The highly technological identity and the value of the Beghelli
brand are completely reflected in this project for the renewal of
light sources for emergency and now also illumination devices.
The use of high-efficiency LED and a calibrated light beam in the
Stella Polare project creates appropriate lighting with very high
energy savings.
The Useful Lighting philosophy was born from the need to
achieve a light beam that was suitable for general and
emergency lighting with the highest degree of effectiveness.
The optics were especially designed to resolve the problem of
ground-level lighting with the smallest number of devices, in line
with the requisites of current regulations.
We are proud to present a new concept of lighting and emergency
lighting that surpasses the limits of simple product innovation and
represents a significant advance in the sector.

This emergency lighting fixture is characterised by particularly
sophisticated electronic technology. Logica LED is the only
emergency lighting fixture, supplied in a centralised version (LG,
LGFM), which configures automatically in an Autotest version (AT) if
not connected to a control unit.
The circuit also allows the fixture to be customised to suit the
necessities of use, adjusting its autonomy (1h/2h/3h, up to 6h for the
8W version) and, in the case of the SA mantained version, it can be
switched to a PS version, adjusting the light intensity according to the
requirements of the type of public establishment. The latter opportunity
is a winner when the safety sign becomes the only visible element. It
must therefore be immediately identifiable, elegant, non invasive and
uniform in all fixtures.
Thanks to the symmetry and extreme uniformity of lighting that
characterise the Logica LED, it can be installed, without a predefined
orientation, on the wall, on the ceiling and recessed using the kit
provided, complete with box and a frame that covers the wires.
Inside the housing is a louvre with dual reflection, which in turn
contains two series of highly efficient LEDs that ensure unprecedented
technical lighting output (up to 1500lm). The highly transparent
polycarbonate diffuser has been designed to seal the optics and
obtain Protection degree IP65.

Acciaio Emergenza LED is the answer to the need for high technology
products for particularly demanding high risk contexts. The steel body
and the glass shield offer excellent mechanical strength (IK09) and
protection against aggressive chemical agents. In the industrial
context, it is perfect for installations in explosive atmosphere spaces
created by alterations in gassy substances and the presence of air-
suspended combustible powder (pursuant to ATEX 94/9/EC
regulation for zones 02 and 22).
The optical system consists of a reflector that is subdivided in 4 cells for
excellent light distribution and a special micro-prismatic glass with
extremely high light transmission for greater visual comfort.
Acciaio Emergenza LED is suitable for use in demanding contexts
including outside environments that are directly exposed to the
elements. It is designed to resist mechanical vibrations and
electromagnetic disturbances that are typical of industrial
environments. The special steel brackets allow the device to be
positioned as required. A compatible accessory, ordered separately,
warms the battery and permits installation in sites with temperatures
as low as -40°C.
You can add a separate AUTORIPARA battery to increase the
luminous flux to 1600 lm.

Formula 65 leD ar Granluce Emergency LED GRANLUCE
Device for emergency lighting that is highly flexible in use. The
symmetry and the great uniformity of its illumination means that
Formula 65 LED AR can be installed without a pre-fixed positioning,
to the walls, ceiling, suspended or recessed.
The white polycarbonate body houses a double-reflective optic that in
turn integrates two highly efficient LED series (greater than
160 lumen/Watt). The high-transparent polycarbonate shield was
designed to seal in the optic group so that the device offers a IP65
protection level. The external shell features a number of pre-scored
access points for direct fitting on all the most common junction or
flush-mounted boxes.

Designed to withstand extreme temperatures as low as -40 °C such
as those in cold storage units at high altitudes. The emergency Ice
Pack power supply that confers these features is separately supplied
and includes an automatic battery heating system that does not
degrade with extremely low temperatures. The device is designed to
accommodate the feed-through cabling (section 2.5 mm) and is
suitable for use with the M20 commercial cable brackets, both for
smooth and corrugated tubes of 16 and 20 mm diameter.

