relating to garage and rummage sales;the regulation of peddlers, solicitors andtransient merchants; restricting garageand rummage sales that occur duringthe time period coinciding with the eventknown as Downtown Oronoco Gold Rush;exempting participants therein from certainregulations; amending the provisions ofTitle 500, Section 504, paragraph 504.2and Section 508, paragraph 508.2 ofthe Oronoco City Code.
The City Council of the City of Oronoco,Minnesota, does ordain.
Section 1. The provisions of the title500, section 504, paragraph 504.2, of
the Oronoco City Code are amended toread:

3. There shall be no more than sixgarage or rummage sales conducted atany one premises during any period of12 calendar months.
4. No garage or rummage sale shallbe conducted during any part of morethan four consecutive days.
5. No garage or rummage sale maybe conducted before 7 a.m. or aftersundown.
6. No garage or rummage sale maybe conducted on the day prior to thebeginning of the annual community saleconducted by the organization knownas Oronoco Downtown Gold Rush Days,Inc.; and if conducted during the sametime period, the hours such garage orrummage sale may be conducted shallbe same as that of the sale activityauthorized by Oronoco Downtown GoldRush Days, Inc.
7. Any related signage shall be lim-ited to the premises and to other resi-dential property provided permission fromthe property, owner is obtained, andshall be removed at the termination ofthe sale. All signs shall be kept off thepublic right of way.

Theterms shall not apply to any person whomakes initial contacts with other peoplefor the purpose of establishing or tryingto establish a regular customer deliveryof perishable food and dairy productssuch as baked goods and milk, nor shallthey apply to any person making deliver-ies of perishable food and dairy prod-ucts to customers on his or her estab-lished regular delivery route.

Persons conduct-ing the type of sales commonly knownas garage sales, rummage sales, or es-tate sales shall be exempt from the defi-nition of peddler, solicitor, and transientmerchant, as shall be anyone conduct-ing an auction as a properly licensedauctioneer, or any officer of the courtconducting a court-ordered sale. Exemptionfrom the definitions for the scope of thissection shall not excuse any person fromcomplying with any other applicable statu-tory provision or local ordinance.

A person acting as a peddler, solici-tor, or transient merchant during thetime period of an annual communitysale event sponsored by the organiza-tion known as Downtown Oronoco GoldRush Days, Inc., who is conducting suchactivity in conjunction with and regis-tered with the sponsoring organizationas a part of such event, shall otherwisebe exempt from the licensing and regis-tration requirements of this section.

Persons engaging in door-to-dooradvocacy shall not be required to regis-ter as solicitors. The term door-to-dooradvocacy includes door-to-door canvassingand pamphleteering as vehicles for thedissemination of religious, political andother ideas.
Section 3. This ordinance shall beeffective from and after its publication.
