FUNDING OPPORTUNITY DESCRIPTION

The Utah Department of Health (UDOH) is soliciting applications for the Tobacco Prevention and Control Program (TPCP) Disparity Network to contract with qualified agencies that have the capacity to expand tobacco prevention and control to priority populations throughout the state of Utah.

This funding announcement instructs applicants on how to apply for Grant years 2020-2025 funding.

Applicant Eligibility: Organizations that meet the following criteria are eligible to apply for this grant.

1. Work in partnership with TPCP to maintain or develop a commercial tobacco-free workplace within the first year of this grant.

2. Not currently accepting revenues from the tobacco industry;3. Non-profit Community-Based Organizations (CBOs) serving communities in

Utah;4. Eligible applicants shall be Utah based non-profit 501(c)(3) community-based

organizations (CBO) or faith-based organizations (FBO). An applicant shall be in good standing with the State of Utah on the date of the application submission.

a. Good standing is defined as, but not limited to, resolution of State of Utah audit exceptions, resolution of judgments between the applicant and the State of Utah and fulfillment of all grant obligations by the applicant with the State of Utah.

5. Able to demonstrate broad community partnerships throughout Utah and have the ability to engage the community based on the goals of this grant.

6. Able to provide services outlined in the scope of work according to the timeline outlined in this grant;

7. Demonstrate a long-term commitment to normalizing health-seeking behavior while integrating your identified community’s needs, and thinking holistically about how tobacco affects your community.

8. Demonstrate meaningful community participation in past or current organizational activities.

Funding Purpose: Utah Department of Health and the Utah Tobacco Prevention and Control Program (TPCP) wish to continue to reduce tobacco-related disparities by seeking applications to fund. Four grants will be awarded.

Target Population: Organizations that represent communities who are targeted by the tobacco industry and/or have high tobacco use rates and/or are at high risk of tobacco use are eligible to apply for this grant.

The grant will be awarded to organizations that represent the following communities:

• Racial or ethnic populations

• LGBTQ• Low Income and/or Low Education• Mental Health or Substance Use Populations• Homeless• Refugee• Rural• Mentally or Physically Disabled• Incarcerated

Priority will be given to grass-roots community-based organizations that can demonstrate the capacity to mobilize, organize, and reach their communities statewide.

Two organizations are welcome to apply together to improve their ability to reach their population.

Background: Utah’s smoking rate has seen significant declines in recent years. In 2017, our adult and youth tobacco use rates remained the lowest in the nation at 9% and 3.8%. The prevalence of tobacco use varies significantly among different population groups. Socio-demographic characteristics such as race, ethnicity, geographic location, income, and education level, gender, and sexual orientation correlate with persistent health disparities (refer to tobacco use data in Appendix A: and www.tobaccofreeutah.org annual reports). In this Grant “disparities” refers to the gaps that exist between specific populations in terms of tobacco use, including e-cigarettes, tobacco industry marketing, health effects and access to culturally and linguistically appropriate cessation services. Utah’s Ethnic Networks for Tobacco Prevention and Health were created in 2004 in response to the goals and objectives outlined in TPCP’s Strategic Plan. At the time, based on population size, prevalence and risk rates, and other criteria, the African American, Pacific Islander, Native American, and Hispanic/Latino populations were chosen to represent Utah’s Ethnic Networks. In 2010, the TPCP announced that the former Ethnic Network structure would be replaced by the Tobacco Control Disparity Networks, adding a fifth network to serve LGBTQ communities. Since 2004, the Ethnic Networks and Disparity Networks have expanded tobacco prevention and control efforts by mobilizing communities and extending impact and outreach to their populations. Over the past 15 years, the Tobacco Disparity Networks have enhanced the utilization, innovation and cultural and linguistic competency of TPCP programs, resources, and services. The Networks have improved participation in tobacco prevention and cessation efforts by underserved populations and have proven to be an invaluable addition to the TPCP Program. This grant opportunity will continue the TPCP Disparity Network and the valuable input they bring concerning their population.

Review and Award Process: Grants will be awarded on a competitive basis. However, the Utah Department of Health reserves the right not to fund a network if there are no quality applications with a score of 60 or more points or there are any missing required attachments. The target population and the need for tobacco resources in that population must be clearly identified. Applicants may be competing with other applicants addressing the same population group.

