What is conveyancing?“Conveyancing” is the legal process of transferring ownership of property fromone person to another.

Your saleSelling your property is not always an easy process. There are many steps involved from marketing the property to completing the final settlement. It is in your interest that the conveyance is completed properly and efficiently. Your purchasePurchasing a property involves more complex legal procedures and processes than selling a property. From making an offer, to conducting due diligence enquiries, to ultimately having the property transferred into your name, the assistance of an experienced legal professional is essential to protect your interests.

Due diligence enquiries Tasmania does not currently have a statutory vendor disclosure regime. This means that the principle of “buyer beware” applies to all property purchases. We will undertake a full range of searches and enquiries to obtain relevant information that is available on the public record so that you are informed about the legal and other characteristics of the property you are purchasing.

Legal costs and disbursements Legal costs and disbursements for a conveyance will differ depending on whether you are selling or buying, whether it is a commercial or residential property, whether you have a mortgage and any other work that may be involved. To obtain an estimate of the legal costs, disbursements and other fees that will be payable for your sale or purchase, please contact our office.

Other costs you should be aware of:AGENT’S COMMISSION AND FEES (SALE ONLY)A Real Estate Agent’s fees will vary depending on the sale price of the property and the particular Real Estate Agent you use. The recommended scale of fees available on the Real Estate Institute of Tasmania website (www.reit.com.au) provides a useful guide, however you should always contact your Real Estate Agent to discuss their particular fees and charges.

GOVERNMENT DUTY (PURCHASE ONLY)All property purchases are subject to Government Duty, which is charged according to a scale. The State Revenue Office website (http://www.sro.tas.gov.au/) provides an online calculator which can be used to calculate the Duty payable based on the purchase price. We can also advise you of the Duty payable on your purchase when we provide an estimate.
