Introduction

This Introduction is not part of the Licence conditions.

DER's industry licensing role The Department of Environment Regulation (DER) is a Government Department for the State of Western Australia in the portfolio of the Minister for Environment. DER's purpose is to protect and conserve the State's environment on behalf of the people of Western Australia.

DER has responsibilities under Part V of the Environmental Protection Act 1986 (the Act) for the licensing of prescribed premises. Through this process DER works with the business owners, community, consultants, industry and other representatives to prevent, control and abate pollution and environmental harm to conserve and protect the environment. DER also monitor and audit compliance with works approvals and licence conditions, take enforcement action as appropriate and develop and implement licensing and industry regulation policy.

Licence requirements This licence is issued under Part V of the Act. Conditions contained within the licence relate to the prevention, reduction or control of emissions and discharges to the environment and to the monitoring and reporting of them.

Where other statutory instruments impose obligations on the Premises/Licensee the intention is not to replicate them in the licence conditions. You should therefore ensure that you are aware of all your statutory obligations under the Act and any other statutory instrument. For your Premises relevant statutory instruments include but are not limited to obligations under the:

• Environmental Protection (Unauthorised Discharges) Regulations 2004 — these Regulations make it an offence to discharge certain materials such as contaminated stormwater into the environment other than in the circumstances set out in the Regulations.

• Environmental Protection (Controlled Waste) Regulations 2004 - these Regulations place obligations on you if you produce, accept, transport or dispose of controlled waste.

• Environmental Protection (Noise) Regulations 1997 — these Regulations require noise emissions from the Premises to comply with the assigned noise levels set out in the Regulations.

You must comply with your licence. Non-compliance with your licence is an offence and strict penalties exist for those who do not comply.

Licence holders are also reminded of the requirements of section 53 of the Act which places restrictions on making certain changes to prescribed premises unless the changes are in accordance with a works approval, licence, closure notice or environmental protection notice.

Licence fees If you have a licence that is issued for more than one year, you are required to pay an annual licence fee prior to the anniversary date of issue of your licence. Non payment of annual licence fees will result in your licence ceasing to have effect meaning that it will no longer be valid and you will need to apply for a new licence for your Premises. Operating without a licence is an offence under the Act.

Ministerial conditions If your Premises has been assessed under Part IV of the Act you may have had conditions imposed by the Minister for Environment. You are required to comply with any conditions imposed by the Minister.

Premises description and Licence summary The Shire of Bruce Rock operates the Bruce Rock Waste Management Facility. Bruce Rock is approximately 254 km east of Perth. It has a population of approximately 700 people, with 1,200 people in the Shire.

The landfill has been operating on the site for approximately 50 years and is accessed from Depot Road. It is located approximately 2.3km south-east of the Bruce Rock town site and is surrounded by farm land. The nearest residence is also 2.3 km from the Premises boundary. The Premises covers an area of 51 ha in a geologically stable area with impermeable clay soils (tested to be at least 2x10. 10 metres per second) and on a less than 5 degree slope. Depth to groundwater is expected to be greater than 19 metres below ground level and there is no surface water or wetlands in the area. The facility was recently upgraded and expanded under works approval (W5303/2012/1) which is expected to provide 32 years landfill space.

The facility receives waste deposited by the general public and municipal waste collection. The Premises is divided into a public area consisting of signed material set down areas (MSDAs) that are located on a bunded concrete hardstand, and a restricted area, only accessed by the landfill operator which includes the landfill cells and liquid waste evaporation ponds. Municipal waste is deposited directly into the landfill cells and the MSDA is cleared and sorted / processed at least twice a week by the operator.

The MSDA (waste transfer area), evaporation ponds and active landfill area is fenced with 1.8 m high security fencing, while the remainder of the premises is fenced with stock-proof fencing. While the site is not manned, public access is restricted to a defined area which is monitored by surveillance cameras. Stormwater is managed by bunding and drains.

The main potential emissions from the site are fugitive dust and odour emissions. Windblown litter and flies and pests may be a problem if waste is not buried regularly with adequate cover material. The Premises is managed by a DER endorsed management plan and rehabilitation plan.