This RGA is designed to provide applicants with sufficient information to submit applications that meet minimum requirements but is not intended to limit a proposal’s content or exclude any relevant or essential data.

Funding will be awarded based on the need of the area, the strength of the application, and ability of the potential sub-awardee to implement and sustain an evidence-based program model with the proposed target population. The Utah Department of Health (UDOH) will establish a panel of experts who will review the proposals submitted by each applicant agency. Reviewers will provide an overall impact/priority score to reflect their assessment of each application. Grant scoring criteria can be found in Appendix G of this document.

APPLICATION INSTRUCTIONS

Applicants must complete each of the sections in the Application Packet (Pages 8-21) to be considered for a funding award. All portions of the Application Packet should be submitted as one document in Microsoft Word or Adobe PDF file formats. Completed packets should be submitted via email to Frances Favela at [email protected] by Friday, November 1, 2019, by 11:59 pm. Any applications submitted after November 1st are disqualified for review.

Q&A Sessions: Two informational calls will be held for potential grant applicants. These sessions will give applicants an opportunity to learn more about the grant, TPCP, ask questions, and receive necessary guidance. Conference call information will be provided to applicants once they have RSVP’d to Frances Favela by October 7, 2019. The dates for Q&A calls are as follows:

October 8, 2019: 10 AM – 11 AMOctober 10, 2019: 3 AM -4 PM

Standard Contract Terms and Conditions: Grants resulting from this RGA will include, but not limited to: the Utah Department of Health General Grant Provisions. All applications submitted become the property of the State of Utah and shall not be returned to the applicant. The application may be reviewed by anyone designated by the State of Utah.

Additional conditions include:A. Use of FundsFunds received under this part directly or indirectly, may not be used to:

1. To engage in any lobbying or political activity, including the support of, or opposition to, candidates, ballot questions, referenda, or similar activities.

2. To engage in litigation with any tobacco manufacturer, retailer, or distributor, except to enforce:Provisions of the Master Settlement AgreementTitle 26, Chapter 38, Utah Clean Air ActTitle 26, Chapter 62, EnforcementTitle 77, Chapter 39, Sale of Tobacco and Alcohol to Under aged Persons.

3. To provide Nicotine Replacement Therapies to youth.

4. To provide electronic cigarettes in any form.

5. To conduct hypnosis, relaxation, biofeedback, aversion, or other homeopathic cessation therapies in the absence of other proven effective behavioral counseling strategies.

6. As a substitute for tobacco industry sponsorship of event or organizations.

Cost Reimbursement: This grant uses the cost reimbursement, payment model. This model is a Grantee being paid for all of its allowed expenses to a set annual limit. The Grantee will be paid for activities performed as defined in the grant. The grant will identify a maximum annual dollar amount for which to provide services.

SCOPE OF WORKThis grant is to expand tobacco resources and technical assistance to the priority communities that are outlined in this grant. TPCP will rely on your organization to be advocates for your community, help the TPCP understand the community’s needs, and how the Tobacco Program can supplement the current programing with tobacco-related technical assistance in order to help the community reach their goals.The purpose of the Grantee is to mobilize communities so tobacco-related policy and resources are available to all Utahans especially those populations targeted by the tobacco industry. The awarded agency will be responsible for establishing and or maintaining a Disparity Network, conducting a needs assessment and participating in education, advocacy, and tobacco-related policy efforts that benefit disparately affected populations. The Grantee will have the assistance of the TPCP program to holistically

address tobacco-related issues, demonstrate how tobacco increases the risk for other health problems and chronic diseases affecting their community.Over the five year grant period, the Grantee will implement a method for distributing tobacco-related information to their community (if not already in place), provide support and technical assistance to the TPCP and TPCP partners on tobacco-related issues unique to their population. The Grantee will also provide the TPCP with feedback on activities, interventions or data collection to ensure cultural and linguistic appropriateness. Technical assistance by TPCP and the Disparity Network Coordinator will be readily available to help agencies reach these goals.

APPENDIX B:RESPONSIBILITIES OF GRANT FUNDING RECIPIENTS

A. Reports1. Monthly InvoicesGrantees will be required to submit monthly itemized invoices by the 10 th of the month, to Frances Favela at [email protected]. All billings and fees are subject to approval and audit by the State.

