NGB 23 (RPAM)
• 20-Year letters are generated after close of Soldiers AYE and will issued the following month.
• The original 20-year letter is mailed to the soldiers Home ofRecord.
• A copy is scanned and placed in IPERMS.
• SPB is automatic. However, Soldier has 90 days after 20 year letter generated to decline coverage.

Retirement Documents
The National Defense Authorization Act for 2008 amended 10 USC § 12731, reducing the eligibility age for Reserve retirement pay
A way to show appreciation for Reserve Component sevicemembers who served in certain types of tours
Reduces eligibility to receive retirement pay below age 60 Retirement pay may not be reduced below age 50 NOTE: Reserve retiree healthcare and other retirement
benefits remain at age 60, regardless of eligibility age for Reserve retirement pay
The law does not provide credit for time served before 29 Jan 2008

Reduced Retirement Age
Eligible for retirement (received Notice of Eligibility for Retired Pay).
Eligible active duty service (as a member of the Ready Reserve) was on/after 29 January 2008.
Eligibility will be reduced below age 60 by 3 months for each cumulative total of 90 eligible days of active duty service per calendar year.

**If you were deployed overseas or on orders in support of the Global War on Terrorism since 2008, you most likely qualify for reduced retirement.
Reduced Retirement Age(How to Qualify)
▪ Individual mobilization orders ▪ DD 214▪ Documents must be submitted through chain of command to
G-1 (RPAM section) in order to request reduced retirement update on the NGB 23B (RPAM Statement)
▪ Requests accepted for Soldiers with at least 18 years of service, over the age of 58, or considering retirement within the next 12 months
▪ Periods of qualifying years reduced will be shown on the NGB 23B (RPAM Statement) as RPED

15 Year NOE
• Soldiers with at least 15 years of qualifying service who are found unfit for continued military service due to a physical disability, not through misconduct, may be issued this written notice of eligibility for non-regular retirement.
▪ A 15yr letter is authorized when a Soldier is solely found unfit for duty due to a physical disability. Other administrative reasons for separation cannot be combined with physical disability retirements i.e. MRD and Unfit for duty
• This NOE will not be issued automatically but on a case by case basis as a Soldier meets all the qualifications above.
• This memorandum will be required at the time of application for retired pay.13
Medical Retention Determination Point (MDRP)- Soldiers are identified with medical conditions or physical defects that fall below medical retentions standards IAW AR 40-501, Chapter 3.
Physical Evaluation Board (PEB)- Determines if Solder is deemed fit or unfit for duty.
Medical Evaluation board (MEB)-Required if there is a military-related injury.

Promotion when placed on the Disability Retired List▪ Per the provisions of 10 USC § 1372, Soldiers on a promotion list at the
time of retirement disability will be retired for disability at the promotion list grade. Further, the Soldier will be promoted to the designated grade effective the day before placement on the retired list.
▪ Per the provisions of the 10 USC § 1212, Soldiers who are on a promotion list at the time of separation for disability with entitlement to disability severance pay will be paid such compensation at the promotion list grade. Further, the Soldier will be promoted to the designated grade effective the Soldiers separation date.

Disability Separationor Retirement Process
▪ Congress established CRSC in 2002, and it became effective June 1, 2003, so Veterans may receive retired pay for combat-related injuries.
▪ In January 2008, CRSC was extended to those with less than 20 years of service under Section 641 of the National Defense Authorization Act.
▪ If a retiree has a combat-related injury, is on the Temporary Disability Retired List (TDRL) or Permanent Disability Retired list (PDRL), and has received a VA rating of 10% or more, then they may be eligible for CRSC.

Combat-RelatedSpecial Compensation (CRSC)
Concurrent Retired and Disability Pay (CRDP) allows military retired Soldiers with a VA disability of 50% or greater to receive both retired pay and VA compensation. Title 10 USC 1414 DODFMR Volume 7B, Chapter 64
Reserve Soldiers with a 20 year NOE and a disability retirement can send their NOE and NGB 23 (RPAS) to DFAS when they reach age 60 to begin receiving entitlement. Retired pay will be recalculated at the non-regular rate.

