PROPOSED WEMBEZI WATER CONSERVATION AND DEMAND MANAGEMENT BULK WATER AND

RETICULATION SCHEME UPGRADE, INKOSI LANGALIBALELE LOCAL MUNICIPALITY, UTHUKELA

DISTRICT MUNICIPALITY, KWAZULU-NATAL.

1. INTRODUCTION

Terratest (Pty) Ltd has been appointed by the uThukela District Municipality to undertake the necessary

environmental services required for the proposed Wembezi Water Conservation and Demand Management

Bulk Water and Reticulation Upgrade Scheme, Inkosi Langalibalele Local Municipality, KwaZulu-Natal. This

Notification Sheet aims to inform Interested and Affected Parties (IAPs) of the Environmental Impact

Assessment (EIA) process that is being conducted in the form of a Basic Assessment Process. All issues

and comments raised by IAPs during this process will be documented in a Basic Assessment Report. This

will assist in the identification of environmental issues that could have a negative and / or positive impact on

the site and the community.

According to the EIA Regulations (2014, as amended), it is necessary for the Applicant to appoint an

independent Environmental Assessment Practitioner (EAP) who will adhere to the environmental

regulations and complete the applicable environmental process on behalf of the Applicant. In this case, the

relevant role players for the proposed development are as follows:

Competent Authority: KwaZulu-Natal Department of Economic Development, Tourism & Environmental

Affairs (EDTEA)

2. PROJECT DESCRIPTION AND LOCALITY

The proposed upgrade includes the installation of a new 8km High-density Polyethylene (HDPE) 750mm

diameter (Ø), rising main bulk pipeline from the existing pump station at George Cross Water Treatment

Works, to a new 10 Mega-litre (Ml) bulk storage reservoir, Wembezi. The proposed rising main bulk water

pipeline will be aligned to run alongside an existing Ø355mm rising main which currently serves the existing

10Ml Wembezi Reservoir, within an existing 3m wide servitude.

The project also includes for the upgrade of the existing water reticulation scheme in Wembezi, which will

amount to the replacement of approximately 160 993m of reticulation pipeline, ranging from Ø75mm

unplasticized polyvinyl chloride (uPVC) to Ø500 HDPE. All reticulation will be constructed within the same

footprint as the previously installed network.

The proposed upgrade is required as Wembezi experiences severe water losses from the existing, dated

infrastructure and supply is therefore unreliable. The neighbouring area of Ntabamhlophe feeds off the

Wembezi infrastructure, and as this is failing, the area of Ntabamhlophe also receives an unreliable supply

of water, if any at all. The proposed development therefore forms part of a larger project, which aims to

upgrade water infrastructure and potable water supply in both the areas of Wembezi and in the

neighbouring area of Ntabamhlophe. An additional aim of the upgrade is to stop the unnecessary and

extreme water losses currently experienced, estimated to be 9Ml per day, and is thus also considered to be

a water conservation initiative.

A Locality Map is attached as Appendix 1.

3. THE ENVIRONMENTAL LEGAL FRAMEWORK

In accordance with the National Environmental Management Act (Act 107 of 1998) and the EIA Regulations

(2014, as amended), the following Listed Activities are triggered:

• GNR 327, Item 9: “The development of infrastructure exceeding 1000 metres in length for the bulk

transportation of water or stormwater (i) with an internal diameter of 0.36 metres or more; or (ii)

with a peak throughput of 120 litres per second or more, excluding where (a) such infrastructure is

for bulk transportation of water or stormwater drainage inside a road reserve or railway line

reserve; or (b) where such development will occur within an urban area.”

− The proposed project entails the development of an 8 000m (i.e. 8km) long rising main bulk

water pipeline with an internal diameter of 0.75m (i.e. 750mm). The alignment of the rising

main bulk water pipeline does not fall within an urban area and does not run inside a road or

railway line reserve. Further, portions of the reticulation upgrade do not fall within urban areas

and will have an internal diameter of more than 0.36m. This Listed Activity is therefore

triggered.

• GNR 327, Item 12: “The development of (xii) infrastructure or structures with a physical footprint of

100 square metres or more where such development occurs a) within a watercourse b) in front of

the development setback; or c) if no development setback exists, within 32 metres of a

watercourse, measured from the edge of the watercourse, excluding (dd) where such development

occurs within an urban area; (ee) where such development occurs within existing roads, road

reserves or railway line reserves.”

− The rising main bulk line is aligned to run through wetlands, which will result in more than

100m2 of infrastructure being developed in a watercourse. The alignment of the rising main

bulk water pipeline does not fall within an urban area and does not run inside a road or railway

line reserve. This Listed Activity is therefore triggered.

