REGULATIONS FOR TENDERS AND CONTRACT FOR THE GUIDANCE OF
CONTRACTORS FOR MECHANICAL ENGINEERING WORKS.
1. MEANING OF TERMS:
Definition
In these Regulations for Tenders and Contract the following
terms shall have the definitions meanings assigned hereunder
except where the context otherwise required:-
(a) "Railway" shall mean the President of the Republic of India or
the Administrative Officers of the West Central Railway or of
the Successor Railway authorized to deal with any matters,
which these presents are concerned on his behalf.
(b) "General Manager" shall mean the officer in administrative
charge of the whole of Railway or exercising the powers of
General Manager for the subject contract and shall mean and
include the General Manager of the successor Railway.
(c) “Chief Mechanical Engineer" shall mean the officer in charge
of the Mechanical Department of West Central Railway.
“Chief Workshop Engineer” shall mean the officer in charge of
all Workshops of West Central Railway.
(d) "Chief Workshop Manager” shall mean the Officer in charge
of Workshop, CRWS, Bhopal.
(e) “Engineer” shall mean the Divisional/District Mechanical
Engineer or the Works Manager in executive charge of the
works and shall include the superior officers of the Mechanical
Department of the West Central Railway i.e. the Dy. Chief
Mechanical Engineer shall mean and include the Engineers of
the successor Railway.
(f) "Engineer’s Representative" shall mean the Assistant Works
Manager/Works Manager in direct charge of the work and
shall include any Resident Engineer or Section Engineer or any
Inspector of the Mechanical Engineering Department
appointed by the West Central Railway and shall mean and
include the CWM's Representative of the successor Railway.
(g) "Contractor" shall mean the person firm or company whether
incorporated or not who enters into the contract with the
Railway and shall include their executor’s administrators,
Successors and permitted assigns.
(h) "Divisional Railway Manager" shall mean the Administrative
Officer in charge of a Division of West Central Railway for the
time being and shall mean and include the Divisional Railway
Manager of the successor Railway.

(i) "Tenderer" shall mean the persons, the firm or company who
tenders for the work with a view to execute the works on
contract with the Railway and shall include their personal
representatives, successors and permitted assigns.
(j) "Limited Tenders" shall mean tenders invited from all or some
Contractors on the approved list of Contractors with the
Railway.
(k) "Open Tenders" shall mean tenders invited in open and public
manner and with adequate notice.
(l) "Works" shall mean the works contemplated in the drawings
and schedules set forth in the tender forms and description of
contract and required to be executed according to
specifications.
(m) "Specifications" shall mean the specifications for Materials &
Works, Central Railway issued under the authority of the Chief
Mechanical Engineer or as amplified, added to or superseded
by special specifications, if any, appended to the Tender
Forms.
(n) "Schedule of Rates of the West Central Railway” shall mean
the Schedule of Rates issued under the authority of the Chief
Mechanical Engineer from time to time.
(o) "Drawing" shall mean the drawings, plans and tracings or
prints thereof annexed to the Tender Forms.
2. Words imparting the singular number shall also include the
plural and vice versa where the context requires.

3. These Regulations for Tenders and Contracts shall be read in
conjunction with the General Conditions of Contract which are
referred to herein and shall be subject to modifications,
additions or super session by special conditions of contract
and/or special specifications, if any, annexed to the Tender
Forms.
4. A contractors who has not carried out any work so far on this
Railway should furnish the particular regarding :-

Credentials
(a) his position as an independent contractor;
(b) his capacity to undertake and carry out works satisfactorily,
as vouched for by a responsible official or firm;
(c) his previous experience on works similar to that to be
contracted for in proof of which original certificates or
testimonials may be called for and their genuineness verified if
need be, by reference to the signatories thereof;
(d) his knowledge, from actual personal investigations of the
resources of the Zone or Zones in which he offers to work;

(e) his ability to supervise the work personally or by competent
and duly authorized agents;
(f) his financial position;
(g) An authorized copy of income tax clearance certificate or PAN
should be sent, without which the tender will not be
considered.
5. Should a tenderer find discrepancies in, or omissions from the
drawings or any of the Tender Forms or should he be in doubt
as to their meaning he should at once notify the authority
inviting tenders who may send a written instruction to all
tenderers. It shall be understood that every endeavour has been
made to avoid any error which can materially affect the basis
of the tender and the successful tenderer shall take upon
himself and provided for the risk of any error which may
subsequently be discovered and shall make no subsequent
claim on account thereof.

6 The tenderer shall be required to deposit earnest money with
the tender for the due performance with the stipulation to keep
the offer open till such date as specified in the tender, under the
conditions of tender. The earnest money shall be 2% of the
estimated tender value as indicated in the Tender Notice.
7(a) Before submitting a tender, the tenderer will be deemed to have
satisfied himself by actual inspection of the site, nature of work
including shape, size, and other physical condition of
Job/works and locality of the works, that all conditions liable to
be encountered during the execution of the works are taken
into account and that the percentage/rates* he enters in the
tender form is/are adequate and all inclusive to accord with the
provisions in Clause 37 of the General Conditions of Contract
for the completion of works to the entire satisfaction of the
Engineer.
7(b) When work is tendered for by a firm or company of
contractors, the tender shall be signed by the individual legally
authorized representative to enter into commitments on their
behalf supported by Power of Attorney & Partnership Deed in
case of partnership firms.
The Railways will not be bound by any power of attorney
granted by the tenderer or By change in the composition of the
firm made subsequent to the execution of the contract. It may,
however, Recognize such power of attorney and changes after
obtaining proper legal advice, the cost of which will be
chargeable to the Contractor.

8. At the advertised time and place, tenders received for contract
shall be opened by a Committee of officials, and where
practicable, the names of tenderer and the rates tendered by
them read out in the presence of such of the intending
contractors or their agents as may attend.

9. The Railway reserves the right of not to invite tenders for any
work or works, or to invite open or limited tenders and when
tenders are called to accept a tender in whole or in part or reject
any tender or all tenders without assigning reasons for any such
action.

10. The tenderer whose tender is accepted shall be required to
appear at the office of the Chief Workshop Manager, CRWS,
Bhopal or if a firm or corporation, a duly authorized
representative shall so appear and execute the contract
documents within seven days after notice that the contract has
been awarded to him. Failure to do so shall constitute a breach
of the agreement effected by the acceptance of the tender in
which case the full value of the earnest money accompanying
the tender shall stand forfeited without prejudice to any other
rights or remedies.
In the event of any tenderer whose tender is accepted shall
refuse to execute the contract documents as herein before
provided, the Railway may determine that such tenderer has
abandoned the contract and thereupon his tender and the
acceptance thereof shall be treated as cancelled and the
Railway shall be entitled to forfeit the full amount of the
earnest money and to recover the liquidated damages for such
default.

11. Every contract shall be completed in respect of the documents
it shall constitute. Not less than 5 copies of the contract
documents shall be signed by the competent authority and the
contractor and one copy given to the contractor.
(a) For contracts for specified works, valued at more than
Rs.10000 the contract documents required to be executed by
the tenderer whose tender is accepted shall be the agreement at
printed tender booklet.

12. (i). The drawing if mentioned in this contract with drawing number for
executing the work can be seen in the office of Chief workshop Manager,
CRWS, Bhopal at any time during office hours.
(ii). The details of the works can also discussed with concerned
Official/Officers of CRWS, Bhopal at any time during office hours.
13. General Conditions of Contract works and other details of works can be
seen at the office of Chief Workshop Manager, CRWS, Bhopal.
14. Tenders containing erasures and alterations of the tender documents are
liable to be rejected. Any correction made by the Tenderer/Tenderers in
his/their entries must be attested by him/them. The Tenderer/Tenderers shall
quote his/their overall cost as percentage rates with reference to sum of each
item and must tender for all the items shown in the attached Schedule. The
quantities shown in the attached Schedule are given as a guide and are
approximate only and are subject to variation according to the needs of
Railway. The Railway accepts no responsibility for their accuracy. The
Railway does not guarantee work under each item of the Schedule.
Percentage rates of works should be written in words as well as in figures at
specified place. In case of discrepancies between the rate quoted in figures
and words, the lowest rate quoted in words or figure taken as valid one and
no submission after opening of tender is acceptable
15. The works are required to be completed on daily basis over a period of 02
years.
16. The tender must be accompanied by a sum of Rs. 65217/- as earnest money
deposited in any forms mentioned in the tender notice/tender document
failing which the tender will be summarily rejected. The tenderer shall hold
the offer open till such date as may be specified in the tender. It is
understood that the tender documents have been sold/issued to the tenderer
and the tenderers is being permitted to tender in consideration of the
stipulation on his/their part that after submitting his tender, he will not resile
from his offer or modify the terms and conditions thereof in a manner
not acceptable to the Chief Workshop Manager, CRWS, Bhopal of the
West Central Railway. Should the tenderer fail to observe or comply with
the foregoing stipulation, the amount deposited as security for the due
performance of the above stipulation shall be forfeited by the Railway.
If the tender is accepted, the amount of earnest money will be held as part of
security deposit for the due and faithful fulfillment of the contract. The
earnest money of the unsuccessful tenderer hall save as herein before
provided be returned to the unsuccessful tenderers but the Railway shall not
be responsible for any loss or depreciation that may happen to the security
for the due performance of the stipulation to keep the offer open for the
period specified in the tender documents or to the earnest money while in
their possession, nor be liable to pay interest thereon.
17. It shall not be obligatory on the said authority to accept the lowest tender
and no tenderer/tenderers shall demand any explanation for the cause of
rejection of his/their tender.

18. If the tenderer deliberately gives/tenderers deliberately give wrong
information in his/their tender or creates/create circumstance for the
acceptance of his/their tender, the Railway reserves the right to reject such
tender at any stage.
19. If a tenderer expires after the submission of his tender or after the
acceptance of his tender, the Railway shall deem such tender as cancelled.
If a partner of a firm expires after the submission of their tender or after the
acceptance of their tender, the Railway shall deem such tender as cancelled
unless the firm retains its character.
20. The earnest money including the amount taken as security deposit for the
due performance of the stipulates to keep the offer open till the date
specified in the tender will be refunded to the unsuccessful
tenderer/tenderers within reasonable time. The earnest money deposited by
the successful tenderer/tenderers will be retained towards the security
deposit for the due and faithful fulfillment of the contract but shall be
forfeited if the contractor fails/contractors fail to execute the Agreement
Bond or start work within a reasonable time ( to be determined by the
Mechanical Engineer in-charge after notification of the acceptance of
his/their tender.
21. The tenderer is required to produce following documents along with
original tender papers duly filled & signed at all pages.
1. Earnest money in proper form.
2. Current and valid PAN.
3. Partnership Deed.
4. Power of Attorney.
5. Tender documents duly signed & completed.
Any other document the tenderers may like to submit in support of his
credentials/scheme.
22. Tenders must be enclosed in sealed cover, super scribed " Miscellaneous
work related to RRWI, Hostel, TTC, ORH & Crèche of CRWS/BPL” and
must be deposited in the special box allotted for the purposes in the office of
Chief Workshop Manager not later than 15.00 hours on the 30.03.2016.
The box will be sealed at 15.00 hours on 30.03.2016 and will be opened at
15.15 hours on 30.03.2016. Those who wish to attend may do so.
23. ‘Delayed’ & ‘Late’ tenders will be dealt as per rules issued by Railway
Board.
24. Non-compliance with any of the conditions set-forth herein above is liable
to result in the tender being rejected.
25. Accepting Authority:-
The authority for the acceptance of the tender will rest with the Chief
Mechanical /Chief Workshop Manager, Dy.CME/or any other competent
authority, West Central Railway who does not bind himself to accept the
lowest or any other tender nor does he undertake to assign reasons for
declining to consider any particular tender or tenders.

26. The successful Tenderer/Tenderers shall be required to execute an
Agreement with the President of India acting through the Chief Workshop
Manager, CRWS, Bhopal of the West Central Railway, for carrying out the
work according to the General Conditions of Contract and Specifications for
Works and Materials of West Central Railway.
27. The Tenderer shall keep the offer open for a minimum period of 90- days
from the date of opening of the tender within which period; the tenderer
cannot withdraw his offer, subject to the period being extended further if
required by mutual agreement from time to time. Any contravention of the
above condition will make the tenderer liable for forfeiture of his earnest
money / Standing Earnest Money. The tenderer(s) quoting against stipulated
standing earnest money must keep the offer open to the extent specified in
the tender documents. Any contravention of the above will make the tender
liable to forfeiture of his part/full standing earnest money.
28. Should a tenderer be retired Engineer of the Gazetted rank or any other
Gazetted Officer working before his retirement, whether in the executive/or
administrative capacity, or whether holding a pension able post or not, in
the Mechanical Engineering Department of any of the Railway owned and
administered by the President of India for the time being, or should a
tenderer being partnership firm have as one of its partners a retired Engineer
or a retired Gazetted officer as aforesaid, or should a tenderer being as
incorporated company have any such retired Engineer or retired Officer as
one of its directors, or should a tenderer have in his employment any retired
Engineer, or retired gazetted Officer as aforesaid the full information as to
the date of retirement of such Engineer or gazetted officer from the said
service and in cases where such Engineer or Officer had not retired from
Government service at least two years prior to the date of the submission of
the tender as to whether permission for taking such contract, if the
contractor be a partnership firm or an incorporated company, to become a
partner or director as the case may be, or to take employment under the
contractor has been obtained by the tenderer or the Engineer or the Officer
as the case may be from the President of India or any officer duly
authorized by him in this behalf shall be clearly stated in writing at the time
of submitting the tender. Tenders without the information above referred
to or a statement to the effect that no such retired Engineer or retired
Gazetted Officer is so associated with Tenderer, as the case may be, shall be
rejected.
29. Should a Tenderer or Contractor being an individual on the list of approved
Contractors, have a relative employed in gazetted capacity in the
Mechanical Engineering Department of West Central Railway, or in the
case of a partnership firm or company incorporated under the India
Company Law should a partner or a relative or the partner or a share
holder or a relative of a share holder be employed in gazetted capacity in
the Mechanical Engineering Department of the West Central Railway, the
authority inviting tenders shall be informed of the fact at the time of
submission of tenders, failing which the tender may be rejected, or if such

