Whether you’re a new or existing owner or a tenant, all Schonenberg residents subscribe to a

Estate living is unique and calls for a high degree of respect and certain restraints with regards

to one’s neighbours. Meaning Schonenberg residents need to adhere, at all times, to the rights

and privileges of the other residents. And to make community association living work, there are

certain house rules and regulations for the protection and reinforcement of this lifestyle and the

Schonenberg Estate is located in Somerset West, a country town that is organisationally and adminstratively included in the City of Cape Town metropolitan municipality.It’s a place where you can live, relax and walk safely out of your home in a secure landscaped environment surrounded by natural beauty.

As one of Somerset West’s prime property developments, the estate lies in the Helderberg (meaning ‘clear mountain’) Basin between the False Bay ocean and the Hottentots Holland and Helderberg mountain ranges.

distance of the upmarket Waterstone Village shopping centre; in close proximity to the Helderberg

The property on which the Schonenberg

Estate is situated was in all likelihood utilised

as a camp by Khoi pastoralists prior to colonial

settlement; as they used the areas between

the Lourens and Eerste Rivers extensively.

The historical use of the land was probably

agricultural prior to ownership passing to the

De Beers Consolidated Mines. At the beginning

of the twentieth century, De Beers established

their operations and infrastructure in the area

and in 1923 formed a new company called

Africa Explosives and Chemical Industries Ltd

(AECI) to house their explosives business. The

property interests of AECI Ltd were to be

managed by a subsidiary company, Heartland

Properties (Pty) Ltd, which received approval

for the rights to develop the land.

The name “Schonenberg” originates from the story of a shipwreck. The Dutch East Indiaman, The

Schonenberg, was on her eighth voyage back to Holland from the East when she ran aground

at Cape Agulhas on 20th November 1722. It is told that the ship’s captain and three Dutch

farmers from the Holland Hottentots district conspired to run the ship ashore – heavily laden

with costly oriental goods – with intent to salvage the valuable cargo and stash it away on the

Vergelegen Estate, near the town of Somerset West. When the Governor at the Castle of Good

Hope was informed of the dubious circumstances of the wreck, he was suspicious and had the

perpetrators arrested, tried and brutally punished. Although the grounds of Vergelegen were

thoroughly searched over the years, no treasure was ever recovered but the legend lives on.

ESTATE MANAGEMENT Home Owners’ Association (HOA)

There is only one overall association for the Schonenberg Estate, which is governed by the

customized constitution that covers all aspects of estate management.

The HOA is the non-profit controlling body of the estate and its main objective is to promote,

advance and protect the common interests of its members with respect to their ownership, use

and enjoyment of the erven, and the common property which comprises the estate.

Among its many responsibilities, the HOA determines and maintains the code of conduct of

residents. There are rules and regulations regarding certain things, such as house design, exterior

maintenance and alterations to property. One of the functions of the HOA is to monitor and

enforce compliance with the Constitution and the Estate Management Rules and Regulations, on

behalf and for the benefit of its members.

Above all, the HOA is committed to the sustainable development of the Schonenberg community.

ROLE OF TRUSTEES The control, management and administration of the affairs of the HOA is vested in the trustee committee who may exercise their authority to do all such acts in the discharge of their duties or the fulfillment of their obligations.

The trustee committee, consisting of at least six (6) but not more than eight (8) persons, is appointed by the HOA and it is the members who elect the trustees annually. A trustee holds office until the second succeeding Annual General Meeting (AGM) and if nominated, is eligible for re-election, provided that she or he does not serve for more than four (4) consecutive years.

“We encourage homeowners to get involved in the community and become association volunteers, to stand for office as a trustee or serve on one of the six sub-committees or simply contribute to what we call our ‘brains trust’.

HOA MEMBERSHIPUpon registration of ownership of an erf or unit in the estate, the owner automatically becomes a member of the HOA and is obliged to comply with the provisions of the Constitution, the Architectural Guidelines and the Conduct Rules. No person may cease to be a member while remaining a registered owner, and membership is only transferred to a new member by registration of a Deed of Transfer at the Deeds Registry in Cape Town.

