Proceedings of the 13th meeting of Karnataka State Coastal Zone Management
Authority (KSCZMA) held on 30th January, 2016 at 11:00 AM at Room No. 253, 2nd
Gate, M.S. Building under the chairmanship of Additional Chief Secretary to
Government, Forest, Ecology & Environment Department.
Members present: As per the list enclosed.
The Chairman welcomed the members present. All the files were placed before the Authority for
perusal and the subjects were deliberated as per the Agenda.
13.1 Confirmation of the proceedings of the previous KSCZMA meeting held on
15.12.2015.
13.2 Action Taken Report on the proceedings of the previous KSCZMA meeting held on
15.12.2015.
Action Taken Report at Annexure – I was perused and the Authority noted the action taken.
While discussing about the Action Taken Report regarding preparation of State Coastal
Zone Management Plan, the Secretary to Government (Ecology & Environment) explained the
process involved in preparation of CZMP Maps and its approval by MoEF. Further, it was
informed that the stage of preparation of CZMP Maps will be sought from NCSCM, Chennai. It was
also informed that the Cadastral Village Maps of 369 Villages of coastal districts of Karnataka have
been furnished to NCSCM on 07.01.2016, and action has been taken to obtain balance village
maps of 93 villages from ICT Centre, Aranya Bhavan, Malleshwaram, Bengaluru for onward
submission to NCSCM. At this stage, professor Sri. Sridhara, representing Karnataka Remote
Sensing Application Centre, Bengaluru was requested to furnish the Cadastral Maps of 93 Villages
if available with them for further necessary action.
The Authority after deleberations and discussion decided to seek further 6 months
extension of time for using the already approved CZM Plan as its validity is expiring on
31.01.2016 as per the MoEF Notification dated:31.03.2015.
13.3 Ratification of provisional NOC issued by the Regional Director (Environment)
with the approval of the DCZMCs.
The KSCZMA during the meeting held on 11.06.2014 had taken a decision to authorize
the Regional Directors (Environment) of the coastal districts to issue provisional NOC for
construction/reconstruction/repair of dwelling units in CRZ II and CRZ III (200-500 mts area)
and outside the CRZ limits with the approval of the concerned DCZMCs and subsequently to
place the proposals for ratification of the action taken (Government letter No. FEE 236 CRZ
2013 dated. 18.08.2014).
In the Government letter No.FEE 236 CRZ 2013, Dated:18.08.2014 detailed procedure
to process the application seeking CRZ Clearance for reconstruction / repairs of dwelling units
in CRZ II and CRZ III (200-500 mts area) with approval of concerned DCZMCs was issued to all

the three Regional Directors of Mangalore, Udupi and Uttara Kannada Districts. Accordingly, the
Regional Directors after issuing provisional CRZ Clearance submitted proposals for ratification
as per Annexure II, III and IV respectively.
The Authority after examining the ratification proposals instructed the Regional
Directors to consider to issue provisional CRZ Clearance to those cases which are urgent in
nature after getting approval from concerned DCZMCs with proper justification for urgency in
future and other proposals are to be submitted to the Authority after obtaining approval of
concerned DCZMCs. It was further instructed to Regional Directors that photos with GPS
readings of the buildings/projects are to be taken before and after construction of buildings and
the same has to be brought to the notice of the Authority. All the three Regional Directors were
instructed to record the plinth area in Sq. ft in all ratification cases in future.
The Authority after discussion, decided to accord ratification for the action taken by
concerned Regional Directors with the above instructions. Further, the Authority decided to
issue proper CRZ Clearance for the proposals listed in Annexure II, III and IV.
13.4 Construction / Re-construction and Conversion of Residential Buildings:
13.4.1 Request for issue of NOC from Smt. Sadiyamma Marakalthi D/o Bacchi Marakalthi for
reconstruction of residential house at Sy. No. 18/28 of Parampalli Village, Udupi
Taluk, Udupi District (FEE 36 CRZ 2016).
Smt. Sadiyamma Marakalthi D/o Bacchi Marakalthi has requested to issue NOC for
reconstruction of residential house at 18/28 of Parampalli Village, Udupi Taluk, Udupi District. The
Regional Director (Environment) has inspected the proposed site and reported that project site is at
jurisdication of 150 mts from HTL of River (as per CZMP approved 1996). It is classified as CRZ-I.
The distance from HTL of river is 35 mts.
The Regional Director (Environment) has submitted the proposal along with application in
the prescribed format, RTC, Survey map of the site, tax assessment extract for the year 1978-79,
Certificate from Saligrama Municipality for change of door no. dated: 05.11.2015, approved CZMP
sheet, draft digitized CRZ map showing the area of proposed reconstruction, photos of old house and
proceedings of DCZMC meeting held on 16.01.2016. The plinth area is about 576 Sq.ft. The DCZMC
recommended the proposal for issue of NOC in the DCZMC meeting held on 16.01.2016.
As per the provisions under the Para 3 (i) (e) of the CRZ Notification 2011 reconstruction,
repair works of dwelling units of local communities including fishers in accordance with local town
and country planning regulations are allowed activities. Hence, the proposal has been submitted for
deliberation and consideration of the authority.
The Authority after discussion and deliberations decided to issue CRZ clearance to Smt.
Sadiyamma Marakalthi D/o Bacchi Marakalthi for reconstruction of residential house at Sy. No. 18/28
of Parampalli Village, Udupi Taluk, Udupi District as per the recommendation of the DCZMC.