This Licence is the result of an amendment to the licensed facility (L6784/1997/16) which has been upgraded and expanded under works approval W5303/2012/1.

Licence conditions

1 General

1.1 Interpretation

1.1,1 In the Licence, definitions from the Environmental Protection Act 1986 apply unless the contrary intention appears.

1.1.2 For the purposes of this Licence, unless the contrary intention appears:

"Acceptance Criteria" takes its meaning from the Landfill Waste Classification and Waste Definitions 1996 (as amended December 2009);

"the Act" means the Environmental Protection Act 1986;

"annual period" means the inclusive period from 1 July until 30 June in the following year;

"approved" and "approval" means approved and approval in writing respectively;

"asbestos" means the asbestiform variety of mineral silicates belonging to the serpentine or amphibole groups of rock-forming minerals and includes actinolite, amosite, anthophyllite, chrysolite, crocidolite, tremolite and any mixture containing 2 or more of those;

"asbestos fibres" has the meaning defined in the Guidelines for Assessment, Remediation and Management of Asbestos Contaminated Sites, Western Australia, (DOH, 2009);

"buffer" means the distance from the boundary of the premises to any area on the premises used for disposal, storage or transfer of waste;

"Clean Fill" has the meaning defined in Landfill Waste Classification and Waste Definitions 1996 (As amended December 2009), published by the CEO and as amended from time to time;

"cover material" means subsoil or other approved inert waste used for covering of waste;

"Code of Practice for the Storage and handling of dangerous goods" means the Storage and handling of dangerous goods, Code of Practice, Department of Mines and Petroleum, Government of Western Australia;

"Contaminated Solid Waste" has the meaning defined in Landfill Waste Classification and Waste Definitions 1996 (As amended December 2009) published by the CEO and as amended from time to time;

"controlled waste" has the definition in Environmental Protection (Controlled Waste) Regulations 2004;

"dangerous goods" has the meaning defined in the Dangerous Goods Safety (Storage and Handling of Non-explosives) Regulations 2007;

"designated burning area" means an area of the premises that has been designated by the licensee as a designated burning area, and which:

(a) is at least fifty (50) metres from the premises boundary; (b) has no flammable material on it, other than the greenwaste and live trees, for a radius of

fifty (50) metres; (c) is positioned in the area of the site where waste (other than the greenwaste to be

burned) has not been deposited; and (d) is at least five hundred (500) metres from any person's residence or place of

employment (other than the premises), or an educational institution, hospital or other public place;

"Director" means Director, Environmental Regulation Division of the Department of Environment Regulation for and on behalf of the Chief Executive Officer as delegated under section 20 of the Environmental Protection Act 1986;

"Director" for the purpose of correspondence means;

"environmentally hazardous material" means material (either solid or liquid raw materials, materials in the process of manufacture, manufactured products, products used in the manufacturing process, by-products and waste) which if discharged into the environment from or within the premises may cause pollution or environmental harm. Note: Environmentally hazardous materials include dangerous goods where they are stored in quantities below placard quantities. The storage of dangerous goods above placard quantities is regulated by the Department of Mines and Petroleum;

"Fire Control Officer" means a person who holds current and recognised qualifications in fire fighting and fire control as are specified in the licence and that person is appointed to the position of Fire Control Officer by the licensee;

"freeboard" means the distance between the maximum water surface elevations and the top of retaining banks or structures at their lowest point;

"fugitive emissions" means all emissions not arising from point sources identified in sections 2.6;

"garden waste or green waste" means biodegradable waste comprising plants and their component parts such as flower cuttings, hedge trimmings, branches, grass, leaves, plants, seeds, shrub and tree loppings, tree trunks, tree stumps and similar materials and includes any mixture of those materials;

"hardstand" means a surface with a permeability of 10-9 metres/second or less;

"Hazardous waste" has the meaning defined in Landfill Waste Classification and Waste Definitions 1996 (As amended December 2009), published by the CEO and as amended from time to time;

