ofKerala atErnakulum,By the impugned judgment
passedbytheHighCourtofKeralawhiledismissingthe
WritPetitionheldthatsincetheMedicalCouncilofIndia
(hereinafterreferred to as MCI)and NationalTesting
Agency(hereinafterreferredtoasNTA) beingexpert
bodies,thecourtcannotissuedirectionseithertoallocate
NEETexam centresinthemiddleeastortopostponethe
exam becauseoftheCOVID-19pandemics.
Thefactsofthepresentdisputeareasfollows:
TheinstantWritPetition beforetheHon’ble High
CourtofKeralawasfiledonbehalfoftheparentsofthe
students who are applicants forthe NEET UG 2020
entranceexaminationandwhoaresettledinDoha,Qatar
alongwiththeirparents.Thereareapproximately4000
students registered forNEET-UG from Qatarand the
MiddleEast.ThenecessityofthepetitionerfilingtheWrit
Petitionwasbecauseoftheproceduraldifficultyfacedby
theparentsingettingtheaffidavitsattestedfrom the
embassyofIndiainQatarandsendingittoIndiaforfiling
thesame.Itissubmittedthatthepetitionerisrequested
bymanyofhisfriends,whoaretheparentsoftheNEET-
UG2020aspirants,tobringtheissuetotheattentionof
theHighCourt.ThatthePetitionerisemployedinQatar
andispresentlyinKeralaonhisvacation.
TheissueraisedintheWritPetitionwasconcerning
theNEET applicantswho havestudiedintheschools
abroadandhassettledwiththeirparentsabroad.The
NEET-UG 2020 examination which was scheduled to
conducton03.05.2020wasrescheduledon26.07.2020,
becauseofCOVID-19pandemic.Thesestudents,aswell
astheirparents,havebookedtheflightstoflybackto
India to participate in the Entrance exam.Butin the
situationofLockdowndeclaredbytheMinistryofHome
AffairsVideitsorderdated24.03.2020andcontinuing
sincethenandwhichhasculminatedintothelatestorder
dated 29.06.2020 wherein the Internationaltravelhas
beenbanned.Becauseofthis,thestudentswerenotina
position to travelto India to attend the examination.
Although theGovernmentofIndia had introduced the
schemeofrepatriationundertheVandeBharatMission
(inshortVBM)andmostoftheparentsandstudentshave
registeredintheIndianembassy,noneofthem managed
togetseatsinthesaidflights.Itisprimarilybecausethe
VBM flightsaremainlyindentedtorepatriatethepeople
whoareindistress,migrantlabourers,peoplewhoarein
a medicalemergency,as also students stranded in
variousuniversitiesabroad.
ItisinthesecircumstancesthattheWritPetitionwas
filedwith2prayers.
1.DirectiontotheUnionofIndiatoallocateNEET
examination centres in Qatarand otherMiddle East
countries.
2.Ifitisnotpossibletoallocatecentres’,thento
postpone the NEET UG 2020 examination untilthe
situationisnormalized.
TheHighCourtdismissedtheWritpetitiononthe
groundthatitcannotissueadirectiontoanexpertbody
liketheMCI.TheNTAhadverycategoricallystatedinits
statementbefore the High CourtthatNEET UG2020
examination may be conducted on 26.07.2020 ifthe
situationisconductiveoronasubsequentdatewhenthe
situationstabilizes.NTAhasstatedthattheyarekeeping
aclosewatchonthesituationandappropriatedecisions
astowhethertoholdtheexam on26.07.2020orona
subsequentdatewouldhavetobetakeninduecourse,if
required,intheinterestofthecandidates,inconsultation
withMCIandMinistryofHealthandFamilywelfarebased
onthefuturedevelopment.Itissubmitted thatasof
todaythereare5,66,840 COVID–19affectedpersons
andtherehavebeen16,893deathswithDelhi,Mumbai,
ChennaiandCalcuttahavingthehighestnumberofcases
inIndia.TheGovernmenthasdeclared170districtsin
IndiaasHotspotsand207districtsasnonHotspotzones
meaningtherebytherearestrictquarantineandlockdown
proceduresinmanyareas.Ithasbeenprojected that
Delhialonewillhave5Lakhspluscasesbytheendof
July 2020.In these circumstances,itis respectfully
submittedthattheentranceexam shallbeconductedon
asubsequentDateontheinterestofthestudentssettled
abroad.Itissubmittedthatapproximately4000students
from theMiddleEasthaveappliedfortheNEETUG2020
examination.Thesestudentsarehelplessto writethe
examination in the presentsituation in as much as
internationaltravelisbannedtoandfrom India.Assuming
thattheyhaveseatsinVBM flights,thestudentswill
exposetoCOVID-19risksasalsotheywouldhaveto
undergo quarantine on theirarrivalin India and the
durationinquarantinewillgoupto21daysdepending
upontheirdestinationofarrival.Theabovefactorswill
addtothementalstressofthestudents,who,ifnoother
alternativeisavailablewillbeforcedtotravelandtakethe
exam.
ItissubmittedthattheNTAinitsstatementbefore
theHighCourthasstatedthattheyarereadytoconduct
anonlinetestfortheNEETexaminationiftheMCIgives
approvalforthesame.ButtheMCIinitscommunication
dated21.05.2020hadinformedthattheonlinetestfor
NEET isnotpossible.Itissubmitted thatduring this
exceptionalcircumstancestheMCIandTheGovthaveto
beflexibleso asto accommodatethesestudentsfor
writingtheNEETexam.ItissubmittedthatJointEntrance
Examination(JEE)forengineeringcoursesinNIT’Sand
IIT’SisalsoconductedbytheNTA.Thesaidexam has
gotthecentre’sinforeigncountriesaswell.TheJEEis
bothanonlineandofflinemodeexamination.Sincethe
NTA has got expertise in conducting the entrance
examinationsabroad,itisrespectfullysubmittedthatfor
thisyear’sNEET-UGexamination,thesamemodelmaybe
adoptedsothatthesestudentswhoareabroadmaybe
abletotakepartintheexamination.
Itis also submitted thatthe parents of these
studentshavealsoapproachedtheembassyofIndiain
Qatarandtheauthoritieshaveforwardedtherequestto
theCentralGovernmentwhereintheembassyofficials
hadstatedaboutthefacilitieswhichcanbegrantedfor
conducting the NEET UG examination in Qatar.Itis
submittedthatthestudentswhoareattendinginthis
examinationhaveputtheirhardworkforlast2yearsby
attendingentrancecoachingclassesandifthesituation
developswheretheyareunabletotaketheexam,sothe
studentswillundergoseverementaltrauma.
Therefore,inviewofthesame,theimpugnedorder
oughttobesetaside.

