Annex 1 Terms and Conditions for Installation of Brown Sign The Terms and Conditions for Installation of Brown Sign (“Terms and Conditions”) shall bind the owner of the venue or facility on the installation and usage of a brown sign approved by the Singapore Tourism Board and Land Transport Authority. 1 Definition of Terms In this document, the following words and phrases shall have the meanings assigned to them except where the context otherwise requires: 1.1 Approval” means the approval by STB and LTA for the installation of the brown sign. 1.2 brown sign” means the brown road directional sign approved or to be approved by the STB and the LTA pursuant to the owner’s application for approval for installation of the brown sign. Annex 1

Terms and Conditions for Installation of Brown Sign

The Terms and Conditions for Installation of Brown Sign (Terms and Conditions) shall bind the owner of the venue or facility on the installation and usage of a brown sign approved by the Singapore Tourism Board and Land Transport Authority.

1Definition of Terms

In this document, the following words and phrases shall have the meanings assigned to them except where the context otherwise requires:

1.1 Approval means the approval by STB and LTA for the installation of the brown sign.

1.2 brown sign means the brown road directional sign approved or to be approved by the STB and the LTA pursuant to the owners application for approval for installation of the brown sign. For the avoidance of doubt, reference to the brown sign shall include the design and information panels and the support structure and footing, as more particularly detailed under the Technical and Installation Requirements for Installation of Brown Sign at Appendix A.

1.3 LTA means Land Transport Authority.

1.4 MCImeans Ministry of Communications and Information.

1.5 name means a word or set of words in multi-language text by which the venue or facility is known or referred to.

1.6 Official Languages means the official languages of Singapore, i.e. English, Simplified Chinese, Bahasa Melayu and Tamil.

1.7 owner means the proprietor of the venue or facility.

1.8 STB means Singapore Tourism Board.

1.9 venue or facility means the tourist attraction or facility for which an application for approval for installation of the brown sign is made by the owner.

2Multi-lingual Text Requirements

2.1The name of the venue or facility on the brown sign shall minimally be in the Official Languages. One additional language text may be included on the brown sign based on business needs, subject to the approval of STB.

2.2The owner shall ensure the accuracy of the name and/or text in every language used on the brown sign.

2.3Where the name of the venue or facility is the same in English and Bahasa Melayu, the same romanised text may be used for both English and Bahasa Melayu. For e.g. Sentosa, the Romanised texts are applicable for English and Bahasa Melayu. Hence, provision of the Romanised texts Sentosa is sufficient.

2.4In the event that there is no established language text of the name in any of the Official Languages and/or additional languages, the owner shall engage qualified translators for the translation or transliteration of the name. For the Official Languages, the owner shall only engage the recommended translators from MCIs listing as per Appendix A.

2.5STB reserves the right to request that the owner use the specific language text which STB deems appropriate.

2.6STB reserves the right to vary and/or add to the requirements under this Clause 2 at any time and such changes will be made known via issuance of letter or in such manner as STB deems appropriate. The owner shall comply with any variations or additional terms within the date specified in the notice.

3Installation of Brown Sign

3.1All works (including but not limited to design, supply, fabrication, installation, rectification, inspection, maintenance, replacement, relocation, removal, reinstatement of the land where the Brown Sign was installed) related to the installation of the brown sign shall be at the owners own cost. The owner shall front and respond to all public feedback on its brown sign(s).

3.2The owner shall comply with the Technical and Installation Requirements for Installation of brown sign detailed at Appendix B.

3.3The brown sign is to be installed along a road or pathway leading to the venue or facility. Typically, it is installed where it would be most needed, i.e. close to the entrance to the venue or facility and at the nearest traffic island or within road reserves.

3.4The owner shall ensure that the installed brown sign matches the approved artwork submitted to STB and LTA.

3.5The owner shall submit a geotagged photograph of the installed brown sign within 7 working days from the date of installation.

3.6In the event that STB, LTA or any relevant authorities requires the use of the land where the brown sign has been installed for road works or otherwise, the owner shall relocate the brown sign to a new location at the owners own cost. The owner shall be responsible for identifying such new location and seek the written approval of both STB and LTA before proceeding with the relocation.