"Inert Waste Type 1" has the meaning defined in Landfill Waste Classification and Waste Definitions 1996 (As amended December 2009), published by the CEO and as amended from time to time;

"Inert Waste Type 2" has the meaning defined in Landfill Waste Classification and Waste Definitions 1996 (As amended December 2009), published by the CEO and as amended from time to time;

"Inert Waste Type 3" has the meaning defined in Landfill Waste Classification and Waste Definitions 1996 (As amended December 2009) published by the CEO and as amended from time to time;

"Landfill Waste Classification and Waste Definitions 1996 (As amended December 2009)" means the document entitled "Landfill Waste Classification and Waste Definitions 1996 (As amended December 2009) published by the Chief Executive Officer and as amended from time to time;

"Licence" means this Licence numbered L6784/1997/16 and issued under the Environmental Protection Act 1986;

"Licensee" means the person or organisation named as Licensee on page 1 of the Licence;

"Premises" means the area defined in the Premises Map in Schedule 1 and listed as the Premises address on page 1 of the Licence;

"putrescible waste" means the component of the waste stream likely to become putrid — including wastes that contain organic materials such as food wastes or wastes of animal or vegetable origin, which readily bio-degrade within the environment of a landfill, as defined in the document titled Landfill Waste Classification and Waste Definition 1996 (as amended December 2009);

"rehabilitation" means the completion of the engineering of a landfill cell and includes capping and/or final cover;

"Schedule 1" means Schedule 1 of this Licence unless otherwise stated;

"Schedule 2" means Schedule 2 of this Licence unless otherwise stated;

"solid waste" has the meaning defined in Landfill Waste Classification and Waste Definitions 1996 (As amended December 2009) published by the CEO and as amended from time to time;

"Special Waste Type 1" has the meaning defined in Landfill Waste Classification and Waste Definitions 1996 (As amended December 2009) published by the CEO and as amended from time to time;

"Special Waste Type 2" has the meaning defined in Landfill Waste Classification and Waste Definitions 1996 (As amended December 2009) published by the CEO and as amended from time to time;

"tipping area" means the area of the landfill where waste currently being brought to the site is being deposited;

"usual working day" means 0800 — 1700 hours, Monday to Friday excluding public holidays in Western Australia; and

"waste" has the meaning defined in the Environmental Protection Act 1986.

1.1.3 Any reference to an Australian or other standard in the Licence means the relevant parts of the current version of that standard.

1.1.4 Any reference to a Guideline or Code of Practice in the Licence means the current version of the Guideline or Code of Practice.

1.2 General conditions

1.2.1 Nothing in the Licence shall be taken to authorise any emission that is not mentioned in the Licence, where the emission amounts to: (a) pollution; (b) unreasonable emission; (c) discharge of waste in circumstances likely to cause pollution; or (d) being contrary to any written law.

1.2.2 The Licensee shall operate and maintain all pollution control and monitoring equipment to the manufacturer's specification or any relevant and effective internal management system.

1.2.3 The Licensee, except where storage is prescribed in section 1.3, shall ensure that environmentally hazardous materials are stored in accordance with the Code of Practice for the Storage and handling of dangerous goods.

1.2.4 The Licensee shall immediately recover, or remove and dispose of spills of environmentally hazardous materials outside an engineered containment system.

1,2.5 The Licensee shall: (a) implement all practical measures to prevent stormwater run-off becoming

contaminated by the activities on the Premises; and (b) treat contaminated or potentially contaminated stormwater as necessary prior to

being discharged from the Premises.' Notel: The Environmental Protection (Unauthorised Discharges) Regulations 2004 make it an offence to discharge certain materials into the environment.

1.3 Premises operation

1.3.1 The Licensee shall only accept waste on to the Premises for burial if: (a) it is of a type listed in Table 1.3.1; (b) the quantity accepted is below any quantity limit listed in Table 1.3.1; (C) it meets any specification listed in Table 1.3.1; and (d) where contaminated solid waste is received, it is supported by documentation that

demonstrates compliance with the acceptance criteria for Class II landfills.