Legal statusThe Conduct Rules have been agreed to by each Member on acquiring an Erf and are attached to the Constitution of the HOA.All Members, Occupiers and entrants onto and to the Estate are obliged to comply with the Conduct Rules and Procedures.These Conduct Rules are in addition to the rights and obligations provided for in the Constitution.The Member or Occupier of every Erf is responsible for ensuring that all members of his family, tenants, guests, visitors, employees, contractors, contractors’ subcontractors and delivery persons also comply with these Conduct Rules and Procedures.The Trustees shall have the rights, in the event of a breach of a Conduct Rule by the Member, Occupier, his family, tenants, guests, visitors, employees, contractors, contractors’ subcontractors and delivery persons, to take such action against the defaulting Member or Occupier as they deem fit.

HOA STAFFThe staff – all English- and Afrikaans-speaking - are employed to deal with the day-to-day

management of the estate, from general maintenance to emergency situations. If you have any

Registration As a new homeowner or tenant, your first port of call is the HOA office, situated at the Main Gate. Residents must make sure that they, and their family members, are properly registered with complete contact information including landline and mobile phone numbers (internal PABX number), email address, physical address, and where they may be reached in case of emergency.

“It’s important for the HOA management and staff to communicate with you directly.” The prescribed form Registration/Access Control must be completed by every owner, tenant and their individual family members. All official written communication from the HOA is sent by way of email or smses to the registered addresses. If a resident’s contact details are incorrect, incomplete or not up-to-date, the HOA cannot be responsible for the lack of communication.

ERF DEVELOPMENTSchonenberg has a unique, well-planned layout with a seamless incorporation of the building

structures into the surrounding historical agricultural landscape. Specific guidelines, supplementary

to the National Building Regulations and the requirements of the local authority, have been developed

in order to protect and safeguard the environment and uphold the appropriate architectural

character and investment value of the properties. These architectural design guidelines and

standards are an extension to the constitution. All building designs have to be approved by the

Schonenberg Design Review Committee (DRC) prior to submission to the local authority.

Owners must ensure that their architects and building contractors have studied the Architectural

Design Guidelines before plans are presented and executed.

The owner and builder must comply with the terms and conditions in the governing documents,

including the Construction Environmental Management Plan (CEMP). In addition, prior to the start

of building, the contractor appointed by the owner must provide the HOA with a ‘Certificate of

Undertaking’ which is attached to the Builders’ Code of Conduct.

Please note:

Duty times for contractors/ service providers are 07:15 to 18:00 (weekdays), and

08:00 to 13:00 (Saturdays). If found on the estate after hours, they may be fined.

Contractors/ service providers are not allowed to walk in or out of the estate or

walk from one plot to another, but must be transported by vehicle.

No contractors/ service providers are allowed to work on Sundays/Public Holidays,

unless otherwise stipulated/advised by the HOA.

If you are planning any alterations or additions to a property (single residential and/

or group sites), the best thing to do is contact the Building Control Officer (BCO),

before commencement of work.

The BCO will provide guidance and make sure that the proposed work will be

done in accordance with the Architectural Design Guidelines and the

Builders’ Code of Conduct.

LEVY

COLLECTION

Levy and collect are not synonymous terms. Levy means assessment or charging or

imposition of tax, collect means physical realisation.

The levies are the contributions payable by every homeowner for the purpose of meeting all expenses

which the HOA has incurred or which the trustee committee anticipates the HOA will incur by way of

landscaping, estate roads and services thereon, the security systems and / or for payments of expenses

necessary in connection with the management of HOA and the common property. The amount of the

annual levy is determined and approved by the trustees.

The levy collection functions are performed by HOA management and staff.Every homeowner shall pay levies in respect of each erf or unit and should

register with correct contact details at the HOA office. Monthly levies are

due on the 1st day of each calendar month. The following payment methods

are available:

complete and return a debit order instruction form by email or hand

in to the HOA office;

arrange for Electronic Fund Transfer (EFT) with your erf

number as reference.

Please note: if a homeowner is in arrears with the payment of levies or

other amounts, they shall be liable for all costs, expenses and interest, legal

and otherwise, in recovering these amounts.

