CivilSocietyOrganizations(CSOs)areconsideredakeypillarinthebuildingofamoderncivilstate.Theyhaveundertakenaprominentandimportantroleintheworkof
theNationalDialogueConference(NDC)throughtheirrepresentativesinthedialoguewhoworkedwithseriousness,dedicationandhighresponsibilityinallgroupsof
theconferenceanditssessions,contributingintheseriousandresponsiblediscussionsinall-importantnationalissues.Theyprovidedarangeofsolutionstothemost
importantandcriticalissuesparticularlytheonesconcernedwithandrelatedtoCSOs.
AftertheNDCconcluded,aconstellationofCSOrepresentativesworkedformanyweeksthatwerecrownedwiththeseminarthatwasheldintheWomenand
YouthForuminthe7thand8thofMay,2014underthetheme,“TheOutputsoftheNDCforCSOs”.Theyworkedonextractingalltexts,principles,constitutional
andlegalguidelinesanddirectandindirectrecommendationsthatCSOsthinkareimportanttobeinsertedintothenewconstitutionandthelegislationsderived
fromitaswellasadvocatingforthemwithemphasizingthatalloutcomesoftheNDCareimportantandshouldbetakenintoaccount.
AlltheseeffortscamewitheffectiveparticipationandunprecedentedsupportbytheWomenandYouthForum,officeoftheUNSpecialAdvisortotheSecretary
GeneralonYemen.

Introduction:
Itmustbenotedthattheconceptofcivilsociety,whichdatesbacktotheintellectualworkofThomasHobbesintheseventeencentury,hasevolvedintwodirections:In
democraticstatesandinstatesintransitiontodemocracy:
First,indemocraticstates:theconcepthadcoveredsocieties,politicalparties,unionsandallsocialandpoliticalorganizationscivicinnature.However,withtheevolution
ofthedemocraticexperienceinwesternnations,ithastakenuptheformofexternalcivicorganizationsindependentofthepoliticalcommunity(specifically,human
rightssocieties,unionsandmediaorganizations.
Second,instatesundergoingdemocratictransition,theconceptisbeingbroadenedtocoverallorganizationsindependentfromthestatesandthosenotundercontrol
oftherulingauthoritiesortheoppositionincludingreligiousorganizations(thisappliestothecaseinYemen).Withsuchanevolution,theroleofcivilsocietyhasgained
specialsignificance.
Significanceofcivilsocietyandrole:Atthislevel,anumberofpointshavetobehighlighted:
� CSO’shaveplayedaroleinconsolidatingefforttoremovetyrannicalregimes.
� CSO’shaveplayedadecisiveroleintheestablishmentofademocraticsystem;thisisacriticalandseriousrole.However,allcivilsocietyforcesshouldfocuson
proposingsolutions,idealandpeacefullobbyingandshouldrefrainfrombecomingapartofthepoliticalpowerplay.Politicalparties,ontheotherhand,shouldpull
outfromcivilsocietyassoonasanagreementontherulesofdemocracyisreached;otherwise,itwouldbetransformedtoatoolfordestabilizationthatwould
abortthedemocraticenterprise.
� Civilsocietyplaysacriticalandinfluentialroleinthepromotionofthedemocratictransitionbyplayingtheroleofamonitorovertheprocesstopreventareturn
totyranny.ThesignificanceofcivilsocietyhasbeenassertedbytheparticipantsintheNDC,who,throughthevarioustexts,constitutionalandlegalguidelines,
decisionsandrecommendations;notjustatthepoliticallevelbutincludecomprehensivedevelopment:political,economic,culturalandsocialdevelopment.Such
outcomesnotonlyconstitutearecognitionoftheroleofcivilsociety,buttheyformthefoundationforfutureworkoftheseorganizations;definingareasforsuch
workandpartnershipwiththegovernmentandtheprivatesector.

