Today’s Program… Righting Wrongful Convictions

Dale Leslie introduced today’s speaker, UofM Law Professor David Moran, co-founder of the Michigan Innocence Clinic (the Clinic). The Clinic was founded with then UofM professor Bridget McCormack in 2009 with the goal of freeing those wrongfully convicted of crimes in which DNA evidence is not available. It was the first of its kind in the nation to use non-DNA evi-dence (new evidence, not old bad evidence) and, to date, has freed 13 men and 3 women who were inno-cent of the crimes they were convicted of commit-ting. These men and women spent a total of 200 years incarcerated for crimes they didn’t commit.

Due to the proliferation of many CSI type television shows, many of us tend to think of DNA and other scientific advances as the only way to exonerate

those wrongfully convicted. As Prof Moran notes, when the DNA revolution hit in the 1990s, many cases where overturned, but these tend to be rape and rape/murder cases where DNA is left behind. In reality, less than 5% of felony cases in the US are cases in which DNA is available and, of these cases where DNA is available, statistic show that 3-5% of those convicted are actu-ally innocent. The effect on the wrongfully convicted individual, that individual’s family, and the costs on society are astounding. Not only that, when the wrong person is convicted, a crimi-nal is free to commit more crime. ~Continued on Page 5.

KCW starting at 6:30pm. All agenda items are due to Secretary Kathie Wilder by noon Sep-tember 15th.

Board-Designates are scheduled to meet as our new board next Monday, September 18 at 6:00pm at KCW to review and discuss next year’s budgets.

The following committees will meet after the meeting next Monday, September 18: Com-munity Services, Membership, Nominating, and Strategic Planning.

Remember, next week’s regular meeting will be held at KCD as will the meeting on the 25th.

Meeting dates for our Aktion Club have been confirmed with Bill Hallock. Meetings will be held at KCD at 10:00am starting next Tuesday, Sept 19, followed by Oct 3, Oct 17, Nov 7 and Nov 21.

Hospitality… We’re saddened to learn that Burt Lamkin’s brother, Keith Lamkin, passed

away in Petoskey at the end of July. Keith was instrumental in starting the Petoskey Kiwanis Club. Click here to read a short tribute to Keith for his work in making non-motorized trails a reality in Emmet County. Don Kossick tried but was unable to contact RJ Taylor, who has not been here for a while. He did talk to Don McEwen on Sunday night who, although he can no longer run a mile, says he’s doing fine. Don K also reminds us to keep Rip Kinney and his wife in our thoughts as they’re still having issues. William Hampton reports that Garry Evans spent the last week in the hospital with pneumonia and has been told to avoid crowds, etc., and asks that we keep him in our prayers. Dale Leslie entertained us with a story about Ed Makielski, who ran the Makielski Berry Farm for 65 years and passed away early this month. Sounds like Ed was a great guy. A big Welcome Back to Bob & Luz Snider and Burt & Sally Lamkin!

Announcements... Kathie Wilder, Sue Dailey and others reported on the great time had at the Kiwanis Dis-

trict of Michigan Annual Convention, where our Newsletter won the Second Place award. Congrats to Utica-Shelby who won First Place (sample their newsletter here). The con-vention attendees also noted a basic dues increase of $2 for Club members and a $4 in-crease to support K Family Clubs.

Fines… President Alan proposed a fine on all those not wearing their membership badges

and that passed. After Andrea Kotch Duda asked if those volunteering at KCD will move into the same department at KCW when the transition happens (you will), Dan Dever proposed a fine on everyone but Andrea that also passed. Kathie Wilder proposed a fine on all those who missed out on a good time and didn’t attend the District Convention. We passed that too.

Happy Dollars… Dale Leslie is happy to announce the 38th birthday of his son Dr. Drew C. Leslie, a music

professor at Appalachian State. He gives some credit to Larry Dittmar, who instead of working at the local Dairy Queen one year, was the band teacher at Wayne Memorial HS and taught Drew’s mother… the rest is musical history.