1.3.2 The Licensee shall ensure that where waste does not meet the waste acceptance criteria set out in condition 1.3.1 of this Licence, it is removed from the Premises by the delivery vehicle or, where that is not possible, the Licensee shall contact the Director to agree a course of action in relation to the waste.

1.3.3 The Licensee shall ensure that wastes accepted onto the Premises are only subjected to the process(es) set out in table 1.3.2 and in accordance with any process limits described in that Table.

(iv) in batches separated from each other by at least 100 mm of soil and each not consisting of more than 100 tyres.

Inert Waste Type 3 (dried wastewater treatment sludge)

To be covered within 24 hours of delivery.

Putrescible waste Municipal waste to be covered within 24 hours of delivery.

shall be restricted to authorised persons only. (iii) The licensee, or representative of the licensee

must witness and sign the register to condition 5.1.5 within 2 hours to attest that it has been

• buried in accordance with the conditions of this licence.

(iv) Not to be deposited within 1 m of the final tipping surface of the landfill.

(v) No works shall be carried out on the landfill that could lead to a release of asbestos fibres.

Special Waste Type 2 (biomedical / clinical)

(i) The waste must be buried in designated cell immediately.

(ii) Access to the area where the waste is buried shall be restricted to authorised persons only.

(iii) The licensee, or representative of the licensee must witness and sign the register to condition 5.1.5 within 2 hours to attest that it has been buried in accordance with the conditions of this licence.

(iv) No works shall be carried out on the landfill that could lead to biomedical wastes being exposed or uncovered.

Hazardous waste Receipt, handling, associated storage prior to the disposal by landfilling, or recycling off-site

(i) Stored in designated receptacle or on a hardstand in a bunded area.

Green waste Receipt, handling, stockpiling and disposal by mulching, composting or burning

Green waste is to be stored in piles no greater than 4 m in height and no more than 1000 m in volume with a 6 m fire break between piles.

Where green waste is unable to be mulched or composted, and green waste is required to be burnt at the premises, the Licensee, or a person nominated by the Licensee, shall: (i) ensure the green waste is dry and seasoned

for at least two (2) months before being burned;

(ii) ensure the green waste is burned in a designated burning area;

(iii) provide an adequate water supply and distribution system to prevent fires from escaping beyond the designated burning area;

(iv) burn green waste in a manner to minimise smoke generation;

(v) burn green waste in windrows or trenches; (vi) ensure burning does not commence before

0800 hours and the Fire Control Officer for the premises declares the area safe by 1200 hours on the same day; and

(vii) ensure from the time burning commences until the Fire Control Officer for the premises declares the area safe, there is/are:

1.3.4 The Licensee shall ensure that septage waste is only stored and/or treated within vessels or compounds provided with the infrastructure detailed in Table 1.3.3.

1.3.5 The Licensee shall manage the landfilling activities to ensure: (a) Waste is placed in a defined trench or within an area enclosed by earthern or other

bunds; (b) the size of the tipping face is kept to a minimum and not larger than 30 m by 2 m; (c) waste is levelled and compacted to ensure all faces are stable and capable of

retaining rehabilitation material; (d) rehabilitation of a cell or phase takes place after disposal in that cell or phase within

12 months after disposal in that cell or phase has been completed;

1.3.6 The Licensee shall ensure that cover is applied and maintained on landfilled wastes in accordance with Table 1.3,4 and that sufficient stockpiles of cover are maintained on site at all times.

1.3.7 The Licensee shall ensure that vermin, birds, flies and other insects do not give rise to nuisance at the premises or in the immediate area of the premises. Any method used by the Licensee shall not cause environmental pollution.

1.3.8 The Licensee shall manage all wastewater evaporation and storage ponds such that: (a) overtopping of the ponds does not occur; (b) a freeboard at or greater than 500 mm is targeted; (c) the integrity of the containment infrastructure is maintained; and (d) vegetation and floating debris (emergent or otherwise) is prevented from encroaching

onto pond surfaces or inner pond embankments.

1.3.9 The Licensee shall ensure that all stormwater drains and sumps on the Premises are kept clear of any waste to allow effective drainage.

