WHEREAS, The City Government has embarked on a project of building a new
Laoag City Public Market and Commercial Complex to ensure the delivery of services to its
constituents;
WHEREAS, City Ordinance No. 1535, series of 1988 entitled “The Revenue Code of
Laoag City”, enacted pursuant to Section 18 of R. A. 7160, was amended by City Ordinance No.
1914, series of 1993 (Tax Ordinance No. 93-001) in which the Market and Slaughterhouse Code
was made an integral part thereof;
WHEREAS, there is a need to enact a separate, codified and upgraded Market and
Slaughterhouse Code for purposes of administrative facility and simplification of implementation
of pertinent revenue measures;
WHEREFORE, upon joint motion of Hon. Shirley Ong Sin, Hon. Michael V. Fariñas,
Hon. Victor U. Aguilar, and Hon. Edison H. Bonoan, duly seconded by Hon. Jose Antonio F.
Pastor, the Body, with members present

AN ORDINANCE ENACTING THE MARKET AND
SLAUGHTERHOUSE CODE OF LAOAG CITY
BE IT ENACTED THAT:
CHAPTER 1 - GENERAL PROVISIONS
Article I - SHORT TITLE AND SCOPE
Section 1. Short Title – This Ordinance shall be known as the “1998 Public Market and
Slaughterhouse Code of Laoag City”.
Section 2. Scope – This Ordinance shall govern the administration of the Public Market of
the City of Laoag including the adjudication of newly created stalls and other vacant spaces
for rent at the Laoag City Commercial Complex, the levy, assessment and collection of
market fees, rentals, charges and other impositions, in accordance with the provisions of RA
7160 and the rules and regulations promulgated by the Department of Finance as far as they
apply to the Laoag City Public Market.
Article II - DEFINITIONS AND RULES OF CONSTRUCTION
Section 3. Definition of Terms and Phrases as used in this Code
a) Agricultural Product – shall include the yield of the soil such as corn, rice, wheat, rye,
hay, coconut, sugarcane, tobacco, root crops, vegetables, fruits, flowers, etc. and their by-
products, ordinary salt, all kinds of fish, poultry and livestock and animal products,
whether in their original form or when produced in a more convenient and marketable
form through the simple processes of freezing, drying, salting, smoking and stripping.
b) Ice Cold Fish – refers to all kinds of fish that are preserved through the process of
refrigeration or the use of cracked ice.
c) Bañera – shall be understood to mean that container made of welded GI sheet, big if
the diameter is 16 inches and 10 inches in height; small if the diameter is 10 inches in
diameter and 10 inches in height.
d) Basket – shall be understood to mean any of, but not limited to, the following:
1) Beans Basket – shall refer to that kind of basket made of Buko (bolo) splits usually
used to pack beans;

2) Kapangan Basket – or large tiklis – shall refer to any kind of basket made
of woven bamboo/rattan splits with 28 inches in diameter and 24 inches in height.
3) La Union Basket or regular tiklis – shall refer to any kind of basket made of woven
bamboo or rattan splits with 20 inches in diameter and 15 inches in height. This
includes the Laga.
4) Manila Basket – shall refer to that kind of basket made of buko (bolo) splits
usually used to pack cabbage, wombok, etc.
5) Bay-ong – shall refer to any container made of woven silag leaves; large if the flat
measurement has a length of 22 inches and a width of 20 inches; others will be
considered as small.
e) Batya – shall be understood to mean that container made of welded GI sheet with a
capacity of about five (5) gantas.
f) Bundles – shall be understood as follows: Large if the diameter is more than one foot;
medium if the diameter is one foot; and small if the diameter is less than one foot of
vegetables or any kind flowers.
g) Can – shall to an empty kerosene can with a capacity of 19 liters.
h) Carinderia – refers to any public eating place where food already cooked are served
for eating at a price;
i) Charges – refers to pecuniary liability, as rents or fee against property or persons.
j) Delinquency – shall mean, for purposes of this Ordinance, the failure, whether
deliberate or not, to pay charges due within the time prescribed in this Ordinance.
k) Farm-to-Market Products – fresh Agricultural Products that come from the
farms/countryside/barangays usually displayed and sold by Farmers/Open Market Sellers
during Open Market Days such as food items, household items, pottery, tools, “bolos”
and knives, handicraft, bamboocraft, earthen products, etc. except livestock.
l) Ganta/Salop – a term of volumetric measurement equivalent to 1/25th
of a cavan
usually used to measure rice, cereals, mongo, small fish, etc. The average weight of one
(1) Ganta/Salop of rice is 2.4 kilos.
m) Market Premises – refers to the open space within the Public Market, its compound,
and parts of the market lot consisting of bare grounds not covered by market buildings,
occupied by Vendors or Stallholders.
n) Open Market Seller – a person who is not a Stallholder who sells his goods and
services during Open Market Days, is assigned and occupies a space within the area
designated as Open Market, and whose goods are subject to the Market Entrance Fees.
o) Person – means every physical or moral, real or juridical, and legal being, susceptible
of rights and obligations or of being the subject of legal relations.
p) Public Market – refers to the Laoag City Public Market and Commercial Complex, or
the building or structure constructed as such.
q) Red Bag – shall be understood to mean that sack with red color made of abaca fibers
used usually to pack potatoes.
r) Rental – means the value of the consideration, whether in money or otherwise, given
for the enjoyment or use of a thing.
s) Sack – Locally known as sako, shall be understood to refer to one with a capacity of
twenty-five (25) gantas.
t) Sack Double – refers to a jute sack, which has a capacity of fifty gantas of rice.
u) Stall – refers to any allotted space or booth in the Public Market where merchandise of
any kind is sold or offered for sale.