PrinciplesandConstitutionalGuidelinesDirectlyRelatedtoCSOs:SocialFoundations:9- Allcitizenshavetherighttoorganizethemselvespolitically,professionallyandinunionsandhavetherightinestablishingscientific,cultural,social,charitable
organizationsaswellasfederations,professionalandcreativeunions.TheStateshallguaranteethisrightandshalltakenecessarymeasurestoenablethepeopleto
practiceit.Itshallguaranteethefreedomofinstitutions,political,labor,cultural,scientificandsocialorganizations.
10- Everycitizenhastherighttochoosetheappropriatework.Acitizenhastherighttoestablish,associateinarepresentativeunionandshallfreelyparticipatein
theactivitiesandeventsofthatunionincludingtherighttostrike.Anyonewhohasbeenaffectedbyadministrativeprocedurehastherighttoobtainawrittenexplanation
ofsuchactionandhastherightofresorttothejudiciarytochallengeanydamagingactions.
11- Publicmanagementorganizationsshouldadheretotheprincipleoftransparencyintheirfunctionsandshouldgivethisrighttoindividual,bodiesand
stakeholders.Variousmediaorganizationshavetherighttoaccessactivitiesofthemanagementandobtaincopiesofrelevantdocuments.Thisshouldbeconsidered
anobligationofmanagement;whereanemployeewhofailstoperformthisdutyshouldbepenalizedappropriately,providedthatthisdoesn’tcontravenethesupreme
interestoftheState.Everyperson,pursuanttoacourtorder,hastherighttoaccessinformationordocumentinpossessionofanotherpersonnecessaryforthepractice
orprotectionoftheperson’srights.
PoliticalFoundations:11- Therightsofpeopletoexpresstheirviewsandpoliticalchoices,toexpresstheirwillthroughcivicaction,suchasprocessions,demonstrations,strikes,
peacefulsit-inswithoutweaponsandwithoutinflictinganydamageorharmtopublicandprivatepropertyisguaranteedwithouttheneedforanypriorpermits.Itis
unlawfulthatsuchrightsareunderminedordetractedfrominanyformormanner.Thereshouldbelegalprovisionsprescribingcriminalpenaltiesagainstanyonewho
contributesindetractingsuchrights.
JudicialAuthorityFirst:InRelationtotheHighJudicialCouncil:
b-TheBarAssociationelects15membersoftheCouncilfromamongseniorlawyersonconditiontheyleavetheirpreviousjob.
Second:InRelationtotheConstitutionalCourt:
b-TheBarAssociationelects15%ofmembersoftheConstitutionalCourtfromamongseniorlawyersprovidedtheyleavetheirpreviousjobs.

properties.TheuseofStatesresourcesandthoseoftheState’sorganizationsshallbeprohibitedfromwhetherforpersonalorpartisanbenefit.
4- Itisunlawfultouseofhousesofworshipsforthedisseminationofpartisanideasorcalltoachieveapoliticalinterest,incitementtohate,violenceorseditions
betweenthepeople.
6- OfficialsoftheState,itsorganizations,anysocialdignitariesoranyotherindividualororganizationsareprohibitedfromreceivingfundsfromaforeignstate
suspectedofbeingabribeorforsubordinationorforapoliticalpurposewhetherperiodic,oninstalments,directlyorindirectly.
Third:SocialFoundations:1. TheStateshallensureequalityandequalopportunitiesforallcitizensinpolitical,economic,socialandculturalareasandlawsshallbeenactedtorealizethat.

mediaCSO›s.Itshallbeestablishedinlinewiththegeneralprovisionsforindependentbodiesandthelawshalldefineitsfunctions.
2- TheHighCouncilforPressandMediashallberesponsibleforformulatingpoliciesanddevelopstrategicmediavisions,reformofthepressandmediasector
(printed,visual,audioandelectronic)andshallbekeentoprovidealllegalandethicalguaranteestoprotectfreedomofexpressionandfreedomofthepressandmedia,
therighttoaccessinformationandtoprotectdiversityofthemedia,neutralityandprofessionalintegritytoensureprotectionfordemocracyandhumanrightsand
nationalandreligiousvaluesguaranteedbytheconstitution.
TheSupremeNationalAuthorityforCombatingCorruption1- Reformulationofthenationalstrategytoenhancevaluesofintegrity,transparencyandaccountabilityfirstandforemostandfightingcorruptionwitheffective
nationalcommunityparticipation.
TheHighAuthorityforEducation,TrainingandScientificResearch:5- TheAuthorityshoulddevelopmentpoliciesandmechanismstostrengthenboardoftrusteesofhighereducationalinstitutionsandshallhaverepresentatives
ofcivilsocietyandtheprivatesectorinitsboardbasedontheirqualifications.
ThePartyAffairsandCivilSocietyOrganizationsCommission:1- TheAuthorityshallcomprisetwodepartments:Thepoliticalpartiesandorganizationdepartmentandthecivilsocietyorganizationsdepartment.
2- Theauthorityshallberesponsibleforscreeningofapplicationsfortheestablishmentofpoliticalpartiesandorganizationsandtheregistrationofcivilsociety
organizationstoverifythattheymeetrequiredconditionsasspecifiedbylaw.
3- TheAuthorityshallberesponsibleforfollowing-uponcomplianceofpoliticalpartiesandorganizationtothelegalcontrolsandthestandardsofintegrityand
transparencyinaccordancewiththelaw.
4. It’snotpermissibletodissolveanypoliticalpartyororganizationoracivilsocietyorganizationunlessbyaconclusivecourtjudgment.
5. TheAuthorityshallberesponsibleforcapacitybuildingofcivilsocietyorganizationstoenablethemtoperformtheirroleasaneffectivepartnerincommunity
development.