Max Ziegler is happy for both his upcoming birthday on September 12, but also for his 53rd wedding anniversary. Congratulations!

Bob Snider is happy to be honored as a Member Emeritus and for remembering all of his work for the club through the years. In the wake of Hurricane Irma, he’s also thankful for the advancement of our nation’s weather warning systems which allowed so many to make it to a safe place. How easily we forgot that it didn’t used to be this way.

Fred Sanchez is happy for many things, including Eastern Michigan’s football team beating a Power 5 team for the first time in 58 years, for his 36th year as a UofM usher on the 50th yard line, for Michigan State’s win over Western and, best of all, The Ohio State University’s loss to Oklahoma at home. This editor thinks Oklahoma gained many new fans this past weekend.

Jerry Brown was happy to attend game day activities in Arlington, Texas and encourages us all to join in the fun.

Evan LeRoy, like Fred and many of us, is happy for Oklahoma and the loss to Ohio State.

Mitch Goodkin found out his daughter and her family are safe and unhurt in Orlando, Flori-da and is very happy for that. He’s also happy that his granddaughter Erin graduated from high school and, fulfilling a promise made long ago, sent Erin, her mother Debbie and grandmother Barbara on a wonderful trip to Europe. He also spent time in Los Angeles this summer, where he was able to see his brother for the first time since 2001.

Nick Dever got call about a bear in his family cottage in Canada. The good news is that the bear was polite enough to slide open the kitchen window to get in. The bad news is that Nick and his son put a screw through the same window while trying to secure it from fur-ther intrusion.

Kathy Barden-Perlberg is happy for the Wednesday night work parties. She encourages more to attend; we need the help to get KCW ready and it’s also a good time.

Jerry McMahon is thankful for the help from Jim Carey in purchasing a lot on Ford Lake, which Jerry intends to build a house on .

Today’s Program Continued… Many factors lead to wrongful convictions, including, but not limited to, incorrect witness statements, under -staffed and under-funded crime labs, police misconduct, over-reliance on jail house snitches and poor legal representation. Michigan is actually one of the worst states in regards to providing legal representation to the poor due to our county-based system.

Prof Moran highlighted the case of Desmond Ricks, who spent 25 years in prison for a murder he didn’t commit. Prof Moran and his colleagues spent five years talking to witnesses, reviewing court transcripts and every other piece of evidence they could find. They eventually found that the Detroit Police Crime Lab had falsified bullet evidence that was the main evidence that convicted Mr. Ricks. I would write more about this case if I had more room but anyone interested can Google “Desmond Ricks innocent” to read about his case and exoneration. I’m thankful for the Michigan Innocence Clinic and the important work they do and we thank Prof Moran for spending his afternoon with us. For those wanting more information on wrongful convictions, Prof Moran suggests the following 2 books; Actual Innocence: When Justice Goes Wrong and How to Make it Right by Barry Scheck, Peter Neufeld and Jim Dwyer and Convicting the Innocent by Brandon Garrett. The second title is available for loan from the AA District Library system. Ann Arbor Club would be interested in hosting the August 2019 Michigan District Convention in the Ann Arbor area. This is just informal at this point, gauging interest of our club, Division 6 and 3 other local Ann Arbor clubs.

Congratulations to Larry Memmer from the Kiwanis Club of Chelsea who was just elected at the District Convention to be our Michigan District of Kiwanis’ new Governor-elect.

Jim Carey notes that Motts Children’s Hospital has asked us to return to serve dinner on Thursday, October 5. The commitment would be from 5:30-7:30 pm. See Jim for more information.

Archive Committee – The archive committee is look-ing for members who are interested in work with the Committee for Movement of the Club and Business Office under Greg Meisner to help determine the placement for display of any moved objects to KCW.

All Committee Chairs and Members – It’s time to con-firm and/or ask about your participation on individual committees for the new Kiwanis year prior to October 1. This needs to be done by mid-September to be listed in the new Membership Digest.
