the Environment (MDE) willhold two oil and propane tankanchoring events in comingweeks for community members,local officials, anchor suppliersand the oil and propane indus-try. The events will be held onOct. 20 and 21 from 9a.m. to 2p.m. The events will includehands on anchoring lessons,presentations on the importanceof anchoring tanks and the op-portunity to meet with those inthe tank and anchor industry. Abarbeque style lunch will beserved.

The first tank anchoring ses-sion will be held on the EasternShore Oct. 20 at the 4-H Parkin Queen Anne’s County, lo-cated off MD Route 18 betweenQueenstown and Centreville.On Oct. 21 the event will beheld at the National Guard Ar-mory on Hudson Street in the Pa-role section of Annapolis. Thoseworking in the heating oil andpropane distribution industries arehighly encouraged to attend oneof these events.

Propane and oil tank spills arebecoming increasingly problem-atic for Maryland residents. Lastyear, flooding from HurricaneIsabel dislodged and spilled hun-dreds of residential oil tanks inMaryland causing the federal andstate governments to spend $15million in remediation costs.These spills are toxic to peopleand animals that live in floodprone areas and can result in wa-ter contamination, fire, injury andeven death.

Maryland is now equippedwith several suppliers of tank an-chors. Most oil suppliers will in-stall anchors for a small fee. Bylaw, propane deals must anchorany propane tank located in thefloodplain. Residents living in thefloodplain are encouraged to takeall necessary precautions to pre-vent future oil and propane spillsby anchoring their tanks imme-diately.

A $149,660 grant from theNational Oceanic and Atmo-spheric Administration(NOAA) will fund projects atthe University of MarylandBiotechnology Institute in Bal-timore, to study toxin produc-tion in fish-killing algae withthe aim of better understand-ing the environmental circum-stances that cause organismsto produce the toxins.

The grant from the Ecologyand Oceanography of HarmfulAlgal Blooms program, man-aged by NOAA Ocean Servicewill focus on Karlodiniummicrun, which occurs widelyalong the east coast of theU.S., and produces at least twofish-killing toxins. The grantwill support research to inves-

In June Maryland named its2004 Green Schools at ceremo-nies at the Patuxent WildlifeCenter in Laurel. The GreenSchool Awards Program cel-ebrates Maryland’s model envi-ronmental education efforts thatcombine classroom studies withthe use of best managementpractices at schools and involvethe community. These are non-competitive awards to recognizeand celebrate the achievement ofschools meeting strict environ-mental education criteria.

ductions will be required eachyear until 2010.

“This agreement will have asubstantial impact on the airquality in the entire Washingtonarea,” said Kendl P. Philbrick,Maryland’s secretary of the en-vironment. Reducing air pollu-tion in the Washington, D.C.area will help the region com-ply with the federal Clean AirAct standards by 2010, Philbricksaid.

Under the terms of the agree-ment:

• Mirant will install state-of-the-art NOx controls on its twocoal-fired units at theMorgantown plant, thecompany’s largest in Maryland.The controls will be fully opera-tional by May 2008. Mirant hasalso agreed to install NOx con-trols on three of the units at itsPotomac River Plant in Alexan-dria.

• The company will run theNOx controls year-round, notjust during the summertimeozone season, to meet an emis-sions rate of .10 pounds per mil-lion BTUs. Operating the con-trols year-round will further re-duce nitrogen deposition in the

Chesapeake Bay and otherMaryland waterways and helpthe state meet the federal stan-dard for fine particulates.

• Mirant’s coal-fired plantswill meet a system-wide ozoneseason NOx limit of .15 poundsper million BTUs in 2008.

• Over the next six years,Mirant will meet sharply declin-ing ozone season and annualNOx emission tonnage caps.

“We estimate that by 2010NOx emissions from Mirant’scoal-burning units will be cut bynearly 75 percent during theozone season and by 65 percenton an annual basis,” Philbricksaid. “This is welcome news forthe entire region.”

The settlement resolves al-leged NOx emissions limit vio-lations at the Potomac Riverplant during the 2003 ozone sea-son.

The settlement was filed infederal district court in North-ern Virginia. Several things musthappen before the settlementtakes effect. Public comment willbe solicited and a federal bank-ruptcy court in Texas must ap-prove the settlement, as must thefederal district court judge.