• GNR 327, Item 19: “The infilling or depositing of any material of more than 10 cubic metres into, or

dredging, excavation, removal or moving of soil, sand, shells, shell grit, pebbles or rock or more

than 10 cubic metres from a watercourse.”

− The construction of the rising main bulk line and reticulation upgrade will necessitate

construction through watercourses, which will result in the excavation and deposition of more

than 10m3 into and out of watercourses. This Listed Activity is therefore triggered.

• GNR 324, Item 14: “The development of (ii) infrastructure or structures with a physical footprint of

10m2 or more where such development occurs (a) within a watercourse (c) if no development

setback has been adopted, within 32 meters of a watercourse, measured from the edge of a

watercourse (d) in KwaZulu-Natal (x) outside urban areas (aa) areas within 10km from national

park or world heritage sites or 5km from any terrestrial protected area identified in terms of

NEMPAA or from the core area of a biosphere reserve.”

− The rising main bulk line will necessitate construction within watercourses that will exceed

10m2, outside urban areas and falls within 5km of the Wagendrift Nature Reserve. Further,

portions of the reticulation fall outside of the urban area as defined by the Competent Authority

which will require construction within a watercourse. This Listed Activity is therefore triggered.

Environmental Authorisation is to be obtained from the EDTEA prior to construction commencing.

4. PUBLIC PARTICIPATION PROCESS

The Public Participation Process, as promulgated in terms of Chapter 6 of the EIA Regulations (GNR 326,

2014) as amended, is a fundamental process whereby the proponent, technical team, government

authorities, key stakeholders and IAPs can engage in an informed decision–making process.

Key activities to be undertaken as part of Public Participation Process include:

• Identification of key stakeholders, authorities and municipalities, environmental groups and

members of the public who may be interested in, or may be affected by the proposed development;

• Compilation of a Notification Letter for distribution to IAPs (this document);

• Placement of an advertisement in a newspaper applicable to the region notifying the public of the

proposed activity;

• Placement of on-site posters detailing the activity and contact details of the Environmental

Assessment Practitioner;

• Recording all IAP comments and presenting such comments, as well as responses provided by the

Environmental Assessment Practitioner, in a full Comment and Response Report which will

accompany the Basic Assessment Report;

• Circulating the Draft Basic Assessment Report to all registered IAPs for a 30 day review and

comment period; and

• Submitting the Final Basic Assessment Report to the EDTEA for a decision on Environmental

Authorisation.

5. HOW DO I PARTICIPATE?

IAPs are invited to participate by providing comments and raising issues of concern regarding the proposed

upgrade. In order to register in the EIA Process and to be kept informed of progress, please complete the

Registration Form attached as Appendix 2 and forward onto Terratest (Pty) Ltd as per the details provided.

Lastly, all key stakeholders and IAPs registered in this Application are hereby informed of Section 3(4) of

GNR 326 of the EIA Regulations (2014, as amended) which states, “When a State Department is

requested to comment in terms of these Regulations, such State Department must submit its comment in

writing within 30 days from the date on which it was requested to submit comment, and if such State

Department fails to submit comments within such 30 days, it will be regarded that such State Department

has no comments.“ This regulation will be enforced when the Draft Basic Assessment Report is submitted

to State Departments for comment. Further, all IAPs are notified of Section 3(8) of GNR 326 of the EIA

Regulations (2014, as amended) which states, “Any public participation process must be conducted for a

period of at least 30 days.” In this regard, all registered IAPs will be afforded the opportunity to comment on

the Draft and Final Basic Assessment Report for a period of 30 days, as and when, it becomes available.

Please would you be so kind as to indicate on the attached map the property to which you refer, as well as the

pastures proposed to be affected. I can then present this information to the associated engineers.

Further, are the pastures utilised continuously year round, or is there a period when the utilisation of this portion of

land is not as important an asset for milk production? I’d like to determine if a construction schedule is required in

this regard. If necessary, this would need to be determined with yourself and the engineers.

In terms of the Basic Assessment Process which Terratest is currently undertaking, a Draft Basic Assessment Report

is in the process of being drafted. This will contain all pertinent information relating to the proposed development

activity, as well as the potential biophysical and social impacts identified in terms of construction. You will be

notified of the availability of this report and be afforded an opportunity to comment on the content. Thereafter, a

Final Basic Assessment Report will be drafted, which again will be circulated for comment, as well as being

submitted to the KwaZulu-Natal Department of Economic Development, Tourism and Environmental Affairs for a

decision on whether the proposed project may be implemented or not.

In regards to the Wembezi Township Bulk Water Scheme upgrade.

I am a manager of the property to which the bulk of the pipe would go through.