2. Monthly Progress ReportsGrantees will be required to submit monthly progress reports via email to [email protected] by the 10th of each month. Progress will be reviewed and payment will be issued based upon progress toward completing activities proposed in the action plan.

Grantees will be required to submit an End of the Year Report that describes successes in reaching activities outlined in the action plan or barriers for not reaching activities.

B. Training RequirementsGrantees will be required to attend a minimum of four trainings each year sponsored by the TPCP during the contract period. If one of your staff is unable to attend the entire meeting, please let the Network coordinator know 24 hours in advance.

C. EvaluationGrantees will be required to participate in or lead data collection efforts within their community with the help of the TPCP team if the data is not already available.

D. Meeting RequirementsGrantees will be required to participate in meetings with the TPCP and other funded Networks in person or via conference call. A meeting schedule will be agreed upon by each of the funded Networks and the TPCP. Grantees will be required to participate in quarterly meetings with the other funded Networks. Grantees will be recruited to be involved in Tobacco Program committees, workgroups and Utah Tobacco-Free Alliance (UTFA) to provide important input regarding their population. If one of your staff is unable to attend the entire meeting, please let the Network coordinator know 24 hours in advance.

E. Site VisitsGrantees will be required to participate in a minimum of two site visits annually. Site visits provide an opportunity for the TPCP to review grant requirements, provide progress report feedback, participate in Grantee meetings and attend community events. Site visits provide the TPCP an opportunity to get an accurate picture of grant activities.

F. Grantee RequirementsThe projected start date for the contract is July 1, 2020. The grant period is July 1, 2020, to June 30, 2025. Contract continuation depends upon satisfactory performance and availability of funding and priorities set through TPCP’s strategic planning process. The UDOH has the authority to terminate the contract at any time during the contractual period. At the termination of the grant, agencies representing the Tobacco Networks will transfer all Tobacco Network records to the UDOH TPCP.

APPENDIX C:CONTRACT REQUIREMENTS AND PROCEDURES

IncentivesIncentives billed under this grant must have a direct correlation to the action plan items under this grant. Incentives must be nominal in cost.

Best and Final OfferThe Issuing Agency may request a Best and Final Offer. This updated budget shall reflect the agencies best cost to deliver services. If the agency fails to respond to the Best and Final Offer request, the application shall not be considered for review.

Data OwnershipAll data collected in the delivery of services under this grant are the property of the State of Utah.

Confidentiality and Reporting Accurate DataAll Grantees shall maintain confidentiality at all times among staff, and volunteers, and take steps to secure the client’s personal identifiable information. Personal identifiable information is defined as but not limited to, the clients' name, home address, phone number, e-mail address, etc. Securing is defined as, but not limited to, locking client files in a file cabinet within a locked room with limited access, need to know access, encrypting electronic databases accessible by password or other identification devices with limited access or need to know access, etc.All Grantees staff and volunteers shall report data accurately. Misrepresentation of activities or data is not acceptable and subject to grant termination and disqualification from future grant application consideration.

Grant ProceduresAny interpretation, correction, or change to this Grant will be made by the TPCP through written amendment sent by the UDOH. Interpretations, corrections, or changes to this grant made in any other manner will not be binding, and community agencies shall not rely upon such interpretations, corrections, or changes.

A. Appeal of AwardAll applicants will be notified of their award status. An applicant that claims to have been adversely affected by the selection of a competing agency shall have fourteen (14) calendar days after receiving status notification to submit a written appeal to Frances Favela ([email protected]). The TPCP shall not consider an appeal submitted after the deadline.

B. Breach of Grant RequirementsIf an agency fails to comply with grant requirements, including failing to file reports in a timely fashion, using any portion of the funds for restricted activities (outlined in Utah code 51-9-203), or failing to comply with the requirements set forth in the Utah Department of Health General Grant Provisions, the agency must repay the funds

received under this funding source to the State and will be disqualified from receiving funds under this funding source in any subsequent fiscal year. See Appendix D: for Utah Code 51-9-203 for Tobacco Program Requirements.

C. Withdrawal If an applicant wishes to withdraw a submitted proposal, it must be withdrawn prior to the proposal due date. A written request to withdraw must be signed by the applicant and submitted to the TPCP on or before the due date.

D. Release of InformationNo information shall be given to any applicant (or any other individual) relative to their standing with other applicants, or the nature of their proposal, during the grant process.