2. Questionsoflaw
Thefollowingsubstantialquestionsoflaw arisein
thisPetitionforconsiderationofthisHon’bleCourt;
i) Whether the action of the respondents is
violative ofArticle 14 in as much as the
students studying abroad willbe prevented
from participatingintheNEET–UG2020exam?
ii) Whethertheactionofrespondentsisviolative
ofArticle 21A in as much as the rightof
Studentstoeducationisbeingjeopardisedby
thestateaction?
iii) Whetherthe action ofthe respondents has
resultedinviolationofArticle14intheasmuch
asthestudentsarebeingunfairlydiscriminated
only on the ground thatthey had studied
abroad?
iv) Whethertheactionoftherespondentsisin
violationofArticle21inasmuchastheState
authoritieshaveabdicatedtheirresponsibility
ofprovidingadequatefacilitiestothestudents
towritetheirexam duringthisepidemic.

5. GROUNDS:
Leave to Appealis soughtinteralia foron the
followinggroundsthatareurgedinthealternative
strictlywithoutprejudicetooneanother:
Itissubmittedthattheimpugnedorderiserroneous
onthefollowinggrounds:
A. ThattheLd.DivisionBenchhasfailedegregiously
to scrutinize the decision taken by the
RespondentstoconducttheNEET examination,
whichisviolativeofArticle14oftheConstitution
ofIndia,wherebythestudentssettledabroadwill
bepreventedfrom participatingintheNEET-UG
2020exam.
B. ThattheLd.DivisionBenchoughttohavefound
thatthedecision taken bytheRespondentsis
arbitraryandisdenyingequalopportunitytothe
studentswhoareregisteredtoappearinNEET–
UG 2020 examination during this COVID-19
pandemic.
C. ThattheLd.DivisionBenchhasfailedegregiously
to scrutinize the decision taken by the
Respondents, which is making unfair
discrimination on NEET aspirants based on of
place ofresidence,which is even violative of
Article14ofConstitutionofIndia.
D. ThattheLd.DivisionBenchoughttohavefound
thatthedecision taken bytheRespondentsis
violatingtheRighttoEducationoftheStudents
which is enshrined under Article 21A of
ConstitutionofIndia.
E. ThattheLd.DivisionBenchoughttohavefound
thatitisthedutyoftheStatetoprovidewiththe
adequatefacilitytothestudentstowritetheexam
duringthePandemic.
F. ThattheLd.DivisionBenchoughttohavefound
that the Respondents have already allotted
examination centres abroad forJointEntrance
Examination(JEE),asimilarallIndiaEntrancetest
foradmissionintoengineeringcourse,butrefusal
toallotexaminationcentresabroadforNEET-UG
2020isarbitrary.
G. That the Ld.Division Bench ought to have

conductNEETon26.07.2020untilthenormalcyis
restored.
6. GROUNDSFORINTERIM RELIEF:
a. ThatthestudentsarepreparingfortheNEET-
UG2020examinationforpastseveralyears.If
thestudentsarenotabletoattendtheexam
this year,they willundergo severe mental
stress.
b. That the Central Government decision to
conducttheNEET-UG2020examinationamidst
the COVID-19 pandemic is a risky decision
wherebyCentralGovernmentisriskingwiththe
futureofexpatriatestudents.
c. ThattheNTAishavingexpertiseinproviding
examination centres abroad for the Joint
Entrance Examination (JEE)forengineering
course.Hence,the NTA ought to provide
centresforconductingNEET-UG2020.
7. MAINPRAYER
Inview oftheabove,itismostrespectfullyprayed
thatthisHon’bleCourtmaybepleasedto:-
a)GrantSpecialLeave to Appealagainstthe final
Judgmentandorderdated30.06.2020inW.P.(C)
No.11495of2020passedbytheHighCourtof
KeralaatErnakulum;
b)Pass such otherorderorfurtherorders asthis
Hon’ble Courtmay deem fitand properin the
circumstancesofthecase.