Be in the know

The Community Schemes Ombud Services Act (CSOS) Act 9 of 2011, which came into

operation on 1 October 2016, enables residents of communities to take their disputes

to the Community Schemes Ombud (CSO) instead of the courts. Although this service

is funded through an annual levy payable to the service on 30 September each year,

the HOA must collect these levies monthly from members in accordance with a sliding

scale based on the municipal valuation of each unit.

USE of UTILITIESWater, Refuse & Sewerage

The HOA is responsible for the recovery of the actual consumption of water and the use of

refuse removal and sewerage on each erf. Homeowners and / or the tenants must pay

these outstanding amounts together with the levy on a monthly basis. The same rules

and regulations apply regarding payment and debt management as with the levy

collections. Prompt payment is important for the cost-effective running of the estate:

if a homeowner doesn’t pay on the 1st day of the month, they will be penalized.

Please note: homeowners must pay their property rates and refuse charge

directly to the municipality of the City of Cape Town.

Electricity The HOA has acquired the services of a vendor to render

an infrastructure for a continuous, uninterrupted, expedient

and error-free supply of electricity and prepaid electricity management, in

accordance with the agreed terms and conditions. Tariffs are adjusted by

default on 1st April for Eskom customers and 1st July for municipal customers.

The vendor calculates the new tariffs according to the published percentage

tariff increase and notifies the HOA accordingly. The HOA notifies the

residents of any tariff changes on the understanding that in accordance with

the municipal by-laws the residents cannot be worse off than they would

have been, if directly supplied by the supply authority. Residents must buy

tokens in the form of a pin number for use in the vendor’s prepayment meters. These purchases can be

made through an electronic prepaid facility with your bank or with electronic payments

(www.myprepaid.co.za) or in shops close-by to Schonenberg, where electricity can be purchased.

Refuse Disposal Refuse is collected before 9:00 am on a weekly basis – including Public Holidays, unless otherwise arranged by the HOA. Household waste should be placed securely in black plastic refuse bags, in a municipality wheelie-bin, to be collected every Thursday from outside the erf by the estate’s contractor. The waste is taken to Schonenberg’s Waste Transfer Station (by the Waterstone Gate) from where it is collected by the municipality’s contractor.

Please put your refuse bags out before 09:00 on Thursday and Friday mornings.

Please note: each new homeowner needs to apply to the municipality for the provision of a wheelie-bin.

Communication & Information Management “Residents, please must make sure that you are properly

registered so that we can communicate with you successfully.”

All official HOA communication is sent either through email

or sms to the names and addresses provided. We can’t be

responsible for any failure of communication, if you haven’t

registered your correct contact details.

We use electronic communication facilities and services for

residents to engage with the estate whenever they like, such as:

GLOvent Community Management System (CMS)

assists the HOA with day-to-day management.

The online community portal provides an area on

the internet for residents to interact with the HOA

management, the trustees and one another.

The HOA uses the GLOvent CMS to send out messages, notices and a monthly electronic magazine(‘eMag’),

for residents to receive important updates and useful confidential information.

Only residents can access this information by using their user name and password. Each resident should

fill in his / her personal details directly in the community portal and make sure everything is correct and

updated. The security of your personal details is important to us, we use this information only to assist

the administration and improve the function of the portal. View / download our Privacy Policy and check

periodically for updates.

Telephone System ‘Fibre to the Home’ (FTTH) is explained as an access network architecture in which the connection to

the estate’s premises is optical fibre. The fibre optic communications path enables several services to

residents, such as data, voice, video and intercom.

The HOA initiated the installation, maintenance and management of an optical fibre communication

infrastructure, aka Fibre to the Home to provide broadband services to the private properties and

administration offices within the estate.

Because it is an open access, residents can select from multiple retail service providers to use the FTTH

network on an equable base, meaning the providers compete to offer

their services to the end-users.

Estate intercom

There is a private automatic branch exchange (PABX) system installed

on the estate to provide free intercommunication between individual

residences and the HOA office and the security offices at the Main Gate

and the Waterstone Gate.