Formula 65 leD capacitor Emergency LED
Device especially designed for extreme situations, both in terms of
difficult maintenance or extremely low or high environmental
temperatures. The power batteries have been replaced with latest
generation high volume capacitors and are guaranteed for more than
20 years. In addition the Capacitor system completes recharging in
just a few minutes (around 10) compared to the traditional 12/24
hour. This revolutionary feature guarantees a safety level unlike any
other to date. Recharging takes only a few minutes, and so lighting
is always available in emergency situations with repeat blackouts,
making the RM function superfluous.
Safety, the elimination of maintenance costs, very fast recharging
times and working temperatures from -40 e +50°C, this is the
Formula 65 LED Capacitor.

store an exceptionally larger quantity of electrical charge compared to
traditional capacitors. Traditional models have a capacity of mF, whilst
the super capacitors can offer more than 5000 F.
These energy conversion and storage devices have very high specific
power and energy that is greatly superior to conventional capacitors.
In contrast to traditional models, they can be charged or discharged
almost instantaneously thanks to the very high specific power. The
supercapacitors can withstand up to 500,000 recharging and
discharging cycles and if suitably managed guarantee a working life in
standby of up to 20 years.

Thermofluidodynamic analysis: calculated heat dissipation
To ensure long duration and high performance of the LED source,
a new technology has been used which simulates heat diffusion
in the fixture: the thermofluidodynamic analysis allows you to
foresee the working temperature of the various components so as
to optimize the heat dissipation system.
In the case of the Lungalargaluce LED Ceiling, the dissipation
organ is the housing of the fixture itself which, to optimize its
efficiency, is made completely of die-cast aluminium.
Compactness and easy to install
Lungalargaluce LED is concentrated technology enclosed in a
housing with very small dimensions. The outer casing, in
polycarbonate, can be easily removed by means of two quick-
release locks that do not require a special tool to open them. The
electronics are housed inside, consisting of the LED module,
Inverter and battery pack.
A quick-connecting terminal board is used for the wiring.

High-performance auxiliary device for emergency lighting.Operation is subordinate to mounting on an existing fixture fortraditional lighting, where the LED module and the respectiveinverter with battery pack are positioned. The Kit includes 3special lenses in high-transparency polycarbonate, for theLungaluce, Altaluce and Largaluce versions, to obtaindifferent dimensions of the illuminated surface and to allowmounting at heights of 3 or 7 metres. The LED module isequipped with a blocking system with an elastic clip for bothT8 and T5 lampholders. It is a high-efficiency Led with arecessed heat sink in graphite-charged polyamide, ensuring along duration and great reliability of the fixture.

The Plug & Light system marks the newfrontier for inverters for integration of the

Beghelli philosophy that was first presentedwith the Smart Drivers, innovative power

This inverter is immediately connectedthanks to the rapid insertion connector that
can be directly inserted in the Driver SDpresent in all Stella Polare LED devices. The system was developed to make
installation of the inverter faster withoutcompromising the features and the
regularity conformity of the Stella Polare LEDdevice in which it is installed as no wiring is
required. Connection takes only a fewseconds. In addition, the compact cabinetalso includes the battery pack eliminating
the problem of the siting and attachment ofthe power source during emergency

Inverter based on Plug&Light patented technology, equipped with a
rapid connector that is compatible with SD (Smart Driver) that comes
as standard in all the devices in the Stella Polare LED range. The
inverter cabinet incorporates the battery pack and features a cable
cover for use removed from the device, such as in the case of Led
Panel or Down light LED, where it is housed in the false ceiling. The
system includes the Battery Control System (BCS) with multi-color
LED signaling system to show battery status, and is compatible with
all LED devices equipped with SELV certified drivers to which it can
be quickly connected using the fast universal terminal board.
The Plug&Light system guarantees the highest level of performance
(for example when installed on BS 100 LED it provides emergency
power of 407 Im), constant output power and complete maintenance
of the conformity features of the Smart Driver device that it is
connected to.

Indica LED is the design solution for sign lighting requirements, with a
high technological content for all types of applications. A back light
system is used and, thanks to a patented optical system, it
guarantees maximum uniformity of sign illumination with excellent
luminosity. The fixture is also particularly versatile because it has a
universal bracket that can be fitted either on the long side, for
mounting on the ceiling, or on the long side for suspended
applications on the wall. A single-sided version is also available for
above-door installations. All Indica LED products have silk-screen
printed opaline polycarbonate diffusers for easier installation and to
guarantee a very high sign illuminance uniformity (over 500cd/sq.m)
on the white part.

