The same applies to companies that have received the approval to keep their factory machineries in ‘warm idle’ mode. Logistics arm of manufacturers that have received MITI’s approval are also allowed to operate. For manufacturers that have been given the greenlight to operate, but are using private or individual logistics or transport services providers, they are advised to seek the approval of Ministry of Domestic Trade and Consumer Affairs. As for workers, only those listed in the companies’ applications that have been approved by MITI are permitted to continue working. Supporting documentations that are attached with the list of staff involved as well as MITI’s approval letter must be provided by the employers to their staff. This is to facilitate the workers’ movement to and fro the workplace and home. MITI also stressed that it will not accept any more application from companies after the last date of submission set, which was on 24 March 2020. The Ministry hopes Malaysia’s industry players will give their full co-operation throughout the MCO extension period and adhere to all the conditions set by the National Security Council in operating their business during the MCO. This is crucial to ensure COVID-19 spread can be contained effectively. MITI also assures that the supply chain of essential goods such as food items in the country will be sufficient throughout the MCO. MITI along with the relevant Ministries will be monitoring the supply chain particularly food and medical items, with the support of industry players. Ministry of International Trade & Industry 25 March 2020 Initiation of an Anti-Dumping Investigation Concerning Imports of Flat Rolled Products of Non-Alloy Steel from China, South Korea and Viet Nam The Government of Malaysia received a petition from NS Bluescope Malaysia Sdn. Bhd. representing the domestic industry requesting for an anti-dumping investigation to be conducted on imports of flat rolled products of non-alloy steel coated or plated with aluminium and zinc (subject merchandise) originating or imported from the People’s Republic of China (China), Republic of Korea (Korea), and Socialist Republic of Viet Nam (Viet Nam). The Petitioner alleged that imports of these subject merchandises originating or imported from China, Korea and Viet Nam are being dumped into Malaysia at a price much lower than their selling price in the domestic market of the alleged countries and that this is causing material injury to the domestic industry in Malaysia. The Petitioner claimed that the dumped imports from the alleged countries have increased in terms of absolute quantity and have caused material injury to the domestic industry. The Government has evaluated and determined that there is sufficient prima facie evidence of dumping, injury and causal link and decided to initiate an anti-dumping investigation on imports of flat rolled products of non-alloy steel coated or plated with aluminium and zinc from the alleged countries. In accordance with the Countervailing and Anti-Dumping Duties Act 1993 and its related Regulations, a preliminary determination will be made within 120 days from the date of initiation. If the preliminary determination is affirmative, the Government will impose a provisional anti-dumping duty at the rate that is necessary to prevent further injury to the domestic industry.

Companies with MITI’s Approval Letter May Continue to Operate During Extended Movement Control Order

Following the announcement by Prime Minister YAB Tan Sri Muhyiddin Yassin on the extension of Movement Control Order (MCO) in Malaysia, Ministry of International Trade & Industry (MITI) wishes to inform the companies producing essential goods that the approval they have obtained from MITI will remain valid throughout the two-week extension, until 14 April 2020. The same applies to companies that have received the approval to keep their factory machineries in ‘warm idle’ mode.

Initiation of an Anti-Dumping Investigation Concerning Importsof Flat Rolled Products of Non-Alloy Steel from China, South

Korea and Viet NamThe Government of Malaysia received a petition from NS Bluescope Malaysia Sdn. Bhd. representing the domestic industry requesting for an anti-dumping investigation to be conducted on imports of flat rolled products of non-alloy steel coated or plated with aluminium and zinc (subject merchandise) originating or imported from the People’s Republic of China (China), Republic of Korea (Korea), and Socialist Republic of Viet Nam (Viet Nam).

The Petitioner alleged that imports of these subject merchandises originating or imported from China, Korea and Viet Nam are being dumped into Malaysia at a price much lower than their selling price in the domestic market of the alleged countries and that this is causing material injury to the domestic industry in Malaysia.

MITI Introduces Alternative Way to Facilitate the Endorsement of Certificate of Origin for Companies During the Movement

Control Order (MCO)Ministry of International Trade and Industry (MITI) announced that it will be introducing an alternative way for Malaysian companies to seek endorsement of the Certificate of Origin (CO) under the Free Trade Agreement (FTA) schemes (other than ASEAN Trade in Goods Agreement (ATIGA)) that will take effect from 30 March to 14 April 2020.

This came following the temporary closure of MITI Services Counter at Menara MITI as well as at its state offices during the Movement Control Order (MCO).

