What to expect… after you file
your adjustment of status petition.

Ok, so you filed your adjustment of status
petition (hopefully you included all the right fees, forms, and evidence) but what happens
next?

What’s first?
Unless the petition is rejected because you made a mistake the first thing to expect is a set of receipt notices for the visa petition, the green card application, and any other application you filed.

Biometrics Appointment
After you get your receipt notices, you should expect a “biometrics” appointment. Basically
it’s a fingerprint and headshot session with the USCIS.
If you’re lucky it will be somewhere near your
location.

DO NOT MISS YOUR
BIOMETRICS APPOINTMENT
If you can’t make it, call or write and request that it be rescheduled. If you miss it your case
will be denied and you’ll get deported. Or you’ll lose your money. Bad things will definitely
happen.

Request for Evidence
After your biometrics appointment you might get an “RFE” (request for evidence) asking for documents. If you already submitted the documents the USCIS is asking for, submit
them again. DO NOT FAIL TO RESPOND TO THE RFE! IF YOU DO, YOU WILL BE DEPORTED. Or you’ll lose your money. Bad things
will definitely happen.

After you respond to the RFE (if you got one), just wait. And wait. And wait. AND WAIT.
Maybe, if you’re lucky, you’ll get a work card and travel permission. With that work card, you can get a social
security number and driver’s license.

If you’re out of status but the USCIS gave you travel permission…
DO NOT TRAVEL OUTSIDE OF THE
UNITED STATES!
Very very bad things may happen. You may be barred from ever becoming a
resident soon to be deported bad. Travel after you’re a resident ok?

THE INTERVIEW!! Yes! You finally got the interview notice!

What happens if you do?
Denied Deported. Very bad.

What to expect at the interview?
In a marriage case, the USCIS will check that the marriage is real (shared assets and liabilities, hold yourself out to the public as a couple, etc..); check on addmissiblity (not a terrorist, criminal,
previously deported, make enough $$$, etc…); and check that the documents are in order (right information; all the right boxes
checked). Beware. They can be nice or they can be mean.

The End?
If you make it out of there alive, and are approved, expect a green card within 2-4 weeks.
Now go on that trip to a tropical paradise.