fact subsequently comes to light, the contract may be rescinded in
accordance with the provisions in Clause 62 of the General Conditions of
Contract.
30. Should the Railway decide to negotiate with a view to bring down the rates,
the original offer will still be binding in case nothing materializes out of the
negotiation. A declaration to this effect should be submitted by the
tenderer/ tenderers along with the negotiated offer in the prescribed
Performa.
31. Income Tax :PAN: -
The Tenderer should submit valid PAN.
32. In case the contractor has not submitted the valid PAN, the contractor will
have to submit to the Railway a valid & current PAN. No payment shall be
made to the contractor or the work carried out or material supplied under
this contract nor shall the contractor make a claim for any payment
whatsoever until and unless a valid current PAN is produced by him.
33. Deduction of I.T. at Source :-
The Rly. will deduct @ 2% of gross amount of each bill as Income-tax and
surcharge thereon. As prescribed by Govt. from time to time and such
deduction of I.T. shall be recovered while Making payment to the
contractor.
34. The tenderer(s) quoting against standing Earnest Money is required to pay
the total Security deposit in the acceptable form before signing the contract
documents.
35. Instructions of Engineer’s Representative: Any instructions or approval given by the Engineer’s representative to
Contractor in connection with the works shall bind the Contractor as
though it had been given by the Engineer provided always as follows:
a) Failure of the Engineer’s representative to disapprove any work or
materials shall not prejudice the power of the Engineer thereafter to
disapprove such work or material and to order the removal or
rectification thereof.
b) If the Contractor shall be dissatisfied by reason of any decision of
the Engineer’s representative, he shall be entitled to refer the matter
to the Engineer who shall there upon confirm every such decision.
36. Partnership Deeds, Power of Attorney etc.:- The tenderer shall clearly specify whether the tender is submitted on his
own behalf or on behalf of a partnership concern/company. If the tender is
submitted on behalf of partnerships concern/company a certified copy of
partnership deed/ articles of association, as the case may be, and a power
of attorney to sign the tender documents, bills etc. should be submitted. If
these documents are not enclosed along with the documents the tender will

be treated as having been submitted by individual, signing the tender
documents. The Railway will not be bound by any power of attorney
granted by the tenderer or by changes in the composition of the firm made
subsequent to the execution of the contract. Railway may, however,
recognize such power of attorney/partnership deed/article of association
after obtaining proper legal advice, charges for which will be chargeable to
the contractor.
37. Power of Modification to Contract: 1) The Engineer on behalf of Railway shall be entitled by order in writing
to enlarge or extend, diminish or reduce the works or make any
alterations in their design, character position, site, quantities, dimensions
or in the method of their execution or in the combination and use of
materials for the execution thereof or to order any additional work to be
done or any works not to be done and the Contractor will not be entitled
to any compensation for any increase/reduction in the quantities of work
but will be paid only for the actual amount of work done and for
approved material supplied against a specific order.
2) In case an increase in quantity of an individual item by more than 25%
of the agreement quantity is considered unavoidable, the same shall be
got executed by floating a fresh tender by Railway. If floating a fresh
tender for operating that item is considered not practicable, quantity of
that item may be operated in excess of 125% of the agreement quantity
subject to the following conditions:
a) Operation of an item by more than 125% of the agreement quantity
needs the approval of competent authority.
i) Quantities operated in excess of 125% but up to 140% of the agreement
quantity of the concerned item, shall be paid at 98% of the rate awarded
for that item in that particular tender.
ii) Quantities operated in excess of 140% but upto 150% of the agreement
quantity of the concerned item shall be paid at 96% of the rate awarded
for that item in that particular tender.
iii) Variation in quantities of individual items beyond 150% will be
prohibited and would be permitted only an exceptional unavoidable
circumstances with the concurrence of associate finance and shall be
paid at 96% of the rate awarded for that item in that particular tender.
b) The variation in quantities as per the above formula will apply only to
the Individual items of the contract and not on the overall contract
value.
3) In case where decrease is involved during execution of contract: The
contract signing authority can decrease the items up to 25% of
individual item without finance concurrent

38. Provision of Workmen Compensation Act: In every case in which by virtue of the provisions of Section 12 Sub-
section (1) of the Workmen Compensation Act 1923, Railway is obliged to
pay compensation to a workman directly or through petty Contractor or
Sub-contractor employee by the Contractor in executing the work, Railway
will recover from the Contractor the amount of the compensation so paid,
and, without prejudice to the rights of Railway under Section 12 Sub
section (2) of the said Act, Railway shall be at liberty to recover any sum
due by Railway to the Contractor whether under these conditions or
otherwise, Railway shall not be bound to contest any claim made against it
under Section 12 Sub section (1) of the said Act except on the written
request of the Contractor and upon his giving to Railway full security for
all costs for which Railway might become liable in consequence of
contesting such claim.

NOW THIS INDENTURE WITNESSTH that in consideration of the payments to be made
by the Railway the Contractor will duly perform the said works in the said schedule set
forth and shall execute the same with great promptness and accuracy in a workman like
manner to the satisfaction to the Railway and will complete the same in accordance with
the said specifications and said drawings of conditions of contract on or before the
…………………. Day of ……………….. 2016 and will maintain the said works for
period of ………………… calendar months from the specified date of their completion
and will observe, fulfill and keep all the conditions therein mentioned, (which shall be
deemed and taken to be part of this contract as if the same bad been fully set forth herein)
AND the Railway do hereby agree that if the Contractor shall duly perform the said works
in the manner aforesaid and observe and the said terms and conditions, the Railway will
pay or cause to be paid to the contractor for the said works on final completion thereof the
amount due in respect thereof at the rates specified in the schedule hereto annexed.

1) Tenderer should quote his single and common percentage rate only, as
ABOVE/BELOW/AT PAR with the Railways estimated cost. In case not quoting of
percentage and not mentioned the percentage above/ below/ at par, the offer treated as
incomplete and summarily rejected without any correspondence.
2) Percentage rates to be quoted both in figures and words. In case quoted percentage is
different in words and figure, the lowest rate quoted in word or figure taken as valid one
and no submission after opening of tender is acceptable.
3) It is certified that I/We have inspected the site of work & acquainted myself/ourselves
with local conditions.
4) I/We undertake to keep this offer valid for 90 Days from the date of opening of tender
and further not to revoke the same before the expiry of such period.
5) Tenderers are advised to refer clause no. clause no.14 & 15 of contract, Part-A is
applicable of tender Booklet before filling up this offer sheet.
6) Applicability of service tax should be clearly mentioned in offer sheet and service
amount will be added in their final rate. Any claim on service tax after opening of
tender is not acceptable. Conditional quoting of applicability of service tax is also not
acceptable. If tenderer quoted rate, without mention the service tax, the offered rate is
treated as rate including of service tax and in such case no claim is acceptable on
service tax during currency of contract. Service tax registration number -----------------.

7) I/We have carefully gone through the specifications; Additional Special Conditions etc.
attached with the tender documents and inspected the site as considered necessary.
8) If the same rate or percentage quoted by more than one firm and if such offer is also
comes as lowest qualified offers, in such cases, one of the firm will be selected for
awarding the contract through lottery system in the presence of all lowest qualified
tenderes. The decision through lottery system will be final and binding to all lowest
valid offer submitted by the tenderer. The participation of tenderer in lottery draw is
their own responsibility as per Railway decided time and date at CRWS, Bhopal.
9) If any ambiguity observed in offer sheet such as omission or wrong quoting of
percentage or non marking of applicable option on above / below /at par etc. such offers
treated as incomplete and invalid and their offer will be summarily rejected.

tender booklet has been prepared only for general information of tenderers and in

1 Sealed tenders are invited for the work of “Miscellaneous work related to
RRWI, Hostel, TTC, ORH & Crèche of CRWS/BPL.”
2. Estimated cost of the work is Rs. 3260850/-
(Rs. Thirty two Lakh, sixty thousand, eight hundred fifty Only)
3. The amount of Earnest Money is Rs. - 65217/-
(Rs. – Sixty five thousand two hundred seventeen Only). Note: MSE’s firm for which clause no.32 of Special condition of contract,
Part-A is applicable.
3.1 The Earnest Money should be in cash or banker cheque / Demand draft in
favour of FA&CAO, WEST CENTRAL RAILWAY, executed by State
Bank of India or any of the Nationalized Banks or by a scheduled Banks.
Offers without Earnest Money will be summarily rejected.
Note: MSE’s firm for which clause no. 32 of Special terms & condition of
contract, Part-A is applicable.
3.2 The Earnest Money deposited by the successful tenderer will be retained by the
Railways as a part of Security Deposit for due and faithful fulfillment of the
contract and the Earnest Money of the unsuccessful tenderers will be refunded as
expeditiously as possible.(GCC Part-II clause No. 16(1).
4. Tender form containing detailed CRWS tender booklet & Special terms and
conditions can be obtained after next day of tender notice published in news
papers and before one day of tender opening from the office of the CHIEF
WORKSHOP MANAGER,WCR, CRWS, NISHATPURA , BHOPAL by
submitting in cash or banker cheque / Demand draft in favour of FA&CAO,
WEST CENTRAL RAILWAY, executed by State Bank of India or any of
the Nationalized Banks or by a scheduled Banks between 10.00 hrs. to 16.00
hrs., on all working days except Saturday. On Saturday up to 13.00 hrs.

5. Duly sealed offers superscripted for “Miscellaneous work related to RRWI,
Hostel, TTC, ORH & Crèche of CRWS/BPL.”should be deposited complete
in all respects and accompanied by Earnest Money in the tender box kept in
the Office of Chief Workshop Manager, Coach Rehabilitation Workshop,
Nishatpura, West Central Railway, Bhopal up to 15.00 hrs on date
30.03.2016. The tender will be opened on same day at 15.15 hrs. Offers
without Earnest Money will be summarily rejected. For MSE’s firm refer
clause 32 special condition of contract, Part-A is applicable. Those who wish
to attend tender opening may do so. If tenders received through post are
found in open condition than those will be returned in same condition.
Tender form will not be sent by post.
6.
6.1
Performance Guarantee & Security deposit's: - Performance Guarantee: A). The successful bidder shall have to submit a Performance Guarantee
(PG) within 30 (thirty) days from the date of issue of Letter of Acceptance
(LOA). Extension of time for submission of PG beyond 30 (thirty) days and
up to 60 days from the date of issue of LOA may be given by the Authority
who is competent to sign the contract agreement. However, a penal interest
of 15% per annum shall be charged for the delay beyond 30 (thirty) days, i.e.
from 31st day after the date of issue of LOA. In case the contractor fails to
submit the requisite PG even after 60 days from the date of issue of LOA, the
contract shall be terminated duly forfeiting EMD and other dues, if any
payable against that contract. The failed contractor shall be debarred from
participating in re-tender for that work.
B) The successful bidder shall submit the performance guarantee (PG) in any
of the following form, amounting to 5% of the contract value.
a) A deposit of cash.
b) Irrevocable Bank Guarantee.
c) Government securities including Stage Loan Bonds at 5% below the
market value.
d) Deposit Receipts, Pay Orders, Demand Drafts and Guarantee Bonds.
These forms of Performance Guarantee could be either of the State Bank of
India or of any of the nationalized banks.
e) Guarantee Bonds executed or Deposits Receipts tendered by all Schedule
Banks.
f) A deposit in the Post Office Saving Bank.
g) A deposit in the National Savings Certificates.
h) Twelve years National Defence Certificates.
i) Ten Years Defence Deposits.
j) National Defence Bonds and
k) Unit Trust Certificates at 5% below market value or at the face value
whichever is less.
l) Also FDR in favour of FA & CAO, West Central Railway, (Free from any

encumbrance) may be accepted.
NOTE: The instruments as listed above will also be acceptable for Guarantee
in case of Mobilization Advance.
C) The performance guarantee shall be submitted by the successful bidder
after the Letter Of Acceptance (LOA) has been issued, but before signing the
contract agreement. This P.G. shall be initially valid up to the stipulated date
of completion plus 60 days. In case the time for completion of work gets
extended, the contractor shall get the validity of performance guarantee
extended to cover such extended time for completion of work plus 60 days.
D) The performance guarantee (PG) shall be released after physical
completion of work based on the 'Completion Certificate' issued by
competent authority stating that the contractor has completed the work in all
respects satisfactorily. (GCC Part –II, clause no. 16).
6.2.
Security deposit of Work: Security deposit for work is 05% of the total
contract value. The earnest money deposited by the successful tenderer will
be retained by Railway as the part of security deposit and balance amount
will be recovered from running bills of the contract. The rate of recovery will
be at the rate of 10% of the bill amount till the full security deposit is
recovered. This security deposit will be released only after the expiry of the
maintenance period and after passing the final bill based on 'No Claim
Certificate'. (GCC Part –II, clause no. 16).
7. The offers submitted should be valid for 90 days from the date of submission.
8. The tenderers shall clearly specify whether the tender is submitted on his
own behalf or on behalf of a partnership concern/company. If the tender is
submitted on behalf of partnership concern/company a certified copy of
partnership deed/articles of association, as the case may be, and a power of
attorney to sign the tender documents, bills etc. should be submitted. If these
documents are not enclosed along with the documents the tender will be
treated as having been submitted by individual, signing the tender
documents. The Railway will not be bound by any power of attorney granted
by the tenderer or by changes in the composition of the firm made
subsequent to the execution of the contract. Railway may, however,
recognize such power of attorney/partnership deed/article of association after
obtaining proper legal advice, charges for which will be chargeable to the
contractor @ Rs.200/- per document. (GCC Part-II, Clause No. 6-c).

