CMD Message
My dear colleagues,
My greetings to you.
I have not been able to
reach out to you through
this platform for quite
some time though I wanted
to very much. I have been
running against t ime
pursuing our plans and
thought I should bring
some good news for all of
us.
The news for us to feel good is we have more than doubled our
installed capacity in mining (from 30.6 MTPA lignite) by
adding 31.5 MTPA of coal which will be coming from recently
allotted Talabira II & III coal blocks in our favour in Odisha in
addition to South Pachwara coal block in Jharkhand. We have
signed an MoU for acquisition of 1200 MW coal-based new
thermal power station of Damodar Valley Corporation (DVC)
at Raghunathpur in West Bengal and if everything goes well,
we plan to operate the new plant in around
4 months' time adding revenue to our company through the
proposed Joint Venture with DVC. PIB meeting for our
1980 MW NUPPL project is over and we are expecting
clearance (for the project) shortly upon which main plant
package awards will be issued. We have floated tenders for
adding 500 MW Lignite based power generating capacity
(250 MW x 2) in Rajasthan at/near Barsingsar and
prospecting is on to add another 1000 MW Lignite based
power station in Neyveli Complex itself.
On the renewable energy front, our 51 MW Wind Power Units
are nearing completion and we have floated tenders for
adding 130 MW each (total 260 MW) Solar Power generating
capacity at Neyveli and also at Barsingsar.
We are at the end of the financial year 2015-16. The setback
we suffered in last November and December due to
unprecedented rains and floods was substantial and we have
been trying to recover which we may do to some extent. But
non-stabilization of TPS-II Expansion Units continues to be a
cause of serious concern for us and the same is true for our
Barsingsar Units where performance improvement has been
low. In both the cases our performance and earnings are sub
optimal and in fact in case of TPS-II Expansion our cost of
depreciation and interest are more than our earnings. I will
With regards,
Sarat Kumar Acharya
urge our officials in both
the places to pay serious
attention to improving
efficiency.
We have embarked upon
creating a culture of leadership excellence where our Senior
Executives were given an opportunity to interact with some
renowned thought leaders of India. As in the past, this year
also we are taking Development Centre initiatives for
capability building for our middle and Senior level Executives.
Such initiatives will build leadership capabilities to take the
organization to new heights. These are in addition to the skill
development programmes which are getting conducted
regularly for employees at various levels.
There were a couple of industrial accidents which resulted in
loss of life. I urge my dear Brothers and Sisters of NLC to adopt
safety standards and follow safe practices in every sphere of
activity. We do not want any accident to happen due to any
unsafe act.
We celebrated Panguni Uthiram and Holi together spreading
the message of universal camaraderie and brotherhood. We
observed International Women's Day and started skill
development and self-employment courses for women
empowerment. We have our plans for promoting Fish
Cultivation, Aqua Culture, Organic farming, Herbal and
medicinal plantations (that were initiated on World Forest Day)
and eco-tourism. I appreciate our employees in various units -
Thermal and Mines, including NTPL, for achieving record
performance on couple of occasions in the last one month.
I invite all of you to join together for achieving our dream of
making NLC a great company empowering the growth of our
great Nation.
Jai Hind,
Nandri and Vanakkam.

MoU with ECT, Australia for Coldry- Matmor Process
CARD signs MoU with ARCI for Developing Fuel Cell
As a part of its R&D activities in developing value-added
products from lignite, NLC joins hand with the NMDC and the
Environmental Clean Technology Ltd (ECT) of Australia for
conducting a “Feasibility study on setting up a Small Pilot Scale
R&D Integrated Plant at Neyveli for Coldry-Matmor process to
attain a value-added product using lignite and iron ore.”
In a brief function, the MoU between the ECT and NLC was
signed by Shri Ashley Moore, MD, ECT, and Shri P.Selva
Kumar, Director (Planning & Projects), NLC, in the presence
of Shri Sarat Kumar Acharya, CMD, NLC, and Shri Glenn
Fozard, CMD, ECT, on January 19, 2016 at Neyveli.
In his address , Shri Acharya said that as the process would be
suitable for purifying the low grade iron ore into a high grade
ore by using the easily available
lignite, the exchange of technical
know-how between India and
Australia would not only benefit the
companies and the countries but also
the humanity. The feasibility report
on the project would be ready by
June-end this year, he said. The
Australian officials said that their
country was pleased to join hands
with NLC in the process of
implementing “Make in India” policy
of Government of India.
Shri Rakesh Kumar and Shri V.Thangapandian, Directors of
NLC, Shri Sean Kelly, Australian Counsel for Southern India,
Shri B.Manivannan, GM/CARD, NLC, Shri P.Veerabalu,
DGM/CARD, NLC, and senior officials witnessed the event.
Earlier, the ECT approached NLC and suggested its
participation in the Matmor Process. Under the procedure,
moisture in lignite would be removed through Coldry process
and iron ore would be added to make pellets which in turn
could be utilized to produce iron ingot of more than 95% purity.
By this effort, lignite could have alternate use as commercial
products and value addition could be done for the lignite
resources in the country.