v) Stallholder – a person to whom a Stall has been accordingly awarded as a result
of the approval of his Application to Lease and has entered into a Contract of Lease with
the City Government for purposes of selling goods or services in the Public Market. This
term shall be used interchangeably with Vendor, Awardee, Lessee, Stall Owner, or Mall
Operator.
w) Travelling/Ambulant Vendor/Peddler – a person who sells goods or offers to sell and
delivers the same from place to place within the City. He/She is not a Stallholder.
x) Tampipi – shall be understood to mean that container made of fine bamboo or rattan
splits which has a cover made just like itself and large enough to fully cover its inner part.
y) Tiklis – shall mean that container made of woven bamboo or rattan splits. It is either
large if the capacity is about two sacks or more or small if the capacity is less than two
sacks. Also called Cain/Kaing.
Section 4. Rules of Construction – In construing the provisions of this Code, the following
rules of construction shall be observed unless otherwise inconsistent with the manifest intent
of the said provisions.
a) General Rule – All words and phrases shall be construed and understood according to
the common and approved usage of the language but technical words and phrases and
such other words which may have acquired a peculiar or appropriate meaning in the Code
shall be construed and understood according to such technical, peculiar or appropriate
meaning;
b) Gender and Number – Every word in the Code importing the masculine gender shall
extend to both male and female. Every word importing the singular number shall extend
and apply to several persons and things as well;
c) Reasonable Time – In all cases where any act is required to be done within a
reasonable time, the same shall be deemed to mean such time as may be necessary for the
prompt performance of the act;
d) Computation of time – The time within which any act is required to be done as
provided in this Code or in any rule and regulations issued pursuant to the provisions
thereof, when expressed in days shall be computed by excluding the first day and
including the last day, except when the last day falls on a Sunday or Holiday in which
case, the same shall be excluded from the computation; and the following business day
shall be considered as the last day;
e) Conflicting provisions of chapters or articles – If the provisions of different chapters or
articles conflict with or contravene each other, the provisions of each chapter or article
shall prevail as to all specific matters and questions involved therein.
f) Words and phrases embodied in this Code not herein specifically defined shall have the
same definitions as found in PD 231 as amended; otherwise known as the Local Tax
Code, PD 464 as amended, otherwise known as the Real Property Tax Code, and RA
7160, otherwise known as the Local Government Code of 1991, as the case may be.
CHAPTER 2
Article I - THE MARKET
Section 5. The Laoag City Public Market and Commercial Complex - Until such time
when other Public markets shall be established by the City of Laoag, the Laoag City Public
Market and Commercial Complex herein referred to is situated in Cadastral Lot No. 9445
owned by the City of Laoag, which is more particularly described as follows: Bounded on the
North by Rizal Street; on the South by A. Bonifacio Street; on the East by L. Abadilla Street;
on the West by Gov. Villanueva Street, in Barangay 16, San Jacinto, Laoag City.
Section 6. Market Stall - shall refer to any allotted space, stand, compartment, store or any
place wherein merchandise is sold, offered for sale, or is intended for such purposes in the
public market. The numbering, designation, or other forms or identification of those stalls

shall be made in accordance with the standard plan recommended and approved by
the Market Committee.
Section 7. Market Sections - Market sections shall be known as the classification of stalls
according to the merchandise or services offered for sale therein. The sale of merchandise
pertaining to one section shall not be allowed in another section, provided, that the City
Mayor, for the good of the public, may grant temporary permit not to exceed thirty (30) days,
to sell merchandise pertaining to one section in another section until after said public good
shall have been satisfied; provided that this power shall be exercised with utmost prudence.
Section 8. Classification of Market Sections - The following shall be the general
classification of market sections:

Section 9. Sectional Classification of Goods and Services
a) Dry Goods Section – Section of the Market where the goods sold include all kinds of
textiles, ready-made dresses and apparels, toiletries, novelties, shoes, laces, kitchenware,
utensils, and other household articles such as handbags, bags, school and office supplies.
b) Grocery Section - Section of the Market where the goods sold include all kinds of
cakes, biscuits, crackers, etc., butter, cheese, confectioneries, candies, canned or bottled
foods, beverages, soft drinks, mineral water, flour, rice, oatmeal, ham, bacon, sugar, nuts,
sauce, onions, garlic, potatoes, except leafy vegetables, eggs, toilet articles, sausages,
corn, mongo, starch, smoked fish, dried fish, salt, soap and other household and food
products, including firewood and charcoal.
c) Meat Section - Section of the Market where the goods sold include all kinds of meat
including Poultry Products such as Chicken, duck, bird, except that of carabao and
horsemeat which shall have a separate and distinct compartment from that of beef and
pork.
d) Fish Section - Section of the Market where the goods sold include fresh fish, clams,
oysters, crabs, lobsters, shrimps, seaweeds, and other seafood and marine products.
e) Vegetable Section - Section of the Market where the goods sold include all kinds of
vegetables and fruits, root crops such as camote, cassava, and the like.

f) Fruits Section - Section of the Market where the goods sold include fruits
whether imported or locally produced.
g) Carinderia/Fastfood Section - Section of the Market where the services for sale include
Carinderia, food houses, and other places where refreshments and food is cooked or
prepared, served, and consumed.
h) Service Outlets/Specialty/Shops Section - Section of the Market where services for
sale include Beauty Parlors, Dental Clinics, Offices, Shoe Repair Shops, Dress Shops,
Barber Shops, and similar services/establishments.
i) Basement Dry Goods Section – Section of the Market where the goods sold include
rice, tobacco, Bagoong, Molasses, Suka, Basi, Charcoal, Hardware, Toy Balloons,
Household Plastic/Aluminum Wares/Glassware, Handicraft, Flowers, etc.
j) Mall Section – Large sections of the Market identified in the Floor Plan as BC1-BC3,
1C1-1C4, 2C1-2C3, 3C1-3C3, the letter “C” representing the word “Commercial”, which
may be leased by one or more persons/entities.
The above described Sections shall be assigned by the Market Committee in the different
areas of the Public Market consistent with Section 8 hereof and taking into consideration
each section’s peculiar needs including considerations of safety and protection.
Section 10. Administration of Public Markets - Unless otherwise provided by law, the City
Mayor shall exercise direct and immediate supervision and control over public markets,
including its extensions, in accordance with this City Ordinance including Resolutions,
Ordinances, Rules and Regulations yet to be promulgated and as provided for by the Charter
of the City of Laoag. He shall have direct administration, control, and supervision over
market personnel in charge of collection including those whose duties concern the
maintenance of sanitary conditions in the market including its premises.
Section 11. Market Superintendent - There shall be one Market Superintendent who shall
be in charge of the Public Market. He shall be the custodian of all properties belonging to the
market and have immediate administrative supervision and control over all subordinate
market employees thereat. The Market Superintendent and his subordinates shall see to it that
all Stallholders and Open Market Sellers are provided with the corresponding regular and
special tickets for the goods/commodities or space they occupy, as the case maybe, on any
particular day and that occupant of stalls or booths of various sections shall pay the rent due
for the area and occupation thereof for the current months. He shall see to it that the market is
efficiently operated and that all subordinate market personnel assigned to him perform their
duties properly.
Section 12. Chief Market Collector - There shall be a Chief Market Collector who, under
the supervision and control of the City Treasurer or authorized representative, shall take
charge of the distribution of work and the proper performance of collection work by the
market collectors under him, and the strict adherence to the rules governing the collection of
fees, licenses and other dues from persons engaged in business in the market and
slaughterhouse.
Section 13. Market Inspector - There shall be a Market Inspector who shall make
inspection of cash tickets issued to Stallholders and make reports to the said Market
Superintendent or his authorized representative for instruction on his work assignment and
submission of report.
Section 14. Uniform Wearing – The Market Superintendent, including all employees of the
Supermarket, shall wear uniforms and pin their Identification Card while on duty for easy
identification.
Section 15. Carriers (Cargadores) or Porters. No person shall engage in the calling of a
Carrier in the public market unless he is a Filipino citizen, of good moral character and
registered as such in the Office of the Market Superintendent, pay the corresponding
occupation fee at the Office of the City Treasurer and has not been convicted of any crime
against property. Each carrier shall be provided by the City Treasurer with Registration