“For Maryland families thatrely on wells,” Governor Ehrlichsaid, “these new measures willprovide additional assurance thattheir water supplies are clean andsafe from MTBE and other pe-troleum products. These aretough, but necessary regulationsto strengthen our environmentallaws.”

Pursuant to the federal CleanAir Act, MTBE (methyl tertiary-butyl ether) replaced lead in gaso-line in the 1980s and is used toreduce carbon monoxide emis-sions from vehicles.

MTBE makes important envi-ronmental and economic contri-butions by improving Maryland’sair quality and keeping gas pricesaffordable.

The emergency regulations willalso require increased groundwa-ter sampling, mandate regulartesting of tanks and fittings, anddefine steps that gas station own-ers and others must take whenunderground storage systems aresuspected of contaminatinggroundwater.

The regulations, announcedAug. 11, will apply in areas wherewells are the primary source ofhousehold drinking water and lo-cal geology makes it impracticalfor homeowners to find a newwater source. MDE will iden-tify the areas and notify affectedtank farm operators.

The regulatory review com-mittee of the General Assemblymust review and approve theproposed emergency regula-tions before they can become ef-fective.

Service stations and other un-derground storage facilities inareas covered by the regulationswill have 30 days after the ef-fective date of the regulations tobegin quarterly sampling of wa-ter in on-site domestic wells andtank field observation pipes.

They will also be required toconduct annual tightness testsfor fittings in catchment basinsand containment sumps. Re-sults must be reported to MDE.

If MTBE at levels greater than20 parts per billion (ppb), morethan 5 ppb of benzene or morethan 100 ppb of total BETX(benzene, toluene, ethyl ben-zene and xylenes) are found, theoperator will be required to drillthree groundwater monitoringwells and submit samples fromthe new wells to MDE. Theywill also be required to performan advanced helium leak deten-tion test, which is used to iden-tify vapor leaks.

In addition to repairing allleaks immediately, the operatorwill be required to install a soilvapor extraction system in thetank area to remove vapors fromthe earth or other advancedtechnology to keep vaporswithin the tank system.

The MDE regulations also es-tablish a timetable for installingdouble-walled piping with sen-sors and alarm systems.Double-walled piping will berequired on all new and replace-ment systems, and systems thatare 15 years old or older mustbe upgraded by January 1, 2006.All systems must be upgradedno later than January 1, 2009.

Since June, MDE has been in-vestigating the presence ofMTBE in private wells in theUpper Crossroads area ofHarford County. The investiga-tion has focused on an Exxon ser-vice station on Fallston Road,where a number of vapor leakshave been found and repaired.

The U.S. Environmental Pro-tection Agency has concludedthat there is no measurable healtheffect from low level MTBE ex-posure. The EPA’s health advi-sory states that levels of contami-nation at or below 20 parts perbillion provide a large margin ofsafety from adverse health effects.

Howeverseveral species identified in theChesapeake and coastal bayshave the potential to release tox-ins directly into the water col-umn or bioaccumulate in shell-fish under certain conditions.Some of those toxins can havehuman or animal health conse-quences. Excess nutrients tendto be a catalyst to dangerous al-gal blooms.

Each year, NOAA OceanService’s Center for SponsoredCoastal Ocean Research, which

manages ECOHAB, awards ap-proximately $30 million ingrants to members of the aca-demic, state and scientific com-munities to assist NOAA in ful-filling its mission to study ourcoastal oceans in order to predict en-vironmental change, manage oceanresources, protect life and property,and provide decision makers withreliable and timely scientific infor-mation. NOAA-sponsored com-petitive research programs such asECOHAB demonstrate NOAA’scommitment to these basic re-sponsibilities of science and ser-vice to the nation for the past 34years.

