• sanctions may involve loss of liberty so the burden of proof is “beyond reasonable doubt”• HSW Act enforced by HSE or local

Civil law
• the plaintiff sues the defendant to address a civil wrong or tort
• the court is concerned with liability rather than guilt, the burden of proof is the “balance of probability”
• sanction is generally compensation, maybe costs