9. Tenderers who desire to forward tender through post should send the same
under registered cover with acknowledgement due so as to reach well in time.
Railway administration will not be responsible for any reason whatsoever.
10. Tenders must be filled in ink or typewritten. No erasures, alterations or over
writing is permitted on the Tender form. The language used in filling the tender
forms must be clear and precise.
11. No alterations in the rates specified in the Schedule will be allowed unless it has
been initialed by the tenderer before the submission of his tender. No alteration
or addition to any of the conditions mentioned in the tender should be made,
and in case any such alteration or condition is made then such tender is likely to
be ignored.
12. The successful tenderer shall be required to execute an agreement with the
President of India acting through Chief workshop Manager, Coach
Rehabilitation Workshop, West Central Railway, Bhopal for carrying out the
work according to the General and Special conditions of contract and
specifications for works as laid down in annexure thereof within thirty days
from date of issue of acceptance letter. (GCC Part-I, Clause No. 8).
13. Railways reserve the right of not to invite tenders for any of Railway work or
works or to invite open or limited tenders and when tenders are called to accept
a tender in whole or in part or reject any tender or all tenders without assigning
reasons for any such action. (GCC Part-I, clause no. 7).
14. The tenderer(s) shall not take any advantage of any misinterpretation of the
conditions due to typing or any other error and if there is any
discrepancy/contradiction/doubt, shall bring it to the notice of the Chief
Workshop Manager, CRWS, Bhopal without delay. In case of any
contradiction, only the printed rules and books should be followed and no
Claim for the misinterpretation shall be entertained.
15. The Railways reserves the right to increase/decrease the order in respect of
quantity of work or can terminate the contract at any stage of the contract by
giving one-week notice. No claims whatsoever shall lie against the Railway for
any such variation in quantity or on account of earlier termination of the
contract. (GCC Part-II, clause no. 41, 42 & 61 (1).
16. Recovery will be made from the contractor as deemed fit by the Railway for
any damage to Railway property caused by the Contractor, whether willingly or
otherwise during the execution of the contract.(GCC Part-II, clause no. 24).
17. Agreed Damages: Agreed damages for delay on overall work will be charged at
the rate 0.5 % per week or part thereof on the total value of the contract and it
will be deducted from the contractor’s bill for delaying completion of work.
(GCC Part-II, Clause no. 17, 17- A & B).
18. If the delivery stipulated in the tender is not adhered to, the Chief Workshop
Manager C.R.W.S. Bhopal will be at his liberty to cancel the order and re-
process the case. (GCC Part-II, clause No. 62(1).

19. The submission of the tender will be deemed to imply that the tender
conditions and all documents attached herewith (including the prescribed form
of agreement) have been studied and understood by the tenderer and that the
tenderer is fully aware of the scope of work to be done and the conditions
effecting thereof.
20.
The rates should be inclusive of all taxes, duties and statutory charges. Post
tender variation in rates is not acceptable, also Railway will not agree to any
escalation in prices/cost during currency of the contract on account of taxes,
duties & statutory charges whether mandatory or non-mandatory. In case of
any discrepancy in quoting of rates in figures and words, than the lowest rate
quoted either in figures or words should be treated as final and valid rate for
evaluation of tender. In such case all rights are reserve with Railway to deal
the case. However the contractor shall abide by the various acts and labor laws
as amended from time to time.
21. Income Tax & commercial tax will be deducted from running bills as per
Government prevailing rates.
22. The “Special conditions and specific instructions to the tenderers and the
stipulations made in schedule of the quantities and rates” shall govern works
executed under this contract are in addition to the “General conditions of the
contract” i.e. GCC, as amended and/or corrected from time to time. Copy of
GCC is available at CWM’s Office, CRWS, Bhopal. Copy of GCC is
available on CRWS website – www.wcr.indianrailways.gov.in
23.
With the existing system it is not possible to keep the record of the bidder
downloading the bid document. Bidder using Bid document downloaded from
the website should watch the website for corrigendum/addendum to the Bid
document and there may not be any separate individual communication for the
same. The bid document available in the Web site can be altered at the last
minute. Hence it will be the responsibility of the bidder downloading the bid
document to check time to time for corrigendum to the bid if any periodically
before finally submitting the bid.
23.1 Railway Administration shall not be responsible for any delay/ difficulties /
inaccessibility of the down loading facility for any reason whatsoever. In case
of any discrepancy between the bid documents down loaded from internet and
the master copy available in this office, the latter shall prevail and will be
binding on the bidder(s). No claim on this account shall be entertained.
24. Tenderers may carefully note the following instructions before filling the
tender document.
24.1 If the tenderer commence the work after signing of agreement and submission
of performance guarantee, abandons the work without completing it, then
performance guarantee will be en-cashed and security deposited so far will be
forfeited. Balance security deposit will be recovered from tenderers unpaid
dues of the existing contract. If there is still some balance left, the same will
be recovered from tenderer’s other ongoing contracts with this railway/other
railways/other Government departments.

24.2 If the agreement is signed and the performance guarantee submitted by the
tenderer, thereafter the tenderer does not commence the work. In such a case
the performance guarantee will be encashed and the amount equal to security
deposit will be recovered from the ongoing contracts of the tenderer. Further,
if the tenderer is not the working contractor of the railway, then action would
be taken for recovery of these dues from other railways/Govt. departments.
24.3 If the letter of acceptance is issued and the contractor does not come forward
to sign the agreement and does not submit performance guarantee within the
stipulated time, in such a case the amount equivalent to performance guarantee
will be recovered from the ongoing contracts of the contractor. Further, if the
contractor is not the working contractor of this Railway or required amount is
not available with WCR, then action would be taken for recovery of these dues
from other railways/Govt. departments.
24.4 If the contractor withdraws his offer before expiry of validity period of his
offer or issue of acceptance letter, whichever is earlier, then in such a case, his
EMD will be forfeited.
24.5 The failed contractor/tenderer who has withdrawn the offer will be debarred
from participating in the tender for executing the work / balance work. If the
failed contractor / tenderer who has withdrawn the offer is JV or a partnership
firm, then every member / partner of such firm will be debarred from
participating in the tender for the balance work either in his individual
capacity or as a partner of a JV / Partnership firm.
25. SETTLEMENT OF DISPUTES:
In the event of any difference or dispute of any kind whatsoever arising out of
or in connection with the contract whether during the currency of the contract
or after its completion and whether before or after the determination of the
contract will be dealt as per GCC Part-II, clause no. 63 & 64(1) (i) to 64.7.
25.1 Jurisdiction of Courts: If any dispute arises between the Railway
Administration and contractor (parties) with respect to this contract, any
application or suit shall be instituted only in the court within the local limits
Bhopal (M.P.) and both parties shall be bound by this clause.
25.2 In case of any dispute arising at the time of the execution at any point of time
during execution of the contract, decision of Chief Workshop Manager,
CRWS, Bhopal or his representative will be final and binding on the
contractor.
26 Any material or tool or equipments, which is brought by the contractor for
execution of work for his own convenience must be entered in the register.
27 Contractor’s labours will be permitted to utilize the existing facilities of
toilets, drinking water, rest room available in CRWS, Bhopal. No additional
facilities will be provided by, the Railway Administration. Utilization of
labour of one particular contract work to another contract work is totally
prohibited.

28 Tenderers are advised to visit CRWS, Bhopal at any time during the office
hours to see and understand the details, the nature of work, working conditions
and safety requirements before filling the tender. The details of the works can
be also discussed with concerned official/officers of CRWS, Bhopal at any
time during the office hours and can also see the drawing if required.
29 If tenderers have any doubt about the general and special terms and conditions
of the tender, the same should be got clarified from this office before
submission of tender. Post tender interpretations will not be accepted by
Railway Administration. This may please be noted.
30 Tenderers may carefully note that their Contract Agreement for this work is
liable to be terminated at any time later, in case any of the information
furnished by them is found to be untrue or any adverse point comes to light
subsequently. The decision of Railway in this regard shall be final and
binding.
31 If the scope of work stipulated in the tender is not adhered to, the Chief
Workshop Manager C.R.W.S. Bhopal will be at his liberty to cancel the order
and re-process the work. (GCC part II, clause No. 62).
32 MSEs registered with following agencies for the ITEM TENDERED will be
exempted from payment of Earnest Money and cost of tender form . (i) District
Industries Centers, (ii) Khadi and Village Industries Commission (iii) Khadi
and Village Industries Board (iv) Coir Board (v) National small Industries
Corporation (vi) Directorate of Handicraft and Handloom (vii) Any other body
specified by Ministry of MSME.
33 Conservancy Cess Charges will be recovered from contractor’s monthly bill as

PART – B: Conditions in respect of statutory Acts, Laws & Rules.
No. Rev-0 dated 01.02.2013.
1. The successful tenderer shall comply with all relevant statutes of Government
including Contract Labour (Regulation and Abolition Act 1970 and Central
rules 1971) and obtain license from Assistant Labour Commissioner or the
Competent authority empowered to issue such license. Any failure on the part
of the successful tenderer in this regard will be at his risk and consequence.
Contractor should comply with Workman’s Compensation Act 1923, Payment
of Wages Act 1936, Minimum Wages Act 1948 of Govt. of India, Employees
State Insurance act, Provident Fund Act, Employment of Children Act, Un-
touchable Act and other Labour Laws. The successful tenderer shall also
indemnify the Railway Administration against any claim / liabilities under
these acts that may occur to the contractor’s labours and staff due to any
reasons whatsoever. It will be the responsibility of the contractor to abide by
the relevant statutes. By entering into the contract, contractor will assume all
the liabilities arising out of various relevant statues. (GCC Part-II, clause No.
3 AND 54 to 60.)
2. The contract shall be governed by the law for the time being in force in the
Republic of India. (GCC Part-II, clause No. 3 AND 54 to 60.)
3. It is the responsibility of Contractors/Suppliers/Scrap dealers/Visitors and their
labourers/workers/staff to ensure that provisions of Factory Act 1948 and
Madhya Pradesh Factory Rules 1962 are followed by them. The subsequent
paragraphs, illustrate the important responsibilities to be assumed by
contractor to follow the provisions of The Factories Act 1948 and The Madhya
Pradesh Factories Rules 1962, however all the sections of the Act and Rules
need to be abided.
The word “Contractor’’ stands for Contractors/Suppliers/Scrap
dealers/Visitors in the following paragraphs and the word “staff” stands for
Labourers/workers/staff of the contractor. The word “Act” stands for Factories
Act 1948 and Madhya Pradesh Factories Rules 1962 in the following
paragraphs.
A. By entering into this contract, it is deemed that contractor agrees to all
the conditions in the contract and assumes responsibility to act
according to the provisions of The Factories Act 1948 and The Madhya
Pradesh Factories Rules 1962 while working in the CRWS. By
accepting the contract, contractor is deemed to have agreed to all the
sections of the said Act and Rules, including section 101 of Factories
Act 1948 which signifies liability of the contractor to the provisions of
Factories Act as an Occupier or Factory Manager. Railway
administration and personnel stands absolved of any responsibility and
liability arising out of Act. The contractor shall indemnify the railway
administration against any claim/liability under the Act that may occur
to the contractor's labours and staff due to any reasons what so ever.

B. The contractor will ensure that he and his staff follow the provisions of
the Act and will ensure that he and his staff work safely. The contractor
shall give high importance to the safety of his staff and they will not do
any act which will endanger safety of their staff or that of any other
person in CRWS (Factories Act 1948 Section 111).
C. For entering into CRWS premises gate pass/identity card is required by
all the contractors and their staff. For issue of gate pass, a written
application is required on prescribed Forms -1 to 6, 6A, 7A, 8 & 9.
Entering in CRWS workshop without valid gat pass is a punishable
offence.
D. It will be responsibility of all the contractors to ensure that their staff is
in good health. The contractors will not employ staffs that are sick or
unfit otherwise for working.
E. Staff less than 18 years is not permitted to enter CRWS premises. It is
contractor’s responsibility that staffs employed by them are not less than
18 years age. In case the age of some staff seems to be less than 18
years then the ‘’date of birth certificate’’ needs to be produced for
issuing of gate pass. If date of birth certificate is not available then age
should be certified by MBBS Doctor with a specific sentences
″Examined Mr… (Name of employee) and found that his age is more
than 18 years″ (Factories Act 1948 Section 2a, 104, 104(a).
F. The contractor should keep a first aid box and a trained staff in First Aid
to provide first aid to injured staff at the work place (M.P. Factories
Rules 1962 Rules-75).
G. Contractor is responsible for safety of his staff under the provisions of
Act. While abiding the provisions of Act, it will be the responsibility of
the contractor :
i) To ensure that he employs healthy and trained staff only and that his
staff follows the principles of safe working. Contractor’s staff will not
enter CRWS without shoes/safety shoes.
ii) To ensure that a capable representative is always available at work site
in the absence of contractor who will also ensure that the workers work
in safe manner.
iii) To ensure that injured, sick, unhealthy, alcoholic, mentally unsound
staff and staff in inebriated condition do not enter the CRWS.
iv) To ensure that his staff does not use short cuts in work and avoid safety
principles to carry out the work.
v) To inform his workers about the safety requirements while working in
CRWS.
vi) To provide protective equipments such as Safety Shoes, Hand gloves,
Helmet, Face Mask, Safety Belt, Ear Plug, Protective clothing etc., to
the staff. The protective equipments should be of good quality and
reputed brand.
vii) To provide suitable good quality tools to his staff for working.
Contractor will further ensure that staff uses the tools in safe manner
and follow safe working methods.

viii) To ensure that staff uses the protective equipment while working and
they use a designated safe path for coming to the work place and going
back from work place and will not deviate from their regular path.
Moving in areas other than the designated work place is an offence.
ix) To ensure recording of attendance of staff and their deployment as per
the Act.
x) To ensure that before starting work in a shop, contractor should inform
Shop SSE and work should not be started without informing shop SSE,
in any circumstances.
xi) To get permit for digging before starting a work which requires digging
at any place (Form/Safety/00.WP.002/1 & 2).
xii) To inform his staff and vehicle operators about the shunting and not to
come in the way of railway tracks. In CRWS shunting of coaches is a
routine process.
xiii) To ensure that his staff leaves the CRWS after their working hours as
mentioned in the duty hours. They are not allowed to stay back beyond
the permitted time.
xiv) To ensure that only trained and authorised staff repairs the machines or
equipments used by his staff.
xv) To ensure that staff uses good quality cables without joints and they
should not tinker with electric switch board.
xvi) To ensure that staff working with electricity or on electrical equipments
to take precautions required for working with electricity and use proper
good quality protective equipment and insulated tools.
To adhere to following safety principles while working at height :-
a) For working at a height ‘’8 feet & above’’, permit is required.
Contractor will ensure work permit is issued on daily basis.
(Form/Safety/00-WP.001/1,2,3)
b) Contractor will ensure that for working at height only trained staff is
employed. The staff should be trained from an institute recognized by
Central Govt. or M.P. Govt.
c) Contractor will ensure that the staffs employed for working at height are
certified by MBBS Doctor that ‘’the staff is fit to work at height’’ and
‘’the staff do not get frightened while working at height’’.
d) It will be the responsibility of the contractor to ensure that his staffs are
provided with safety equipments suitable for working at height and they
use safety belt, safety net and other safety equipment.
e) For working on fragile roof, contractor should ensure that the staffs are
provided with suitable working safety equipment and the staffs use it.
xvii) To ensure that he and his staffs abide to the general safety principles
while working in CRWS, even though they may not have been
specifically listed out in the above paragraphs.

