2. Ruling on Question of breach of Privilege

(a) Yesterday i.e. on the 27th June, 2019, on receipt of a notice of breach ofPrivilege from Shri Dulal Chandra Bar, MLA against Smt. Nargis Begam,MLA and Smt. Chandrima Bhattacharya, MLA for using 'Unparliamentary'expressions against him in the House on 25th June, 2019, Mr. Speaker hadinformed the House that the matter was under his examination and he wouldgive his ruling on it in due course.

After due examination of the matter, Mr. Speaker found that nosupporting document was produced with the notice to substantiate thecharge/complaint. It could not even be perceived whether the notice had beenserved upon the persons complained against beforehand as a matter ofcurtesey. On verification of relevant proceedings Mr. Speaker also found thatno such comment had been made either by Smt. Nargis Begam, MLA or bySmt. Chandrima Bhattacharya, MLA against the Member giving notice.Therefore, such vague and indefinite charges had made the noticeinadmissible and Mr. Speaker disallowed it:

(b) On receipt of a notice of breach of Privilege under rule 226 ofthe Rulesof Procedure and Conduct of Business in the West Bengal LegislativeAssembly from Dr. Partha Chatterjee, Shri Nirmal Ghosh, Shri Tapas Royand Shri Sobhandeb Chattopadhyay against the Editor, the Publisher and theReporter of (i) Ananda Bazar Patrika, (ii) Ei Samay and (iii) Sambad Pratidinfor alleged publication of a distorted news item in their issues dated the27th June, 2019 containing mispresentation of the speech of Hon'bleChief Minister delivered in the House on the 26th June, 2019, Mr. Speaker,after verifying the contents of the notice along with its annexures carefully,satisfied that there was a Prima-facie case ofbreach of Privilege in the instantmatter and the matter had been raised at the earliest opportunity. Therefore,Mr. Speaker requested Dr. Partha Chatterjee to raise the matter as a questionof Privilege under rule 227 of the Rules of Procedure and Conduct of Businessin the West Bengal Legislative Assembly. After the matter was duly raised, ona proposal put forth by the Hon'ble Chief Minister, Dr. Partha Chatterjeewithdrew his notice of Privilege with the consent ofthe House.

Thereafter Mr. Speaker announced that the notice of breach of Privilegehad been withdrawn by Dr. Partha Chatterjee with the consent of the House.

3. Question of breach of Privilege

On receipt of a notice of alleged breach of Privilege and contempt of theHouse under rule 226 of Rules of Procedure and Conduct of Business in theWest Bengal Legislative Assembly jointly from Dr. Partha Chatterjee andShri Tapas Roy, Shri Sobhandeb Chattopadhyay, Shri Nirmal Ghosh,Shri Rathin Ghosh, Shri Churamani Mahata and Shri Amirul Islam againstDr. Sujan Chakraborty, MLA, Shri Ali Imran Ramz, MLA and Shri Sk. AmjadHossain, MLA for alleged misconduct in the House on 27th June, 2019,Mr. Speaker ruled that the matter was under his examination and he wouldgive his rulling on it in due course.

4. Leave of Absence Under Rule 242Under rule 243(1)ofthe Rules ofProcedure and Conduct ofBusiness in the

West Bengal Legislative Assembly, the Speaker read out the application ofShri Hiten Barman desiring permission of the House to remain absent fromthe sittings thereof in terms of Clause (4) of Article 190 ofthe Constitution ofIndia and thereafter asked whether Shri Hiten Barman had the permission ofthe Assembly asked for by him.

Since no dissentient voicewas heard, the Speaker declared that Shri HitenBarman had the permission of the Assembly to remain absent from thesittings ofthe House for the period from 25th June, 2019 till the last sitting ofthe current Session of the Assembly.

5. Calling Attention to the matter of Urgent Public ImportanceThe Minister-in-Charge of the Irrigation and Waterways Department

made a statement on the subject of severe erosion of embankments of riverGanga at Gargari Ghat in Serampore Municipal area.
