Whereas, the petitioners namely Sh. Sanjay Kumar and
others approached Hon 'ble High Court by way of filing CWP No. 29946 of
201 7 titled as San jay Kumar and others versus State of Haryana & others
praying therein for issuance of writ of mandamus directing the
respondents to grant additional increments to the petitioners who have
acquired higher qualification in compliance of Government of Haryana
Circular dated 24.04.2 14 bearing Memo No. 10/01/2014-3GSI1
(Annexure P-1) from the date of acquiring higher qualification.
After considering the submissions made in the writ petition,
the Hon'ble High Court vide its order dated 29.01.2018 has observed and
issued directions to respondents as under:-
"This petition is disposed of in terms of order dated
August 17, 2017 passed in CWP No.18010 of 2017 in
Balbir Singh Sheoran and others v. State of Haryana and
another since the claim for additional increments is the
same as claimed in this writ petition.
Accordingly, the present writ petition is treated as a
representation on behalf of the petitioners and 'ls
disposed of with a direction to the respondents to look
into the grievance of the petitioners, hearing them and
take a final decision within three months from the date of certified copy of this order"
That the petitioners in CWP No. 18010 of 201 7 titled as Balbir
Singh Sheoran and others v. State of Haryana and others had prayed for
additional increment and to pay the arrears accordingly for .higher
qualification in view of Government of Haryana circular dated 24.04.2014 bearing Memo No. 10/01/2014-3GS-II.
The matter of grant of incentive for higher qualification was
considered by the Council of Ministers in its meeting on 26.1 Q.2016. and it
was decided vide memo No. 10/1/2014-3GS-II dated 17.01.2018 to
withdraw such grant of incentive for acquiring higher qualification except

approved that no Government Employee shall claim higher pay scale on
the ground of possessing higher qualification than essential qualification
of the post at the time or entry into Government Service or on acquiring

higher qualification during the service and the employee will be entitled
only to the pay scale prescribed for the post in the departmental Service Rules.
Thus, the claim of the petitioners for additional increments and
arrears thereto in view of Government of Haryana cir~ular. dated
24.04.2014 bearing Memo No. 10/01/2014-3GS-II is untenable in light of
the fact that the circular dated 24.04.2014 bearing Memo No.
10/01/2014-3GS-II stands withdrawn vide memo No. 10/ 1/2014-3GS-II dated 17.01.2018.