E. Public InformationThe successful applicant’s proposal shall be made public information after the award of the grant. If any part of a proposal is considered a trade secret, the applicant must clearly designate that portion as confidential in order to obtain protection from disclosure. Public Records Law shall determine if the confidential information claimed to be exempt is, in fact, exempt from disclosure.

F. Cost of Proposal PreparationAll costs incurred in preparing and submitting a proposal in response to this Grant is the responsibility of the applicant and will not be reimbursed by the TPCP.

G. Grant ObligationAll applicants that submit a proposal in response to this grant understand and agree that the TPCP is not obligated thereby to enter into an agreement with any applicant and has no financial obligation to any applicant.

H. Award NegotiationThe state may accept an applicant's initial proposal by an award of a contract with or without discussion to clarify proposals that are reasonably capable of receiving an award. Discussions may explore the applicant’s understanding of requirements, qualifications, ability to perform the work successfully, and compensation. Discussions may result in non-material changes to the grant or proposals. The State may also ask for best and final offers from bidders whose proposals are reasonably capable of receiving an award or negotiate with the apparently successful applicant. During any of these processes, the content of competing proposals will not be disclosed.

1. If discussions result in a need for a material change to the grant or to proposals, the State will issue written requests for best and final offers, specifying the information to which each applicant is requested to respond. The request will specify the place, time, and date for receiving the written offers. If an applicant does not submit a notice of withdrawal or a timely best and final offer, the applicant's proposal will be considered its

best and final offer. If necessary, the State may issue a subsequent request for best and final offers. Best and final offers will then be re-evaluated.

2. The State may convene a negotiating team and negotiate with the apparently successful applicant if negotiation is in the best interest of the State. If a negotiated proposal is acceptable to both parties, a contract may be awarded. If the parties are unable to agree, the State may terminate the negotiations in writing and negotiate with the next ranked applicant.

Appendix D:UTAH CODE 51-9-203

Requirements for tobacco programs

(1) To be eligible to receive funding under this part for a tobacco prevention, reduction, cessation, or control program, an organization, whether private, governmental, or quasi-governmental, shall:(a) submit a request to the Department of Health containing the following information:

(i) for media campaigns to prevent or reduce smoking, the request shall demonstrate sound management and periodic evaluation of the campaign's relevance to the intended audience, particularly in campaigns directed toward youth, including audience awareness of the campaign and recollection of the main message;(ii) for school-based education programs to prevent and reduce youth smoking, the request shall describe how the program will be effective in preventing and reducing youth smoking;(iii) for community-based programs to prevent and reduce smoking, the request shall demonstrate that the proposed program:

(A) has a comprehensive strategy with a clear mission and goals;(B) provides for committed, caring, and professional leadership; and(C) if directed toward youth:

(I) offers youth-centered activities in youth-accessible facilities;(II) is culturally sensitive, inclusive, and diverse;(III) involves youth in the planning, delivery, and evaluation of services that affect them; and(IV) offers a positive focus that is inclusive of all youth; and

(iv) for enforcement, control, and compliance program, the request shall demonstrate that the proposed program can reasonably be expected to reduce the extent to which tobacco products are available to individuals under the age of 19;

(b) agree, by contract, to file an annual written report with the Department of Health. The report shall contain the following:(i) the amount funded;(ii) the amount expended;(iii) a description of the program or campaign and the number of adults and youth who participated;

(iv) specific elements of the program or campaign meeting the applicable criteria set forth in Subsection (1)(a); and(v) a statement concerning the success and effectiveness of the program or campaign;

(c) agree, by contract, to not use any funds received under this part directly or indirectly, to:

(i) engage in any lobbying or political activity, including the support of, or opposition to, candidates, ballot questions, referenda, or similar activities; or

(ii) engage in litigation with any tobacco manufacturer, retailer, or distributor, except to enforce:

(A) the provisions of the Master Settlement Agreement;(B) Title 26, Chapter 38, Utah Indoor Clean Air Act;(C) Title 26, Chapter 62, Part 3, Enforcement; and(D) Title 77, Chapter 39, Sale of Tobacco or Alcohol to Under Age Persons; and

(d) agree, by contract, to repay the funds provided under this part if the organization:(i) fails to file a timely report as required by Subsection (1)(b); or(ii) uses any portion of the funds in violation of Subsection (1)(c).