Indica LED is the design solution for sign lighting requirements, with a
high technological content for all types of applications. A back light
system is used and, thanks to a patented optical system, it
guarantees maximum uniformity of sign illumination with excellent
luminosity. The fixture is also particularly versatile because it has a
universal bracket that can be fitted either on the long side, for
mounting on the ceiling, or on the long side for suspended
applications on the wall. A single-sided version is also available for
above-door installations. All Indica LED products have silk-screen
printed opaline polycarbonate diffusers for easier installation and to
guarantee a very high sign illuminance uniformity (over 500cd/sq.m)
on the white part.

This is the software created by the Beghelli Research Centre for
lighting design. It contains all the technical data sheets of Beghelli
products for both lighting and emergency lighting. It allows the
processing of CAD Data from other architectural programs and
exporting of the results with the greatest simplicity. It is an effective
tool allowing the creation of:
• Professional and efficient projects with maximum simplicity
• Calculation of emergency lighting in compliance with standard
UNI-EN 1838.

LOGICA management software VISUAL
Software for the management of one or more centralized
emergency lighting systems of the Series LOGICA, LOGICA FM
and SoccorLogica. It is possible to import the plans in standard
formats and to complete them with the positioning of the various
lighting and emergency devices. The video interface allows direct
action on the devices and display of their status. It allows all the
operations contemplated by the control unit to be performed in
remote mode: a report on the system status can be obtained
automatically. The reports can be archived, creating a historic
trace of the status of the various systems.

AT - AutoTest: the recessed control system
ELECTRONICALLY CONTROLLED RECHARGING TO SAVE ENERGY AND DOUBLE THE BATTERY LIFEThe waste of energy, caused by the continuous recharging of
emergency fixtures, is often neglected. Beghelli, always attentive to
environmental issues, has created a recharging system which, as
soon as the battery has completed the cycle (12 hours), automatically
passes to the next stage to maintain the charge, limiting lamp
absorption to less than one Watt.
This SYSTEM, which appreciably reduces the waste of energy,
limits thermal build-up and consequent stress on the battery
which, consequently, will have an increase of its working life that
is double the life obtained with conventional circuits.
SIMPLIFIES THE PROCEDURES LISTED BY STANDARD UNI 11222
This system guarantees the control operations that must be
carried out by the Head of the prevention and protection service
according to Decree 81/08 of the Consolidation act on safety on
the workplace.
The autonomy test includes checking of all the lamp functions in a
space of time equal to the autonomy required by the individual
standards and it is carried out every 26 weeks; there is also an
operation test every 28 days, concerning the lamp, battery and
circuit. The result of the tests is shown by the multicolour LED on
the fixtures. This always guarantees perfect control of operation
and allows an economic saving on the costs of personnel who
otherwise would be assigned to maintenance.

AR - AutoTest Ripara:from AT to AR with an extra battery
The self-powered emergency lighting fixtures in the AutoRipara
series are the fruit of sophisticated electronic technology, which
also includes a microprocessor able to integrate a high number of
functions. As well as switching on automatically in the absence of
mains power, the fixtures perform periodic self-control tests
regarding both operation and autonomy, as required by Standard
UNI11222.
To perform the tests the AutoRipara system simulates the
absence of mains power and checks that the fixtures are working
correctly. The operation test checks all the lamp functions in the
space of 1 minute and is held monthly. The autonomy test
includes checking of all the lamp functions in a space of time
equal to the autonomy required by the individual standards and it
is carried out every 26 weeks. The result of the tests is shown by
the multicolour LED on the fixtures. This always guarantees
perfect control of operation and allows an economic saving on
the costs of personnel who otherwise would be assigned to
maintenance. AutoRipara fixtures can be installed in existing
emergency lighting systems without requiring the laying of further
wiring.

LGFM - Logica FM:the centralized system by radio
SISTEMA LOGICA CT BY RADIO (up to 992 fixtures)
The LOGIC FM Control unit manages and controls emergency
fixtures of the Logica FM series. The LOGIC FM Control unit can
in turn be managed and controlled by a remote or local PC.
LOW-POWER RADIO COMMUNICATION BASED ON SPREAD-SPECTRUM TECHNOLOGY WITH UNLIMITED RADIO RANGE
The radio waves used by the Logica FM system have very low
power to avoid any type of interference and electromagnetic
pollution. The power involved in the radio communications is less
than one hundredth of the power emitted by an ordinary cell
phone.
The signal transmitted by the Control unit is received by the first
fixture in the “path” memorized at start-up of the Control unit; each
fixture, being equipped with a radio transceiver and amplifier,
receives and transmits the signal to the fixture that follows it in the
memorized “path”.
All the products in this range comply with the requirements of
European Recommendation ERC/REC 70-03.