Certificate and a numbered plastic badge, which shall be worn conspicuously while
working as carrier.
For the issuance of plastic badge, the City Treasurer shall collect a reasonable amount
as maybe necessary to cover the actual cost thereof. The City Treasurer shall have the power
to fix the number of carriers upon recommendation of the Market Superintendent certifying
the need of the market for such number of carriers. Any registered Carrier convicted of crime
against property subsequent to his registration shall be dropped from the list of carriers kept
in the Office of the City Treasurer.
No employer-employee relationship shall exist between the Carrier and the City
Government.
Section 16. Business Hours in the Public Market - The Official hours of business in the
Public market shall be from 4:00 o’clock in the morning through 9:00 o’clock in the evening
daily, except during “Ipon” Season when an extension of up to 10:00 o’clock in the evening
shall be allowed. The opening and closing of business hours in the Public Market shall be
announced by means of the ringing of a bell to be installed thereat, which bell shall be under
the direct responsibility of the Market Superintendent and ringing thereof shall be under the
responsibility of the supervising Market Laborer, provided, that the bell shall be rung by way
of warning about thirty (30) minutes before closing time in the evening. After the closing
bell, no person shall be allowed within the market premises, except duly authorized persons.
Section 17. Open Market Days – Open Market Days shall be on Wednesdays and Sundays
only with the following conditions:
a) The Basement Parking Area shall be used as the Open Market Area. No vehicle shall
be allowed inside the Basement Floor on these days. The surrounding streets shall not be
used to display goods.
b) Only Farm-to-Market Products shall be displayed and sold in the Open Market Area
and only Producers/Farmers/Open Market Sellers who are not Stallholders shall sell in
the Open Market Area.
c) Open Market shall be until 3:00 p.m. only. Failure to vacate the area shall be a
violation of this Ordinance.
d) All sellers in the Open Market Area shall see to it that the spaces they occupied are
cleaned after use.
e) No Stallholder or their representive/dummy shall be allowed to sell their goods in the
Open market Area at any time.
Section 18. Prohibition of Taking Up Residence in the Market - No person shall be
allowed to live or otherwise take up residence in the market. Any violation of this provision
shall be sufficient ground for cancellation of Contract of Lease.
Section 19. Manner of Displaying Article for Sale - All articles for sale in the market shall
be displayed in such a manner that they will be sanitary, clean and free from contamination.
Section 20. Sale and Displaying of Article for Sale - All articles displayed in the market,
whether they are for sale or not, or are offered directly for sale or not, shall for all intents and
purposes be considered for sale and shall pay the corresponding market fees provided for in
this Ordinance.
Article II - STALLHOLDERS
Section 21. - Classification of Stallholders/Vendors Inside the Market - The
Stallholders/Vendors shall be grouped into different classifications in accordance with the
goods, or merchandise sold as follows:
a) Dry Goods Vendors
b) Grocery Vendors
c) Food Vendors
d) Poultry Products Vendors

Section 22. Duties of Stallholders/Vendors who are under Contract of Lease – All
Stallholders/Vendors who are under a Contract of Lease shall have the following duties:
a) Stallholder/Vendor shall at all times have his/her picture and that of his/her helper
displayed.
b) Stallholder/Vendor shall keep the stall at all times in good sanitary condition and
comply strictly with all sanitary and market rules and regulations now existing or which
may hereafter be promulgated.
c) Stallholder/Vendor shall pay the corresponding rents for the stall in the manner
prescribed by this Ordinance.
d) The business to be conducted in the stall shall be one that is considered a legitimate
trade, and shall exclusively belong to the Stallholder/Vendor.
e) In the event that Stallholder/Vendor engages the services of helpers,
Stallholder/Vendor shall nevertheless personally conduct the business and be present in
the stall. Stallholder/Vendor shall promptly notify the market authorities of his/her
absence, giving his/her reason/s therefor.
f) Stallholder/Vendor shall not sell or transfer any privileges over the stall or otherwise
permit another person to conduct business therein.
g) Occupying any other place of the market, regardless of the day of the week, aside from
that which a Stallholder is paying for and which he/she has been awarded shall constitute
a violation of this Ordinance and shall be, upon the discretion of the Court, subject to the
following schedule of penalties:
1) 1st Offense – a fine of Three Hundred Pesos (P300.00)
2) 2nd
Offense – a fine of Five Hundred Pesos (P500.00)
3) 3rd
Offense – a fine of One Thousand Pesos (P1,000.00) and Cancellation of
Offender’s Contract of Lease
Section 23. Duties of Stallholders/Open Market Sellers Whose Articles or Merchandise
For Sale are Subject to the Market Entrance fees - All Stallholders/Open Market Sellers
or persons whose articles or merchandise for sale are subject to the Market Entrance Fees,
shall have the following duties:
a) It shall be the duty of concerned Stallholders/Open Market Sellers to show to the
Market Collector that all corresponding Market Entrance fees of the articles or
merchandise they offer for sale have been paid for in accordance with the provisions of
this Ordinance.
b) Stallholders/Open Market Sellers in the market offering for sale different classes or
kinds of merchandise classified by type of goods with distinct rates and fees shall be duty
bound to pay separate Market Entrance Fees for each kind of article or merchandise.
c) All concerned Stallholders/Open Market Sellers shall see to it that the Market
Collector has issued the appropriate receipt or cash tickets corresponding to the amount
of Market Entrance Fees paid. The receipt or cash tickets of Market Entrance Fees shall
be preserved and be made ready for inspection during market hours. If the market
collectors shall fail to issue receipts or cash tickets corresponding to the amount paid, it
shall be the duty of the Stallholder/Open Market Seller to report the matter immediately
to the Market Inspector, Market Superintendent, or the City Treasurer. All