TheNationalAuthorityforPersonswithDisabilities-Recommendations:a- Coordinationamongallrehabilitationcenters,organizationsandunionstounitetheeffortsforthepersonswithdisabilities.
TheHighNationalAuthorityforMotherhoodandChildhood1.c. Coordinationandcooperationwithallofficialsectorsandcivilsocietyorganizationsconcernedwithmotherhoodandchildhoodlocally,regionallyand
internationalwiththeobjectiveofcreatingtherequiredbalanceandintegrationsbetweenthesesectors.
TheNationalHumanRightsCommission6-Responsibleofcoordinationbetweenthecommunityanditsorganizationsandbecomesaneutralforumtoconductseriousdialoguetoensuretheenhancementand
protectionofhumanrights.
PrinciplesandConstitutionalGuidelinesIndirectlyRelatedtoCSOs:
TheHighAuthorityforEducation,TrainingandScientificResearch2. TheExecutiveAuthorityshallberesponsiblefortheimplementationofstrategiesandpolicesdetermineandevaluatedforeducational,trainingandscientific
researchinstitutionsbyprovidingfundingandrequiredinvestmentandtodiversifysourcesoffundingforthe,.Itshouldcreateeffectivecommunityparticipationprograms
withthecommunityontheonehandandwitheducationaltrainingandscientificresearchinstitutionsontheother.

PrinciplesandConstitutionalGuidelinesDirectlyRelatedtoCSOs:30. Peacefulstrikesareoneofthelegalandlegitimatemeansforworkersandstaffandtheirtradeunionorganizationstodefendtheirrightsandlegalinterests
incaseofviolationandconfiscationthereof.
32. Workers,employeesandprofessionalshavetherighttoorganizeunions,federationsandcooperativeassociationsbymerelyservingnotice.Theseentities
shallhavelegalpersonalityandshouldbebasedondemocraticfoundationswhileexercisingtheiractivitiesindependentlyandfreely.Itshallparticipateinserving
society,improvingtheefficiencyofitsmembersandprotecttheirrights.Noauthorityispermittedtodissolvethemorimposeguardianshipoverthemunlessbyafinal
courtjudgment.
33. Lawshallregulateunionsandprofessionalactivities,managementondemocraticbasis,identificationoftheirresource,waysandmeansofholdingmembers
accountablefortheirprofessionalbehavioraccordingtocodeofconducts.It’sonthatbasisthatalicensetopracticeaprofessionshallbeissued.Onlyoneunionistobe
establishedtoregulateanyoneprofession.Authoritiesarenotpermittedtodissolveanyadministrativebodyofaunionunlessbycourtjudgment.
36. Nopartyshouldhavetherighttointerfereintheworkofthetradeunionorganizationsdirectlyorindirectly.Likewise,theyhavenorighttoexercisecoercion
againstanyonewithrespecttotheirjoininganytradeunionorganization,resignamembershiporganizationorpreventanyindividualfromexercisingunionrights.
37. Itisnotpermissibletoimposeanysanctionsonmembersoftradeunionorganizations,includingusingthepenaltyofdismissalforexercisingtradeunion
activities.
38. Allassociations,federations,tradeunionsandcooperativesaretobeundertheoversightoffinanceandaccountingcontrolauthorities,whichshallberegulated
bylaw.
44. TheStateandmedicalunionsshallbeobligatedtosuperviseandmonitorhealthinstitutions,allhealthmaterialsandproductsandhealthadvertisement.
48. TheStateshallobligatehealthmonitoringbodiesandmedicalunionstoholdaccountableinstitutionsandindividualsformedicalerrors,butthisdoesnot
impacttherightofthevictimtoresorttothejudiciary.
57.TheStateshallobligatetoprepareschool’sCurriculathroughamixedbackgroundcommissionwiththeparticipationofcivilsocietyorganizationsandspecialists
inallschoollevelstoensureculturaldiversity,integratefreedom,humanrights,citizenship,democracyandprincipleofdevolutionofpowerwithpluralismandthatthe
peoplearethesourceandpower-owners.
66. Individuals,institutions,associationsandpartieshavetherighttoownandstart-upanaudio-visual,printedorelectronicmediumsbymerelyservingnoticeto
thatfact.