LOGICA is a versatile and modular emergency control system,
conceived to ensure compatibility with local and national
regulations concerning the use and checking of emergency
lighting systems. In particular Standard 11222 specifies theprocedures for the periodic checking, maintenance,overhaul and commissioning of emergency fixtures.

INNOVATION AND VERSATILITY
The SoccorLogica system is a centralized power supply system
for emergency lighting with DIAGNOSTIC functions and automatic
tests of operation and autonomy.
The great versatility of the system allows fixtures already used for
ordinary lighting to be connected in an emergency, simply by
inserting the specific lamp module.
In addition to the system fixtures, SoccorLogica also integrates
fluorescent lighting fixtures equipped with an electronic control gear
or a DALI type electronic control gear, incandescent, 230V halogen
and low-voltage halogen fixtures with an electronic transformer: in
an emergency the system provides a continuous voltage at
216Vdc, assigning a single specific address in self-learning for
rapid identification. The SoccorLogica centralized battery system
allows the installation of an emergency lighting system for
structures of any size.
It is possible to integrate SoccorLogica in a BMS (Building
Management System) based on LON or KONNEX technology.
SAFE AND ECONOMIC INSTALLATION
Each fixture is able to dialogue individually with the control unit
using the supply lines for the exchange of information by means
of powerline technology: on the power lines dedicated to the
fixtures, the Control unit sends a digital transmission coded in
such a way that it can be “heard” only by the fixture for which it is
intended. This technology limits connections and installation
cables, with an obvious saving in material and manpower.
THE FIXTURE ADAPTS TO THE NECESSITY
The centralized supply and control system with which every single
lighting fixture con be controlled and supervised without any
difficulty in programming allows different operating modes, such
as: non permanent Emergency Only (SE), permanent lighting
Always On (SA). Fixtures with different operating modes can be
installed on the same line, commanded by a local switch with
timed ignition, setting or modifying the data directly from the
Control unit or be means of the specific VISUAL LOGICA software.
Using the special DALI ballast connection module, it is possible to
choose the emergency flux lamp by lamp, with limitation of the
power supplied in an emergency and consequent optimization of
the system.
THE COMPATIBILITY OF THE LOGICA WORLD
All systems in the LOGICA series are compatible and can
dialogue with one another using the VISUAL LOGICA software.
Fixtures of the LOGICA, LOGICA FM and SoccorLogica series
can be controlled with the same instrument. The system operator
can use a single PC station to fulfil all the obligations envisaged
by the Regulations in force, and to perform commands and
controls of any type.

large display panel and a separable frame for 19” rack modules
with battery pack in a separate cabinet.

THE CONTROL UNITS
The system Control unit is integrated in a metal cabinet that
contains all the system components. In systems with higher
powers there is a second cabinet containing the battery packs.
The batteries used are 216 V packs with an average life of more
than 10 years.
Each control unit has a variable number of lineS, depending on
the model.
Each output module manages 2 lines able to control up to 32
fixtures for a maximum of 690W each line. The total must not
exceed the total power of the Control unit.
The possibility of sharing the emergency lighting power supply
over several outputs, all individually protective and selective
among one another, offers a great advantage from the point of
view of safety and regulations, bringing a centralized power supply
system close to the intrinsic safety of an emergency lighting
system made with autonomous fixtures.
The emergency fixtures, or the ordinary lighting fixtures fitted with
the special lamp module, are directly connected on the line that
leaves the SoccorLogica Control unit. In the absence of mains
power, the supply to the emergency fixtures is guaranteed by the
battery packs integrated in the control unit or housed in a separate
cabinet.