While mainly veld, the line does cut through our pasture platform. This is essential to our milk production.

We would need to work closely together to plan around this project please.

Hi Liz

Jan met with Warren (farmer just outside Wembezi) and to discuss his concerns. We will still be able to construct

the pipeline as long as we replace the grass and reconstruct the gravel road to its original condition which we will

make provision to do so. He also mentioned that certain times of year he uses the pivot irrigation more so we will

try compensate this by constructing on his farm when he irrigates less.

Based on the information supplied, Ezemvelo does not anticipate that the proposed activity would result in significant negative impacts upon local biodiversity, provided that best practice mitigation measures are implemented during the construction and operational phase. Please be informed that Ezemvelo does not require additional documentation with regards to this project, except when additional biodiversity information becomes available and/or additional biodiversity impacts are identified which are not presented in the abovementioned report. DHL EXPRESS TERMS AND CONDITIONS OF CARRIAGE("Terms and Conditions")

IMPORTANT NOTICE

When ordering DHL's services you, as "Shipper", are agreeing, on your behalf and on behalf of the receiver of the Shipment ("Receiver") and anyone

else with an interest in the Shipment,that the Terms and Conditions shall apply.

"Shipment" means all documents or parcels that travel under one waybill and which may be carried by any means DHL chooses, including air, road or any other carrier.

A "waybill" shall include any Shipment identifier or document produced by DHL or Shipper automated systems such as a label, barcode, waybill or consignment note as

well as any electronic version thereof. Every Shipment is transported on a limited liability basis as provided herein.If Shipper requires greater protection, then

insurance may be arranged at an additional cost.(Please see below for further information)."DHL" means any member of the DHL Express Network.

1 Customs ClearanceDHL may perform any of the following activities on Shipper's or Receiver's

behalf in order to provide its services: (1) complete any documents, amend

product or service codes, and pay any duties, taxes or penalties required under

applicable laws and regulations ("Customs Duties"),(2) act as Shipper's forwarding

agent for customs and export control purposes and as Receiver solely for the

purpose of designating a customs broker to perform customs clearance and entry

and (3) redirect the Shipment to Receiver's customs broker or other address upon

request by any person who DHL believes in its reasonable opinion to be authorized.

2 Unacceptable ShipmentsA Shipment is deemed unacceptable if:

• no customs declaration is made when required by applicable customs regulations,

• it contains counterfeit goods, animals, bullion, currency, gem stones; weapons,

explosives and ammunition; human remains; illegal items, such as ivory and narcotics,

• it is classified as hazardous material, dangerous goods, prohibited or restricted

articles by IATA (International Air Transport Association), ICAO (International Civil

Aviation Organization), ADR (European Road Transport Regulation on dangerous goods)

or other relevant organization ("Dangerous Goods"),

• its address is incorrect or not properly marked or its packaging is defective or

inadequate to ensure safe transportation with ordinary care in handling,

• it contains any other item which DHL decides cannot be carried safely or legally.

3 Deliveries and UndeliverablesShipments cannot be delivered to PO Boxes or postal codes. Shipments are

delivered to the Receiver's address given by Shipper but not necessarily

to the named Receiver personally.Shipments to addresses with a central

receiving area will be delivered to that area.

DHL may notify Receiver of an upcoming delivery or a missed delivery.Receiver

may be offered alternative delivery options such as delivery on another day,

no signature required, redirection or collection at a DHL Service Point.Shipper

may exclude certain delivery options on request.

If the Shipment is deemed to be unacceptable as described in Section 2, or it

has been undervalued for customs purposes, or Receiver cannot be reasonably

identified or located, or Receiver refuses delivery or to pay Customs Duties or

other Shipment charges, DHL shall use reasonable efforts to return the Shipment

to Shipper at Shipper's cost, failing which the Shipment may be released,

disposed of or sold without incurring any liability whatsoever to Shipper or

anyone else, with the proceeds applied against Customs Duties,Shipment charges

and related administrative costs with the balance of the proceeds of a sale to

be returned to Shipper. DHL shall have the right to destroy any Shipment which any

law prevents DHL from returning to Shipper as well as any Shipment of Dangerous Goods.

4 InspectionDHL has the right to open and inspect a Shipment without notice

for safety, security, customs or other regulatory reasons.

5 Shipment Charges & BillingDHL's Shipment charges are calculated according to the higher of actual or

volumetric weight per piece and any piece may be re-weighed and re-measured

by DHL to confirm this calculation.

Shipper, or the Receiver when DHL acts on Receiver's behalf, shall pay or

reimburse DHL for all Shipment or other charges due, or Customs Duties

owed for services provided by DHL or incurred by DHL on Shipper's or

Receiver's behalf.Payment of Customs Duties may be requested prior to

delivery.If DHL uses its credit with the Customs Authorities or advances

any Customs Duties on behalf of a Receiver who does not have an account

with DHL, DHL shall be entitled to assess a fee.