Retired ID Card
• Retired pay is not automatic. Retired pay application must be submitted prior to reaching eligibility age (60th birthday or reduce retirement age).
• Application for retired pay should be completed and sent to the Human Resource Command, Fort Knox no earlier than one year and no later than 90 days prior to the date retired pay is to start.
• Soldiers are responsible for submitting their retirement application.
• The State RSO can assist Soldiers with submitting the retired pay application to HRC (Human Resource Command)

Is there a Statute of Limitations on Retired Pay? Reference: 31 USC 3702
Yes! There is a 6 year statute of limitations for back pay of retired pay.
• A claim must be filed within 6 years from the date of eligibility for retired pay.
• If not filed within the 6 year limitation, 1 day’s retired pay is lost for each day of delay in filing the application.
• Example: If you became eligible for retired pay on 2 July 2000 and the application for retired pay was not processed by DFAS until 2 September 2006, payment can only be made from 2 September 2000

RESERVE COMPONENT SURVIVAL BENEFIT
PLAN
RC-SBP
Reserve Component Survivor Benefit Plan (RC-SBP) gives retirement eligible Soldiers the option to leave up to 55% of their retired pay to
surviving dependents. Your election here has an effect on SBP at 60.
Your RCSBP election covers you from the time you qualify for a Reserve Retirement until you begin receiving retired pay.
Your RCSBP election (Option B or C) automatically becomes your SBPelection.
If you elected to decline RCSBP (Option A), you will have no RCSBPcoverage and must make an SBP election at your Reserve non-regular retirement.
“What is RC-SBP?”
There are 3 Options to choose from:Option A: Decline coverage (remains eligible for standard SBP coverage at age 60)Option B: Deferred Annuity, starting on what would have been the Soldier’s 60th birthday(if deceased prior to age 60) or, if 60 or over at time of death, on the day following date of death.Option C: Immediate Annuity beginning on the day following date of death regardless of age at time of death. If no option is made default is C.No Dependents at NOE: If you are not married, have no eligible children, and do not desire to elect RCSBP for a former spouse or insurable interest; you do not have an RCSBP election Option.
About Elections
• All Elections made upon receipt of Notice of Eligibility to Receive Retired Pay (“20-Yr Letter”)
• Option A: No RC-SBP coverage, with option to elect coverage when eligible to receive retired pay
• Option B: RC-SBP coverage, with deferred annuity when the RC Soldier would turn age 60
• Option C: RC-SBP coverage, with immediate annuity (default)
RC-SBP Election Options
• You have one year to notify the Human Resources Command (HRC) that you now have an eligible beneficiary and request RCSBP coverage.
• The election must be submitted on a DD Form 2656-5 because you must elect an RCSBP Option, B or C, and level of coverage.
• Failure to elect RCSBP coverage within one year of acquiring an eligible dependent will result in your RCSBP election defaulting to Option A until your Reserve non-regular retirement at which time you will have to make an SBP election.

eligibility).*Insurable Interest coverage ranges from 10-40% of gross retired pay
**Current threshold amount is $1806 as of Jan 2019Cancellation is between 24 – 36 mos mark only.
COST COMPUTATION
• Who Can Elect: Unmarried Soldiers with zero or one dependent child (but cannot elect to cover adult child)
• Eligible Beneficiaries: Relative more closely related than cousin; or business associate w/financial interest in Soldier (proof needed)
• Base Amount: Must be full retired pay• Cost: Very expensive option
• RC-SBP: same as SBP• SBP: 10% plus 5% for each full 5 yrs younger beneficiary is than
Soldier (maximum 40%)• Benefit: 55% of retired pay, less RC-SBP cost• Loss of Beneficiary: May elect new beneficiary within 180
days of current beneficiary’s death.
Insurable Interest Option
This is a JOINT decision for married Soldiers who:• Elect Option A, decline RC-SBP • Cover less than full retired pay• Elect “Child Only”• Elect Option B, deferred annuity
It is the Soldier’s election• The spouse can only concur or non concur • If spouse does not sign, coverage will be established for an immediate spouse annuity based on full retired pay