Coastal Supply Company -Wicomico County —On June 14,MDE received payment of$4,000 from Coastal Supply asrequired by a recently signedConsent Order to resolve viola-tions of air quality regulations.The action was based on fourNotices of Violation issued byMDE to Coastal Supply for dustemissions and air pollution nui-sance violations. The dust wasemanating from Coastal Supply’sproperty and falling on a residen-tial area nearby. The residentswere registering complaints withMDE’s Eastern Shore RegionalOffice. In addition to paying thepenalty, Coastal Supply improvedits operations in order to eliminatedust emissions. Coastal Supplyis now operating in compliancewith air quality requirements. Sta-tus: Case Closed. (Reference#AQCP 031004)

Ethel Mae Holmes – Norfolk,VA—On June 24, MDE’s previ-ously issued Notice of Revocationand Order to Ethel Mae Holmes,president of Holmes Environ-mental, Inc. became a Final Or-der. The 30-day deadline hadpassed for Ms. Holmes to requesta hearing and she failed to re-spond to the previously issuedOrder, which required her tocease all the activities for whichshe has accreditation, return allcertificates and photo ID cards in

her possession, and provide a listof asbestos projects that shehandled in Maryland. The Revo-cation and Order were originallyissued by MDE because Ms.Holmes used fraudulent certifi-cates from a Virginia-based train-ing provider to obtain asbestostraining and accreditation inMaryland. Additionally, she wasfound guilty in federal court onMarch 23rd on all counts of an in-dictment including use of the cer-tificates that she used in Marylandto obtain further training. Status:Ms. Holmes to be sentenced onOctober 29th. (Reference #AP 04-01-02REV)

Consultative Examinations,Inc. – Baltimore City—On July1, MDE and Consultative Exami-nations signed a Consent Orderwith an $800 penalty to resolvethe Complaint, Order, and Ad-ministrative Penalty issued byMDE to Consultative Examina-tions for failing to renew regis-tration of a radiation machine fa-cility within the prescribedtimeframe. Status: Case Closed.(Reference #RHP 04-00)

Allan C. Johnson, DMD –Prince George’s County—OnJuly 6, MDE and Dr. Johnsonsigned a Consent Order with an$800 penalty to resolve the Com-plaint, Order, and AdministrativePenalty issued by MDE to Dr.Johnson for failure to renew reg-istration of a radiation machinefacility within the prescribedtimeframe. Comprehensive OrthopedicServices and Sports MedicineCenter - Charles County—OnJuly 6, MDE and ComprehensiveOrthopedic Services signed aConsent Order with a $7,500 pen-alty to resolve the Complaint,Order, and Administrative Pen-alty issued by MDE to Compre-hensive Orthopedic Services andSports Medicine Center for fail-ure to certify a radiation machineand for its continued use whileuncertified. Belle Grove Corporation andPatuxent Rock – Baltimore CityOn July 28, MDE received pay-ment of a $25,000 administrativepenalty assessed against BelleGrove Corporation and PatuxentRock. The payment was requiredby a Consent Order entered intowith MDE to settle violations ofair quality permit requirements.Belle Grove and Patuxent con-structed and operated two con-crete crushers and associated clas-sifying screens without first ob-taining permits to construct andpermits to operate from the De-partment. Since settlement of thecase, MDE has issued permits forthe crushing operation. Status:Case Closed. (Reference #AQCP040727)

Franklin Square Hospital –Baltimore County—On July 30,MDE issued a Notice of ProposedCivil Penalty to Franklin SquareHospital in the amount of $32,500for violating air quality regula-tions. Franklin Square operates amedical waste incinerator subject

to state and federal air quality re-quirements. Franklin Square vio-lated air quality requirements byoperating its incinerator for sevendays with its bypass stack open,allowing uncontrolled emissionsto escape. The Hospital alsocharged waste into the incinera-tor at a higher rate than allowedby the regulations. Status:Franklin Square has 10 days torequest a meeting on the Penalty.(Reference #AQCP 0408)

Air Products Polymers, L.P.(Air Products)– Cecil County—On August 11, MDE issued aNotice of Proposed Civil Penaltyin the amount of $14,000 to AirProducts for air quality violations.Air Products operates an emul-sion manufacturing facility that isa major source of volatile organiccompounds, making it subject tocertain permitting regulations.MDE issued a permit to the Com-pany in May 2000. Based on anevaluation of required reportssubmitted by the Company, MDEdetermined that the Company hadnot conducted monitoring andrecord keeping for its equipmentas required by its permit. The vio-lations occurred over a period ofseveral months. Monitoring andrecord keeping are required com-ponents of the permit to ensurecompliance with air quality emis-sion standards. Anne Arundel County Depart-ment of Public Works – AnneArundel County – On June 28,MDE and Anne Arundel CountyDepartment of Public Works fi-nalized an administrative consentorder regarding improvements tothe Anne Arundel County sani-tary sewer system to address sani-tary sewer overflows (SSOs).Under the terms of the consentorder, Anne Arundel County hasagreed to perform a Capacity,Management, Operation andMaintenance (CMOM) Program,a System Evaluation and Capac-ity Assurance Plan and an Over-flow Emergency Response Planto properly manage, operate andmaintain its sewer collectionsystem to provide adequate ca-pacity to convey base and peakflows and to prevent SSOs andmitigate adverse impact to pub-lic health and to waters of theState. The County has alsoagreed to pay $18,000 to theMaryland Clean Water Fundand to expend a minimum of$81,600 to complete a Supple-mental Environmental Project(SEP). The consent order also

