Xybix ErgoPower tables are the only tables that can be used with I-Fit® Ergonomic positioning software. Memorized positions roam with each user to any console. Reporting presents statistical usage information for any or all users. Finally, tables that can ensure correct positioning along with record keeping abilities can greatly enhance proactive ergonomic programs.

Xybix offers many options for energy saving LED task lighting: • The Lux Light (LED) – Two tasklights on front worksurface. Stylish nickle plated finish, multi-directional flex, can be dimmed with the use of the MyClimate controller. Cool to touch.

• The Z-Bar (LED) – This desk lamp is compact and space saving, it is a great for illuminating a keyboardor reference materials. It provides over 50,000 hours of illumination and has four brightness settings.

• Bias Lighting – attached to Rollervision® this indirect lighting source helps make computer viewing more comfortable by reducing eye strain. By reducing fatigue this type of lighting creates an easy transition for the eyes from the darkness of the room to the brightness of your computer monitors. FREIGHT TERMS

Shipments within the Continental USA

All shipments within the continental USA will be F.O.B. Factory.

Anything else to the contrary notwithstanding, Xybix reserves the right to pass on charges for other than normal dock to dock delivery, such as residential delivery, lift gate service, inside delivery, etc., unless alternative arrangements have been agreed to in writing with Xybix prior to the shipment.

In any event, for shipments within the continental USA, Buyer acknowledges that once Xybix delivers goods to the carrier, title to the goods and risk of loss will pass to Buyer, and customer is responsible for seeking appropriate recourse against the carrier, which shall be customer’s sole recourse for goods damaged in transit.

Shipments to Hawaii, Alaska and Canada

Shipments to Hawaii, Alaska, and Canada will be handled on a case by case basis. Please contact the Customer Service department at Xybix for more information and a quote.

Shipments to Canada

Shipments to Canada will be Carrier Paid to Destination and subject to GST, any other applicable taxes, any customs, insurance and or broker fees.

In any event, for shipments to Canada, Buyer acknowledges that once the goods are delivered at the Destination, title to the goods and risk of loss will pass to Buyer, and if goods are damaged or lost by the carrier in transit to any further destination, Buyer is solely responsible for seeking appropriate recourse against the carrier in connection with any such damages or losses.

Delivery Date Guarantee Charge

Delivery date and time are at the discretion of the carrier within reasonable transit time unless special arrangements have been agreed to in writing between customer and Xybix prior to shipment. There is an additional charge for guaranteed delivery on a specific day. A significant additional charge is added for delivery guaranteed within a specific time window on a specific day. These charges will be quoted at customer request.

Re-delivery and Reconsignment of Freight

The customer will be charged for re-delivery or reconsignment of all orders (regardless of shipping terms agreed to), if re-delivery or reconsignment was caused by a customer change after the goods have left Xybix’s factory/dock.

Choice of Carrier

Xybix will use reasonable commercial judgment for choice of carrier, without assuming responsibility for delays, damage or loss.

Shipment Damage Claims

All shipments must be carefully inspected by customer before acceptance, and the delivering carrier must record any damage or shortage noted at time of delivery. If customer believes it has uncovered further damage after delivery, immediate inspection by the delivering carrier must be requested. Damaged freight must be kept at point of delivery in original packaging for inspection by carrier. Customer is responsible for seeking appropriate recourse against the carrier, which shall be customer’s sole recourse for goods damaged in transit.

Concealed Damage

Concealed damage and concealed shortage must be notified within 10 calendar days from delivery date at the specified location to identify concealed damage not visible at time of delivery. Customer must notify carrier and Xybix within such 10-day period, and must retain the original packaging and product. If requested by either carrier or Xybix, customer must ship product back at Xybix’s expense. If Xybix determines that damage was due to Xybix’s error, Xybix’s sole obligation is to replace product in timely fashion and ship to customer at Xybix’s expense. If Xybix determines carrier is at fault, customer must seek recourse against carrier, which shall be customer’s sole recourse. Customer waives right to place claim against Xybix if filed after 10 calendar days of receipt of shipment.

Shortage Claims

Customer has 15 calendar days after delivery at the specified location to file a claim against Xybix for product shortages or Xybix errors not obvious at the time of delivery. If Xybix determines a shortage or error was made by Xybix, Xybix’s sole obligation is to fill the shortage or correct error and ship at Xybix’s expense. Customer waives right to place claim against Xybix if filed after 15 calendar days of receipt of shipment.