Stallholders/Open Market Sellers shall display in conspicuous place the receipts
or cash tickets issued for their market fees.
Section 24. Duties of Market Collectors - All Market Collectors must accurately assess the
market fees of the goods/merchandise of every vendor in accordance with the prescribed
market fees herein provided and issue the corresponding cash tickets or official receipt as the
case maybe.
All collectors must remit their collections during the day to the liquidating officer
before the end of the day and any violation hereof shall be meted the penalty imposed under
RA 3019 Anti Graft and Corrupt Practices Law.

Section 26. Who Pays Rentals – All Stallholders whose Application to Lease a Market Stall
have been duly approved, executed a Contract of Lease, and who have been consequently
awarded a Stall, regardless of the types of goods to be sold, shall pay the Stall Rates
prescribed in this Ordinance.
Section 27. Time for Payment of Rentals - The rentals for stall or booths fixed in the
preceding section shall be payable to the City Treasurer in advance within the first twenty
(20) days of every month.
Section 28. Surcharges and Interest for Late Payment - If the rental is not paid within the
time fixed herein the Stallholder shall pay a surcharge of twenty five (25%) percent of the
rental due plus interest of twenty four (24%) percent per annum from the date they become
due until same is fully paid.
Delinquency in the payment of market rentals shall be sufficient cause for the
cancellation of rights and lease contracts for the occupancy of the stall or booth.
Article II - MARKET ENTRANCE FEES
Section 29. A Market Entrance Fee is hereby imposed on all commodities or merchandise
herein identified/classified which is being brought into the public market for sale on the basis
of measurement herein indicated, or any other convenient unit of measurement, at the rates
herein indicated:

classification as those items of which they have a familiar likeness, or similarity of
characteristic.
Likewise, all other containers not included herein shall also fall under the same
classification as that of other containers which may be more or less of the same size, the
same value of the goods contained or the same bulk or volume.
Section 30. Non-Classified Items – Stallholders/Vendors who, in the process of replenishing
their stocks, bring in items or merchandise not classified under the preceding provisions
which more or less belong to the Dry Goods/Groceries type of goods shall not pay the market
entrance fees.
Section 31. Payment of Market Fees - The market fees assessable and collectable pursuant
to Section 25, this Chapter, shall be paid in advance before any person can sell, or offer to
sell any commodity or merchandise within the public market and its premises.
Section 32. Cash Tickets/Official Receipts - The market fees shall be acknowledged
through the issuance of cash tickets or official receipts. The cash tickets issued shall bear the
stamp of the City Market, date of issue, and signature or initials of the market collectors
issuing the same, and shall be good only for the space or spaces of the market premises to
which they are assigned while in the possession of the original purchaser.
If the vendor disposes his merchandise by wholesale to another vendor, the latter shall
be issued another cash ticket if he desires to sell the same merchandise in the market even if
their transaction is done in the same place occupied by the previous vendor.
Section 33. Penalty for Non-Payment of Market fees - Any vendor found selling without
any cash tickets or receipt shall pay a penalty of thrice as much as the required market fees.
And any vendor found to have concealed his goods or merchandise just to evade the payment
of higher market fees shall pay a penalty of twice much as the required fees.
Any vendor who fails to present his or her receipt or cash tickets in the course of
inspection by the market inspector shall be presumed to be selling without first paying the
required Market Entrance Fees.

Section 34. Penalty for Under-collection of Market Fees and Non-issuance of
Cash Tickets or Receipts - Any collector who is found to have issued cash tickets or
receipts much lesser than the required market fees or have collected the market fees but
failed to issue cash tickets or receipt shall be administratively and/or criminally liable.
Article III - APPLICATION TO LEASE AND ADJUDICATION OF VACANT STALLS
Section 35. Adjudication of Vacant Stalls/Vacated Stalls and Newly Constructed Stalls
- Vacant market stalls/booths shall be adjudicated to qualified applicants in the following
manner:
a) Notice of vacancy of vacant or newly constructed stalls or booths, shall be made for a
period of not less than ten (10) days immediately preceding the date fixed for the award
to qualified applicants to apprise the public of the fact that such stalls or booths are NOT
occupied and available for lease. Such notice shall be posted conspicuously on the
unoccupied stall or booth and the bulletin board of the market. The notice of vacancy
shall be in the following FORM:

COMPLEX is vacant or will be vacated on

this Stall/Booth; shall file an application therefor on the prescribed
form (copies maybe obtained from the Office of the City Treasurer
during office hours and before 12:00 o’ clock noon of
__________, 19___ ). In case there are more than one applicant,
the award of the lease of the vacant stall/booth shall be determined
through the drawing of lots to be conducted on __________,
19___, at 12:00 o’clock noon at the Office of the City Treasurer by
the Market Committee. This stall/booth is found in the