The Centre for Applied Research & Development (CARD), the
in-house R&D Unit of NLC, and International Advanced
Research Centre (ARCI), an autonomous R&D Centre of
Department of Science and Technology, Govt. of India, have
signed an MoU for conducting preliminary study on hydrogen
based fuel cell for a period of three months. It is the first R&D
Project of its kind in the country for a power plant to produce
hydrogen based fuel cell for power generation.
In TPS-II Expansion, Sodium Hypochlorite is used as an
oxidizing biocide to control algae growth in the cooling tower
water circulating system, in place of chlorine which is
generally used in conventional method. Fortunately, while
producing Sodium Hypochlorite the process eminates
enormous quantity of hydrogen gas, as a by-product during
the electrolytic process. This hydrogen gas is identified as
useful source of energy in fuel cells (a renewable source of
energy similar to battery cell) to generate electric power on
demand and to fuel electric vehicle etc. The energy produced
in the process is a clean energy as hydrogen and air are the
consumables for the power generation and water is the by-
product. It is predicted that within 45 years, the petroleum
reserves will be exhausted and therefore fuel cells would be
the only option for energising the automobile industry. In
addition, Union Ministry of Coal, was advised to undertake
R&D on fuel cell and Renewable Energy storage as per
Minutes of the Meeting of Prime Minister's Council on Climate
Change at New Delhi on January 19, 2015. With this
background NLC has taken up this R&D Project.
In a simple function held in the CARD premises on February
24, 2016, Shri B. Manivannan, GM/CARD, NLC, and Shri R.

Vulcanizing Panel
for carrying out the
vulcanizing works
in Mine-1A.
This new system contains permanent wiring system for the
five 440 V panels with proper input and output for quick
establishment of power supply to the vulcanizing spot. Earlier,
these 5 panels were used to be transported separately and
assembled at the site. But such an arrangement was prone to
get wrong connection and the panels were also likely to get
damaged during transportation. The new system would be
free from such disadvantages.
This compact transportable power supply system averts
frequent power failures and ensures total electrical safety.
At Toronto, Canada
NLC participated in PDAC 84th Annual International
Convention, Trade Show & Investors Exchange at Toronto,

Newsletter of NLC Vigilance Department
PROVEN VALUES. POWERFUL VISION
From the pen of CVO
Shiv Raj Singh, IFS
Chief Vigilance Officer
With best wishes to all,
I joined Neyveli Lignite Corporation, a 'NAVARATNA'
Government of India company, as CVO on 15thMay 2013 after
serving as CVO in Hindustan Steelworks Company Ltd under
Ministry of Steel, Kolkata for about three years and prior to that
as Joint Director in Forest Survey of India, Dehra Dun under
Ministry of Environment and Forests. I take pride and great
pleasure to share with you all that the institution of NLC
happened to be a great platform for me to learn various new
activities and skills, and to enrich myself with knowledge and
experience. After having worked for about three years with
you, now the time has come to bid adieu to you, all the
employees of the NLC Ltd, as I will be laying down my office
shortly on completion of my tenure in NLC on 06-07-2016 along
with that of Government of India and join back to my cadre
KARNATAKA.
I, look back at the days and the cherished memories during the
past three years serving in this company. I would not like to
project my contributions and achievements while serving
NLC, as I feel you and the public are the best
evaluator. I can only say that surely I tried to deliver
my services to the best of my knowledge and
capacity, fairly and fearlessly. If I qualify on your
parameters and standards, it will be a great
achievement for me. Here I would like to repeat
some of the lessons which I was told and I tries to
follow.
“You are a ray of hope especially to POOR and
WEAK, Don't avoid them. If you don't entertain
them, they will remain deprived, while rich and
powerful have many ways and means to get their
works done and you can't avoid them”
“If an occasion arises where you have to choose between your
carrier and service to institution/nation, choose the later”
Last but not the least; I take this opportunity to express my
sincere thanks to all the employees, right from contract
workmen up to the Management of NLC Ltd for your kind
cooperation extended to me during my tenure. I am also
grateful to all informants, in and out of NLC, for feeding me
and vigilance department with apt and valuable information. I
wish NLC Ltd and everyone a great success with leap and
bounces not only to attain a status of “MAHARATNA” but
also to be a distinct leader globally. I am sure NLC can attain
this shortly with her great vision, integrity, Transparency,
Fairness and Accountability in actions, and Competitiveness
in business.
May God Bless NLC Ltd and You all.

