The Roads Act, 1911.

WHEREAS by Section 139 of "The Roads Act, 1911,'' it is provided that, subject to the provisions of "Th-, Permanent Reserves Act, 1899," the Governor may place any Public Reserve under the control and management of a Road Board, and that for the purpose of controlling or managing such Reserve the Board shall have all the power of a Board of Parks and Reserves appointed under " The Parks and Reserves Act, 1895," together with the powers conferred by "The Roads Act, 1911"; And whereas it is expedient that Reserve 14004 (Recreation, Mandurah) should be placed under the control and management of the Murray Road Board: Now, there-fore, His Excellency the Governor, by and with the advice and consent of the Executive Council, and in exercise of the power conferred by the recited section of "The Roads Act, 1911," cloth hereby place the said Reserve under the control and management of the Mur-ray Road Board.

HIS Excellency the Governor in Council has been pleased, on the advice of the Advisory Committee, to approve the following amendment of Regulation 58.

Amendment. THE Regulations published in the Government Gazette of the 17th day of July, 1914, are hereby amended by adding to Regulation 58 a paragraphs as follows:-

3x. Notwithstanding anything herein contained to the contrary, Irish whisky shall be spirit distilled from barley, malt, or other grains, certified, to the satisfaction of the Customs, to have been matured by storage in wood for a period of not less than two years, and shall be sold under one of the following designations, and con-form to the respective standards specified therefor :-

(a.) Standard pot still whisky shall contain at least 35 grammes of compound ethers and 200 grammes of higher alcohols per 100 litres of absolute alcohol, when these ingredients are estimated strictly by the methods laid down in Schedule A attached to these Regulations.

(b.) Blended whisky containing at least seventy-five per centum of standard pot still whisky shall contain not less than 30 grammes of compound ethers, and 160 grammes of higher alcohols per 100 litres of absolute alcohol.

(c.) Blended whisky containing at least fifty 'per centum of standard pot still whisky shall con-tain not less than 25 grammes of compound ethers, and 130 grammes of higher alcohols per 100 litres of absolute alcohol.

(d.) Blended whisky containing less than fifty per centmn of standard pot still whisky shall be that which fails to comply with any of the abovo standards.

HIS Excellency the Governor in Executive Council has been pleased to approve of the following By-laws under the provisions of "The Cemeteries Act, 1897," and amending Acts, for the use of the Nabawah Cemetery Reserve No. 15203.

BY-LAWS OF NABAWAH PUBLIC CEMETERY.

1. That all fees and charges payable to the Trustees, in accordance with Schedule "A," shall be paid when applications are made or orders given.

2. That any person desiring ground in the Cemetery for a private grave, vault, tomb, cenotaph, tombstone and railing, wall, or for any other purpose, shall apply to the Trustees therefor. If approved, the Trustees, on payment of the required fees, shall issue to such persons so applying a certificate of right of burial in the form specified in Schedule "B."

3. Any person desiring to place or erect any monu-ment, tombstone, on enclosure in any part of the Ceme-tery shall, before obtaining permission to do so, submit a plan of such monument, tombstone, or enclosure, and specify the materials of which it is to be composed, to the Trustees, and shall obtain such permission, in writ-ing, in the form of Schedule "D," before proceeding with the work.

4. If any person shall erect or place any monument or tombstone or enclosure upon any grave, the exclusive right of which has not been obtained, and shall fail to keep the same in repair after receiving one month's notice in writing from the Trustees so to do, then the Trustees may remove such monument, etc.

5. Every person who has the exclusive right of burial in any grave shall keep such grave, and any erection thereon, in proper repair, and if, after receiving notice in writing from the Trustees requiring such repairs to be executed, shall fail so to do, then after the expira-tion of twenty-eight clays the Trustees may cause such repairs to he executed, and may recover the cost thereof from such person before any two Justices- in Petty Sessions.

G. (a.) That all applications for interment shall be inade to the Secretary of the Trustees, and six working hours' notice shall be given to the Sexton prior to the time fixed for the burial, otherwise an extra charge will he made.

(b.) The name, age, and other particulars of the deceased shall be furnished when giving the order, as in Schedule "C."