Fencing and wind-blown wastes

1.3.10 The Licensee shall: (a) implement security measures at the site to prevent as far as is practical unauthorised

access to the site; (b) undertake regular inspections of all security measures and repair damage as soon as

practicable; and (c) ensure the entrance gates to restricted access areas are closed and locked when the

site is unattended.

1.3.11 The Licensee shall take all reasonable and practical measures to ensure that no windblown waste escapes from the Premises and that windblown waste is collected on at least a weekly basis and returned to the tipping area.

1.3.12 The Licensee shall ensure that there are appropriate procedures in place at the Premises so that any unauthorised fire is promptly extinguished.

1.3.13 The Licensee shall notify the Director if an unauthorised fire has not been extinguished within two (2) hours.

1.3.14 The Licensee shall provide to the Director a report detailing but not limited to, the following information: (a) details of the date, time and location of the unauthorised fire; (b) the time the unauthorised fire was declared safe by the Fire Control Officer for the

Premises; and (c) the cause, or suspected cause, of the unauthorised fire.

1.3.15 The Licensee shall provide the report referred to in condition 1.3.14 of this licence within fourteen (14) days of the fire,

1.3.16 The Licensee shall maintain a sign at the entrance to the Premises which clearly displays the following information: (a) a contact telephone number for information and complaints or notification of fires; (b) a list of materials that are accepted at the Premises; (c) the type of waste that must not be deposited on the Premises and a contact

2 Emissions

5 Information

5.1 Records

5.1.1 All information and records required by the Licence shall: (a) be legible; (b) if amended, be amended in such a way that the original and subsequent

amendments remain legible or are capable of retrieval; (c) except for records listed in 5.1.1(d) be retained for at least 6 years from the date the

records were made or until the expiry of the Licence or any subsequent licence; and (d) for those following records, be retained until the expiry of the Licence and any

subsequent licence: (i) off-site environmental effects; or (ii) matters which affect the condition of the land or waters.

5.1.2 The Licensee shall ensure that: (a) any person left in charge of the Premises is aware of the conditions of the Licence

and has access at all times to the Licence or copies thereof; and (b) any person who performs tasks on the Premises is informed of all of the conditions of

the Licence that relate to the tasks which that person is performing.

5.1.3 The Licensee shall complete an Annual Audit Compliance Report indicating the extent to which the Licensee has complied with the conditions of the Licence, and any previous licence issued under Part V of the Act for the Premises for the previous annual period.

5.1.4 The Licensee shall implement a complaints management system that as a minimum records the number and details of complaints received concerning the environmental impact of the activities undertaken at the Premises and any action taken in response to the complaint.

5.1.5 The Licensee shall: (a) implement and maintain a system which ensures that a record is made of:

(i) the waste types and quantities accepted at the Premises; (ii) the waste types and quantities disposed of at the site; (iii) where appropriate the amount of landfill levy payable in respect of the waste; (iv) the waste types and quantities removed or rejected from the Premises,

including the reasoning; and (v) any documentary evidence to demonstrate compliance with the Class II landfill

acceptance criteria. (b) Maintain a register of the Special Waste Type 1 and Special Waste Type 2 disposed

of at the Premises which shall include:

5.2 Reporting

5.2.1 The Licensee shall submit to the Director an Annual Environmental Report within 90 calendar days after the end of the annual period. The report shall contain the information listed in Table 5.2.1 in the format or form specified in that table.

This Environmental Assessment Report (EAR) has been drafted for the purposes of detailing information on the management and mitigation of emissions and discharges from the prescribed premises. The objective of the EAR is to provide a risk assessment of emissions and discharges, and information on the management of other activities occurring onsite which are not related to the control of emissions and discharges from the prescribed premises activity. This does not restrict the Department of Environment Regulation (DER) to assessing only those emissions and discharges generated from the activities that cause the premises to become prescribed premises.

Basis of Assessment The Shire of Bruce Rock Landfill (Bruce Rock) has been assessed as "prescribed premises" category number 64 under Schedule 1 of the Environmental Protection Regulations 1987.