13.4.2 Request for issue of NOC from Smt. Ameenabi W/o Late. Hussain Saheb for
reconstruction of residential house at Sy. No. 250/7A of Kodavoor Village, Udupi
Taluk, Udupi District (FEE 35 CRZ 2016).
Smt. Ameenabi W/o Late. Hussain Saheb has requested to issue NOC for reconstruction of
residential house at 250/7A of Kodavoor Village, Udupi Taluk, Udupi District. The Regional Director
(Environment) has inspected the proposed site and reported that project site is at jurisdication of
150 mts from HTL of River (as per CZMP approved 1996). It is classified as CRZ-I. The distance from
HTL of river is 80 mts.
The Regional Director (Environment) has submitted the proposal along with application in
the prescribed format, RTC, Survey map of the site, tax assessment extract for the year 1989-90,
approved CZMP sheet, draft digitized CRZ map showing the area of proposed reconstruction, photos
of old house and proceedings of DCZMC meeting held on 16.01.2016. The plinth area is about 500
Sq.ft. The DCZMC recommended the proposal for issue of NOC in the DCZMC meeting held on
16.01.2016.
As per the provisions under the Para 3 (i) (e) of the CRZ Notification 2011 reconstruction,
repair works of dwelling units of local communities including fishers in accordance with local town
and country planning regulations are allowed activities. Hence, the proposal has been submitted for
deliberation and consideration of the authority.

13.4.3 Request for issue of NOC from Sri. Mahammed Ismail S/o Ibrahim for reconstruction
of residential house at Sy. No. 47/2B of Navunda Village, Kundapura Taluk, Udupi
District (FEE 34 CRZ 2016).
Sri. Mahammed Ismail S/o Ibrahim has requested to issue NOC for reconstruction of
residential house at 47/2B of Navunda Village, Kundapura Taluk, Udupi District. The Regional
Director (Environment) has inspected the proposed site and reported that project site is at
jurisdication of 500 mts from HTL of Sea. It is classified as CRZ-III. The distance from HTL of sea is 75
mts.
The Regional Director (Environment) has submitted the proposal along with application in
the prescribed format, RTC, Survey map of the site, tax assessment extract for the year 1988-89,
Certificate from Navunda Grama Panchayath for change of door no. dated: 24.11.2015, approved
CZMP sheet, draft digitized CRZ map showing the area of proposed reconstruction, photos of old
house and proceedings of DCZMC meeting held on 16.01.2016. The plinth area is about 56 Sq.mtr.
The DCZMC recommended the proposal for issue of NOC in the DCZMC meeting held on 16.01.2016.
As per the provisions under the Para 8 III CRZ III A (ii) of the CRZ Notification 2011, the
above proposal is a permissible activity. Hence, the proposal has been submitted for deliberation and
consideration of the authority.

Mahammed Ismail S/o Ibrahim for reconstruction of residential house at Sy. No. 47/2B of Navunda
Village, Kundapura Taluk, Udupi District as per the recommendation of the DCZMC.
13.4.4 Request for issue of NOC from Sri. Suleman S/o Haji Byari for reconstruction of
residential house at Sy. No. 109/9A of Parampalli Village, Udupi Taluk, Udupi District
(FEE 33 CRZ 2016).
Sri. Suleman S/o Haji Byari has requested to issue NOC for reconstruction of residential
house at 109/9A of Parampalli Village, Udupi Taluk, Udupi District. The Regional Director
(Environment) has inspected the proposed site and reported that project site is at jurisdication of
500 mts from HTL of Sea. It is classified as CRZ-III. The distance from HTL of sea is 185 mts.
The Regional Director (Environment) has submitted the proposal along with application in
the prescribed format, RTC, Survey map of the site, tax assessment extract for the year 1986-87,
Certificate from Saligrama Municipality for change of door No. dated: 04.12.2015, approved CZMP
sheet, draft digitized CRZ map showing the area of proposed reconstruction, photos of old house and
proceedings of DCZMC meeting held on 16.01.2016. The plinth area is about 476 Sq.ft. The DCZMC
recommended the proposal for issue of NOC in the DCZMC meeting held on 16.01.2016.

above proposal is a permissible activity. Hence, the proposal has been submitted for deliberation and
consideration of the authority.
The Authority after discussion and deliberations decided to issue CRZ clearance to Sri. Suleman
S/o Haji Byari for reconstruction of residential house at Sy. No. 109/9A of Parampalli Village, Udupi
Taluk, Udupi District as per the recommendation of the DCZMC.
13.4.5 Request for issue of NOC from Sri. Mahabala Poojary S/o Akkamma Poojarthy for
reconstruction of residential house at Sy. No. 171/4P6 of Kumbhashi Village,
Kundapura Taluk, Udupi District (FEE 32 CRZ 2016).
Sri. Mahabala Poojary S/o Akkamma Poojarthy has requested to issue NOC for
reconstruction of residential house Sy. No. 171/4P6 of Kumbhashi Village, Kundapura Taluk, Udupi
District. The Regional Director (Environment) has inspected the proposed site and reported that
project site is at jurisdication of 500 mts from HTL of Sea. It is classified as CRZ-III. The distance from
HTL of sea is 80 mts.
The Regional Director (Environment) has submitted the proposal along with application in

The Authority after discussion and deliberations decided to issue CRZ clearance to Sri.
Mahabala Poojary S/o Akkamma Poojarthy for reconstruction of residential house at Sy. No. 171/4P6
of Kumbhashi Village, Kundapura Taluk, Udupi District as per the recommendation of the DCZMC.
13.4.6 Request for issue of NOC from Sri. Ramachandra Hebbar S/o Late. Narayana Hebbar
to develop horticulture activity at Sy. No. 250/5 of Kumbhashi Village, Kundapura
Taluk, Udupi District (FEE 31 CRZ 2016).
Sri. Ramachandra Hebbar S/o Late. Narayana Hebbar has requested to issue NOC for
excavation of soil for land development at Sy. No. 250/5 of Kumbhashi Village, Kundapura Taluk,
Udupi District. The Regional Director (Environment) has inspected the proposed site and reported
that project site is at jurisdication of 500 mts from HTL of Sea. It is classified at CRZ-III. The distance
from HTL of sea is 220 mts.
The Regional Director (Environment) has submitted the proposal along with application in
the prescribed format, RTC, Survey map of the site, approved CZMP sheet, draft digitized CRZ map
showing the area of proposed excavation of soil, photos of old house and proceedings of DCZMC
meeting held on 16.01.2016. Area is 2.03 Acres. The DCZMC recommended the proposal for issue of
NOC in the DCZMC meeting held on 16.01.2016. Since this activity is a land reclamation activity, as
per para 3(iv) of CRZ Notification 2011, this activity is a prohibited activity. But DCZMC has
recommended the proposal to KSCZMA for clearance.
The Authority after discussion and deliberations decided not to issue CRZ clearance to Sri.
Ramachandra Hebbar S/o Late. Narayana Hebbar to develop horticulture activity at Sy. No. 250/5 of
Kumbhashi Village, Kundapura Taluk, Udupi District as the activity was found to be of land reclamation
which is not a permissible activity as per Para 3 (iii) of CRZ Notification, 2011.
13.4.7 Request for issue of NOC from Sri. Gopi Narayan Vaidya for reconstruction of
residential house at Sy. No. 13/14 of Horbag Village, Kumta Taluk, Uttara Kannada
District (FEE 16 CRZ 2016).
Sri. Gopi Narayan Vaidya has requested to issue NOC for reconstruction of residential house
at Sy. No. 13/14 of Horbag Village, Kumta Taluk, Uttara Kannada District. The Regional Director
(Environment) has inspected the proposed site and reported that project site is at jurisdication of
100 mts from HTL of River (as per CZMP approved 1996). It is classified as CRZ-III. The distance
from HTL of river is 35 mts.
The Regional Director (Environment) has submitted the proposal along with application in
the prescribed format, Site inspection report, Sy. Map of the site, Plinth Area & Ownership letter,
R.T.C. of the site, 1981-82 year Tax Assessment Receipt PDO letter, 2011-12 year Tax Assessment