100.TheArticleofAssociationofanyprofessionalunionisthelegalreferencefortheunionuntilaspeciallawisissuedwherethearticleofassociationshallremainin
forceinternally.
116. Citizenshavetherightofassociation,civilinstitutionsandpoliticalpartiesbemerelysubmittinganotification.It’snotpermissibletodissolveanyofsuch
institutionunlessthroughafinalcourtjudgment.
174. Supportoforganizationsandbodiesworkingtoprovidecarefortheelderly.
205. Civilsocietyorganizationsareoneoftheimportantmeansofprotectingrightsandfreedoms.Theyaremajorcontributorstothedevelopmentofpoliciesand
supportforcommunityactivitiesinallfields.Therefore,it’sincumbentupontheState,tosupportanddevelopcivilsocietyandensureitsindependence.
PrinciplesandConstitutionalGuidelinesIndirectlyRelatedtoCSOs:34. TheStateshallensureallfundamentalbasesforadecentandfreelife.Itshallensuresufficientincome,appropriatehousingandshallundertakethe
developmentofanationalhousingplantobebasedonsocialequity.Itshallpromoteself-initiatives,cooperativehousingsocietiesandregulatelanduseforarchitectural
usesinamannerthatwouldrealizepublicinterestandprotectsrightsoffuturegenerations.
41. TheStateshallbeobligatedtothedevelopmentofliteracyprogramsandplanswithcontributionsfromsocietytoachievethispurpose.

13. Politicalparties,civilsocietyorganizationsshallcommittorulesofdemocracyintheirstructuresandtheapplicationoftheprinciplesofgoodgovernance
withinthepartiesandoutside.
14. Anindependentbodystaffedbyelectednon-partisanmemberswithareputationforintegrityshallbeestablished.Itshallregisterpoliticalparties,organizations,
andcivilsocietyorganizations.
15. TheGovernmentshallsupportallpoliticalparties,organizations,andcivilsocietyorganizationsfromthepublicbudget.Foreignfundingforallpoliticalparties
andorganizations,individualandgroupsshallbeprohibitedfromreceivinganyforeignfunding..Civilsocietyorganizationsshallalsobebannedfromreceivingany
foreignfundingforpurposesotherthandevelopment.Politicalfundingofindividuals,groupsororganizationsshallbecriminalized.
17. TheConstitutionshallguaranteetherightofassociationforthepeopleinpoliticalpartiesandcivilsocietyorganizationtopromotethefreewillofthepeople.
Thesetting-upofapoliticalpartyonreligious,sectarian,ethnicorreligiousdoctrineshallbeprohibited.
19. TheConstitutionshouldprovideforthefullpartnershipwiththecivilsocietysectoranditsorganizationstopromotecommunityparticipationindevelopment
effortandtodevelopitsroleinpublicmonitoringasapressuretooltoachievepublicinterestunderthebalanceandintegrationofitsrolewiththepublicandprivate
sectors.
129. Thelawshallprovideforthefollowing:-
a. Empowermentofwomeninpoliticalpartiesandorganizationbygivingwomenatleast30%representationsintheirgoverningbodies.
PrinciplesandConstitutionalGuidelinesIndirectlyRelatedtoCSOs:16. Criminalizationofexploitationofpublicfunds,themedia,civilandmilitaryinstitutionsinfavorofonepartyorgroup.Therulingpoliticalpartyorcoalitionshall
bebannedfromsharingthepublicservicejobsbelowthelevelofseniorpoliticalpositions.
PrinciplesandLegalGuidelinesDirectlyRelatedtoCSOs:22. Promotetheawarenessroleofthemedia,civilsocietyandpoliticalpartiesinamannerthatensurethespreadoflegalawarenessandrespectforthelaw.