The Shire of Bruce Rock Landfill is a class II facility and currently accepts waste from within and around the Shire of Bruce Rock for disposal on the site. The Shire has redeveloped and expanded

the existing landfill site (L6784) under Works Approval W5303/2012/1. This included the construction of new in-situ clay-lined trench cells for the disposal of domestic and commercial waste, new septage ponds to cater for liquid wastes and other necessary infrastructure for the acceptance of recyclable material in a "material set down area". A partial compliance document was provided on 15 October 2013 with the request to amend the existing licence to reflect the new operating environment.

The intent of this EAR is to assess potential environmental impacts of emissions and discharges associated with the operational phase of the upgraded landfill. Subsequent to construction works being completed in accordance with section 56 of the EP Act, an amendment to the current licence is being undertaken to enable operation of the new infrastructure.

1.0 BACKGROUND

1.1 GENERAL COMPANY DESCRIPTION The Shire of Bruce Rock is situated approximately 254 kilometres (km) east of Perth. The town of Bruce Rock has a population of approximately 700 people, with 1200 people in the shire.

Established in 1913, the Shire of Bruce Rock has an area 2726.9 km2 and includes the towns of Ardath, Babakin, Belka, Erikin, Kwolyin, Shackleton and Yarding. The landfill currently only services the Bruce Rock townsite.

Economically the area depends on cropping of cereals, primarily wheat, but also barley, lupins and peas. The town is a receiving site for Cooperative Bulk Handling. Livestock such as sheep, goats and pigs are also raised in the area.

The new landfill site is located along the northern border of the existing landfill site L6784/1997/15. This existing landfill has been located and operating at this site for approximately 50 years.

1.2 LOCATION OF PREMISES The premises is surrounded by cleared farmland. The surrounding area is principally used for cropping. The new extended premises in which the landfill cells are located are only accessed by the landfill operator through the old landfill site which is now being used as a solid waste depot. Public access will be restricted to the drop-off of waste and recyclables at the existing site proposed for redevelopment off Depot Road.

The nearest residence or building is 2.3 km to the east of the Bruce Rock landfill site. The town of Bruce Rock is also approximately 2.3 km from the premise boundary. There is no surface water or wetlands in the area. The slope of the site is less than 5 degrees.

The location of the premise is in a geologically stable area. The Bruce Rock catchment is underlain by highly weathered Archean granite and gneiss bedrock. The site is located on clayey soils with a dolerite seam directly beneath the site. The permeability, ,of the clayey soil at the landfill site is very low (tested to be at least 2x10-1° metres per second) and the approximate depth to the highest known aquifer or water table beneath the site is 19 metres (m). Three new groundwater monitoring bores have been established at the new site to determine groundwater background quality and water table levels; however these were dry at the time of testing. Existing offsite bores, closer to town, indicate a salinity of 67 pm/cm and a pH of 3.8. The groundwater is estimated to flow to the southeast.

Bruce Rock has hot, dry summers and mild winters with an average maximum temperature of 25°C and an average minimum temperature of 10.5°C. The average annual rainfall is 329.5 millimeters,

with the wettest months being from May until August. Prevailing winds dominate from the south-east in January to March; north-east in April and May, and July to September; strong north-westerlies in June (associated with cold fronts); and variable winds during October and November.

The land is not subject to any native title claim under the Commonwealth Native Title Act 1993.

1.3 PROPOSAL DESCRIPTION

Solid Wastes With the upgrade and expansion of the facility (to the north), the old landfill area has been rehabilitated and is now the public waste deposition area known as a Materials Set Down Area (MSDA) where the public will be able to deposit putrescible waste, green waste, recyclable materials supplementary to the municipal waste collected through a kerb-side collection service. The majority of public waste material will be received in this area. However, a percentage of waste (such as asbestos and clinical I biomedical waste) will be directed, under controlled access, to the landfill area at the discretion of the site supervisor. The rest of the old landfill area continues to be rehabilitated (including revegetation).