Treasurer by the applicant in person accompanied by two copies of his/her latest picture.
c) It shall be the duty of the City Treasurer to keep a register book showing the names

booth/stall applied for by them, and the date and hour of the receipt by the Treasurer of
each application. It shall be also the duty of the Treasurer to acknowledge receipt of the
application setting forth therein the time and date of receipt thereon.

e) Applicants who are Filipino citizens shall have preference in the lease of public market
stalls. If on the last day set for filing applications, and there is no application from a
Filipino citizen, the posting of the Notice of Vacancy prescribed in the foregoing shall be
repeated for another ten (10) day period. If after the expiration of that period and there is
still no Filipino citizen applicant, the stall affected may be leased to any alien applicant
who first filed his application. If there are several alien applications already filed, the
adjudication of the stall shall be made through the drawing of lots to be conducted by the
Market Committee. In case there is only one Filipino applicant, the stall or booth applied
for shall be adjudicated to this applicant. If there are several Filipino applicants for the
same stall, adjudication of the stall shall be made through the drawing of lots to be
conducted by the Market Committee on the date and hour specified in the Notice. The
result of the drawing of lots shall be reported immediately by the Market Committee to
the City Treasurer for appropriate action.
f) The Certificate of Award shall be displayed conspicuously inside the stall.
Section 36. Number of Stalls to One Person Not to Exceed Two - No person shall be
allowed to lease more than two stalls, provided, that these two stalls leased to that one person
shall adjoin one another and shall be located in the same section of the market and provided,
further, that it shall be a violation of this section for more than one member of a family
consisting of the father, sons and daughters to hold stalls in the public market unless those

sons and daughters are already married and with families of their own to support, or
when they are already by themselves independent from their mother and father.
Section 37. Vacancy of Stall Before Expiration of the Lease – Should, for any reason, a
stall holder or lessee discontinue or be required to discontinue his business before his lease
expires, such stall shall be considered vacant and its occupancy thereafter shall be disposed
of in the manner prescribed herein.
Section 38. Partnership with Stall Holder - A Market stall holder who enters into a
business partnership with any party after he had acquired the right to lease has no authority to
transfer to his partner or partners the right to occupy the stall; provided, however, that in case
of death or any legal disability of such stall holder to continue his business, the surviving
partner maybe authorized to continue occupying the stall of the business of the partnership. If
the surviving partner is otherwise qualified to occupy a market stall under the provision
hereof, and the spouse, parent, son, daughter or relative within the third degree of
consanguinity or affinity of the former stall holder is not applying for the stall, the partner
shall be given the preference to continue occupying the stall or booth concerned, if he applies
therefor.
Section 39. Assignment of Occupied Stall
a) No person shall sell, offer for sale or expose for sale any article or articles in the public
market or use or occupy any stall without first having been assigned to such stall in the
manner prescribed in this Ordinance. Residents of the City of Laoag shall be given
preference in the occupancy or lease of stalls over non-residents unless there are no
resident applicants at the time of awarding of stalls.
b) Vendors shall be assigned a stall according to the nature of the merchandise intended
for sale consistent with the standard plan containing the unit identification as reflected in
Section 8, Section 9, and Section 25 of this Ordinance.
c) Dwelling in stalls or any place within the market premises is strictly prohibited.
d) Any person other than the Stallholder or his partner or his registered helper found
conducting business at the Stallholder’s stall shall be required to pay rent in addition to
the corresponding rents collected from the regular holder of the lease; provided, that the
payment of such additional rents shall not waive the rights of the market authorities to
impose whatever penalties be levied upon the lessee for the violation of this provision
including the revocation of lease.
Section 40. Lessee to Personally Administer his Stall - Any person who has been awarded
the right to lease a market stall in accordance with the provisions hereof, shall occupy,
administer and be present personally at his stall or stalls; provided, however, that he may
employ helpers who must be citizens of the Philippines, including but not limited to the
spouse, parents and children of the stall holder who are actually living with him and who are
not disqualified under the provisions hereof; and provided further, that the persons to be
employed as helpers shall under no circumstance be persons with whom the stall holder has
any commercial relation or transaction.
Section 41. Sub-leasing of Privileges to Occupy Stall Prohibited - No Awardee shall
sublet or sublease the stall so awarded nor shall any privilege acquired be sold. Any person
other than the Stallholder, or his partner, or his registered helper, found selling in the
Awardee’s stall is a prima facie evidence of sub-leasing and shall subject the
Stallholder/Awardee to outright revocation of his award.
Section 42. Appeals - Any applicant who is not satisfied with the adjudication made by the
City Treasurer or the Market Committee of the stall applied for by him may file with the City
Mayor an appeal and the decision of the City Mayor in such case shall be final.
Section 43. The Market Committee - There is hereby created a Market Committee whose
duty shall be to conduct the drawing of lots and opening of bids in connection with the
adjudication of vacant or newly constructed stalls or booths in the public market of Laoag
City.