As per the provisions under the Para 8 III CRZ III A (ii) of the CRZ Notification 2011, the
above proposal is a permissible activity. Hence, the proposal has been submitted for deliberation and
consideration of the authority.
The Authority after discussion and deliberations decided to issue CRZ clearance to Sri. Gopi
Narayan Vaidya for reconstruction of residential house at Sy. No. 13/14 of Horbag Village, Kumta
Taluk, Uttara Kannada District as per the recommendation of the DCZMC.
13.4.8 Request for issue of NOC from Sri. Ramachandra Ganapathi Naik for reconstruction
of residential house at Sy. No. 60/1/5 of Aghanashini Village, Kumta Taluk, Uttara
Kannada District (FEE 15 CRZ 2016).
Sri. Ramachandra Ganapathi Naik has requested to issue NOC for reconstruction of
residential house at Sy. No. 60/1/5 of Aghanashini Village, Kumta Taluk, Uttara Kannada District.
The Regional Director (Environment) has inspected the proposed site and reported that project site
is at jurisdication of 100 mts form HTL of River (as per CZMP approved 1996). It is classified as CRZ-
III. The distance from HTL of river is 80 mts.
The Regional Director (Environment) has submitted the proposal along with application in

above proposal is a permissible activity. Hence, the proposal has been submitted for deliberation and
consideration of the authority.
The Authority after discussion and deliberations decided to issue CRZ clearance to Sri.
Ramachandra Ganapathi Naik for reconstruction of residential house at Sy. No. 60/1/5 of Aghanashini
Village, Kumta Taluk, Uttara Kannada District as per the recommendation of the DCZMC.
13.4.9 Request for issue of NOC from Sri. Somashekhar Sannappa Naik for reconstruction of
residential house at Sy. No. 285/1A+1B of Nadumaskeri Village, Kumta Taluk, Uttara
Kannada District (FEE 14 CRZ 2016).
Sri. Somashekhar Sannappa Naik has requested to issue NOC for reconstruction of residential
house at Sy. No. 285/1A+1B of Nadumaskeri Village, Kumta Taluk, Uttara Kannada District. The
Regional Director (Environment) has inspected the proposed site and reported that project site is at
jurisdication of 150 mts from HTL of River (as per CZMP approved 1996). It is classified as CRZ-III.
The distance from HTL of river is 70 mts.

above proposal is a permissible activity. Hence, the proposal has been submitted for deliberation and
consideration of the authority.
The Authority after discussion and deliberations decided to issue CRZ clearance to Sri.
Somashekhar Sannappa Naik for reconstruction of residential house at Sy. No. 285/1A+1B of
Nadumaskeri Village, Kumta Taluk, Uttara Kannada District as per the recommendation of the DCZMC.
13.4.10 Request for issue of NOC from Sri. Sukru Beerappa Harikantra for reconstruction of
residential house at Sy. No. 250/A of Kagal Village, Kumta Taluk, Uttara Kannada
District (FEE 17 CRZ 2016).
Sri. Sukru Beerappa Harikantra has requested to issue NOC for reconstruction of residential
house at Sy. No. 250/A of Kagal Village, Kumta Taluk, Uttara Kannada District. The Regional Director
(Environment) has inspected the proposed site and reported that project site is at jurisdication of
150 mts from HTL of River (as per CZMP approved 1996). It is classified as CRZ-III. The distance
from HTL of river is 10 mts.
The Regional Director (Environment) has submitted the proposal along with application in
the prescribed format, Site inspection report, Sy. Map of the site, Plinth Area & Ownership letter,
R.T.C. of the site, 1988-89 year Tax Receipt, 2014-15 year Tax Receipt, CZMP sheet, draft digitized
map showing the proposed area of construction, photo’s of old house, Sewage disposal Certificate

recommended the proposal for issue of NOC in the DCZMC meeting held on 07.01.2016.
As per the provisions under the Para 8 III CRZ III A (ii) of the CRZ Notification 2011, the
above proposal is a permissible activity. Hence, the proposal has been submitted for deliberation and
consideration of the authority.
The Authority after discussion and deliberations decided to issue CRZ clearance to Sri. Sukru
Beerappa Harikantra for reconstruction of residential house at Sy. No. 250/A of Kagal Village, Kumta
Taluk, Uttara Kannada District as per the recommendation of the DCZMC with a condition that Sewage
Disposal arrangement should be made before starting reconstruction.
13.4.11 Request for issue of NOC from Smt. Anuradha Avalla for construction of residential
house at Sy. No. 31/2 of Baad Village, Kumta Taluk, Uttara Kannada District (FEE 59
CRZ 2016).
Smt. Anuradha Avalla has requested to issue NOC for construction of residential house at Sy.
No. 31/2 of Baad Village, Kumta Taluk, Uttara Kannada District. The Regional Director
(Environment) has inspected the proposed site and reported that project site is at jurisdication of