Bruce Rock has also moved its existing recycling collection point in town on Latham Street to the landfill site to consolidate its waste management. While operating under the licensing threshold, recyclable materials include steel, used oil, metal and DrumMUSTER pesticide containers will be kept in areas within concrete partitions at the waste management facility within the landfill site.

The Shire of Bruce Rock has developed an operational and management plan of the new landfill based on the Victorian EPA's document, Best Practice Environmental Management Siting, Design, Operation & Rehabilitation of Landfills (2010), titled the Shire of Bruce Rock Landfill Site Procedure Manual, Shire of Bruce Rock, 2013.

The site will receive: • Putrescible waste; • Clean fill, • Household hazardous materials (used oil, vehicle batteries, paint etc) • Contaminated solid waste meeting acceptance criteria for Class Ill landfills; • Type 1, 2 3 inert wastes; • green waste • Type 1 and Type 2 special wastes; and • Liquid waste (septic tank pump-outs).

The Works approval W5303/2012/1 still remains active to enable the construction of landfill cells as needed; it expires on 13 January 2015. The following infrastructure has been constructed as part of this works approval:

• Perimeter fencing with a separate public and restricted access area • One landfill cell is completed; remaining 66 clay-lined landfill trench cells to be

constructed as is needed • Two secure septage evaporation ponds • Asbestos disposal burial cell • Medical waste and animal burial cell • Designated tyre burial cell • Raised concreted material set down area with 1.8 m screen fence • Bunded and roofed used oil receptor area • Drum muster compound

• 5 depositor bunkers for recycling and processing material • Defined green waste burning area

Other infrastructure to be installed or constructed in conjunction with the works above but not as part of this works approval are:

The implementation of the Shire of Bruce Rock Landfill Management Plan is expected to reduce trench-deposited waste by targeting specific wastes for recycling and diversion (e.g. organic material for mulching and composting). Trench deposited waste will have bi-weekly covering of at least 300 millimetres of top cover.

The new landfill site is expected to support 67 cells, in which the dimensions are 30 x 30 x 2 m with a 2.5 — 3.5 m filling depth and 2 m separation between cells. Each cell will provide a receiving area capacity of approximately 1350 m3. The total area of landfill is estimated to be 7.3 hectares of effective area and the total putrescibles waste estimated each year is 381 tonnes.

The landfill is expected to provide long term use of over 32 years with good management and rehabilitation of covered cells and unused areas or buffers is to be ongoing. The area closest to the current landfill will be used first with the rest of the proposed landfill area outside the fence. The fence will be adjusted as the landfill area grows in size.

Rainfall will be captured from the site office roofs for fire fighting resources, emergency wash down, ablutions, dust reduction or possibly for revegetation areas. 50,000 litres of water will be stored onsite in a storage tank for fire fighting resources.

Stormwater bunding and diversion drains have been developed on site with the waste trench construction material to divert stormwater and avoid contamination.

Temporary litter screens will be used to control windblown waste from trenches. Bi-weekly monitoring and collection of litter will be employed to reduce windblown waste.

Oil to be stored at the landfill site will be stored in a roofed, concrete bunded area with a 2 m hardstand apron. No more than 2,000 litres will be stored at the site and will be collected for disposal off site by a controlled waste carrier.

Green waste will be removed from the MSDA and placed on natural, cleared ground in the restricted area with a minimum of 50 m separation from the premise boundary. The landfill is expected to receive approximately 100m3 of various types of green waste each month. Green waste will be burnt on site under the same provisions as stipulated in the Environmental Protection (Rural landfill) Regulations (2002) — related conditions will be added to the licence to reflect these provisions.

Currently the Shire of Bruce Rock does not receive medical or animal waste but have plans to provide for this service in the future. The disposal of these wastes will be to a separate cell within the landfill.

