceding over an activity relating to their committees,will lead the implementation of the activity in coordination with the organizations
elected or appointed officials.
SECTION 10. Powers and Duties of Sitio Representatives
The Sitio Representatives shall:
(a) Keep the GOTS informed about any issues and concerns that are raised by the Sitiomembers they represent.
(b)Provide the GOTS the information about members of the Sitio being represented.

(c) Assist members of the Sitio being represented in application process forprocurement of funds or application of new members.
(d)Keeps the Sitio members they represent be informed about the GOTS activities.
ARTICLE VII
STANDING COMMITTEES
SECTION 1. To ensure coordination and efficiency in the activities and transaction of GOTS
affair and in order to realize the objectives of this Constitution, the following five (5) standing
committees are hereby created:
(a)SPORTS COMMITTEE- the Sports Committee shall be responsible for the promotionand pursuance of all physical sporting matters including competitive activities which
may include basketball, volleyball, table tennis or long tennis and other indoor
games as may prescribe by them.
(b)GRIEVANCE COMMITTEE- the Grievance Committee shall investigate internaldisputes and shall assist in the presentation and settlement ofmembers grievance
with respect to the organization. It shall be responsible for the adoption and
implementation of programs, projects and activities that will promote and protect
the general welfare of the members.
(c) DEVELOPMNENT AND MEMBERSHIP COMMITTEE- shall receive and processapplication for membership and make recommendations thereon to the president. It
shall implement rules, regulations and decisions as may be promulgated by the
general membership for the admission of members in the organization.
(d)COMMUNITY SERVICE COMMITTEE- is responsible for the development, promotion,and implementation of community service programs on the local, state, and national
levels. It shall strive to make significant and positive contributions to the community
through a collective effort.
(e)FUND RAISING/ FINANCIAL COMMITTEE- It shall develop ideas for fundraisingevents and activities, and raise awareness and visibility for the youth. It shall initiate
and cultivate donating relationships that may lead to a long-term partnership and
support for GOTS ongoing programmatic work or activities.
(f) INFORMATION COMMITTEE- It shall do advance research relevant to the generalwelfare of the GOTS and to collate information and disseminate it to members. It
shall be responsible in propagating the time and date of special or regular assembly
of the organization to its members. And shall be accountable in informing the
members for any upcoming events or activities by GOTS.

ARTICLE VIII
MEETINGS
SECTION 1. Meetings shall be held regularly at a time to be specified by the organization at
the beginning of each semester. There should be at least one general assembly/meeting per
semester.
SECTION 2. Special meetings of the officers or the organization may be called at any time,
either at the call of the President, upon request of any of the standing committees.
SECTION 3. Notices of the meeting shall be sent out by the information committee headed
by the public relation officer five (5) days prior to such meeting by posting in conspicuous
places preferably inside office premises, said notices.
SECTION 4. Any member who absents himself from any regular or special meeting of the
general membership shall submit a written explanation to the Committee on Membership as to
the reason or reasons for his failure to attend the meeting. The Committee on Membership
shall evaluate the explanation and render a report thereof to the President.
SECTION 5. In the event reason or reasons are unacceptable to the Executive Board for
being unjustified, the erring member or members shall pay at the discretion of the President
and the Fundraising/ Financial Committee a fine of not less than 50 PESOS nor more than 200
PESOS to the organization, through the Treasurer.
SECTION 6. Any officer who absents his/herself without a valid reason will be penalized for
additional fine of not less than 20 PESOS nor more than 50 PESOS other than that of section 6
hereof to the organization, through the Treasurer.
SECTION 7. An absence of three (3) consecutive meetings or five (5) cumulative meetings of
any member without a valid reason shall be a ground for his/her disqualification from the
GOTS.
ARTICLE IX
QUORUM and RULES OF ORDER
SECTION 1. A majority of the members of the GOTS shall constitute a quorum to officially
transact any business.
SECTION 2. Except when a greater proportion is required hereon or by law, a majority voteshall prevail at meetings and deliberations of the GOTS.
SECTION 2. Meetings of the GOTS, shall whenever practicable be governed by the Roberts
Rules of Order.

ARTICLE X
DUES and OTHER PAYMENTS
SECTION 1. An admission fee of 100 pesos shall be paid by an applicant before he becomes
officially a member of the GOTS.
SECTION 2. Every member shall pay semestral dues to the GOTS in the amount of 100
pesos, which may be collected through written authorization of the member or committee
concerned.
SECTION 3. All amounts collected pursuant to the two preceeding sections shall constitute
the General Fund of the GOTS to be applied to the operational and organizational expenses of
the organization or for any purposes or object as may be authorized by the President in awritten resolution adopted at a meeting duly called for the purpose.
SECTION 4. Every payment of fees, dues or other contributions by a member shall be
evidenced by a receipt signed by the Treasurer or the authorized proper committee making the
collection and entered into the records of the GOTS to be kept and maintained for the purpose.
SECTION 5. Every expenditure of the funds of the Organization shall be evidenced by a
receipt from the person to whom the payment is made which shall state the date, place and
purpose of such payment. Such receipt shall form part of the financial records of the GOTS.
SECTION 6. The books of accounts and other records of the financial activities of the union
shall be open for inspection by any officer or member anytime during office hours.
ARTICLE XI
GROUNDS FOR RECALL
SECTION 1. Any of the following shall be a ground for the impeachment or recall of GOTS
officers:
(a) Committing or causing the commission directly or indirectly of acts against theinterest and welfare of the GOTS.
(b)Malicious attack against the GOTS, its officers or against a fellow GOTS officer ormember.
(c) Gross misconduct unbecoming of any member or officer of the organization.(d)Misappropriation or malversation of GOTS funds and property. This is without
prejudice to the filing of an appropriate criminal or civil action against the
responsible officer or officers by any interested party.

(e)Willful violation of any provisions of this Constitution or rules, regulations, measuresresolution and decision of the GOTS.
ARTICLE XII
AMENDMENTS TO THE CONSTITUTION
SECTION 1. Proposals for amendments to this Constitution may be made by any of the
standing committees or upon formal petition of at least ten (10) percent of the general
membership.
SECTION 2. No proposal shall be considered an amendment and become a part of this
constitution until after the same shall have been ratified by two-thirds 2/3 vote of all themembers of the Organization either at special meeting or a referendum called for such
purpose.
BY-LAWS
ARTICLE I
DUES
SECTION 1. Dues will be 100 pesos per semester or collection by each member.
SECTION 3. There shall be two collections every school year for each member.
SECTION 2. Dues will be collected every 2nd
Sunday of June and second collection will be
every 2nd
Sunday of November each school year, through the Treasurer or the Fund raising/
Financial Committee.
SECTION 3. Dues will be considered delinquent if not paid within forty-five (45) days from
the date of payment.
ARTICLE II
MEETINGS
SECTION 1. A general membership meeting or general assembly shall be held every 2nd
Sunday of June and 2nd
Sunday of November.
SECTION 2. An assembly of the officers shall be held every 3rd
Sunday of each month during
school calendar year. However upon the request of the President or any of the standing
committees a special assembly shall be held.

AMENDMENTS TO BY-LAWS
