Electricity Transmission Amendment Regulations (No. 2) 2006

Made by the Governor in Executive Council.

1. Citation

These regulations are the Electricity Transmission Amendment Regulations (No. 2) 2006.

2. Commencement

(1) These regulations come into operation at the time at which the first trading day under the market rules commences.

(2) In subregulation (1) —

“market rules” means the market rules made under the Electricity Industry Act 2004 Part 9.

Note: The market rules require the Minister for Energy to publish in the Gazette the time at which the first trading day commences.

3. The regulations amended

The amendments in these regulations are to the Electricity Transmission Regulations 1996*.

4. Regulation 3 amended

Regulation 3(1) is amended as follows:

(a) by deleting the definitions of “market member”, “wholesale electricity market commencement” and “wholesale electricity market participant”;

(b) after the definition of “voltage control” by deleting the semicolon and inserting instead a full stop.

5. Regulation 18A inserted

Before regulation 19 the following regulation is inserted in Part 4 —

“ 18A. Application of Part modified for wholesale

electricity market

(1) In this regulation —

“market rules” means the market rules made under the Electricity Industry Act 2004 Part 9;

“wholesale electricity market commencement” means the time at which the first trading day under the market rules commences.

(2) After wholesale electricity market commencement this Part (other than regulation 24) does not apply to, or in relation to, a user if the user’s access agreement relates to any part of the South West interconnected system.

6. Regulation 19 amended

Regulation 19(1a) is repealed.

7. Regulation 20 amended

(1) Regulation 20(1a) is repealed.

(2) Regulation 20(1) is amended in the definition of “Prices and Charges Paper” as follows:

(a) by deleting “, in relation to a corporation,”;

(b) by deleting “the corporation” and inserting instead —

“ the Regional Power Corporation ”.

(3) After regulation 20(1) the following subregulation is inserted —

“ (1a) In the case of the electricity transmission network

operated by the Electricity Networks Corporation, the loss factor for a particular connection or a connection of a particular class, is the loss factor (as defined in the market rules made under the Electricity Industry Act 2004 Part 9) for that connection or class.

”.

(4) Regulation 20(2) is amended by deleting “The” and inserting instead —

“ In the case of any electricity transmission network

operated by the Regional Power Corporation, the ”.

3. The regulations amended

The amendments in these regulations are to the Electricity Distribution Regulations 1997*.

5. Regulation 20A inserted

Before regulation 21 the following regulation is inserted in Part 4 —

CO401* CONSERVATION AND LAND MANAGEMENT ACT 1984

(Section 14) PROPOSAL TO RESERVE WESTERN AUSTRALIAN WATERS

Proposed Walpole and Nornalup Inlets Marine Park. Notice is hereby given under section 14 of the Conservation and Land Management Act 1984 (CALM Act) of a proposal to reserve Western Australian waters under section 13(1) of the CALM Act as a marine park in the waters of the Walpole and Nornalup Inlets. Notice is also given that it is proposed that the proposed marine park will be classified as Class A. Any person may make a written submission on this proposal and all persons with an interest in the proposal are encouraged to do so. Marine parks are created to protect natural features and aesthetic values while at the same time enabling recreational and commercial uses where these activities do not compromise conservation values (the statutory purpose of marine parks is provided in CALM Act section 13B(1)). The proposed Walpole and Nornalup Inlets Marine Park comprise the waters of the State, including the airspace above those waters and sea-bed to a depth of 200 metres below those waters, bounded by the coordinates described below. The boundary of the proposed Walpole and Nornalup Inlets Marine Park follows the shoreline of both inlets and the shorelines of the Frankland River to Monastery Landing, the Deep River to the Bibbulmun Track swing-bridge and the Walpole River to the South Coast highway bridge. The boundary extends to low water mark where it is adjacent to the boundary of the Walpole-Nornalup National Park, and elsewhere to high water mark. The ocean boundary is delineated by a line of longitude at 116° 44’ 15” East. All geographic coordinates are expressed in terms of the Geocentric Datum of Australia 1994 (GDA94). High Water Mark (HWM) is the ordinary (mean of) high water mark at spring tides as defined by the Land Administration Act 1997. Western Australia’s coastal waters are defined by the Coastal Waters (State Powers) Act 1980. An indicative management plan has been prepared outlining how the proposed Walpole and Nornalup Inlets Marine Park would be managed. This plan includes a map and details of the proposed boundaries, zoning and management strategies for the proposed reserve. Under CALM Act Section 62 (1a), the proposed Walpole and Nornalup Inlets Marine Park is intended to be classified as recreation area in its entirety. The following activities are considered to be incompatible with the purpose of this management zone: all commercial fishing activities; aquaculture; mineral and petroleum drilling and development; recreational netting; spearfishing; and the discharge of boat sewage.

DECLARATION OF LOCAL-INTAKE AREAS FOR SCHOOLS WITH SECONDARY STUDENTS AFFECTED BY THE ESTABLISHMENT OF PERTH MODERN SCHOOL AS A CENTRE OF EXCELLENCE

(Pursuant to Sections 60, 78, 79 and 80) The Hon. Minister for Education has declared that the local-intake areas for the secondary schools listed hereunder shall be as stated in this notice. Children of compulsory school age who reside within the local-intake areas of the following secondary schools shall be entitled to attend the schools to which such local-intake areas apply if there is an appropriate educational program for them at that school. The local-intake area of a secondary school may be defined in this notice by listing the names of the contributory primary schools, the local-intake areas and the traditional catchment areas of which, when amalgamated, constitute the local-intake area of that secondary school. Children who reside outside these local-intake areas may apply to attend the schools to which such local-intake areas apply.

Where the area of land is 2020 square metres or less, all inflammable material on the land

shall be removed from the whole of the land, and the property mowed. The height of the grass when mowed shall not exceed 75mm.

ii. Where the land exceeds 2020 square metres in area, firebreaks (mineral earth break) at least 3 metres wide and high shall be cleared of all inflammable materials immediately—

(a) inside all external boundaries of the land; and (b) surrounding all buildings situated on the land. Inflammable material is defined for the purpose of this notice to include Wattle Tree, Tea Tree, dead trees, timber, boxes, cartons; paper and like inflammable material, rubbish and also any combustible matter, but does not include living trees, shrubs, growing bushes and plants under cultivation. The purpose of a firebreak is to stop the spread of fire and to allow the entry of fire fighting vehicles also to provide a break from which back burning can take place to control a fire. Persons who fail to comply with the requirements of this notice may be issued with an infringement notice or prosecuted. Where the owner fails to comply with the Requisitions of the notice, Council or its Duly Authorised Officers will carry out the required work at the cost of the owner or occupier.