4. CRWS is IMS certified shop therefore; it is contractors’ responsibility to
ensure that environmental norms set by MPPCB are not violated and he
(contractor) will only use those processes which do not affect environment, his
staff or any other process.
5. The Railway shall not be responsible for any accident that may occur to
contractor’s labours/staff for any reasons whatsoever. It is the responsibility of
contractor to move the injured staff to hospital for treatment & to bear the
expenses of such treatment. The contractor will himself ensure the safety of
his workers and shall be liable to pay claims, whatsoever if made by the
contractor labour. Railway will not carry any responsibility of such payments.
As per section 101 of Factory Act, the liability on account of failure to follow
provisions of Factories Act or liability arising out of Factories Act lies with
the contractor.
6. The persons engaged by the contractor should be courteous, well mannered
and well behaved. Railway reserves the right to ask the contractor to remove
any person if found to be unsuitable for work or any other ground like bad
conduct etc. In such situation the contractor must remove the concerned
person and replace a suitable person forthwith. The person so removed must
not be engaged by the contractor in any site of Railways.
7. Contractor is responsible to pay minimum wages to his labour as per rate
issued by Labour Commissioner, Madhya Pradesh State Government, during
the contract period.
7.1 The contractor shall be liable to pay the wages to labour at revised rate, if rates
revised by the Ministry of Labour, M.P.Government during currency of
contract, Railway will not pay difference of payment (towards wages
alongwith corresponding difference towards EPF,Workmen compensation
etc).The future escalation in labour rate is already considered in estimated cost
of contract, so price variation clause (PVC) is not applicable in this contract.
7.2 As per EPF Commissioners guidelines any contractor labour working inside
the CRWS, Bhopal premises should be covered under EPF Act irrespective of
total labour available with contractor.
7.3 Tenderer should have a valid registration number/establishment code/business
number with Employee Provident Fund Commissioner as per rule. The
tenderer will furnish attested copy of this registration number/establishment
code/business number along with tender document. The offer of tenderer
without the document of registration will not be considered and will be
rejected summarily.
7.4. Tenderer must have to register himself or his firm with central excise/service
tax department towards services to be provided by him. He will submit the
copy of valid registration number along with his tender. The offer of tenderer
without proof of registration of service will not be considered and rejected
summarily.

7.5. The contractor while submitting on account/final bill, will submit
documentary proof employee wise (For the employees worked during the
month) showing details of payment made toward his and employee
contribution to EPF for the period for which bill is submitted. As a
documentary proof, either he can submit along with bill, attested photocopy of
pages of PF pass book of employee showing PF amount transfer by employer
during that month or copy of ECR(Showing details of contribution member
wise who worked for that month) uploaded along with proof of remittance
through electronically generated challan or any other proof showing that PF
contribution of the employee/labour worked for particular month have been
deposited with EPFO. The supervisor in-charge and other bill checking
official will check these document with attendance register. It is to be ensured
that amount paid by contractor must tally with amount worked out as per
norms.
7.6 The contractor while submitting on account/final bill, will submit
documentary proof employee wise (For the employees worked during the
month) showing details of premium paid under, Employees compensation
liability policy of his worker under Workmen compensation act, for the period
for which bill is submitted.
7.7. The contractor at the time of submission of bill will present proof of payment
of wages to his employees/labour. Payment through bank is mandatory and
contractor will furnish an attested photocopy of relevant pages of passbook
showing transaction of payment of wages of particular month or any other
proof showing that salary payment is transferred into saving account of his
employee/labour for the staff who worked for particular month for which bill
is submitted. The supervisor in charge of work and other checking staff of bill
will ensure through document that contractor paid wages as per minimum
wages act for the staff who worked for particular month.
7.8 The contractor will submit bill/invoice showing amount of service tax in the
invoice/bill. The service tax amount will be reimbursed on
producing/submitting the actual/attested bill/invoice of service tax amount
paid.
7.9 Payment of minimum bonus: The contractor has to pay minimum bonus which
shall be 8.33% of the salary or wages earned by the employee during the
accounting year, based on the specified number of days advised by Railway,
according minimum Bonus Act. The Bonus payment also allowed only
through ECS clearance. Failing to this final bill of the contractor will not be
passed.
7.10 Contractor is responsible for filling of form no. 18, 19, 20 under rule no. 103,
102 & 104 of M.P. Factories rules 1962 respectively, and will submit copy of
the same to inspecting authority at the time of claiming payment. Contractor is
also responsible for maintaining records like register of wages, muster roll,
register of over time, register of advance, wages slip, notice board etc, in terms
of “The Contract Labour (Regulation & Abolition) Central Rules, 1971”. A

list of register required to be maintained is given below for contractors,
guidance, however the contractor will be ensured all type of records both
mandatory as well as need base requirement subjected to case to case.
7.11 The total offered Rates below the minimum wages Act (as per the current
valid labour rate) received in any tender based on minimum labour requirement, the same will be summarily rejected. The contractor’s
assessment on overall rate quoted by contractor with respect Railway estimate
may also be submitted along with their offer as a supporting document to
justify the rate quoted by him. In the absence of this document, the rate
evaluation is purely Railway’s right and in this connection no claim on later
stage is acceptable.
8. Payment: - No advance payment will be made by Railways. Payment will be
made month wise for the services rendered in all 04 service buildings in one
month through on Account bill submitted by the contractor duly checked,
passed and certified by nominated supervisor & nodal officer for doing work
as per prescribed method.
9. The contractor will ensure disbursement of wages to his labour within expiry
of 07th day of the wages period, through ECS clearance of Bank.
10. If the payment from Railway is delayed due to some reasons, the contractor
shall arrange payment to his employees from his own sources.
11. It is the sole responsibility of contractor to observe and abide by the provisions
of various statutory labour laws and Act and regulations framed by the
Govt/administration and revised time to time. Rly will not be responsible for
any violation of the act or regulation by the contractor. However, during
currency of the contract, Railway reserves the right to demand any/all
documentary proof to ensure compliance of applicable statutory and
mandatory laws.
12. If violation of any of the statutory provisions detected, the Railway reserves
the right to take action against the defaulting contractor including recovery of
cost of damages and other legal action as deemed fit.
13. Penalty imposed by govt. authorities due to non compliance of the statutory
provision of laws, shall be liable to be paid by the contractor. Railway will not
pay or reimburse this penalty to the contractor.
14. Successful contractor will have to obtain necessary labour license if required
from Labour Commissioner in respect of his employees and submit the same
in the Office of CWM/CRWS/Bhopal before commencement of work.

Special condition of contract. PART-C:
1. Quantity of work: On daily basis over a period of 24 months (Twenty four
months). Timely execution of work is the essence of this contract. This is a
service contract; thereby the work shall be executed daily as per the
requirement given in schedule of work. Break in work (Service) or carry
forwarding of works is not possible and not acceptable in service contract.
Please note this fact before submit the tender form.
2. Completion period of the work is on daily basis over a period of 24 months
(Twenty four months), to be counted from Sixty days (60 days) from the date
of issue of acceptance letter, or when the contractor states in writing that he is
ready to start the work, whichever is earlier. This is a service contract and
contractor is responsible to provide services on each and every working day
and not allowed for any service breaks during the two year contract period.
3. INSPECTION: Inspection will be carried out by Senior Section Engineer,
RRWI or any other nominated representative of CRWS, Bhopal. The daily
performance of the firm will be assessed on the basis of services provided at
various locations by the firm as per scope of work on gradation basis as per
enclosed Table - L.
4. For the purpose of this contract, CMT/CRWS (Officer in-charge) will be the
nodal authority. All written correspondence in respect of this contract should
be addressed to the Railway Administration through CMT only. Senior
Section Engineer/Instructor, RRWI/TTC (or any other supervisor nominated)
is authorized supervisor for this contract.
5. Special Agreed Damages:-
5(a) The contractor should ensure that the overall score should be 90% and above
for full payment. If the score is found below 90%, then a penalty as specified
below shall be imposed and recovered from the bills. OVERALL RATING Penalty
Above 90% No penalty.
Above 75% up to 90% 10% of the accepted rate will be recovered from the
bills
Above 60% up to 75% 20% of the accepted rate will be recovered from the
bills
Up to 60%
No payment will be allowed. However contractor or
his representative responsible to start re-work for
improvement within same day and within the time
jointly decided by Contractor and Railway
supervisors and on satisfaction of re-work, payment
will be made based on fresh overall rating.
Note: -
1) Contractor will ensure overall rating always above 90%.
2) In case scoring is 90% and below in more than three days continuously,
Railway may deal the case as per clause 62 of general condition of
contract including termination.

3) In case scoring is 60% and below, the contractor shall be responsible for
re-work by his own expenditure to the entire satisfaction of Railway
representative and scoring will be bring the accepted level of payment. In
case he failed to improve the scoring in such cases, the case may be
treated as break of contract and Railway may deal the case as per clause
62 of general condition of contract including termination. In such cases,
Railway has full right to execute the work through any other agencies for
avoiding inconvenience of employees of Work Shop.
5(b) If the contactor failed to hand over the all type & full quantity of consumable
material for cleaning (as mentioned in Table - IV) on 25th
of the month a
penalty up to Rs. 500/- per day may be imposed in each type of material till
the material made available and handed over to Railway authority.
5(c) For successful execution of work contract, availability of adequate manpower
is essential. For any shortfall noticed in man power deployments (as required
in Table-A), the amount equivalent to standard minimum wages per
labour/employee will recovered equivalent to number of manpower shortage
based on the minimum current wages plus Rs 200/- will imposed as a token
penalty per man shortage. In case any consequent failure continuously more
than three days; the contract may be dealt under clause no 61 & 62 of GCC,
including termination of contract.
5(d) The complaints received on poor quality of work a suitable penalty up to Rs
1000/-will be imposed based on gravity of complaints and evidence.
5(e) Any complaint or short coming highlighted during the inspection of any
Railway official may attract the penalty upto Rs. 1000/- as per the seriousness
of case to case.
5(f) Failure in staff payment on or before 07th of every month / on or before the
agreed date of payment between staff and contractor as per the minimum
wages act will attract a penalty Rs. 1000/-per day from next day onward. If the
failure is continues 03 subsequent months the case may be dealt with clause
No. 61& 62 of GCC, including termination.
5(g) Any interruption of work due to various reasons such as dispute among staff,
poor industrial relation between the staff & management of the contractor or
due to mass absent of festival season etc may also attract penalty up to Rs.
5000/- per day. If the failure is continues 03 subsequent days the case may be
dealt with clause No. 61& 62 of GCC, including termination.
5(h) Railway will conduct periodical or as and when required, quality audit of work
contract through nominated Railway official. Any discrepancy noticed during
the audit will attract a penalty upto Rs 2000/-. If the discrepancies not
corrected within 7-days following the report, Railway will impose a penalty
upto Rs 500/- per day from the date of noticed the discrepancy until the
discrepancy/shortcoming made good. If contractor is not take action to make
good the deficiency or discrepancies within a month, the case may be dealt as
per the clause no 61 & 62 of general condition of contract including
termination of contract.

7 Contractors scope of work:-
7.1.1 I. Quantity and location of work --- Cleaning work of 04 service building Cleaning Activities for all service buildings
1. All tools, tackles, and equipments including HP water jet machine, vacuum
cleaner, Hand push wet & dry sweeping machine, Wet & dry Vacuum
cleaner, mop, scrubbers & dusters etc. shall be provided by the contractor.
The repair & replace of consumable or total replacement of the
machine/items provided by the contractor is to be carried out by the
contractor at his own cast. The list of equipment brought to Railway
premises will be informed to nominated Railway Representative to look
after the this work contract.
2. All essential consumable clean materials like acid, harpic, detergent etc as
prescribed in list shall be provided by the contractor. It has been decided to
procure and handover the consumable material to Railway’s authority on
25th of every month for the incoming month usage. In case the 25th
of
month is falls in holiday, the same will be handover to previous working
day.
3. All cleaning aid like broom Goa, wiper, pocha etc as prescribed in list shall
be provided by the contractor. It has been decided to procure and handover
the consumable material to Railway’s authority on 25th of every month for
the incoming month usage.
4. It is the responsibility of the contractor to provide PPE items like hand
gloves, uniform, safety shoes, dust mask, etc. to his / her employees
otherwise penalty of Rs 500.00 will be will be charged per each individual
staff.