Post is received centrally at the HOA office from Mondays to Fridays, then delivered to the post room which is

on Vaillant Boulevard, next to the Children’s Play Park. The post room contains a lockable post box for each erf

and the application procedure is similar to the SA Post Office box system. New homeowners, or tenants with a

letter of approval from the owner of the erf, should apply to the HOA for a post box key using the prescribed form

Application for Post Box Key. “You have to pay a deposit of R200.00 and only one post box will be issued per erf.

Should the post box key be lost, a replacement / administration fee will be charged.”

Use of Private Property

The Schonenberg lifestyle estate has attracted a diverse mix of investors: from the buy a plot of land to

build-my-own-home to the discerning purchaser of a completed property to the buy-to-let investor.

Exclusively Residential

No homeowner or tenant may, without the prior written consent of the trustees, use the erf for any other

purpose than residential, save for those erven designated for commercial or business use. Furthermore, no

advertising is allowed except that which has been approved for commercial use.

Rental Restrictions

Owners wishing to let residential homes on their erven need to obtain the prior written consent of the

trustees. No letting for shorter than a 6 (six) month period is allowed and the owner is obliged to notify

the trustees of any short-term occupancy for security purposes. The trustees shall be advised prior to any

proposed tenant taking occupation of an erf, and the tenant shall pre-sign a copy of the Conduct Rules

as provided for in the constitution.Tenants are obliged to comply with this constitution notwithstanding any

provision to the contrary contained in any lease or any grant of rights of occupancy.

Design Review CommitteeTo ensure the estate’s aesthetic, the Design Review Committee must approve all

structural, decorative or other alterations and additions on the site.

Do Obtain written consent of the trustees prior to installing:

any locking / safety device; canopy / screen to prevent

entry of animals, insects, etc; or any outside TV aerial / satellite dish.

Ensure any broken window pane is replaced within 3 days of breaking.

Maintain the garden, fencing and verges on your erf.

Don’t Erect any washing lines or hang washing / other items on any part of the premises

so as to be visible from outside or offensive in any manner.

Put up improvements that cause a nuisance or annoyance to any homeowner /

tenant and surrounding neighbours.

Put up curtains or blinds that are not aesthetically acceptable.

Place or do anything on the balcony, stoep or patio which is aesthetically displeasing

or undesirable when viewed from outside.

Use of Common PropertyThe common property, which amounts to about 60 ha of landscaped environment comprised of

the entrances, parks, street gardens, wetlands, including the demarcated conservation area, and

5 km of walking paths, is reserved for homeowners, tenants, and their respective families, guests

or visitors, who should be accompanied by their hosts at all times.

Operating hours: all week from 05:00 to 21:30

Any usage after these hours, without approval of the trustee committee, shall be regarded as a

violation of the Conduct Rules

DoEnjoy footpaths laid out across the estate to allow residents the opportunity to

relax and experience the wonders of nature.

Walk / run / jog or cycle - pedestrians have right of way.

Play games on designated communal areas, such as the Children’s Play Park.

Take your dog for walks – on a leash at all times and clean up after your animal.

Book a park area to hold a function, such as a child’s birthday party. Apply for

permission in advance from the HOA, detailing time, date, number of people,

and parking arrangements.

Donate a bench alongside your favourite walkway (with trustees’ approval).

Don’t Erect, store, leave or allow any article or thing to be erected, etc.

Leave vehicles unattended - ensure that those vehicles do not drip oil or

brake fluid and/or any other fluid or liquid.

Dismantle or affect major repairs to any vehicle.

Wash vehicles owned by residents.

Abandon bicycles, motor cycles, tricycles, roller skates, skateboards, etc.

Remove any shrub, tree or plant.

Place or do anything which is unsafe, aesthetically displeasing or undesirable, i.e.,

utilise glass bottles or containers, braai, or play loud music.

Build a fire of any sort for whatever purpose.

Deposit, throw, permit or allow any rubbish, including dust, food, scraps, cigarette

butts or any other litter to be deposited, etc.

Use any common property which has been declared ‘out of bounds’ by the trustees.