The Market Committee shall be composed of the City Treasurer, as Chairman,
with members as follows:
a) A representative of the City Mayor,
b) A representative of the Sangguniang Panlungsod,
c) A representative of the City Attorney or a representative of the City Prosecutor,
d) Members of the Local Finance Committee,
e) And a representative of the Market Vendors Association appointed by the City Mayor
Section 44. Payment of Deposit Upon Award of Market Stalls or Booths - An Awardee
for the occupancy of a market stall or booth in the City Market shall deposit with the City
Treasurer an amount equivalent to the rental of the stall for one (1) month upon award. The
amount deposited shall be applied as payment of rentals due thereon, only upon termination
of the Contract of Lease.
Section 45. Contract of Lease - All Awardees for the occupancy of stalls in the City Market
shall enter into a Contract of Lease with the City Government of Laoag to complete their
privilege of occupying the stall awarded in their favor. The contract of lease shall be
executed annually to cover the period from January 1 to December 31; provided, that the
initial contract shall cover the period from the date of award until December 31.
Article IV - OTHER PROVISIONS
Section 46. Travelling/Ambulant Vendors/Peddlers - It shall be prohibited for
Travelling/Ambulant Vendors/Peddlers to sell merchandise in any part of the Market.
Further, it shall be also prohibited for any Stallholder to sell his or her merchandise outside
of his designated Stall/space in the market at any day.
Section 47. Begging and Soliciting Contributions - It shall be prohibited to beg or solicit
contributions in the Public market.
Section 48. Health of Vendors and their Employees - It shall be prohibited for any person
who is sick of a contagious disease to sell in the market or to act as an employee of any
vendor thereat. The City Health Officer shall prescribe the necessary rules and regulations
implementing the provisions of this section.
Section 49. Prevention of Employees to Execute their Duties - No person shall resist,
obstruct, or put any obstacle to prevent the employees of the market in the performance of
their duties. Anyone found resisting, obstructing or putting any obstacle with the view of
preventing the employees from discharging their duties shall be punished with a fine of Two
Hundred (P200) Pesos or imprisonment for two (2) days or both upon the discretion of the
court.
Section 50. Peace and Order in the Market and its Premises - It shall be the duty of the
Philippine National Police (PNP), Laoag City Station to maintain peace and order in the City
Market and its premises and shall assist the market employees in the enforcement of the
provisions of this Ordinance and the rules and regulations pertaining to administration of the
market.
Section 51. Responsibility for Loss or Damages Incurred by Vendors in the Market -
The City of Laoag or its officials and employees shall not be responsible for any damages or
losses incurred in any occupant of market stalls or Vendors in the Public Market by reason of
theft, fire, robbery or any other causes occasioned by the enforcement of rules and
regulations governing the market. The care of articles of trade or merchandise in the market
stall shall be the sole responsibility of the Stallholders/Vendors concerned.
Section 52. Construction or Improvements in the City Public Market - Construction or
improvements may be introduced in the stall/booth/space upon the authority of the City
Government of Laoag, provided, that all construction or improvement shall be temporary,
and provided further that all such construction or improvement shall ipso facto become the
property of the City of Laoag.
Section 53. Civil Remedies to Enforce the Collection of Delinquent Rentals - To enforce
the payment of delinquent rentals or fees, the City Government of Laoag shall avail civil