All the configurations shown in the diagram can be simply programmed by the control unit, without any change to the system, using onlythe power line of the lamps, and they can be reconfigured to suit any changes in the system requirements.
CONTROL AND MONITORING INTERFACE
The system manages and coordinates all the SoccorLogica
systems in compliance with standards EN50171 and EN 50172.
The interface has four control buttons, one display, a multimedia
board (MMC) and a printer port.

interface allows direct action on the devices
and display of their status. It allows all the

SLGS - Soccorlogica Sicuro 24V:intelligent centralized power supply at low voltage

The Soccorlogica Sicuro 24V system is an emergency lighting
system with centralized power supply which allows the
management of lamps for emergency lighting and escape routes,
with diagnosis functions and automatic tests of operation and
autonomy, but which uses a very low safety voltage.
In compliance with regulations DIN EN 50172, the system falls
under protection class III.
The great versatility of the system allows the emergency
connection of Beghelli LED fixtures designed for the purpose, but
also of ordinary Beghelli LED lighting fixtures, simply by fitting the
specific lamp module, Sicuro 24V Inverter LED.
In an emergency the system provides a continuous voltage at
24Vdc, assigning a single specific address in self-learning for
rapid identification. The system has a centralized battery.
It is possible to integrate SICURO LED 24V in a BMS (Building
Management System) with appropriate software.

THE ELEMENTS• Device for automatic control and monitoring, in compliance with
standard EN 62034. Monitoring is carried out by means of two
types of tests. The shorter one evaluates the perfect operation
of the system (functional test) and the more detailed one
evaluates the emergency autonomy (duration test). The test
results are stored in the SicuroLED device.
• Charger 27.2 V / 3A 27.2V / 5A, 27.2V 10A
• Automatic emergency activation in the absence of mains
power. The system also allows the emergency to be managed
autonomously on the various system sections.
• The mains presence on the distributions is indicated to the
system by single-phase or three-phase mains sensor devices.
They are fitted downstream from the differentials/disconnecting
switches and monitor the single phase or the three phases.
• Each SicuroLED Control unit manages up to 128 lamps,
subdivided into 4 lines of maximum 32 lamps each. Main
characteristics and functions of the system:
- integration of SE and SA functionality
- Univocal and automatic addressing of the lamps
- Targeted monitoring of the single lamp
- In the presence of mains power, the lamps can be dimmed
from 10% to 100%

The simplest system in compliance with standard UNI 11222
The UNI 11222 standard defines the procedures for running
periodic controls, maintenance, overhaul and commissioning of
safety lighting equipment in buildings, composed of emergency
lighting fixtures, both autonomous and centralized. The Standard
requires almost everywhere the use of fixtures and/or emergency lighting
systems that allow automatic checking of their effective autonomy.
It also specifies that the registrations effected by automatic diagnostic
systems constitute a valid input to the compilation of the periodic controls
register. Even for moderate size systems it is therefore absolutely recommended
to use at least Autotest fixtures, which from the economic point of view are now
comparable to normal traditional emergency fixtures.

When the system starts to have important dimensions (on average more than 30-40 fixtures installed), it is
necessary to aim for systems with centralized self-diagnosis such as Logica and Logica FM which have
the advantage of concentrating the results of the periodic tests in a single station. Logica FM also offers
the extraordinary convenience of not having to lay additional connections besides the ordinary mains
power supply cables. This characteristic makes it possible to install an emergency lighting system with
centralized control even on existing systems, without making any alterations to the electrical system since
a dedicated data line is not necessary.
Instead SoccorLogica allows the concept of emergency lighting with diagnostics to be extended also to
systems with a centralized power supply.

The highly technological identity and the value of the Beghelli
brand are fully expressed in the project for the renewal of
emergency fixture light sources. The use of high-efficiency LEDs
and a calibrated light beam produces adequate lighting while
maintaining very high energy saving.
The Luce Utile (Useful Light) philosophy springs from the need to
obtain an ideal beam of light for emergency lighting that gives the
maximum possible light output. The optics have been specially
designed to solve lighting problems on the ground with a smaller
number of fixtures, respecting the values envisaged by the
regulations in force.