The measure is important to ensure all import and export activities with FTA partner countries and Generalised System of Preferences (GSP) donor countries can be continued.

CO Endorsement for other FTA and GSP schemes

In compliance with the MCO, the CO endorsement services will be done through back-office at Menara MITI and its State offices, except for MITI Malacca which will remain close. In connection with this investigation, Ministry of International Trade and Industry (MITI) will provide a set of questionnaires to interested parties (importers, foreign producers, exporters and associations). Other interested parties may request for the questionnaires in writing to MITI no later than 3 April 2020. Interested parties may also provide additional supporting evidence to MITI before 17 April 2020 to support this investigation. In the event no additional information is received within the specified period, the Government will make its preliminary findings based on the available facts. CO Endorsement for ATIGA

In addition, MITI emphasised that effective 18 March 2020, it has enforced the utilisation of ATIGA e-Form D for Normal, Back-to-Back and Third Country Invoicing application. This means, no manual endorsement of Certificate of Origin will be done for ATIGA Form D. For more details companies can email to [email protected].

Status Permohonan Kilang untuk Meneruskan BeroperasiSewaktu Tempoh Perintah Kawalan Pergerakan (PKP)

(Setakat 30 Mac 2020, 5 petang)Kementerian Perdagangan Antarabangsa & Industri (MITI) mengesahkan telah menerima sebanyak 11,827 permohonan daripada syarikat-syarikat pelbagai sektor pembuatan untuk meneruskan operasi sewaktu tempoh Perintah Kawalan Pergerakan (PKP). Sehingga jam 5 petang, 30 Mac 2020 daripada jumlah tersebut, 4,111syarikat atau 34.76 peratus telah dibenarkan untuk beroperasi, manakala 3,495 permohonan (29.55 peratus) telah ditolak. Manakala 2,333 (19.73 peratus) adalah di dalam senarai Keep In View (KIV), 38 syarikat (0.32 peratus) dalam senarai utama dan selebihnya (1,850, 15.64 peratus) masih di dalam proses saringan.

Selain itu, MITI ingin menjelaskan kebenaran untuk beroperasi perlu diberi kepada syarikat-syarikat tertentu bagi memastikan bekalan produk penting dan kritikal akan mencukupi untuk kegunaan orang ramai sepanjang tempoh PKP. Kebenaran yang diberikan ini juga adalah sah sehingga 14 April 2020.Antara sektor-sektor pembuatan dan pengeluaran barang-barang keperluan umum yang dikategorikan penting dan kritikal adalah seperti berikut :

• Makanan dan minuman;• Produk barangan rumah (termasuk hand sanitiser);• Peralatan perlindungan peribadi (termasuk topeng muka);• Farmaseutikal;• Bahan pembungkusan dan percetakan, khususnya untuk industri pemakanan dan minuman;• Peranti perubatan, dan pembedahan; dan• Minyak dan gas.

Bagi syarikat-syarikat yang tidak diluluskan pula, antara punca-punca permohonan-permohonan mereka ditolak adalah kerana kebanyakan syarikat tidak mematuhi syarat-syarat yang ditetapkan antaranya termasuklah syarikat yang memohon bukan di dalam sektor yang penting & kritikal; syarikat mengemukakan maklumat yang tidak lengkap atau tidak tepat; dan syarikat tidak mengemukakan pengurangan jumlah tenaga kerja ke tahap minima ataupun sekurang-kurangnya 50 peratus seperti yang ditetapkan Majlis Keselamatan Negara.

MITI ingin mengingatkan syarikat-syarikat yang telah mendapat kelulusan untuk mengikut syarat-syarat yang ditetapkan Kerajaan, antaranya memastikan hanya jumlah pekerja dan senarai pekerja yang diluluskan MITI sahaja datang bekerja; menyediakan saringan suhu badan setiap hari, menyediakan sanitasi tangan dan topeng muka untuk pekerja, memastikan premis disanitasi tiga kali sehari, mengamalkan social distancing dan jika ada pekerja yang dijangkiti COVID-19 majikan perlu segera memaklumkan Pejabat Kesihatan atau Hospital Kerajaan yang terdekat.

Senarai nama syarikat-syarikat yang diberi kelulusan telah pun diberikan MITI kepada pihak Polis Diraja Malaysia dan Kementerian Dalam Negeri untuk pemeriksaan dan pemantauan. Kegagalan syarikat mengikut syarat-syarat yang ditetapkan boleh menyebabkan kelulusan mereka dibatalkan dan ditarik balik.