Liquid Wastes Wastewater produced from domestic dwellings, commercial offices and industrial premises of the Shire of Bruce Rock are not connected to a reticulated sewage treatment system. All houses are connected to septics and, leach drains and some to a treated effluent disposal pond. Until recently, septage pump-outs were incorrectly disposed of at the effluent disposal pond. Two new septage ponds constructed under W5303/2012/1 will accept septage pump

outs for evaporation. Only one pond will be used at a time. The compacted clay lined septage ponds are to be located in the restricted area within its own 1.8 m chain mesh fence and locked gate. Each pond is 10 m x 10 m x 1.26 m and has a capacity of 90,000 litres (excluding freeboard). Each pond has a 2.4 m wide bank and 3:1 m batter. The ponds are built above natural ground level. Access to the ponds are gravelled and the waste receptor is a concrete tank feeding into a central funnelled outlet and a splitter (to enable switching between ponds) without having to have vehicles getting too close to the pond edge. A freeboard of 600 millimetres will be maintained to avoid overflows during significant rainfall events. The design of the ponds is in accordance with the Health (Treatment of Sewage and Disposal of Effluent and Liquid Waste) Regulations 1974 and the Water Quality Protection Note No 39: Ponds for stabilising organic matter, Department of Water, February 2009

The site will initially not be manned. Video surveillance will be trialled to monitor access and public behaviour at the site. Signage already exists for the site.

1.4 REGULATORY CONTEXT

1.4.1 Part IV Environmental Protection Act 1986, Environmental Impact Assessment It is considered that the proposal did not need referral to the Environmental Protection Authority as it was not considered to be a significant proposal under S378 of the Environmental Protection Act 1986.

DER Waste Management Branch has been informed of the extension of the Shire of Bruce Rock landfill site.

1.4.2 Part V Environmental Protection Act 1986, Environmental Management The Shire of Bruce rock currently holds a licence for category 64. The new landfill site will become a 'prescribed premises', upon application for a licence and the submission of a completion certificate of the landfill. The current licence will be amended to include the new landfill site.

DER will also administer the following legislation to regulate various activities associated with the Shire of Bruce Rock landfill:

• Contaminated Sites Act 2003; • Environmental Protection (Controlled Waste) Regulations 2004; • Environmental Protection (Unauthorised Discharge) Regulations 2004; • Environmental Protection (Rural Landfill) Regulations 2002; and • Environmental Protection (Noise) Regulations 1997;

No clearing permit has been required for this site as it is cleared farmland.

Other Decision-making Authorities' Legislation which applies Other legislation which may apply to the site includes:

1.4.5 Local Government Authority The Shire of Bruce Rock is the proponent for the premises.

2.0 STAKEHOLDER AND COMMUNITY CONSULTATION

SUBMISSIONS RECEIVED DURING 21 DAY PUBLIC COMMENT PERIOD The Application for works approval to redevelop and expand this facility were advertised in the West Australian newspaper on 26/11/2012 as a means of advising stakeholders and to seek public comments. No submissions were received.

3.0 EMISSIONS AND DISCHARGES RISK ASSESSMENT DER considers that conditions should focus on regulating emissions and discharges of significance. Where appropriate, emissions and discharges which are not significant should be managed and regulated by other legislative tools or management mechanisms.

The following section assesses the environmental risk of potential emissions from the Shire of Bruce Rock Landfill. In order to determine the site's appropriate environmental regulation, an emissions and discharges risk assessment was conducted of the Shire of Bruce Rock Landfill using the environmental risk matrix outlined in Appendix A. The results of this are summarised in Table 2.

4.0 GENERAL SUMMARY AND COMMENTS This site proposed for a new landfill for the Shire of Bruce Rock is adjacent to the existing landfill site and should be the same environmental risk which in this case is low. The site is relatively isolated from residential areas. The Shire will manage the area in accordance with the Shire of Bruce Rock Landfill Site Procedure Manual, Shire of Bruce Rock, 2013.

The licence will have standard landfill licence conditions focussing on restrictions on the type of wastes that can be accepted, burial or covering regimes, fencing maintenance, windblown waste collection, fire and dust management and annual reporting on all of these parameters.

The licence is amended on 20 December 2013 after the submission of the compliance documentation for Works Approval 5303/2012/1 and conversion to the REFIRE format.

It is suggested that the license be provided to the prescribed premises for a period of 5 years.