RHOS DIRECTIVE 2002/95/EC
In order to facilitate the recovery and recycling of electrical equipment and to avoid the accumulation ofhazardous substances in the environment, the European community issured the RHOS directive,acknowledged in Italy with the same decree as the WEEE directive, that is DM 151 of 25 July 2005. TheDirective was rewritten and issued with reference 2011/65 with new obligations for producers in termsof documentation. The substantial provisions remain unchanged:
Without prejudice to annex 5, as from 1st July 2006 it is forbidden to launch on the market new electricaland electronic equipment falling under the categories identified in annex 1A, as well as incandescent lightsources containing lead, mercury, cadmium, hexavalent chromium, polybrominated biphenyls (PBBs) orpolybrominated diphenyl ether (PBDE).
Exceptions and exemptions to this regulation are contemplated, in particular the veto on mercury is notapplied to compact fluorescent lamps and fluorescent tubes containing mercury in quantities notexceeding the allowed limits. WEEE DIRECTIVE 2002/96/ECThe quantity of waste derived from electrical and electronic equipment (WEEE) is increasingly rapidly anda large part consists of light sources (excluding incandescent filament lamps).The main objective of the directive is to prevent WEEE thrown, at the end of their working life, into landfillor incinerators, causing a further serious impact on the environment. Directive 2002/96/EC has therefore sought to introduce a control mechanism which envisages acontrolled management of the device at the end of its working life, to encourage its reuse or recycling.The legislative mechanism also promotes design and production concepts that make product disposaleasier, in terms of both disassembly and materials.In the case of lamps, the financing of activities connected to the collection, management and recyclingof WEEE at the end of their working life is guaranteed by a visible fee applied at the moment of sale.
All passages in the commercial chain are required to make a contribution, some in economic terms, somein terms of activity, to ensure that the spirit of the directive is respected (and the environment isprotected).
In Italy the directive was acknowledged with decree 151 of 25 July 2005 and subsequently integrated inother implementing decrees.
THESE ARE THE PRINCIPAL OBLIGATIONS ENVISAGEDThe producer (understood in the broad sense and therefore substantially whoever applies his brand onthe goods and who imports from another country) is responsible for the costs of disposal of his productsat the end of their working life.The sales outlet is required to collect the product at the end of its working life if it replaced by a new oneof the same kind.The consumer is required to manage the item sensibly at the end of its life, consigning it to an equippedcollection point, a sales area, or following the manufacturer’s indications.
Beghelli has always been aware of the environmental problem and is one of the founder members of theECOLIGHT consortium, to which the company consigns all the collected visible contribution.
Choosing products and companies that rely on voluntary consortiums for the recovery and recycling ofproducts is a responsible and ecologically correct choice for the protection of the environment and for ourfuture.

General terms of sale
Beghelli products are manufactured to state-of-the-art standards in terms of safety, in compliance with therequirements of laws 186/68 and 791/77, and do not compromise the safety of persons, pets or property,if installed and used according to their intended purpose and correctly fitted. Moreover, the products thatfall within the field of application of the EEC Directives (“EMC” Directive 89/336/EEC - acknowledged withLaw Decree 476/92 - amended by Directive 93/68/EEC and the “BT” Directive 73/23/EEC - acknowledgedwith Law 791/77 - amended by Directive 93/68/EEC) comply with the essential requirements containedtherein. The CE mark applied on the product and/or on the packaging and/or on any warnings for use thataccompany the product “indicates presumed conformity with the Directives” mentioned above. Beghellikeeps a Technical Archive, at the disposal of the competent authorities for any inspections, containing thedocumentation demonstrating that the produce has been examined to assess its conformity.