Reference is invited to the Commission's Circular No. O1/O1/08 dated 31.12.2007
(issued vide OM No. 02-07-1-CTE-30 dated 09.05.2006), wherein necessity for ensuring
verification of genuineness of Bank Guarantee prior to its acceptance was emphasized and steps
were suggested.
2. It is, however, observed that the practice of paper based verification of BGs followed by
the organizations is not only time consuming causing delay in acceptance/award of works or
advance related payments but also its trustworthiness cannot always be ensured due to human
intervention in it.
3. In this background, organizations are advised to follow IT enabled confirmation system
which is swift and secured in addition to their existing paper based confirmation system. The
following methods for verification may be considered by the organizations:-
a) Getting confirmation through digitally signed secured e-mails from issuing Banks;
b) Online verification of Company portal with user ID and password followed by 2nd
stage authentication system generated One Time Password (OTP) on portal for
reconfirmation;
c) E-mail confirmation followed by 2nd stage authentication by system generated SMS
through registered mobile and reconfirmation through SMS to the verifying officer.
4. Keeping above in view, organizations may evolve their own procedure adopting any one
or more of the above methods for ensuring genuineness of B65, which is compatible with the
guidelines of Banks/Reserve Bank of lndia.

Sub:- Action on Anonymous / Pseudonymous Complaints - reg.
1. The Commission has been receiving references from Departments / Organisations
seeking clarification on the action to be taken on anonymous/pseudonymous complaints which
were acted upon and at different stages of process including under disciplinary proceedings
before issuance of CVC Circular No. 07/11/2014 dated 25"‘ November, 2014 on the captioned
subject. A few Court decisions arising out of the Commission's guidelines issued earlier on the
subject were also brought to the notice of the Commission.
2. The Commission considered the details of the Court orders/judgments and in one
instance, the Central Administrative Tribunal (CAT), Principal Bench, Delhi had quashed the charge
sheet dated 14.10.2004 issued to the delinquent official based on the pseudonymous complaints
dated 18.02.1997 and 02.04.1997, vide order dated 20.07.2005. CAT had quashed the charge-
sheet served mainly considering the circulars of the Commission dated 29.6.1999 and 31.01.2002
on the subject. ln the order dated 20.07.2005, it was observed that the charge-sheet dated
14.10.2004 was issued pursuant to pseudonymous complaints received earlier and therefore is in
violation of Commission's circular dated 29.6.1999 and 31.01.2002. The High Court agreed with
the findings and observations of the CAT and dismissed the department's Writ Petition filed
against the order ofthe CAT in limine. Thereafter, the Supreme Court had also dismissed the
department’s Civil Appeal in the matter. CAT’s decision is based on one of the judgement dated
26.09.2003 of Madras High Court (in another case) wherein it was observed that the preliminary
enquiry report dated 25.05.2000 based on anonymous complaint was subsequent to the CVC‘s
circular dated 29.06.1999 and, therefore, is liable to be quashed and further that the prohibition
(in CVC circular) that “no action will cover all pending proceedings on that date.”
3. The instructions I guidelines issued from time to time on the subject-matter by
DoPT/CVC are as follows:
i. DoPT's O.M. No. 321/4/910-AVD.lll dated 29.09.1992 that no action is required to be
taken on anonymous/pseudonymous complaints in general, provided the option to
inquire into such complaints which contained verifiable details.
ii. Commission's initial Circular No. 3(v)/99/2 dated 29.6.1999 prescribing that no
action should be taken on anonymous/pseudonymous complaints and should just be
filed.
iii. Commission's circular No.98/DSP/9 dated 31.1.2002 reiterating that under no
circumstances, should any investigation be commenced on anonymous/
pseudonymous complaints.
iv. Commission's circular No. 98/DSP/9 dated 11.10.2002 reviewing its earlier
instructions of 1999, providing that if any Departments/ organisations proposes to