7. The Trustees shall cause all ordinary graves to be dug, but any person desiring to construct a brick grave or vault shall be permitted to construct the same under the directions of the Surveyor, on payment of the required fees, and every coffin placed therein shall be bricked in and made and kept air-tight.

8. That every coffin shall have upon the lid a lead or copper plate with the name of the deceased and date of burial thereon.

9. Every grave shall be at least six feet deep, except those used for the burial of infants, which the Trustees may allow to be of a lesser depth, but no interment shall be allowed in any grave with a lesser depth than three feet fiom the top of the coffin to the original surface of the ground.

10. That in ease of application for interment in any private grave or vault to which during life the deceased Person had no claim, the written consent of the owner shall be given with the application, or other satisfactory evidence that the person desiring to bury therein is entitled to do so.

11. That no burial shall be permitted to take place inn the Cemetery- without an order for burial being obtained from the Secretary of the Cemetery in the Iona of Schedule "C," and delivered to the Sexton of the Cemetery.

12. the hours for burials shall be as follows:— Omm wook-days.—Throughout the year, 8 an to

6 p.m. ()PSI' ndo ys.—Throughout, the year, from 9 a.m.

to 10 a.m., and from 12 noon to 5 p.m. 13. That no burial shall be allowed to take place

before or after the hours above mentioned, except by special permission and upon payment of the tee for burials "not in the usual hours."

14. That the time stated in Schedule "C" for any burial shall be the time for the funeral to be at the Cemetery, and the same shall be punctually observed.

15. 'Flint every funeral shall enter by the principal entrance and thence follow' the Sexton to the grave. No bicycle, velocipede, carriage or vehicle, except hearses and mourning coaches, shall be permitted to pass the said entrance. Horses shall not be driven faster than at a walking pace, and no horses or other animals shall he ridden throtmgh the cemetery.

16. That every erection shall he placed upon proper foundations, and, if required by time Trustees, shall extend to the bottom of the Crave. All refuse and rubbish and material remaining i ter any work is com-pleted shall be remnoved front the cemetery at once, and at the expense of the person causing the same.

17. All materials required in the making, repairing, or completion of any work shall be fully prepared before Being taken into the Cemetery.

18'. That no catacomb shall be allowed. 19. That the Trustees shall not (except in very excep-

tional circumstances, and when an order to exhume any corpse has been obtained under Section It of "The Cemeteries Act, 1897") permit the removal of any corpse from any grave for re-interment in this or any other Cemetery, and before any such exceptional case e1101 be dealt with by the Trustees, a written application setting forth the reasons for the proposed removal of such corpse, and verified by a statutory declaration, shall be produced by the nearest available representative of the deceased, and, in the event of such application being granted, the permission of the Colonial Secretary, in addition to the permission of the Trustees, shall be obtained, If found necessary, the coffin shall be enclosed in a second and air-tight wooden or leaden coffin prior to removal.

20. , That any -workman or other employee employed by the Trustees, or by any other person, shall at all times while in the Cemetery be subject to the super-vision, direction, and control of the Surveyor, and shall obey all such directions, and shall be removable from the Cemetery upon any breach of the By-laws or any refusal or neglect to comply with or obey any such directions,

21. Any person taking part in the dressing or attend-ing to any graves shall comply with the following rules, namely:—

That no person in the Cemetery or in its approaches shall commit any nuisance or trespass or be guilty of any breach of decorum, or cut, pluck, gather, or take out of the Cemetery any flower, -plant, shrub. nc tree. or any Dart thereof, or do any injury whatso-ever thereto. or to any plot, border, railing, fence. or an erection or road, or remove or interfere with a nything laid, built, or placed on any grave or plot or place; and

any person so doing shall be guilty of a breach of this By-law, and on conviction be liable to a penalty as here-inafter provided for.

27. That no person shall promote or advertise or carry on within the Cemetery or its precincts or ap-proaches any trade or business or calling, either by solicitation, distribution of cards or circulars, or other-wise, or any other system. of advertisement whatever.

28. The Secretary or Surveyor, as referred to in these By-laws, meaus the person for the time being employed by the 17, ustees as such for the Cemetery, and such person or persons shall, subject to the Trustees, exercise a general supervision and control over all matters pertaining to the Cemetery, and to carrying out the enforcement of these By-laws, and the direction of such person or persons shall, in all cases, and for the purposes, be presumed to be and to have been the direction of the Trustees.