In order to ensure smooth carrying out of work mentioned for all activities as
per Clause No 07 of special condition of contract, Part-C (i.e. contractor’s
scope of work), contractor shall provide sufficient and competent manpower to
carry out the work. For smooth carrying out of work, either contractors will
him-self available at site or he may depute his manager to supervise overall
work. Railway representative will monitor the daily work as per scope of
work.
6(a) It will be the responsibility of contractor for payment of compensation, in case
of any accident of his staff, while working in CRWS/Bhopal, under the
provision of Workman’s Compensation Act 1923.(GCC clause No 57).
The contractor shall note that no compensation due to any loss of life or loss
of material or any other account be given by the Railway Administration while
carrying out the work by the contractor as per agreed terms and the contractor
shall have to pay all the compensation in case of any accident, injury to his
labour and losses on this account shall be recovered from contractor’s account.
6(b) Contractor should cover his staff in Workman compensation (General) from
any General Insurance Company; failing to this Railway will not bear any
responsibility of compensation, under workman compensation Act- 1923.

duty any point of time within working hour’s a fine of Rs.100/- will be
charged per each individual will be charged.
7. The work in service buildings should commence at prescribed time sharply,
and should be continued up to schedule time on all days of the month
excluding Sundays and holidays.
8. Full floor dry sweeping & wet cleaning of covered area of 04 service
building including should be carried out daily & weekly as mentioned in
respective service building area.
9. Area underneath, in and around of drinking water cooler need to be cleaned
on daily basis and should be kept in highly hygienic condition.
10. Spider web removal should be carried out once in a week as per schedule
given in Table VI.
11. Road sweeping inside the railway premises as instructed by nominated
Railway Representative should be carried out once in a week and are
whenever need or found necessary to sweep any time
12. Toilet commode pan/closets cleaning should be carried out daily by HP
water jet machine.
13. Wash basins & Urinal pots & entire toilet area cleaning should be carried
out daily by HP water jet machine. Contractor will use the machine
compulsorily otherwise penalty of Rs 500.00 will be charged /day from
third day onwards.
14. In view of intensive and heavy utilization of toilets, urinals, bathrooms of
Hostel & ORH and cleaning of rooms of occupants need to be clean in
second shift as in the day rooms cleaning cannot be performed. The
contractor will provide one cleaning staff among the total cleaning staff in
second shift from 12.00 hr to 21.00 hr for covering the cleaning work of
both service building.
15. Once in a week ceiling fans of all four service building needs to be cleaned
compulsory
16. Cleaning register will be maintained by contractor and he will take daily
sign of Railway supervisor /SSE.
A. Overall maintenance of all building in a very presentable condition in
order to give a beautiful look to the campus. The details of covered &
open area, number of toilet & its area and other details are mentioned in
the Table I to VI. The work pertains to following area:-

7.1.2 II. Quantity and location of work - Gardening work of 04 service building
Gardening Activities for all service buildings

shall be provided by the contractor. It has been decided to procure and

3. Contractor will use all the machine compulsorily otherwise penalty of
Rs 500.00 will be charged /day from third day onwards.
4. It is the responsibility of the contractor to provide PPE items (like
uniform, shoes/mask/ gumboots of ISI mark, raincoat, umbrella, etc.) to
his/her employees otherwise penalty of Rs 500.00 will be will be
charged per each individual staff.
5. If gardening staff found without proper dress code or dirty clothes
while on duty any point of time within working hour’s a fine of
Rs.100/- per each individual will be charged.
6. The work in garden should commence at 0800 hours sharply, and the
work in garden should be continued up to 1700 hours on all days of the
month excluding Sundays and holidays.
7. Watering and irrigation works must be done on daily basis for watering
rubber/PVC plastic pipe will be provided by contractor.
8. Watering to all lawns and gardens, flower pots, built-in-flower pots,
live hedges, plants, trees, etc., in the specified area.
9. Cutting/trimming of grass at regular intervals of time to give uniform
look in all lawns/ gardens equipment require for cutting/trimming
/digging will be provided by contractor.
10. Trimming and shaping of hedges and plants in approved pattern/
fashion/ design in all the gardens.
11. Overall maintenance of all gardens in a very presentable condition in
order to give a beautiful look to the campus.
12. Preparation and maintenance of flower pots. Weeding out wild plants,
grass, shrubs, etc., from the gardens and flower pots.

13. Spraying chemicals to trees, plants, grass, etc. as and when required.
The chemicals will be supplied by the contractor with spraying
equipment.
14. The new plants and trees shall be supplied by the railway for plantation.

III. Quantity and location of work – Services required at Hostel
i) Services are required to provide checking in / checking out facility for

trainees may vary time to time for which no claim can be raised by
contractor at any cost.
Guidelines for Services required at Hostel. Duties of Resident Cook & kitchen staff --- In Hostel one trained or
experienced cook and minimum three assistant cooks/helpers each male will
be posted. The staff will be known as resident kitchen staff. The resident
kitchen staff will do the job of cooking & distribution of the food for provision
of messing arrangement (with contractors all material) for around 55 to 50
persons on daily basis at Hostel which covers morning tea, breakfast, lunch,
evening tea and dinner to the occupants, visitors & guests in dining hall of the
hostel as per prescribed menu & time schedule to occupants. They will also do
the Cleaning of kitchen utensils with cleaning agent and disinfectants dusting
of the equipments and hygiene of dining hall of the hostel to maintain
cleanliness all the time. The workers should maintain personal hygiene. They
should behave politely and amenable to discipline and knowledge &
experience in care taking of guest. This service is to be operated throughout
the year without any break on all days by the contractor. Since the Round the
clock services are required taking charge of all dead stock assets and fittings of
hostel. Cooking and distribution services are required for provision of messing
arrangement (with contractors all material) for around 55 to 50 persons on
daily basis at Hostel which covers morning tea, breakfast, lunch, evening tea
and dinner to the occupants, visitors & guests in dining hall of the hostel as per
prescribed time schedule as follows.
SUPPORT SERVICE – The resident supervisor & kitchen staff will provide
support in Hostel including checking in / checking out facility for occupants,
registration of trainee, room allotment, distribution linen & other items, store
management, kitchen area upkeep and other guest assistant jobs etc. on all
days
Essential for duties: The contractor‘s staff will wear uniform along with
photo equipped badge & company logo while on duty. The contractor will
issue identity cards to his security person after getting them verified by the
Railway authority. Any worker found without identity card will not be
permitted to enter the premises.

Accommodation -- Railway would provide free suitable accommodation with
in the hostel premises/nearby hostel along with free water & electricity for the
resident kitchen staff.
Facilities for Trainees/Guest: Contractor shall maintain hostel lounge for
upkeep of newspaper papers, magazines, television and other assets.
Contractor to provide 3 daily newspapers every day (Dainik Bhaskar, Raj.
Patrika, Nav Bharat or any other news paper(both Hindi) and Times of India
(English) and magazines every month are India Today, Pratiyogita
darpan,Ghrah Shobha, Sports magazine (English) all issue in time.
All the linens, mosquito net and blankets shall be provided by Railways,
washing and ironing is to be arranged by the contractor, so as to provide every
occupant with fresh linen set and change once a week. Approx. 80 to 100
Blankets however shall be required to be dry cleaned twice a year.
Safety & security: Entry in Hostel will be permissible only after presenting
the valid photo containing Identity Card by occupants. Restriction of the
unauthorized entry will be maintained for security purpose.
Special condition: The monthly wages of resident kitchen staff has to be
earned by contractor within this agreed per day charges. These charges will be
decided before commencement of the work and decision of Railway
Administration will be final and binding on contractor. The staff will be
deployed only after producing valid police verification from local district
HQ/BPL and affidavit of person that has no criminal record. To ensure the
cooking of food is hygienic the staff will get medical examination by district
health officer of frequency every three month. In case of injured staff/absentee
contractor will replace by suitable one i.e. Cook to cook and helper to helper.
Supervision/running of Hostel: A railway officer or nominated
representative will inspect hostel housekeeping, messing facility & other
hospitality for occupants time to time for smooth running of the hostel.
Penalty: If resident kitchen staff or cleaning staff or gardening staff while on
duty found without dress code & not fully equipped any point of time within
working hour’s a fine of Rs.100/- per individual will be charged by competent
authority.
Fee : Contractor will charge from each trainee/employee Security Deposit &
Mess Security Deposit at the time of admission in hostel. The Security & Mess
Security Deposit are refundable to the occupants without any interest, when
they vacate the hostel it will be adjustment in their pending dues of bill of
mess.
Maintenance of record: Resident cook/Care taker of hostel will maintain
following record in register of hostel.

FACILITIES TO BE PROVIDED BY RAILWAYS:-
i) The Railway will provide necessary furniture, in dining hall, Rooms,
lounge etc. The contractor shall keep a proper account and safe custody of
the items/equipments handed over to him and in case of any
damage/loss/misplacement/pilferage/theft, the contractor shall be
responsible to repair/replace the same at his own expenses, failing which
Railway shall be entitle to deduct such costs, as decided by the Officer In-
charge to make good the loss from the bills of the contractor. The decision
of the Railway shall be final and binding. One refrigerator, for storing
milk, vegetables, and other perishable food items.
ii) Mattresses, Pillows, Bed sheet, Pillow covers, blankets and mosquito nets
for hostel will be provided by the Railway. The contractor has to ensure
their safe custody.
iii) Water supply and electricity shall be provided at available points free of
cost.
Menu for Breakfast, Lunch & Dinner etc: Menu is provided by railway
The per day meal charges including breakfast, lunch, tea, coffee, snacks
and dinner etc. (based on unlimited thali system), will be decided as per
menu by mutual agreement between Railway administration and contractor
for a period of the contract. Any escalation in per day meal charges will
also be decided by mutual agreement between Railway administration and
contractor.

(06.00-06.30 Hrs.) –from March to September and between (06.30 –

II. INSTRUCTIONS FOR PREPARATIONS
1. Only packed dals, salt, spices, condiments and oil with AGMARK
quality symbol should be purchased. Any ingredient being sold loose
should never be bought. The packaging and expiry date of the ingredients
should be checked.
2. Food grains should be stored in standard bins while, plastic food grade
containers are ideal for storage of dals, spices, condiments and other
ingredients.
3. Vegetable, fruits and perishable food commodities should be procured
fresh and storing for longer time/duration should be avoided.
4. The food containers during cooking should be checked for its cleanliness.
5. Storage of raw materials, ingredients should be subject to FEFO (First
Expire First Out) or FIFO (First in, First Out) stock rotation system as
applicable. Containers made of non-toxic materials should be provided
for storage of raw materials.
6. The cereals and pulses should be manually cleaned before cooking to
remove any extraneous matter.
7. Leafy vegetables when added to any preparation should be thoroughly
washed by hot water before cutting and should not be subjected to
washing after cutting.

8. Rice should be of standard variety namely Basmati or Saila.
9. Only good quality Agmark flour should be used. Maida should not be
used for making chapattis.
9. Cooking should be done using Agmark ingredients and fresh vegetables.

seed oil.
10. Tea should be of branded Company only like Brook Bond/Lipton/Taj

17. For lunch and dinner a variety must be ensured. Dal of different varieties
must be served on different days and for lunch and dinner. This may
include the following: Moong dhuli, Moong sabut, Moong chilke wali,
Masur Dhuli, Masur Sabut, Chana dal, Arhar Dal, Arhar, Kaala chana,
Safed chana, Lobia/raungi, rajma, Urad sabut etc
18. No dal may be served more than twice during a week. Similarly, the
vegetable of different verities preferably, seasonal vegetable, must be
served. The same vegetable may not be served more than twice during a
week.
19. No sweet & fruit mayt be served more than twice during a week.
20. Sufficient fresh green vegetables should be used for veg. curries. Use of
Potato should be limited and proper combination of vegetables may be
maintained while preparing specific curries.
21. Prepared food should be delicious / tasty with permissible spices, chilly,
salt, etc. Food service should be fast and smooth. At least one waiter
should be available for every 20 trainees serving food in the mess. This is
in addition to cleaning, washing and cooking staff.
22. Leftover food should not be served later on.
23. Menu as specified above will have to be followed strictly. However,
some small modifications can be made by the contractor after approval of
inspecting authority, if required.
24. The contractor will be required to provide special (example, khichri) or
any other suitable item for sick residents in lieu of the regular meals.
25. In case the adulteration, improper hygiene, shortage of food, substandard
taste, and change in menu without approval are found in the food the
competent authority will recommend the penalty to be imposed on the