General behaviour All residents shall ensure that their use of private property and the common property shall not cause a nuisance,

disturbance, inconvenience or annoyance, and / or detrimentally affect the rights and interests of other residents.

Residents shall be responsible for the behaviour of their family, tenants, guests, visitors, employees, contractors,

contractors’ subcontractors and delivery persons and shall be liable for any damage caused by them. Any damage

caused by such persons shall be properly repaired at the cost of the homeowner or tenant concerned, within 14 days

of written notice by the trustees.

Environmental Management

The HOA is committed to enhance and sustain the landscaped areas and natural ecosystems on the estate and to work on effective solutions to manage, protect and control them safely. The aim is environmental sustainability, meaning maintaining the environment in a responsible way to keep it healthy for future generations.

Legislation-compliantThe HOA has to comply with the Operational Environmental Management Plan (OEMP), which is a condition of approval by the City of Cape Town’s Department of Environmental Affairs and Development Planning (DEA&DP). It is a constitutional and legal obligation to adhere to the specifications of the OEMP and the estate is audited annually. Conservation AreaEven before building started, 3 hectares of land were demarcated as the focal feature of the wetland areas. ‘The Seep’, as it is called, was awarded conservation status and is recognised as an environmentally-sensitive area by the Environmental Management Department. Read about the Seep Conservation Management Plan.LandscapingGuidelines were developed for the estate and the HOA has to ensure that the landscaping of the common property is implemented as per the original plan and maintained. It is also the responsibility of individual homeowners to ensure that their private properties are appropriately landscaped and responsibly maintained. Planting of water-wise and indigenous plants is encouraged while invasive alien plants are prohibited – specifically in the area around ‘The Seep’. USE OF VEHICLES AND TRAFFIC CONTROL “When driving on the estate, residents, tenants and their visitors shall be fully

licensed and observe all the rules of the road. All drivers are expected to be civil and

courteous and hooters shall only be sounded in emergencies.Give pedestrians right

of way and watch out for wildlife.”

Speeding & signageThere are well-signposted speed

limits throughout the Estate,

which are rigorously enforced

for everybody’s safety,

especially children.

There is a maximum speed limit

of 40 km/h (forty kilometres per hour)

and lower speed limits of 30 km/h

and 20 km/h are imposed where

deemed necessary. The HOA has

also introduced traffic calming

measures, such as speed-humps

and pedestrian crossings, and

speed measuring controls are

conducted on a regular basis.

PARKING RULESNo homeowner or tenant shall park or stand any vehicle upon Common Property

or another resident’s erf or permit / allow this to be done without the prior written

consent of the trustees and the owner of the erf.

Vehicles may only be parked on such areas of the estate that are specifically

designated or approved by the trustees and in such a way that the flow of traffic

and driveway access is not obstructed.

No parking in front of the fire hydrants is permitted.

No trucks, caravans, trailers, boats or other heavy vehicles may be parked within the

estate without the prior written consent of the trustees.

Only visitors’ vehicles may be parked on the specifically demarcated visitor parking

areas.

Only HOA staff and short-term visitors may park in the bays in front of the HOA

office.

Any breach of these parking rules will entitle the trustees to have the offending

vehicle removed, towed away or have its wheels clamped at the risk and expense of

the owner.

Disclaimer: Vehicles entering the estate and being driven or parked in the estate shall be at the

owner’s risk and responsibility from the time the vehicle enters the estate and no liability shall

attach to the trustees, the HOA or its agents or any of their employees for any loss or damage

of whatever nature which the owner, or any person claiming through or under him, may suffer in

consequence of his vehicle having entered, being driven or parked on the estate.

No animals, reptiles, birds (other than a bird in a cage) shall

be kept in an outbuilding unless expressly authorised in

writing by the trustee committee. Should any prescribed

condition be breached, the trustees may immediately

withdraw such authority.

Homeowners and tenants shall comply with the City of Cape

Town Animal By-law, 2010, subject to the trustee committee

making any ruling they deem necessary in relation to any

domestic pet as provided for in the Constitution and/or the

Conduct Rules.