29. That all fees not paid may be recovered, and all proceedings under these By-laws taken before any two Justices in Petty Sessions, except where otherwise pro-vided for.

30. That any person committing a breach of any of these By-laws shall be proceeded against, and shall be liable, on conviction, to such penalties as are hereinafter provided for.

31. That a plan of the Cemetery, showing the dis-tribution, sections, blocks, graves, numbered, a register of burials, certificates of right of burials, shall lie kept at the office of the Trustees.

32. That the officiating minister at any burial shall be given at least six hours' notice prior to time time stated for such burial.

33. Any person committing a breach of 'any of the foregoing By-laws shall he liable to a penalty not exceeding Five pounds, and in case of a continuing breach, not exceeding One pommel for every day during mvhich such breach continues.

The -foregoing By-laws, with the accompanying Sche-dules, were duly framed and presented to a meetim,--- the Poard of Trustees held at their office on Sato' 2Sth September, 1915, and adopted.

WHEREAS by virtue of the provisions of "The Roads Act, 1911" (1 George V., No. 29), and amendments thereto, the Road Board of every Road District is em-powered to make, alter, and repeal By-laws for any of the purposes of the said Act, and the Cottesloe Beach Road Board, in pursuance of such powers vested in the said Board under and by virtue of the said Act, and of every other Act and authority enabling it on that be-half, cloth hereby make the following. By-law:-

- That all persons intending to erect, alter, or add to any building within the Road Area now or here-after to be prescribed under the Building Regula-tions shall, before commencing., deposit with the Secretary for approval drawing's showing the plans, elevations, and, sections of such building, altera-tions, or additions, together with full and complete specifications of the narks proposed to be done.

Seale of Fees. The following fees shall be paid_ by the owner or

builder to the Road Board in respect of all build-ings to be erected or altered, or any matter re-quired or permitted under these By-laws or the Road Act :-

For all buildings, estimated cost three hundred pounds or under, license fee ten shillings and six-pence.

For all buildings over three hundred "pounds, ten shillings per cent.

Maximum fee chargeable, two pounds two shil-lings.

All fees shall become part of the ordinary rev-enue of the Cottesloe Beach Road Board.

Second Schedule. Additions and Amendments to Uniform General By-laws

for Regulating Motor Traffic and Standard Lights to be carried by all Vehicles.

Add to By-law No. 1, at the -end of the definition of the word "trailer," and includes the following words:-

` Any attachment to a motor cycle." Add the following new By-law:—

No. 91. (1.) No person shall in any way obscure or conceal the number on any number plate attached to any motor car, motor wagon, motor carrier, or motor cycle, or suffer or permit any such number to be in any way obscured or concealed.

(2.) Without prejudice to the generality of the above prohibition, the following acts or omissions are pro-hibited, that is to say :—Placing any article or thing or suffering any article or thing to be placed over, before, or upon the number or any part thereof ; smearing or putting any grease or oily matter or suffering any grease or oily matter to be smeared o• put on or above the number or any part thereof.

(3.) Any person who contravenes any provision of this By-law, whether by act or omission, shall, on sum-mary conviction, be liable to a penalty not exceeding £20.

THE GOVERNMENT GAZETTE.

The Government Gazette is published on Friday in each week, unless otherwise interfered with by Public Holiday's or other unforeseen circumstances.

SUBSCRIPTIONS.—The Subscription to the "Government Gazette" is as follows :-22s. 6d, per annum, 12s. per half year, and 7s. per quarter. Single copies 6d., previous years up to ten years ls., over ten years 2s. 6d.

Subscriptions are required to commence- and terminate with a month:

Advertisements: Notices for insertion must be re-ceived by the Government Printer before Ten o 'clock on the day preceding the day of publication, mid are charged at the following rates :—

For the first eight lines, 4s.; For every additional line, 4d.,

and half-price for each subsequent insertion. To estimate the cost of an advertisement, count nine

words to a line; heading, signature, and date being reckoned as separate lines.

All fees are payable in advance. Remittances should be made by money order, postal note, or cheque. Ex-change must be added to cheques.