500 mts from HTL of Sea (as per CZMP approved 1996). It is classified as CRZ-III. The distance from
HTL of sea is 325 mts.
The Regional Director (Environment) has submitted the proposal along with application in
the prescribed format, Copy of NOC issued, Site inspection report, Sy. Map of the site, Plinth Area,
R.T.C. of the site, CZMP sheet, draft digitized map showing the proposed area of construction, Sewage
disposal Certificate and proceedings of DCZMC meeting held on 07.01.2016. The plinth area is
146.26 Sq.ft.
As per the provisions under the Para 8 III CRZ III B (vii) of the CRZ Notification 2011
construction or reconstruction of dwelling units so long it is within the ambit of traditional rights
and customary uses such as existing fishing villages and goathans. Building permission for such
construction or reconstruction will be subject to local town and country planning rules with overall
height of construction not exceeding 9mts with two floors (ground + one floor). Hence, the above
proposal is a permissible activity. But DCZMC has recommended to reject the proposal on the
grounds that the applicant is not a local resident and is not bound by the Local Town And
Municipal Regulations as per Para 8 III CRZ III B (vii) of the CRZ Notification 2011. It is further
stated that the applicant is a resident of New Delhi and hence, the proposal is not eligible for
issue of NOC.
The Authority after discussion and deliberations decided not to issue CRZ clearance to Smt.
Anuradha Avalla for construction of residential house at Sy. No. 31/2 of Baad Village, Kumta Taluk,
Uttara Kannada District as per the recommendation of the DCZMC, as the applicant is not a local
resident.
13.4.12 Request for issue of NOC from Sri. Pradeep Narayana Shetty, Madadolakara for
construction of residential house at Sy. No. 622/2 of Bailoor Village, Bhatkal Taluk,
Uttara Kannada District (FEE 58 CRZ 2016).
Sri. Pradeep Narayana Shetty, Madadolakara has requested to issue NOC for construction of
residential house at Sy. No. 622/2 of Bailoor Village, Bhatkal Taluk, Uttara Kannada District.
The Regional Director (Environment) has submitted the proposal along with application in
the prescribed format, Sy. Map of the site, R.T.C. of the site, CZMP sheet, draft digitized map showing
the proposed area of construction, Photo of the old house and proceedings of DCZMC meeting held
on 07.01.2016.
As per the provisions under the Para 8 III CRZ III B (vii) of the CRZ Notification 2011
construction or reconstruction of dwelling units so long it is within the ambit of traditional rights
and customary uses such as existing fishing villages and goathans. Building permission for such
construction or reconstruction will be subject to local town and country planning rules with overall
height of construction not exceeding 9mts with two floors (ground + one floor). Hence, the above
proposal is a permissible activity. But DCZMC has recommended to reject the proposal on the
grounds that the applicant is not a local resident and is not bound by the Local Town And
Municipal Regulation as per Para 8 III CRZ III B (vii) of the CRZ Notification 2011. It is further
stated that the applicant is a resident of Dandeli and hence, the proposal is not eligible for
issue of NOC.

Pradeep Narayana Shetty, Madadolakara for construction of residential house at Sy. No. 622/2 of
Bailoor Village, Bhatkal Taluk, Uttara Kannada District as per the recommendation of the DCZMC, as
the applicant is not a local resident.
13.4.13 Request for issue of NOC from Sri. Tejeshear Singh Dunna for construction of
residential house at Sy. No. 75/2 of Baad Village, Kumta Taluk, Uttara Kannada
District (FEE 57 CRZ 2016).
Sri. Tejeshear Singh Dunna has requested to issue NOC for construction of residential house
at Sy. No. 75/2 of Baad Village, Kumta Taluk, Uttara Kannada District. The Regional Director
(Environment) has inspected the proposed site and reported that project site is at jurisdication of
500 mts form HTL of Sea (as per CZMP approved 1996). It is classified as CRZ-III. The distance from
HTL is 200.54 mts from Sea.
The Regional Director (Environment) has submitted the proposal along with application in
the prescribed format, Copy of NOC issued, Site Inspection Report, Sy. Map of the site, Plinth area,
R.T.C. of the site, CZMP sheet, draft digitized map showing the proposed area of construction, Sewage
disposal certificate copy and proceedings of DCZMC meeting held on 07.01.2016.
As per the provisions under the Para 8 III CRZ III B (vii) of the CRZ Notification 2011
construction or reconstruction of dwelling units so long it is within the ambit of traditional rights
and customary uses such as existing fishing villages and goathans. Building permission for such
construction or reconstruction will be subject to local town and country planning rules with overall
height of construction not exceeding 9mts with two floors (ground + one floor). Hence, the above
proposal is a permissible activity. But DCZMC has recommended to reject the proposal on the
grounds that the applicant is not a local resident and is not bound by the Local Town And
Municipal Rules as per Para 8 III CRZ III B (vii) of the CRZ Notification 2011. It is further
stated that the applicant is a resident of Dandeli and hence, the proposal is not eligible for
obtaining NOC. It is further reported by the RD that construction of the building has already
been started without obtaining prior CRZ Clearance and hence it is also a case of violation.
Hence a direction may be issued to stop the work and not to proceed with further construction
under section 5 of EP Act. Further, credible action may be taken as per the section 19 of EP Act.
The Authority after discussion and deliberations decided not to issue CRZ clearance to Sri.
Tejeshear Singh Dunna for construction of residential house at Sy. No. 75/2 of Baad Village, Kumta

Taluk, Uttara Kannada District (FEE 60 CRZ 2016).
Smt. Nirmala Rajesh Kamath has requested to issue NOC for construction of residential house