Pricing/Order Entry Errors

Claims for pricing or order entry errors must be made no later than 20 days from receipt of invoice.

RETURN AUTHORIZATION POLICY

Authorization is required for the return of any merchandise to Xybix. Call Xybix Customer Service at (800) 788-2810. We require the following:

Terms and Conditions A Customer Service Representative will take your request and furnish you with an RMA number, and will send instructions for the return of the product. A credit memo will be issued upon inspection and approval of the returned product. Upon receipt and inspection, Xybix will determine credit amount and notify you of any discrepancies. Please DO NOT make any financial adjustments to your account prior to Xybix issuing a credit memo for returned goods. We will credit or refund the value of the product total and any taxes you were charged, less applicable fees (excluding delivery charges). Refunds will be given in the same form of payment. Adjustments to credit cards should appear within two billing cycles. Please allow a minimum of 30 days for us to receive and process your return. Requests for return authorization must be made within sixty (60) days of the invoice date. Authorized returns are subject to a 25% restocking fee. Once an RMA number is issued, returned product must be received at Xybix within 30 days. Credit can only be given if the product is in new, re-saleable condition. Custom products and special configurations are non-returnable. Unauthorized product returned on the RMA number will not be credited. Claims for product damaged on the return shipment are the responsibility of the shipper. The customer is required to pay the return freight costs.

REPLACEMENT ORDERS

Any replacement orders will be charged to your account. A credit memo will be issued for returned products that have been approved less a 20% restocking fee.

ORDER CANCELLATION POLICY

Purchase orders may not be changed or cancelled, in whole or part, without prior written consent of Xybix. If an order is cancelled before production begins, Xybix will halt processing of the order at no charge. If the order is already in production, cancellation is subject to a cancellation fee of 10% of the net invoice or for reasonable cancellation charges as established by Xybix. Special Products (customs) cannot be cancelled once in production and are non-refundable.

PAYMENT TERMS

Standard payment terms for installed products are 50% down with order, 40% NET 30 or upon beneficial usage and 10% upon punch list completion. Other terms as negotiated.

Xybix dispatch workstations limited warranty

Warranty Terms and Conditions Defects in Xybix manufactured products and components covered by this warranty and found during the applicable warranty period (see below) will be repaired or replaced (at Xybix’s sole option) upon prompt notice from the original buyer. Troubleshooting tasks (as outlined in the Buyer’s responsibility clause below) must be performed before product repair or replacement will be provided. Repairs, substitute products or replacements of equal or higher value used to resolve a warranty claim will in no way extend the applicable warranty period applied to the original product. Xybix will assume responsibility for all shipping and return shipping expenses of any defective product covered by this warranty.

This warranty does not apply to: Normal wear and tear and consumable items such as light bulbs

Xybix products which have undergone unauthorized modifications or reconfiguration

Products subject to improper use or conditions including negligence, accident or alterations

Products damaged by AC power disturbances

Any account not paid in full

Matching of color, grain or texture

WARRANTY PERIOD

Limited Lifetime Warranty Except as listed below, any defective Xybix manufactured components will be replaced at no charge for as long as the original purchaser owns the product. Labor and all associated expenses for defective products covered by this warranty will be provided to the original buyer for three years from the date of acceptance or beneficial usage whichever occurs first. Limited Term Warranty Lift columns, electronic controls, switches, heating devices and all moving parts found to be defective, will be replaced or repaired (at Xybix’s option) for the first three years of original ownership. This warranty includes parts, labor and shipping costs.

BUYER’S RESPONSIBILITY The execution of this warranty requires the cooperation of the buyer with Xybix. The buyer agrees to perform basic troubleshooting tasks to determine the nature of the defect (and quickly self correct – if possible) with assistance from Xybix customer service before Xybix personnel will provide on-site assistance. In the event that Xybix personnel must provide on-site assistance and the product failure or defect is found to have resulted from items to which this warranty does not apply, the buyer agrees to reimburse Xybix for all expenses resulting from the warranty claim. Expenses include, but are not limited to: product, shipping, installation, transportation and accommodations. An hourly labor rate will be applied for work performed. Xybix makes no other express or implied warranties to any product except as stated above, and in particular, makes no warranty or claim of merchantability or fitness for a particular purpose. Product repair or replacement is the buyer’s exclusive remedy for any and all product defects except as outlined in the foregoing warranty.