3.7In the event that the brown sign is no longer needed at the location it resides, the owner shall immediately remove the brown sign.

4Rectification

4.1In the event that the owner fails to comply with the Multi-lingual Text Requirements under Clause 2 above, the Technical and Installation Requirements for Installation of Brown Sign detailed at Appendix B, or if the installed brown sign does not match the approved artwork, the owner shall carry out and complete rectification works within the date specified in STBs notification letter. Upon rectification, the owner shall furnish a geotagged photograph of the rectified brown sign within 7 working days from the date of installation of the rectified brown sign.

4.2If the owner fails to complete the rectification works within the date specified in STBs notification letter, the Approval is deemed to be withdrawn. The owner shall remove the brown sign, at the owners own costs, within 14 working days from the date specified in STBs notification letter. The owner shall notify STB of the removal of the brown sign on the date of its removal.

4.3In the event the owner fails to remove the brown sign pursuant to Clause 4.2 above, STB and/or LTA may remove the brown sign and all costs and expenses incurred by STB and/or LTA (including any costs and expenses in relation to reinstatement of the land where the brown sign was installed) shall be recoverable from the owner.

5Validity Period

5.1The validity period for the Approval is for 5 years, with an option to renew for another 5 years provided that the conditions for renewal as stated under Clause 6 below are met.

5.2Upon verification that the installed brown sign matches the approved artwork submitted to STB and LTA, a Letter of Certificate for Installation of Brown Sign will be issued stating the exact validity period of the Approval.

5.3The commencement date of the validity period will be the date of installation of the brown sign. In the event that more than a brown sign has been approved, the commencement date of the validity period will be the date of issuance of the certificate.

6Renewal for a Further 5 Years

6.1For renewal, the owner has to apply at least 6 months prior to the expiry date of the validity period.

6.2The renewal will be subject to an assessment on the eligibility of the venue or facility to qualify for the brown sign and the owners acceptance of these Terms and Conditions.

6.3In addition, the owner is required to submit the Professional Engineers (PE) certification on the soundness of the support structure and footing for the brown sign and a geotagged photograph to show that the brown sign is maintained in good condition.

6.4Upon verification that the brown sign is in order, a Letter of Certificate for Renewal of Installation of Brown Sign will be issued stating the exact validity period of the Approval.

6.5 In the event the owner decides not to renew the approval for installation of the brown sign, the owner shall remove the same by the expiry date of the validity period, failing which STB and/or LTA may remove the brown sign and all costs and expenses incurred by STB and/or LTA (including any costs and expenses in relation to reinstatement of the land where the brown sign was installed) shall be recoverable from the owner.

6.6Within 7 days of the removal, the owner shall submit a geotagged photograph of the reinstated land and advise STB on the date of removal.

7Replacement of Brown Sign

7.1During the validity period of the brown sign, the owner may apply at any time for the replacement of brown sign, in whole or in part.

7.2The replacement will be subject to an assessment on the eligibility of the venue or facility to qualify for the brown sign and the owners acceptance of the Terms and Conditions.

7.3The owner is required to submit a geotagged photograph to show that the the structure and footing of the brown sign is maintained in good condition, and where required, the PEs certification on the soundness of the support structure and footing for the brown sign.

7.4In the event that only a part of the brown sign is replaced, regardless of the date for application of replacement, there is no extension of time to the validity period of the Approval.

7.5In the event that the entire brown sign is replaced, the commencement date of the validity period will be the date of issuance of the certificate for the replaced brown sign.

8Contravention of and changes to the Terms and Conditions

8.1In the event that the owner contravenes any of these Terms and Conditions, the Approval is deemed to be withdrawn and any further use of the brown sign shall cease. The owner shall remove the brown sign within the timeline stipulated by STB.

8.2 STB and/or LTA may vary and/or add to the Terms and Conditions from time to time and such changes will be made known via issuance of letter or in such manner as STB and/or LTA deems appropriate.