The Regional Director (Environment) has submitted the proposal along with application in
the prescribed format, Sy. Map of the site, Plinth area, R.T.C. of the site, draft digitized map showing
the proposed area of construction and proceedings of DCZMC meeting held on 07.01.2016.
As per the provisions under the Para 8 II CRZ II (i) of the CRZ Notification 2011 buildings
shall be permitted only on the landward side of the existing road, or on the landward side of existing
authorized structures and as per Para 8 II CRZ II (ii) of the CRZ Notification 2011 buildings
permitted on the landward side of the existing and proposed roads or existing authorized structures
shall be subject to the existing local town and country planning regulations including the ‘existing’
norms of Floor Space Index or Floor Area Ratio: Provided that no permission for construction of
buildings shall be given on landward side of any new roads which are constructed on the seaward
side of an existing road.
The proposal is recommended for rejection since, there is no authorized constructions or
existing road which are constructed before 1990 on seaward side of the proposed construction.

residential house at Sy. No. 192/2 of Gude Angadi Village, Kumta Taluk, Uttara
Kannada District (FEE 276 CRZ 2015).
Sri. Venkataramana Jattappa Naik has requested to issue NOC for construction of residential
house at Sy. No. 192/2 of Gude Angadi Village, Kumta Taluk, Uttara Kannada District. The Regional
Director (Environment) has inspected the proposed site and reported that project site is classified as
CRZ-III. The distance from HTL of sea is 180 mts.
The Regional Director (Environment) has submitted the proposal along with application in
the prescribed format, Sy. Map of the site, R.T.C. of the site, draft digitized map showing the proposed
area of construction and proceedings of DCZMC meeting held on 19.06.2015. The plinth area is
901.66 Sq. ft.
As per the provisions under the Para 8 III CRZ III A (ii) of the CRZ Notification 2011 No
construction shall be permitted within NDZ except for repairs or reconstruction of existing
authorized structure not exceeding existing Floor Space Index, existing plinth area and existing
density and for permissible activities under the notification including facilities essential for
activities; Construction/reconstruction of dwelling units of traditional coastal communities including
fisherfolk may be permitted between 100 and 200 metres from the HTL along the seafront in
accordance with a comprehensive plan prepared by the State Government or the Union territory in
consultation with the traditional coastal communities including fisherfolk and incorporating the

the Union territory CZMA to NCZMA for approval by MoEF.
The proposal is recommended by DCZMC for rejection since, the place of building lies in NDZ

Venkataramana Jattappa Naik for construction of residential house at Sy. No. 192/2 of Gude Angadi
Village, Kumta Taluk, Uttara Kannada District as per the recommendation of the DCZMC.
13.4.16 Request for issue of NOC from Smt. Girija Nagesh Moger for reconstruction of
residential house at Sy. No. 19A of Shirali-I Village, Bhatkal Taluk, Uttara Kannada
District (FEE 277 CRZ 2015).
Smt. Girija Nagesh Moger has requested to issue NOC for construction of residential house at
Sy. No. 19A of Shirali-I Village, Bhatkal Taluk, Uttara Kannada District. The Regional Director
(Environment) has inspected the proposed site and reported that project site is classified as CRZ-III.
The distance from HTL of sea is 110 mts.
The Regional Director (Environment) has submitted the proposal along with application in
the prescribed format, Sy. Map of the site, R.T.C. of the site, plinth area, tax paid receipt of 1988-89 to
2013-14, sewage disposal certificate, photo of old house and proceedings of DCZMC meeting held on
19.06.2015. The plinth area is 61.18 Sq. mt. The DCZMC recommended the proposal for issue of NOC
in the DCZMC meeting held on 19.06.2015.
As per the provisions under the Para 8 III CRZ III A (ii) of the CRZ Notification 2011 No

residential house at Sy. No. 21/1A2B of Shirali-I Village, Bhatkal Taluk, Uttara
Kannada District (FEE 278 CRZ 2015).
Smt. Madevi Manjunath Moger has requested to issue NOC for construction of residential
house at Sy. No. 21/1A2B of Shirali-I Village, Bhatkal Taluk, Uttara Kannada District. The Regional
Director (Environment) has inspected the proposed site and reported that project site is classified as
CRZ-III. The distance from HTL of sea is 110 mts.
The Regional Director (Environment) has submitted the proposal along with application in
the prescribed format, Sy. Map of the site, R.T.C. of the site, tax paid receipt of 1970-71 to 2013-15,
plinth area, sewage disposal certifiate, photo of old house and proceedings of DCZMC meeting held
on 19.06.2015. The plinth area is 22.42 Sq. mt.
As per the provisions under the Para 8 III CRZ III A (ii) of the CRZ Notification 2011 No

residential house at Sy. No. 76/1 of Shirali-I Village, Bhatkal Taluk, Uttara Kannada
District (FEE 280 CRZ 2015).

13.5 Other construction / reconstruction projects including Industries :
13.5.1 Request for issue of CRZ Clearance from Raftar Terminals Private Limited for the
storage of Acetic acid, MEG (Mono Ethylene Glycol), Naptha Motor Spirit at Sy. No.
46/1(P), 47/1(P), 47/2(P), 47/3(P), 47/7(P1), 47/7(P2), 47/8(P), 47/13(P),
47/14(P), 47/15, 47/16(P), 47/3P, 47/9(P), 47/10(P), 47/7(P3) of Thannirubhavi
Village, Mangalore (FEE 364 CRZ 2015).
M/s Raftar Terminals private Limited has requested CRZ clearance for the storage of Acetic
acid, MEG (Mono Ethylene Glycol), Naptha Motor Spirit at Thannirubhavi village. The Regional
Director (Environment) has inspected the proposed site and reported that project site is at distance
of 150 mts from river & 500 mts from sea (as per CZMP approved 1996). It is classified as CRZ III.
The Distance from HTL is Approximately 205mts from HTL of sea, & approximately 150 mts from
HTL of river.