refer the matter to the Commission seeking its concurrence through the CVO or the
Head of the organisation.
v. DoPT O.M. No. 104/76/2011-AVD.l dated 18.10.2013 that no action is required to be
taken on anonymous complaints, irrespective of the nature of allegations and such
complaints need to be simply filed.
vi. Commission’s circular No.07/11/2014 dated 25.11.2014 withdrawing Circular dated
11.10.2002 and reiterating previous circulars dated 29.6.1999 and 31.1.2002 to the
effect that no action should be taken on anonymous/pseudonymous complaints and
such complaints should be filed.
4. Since, the aforesaid issues arising out of the observations of CAT and High Court of
Madras involve interpretation of substantial questions of law, the opinion of Ld. Attorney General
for lndia was sought by the Commission. Ld. Attorney General for lndia has furnished his opinion
and clarified that unless expressly stated all Executive Circulars are prospective in nature and they
do not have retrospective effect. Only a law can be retrospective if a law expressly states that it will
be retrospective or the intention to that effect is very clear. it is further clarified that an
anonymous/pseudonymous complaint, say made in 1997 i.e. prior to the prohibitory circular
dated 29.06.1999 ought to have been generally not entertained but if there was verifiable material
in accordance with the DoPT's O.M. of 1992 and investigation has commenced, the same would
have to be taken to its logical conclusion notwithstanding the issue of a later circular dated
29.06.1999.
5. Based on the opinion furnished by Ld. AG, the following clarifications are being issued:-
I. No action should be taken on anonymous / pseudonymous complaints in line with
Commission's present instructions dated 25th November, 2014 and such complaints
should be filed.
ii. However, where the action was initiated on anonymous / pseudonymous complaints
prior to the issue of CVC’s circular dated 29.6.1999 and was pending as on 29.6.1999,
it can be pursued further to its logical end.
iii. Where action was initiated on anonymous! pseudonymous complaints between the
period 11.10.2002 and 25.11.2014 with prior concurrence of CVC but is pending,
further action is permissible on such complaints.
iv. Material/evidence gathered during the investigation/verification of anonymous
complaints when the action was prohibited on such complaints (i.e. between
29.06.1999 & 11.10.2002), or where such enquiry was initiated without the approval
of CVC, can be utilised for further initiation of disciplinary proceedings on
misconducts noticed in such verification / enquiry.
6. All Administrative Authorities / CVOs may note the above clarifications for guidance /
compliance while handling and processing matters arising out of anonymous / pseudonymous
complaints.

TPS-I Expn.& TPS-II excel targets despite Nature's fury!
NLC on the Growth Path - Looking Ahead
On November 8 and 9, 2015 Neyveli received around 440 mm rainfall in 24 hours. Our mines got flooded and the production came to
a grinding halt. This natural disaster marooned our mines for about 35 days and chocked the power generation.
But once again we proved ourselves that we are capable to restore, rebuild and regenerate in the shortest possible time. Incredibly
our TPS-I Expn and TPS-II had generated 110.71% and 109.28% of electricity respectively, against the target. In overburden
removal too, we made 8.46% extra output beyond the target. However the overall target of lignite production and power generation
slightly slipped due to the calamity.
To familiarize the new vision and mission, corporate plans and the strategies of the company to attain Maharatna status with the
Executives of the organization, the CMD organized a series of interactive sessions with the Executives of all cadres at Learning and
Development Centre and at Lignite Hall, Neyveli, on different days.
On 22.10.2015, he interacted with the Senior Executives of the company. He narrated his ideas to the Chief Managers of the
Company on 07.11.2015. He made his presentation to the entry level Executives on 20.01.2016. On January 25, 2016 he explained
his ideas with the Middle Level Executives. Directors Shri Rakesh Kumar, Shri Subir Das, Shri V.Thangapandian and
Shri P.Selvakumar joined the CMD in these sessions. The CMD and Directors also replied to the queries of the Executives.
The interactive session brought confidence to all, and motived the employees to work hard for achieving the next level, Maharatna.