The owner of any pet that causes a repeated nuisance,

disturbance, inconvenience or annoyance to another

resident, particularly in the form of barking or meowing, may

be required to remove such pet from the estate on receipt

of a written notice from the trustees. Unidentified stray

animals will be removed from the estate.

Tips from your pet-friendly HOA:

Walk your dog on a leash, and ensure that your

animal does not foul on any part of the common

property or otherwise cause any nuisance. Dog

owners will be responsible for cleaning up their

dog’s excrement and are also responsible for any

damages caused by their animal.

If a pet is being offensive, the offended party should

first discuss the issue with the pet owner and

request corrective action. If the condition persists,

you should submit a written complaint to the HOA

explaining the offense, time and place.

Pests Homeowners and tenants shall keep their properties free of rodents, white

ants, borer, and other wood-destroying insects, and to this end shall permit the

trustees, the managing agent and their duly authorised agents or employees, to

enter any erf from time to time for the purpose of inspecting improvements and

taking such action as may be reasonably necessary to eradicate any such pests.

The costs of inspection, eradicating any such pests as may be found within

improvements or replacement of any woodwork or other material as may be

damaged by any such pests, shall be borne by the homeowner and/ or tenant.

SAFETY AND SECURITY

Security and safety are paramount to the HOA and the estate manager is

ultimately responsible for upholding security on the estate. To assist him, a security

company is employed to carry out all the usual functions to make Schonenberg

a safe environment.

Security features include:

walls | CCTV cameras throughout the Estate

Every person requires official authorization to enter and move around the estate.

This not only applies to homeowners, tenants and their dependants but also to

all categories of guests, visitors and employees. Residents must comply with the

rules for entry and exit to the estate and be responsible for their visitors.

ACCESS MANAGEMENT There are only 2 access / exit gates into and out of the estate for both vehicles

and pedestrians and both are manned by the security company. Booms are

installed in the vehicle approach and there are turnstiles and a swing gate for

pedestrian access.

CCTV cameras are installed at selected positions along the fencing and at both

access / exit gates to monitor incoming and outgoing vehicle and pedestrian

traffic. This electric equipment is monitored 24 hours a day at the security control

building.

All residents – homeowners, tenants and individual family members - have to be

registered with the HOA to receive their own access disk (commonly known as a

‘tag’) and / or use their own biometric fingerprint, which will operate the access /

exit booms and pedestrian turnstiles at both gates.

VISITOR MANAGEMENT SYSTEM (VMS) The HOA uses the GLOvent App as the main source of communication and

management for its Visitor Management System (VMS). The GLOvent App is free

to all residents with smartphones, but please note that it is only available for IOS

(App store) and Android (Play Store). For those residents who cannot or do not

want to use the App, the alternative sms system can be used.

If you need help to download the App, call the HOA 021 855 4537 / PABX 9.

Residents will be notified when the GLOvent App is updated and the new

upgrade should be downloaded. All non-residents: guests, visitors, employees,

contractors, subcontractors, service providers and delivery persons, must have

security clearance to access the estate. They need to request pre-clearance or

gain security clearance authorization at the gate from the homeowner or tenant

they wish to visit.

For instructions on how to request a pre-clearance code for your visitor go to

either Pre-clearance via GLOvent App or Pre-clearance via sms.

At Main Gate and Waterstone Gate, pre-cleared visitors are quickly allowed access

whereas visitors without security clearance are expected to park at the side and

contact the resident to get the clearance code or ask the security officer to

contact the resident on their behalf. The code (5-digit pin number) is valid for one

entry and one exit only. However, once a visitor is registered on your smartphone

/ mobile phone you may nominate them as regular visitor for one year.

Contractors and subcontractors must gain pre-clearance from residents and all

their passengers have to be registered with their IDs to pass through the security

turnstiles.

All contractors, subcontractors, service providers - domestic workers and

gardeners, and contractors’ individual employees need to complete the

Registration / Access Control Form Sections 3 C, D.

VISITOR MANAGEMENT SYSTEM (VMS) There are security clearance guidelines at the two gates by way of signage on

overhead notice boards and on the street surface. It is important that directions

should be strictly followed and the directives given by the security officers obeyed.