The Regional Director (Environment) has inspected the site and reported that the area falls
under CRZ-III as per approved Coastal Zone Management Plan 1996. The proposal was placed in
DCZMC meeting held on 29-06-2015. The committee after discussions, deferred the case and decided
to re-inspect the site with committee members. Accordingly the committee inspected the spot on 30-
06-2015 and submitted a report for having violated the Para 3(iv) of CRZ Notification 2011. Para
3(iv) says “Land reclamation, bunding or disturbing the natural course of seawater” is prohibited
activity. But again on 09.10.2015, the committee members inspected the site and after detailed
verification, it is found that:-
1. The said area is not at all coming under the natural course of sea water and not
disturbing the natural course of seawater. Hence no voilation is noticed.
2. The said area is adjacent to the G.M.R foundation project which is being executed long
back where CRZ clearance has been obtained.
3. This land belongs to KIADB Industrial area, which is purchased on lease by M/s Raftar
Terminals private Limited.
4. In this area no Mangroves species is found.
5. The project involves storage of petrolium products i.e Naptha, Motor Spirit, Acetic acid
and Mono Etylene Glycol (MEG).
The Regional Director (Environment) has submitted the proposal for the storage of Acetic
acid, MEG (Mono Ethylene Glycol), Naptha Motor Spirit at Thannirubhavi village, submitted by M/s
Raftar Terminals private Limited, along with the application in the prescribed format, checklist,
Form-I, survey sketch of site. Karnataka Industrial Areas Development Board possession certificate,
material safety data sheet satellite image (10 Ms radius), tank farm facility layout, pipeline facility
layout, site location showing the survey numbers, contour of the Site, green area, overall area and
used area, connectivity map, pipeline road corridor, storm water layout, fire fighting layout, water
NOC, fire NOC, MESCOM NOC, aerial view of the site, CRZ map and report by IRS, Anna University,
geotechnical investigation report, risk assessment study report, copy of challan about payment of
processing fees, CZMP of the proposed site, google map, inspection report of Regional
Director(Environment), proceedings of DCZMC meeting held on 29-06-2015 & 16-11-2015. The
DCZMC recommended the proposal to issue NOC in the DCZMC meeting held on 16-11-2015 with a
condition that, the storage of Acetic acid & MEG were not there in the Annexure II of the Notification,
and they have to take necessary permission for the storage of the same from the concerned
department.
The area falls under CRZ-III as per approved Coastal Zone Management Plan. As per Para 8 III
CRZ III (iii) and (e) of the CRZ Notification 2011, the above project is a permissible activity except for
the storage of Acetic acid & MEG, for which permission may have to be obtained from the MoEF.
The Authority after discussion and deliberations had decided to send a team of officers
consisting of Sri. A. Ramesh, SEO dealing with Hazardous Waste, concerned EO of Mangalore from
KSPCB and RD, Mangalore to inspect the site and to get a report from them at the earliest before
coming to final decision regarding giving CRZ clearance for the storage of Acetic acid, MEG (Mono
Ethylene Glycol), Naptha, Motor Spirit, at Thannirubhavi Village, Mangalore.
As per the decision of the Authority, the above team inspected the spot on 07.01.2016 and

has submitted its report on 16.01.2016. In this report it is recommended that the project can be
considered for storage of motor Spirit and Naphtha and laying pipelines after taking into considering
all the aspects indicated in the report. However thje project proponent in his representation dated
14.01.2016 requested to permit the storage of Naphtha and motor spirit only.
The Authority after detailed delebrations and discussion, decided to take up site inspection
keeping in view the location of the project and sensitivity of the area and the subject is deferred.
13.5.2 Request for issue of CRZ Clearance from Sri. V. Mahesh Kamath for setting up of Yacht
School at Sy. No. 78/36, Kolchi Kambla Estuary, Bappanadu Village, Mangalore (FEE
10 CRZ 2016).
Sri. V. Mahesh Kamath has requested CRZ Clearance for setting up of Yacht School at Sy. No.
78/36, Kolchi Kambla Estuary, Bappanadu Village, Mangalore.
The Regional Director (Environment) has inspected the proposed site and reported that
project site is classified as CRZ-I. The distance from HTL of river is 60 mts.
The proposed activity involves the Yachting lessons and Sailboat rides and the site is on the
landward side of Kolchi Kambla road (10 ft. width), which later joins N.H. 66 at a distance of around
3 Kms. The proposed structure is a pre-fabricated bolt-on type temporary structure without the
need to dig foundation. The details are as follows:

CZMP of the proposed site and proceedings of DCZMC meeting held on 12.01.2016.
The DCZMC recommended the above proposal related to water sports activity to issue NOC
in the meeting held on 12.01.2016.
The area falls under CRZ-I as per approved Coastal Zone Management Plan. As per the
provisions under Para 8 I CRZ I (ii) (b) of the CRZ Notification 2011 construction of dispensaries,
schools, public rainshelter, community toilets,bridges, roads, jetties, water supply, drainage,
sewerage which are required for traditional inhabitants living within the biosphere reserves are
permitted after obtaining approval from concerned CZMA. Hence, the above project is a permissible
activity.