remedies provided for in the collection of delinquent taxes, fees, and charges under
Section 174 of R.A. 7160 in addition to the cancellation of the award and the Contract of
Lease covering the stall or booth of the delinquent Lessee.
CHAPTER 4 – THE SLAUGHTERHOUSE
Section 54. Slaughterhouse Fees - There is hereby imposed a slaughterhouse fee for the
slaughter of animals in accordance with the following:
a) For Public Consumption on the basis of head:
1) Large cattle, per head P16.50
2) Hogs, per head 11.00
3) Goats, sheep, other/head 5.50
4) Fowls/others 1.00
b) For Home Consumption on the basis of head:
1) Large cattle, per head P 4.25
2) Hogs, per head 2.50
3) Goats, sheep, other/head 1.50
Section 55. Fees for Permit to Slaughter - Before the animal is slaughtered for public
consumption, a permit therefor shall be secured from the Meat Inspector, duly authorized and
accredited by the National Meat and Inspection Commission, through the City Treasurer or
his duly authorized representative and the following corresponding fee shall be collected.
a) Large cattle, per head P 5.50
b) Hogs, per head 3.50
c) Goats 2.25
Section 56. Entrance Fee on Dressed Meat Slaughtered Outside the Jurisdiction of
Laoag City - Entrance fee in the amount of two (P2.00) pesos per kilo is hereby imposed on
dressed meat slaughtered in any duly accredited slaughterhouse outside the City. Dressed
meat in this nature must be supported/covered by a transfer certificate approved by
competent authority from the place of origin.
Section 57. Place of Slaughter - The slaughter of any kind of animal for sale or for public
consumption, shall be done only in the City Slaughterhouse. The slaughter of animals
intended for consumption may be done elsewhere except large cattle; provided, that the
animals slaughtered for home consumption shall not be sold or offered for sale.
Section 58. Duty of the Barangay Chairman - Before any animal is slaughtered for home
consumption elsewhere other than the City Slaughter, the same shall be reported to the
Barangay Head of the barangay where such slaughter is made who shall require the
presentation of evidence that the corresponding fees have been duly paid to the City
Treasurer or his authorized collector and that all requirements prescribed in this Article have
been duly complied with.
It shall also be the duty of the Barangay Captain or Barangay Head to report to the
authorities concerned any and all slaughters made in violation of the provision of this Article
for appropriate legal action. Any connivance made or wilful intent to conceal any such
violation by the Barangay Captain or Barangay Head shall subject him to fine of not less than
One Thousand (P1,000.00) Pesos nor more than Five (5) months imprisonment or both or
shall be dismissed from Office.
Section 59. Requirements for the Issuance of a Permit to Slaughter Large Cattle - Upon
issuance of the permit required in Section 55 of this Chapter, large cattle shall be slaughtered
at the City Slaughter House. Before issuing the permit to slaughter large cattle, the Treasurer
or his/her duly authorized representative shall require for branded cattle the
production/presentation of the certificate of ownership if the owner is the applicant, or the
original certificate of ownership and the certificate of transfer showing title in the name of
the person applying for the permit if he is not the original owner and there is no certificate of

transfer made in his favor, one such certificate shall be issued and the corresponding
fee collected therefor.
For unbranded cattle that have not yet reached the required age for branding, the
Treasurer shall require such evidence that will be satisfactory to him regarding the ownership
of the animal for which permit to slaughter has been requested. For unbranded cattle of the
required age, the necessary owner’s certificate and the transfer certificate shall be issued and
the corresponding fees collected therefor before the permit is granted.
Section 60. Corral Fee - There is hereby imposed a Corral fee, per day, or fraction thereof of
animals to be slaughtered which are deposited and kept in the City Slaughterhouse at the
following rates:
a) Large cattle, per head per day or fraction thereof P5.00
b) Hogs, per head per day or fraction thereof 3.00
c) Goats, sheep, per head per day or fraction thereof 1.00
d) Others, per head per day or fraction thereof 1.00
CHAPTER 5 - MISCELLANEOUS PROVISIONS
Section 61. Penal Provisions – Except as otherwise specifically provided in the specific
Section of this Ordinance, a fine not exceeding One Thousand Pesos (P1,000), or
imprisonment of not less than One (1) Month but not more than Six (6) Months, or both at
the discretion of the Court, is hereby imposed for violation of any provisions hereof.
Section 62. Administrative Authority of the City Treasurer – The City Treasurer shall,
with the approval of the City Mayor, formulate such forms and issue from time to time such
regulations as may be needed for the proper, effective and efficient implementation of this
Ordinance.
Section 63. Publication of Code – Within ten (10) days after its approval, a certified true
copy of this Code shall be published in full for three (3) consecutive weeks in a newspaper of
local circulation.
Section 64. Appropriations for the Publication of this Code – The amount of Fifty
Thousand Pesos (P50,000.00) is hereby appropriated from unappropriated funds for the
publication and printing of this Code.
Section 65. Public Dissemination of Code – Copies of this Market and Slaughterhouse
Code shall be furnished the City Treasurer for public dissemination.
Section 66. Authority to Adjust Rates – The Sangguniang Panlungsod, in accordance with
R. A. 7160 otherwise known as the Local Government Code, shall have the sole authority to
adjust the rates as prescribed herein not oftener than once every five (5) years, but in no case
shall such adjustments exceed Ten Percent (10%) of the rates fixed in this Code.
CHAPTER 6 - FINAL PROVISIONS
Section 67. Separability Clause – If, for any reason, any section or provision of this
Ordinance shall be held to be unconstitutional or invalid by a court of competent jurisdiction,
such judgement shall not affect or impair the remaining provisions, sections, or parts which
shall continue to be in force and effect.
Section 68. Applicability Clause – All other matters relating to the impositions in this Code
shall be governed by pertinent provisions of existing laws and other Ordinances.
Section 69. Repealing Clause – All Ordinances, rules and regulations, or parts thereof, in
conflict with, or inconsistent with any provisions of this Code are hereby repealed or
modified accordingly.
Section 70. Effectivity Clause – This Code shall take effect upon approval and after
publication.