Please note:

Visitors, contractors and employees that refuse given directives, use abusive

language and delay operations at the gates to proceed normally, may be refused

entry and will have to re-apply for entry in future.

Only in exceptional circumstances such as in emergencies, or when visitors do

not have the resident’s contact details, may the security officer intervene to gain

temporary permission for entry.

Under no circumstances will access be given without evidence that the resident

has been contacted for permission and such permission has been obtained.

Pedestrians will be expected to get pre-clearance / clearance from the resident

or driver and produce an identification card (ID) before access is allowed.

Passengers with pre-cleared contractors / sub-contractors will be expected to

get pre-clearance / clearance from the resident or driver and produce an ID before

access is allowed. All visitors and their passengers / employees must keep to the

stipulated conditions of access. Final discretion to allow or deny access remains

with the security officer on duty in consultation with the HOA management.

VISITOR MANAGEMENT SYSTEM (VMS) General guidelines:No access will be granted to empty erfs.

No deliveries will be accepted at the gates.

Only original documents or clear certified copies will be accepted as proof of

identity.

Any vehicle may be stopped for physical inspection before being allowed in or out

of the estate.

If biometrics and / or an access disc (tag) is not working, no access is allowed until

the reason for the non-functioning has been determined and / or procedures to

obtain a valid access have been completed .

A resident who arrives at the gate without an access disc (tag) or a disc that has

been deactivated must (1) be verified against the owners’ list, and (2) be sent to

the Access Control Administrator at Waterstone Gate to re-activate the tag.

A visitor that arrives at the exit without security clearance will not be allowed

out without confirmation and authorization of the resident visited (the visitor has

not been officially allowed in!).

Show houses are only allowed when the HOA has been informed 24 hours in

advance and security clearance procedures have been arranged. The agent must

meet the prospective client outside the estate, escort them in as a passenger,

and take full responsibility for them viewing the house. (Agents aren’t allowed to

use a homeowner’s tag. If found using a tag, it will be confiscated.)

Fire & Emergencies

All cases of emergency, including, but not only, fire, criminal entry, and civilian disturbances, should be reported to the security control room, where the staff is trained to deal with the situation 24 hours a day, 7 days a week. An armed response vehicle, permanently stationed on site, is equipped with a hose and a fire hydrant coupling.

Please note: In a domestic emergency situation, e.g., a burst pipe, an electrical issue,

etc., contractors are allowed access to a resident’s property after hours.

Insurance The HOA shall have no responsibility whatsoever for the insurance of the contents of or improvement on any

particular erf, which shall at all times be the sole responsibility of the homeowner and tenant in question.

A homeowner or tenant shall not do or permit to be done on his erf or on the common property anything which will

or may increase the rate of premium payable by the trustees on any insurance policy or which may tend to vitiate

any such insurance policy nor bring onto the estate, premises or building any hazardous substances and/or any

form of machinery whatsoever.

A homeowner or tenant shall not store or harbour upon the common property or any part thereof or on his erf any

goods which may vitiate any fire insurance policy held by the trustee committee or increase the premium payable

in respect of such policy.

GENERAL DISCLAIMER

The trustee committee or its agents shall not be liable for any injury, loss or damage of any description which any

homeowner or tenant of property or any family member, employee, relative, friend, acquaintance, visitor, invitee

or guest may sustain, physically or to his or their property, directly or indirectly, in or about the common property

or in the individual property by reason of any defect in the communal area, its amenities or for any act done or for

any neglect on the part of the trustees or any of the HOA’s employees, servants, agents or contractors.

The trustee committee or its representatives and servants shall not be liable or responsible in any manner

whatsoever for the receipt or the non-receipt and delivery or non-delivery of goods, postal matter or any other

property.

No fireworks, firearms, bow and arrows or pellet guns may be discharged in the estate.

A homeowner shall not use or permit his home to be used for any purpose which is detrimental to the reputation

of the estate.

All complaints, violation of the conduct rules, or any other cause of concern must be in written form, addressed to

the chairperson of the Home Owners’ Association.