(2) The Department of Health shall review and evaluate the success and effectiveness of any program or campaign that receives funding pursuant to a request submitted under Subsection (1). The review and evaluation:(a) shall include a comparison of annual smoking trends;(b) may be conducted by an independent evaluator; and(c) may be paid for by funds appropriated from the account for that purpose.

(3) The Department of Health shall annually report to the Social Services Appropriations Subcommittee on the reviews conducted pursuant to Subsection (2).

(4) An organization that fails to comply with the contract requirements set forth in Subsection (1) shall:

(a) repay the state as provided in Subsection (1)(d); and(b) be disqualified from receiving funds under this part in any subsequent fiscal year.(5) The attorney general shall be responsible for recovering funds that are required to be repaid to the state under this section.

(6) Nothing in this section may be construed as applying to funds that are not appropriated under this part.

C. Work with TPCP partners to use needs assessments to develop interventions focused on advancing health equity in select high health improvement index (HII) areas.

D. Identify how to promote healthy retail outlets where retailers sell healthier food options and choose to no longer sell tobacco products. Partner with other programs at the Department of Health, local health departments, community organizations and retailers to implement this process.

E. Increase the number of tobacco-free pharmacies.

F. Collaborate with county and city offices to assure compliance with retail regulations of tobacco specialty businesses.

Objective 3: Prevent Youth and Young Adults from Starting to Smoke, Vape or Use Other Tobacco Products

Strategies:

1. Develop and enact evidence-based prevention policies that protect youth from nicotine addiction.

A. Enact an excise tax on vape and other nicotine products with part of the funding earmarked for tobacco prevention and health equity efforts.

B. Place restrictions on tobacco manufacturer, distributor and retailer rebates, discounts and coupons for tobacco products.

C. Limit the sale of flavored tobacco products to age-restricted tobacco specialty retailers.

D. Develop and enact electronic cigarette advertising restrictions across all forms of media (radio, print, billboards, TV, online, etc).

A. Ensure that all tobacco retailers obtain a permit through their local health department.

B. Coordinate and conduct tobacco compliance check(s) in all tobacco retailers statewide.

D. Coordinate and conduct tobacco retail observations with a focus on tobacco advertising, product placements, and promotions inside and outside of the store.

B. Engage partners that serve priority populations in promoting the Utah Tobacco Quit Line, Way to Quit and other cessation services. 

2. Expand the availability, access, and utilization of cessation services for priority populations.

A. Promote tobacco cessation programs for Medicaid and uninsured clients at state and local service agencies that serve priority populations, such as the Department of Workforce Services, food pantries, and subsidized housing.

B. Partner with QuitSMART Utah to connect low-income tobacco users at community health centers with tobacco cessation resources.

C. Identify, research, develop and offer cessation resources for homeless and transient populations.

D. Identify effective cessation services for people who are released from correctional facilities. Share cessation resources with correctional facilities and services that assist parolees. Partner with healthcare providers to ensure that people released from correctional facilities receive cessation services.

E. Promote the community health workers’ (CHW) specific tobacco cessation module.

Objective 5: Minimize the Negative Effects of Second-Hand Smoke and Vaping Aerosol Exposure

Strategies:

1. Enact, implement and enforce policies that reduce secondhand smoke exposure, including aerosol emitted from vaping products.

A. Assist multi-unit housing (MUH) properties in passing and enforcing comprehensive tobacco-free policies. Educate rental companies & homeowners associations (HOAs) to include tobacco-free policies within their leases/HOA regulations and promote the policies through signage.

B. Assist with developing, implementing and enforcing tobacco-free policies at homeless resource centers.

C. Assist with developing, implementing and enforcing tobacco-free policies at senior citizen living communities and their transportation vehicles.

D. Continue to work with substance abuse and mental health treatment centers to enforce tobacco-free policies and assist with cessation programs and wellness initiatives.

E. Assist outdoor venue managements including UTA, outdoor parks, state fairgrounds, state parks, youth-oriented businesses, gas stations, tourist areas in passing and enforcing comprehensive tobacco-free policies and provide signage as needed.

F. Work with government agencies to pass tobacco-free workplace policies, with a focus on agencies serving priority populations.

G. Use the "Way to Quit Certified Recognition Program" to enact tobacco-free workplace policies and share cessation resources with their staff.