contractor and the decision of the competent authority will be the binding
on the contractor.
26. Tables, benches and boxes, cupboards, glass cases, etc. shall be clean and
tidy. Cooking utensils and crockery should be clean and in good
condition. These should not be broken/ chipped.
27. Utensils should be cleaned of debris, rinsed, scrubbed with detergent and
washed under running tap water after every operation. Wiping of utensils
should be done with clean cloth. Clean cloths should be used for wiping
hands and for clearing surfaces. Cloth used for floor cleaning should not
be used for cleaning surfaces of tables and working areas and for wiping
utensils. Dust or crumb from plates or utensils should be removed into
dustbin by using cloth or wiper.
28. Equipment and utensils used in the preparation of food should be kept at
all times in good order and repair and in a clean and sanitary condition.
Such utensil or container should not be used for any other purpose.
29. Every utensil or container containing any food or ingredient of food
should at all times be either provided with a properly fitted cover/lid or
with a clean gauze net or other material of texture sufficiently fine to
protect the food completely from dust, dirt and flies and other insects.
30. The Kitchen cum Store should be located in a clean and open place and
free from filthy surroundings and should maintain overall hygienic
environment. The premises should be kept free from all insects. No
spraying should be done during the cooking.
31. Waste material generated during the cooking of food should be kept in a
separate container of adequate size with a proper cover preferably one
which need not be touched to open should be provided in the premises for
collection of food waste material. This should be emptied and washed and
dried daily before next use.
III – Personal hygiene & cleanliness checkups of Cook cum Helpers
1. Cooks and helpers should maintain a high degree of personal hygiene and
cleanliness. The person suffering from infectious disease should not be
permitted to work. Biannual health checks up should be undertaken to
ensure fitness for the job of CCH. Cooks/helpers should report
immediately to their supervisors, if they are suffering from any disease
likely to be transmitted via food, e.g. diarrhea or vomiting, infected
wounds like, skin infections, jaundice or sores.
2. All food handlers should remain clean, wear washed clothes and keep
their finger nails trimmed, clean and wash their hands with soap/
detergent and water before commencing work and every time after
touching, raw or contaminated food or using toilet. All Cook cum helpers
should avoid wearing loose items that might fall into food and also avoid
touching or scratching their face, head or hair.
3. Nail polish or artificial nails should not be worn because they can
become foreign bodies and may compromise on food safety. No watches,

rings, jewelry and bangles should be worn during cooking, serving and
distribution where there is a danger of contamination of product.
4. Chewing, smoking, spitting and nose blowing should be prohibited
within the Premises especially while handling food.
5. The CCHs should have adequate and suitable clean protective clothing,
head covering hair should be tied up neatly and ensured that the CCHs at
work wear only clean protective clothes and head covering essentially
during mess operation.
6. The CCHs should wash their hands at least each time work is resumed
and whenever contamination of their hands has occurred; e.g. after
coughing / sneezing, visiting toilet, using telephone, smoking etc; avoid
certain hand habits - e.g. scratching nose, running finger through hair,
rubbing eyes, ears and mouth, scratching beard, scratching parts of
bodies etc.- that are potentially hazardous when associated with handling
food products, and might lead to food contamination through the transfer
of bacteria from the employee to product during its preparation. When
unavoidable, hands should be effectively washed before resuming work
after such actions.
IV - Facilities & Infrastructure Provided By The Contractor in mess This hostel will require a well equipped Kitchen with following facilities:
1. Two gas stoves, with three additional cylinders
2. One Instant coffee machine.
3. One branded refrigerator of 280 liter capacity
4. Proper stainless steel container for keeping the cooked food warm.
5. Racks for keeping groceries etc.
6. Food preparation utensils
7. Plastic Dust bins in kitchen
8. Two Stainless steel tub for collection of used utensils
9. One Stainless steel tub for collection of used glass
10. One Stainless steel set –one Thali, three Katori, one glass for 60 Nos.
trainees or standard thali with sufficient pockets with approval.
11. Table serving utensils for covering minimum 05 Nos tables
Free of cost electricity & water to be used for catering purpose only.
However it should not be used for private purpose. Electricity would not be
allowed to be used for cooking purpose. Save electricity if not required.
V- Instructions for contractor
1. It will be the responsibility of the contractor to keep the equipment, gas
stoves and infrastructure in good condition. The contractor shall be
responsible for any damage/missing to burners and cylinders or any other
item. He shall bear the damage/missing charges if any.
2. In case, additional gas stove/cylinders are required, the contractor will have
to make his own arrangements. Charges for consumption of gas will be
borne by the contractor. It will be the responsibility of the contractor to

keep sufficient no. of gas cylinders every time.
3. The repair & replace of consumable or total replacement of the items
provided by the contractor from Sr.No 1 to Sr No3 is to be carried out by
the contractor at his own cast.
4. If the contractor provides eatables to the staff and guests etc on credit, he
himself will be responsible for recovery.
5. Hostel mess facility is only for staff staying in the hostel. No outsider will
be allowed without permission of Railway authority. If found serving
meals to outsiders will be charged penalty of Rs. 500/- per day.
6. Any function or party will not be allowed without written permission of
Railway authority.
VI - Instructions for Operation of Mess
1. Contractor or his representative has to be physically present on the hostel
premises to supervise the mess activity. No sub-contract shall be allowed.
2. The Contractor should provide sufficient number of kitchen staff for
cooking & serving - 01 Chief Cook & 03 nos staff for assist in cooking,
serving, cleaning and washing etc. The numbers given are illustrative and
actual number may be mutually agreed upon between railway and the
contractor. The contractor will ensure that his kitchen staff will served
cooked food items on the dining table to staff.
3. This mess is operated on “No profit –No loss” scheme so labour cost is
included in per day diet charge. Railway will not pay any wages to
contractor separately for resident kitchen staff; however contractor will pay
the wages to kitchen staff as per "Minimum Wages Act 1948" and he will
also follow all labour laws as applicable for contract.
4. Contractor shall have to provide adequate china crockery, stainless steel
cutlery, kitchen utensils, serving utensils, towel at wash basin for day to
day use.
5. The service boys engaged by the contractor will have to wear uniform
(preferably) in the hostel premises. The cook and assisting staff are also
required to wear the apron and a cap. The contractor shall ensure that its
personnel are well dressed in proper uniform, well trained, well behaved
and courteous in dealing with railway officials, trainees, visitors etc. The
contractor shall also ensure that his personnel do not smoke, consume
alcohol or any intoxicating drugs/substances while performing duty in
premises.
6. The Contractor maintains absolute hygiene, cleanliness inside and around
the designated premises of mess/kitchen/dining area through permissible
measures at all the times. The contractor will be responsible for the
cleaning of the dining area and kitchen including the wash basins pits,
dining tables and the dustbins for maintaining proper hygiene. Liquid soap
will be provided by the Contractor in dining hall wash basin. The
contractor shall maintain proper pest and rodent control by authorised
agency within the designated premises of kitchen/cooler area on monthly

basis. The charge of pest control will be paid by the contractor (for
recommended service and frequency) The same are included in total cost
of contract. The contractor will present the certificate of completion of pest
control every month’s first week by authorised agency.
7. The Contractor shall ensure that the utensils being used are hygienically
washed and cleaned at all times. Cleaning/washing agents for utensils will
be supplied by contractor.
8. The items to be supplied to the hostellers will be as per approved menu and
of required standard. No deviation will be permissible without prior
permission.
9. Hostel facilities should not be used by the contractor to serve outside
customers other than permitted Railway staff of hostel. If found staying
outsider or serving meals to outsiders will be charged penalty of Rs. –
500/- per day. The railway administration‘s decision will be final in any
special circumstances for use of hostel.
10. Any deviation from the Menu items agreed in the contract will be viewed
seriously and the contractor a fine of Rs.1000/- will be charged per each
individual item will be charged.
11. Mess is compulsory for all the trainees staying in the hostel. However if a
trainee does not avail mess facility for a day or more with the prior
intimation in writing, he/she will not pay for the absence period.
12. Mess charges may be collected from the trainees in advance for continuous
spells of 7 days or up to his date of departure whichever is earlier. In
emergency, if a particular trainee wants to go earlier than his scheduled
departure, the mess contractor will have to refund the money for remaining
days.
13. For any eventuality/miss happening or accident at the place of work or
outside to his employees or any person engaged by him, this office will
have no responsibility to pay any compensation what so ever. It will be the
responsibility of the contractor to bear such cost, if any.
14. The Railway shall not provide any cash subsidy to the Contractor for
running the mess. Payment to the employees of the contractor is to be
made by him as per minimum wages act of the Govt.
15. All employees engaged by the Contractor will be subject to police
verification. The contractor will have to register all his employees who will
be working in the hostel premises along with a copy of their photographs,
residential details for clearance by the railway. The contractor will have to
issue Photo ID card to all his staff while working in the hostel premises.
16. Hostel Mess is to be operated throughout the year without any break on all
days by the contractor. The contractor should provide suitable leave
reliever to his staff. The contractor should provide his mobile cell number
at the hostel reception.
17. Six monthly medical checkup of cooking staff must be carried out from
medical hospital. , If need directed to the railway hospital, medical chages
paid by contractor.
18. The Contractor shall be fully responsible for providing leave benefits,

weekly off, National & Festival holidays etc., to the personnel deployed
and as and when, any of personnel comes late or proceeds on leave or
absents himself/herself, it will be the prime responsibility of the contractor
to provide a suitable substitute.
VII -- Penalty Clause on Food-Service-Hygiene etc
1. If hostel item /equipment found missing or damaged by his staff, the
Contractor have to recuperate the same within three working days failing
which a penalty of will be imposed and cost of equipment will be recovered.
2. In case it is found and proved that the food/eatables provided by the
contractor are not of good quality and are dangerous for health/attained
expiry date a minimum fine of Rs.500/- will be levied.
3. In case it is found that food items exhausted before schedule time or
deviation of given menu, lack of taste in food, scarcity of utensils in serving
time a minimum fine of Rs.500/- will be levied.
4. If contractor fails to serve food according to the mess timings or any delay in
service of more than 30 minutes a penalty of Rs.500/- will be levied.
5. Improper cleaning of the dining area and kitchen including the wash basins
pits, dining tables and the dustbins will attract a fine of Rs.100/- each time.
6. If liquid soap found missing at the wash basins in the mess a fine of Rs.75/-
will be charged each time.
7. If dirty towel or washbasin towel found missing at the wash basins in the
mess a fine of Rs.75/- will be charged each time.
8. If mess staff found without caps, aprons in cooking area or serving staff

10. The waste materials/leftover food from mess should be removed from hostel
premises every day. The contractor shall ensure that stray cattle such as pigs,
dogs etc. should not consume any food within the hostel premises. If any
deviation found, a penalty of Rs.500/- per day will be charged in both the
cases.

IV. Quantity and location of work – Services required at Officers Rest House
Duties of Resident Cook/Caretaker --- In ORH one trained or experienced
resident cook male will be posted. He should have knowledge and experience in
care taking of guest. Since the Round the clock caretaking services are required
so he should be educated, maintained occupancy register of O.R.H. & taking
charge of all dead stock assets and fittings of rest house. Making up bed with
linins supplied by Railway and handing over to occupier of the rest house and
keep proper accounts of all accountable items of the Officer Rest house and
escorting of allotter/s & guests.
He will do the job of cooking & distribution of the food to guest. He will also
do the Cleaning of kitchen utensils with cleaning agent and disinfectants
dusting of the equipments and gadgets of the O.R.H. to maintain cleanliness all
the time.
Essential for duties: The contractor‘s staff will wear uniform along with photo
equipped badge & company logo while on duty. The contractor will issue
identity cards to his resident cook after getting them verified by the Railway
authority. Any worker found without identity card will not be permitted to enter
the premises.
SUPPORT SERVICE –The resident cook will also provide support in ORH
for receiving of guest, distribution linen & other items, store management,
kitchen area upkeep and other guest assistant jobs etc. on all days. Doing small
jobs required for the occupants like getting their cloths ironed, getting News
paper & other items from shop etc. and errands for which costs will have to be
got collected from the occupants. Railway will not be responsible for payments.
Accommodation -- Free residential accommodation and electricity will be
provided to the resident cook/care taker in the outhouse of Officer Rest House.
Menu for Breakfast, Lunch & Dinner etc: No menu is provided by railway.
The occupants shall also be provided with tea on demand, breakfast, lunch &
dinner for which cost shall be borne by the occupants. Restriction of the
unauthorized entry will be maintained for security purpose.
Facilities for Guest: All the linens including blankets shall be provided by
Railways, washing and ironing is to be arranged by the contractor, so as to
provide every occupant with fresh linen set and change twice a week. Approx. 8
to 10 Blankets however shall be required to be dry cleaned once a year.
Supervision/running of ORH: A railway officer or nominated representative
will inspect ORH housekeeping & facility time to time for smooth running of
the ORH.
Fee : Contractor will not charge any fee from the officer/guest availing the
ORH facility.
Penalty: If resident cook/caretaker staff while on duty found without dress code
& not fully equipped any point of time within working hour’s a fine of Rs.100/-
per individual will be charged by competent authority.

As per the provisions under Section 48 of the Factories Act, 1948 any factory
employing 30 or more women workers are required to provide creche facilities
for the use of children under the age of 6 years for the women employees
Aya --- In crèche one trained or experienced female Babysitter/Aya will be
posted. She should not be less than 30 year of age and should have knowledge
and training in handling of children.
Essential for duties: The contractor‘s staff will wear uniform along with photo
equipped badge & company logo while on duty. The contractor will issue
identity cards to his security person after getting them verified by the Railway
authority. Any worker found without identity card will not be permitted to enter
the premises. Age Group of children: Crèche facility should be serving for children in age
group of 90 days to 06 years. Aya will maintain proper hygienic Care, security
& safety of children.
Working Hours: Baby seating services are required to take care of children’s
of Railway female employees in Crèche between 07.00 Hrs. to 16.00 Hrs
attached with CRWS working days.
Medical attention: The Crèche must be equipped with basic First Aid kit
containing pediatric medicines for common ailments like fever, vomiting etc.
and ointments, disinfectants, band aids, cotton wool etc. for minor injuries.
Monitoring/supervision/running of Crèche: A women officer & a
representative from the women employees will inspect Crèche facility time to
time for smooth running of the Crèche.
Penalty: If Babysitter/Aya while on duty found without dress code & not fully
equipped with first aid box for children any point of time within working hour’s
a fine of Rs.100/- per individual will be charged by competent authority.
Fee: Contractor will not charge any fee from the female railway employees for
availing the Crèche facility. Crèche should be run on self-sustaining basis.