6 DHL's Liability6.1 DHL's liability in respect of any one Shipment transported by air

(including ancillary road transport or stops en route) is limited by the

Montreal Convention or the Warsaw Convention as applicable, or in the absence

of such Convention, to the lower of (i) the current market or declared value,

or (ii) 19 Special Drawing Rights per kilogram (approximately null 26.00 per

kilogram). Such limits shall also apply to all other forms of transportation,

except where Shipments are carried only by road, when the limits below apply.

For cross border Shipments transported by road, DHL's liability is or shall

be deemed to be limited by the Convention for the International Carriage of Goods

by Road (CMR) to the lower of (i) current market value or declared value, or

(ii) 8.33 Special Drawing Rights per kilogram (approximately null 14.00 per kilogram).

Such limits will also apply to national road transportation in the absence of any

mandatory or lower liability limits in the applicable national transport law.

If Shipper regards these limits as insufficient it must make a special declaration

of value and request insurance as described in Section 8 or make its own

insurance arrangements.

DHL's liability is strictly limited to direct loss and damage to a Shipment only and

to the per kilogram limits in this Section 6. All other types of loss or damage are

excluded (including but not limited to lost profits, income, interest, future business),

whether such loss or damage is special or indirect, and even if the risk of such loss

or damage was brought to DHL's attention.

6.2 DHL will make every reasonable effort to deliver the Shipment according to DHL's

regular delivery schedules, but these schedules are not binding and do not form part of

the contract. DHL is not liable for any damages or loss caused by delay, but for certain

Shipments, Shipper may be able to claim limited delay compensation under the

Money Back Guarantee terms and conditions, which are available on the DHL website

(www.dhl.com) or from DHL Customer Service.

7 ClaimsAll claims must be submitted in writing to DHL within thirty (30) days from the

date that DHL accepted the Shipment, failing which DHL shall have no liability

whatsoever.Claims are limited to one claim per Shipment, settlement of which will

be full and final settlement for all loss or damage in connection therewith.

8 Shipment InsuranceDHL may be able to arrange insurance covering the value in respect of loss of or

damage to the Shipment, provided that the Shipper so instructs DHL in writing,

including by completing the insurance section on the front of the waybill or by

DHL's automated systems and pays the applicable premium.Shipment insurance

does not cover indirect loss or damage, or loss or damage caused by delays.

9 Circumstances Beyond DHL's ControlDHL is not liable for any loss or damage arising out of circumstances beyond DHL's

control.These include but are not limited to electrical or magnetic damage to, or

erasure of, electronic or photographic images, data or recordings; any defect or

characteristic related to the nature of the Shipment, even if known to DHL;any

act or omission by a person not employed or contracted by DHL - e.g. Shipper,

Receiver,third party, customs or other government official; "Force Majeure" -

e.g. earthquake,cyclone,storm, flood, fog, war, plane crash, embargo,

riot, civil commotion, or industrial action.

10 Shipper's Warranties and IndemnitiesShipper shall indemnify and hold DHL harmless for any loss or damage arising out of

Shipper's failure to comply with the following warranties and representations:

• all information provided by Shipper or its representatives is complete and accurate;

• the Shipment is acceptable for transport under Section 2 above;

• the Shipment was prepared in secure premises by reliable persons and was

protected against unauthorized interference during preparation, storage and any

transportation to DHL;

• Shipper has complied with all applicable customs, import, export, data protection

laws, sanctions, embargos and other laws and regulations; and

• Shipper has obtained all necessary consents in relation to personal data provided

to DHL including Receiver's data as may be required for transport, customs clearance

and delivery, such as e-mail address and mobile phone number.

11 RoutingShipper agrees to all routing and diversion, including the possibility that

the Shipment may be carried via intermediate stopping places.

12 Governing LawAny dispute arising under or in any way connected with these Terms and Conditions

shall be subject, for the benefit of DHL, to the non-exclusive jurisdiction of the

courts of, and governed by the law of the country of origin of the Shipment and

Shipper irrevocably submits to such jurisdiction, unless contrary to applicable law.

13 SeverabilityThe invalidity or unenforceability of any provision shall not affect any other

part of these Terms and Conditions.

Should no comment be received within the 30 day commenting period, it will be assumed that the relevant State Department has no comment to provide. All comments received in response to the BA Report will be attached to, summarised and responded to in a final version of the BA Report, which will be submitted to the Competent Authority, the EDTEA, for a decision on Environmental Authorisation.