establishes stipulated penaltiesfor reported SSOs. Status:Case closed. (Reference # CO-04-0135).

Baltimore City Departmentof Public Works – BaltimoreCity – On July 7, the BaltimoreCity Department of PublicWorks paid a stipulated pen-alty of $38,875 to the Mary-land Clean Water Fund to re-solve reported sanitary seweroverflows (SSOs) during theperiod July 1 – December 31,2003 in accordance with theprovisions of the federal/StateCivil Consent DecreeJFM02CVA1524. Carroll County Departmentof Public Works – CarrollCounty – On June 9, MDE andthe Carroll County Departmentof Public Works finalized asettlement agreement wherebyCarroll County agreed to pay$14,500 to the Maryland CleanWater Fund to resolve pastNPDES permit violations atthe Freedom District WaterTreatment Plant. Status: Caseclosed. (Reference #PS-04-0129).

Water and Sediment Pol-lution Penalties – Statewide

During the period June 15,2004 to July 15, MDE col-lected an additional $840 to theSediment Fund in resolution ofalleged erosion and sedimentcontrol/sediment pollution vio-lations from one site and$8,125 to the Clean WaterFund in resolution of allegedwater pollution violations atthree facilities.

Dominic Joseph Perini,Washington County – On July13, Dominic J. Perini pledguilty before Judge Donald E.

Beachley in the WashingtonCounty Circuit of one count ofperforming construction withoutan approved sediment controlplan, in violation of §§ 4-105(a)(3) and 4-116(a) of the En-vironment Article, AnnotatedCode of Maryland. JudgeBeachley placed Mr. Perini onone-year unsupervised probationbefore judgment with the follow-ing conditions: (1) Defendantmust remove an unauthorizedbridge; (2) pay $4,000 penaltyand court costs ($2,000 to theSediment Control Fund and$2,000 to Washington County);and (3) pay $10,000 to the Chesa-peake Bay Foundation for aSupplemental EnvironmentalProject. This case was pros-ecuted by the Office of the At-torney General’s EnvironmentalCrimes Unit following referral byMDE’ Water Management Ad-ministration. Town of Manchester, CarrollCounty -On July 30, MDE andthe Town of Manchester finalizedan administrative consent orderregarding alleged violations ofthe reporting and effluent limita-tion requirements established inState Discharge Permit 00-DP-0642 issued to the ManchesterWaste Water Treatment Plant.Under the terms of the ConsentOrder, the Town of Manchesterhas agreed to perform improve-ments to the treatment plant inaccordance with an approvedplan and time schedule and to payan administrative penalty of$17,125 to the Maryland CleanWater Fund. Hernwood Landfill, BaltimoreCounty – On July 28, MDE issuedan administrative Complaint, Or-der & Penalty against BaltimoreCounty for alleged solid waste andwater pollution violations at the

Hernwood Sanitary Landfill lo-cated in Granite, Maryland. TheOrder requires Baltimore Countyto submit to MDE’s Waste Man-agement Administration plans forcompletion of the landfill cappingproject and to submit to MDE’sWater Management Administra-tion plans for improvements tothe landfill’s leachate treatmentsystem to address alleged viola-tions of the ammonia effluentlimitations established in StateDischarge Permit 94-DP-2635.The Department is seeking an ad-ministrative penalty of $50,000 inthis case. Status: BaltimoreCounty has filed an appeal in thiscase. Settlement negotiationshave been initiated. (Reference #AO-05-0007; #C-O-AP-05-SW-006).