Guidelines for Watch and Ward Services for RRWI, TTC, & Hostel Duties of Unarmed Security person --- In Watch and Ward Services for
RRWI, TTC, & Hostel one trained or experienced well equipped unarmed
healthy person male will be posted. He should have knowledge and experience
in similar nature work of security. Ex service man may be deployed. This
service is to be operated throughout the year without any break on all days by
the contractor. The contractor should provide on duty security staff‘s mobile
cell number to nominated railway representative or railway official.
Essential for duties: The contractor‘s staff will wear uniform along with photo
equipped badge & company logo while on duty. The contractor will issue
identity cards to his security person after getting them verified by the Railway
authority. Any worker found without identity card will not be permitted to enter
the premises. He will also equipped with Mobile phone, 04 cell torch, Cap,
Whistle & 4’ long thick wooden danda.
Working Hours: Watch and ward services are required between 15.30 hrs to
7.30 hrs. in two shift of 08 hrs each from Monday to Saturday and on Sundays
and Holidays round the clock. Supervision of RPF: On duty security person will inform to RPF Main gate of
CRWS before start of his duties. He will work under Supervision of
RPF/CRWS.
Penalty: 1. If during patrolling of RPF staff if security person found absent from duty
place or absent without substitute arrangement then a penalty up Rs 1000.00
will be deducted/day per individual in a shift from contractor bill. A railway
officer or nominated representative will also check him time to time to ensure
security & safety of 03 nominated service buildings.
2. If security person found without dress code & not fully equipped any point of
time within working hour’s a fine of Rs.100/- per individual will be charged by
competent authority.
Communication -- In case of any unusual noticed while on duty the matter will
be inform to RPF & nominated railway representative or railway official
immediately.
Maintenance of record: Security person will maintain handing over & taking
over record of 03 nominated service buildings.
7.2 Procedure of cleaning work/methodology of cleaning work.
7.2.1 A. Floor sweeping.
i) Full floor sweeping of office building including ground floor parking area
should be carried out daily or weekly as mentioned in respective service
building area.
ii) Collects bigger size rubbish and paper litter etc from floor of building.

iii) Side wall fittings including small luggage racks should be cleaned &
wiped dry.
iv) Proper dry sweeping from end to end, 100% floor surface with broom or
coir hand sweeping brush.
v) Dry sweeping should be carried in such a way that no dust or sand or any
other litters left in office floor.
vi) Ensure underneath surface area cleaned in all office almirah, table, chair,
bench etc.
vii) It should be ensured that all drain holes and the drainpipes are clear and
water drains out speedily and smoothly.
viii) All litter, dust & debris shall be collected in poly bags and disposed off at
nominated bin later.
ix) All waste paper basket, etc. should be emptied and cleaned.
x) Carpet should be removed and properly cleaned at outside of office and
remove the muck/sand/dust and keep back.
xi) The administrative office floor and corridor should be wet wiped with
appropriate wet wiper after sprinkled disinfection liquid on daily basis and
all shop office should be wet wiped once in a week along removal of
spider webs.
7.2.2 B. Toilet commode pan/closets.
i) Toilet cleaning should be carried out daily and weekly by High pressure
water jet machine as mentioned in respective service building area.
ii) First back side of door, floor, commode pan and sidewalls up to level of
tiles should be hosed or sprinkled with water.
iii) If the commode pan is stained, apply diluted HCL acid by using hand
sweeping brush.
iv) Allowed the commode pan with stain socking for two to three minute.
v) Following the soaking, the commode pan should be scrubbed with
portable scrubber and flushed with water. If stain is heavy or hard, then
repeat the acid process.
vi) Apply soap liquid by HP jet machine & hand sweeping brush and rubbed
properly on floor tiles, side wall tiles and lower back side of lavatory.
vii) Wash with water and sweep the water by using broom-goa.
viii) After full removal of soap liquid, the floor should be wiped with suitable
rubber wiper.
ix) In case of western commode, the Plastic commode seats and covers
should be washed with soap liquid and wiped dry.
x) After cleaning there is no stain appeared in pan, tiles of floor and side
wall.
xi) Sprinkled diluted phenyl by using hand/ backpack sprayer. The dilution
should be 1:2 ratios of phenyl and water.
xii) Ensure there is no stink after cleaning of toilet

i) Urinal pot cleaning should be carried out daily and weekly by High
pressure water jet machine as mentioned in respective service building
area.
ii) Flush the Urinal pot, drainage pipe and sewage channel with water.
iii) Remove all rubbish, paper litter, dust & debris from urinal pots, if any in a
poly bags and disposed off at nominated bin later.
iv) Apply soap liquid on urinal pots by HP jet machine and scrub with brush
or mini scrubber.
v) Ensure that no litter, cigarette butt dust & debris left inside the urine pot
and also in sewage channel.
vi) Wash with plain water and ensure no stain in urine pot.
vii) Ensure that the drain hole and the drainpipe are clear and water drains out
speedily and smoothly.
viii) Sprinkled phenyl using hand/ backpack sprayer.
7.2.4 D. Washbasins.
i) Wash basin cleaning should be carried out daily and weekly by High
pressure water jet machine as mentioned in respective service building
area.
ii) Remove all rubbish, paper litter, dust & debris from wash basin and
sewage water channel, if any in a poly bags and disposed off at nominated
bin later.
iii) Flush wash basin, drainage pipe and sewage channel with water.
iv) Apply soap liquid on washbasin by HP jet machine and scrub with brush
or mini scrubber.
v) Wash with water and ensure no stain in wash basin.
vi) Ensure that the drain hole and the drainpipe are clear and water drains out
speedily and smoothly.
7.2.5 E. Spider web removal & roof dusting.
i) Spider web removal should be carried out prior to dry sweeping and
dusting of floor.
ii) Ensure as far as possible to protect office records, equipments including
PC, printer etc from dusting and spider webs prior to starting spider web
removal
iii) Spider webs and roof dusting should be executed as single work for entire
building/offices/shops.
iv) Use natural/synthetic bristled brushes with adequate length of handle for
spider removal.
v) Spider web removal should be carried out once in a week as per schedule
given in Table –
vi) Roof of rooms, offices, corridor, stair case, toilet, water cooler shed.
Verandah etc should be brushed up and remove all dust and spider web
thoroughly from end to end.

vii) Ensure spot spider webs from electrical fittings, crevices or corner of
office equipments or mosquito metallic wire nets of windows or door back
corner or frames.
viii) Following roof brush up, the dusting should be carried out from all office
equipments, furniture, window sills, door/window pelmets, top of water
cooler, top of flesher etc.
ix) Dust from fan leaf, tube light frame etc also ensured.
x) Dry sweep entire office floor of office building and ensure no dust left in
office floor.
xi) After spider web removal, no dust or part of spider web appeared on entire
building roof or corner or any crevices or corner.
7.2.7 F. Area underneath, in and around of drinking water cooler. i) The area need to be cleaned on daily basis and should be kept in highly
hygienic condition.
ii) Collect the rubbish and paper litter etc manually in a ploy bag and dispose
the same later at nominated place.
iii) Apply diluted HCl (Hydro chloric Acid) or diluted H2SO4 (Sulphuric
Acid) and rub the all blackish area for removing mud/muck and other
fungus growth.
iv) Wash the entire area with fresh plain water and repeat the above acid
treatment if required for complete clearing all muck/fungus blackish area.
v) Cleaning the top and side wall of cooler by removing dust and other
rubbish if any and wash all side of water cooler.
vi) Apply detergent as per requirement for ensure full cleaning.
vii) Apply suitable detergent (Diluted liquid soap) on wash basin of water
cooler and clean it properly by using appropriate shape and size of brush.
viii) Ensure drinking water cooler and its surrounding as well as underneath
are very clean and hygienic condition.
7.2.8 G. Sweeping of Service Road. i) These cover the dry sweeping of all service roads inside & outside of the
service building once in a week.
ii) Sweeps collected in dry sweeping should be deposed suitable in such a
manner that the sweeps not flow back to road due to natural air
movements/current.
iii) Dry sweeping should be carried out by using good quality Broom Goa
with long handle.
iv) No tree leaf/litters/any type of waste/released material parts/rubbish/debris
allowed after dry sweeping of Road.
v) The work should be started from end to principle and also executed at
nominated day and time.

7.2.9 Procedure of gardening work/methodology of gardening work.
Procedure of gardening A. Watering of entire garden area & Watering of pots.
i) All lawn & hedge area & flower pots of service building need to be
covered daily.
ii) Proper irrigation from end to end, 100% garden area with sprinkle
system..
iii) Watering should be carried in such a way that no area or flower pot left
dry.
iv) Ensure underneath surface area wet properly.
v) It should be ensured that all nozzles holes are clear and water irrigation
and absorbs in surface speedily and smoothly.
B. De - weeding of hedge & lawn area i) It should be carried out weekly
ii) All lawn & hedge area was attended properly and no residue left in garden
area.
iii) Removing unwanted grass, plants, removing wild grass, clearing jungle
from hedge.
iv) Hedge area need to be clear using garden tool kit.
v) Apply manure, fertilizer. black soil and pesticide/chemical as & when
required.
vi) Ensure there are no unwanted plats in entire garden after de weeding..
C. Cleaning & de - weeding of flower pots i) It should be carried out weekly
ii) All flower pots were attended properly and no residue left in pots.
iii) Removing unwanted grass, plants, removing wild grass, clearing jungle
from flower pots.
iv) Flower pots need to be clear using garden tool kit.
v) Apply manure, fertilizer, black soil and pesticide/chemical as & when
required.
vi) Ensure there are no unwanted plants in flower pots after gudai of it.
E. Trimming of hedge & Lawn.
i) It should be carried out fortnightly.
ii) Cutting/trimming of grass at regular intervals of time to give uniform
look in all lawns/ gardens. This activity need to be done using hand lawn
movers.
iii) Trimming and shaping of hedges and plants in approved pattern/ fashion/
design in all the gardens.
iv) Remove all residues from entire garden area in a poly bags and disposed
off at nominated place later.
v) Ensure there are no unwanted plants in garden area after trimming.

F. Spray of chemicals/pesticides to entire garden area.
i) It should be carried out quarterly in entire garden area.
ii) If any garden area or plant looking unhealthy & infected than can be done
earlier as per situation demand.
iii) This activity need to be done by using chemical spray pump.
iv) Ensure that all garden area, plants & flower pots are healthy.
G. Adding of fertilizer & manure to entire garden area and all flower pots & plants.
i) It should be carried out half yearly in entire garden area.
ii) If any garden area or plant looking unhealthy than can be done early as
per situation demand.
iii) This activity need to be done manually.
iv) Ensure that all garden area, plants & flower pots are healthy.
H. Adding of black soil to entire garden area and all flower pots & plants.
i) If any garden area or plant looking unhealthy than it can be done as per
situation demand. This activity need to be done manually.
ii) Ensure that all garden area, plants & flower pots are healthy.
7.3 III. Other Scope of work:
7.3.1 Arrangement of prescribed number of labour for the work of “Miscellaneous
work related to RRWI, Hostel, TTC, ORH & Crèche of CRWS/BPL” as per
contract term and condition & as mentioned in item No. – 7, Table – I to VII.
No claim for dispensation on number of staff is allowed and permitted.
7.3.2 Minimum qualification requirement of staff as well as preferable age limit is
given in Table - B.
7.3.3 Reporting of all contractor’s staff and supervisor to nominated Representative
of Railway and give their attendance. The attendance should be jointly recorded
by Railway representative and Contractor’s representative.
7.3.4 Distribution of staff to various work of cleaning lavatories, toilets, wash basins,
urine pots, dry sweeping & moping of office areas, verandas, parking area, dry
sweeping of premises, nominated roads, water cooler area, service building
areas, gardening activities, kitchen activities, watch & ward duties, crèche work
etc as per guidance and instruction of Railway representative & work procedure
given in item no - 7.2
7.3.5 The work shall be carried out without causing infringement to the Railway
normal working.
7.3.6 Adequate safety precautions are to be taken by the Contractor to ensure safety
of workmen engaged by the Contractor.
7.3.7 Contractor, his supervisor and all staff should be attended one day safety classes
at Safety officer’s office prior to start the work.
7.3.8 The contractor shall note that no compensation due to any loss of life or loss of

material or any other account be given by the Railway Administration while
carrying out the work by the contractor as per agreed terms and the Contractor
shall have to pay all the compensation in case of any accident, injury to his
labour and losses on this account shall be recovered from contractor’s account.
7.3.9 The contractor staff should always use personal protective equipments as per
the details given in Table – D. Contractor’s staff not allowed to work without
prescribed personnel protective devises. However the same should be handover
to the nominated Railway representative and same should be issued as per strict
guidance of Railway representative. The minimum quantity of PPEs should be
ensured by contractor on every 25th of the month with consultation of Railway
representative and as per the consuming rate mentioned in terms and conditions.
Contractor is also responsible for ensuring the quality of PPEs and responsible
to change the material, in case Railway Representative noticed any inferior
quality of PPEs. Similarly, the work shall be allowed to start only after
deposition of the minimum PPEs based on the minimum manpower as
mentioned in Table - H
7.3.10 Contractor is responsible to procure all cleaning equipments and consumable
required for execute the work by his own expenditure. The minimum
requirement of material is given in Table – I. It is only an indicative for
contractor and he should ensure minimum material availability as per his own
convenience, however the list of material shall be procured and handed over to
nominated railway representative on or before 25th of every month for execute
the work of incoming month. The quantity mentioned in the Table – I is
minimum requirement and contractor is not allowed in dispensation for reduce
the material minimum consumption.
7.3.11 The contractor is responsible for police verification of his staff proposed going
to deployed for execution of work in workshop, prior to starting of work.
7.3.12 Contractor is also responsible to conduct the medical checking of his staff and
fit certificate issued by a registered MBBS medical doctor of all staff shall be
submitted to nominated Railway representative prior to starting the work.
7.3.13 Based on the nature of job, the work is only allowed in day time however in
case of any emergency; contractor is responsible for giving additional
manpower on 08 – hour notice to meet out the emergencies.
7.3.14 Considering nature and hardship of work, only male staff with age range of 18
to 55 year is only allowed for work. In case of Railway administration
demanded, contractor is responsible for submitting the age proof of any staff
deployed for execute the work within three days.
7.3.15 Contractor is responsible to handed over all details of staff such as Name,
father’s name, address of staff, any contact number of his family in case to
contact on emergency etc. prior to starting the work.
7.3.16 Contractor will provide photo Identity Card to all the staff employed by him at
his own cost, prior to starting of contract work and to ensure that his staff will
keep ID card with them during working in CRWS/Bhopal. All contractors’ staff
except resident staff are responsible for automatic punching of gate attendance
system while going in and out of duty. Railway will be issued bio-metric