The Authority after discussion and deliberations decided to issue CRZ clearance to Sri. V.
Mahesh Kamath for setting up of Yacht School at Sy. No. 78/36, Kolchi Kambla Estuary, Bappanadu
Village, Mangalore as per the recommendation of the DCZMC.
13.5.3 Request for issue of NOC from Assistant Director, Fisheries Department, Udupi for
construction of II Stage Fishing port at Hejamadi Kodi, Udupi District (FEE 30 CRZ
2016).
Assistant Director, Fisheries Department, Udupi has requested to issue NOC for construction
of II Stage Fishing port at Hejamadi Kodi, Udupi District. The Regional Director (Environment) has
inspected the proposed site and reported that project site is classified as CRZ-I, III and IV. The G.P.S.
Co-ordinates are as follows:
Northern Side: N 130 05’ 16.8’, E 740 46’ 21.2’.
Southern Side: N 130 04’ 33.7”, E 740 46’ 35.2’.
The project comprises of the following principle components.
i. Provision of safe landing and berthing facilities for Mechanised Fishing Vessesls
(MFVs) to operate throughout the fishing season.
ii. Constructing of shore-based establishments and organisation of distribution and
marketing arrangements for prawn and fish products through the Fishery Terminal
Organisation (FTO) to be setup.
It is proposed to construct training walls of length 692 mts on northern side and 781 mts on
southern side at Hejmadikodi, Fish Landing Centre under this project.
The Regional Director (Environment) has submitted the proposal along with application in
the prescribed format, RTC, Survey map of the site, project report, approved CZMP sheet, draft
digitized CRZ map showing the area of proposed reconstruction and proceedings of DCZMC meeting
held on 16.01.2016. The DCZMC recommended the proposal for issue of NOC in the DCZMC meeting
held on 16.01.2016.
As per the provisions under the Para 3 (i) (a) of the CRZ Notification 2011, the above project
proposal is a permissible activity. Hence, the proposal has been submitted for deliberation and
consideration of the authority.
The Authority after discussion and deliberations decided to issue CRZ clearance to Assistant
Director, Fisheries Department, Udupi for construction of II Stage Fishing port at Hejamadi Kodi, Udupi
District as per the recommendation of the DCZMC.
13.5.4 Request for issue of NOC from M/s Agrawal Industries Corporation Ltd, Karwar Port
Installation, Bhu devi temple road for construction of Liquid Storage Tank Terminal
for storage of Molasses, Edible Oil and Bitumen at Sy. No. 21A1/21A/1&21A2/149K
of Goudwada, Baithkol Village, Karwar Taluk (FEE 4 CRZ 2016).
M/s Agrawal Industries Corporation Ltd, Karwar Port Installation, Bhu Devi Temple road has
requested to issue NOC for construction of Liquid Storage Tank Terminal to store Molasses, Edible

Oil and Bitumen at Sy. No. 21A1/21A/1&21A2/149K of Goudwada, Baithkol Village, Karwar Taluk.
The storage capacity of the tank terminal is 20000-22000 KL and there are 3 dedicated pipeline link
of 1.3 Km length each from Karwar Port. The Regional Director (Environment) has inspected the
proposed site and reported that project site is at jurisdication of 150 mts from HTL of River (as per
CZMP approved 1996). It is classified as CRZ-III. The distance from HTL of sea is 30.22 mts.
The G.P.S. readings is N 140 47’ 39.7’,
E 740 06’ 30.0’.
The Regional Director (Environment) has submitted the proposal along with application in
the prescribed format, Site inspection report, approved CZMP map sheet, draft digitized map
showing the proposed area of construction, R.T.C. of the site, Project layout, EIA report and
proceedings of DCZMC meeting held on 07.01.2016. The DCZMC recommended the proposal for
issue of NOC in the DCZMC meeting held on 07.01.2016, for the storage of edible oils excluding
Molasses and Bitumen.
As per the provisions under the Para 8 III CRZ III A (iii) (e) of the CRZ Notification 2011
facilities for receipt and storage of petroleum products and liquefied natural gas as specified in
Annexure-II are permitted and as per Para 8 III CRZ III B (iv) of the CRZ Notification 2011 provision
is there for storage of non-hazardous cargo such as, edible oil, fertilizers, food grain in notified ports.
But, as per Para 8 III CRZ III A (i) of the CRZ Notification 2011. The NDZ shall not be applicable in
such area falling within any notified port limits. The storage of Bitumen and Molasses are not
included in Annexure-II of the CRZ Notification 2011. Subsequently the project proponent in his
representation submitted on 10.12.2015, stated that Bitumen and Molasses are non hazardous and
also not listed as per Hazardous Raw Material Notification 2000 and its amendments thereof.

As per the provisions under Para 4 (ii) (b) of the CRZ Notification 2011 construction
activities relating to projects of Department of Atomic Energy or Defence requirements for which
foreshore facilities are essential such as, slipways, jetties, wharves, quays; except for classified
operational component of defence projects. Residential buildings, office buildings, hospital
complexes, workshops of strategic and defence projects in terms of EIA notification, 2006 and as per
Para 8 III CRZ III A (iii) (j) of the CRZ Notification 2011 construction of dispensaries, schools, public
rain shelter, community toilets, bridges, roads, provision of facilities for water supply, drainage,
sewerage, crematoria, cemeteries and electric sub-station which are required for the local
inhabitants may be permitted on a case to case basis by CZMA. As per Para 8 III CRZ III B (viii) of the
CRZ Notification 2011 Construction of public rain shelters, community toilets, water supply
drainage, sewerage, roads and bridges are permissible and CZMA may also permit construction of
schools and dispensaries for local inhabitants of the area for those panchayats, the major part of
which falls within CRZ if no other area is available for construction of such facilities.
But, it is observed from the DCZMC meeting proceedings that the construction activity of the
project has been taken up before obtaining prior CRZ Clearance and hence it becomes violation.
Action as per section 19 of EP Act 1986 and as per MoEF Memorandum dated: 12.12.2012 credible
action has to be initiated for not taking prior CRZ clearance.
The Authority after discussion and deliberations decided not to issue CRZ clearance to Dr.

occupation of tourist or visitors for construction of beach resorts or hotels has to be obtained.
But, it is observed from the DCZMC meeting proceedings that the proponent has not
submitted NOC from Karnataka State Pollution Control Board/Central Pollution Control Board.

Director of Fisheries Harbours, Malpe Udupi for construction of Training Walls Groynes for
development of Fish Landing Centres at Alvekodi & Tenginagundi Village, Bhatkal Taluk, Uttara
Kannada District as per the recommendation of the DCZMC with a condition that the proponent should
submit NOC from Karnataka State Pollution Control Board/Central Pollution Control Board, Project
layout, R.T.C and to pay the processing fee immediately.