1. ORDERS - FINALIZATION OF AGREEMENTSProduct purchase orders must be made in writing. Placing of an order is considered irrevocable. TheSeller reserves the faculty to fulfil orders also in part, or to cancel them, even any residual part, in theevent of a change of the situation of the Buyer. All collaboration programmes, orders, commissions andagreements are intended as finalized with the written or verbal confirmation by the Seller, or at any ratewith the start of invoicing and/or delivery of the products ordered.
2. VARIATIONS AND MODIFICATIONSAfter finalization of the order, any modification or integration of the content and terms of the order shallbe valid and become effective only when the Seller sends the Buyer a variation of the confirmation. Thetext of the confirmation or of the variation of the confirmation by the Seller shall prevail in any case overany other document.Should the Buyer not wish to accept the terms that differ from his order, he must point it out within 20(twenty) days of the date of confirmation, otherwise the variation of confirmation shall be deemedaccepted in full.
3. ACCEPTANCE PROCEDUREThe Seller cannot be held liable for non acceptance of an order, or for non delivery or delayed delivery ofthe products ordered. The acceptance and execution of the order are specifically subordinate to theavailability of the products ordered and to the absence of circumstances that could in any way influencetheir availability and the promptness of their delivery.
4. DELIVERY TERMSThe delivery terms communicated by the Seller are purely indicative.The delivery terms expressed in days are normally calculated in working days.Any modifications to the delivery terms requested by the Buyer must be accepted in writing by the Seller.Any delays in delivery, and any interruptions and/or total or partial suspensions of delivery, even if notdue to force majeure and/or act of providence, shall not entitle the Buyer to claim a refund for damagesand/or compensation of any kind nor even interest; the Buyer shall have the sole faculty to cancel theorder upon written notice to the Seller of at least thirty days counted from the date of receipt of theregistered letter with recorded delivery sent by the Buyer.
5. FORCE MAJEUREWithout limitation, the following are to be considered causes of force majeure: strikes, lockouts, rebellion,labour conflicts, fire, natural calamities, impossibility to provision products, interruptions or difficulties intransport, delayed deliveries, lack of raw materials, actions of the government and authorities, failure ofsuppliers and, in general, any unforeseeable event which cannot be reasonably considered to be underthe control of the Seller. In all such cases, as in the event of act of providence, the Seller reserves thefaculty to suspend and/or delay the delivery of the products and even to cancel the orders, even if alreadyconfirmed, without this entitling the Buyer to claim a refund from the Seller for damages and/orcompensation of any kind, including direct, indirect and consequential damage.
6. DELIVERY - TRANSPORTThe goods always travel at the Buyer’s own risk, even when sent carriage paid and/or with the Seller’svehicle, so the Seller shall not accept any complaints for any breakages and/or tampering with theproducts. Delivery of the products is considered made from the headquarters of the Seller at Monteveglio(Bologna). Transport expenses are borne by the Buyer. The Seller does not accept returned packaging.
7. COMPLAINTS - REPLACEMENT OF PRODUCTSFor replacements and complaints the safeguards contemplated by the law are applied, applicable to thespecific type of customer, professional operator or consumer. As soon as the products are received, theBuyer is required to check the condition, the quantity of the supply and to ensure that it corresponds tothe delivery note. Any complaints concerning quality, quantity or type of product must be made in writingwithin 8 (eight) days of the date of receipt of the goods. Once that time has expired, and without prejudiceto the various guarantee conditions envisaged for the individual products, no complaint can be maderegarding the substance and quality of the goods, or for their general conditions. The Buyer may for noreason return the products without prior authorization of the Seller in writing, nor delay and/or totally orpartially suspend payment of the invoices, not even in the case of complaints. Should there be groundsfor the complaint, in the Seller’s opinion, and if it has been made within the guarantee terms indicated inthe illustrative booklets that accompany the individual products, the guarantee obligation is limited to thesimple replacement of the non conforming product according to the delivery procedures of the firstsupply. Any right of the Buyer to cancel the order or to obtain any refund for expenses and/or damagesis therefore excluded. The right to replacement of the disputed product expires if the product is not keptdiligently, at the Seller’s disposal, and immediately returned to the place established by the Seller.
8. PRICESThe prices indicated in the Seller’s price lists are not binding, consequently the Seller reserves the rightto modify them until the time of delivery of the products.The prices are net of VAT and of any other fiscal dues.
9. PAYMENTSAll payments must be made at the times and with the methods indicated by the Seller to the latter’sheadquarters at Monteveglio (Bologna) or to the person indicated and duly authorized in writing by theSeller. In the case of a delay in payment, the defaulting buyer shall be required to pay the Seller interestfor arrears from the due date of the contractual term until the date of settlement, according to the prime-rate in force at the time (as determined by the Italian Banking Association - ABI) plus 5 (five) points,without prejudice to claims for further loss. Failure by the Buyer to respect the terms of payment shallentitle the Seller to terminate the respective supply contract with immediate effect and to suspenddelivery of all products that may be ordered without the need for any communication, with the consequentright for the Seller to demand the immediate payment of the entire credit and to take action for thecompensation of damage suffered.
10. LIEN AGREEMENTThe products are sold under a lien agreement; they shall therefore remain the property of the Seller untilfull payment has been made. The Buyer therefore undertakes to inform third parties of the existence and efficacy of this lienagreement, and to safeguard the Seller’s rights deriving therefrom.
11. COMPETENT COURTFor any controversy or dispute concerning the interpretation, validity and execution of the order, orconnected in any way to the contracts to which these general terms of sale apply, the exclusivecompetent court shall be the Court of Bologna.