punching cum identity card for all contractor staff, supervisors and contractor.
The cost of the same should be recovered from contractor’s bill. In case any
missing or loss card of any staff, contractor is responsible to lodge an FIR in
nearest police station and copy of the same should be handed over to Railway
Representative for further necessary action. Moreover, contractors staff should
be recorded their attendance through electronic biometric punching machine,
which will be made available at the hostel. Contractor responsible to collect
bio-data of all staff proposed to be deployed for the execution of contract work.
In case failure of bio- matric machine, attendance will be recorded manually in
tine on attendance register & physically verified by inspecting authority as
nominated by Railway administration.
7.3.17 In case any staff absconding from duty or on unauthorized absent from duty, the
contactor will submit a written affidavit to Railway, in which he should be
elaborate the reason of his staff absconded or absents from duty. Contactor is
also given his wiliness to take all responsibility that may arise in future
according to legal or statutory requirement in unforeseen circumstance.
7.3.18 Contractor is responsible for removing of staff immediately in case reporting of
misbehavior with any staff or any Railway authority.
7.3.19 Contractor shall responsible for submitting the valid current labour licenses as
per Rule prior to starting the work.
7.3.20 Contractor shall responsible for Keeping One FIRST AID BOX for his staff
emergency use as per the standard list of First Aid Box as in Table - G. The list
of the same is also enclosed as annexure. He should be ensure minimum
medical AIDS always in First Aid Box and responsible to produce the same at
any time by Railway authority for inspection.
7.3.21 Contractor or his authorized representative should be responsible to ensure his
presence in full working time and at working place. In his absence Railway may
stop the work and contractor is responsible for any loss on this account.
7.3.22 The subletting of contract is strictly prohibited and no other agency allowed to
work inside the work shop on behalf of authorized contactor on which the
contract awarded. In case any such cases come to notice of Railway
Administration, the contract shall be dealt as per clause no 60 of GCC including
termination of contract.
7.3.23 Contractor staff can also utilize toilet facilities, cooling water provision and
canteen facilities etc which are provided for Railway staff, however necessary
information may be provided to management, in case they are like to avail
theses facilities through nominated Railway Representative.
7.3.24 Contractor, his representative and supervisor need to be attended a joint
meeting with Railway representative & Officer in-charge for on first working
day of IInd week of every month and need to sort out all issues and review the
progress of Contract. The minute of the meeting should be prepared and same
should be signed jointly.

7.3.25 Contractor is responsible to be participated quality audit of work execution as
per the prescribed schedule and Performa. The purpose of quality audit is to
find out the effectiveness of implementation of contract work.
7.3.26 Contractor is responsible for participate the joint observation of work execution
if requested by Railway Representative.
7.3.27 Contractor is responsible for payment of staff as per Minimum Wages Act. The
contractor is responsible for arrange the payment of his staff through ECS/bank
payment only. Before starting the contract work, contractor should be submitted
valid saving Bank account of all staff and Banker’s willingness for arrangement
of his staff payment through ECS. No other mode of payment is allowed. The
contractor should submit pay sheet and statement of Payment of staff well in
advance to the nominated Railway Representative and after verification based
on attendance of contractor staff by Railway Representative, the contractor will
take necessary steps for staff payment through bank. No dispensation is allowed
in the above method of payment.
7.3.28 Contractor will provide Uniform as prescribed in Table - C photo equipped
badge with company logo to all staff employed by him along with safety
equipments needed like shoes, hand gloves etc. Expenses towards uniform,
shoes, hand gloves etc., will be borne by contractor.
7.3.29 Work Measurement: Work measurement should be carried as per the details
given in Table - L and the observation should be recorded jointly by Railway as
well as Contractor’s supervisor together. The measurement should be taken on
daily basis and same should jointly sign on same day itself. The Performa will
be filled by Railway representative and printed Performa should be arranged by
contractor by his own expenditure. It may be clearly noted that, the final
acceptance will be granted only on the entire satisfaction of Engineer or his
authorized Railway representative. The effectiveness of works will be evaluated
on a scale of 05, 10 or 20 as per the following rating score and scores will be
assigned for each item in the score card:

Note:-
i.The contractor should ensure that the overall scores should be 90%
and above for full payment. If contractor staff attended the work as
per the laid procedure, utilized specified man power and material
with good workmanship, the scoring is supposed to be 90 to 100%.
In case any short cut method adopted by skipping of some part of
the job or neglecting the procedure of work or not giving adequate
effort to achieve full quality work, or shortage or inferior quality of
consumable, the work affect adversely and quality work
deteriorated. In such eventuality, the desired level of performance
which is unavoidable for normal working of Railway may not be
achieved. In order to avoid such problem, the work evaluation
carried out based on the scoring system given in Table - L. The
payment is governed by the following condition:

ii. If the scoring is below 50% contractor is not eligible for any
payment and in such cases, contractor is responsible for rework so
that Railway working may not effect due to poor performance
contract execution.
iii If contractor is failed achieve more than 50% scoring in a
continuous stretch, the contract may dealt as per GCC clause no 60

including termination of contract.
iv. This is service contract and time is essence of execution.
Therefore daily work execution should be match with 90% and
above rating.
7.1 The material specified in Table – D,E &F should procured by the contractor as per lay down specification and quantity for the above work. The procured material handed over to Railway representative on or before of every 25th of the month for the utilization of material from 1st day of every incoming month. The material required for day to day use should be collected from nominated representative of Railway. The month-wise quantities of cleaning material, gardening material and PPEs are prepared and attached in Table - D,E &F for the guidance of contractor. Contractor should ensure the quality of work in all service buildings. No other material allowed for all activity in view of safety.
8 Wages to Labour:
The contractor shall be responsible to ensure compliance with the provision of
the Minimum Wages act, 1948 (hereinafter referred to as the “said act”) and
the Rules made there under in respect of any employee directly or through
petty contractors or sub contractors employed by him. If, in compliance with
the terms of the contract, the Contractor supplied any Labour to be used
wholly or partly under the direct orders or control of the Railway whether in
connection with any work being executed by the Contractor or otherwise for
the purpose of the Railway such Labour shall, for the purpose of this clause,
still be deemed to be persons employed by the Contractor. If any money
shall as a result of any claim or application made under the said act but
directed to be paid by the Railway, such money shall be deemed to be
moneys payable to the Railway by the Contractor and on failure by the
Contractor to repay the Railway any money paid by it as aforesaid within
seven days after the same shall have been demanded. The Railway shall be
entitled to recover the same from any money due or accruing to the
contractor under this or any other contract with the Railway.
9 Provision of Contract Labour (Regulation and Abolition) Act 1970: A) Provision of Contract Labour
i) The Contractor shall comply with the Provision of Contract Labour
(Regulation and Abolition) Act, 1970 and the Contract Labour (Regulation
and Abolition) Central Rules, 1971 as modified from time to time,
wherever applicable and shall also indemnify the Railway from and
against any claim under the aforesaid Acts and the Rules.
ii) The Contractor shall obtain valid license under the aforesaid Act as
modified from time to time before the commencement of the work and
continue to have a valid license until the completion of the work. Any
failure to fulfill this requirement shall attract the penal provisions of the

contract arising out of the resultant non-execution of the work.
iii) The contractor shall pay to labour employed by him directly as per
provisions of the afore said Act and Rule wherever applicable. The
contractor shall not withstanding the provision of contact to the contrary,
cause to be paid the wages to labour indirectly engaged on work including
any engaged by his subcontractor in connection with the said work, as if
the labour had been immediately employed by him.
iv) In respect of all labour directly or indirectly employed in the work for
performance of the Contractor’s part of the contract, the Contractor shall
comply with or cause to be complied with the provisions of the aforesaid
Act and the Rules wherever applicable.
v) In every case in which by virtue of the provisions of the aforesaid Act or
the Rules, the Railway is obliged to pay any amount of wages to a
workman employed by the contractor or his sub-contractor in execution of
the work or to incur any expenditure in providing welfare and health
amenities required to be provided under the aforesaid Act and the Rules or
to incur any expenditure on account of the contingency liability of the
Railway due to the Contractor’s failure to fulfill his statutory obligations
under the aforesaid Act or the Rules and Railway will recover from the
Contractor the amount of wages so paid or the amount of expenditure so
incurred and without prejudice to the rights of the Railway under Section
20 Sub-section (2) and Section 2, Sub-section (4) of aforesaid Act the
Railway shall be at liberty to recover such amount or part thereof by
deducting it from the security deposit and/or from any sum due by the
Railway to the Contractor whether under the contract or otherwise. The
Railway shall not be bound to contest any claim made against it under sub
section (1) of Section 20 and Sub section (4) of section 21 of the aforesaid
Act except on the written request of the Contractor and upon his giving to
the Railway full security for all cost for which the Railway might become
liable in contesting such claim. The decision of the Railway regarding the
amount actually recoverable from the Contractor as stated above, shall be
final and binding on the Contractor.
B) Provision of Contract Labour
1) Contractor should ensure the following important items without any
failure:-
a) As per chapter III, the Contractor shall obtain labour license, before
starting the contract work and renew the license as per the existing Rule
and regulation.
b) As per Chapter V, the contractor should ensure all welfare and health
facilities including first-aid box at work site. The prescribed medicine,
its quantity and List of medical AID and its quantity is given in Table-V.
c) As per chapter VI, wages of staff should be ensured in prescribed time,
with not less than the minimum wages applicable at Bhopal ordered by
the Central Labour Commissioner, which is subjected to revision from
time to time.

d) For the ECS clearance of staff payment, the contractor will be submitted
the staff pay sheet along with attendance register till 5th
of every month
and cross checked pay sheet should be collected by the contractor on
same day and deposit the total pay to respective Bank for disbursement
of wages through ECS. The copy of challan/bank deposit counterfoil
with its original should be submitted along with register of wages for
evidence. e) As per chapter VII, contractor shall be responsible for maintain the
prescribed documents for ready reference. Following are the
important registers

addition to normal 8-hours duty)

2) As per the clause of 63 of Contract Labour (Regulation and Abolition) Act, 1970, the contractor shall fix wage period in respect of which wages shall be payable, as per clause no “No wage period shall exceed one month” & as per clause no 65, the wages of every person employed as contract labour in and establishment or by a contractor where less than 1000 such persons are employed shall be paid before the expiry of seventh day and in other case before the expiry of 10
th day after the last day of the
wage period in respect of which the wages are payable.
3) The mode of payment is normally through Bank ECS. The contractor shall be submitted the details of his staff valid saving bank account number and branch of bank details along with identity card & copy of police verification certificate prior to take the employee for executing the work.
10. No child labour is permitted. Contractor should ensure and certify that labour
engaged by him for the contract is above 18 year and not more than 60 year.
Contractor is responsible to produce the age proofing document to the
satisfaction of Railway, if Railway demanded the same at any time.
11. Facilities to be provided by Railways:
a) Following facility will be provided to resident staff -
i) Free suitable accommodation with in the or near by premises of hostel &
ORH.
ii) Free water supply as per availability.
iii) Free electricity supply as per availability. b) Free water supply as per availability.
c) Free electricity supply as per availability for car washer/ high pressure jet
machine/ vacuum cleaner and other equipments.

12. “Contractor will produce following certificate along with bill”.
“Certificate”
a) This is certifying that employees have in possession of EPF numbers.
They have been paid wages as per M.P. Government / Central
Government Minimum Wages Act. Details enclosed in the form of
“register of wages” form no. XVII of Contract Labour (Regulation &
Abolition) Central Rules, 1971”.
b) This is certified that EPF of staff deployed for above work has been
deposited by me and I will be solely responsible for any claim by my
staff in this respect.
c) This is certified that I have deposited Service Tax for the above work. (If
service tax is quoted by the contractor).
c-i) Service tax is not applicable on us and I will be solely responsible for
any claim by Service Tax Department in this respect. (If service tax is
not quoted by the contactor).
d) This is certified that all the Industrial Laws and other relevant laws &

Timings;
All personnel to report to work on the assigned time and be available till the
assigned time for leaving. All contractor’s staff, supervisor and contractor/s are
responsible for automatic punching of gate attendance system while going in and
out of workshop and prior to start the work as well as in & out of lunch break. For
this purpose, railway will be issued bio-metric punching cum identity card for all
contractor’s staff, supervisors and contractor. The cost of the identity card should
be recovered from contractor’s bill. In case any missing or loss card of any staff,
contractor is responsible to lodge an FIR in nearest police station and copy of the
same should be hand over to Railway Representative for further necessary action.
No duplicate card is allowed to issue without submitting the damaged card/FIR and
depositing of cost of new identity card.
In case failure of bio- matric machine, attendance will be recorded manually
in tine on attendance register & physically verified by inspecting authority as
nominated by Railway administration.
Behaviors;
All personnel need to be courteous to Railway Staff.
Operators should follow supervisor’s instructions on behavior.
Arguments with Railway staffs and RO (Railway officials) should be avoided at all
costs.