Road for storage of Caustic Soda at Sy. No. 27A, 27C & 27D of Baithkol Village, Karwar
Taluk, Uttara Kannada District (FEE 3 CRZ 2016).
M/s Konkan Storage System Private Limited, Sea Bird Road has requested to issue NOC for
storage of Caustic Soda at Sy. No. 27A, 27C & 27D of Baithkol Village, Karwar Taluk, Uttara Kannada
District. The Regional Director (Environment) has inspected the proposed site and reported that
project site is at jurisdication of 500 mts from HTL of Sea (as per CZMP approved 1996). It is
classified as CRZ-III. The distance from HTL of sea is 250 mts. The G.P.S. readings are N 140 47’ 38.9’,
E 740 06’ 42.0’.
Ministry of Environment and Forest, Government of India has accorded Environmental
Clearance under the CRZ Notification, 1991 for establishment of storage tank terminal for M/s
Konkan Storage System Private Limited for storage of Petroleum products, molasses and edible oil
vide letter No. 11-32/2006-IA-III, dated:31.07.2006.
The Regional Director (Environment) has submitted the proposal along with application in
the prescribed format, Site inspection report, Sy. Map in site, Project report, Lease Agreement,
approved CZMP map sheet, Registration copy of the M/s Konkan Storage System Pvt., Ltd., under the
rules of Government of Karnataka, NOC from Government of India, MoEF, New Delhi for storage of 6
terminal tanks for storage of Petroleum products, edible oil & Molasses, draft digitized map showing
the proposed area of construction and proceedings of DCZMC meeting held on 07.01.2016. The
DCZMC recommended the proposal for issue of NOC in the DCZMC meeting held on 07.01.2016
considering Caustic Soda as a raw product in the manufature of fertilizers.
As per the provisions under the Para 3 (ii) (b) of the CRZ Notification 2011 facilities for
receipt and storage of petroleum products and liquefied natural gas as specified in Annexure-II

appended to this notification and facilities for regasification of Liquefied Natural Gas (hereinafter
referred to as the LNG) in the areas not classified as CRZ-I (i) subject to implementation of safety
regulations including guidelines issued by the Oil Industry Safety Directorate in the Ministry of
Petroleum and Natural Gas and guidelines issued by MoEF and subject to further terms and
conditions for implementation of ameliorative and restorative measures in relation to environment
as may be stipulated by in MoEF. Provided that facilities for receipt and storage of fertilizers and raw
materials required for manufacture of fertilizers like ammonia, phosphoric acid, sulphur, sulphuric
acid, nitric acid and the like, shall be permitted within the said zone in the areas not classified as
CRZ-I (i). In this provision Caustic Soda is not mentioned specifically as a raw material required for
manufacture of fertilizers. Hence, this may be recommended to MoEF for CRZ clearance at NCZMA.
The Authority after discussion and deliberations decided to refer the proposal to MoEF for
further needful action regarding the issue of CRZ clearance to M/s Konkan Storage System Private
Limited, Sea Bird Road for storage of Caustic Soda at Sy. No. 27A, 27C & 27D of Baithkol Village,
Karwar Taluk, Uttara Kannada District.
13.5.12 Request for issue of NOC from Mysore Mercantile Co., Ltd., for setting up
Warehousing facility of 26088 KL Liquid Cargo Terminal with connecting pipeline
from jetty to storage tank at Sy. No. 1379 of Baad-III (Aligadda) Village, Karwar
Taluk, Uttara Kannada District (FEE 11 CRZ 2016).
Mysore Mercantile Co., Ltd., has requested to issue NOC for setting up Warehousing facility of
26088 KL Liquid Cargo Terminal with connecting pipeline from jetty to storage tank to store
Molasses, Edible Oil, Plam Oil, Kerosene, Aviation Fuel, High Speed Diesel, Lubrication Oil, Furnace
Oil, Low Sulphar Heavy Stock at Sy. No. 1379 of Baad-III (Aligadda) Village, Karwar Taluk, Uttara
Kannada District. The Regional Director (Environment) has inspected the proposed site and
reported that project site is at jurisdication of 100 mts from HTL of River (as per CZMP approved
1996). It is classified as CRZ-III. The distance from HTL of sea is 305 mts. The G.P.S. readings are N
140 48’ 01.0’, E 740 07’ 22.3’.
The Regional Director (Environment) has submitted the proposal along with application in
the prescribed format, Site inspection report, R.T.C. of the site, Project report, EIA Report, approved
CZMP map sheet, draft digitized map showing the proposed area of construction and proceedings of
DCZMC meeting held on 07.01.2016. The DCZMC recommended the proposal for issue of NOC in the
DCZMC meeting held on 07.01.2016 for the storage of all other products except Molasses.
As per the provisions under the Para 8 III CRZ III A (iii) (e) and Para 8 III CRZ III B (ii) of the
CRZ Notification 2011 facilities for receipt and storage of petroleum products and liquefied natural
gas as specified in Annexure-II; and as per Para 8 III CRZ III B (iv) of the CRZ Notification 2011
storage of non-hazardous cargo such as, edible oil, fertilizers, food grain in notified ports are
permissible. The storage of Molasses is not included in Annexure-II of the CRZ Notification 2011.
However the project proponent in his representation dated 25.01.2016 has requested to accord NOC
including the product ‘Molasses’ as it is a non hazardous in nature.

subject to the existing local town and country planning regulations including the ‘existing’ norms of
Floor Space Index or Floor Area Ratio: Provided that no permission for construction of buildings shall
be given on landward side of any new roads which are constructed on the seaward side of an existing
road. Hence, the above project is a permissible activity.
The Authority after discussion and deliberations decided to issue CRZ clearance to Sri. Prakash
Kamath S/o Venkatesha Kamath and Smt. Latha Kamath W/o Prakash Kamath for construction of
residential house (A Block) at Sy. No. 28/1A(P) of Hosabettu Village in Mangalore City Corporation Limits
as per the recommendation of the DCZMC.
13.6.2 Request for issue of CRZ Clearance from Mr. Isaac Vas M/s. Jyothi Advertisers for
temporary (dismantle able) eco friendly structure for the purpose of restaurant with
permit room for tourists visiting panambur beach (FEE 74 CRZ 2016).

mts to 30 mts from HTL of River and 180 mts from HTL of Sea. It is classified at CRZ-II. The G.P.S.
readings are as follows:

13.7 The Authority after deliberation and discussion decided to hold the Authority meeting
on last Saturday of every month for speedy disposal of the cases and if last Saturday
happens to be a holiday, then the meeting will be held on last Friday of the month after
approval of new CZMP Maps / extension of validity for using already approved plans
from MoEF.
