PROFILE OF CASTANG WINE SHIPPERS

Castang Wine Shippers and Merchants is an independent family business established in 1979. Currently we operate throughout South West England, together with key accounts in other areas of the country. During the past 41 years we have steadily enlarged our portfolio of wines and agencies by increasing our activities firstly throughout Europe and more recently in the new world wineries. Our range now exceeds 350 wines. The business has a wide variety of skills and experience which allows us to offer a comprehensive service together with advice to its clients.

We hope for continued expansion of our activities in the future, mainly in the field of shipping wines and wine related accessories. We enjoy a close relationship with many of the leading growers and estates throughout Europe and also with many producers in new world wineries. We will continue to increase our selections from all wine producing countries and search for exciting new wines.

The main activity of the company is the importation and supply of wines to wine merchants, hotels, restaurants, wine bars and universities together with an active private and corporate clientele list.

SPECIALITIES OF THE COMPANY

Since 1979 we have specialised in the supply of wines purchased direct from growers and producers as well as the more traditional method of purchasing through negocients. We have visited vineyards all over the world to assess the quality of wines and to check methods of vinification. Our regular contact and long term relationships with the growers helps to ensure high quality, thus avoiding badly made and dishonest wines. We would be pleased to help our clients with their plans to visit any of our suppliers. Hopefully our list represents not only genuine value for money but also provides a selection of new, interesting, and unusual wines.

Over the years we have placed much emphasis on the selection of top quality country and house wines. With so many good wine makers around the world combined with modern wine making techniques, it never ceases to amaze us how many anonymous, acidic and overpriced poor quality wines are still available on the market. CAVEAT EMPTOR !!!

SERVICES PROVIDED FOR CUSTOMERS

1. Glass hire is available to all customers subject to replacement costs for breakages.

2. With many years experience, we can offer restaurants and hotels advice on the preparation of wine lists.

3. We are also able to print restaurant customers’ wine lists and menus free of charge using the latest print technology. Wine lists can be changed as and when required from individual data base information. This will avoid inaccurate wine lists.

4. The supply of wine racks to various standard sizes together with the possibility of a made to measure service.

5. Gift packs and presentation cases are available on request for most wines. At Christmas we have a recommended selection of gift cartons ranging from single bottle to full cases.

CASTANG WINE SHIPPERS.

TERMS AND CONDITIONS OF TRADING.1. TERMS OF PAYMENTNormal terms are COD, helping us to maintain our competitive advantage. Monthly accounts (by prior arrangement with references) are to be paid by the 15th day of the month following the date of supply as specified on the statement. If payment is not made within the agreed credit period we reserve the right to charge interest at the rate of 3% above Lloyds Bank base rate per month from the date on which payment falls due until the date on which payment is actually received. Any account falling overdue will not qualify for any discount relating to the overdue amount and we reserve the right to re-impose without notice any discounts that may have been allowed if payment is not made in full by the due date. All costs including legal fees incurred by us in collection of amounts due hereunder or in enforcing repossession in Clause 4 below will be payable by the customer. We reserve the right to suspend or terminate credit facilities at any time. Cheques returned unpaid will be subject to a charge of £50.00 per presentation to cover administration.

2. NEW ACCOUNTS.Accounts may be opened for new customers on receipt of two Trade References together with a Bankers reference.

3. CLAIMS.All goods should be examined at the time of delivery and any loss or damage signed for accordingly. If examination is impractical at time of delivery, please sign delivery note and mark it “unexamined”. In any event Castang Wine Shippers must be notified of any discrepancies and/or breakages in deliveries received, not later than the day following the day of delivery.

4. TITLE OF GOODS“The risk in the goods shall pass from the seller to the buyer upon delivery of such goods to the buyer. However, notwithstanding delivery and the passing of risk in the goods, title and property in the goods, including full legal and beneficial ownership, shall not pass to the buyer until the seller has received in cash or cleared funds payment in full for all goods delivered to the buyer under this and all other contracts between the seller and the buyer for which payment of the full price of the goods thereunder has not been paid. Payment of the full price of the goods shall include the amount of any interest or other sum payable under the terms of this and all other contracts between the seller and the buyer under which the goods were delivered. Until such payment is received the buyer shall hold the goods on behalf of the seller and shall store the goods in such a way they are identifiable as the property of the seller. If the goods are sold before the seller has been paid in full, the buyer shall hold the proceeds of the sale on trust for the seller, and such sale is only authorised by the seller if it takes place in the ordinary course of the buyer’s business. In the event of non-payment of any amounts due to the seller the seller shall be entitled to enter the premises of the buyer and take such measures as are reasonably necessary to recover the goods.”

5. AVAILABILITY OF STOCK AND VINTAGES/SUBSTITUTIONS.If your order includes a wine which is either out of stock or discontinued we will select another wine as near as possible in style, quality and price. Similarly in the event of a vintage being out of stock the next available vintage will be sent unless we are instructed to the contrary.

6. PRICESAll prices are quoted inclusive of V.A.T. and are subject to market fluctuations, alterations in Customs and Excise duties, and stocks being available. This company reserves the right to alter any prices or specifications at any time without notice and all goods sold subject to prices and conditions ruling at the date of despatch. All prices include delivery through Devon and Cornwall providing that conditions stated under clause 7 below are adhered to. Delivery charges outside this area are subject to quotations upon application.

7. DELIVERIES, MINIMUM ORDERS AND DELAYS.This company reserves the right to state minimum value and/or quantity for any orders to be delivered wherever deemed appropriate. Most deliveries are made by our own transport. We would request that three working days are allowed for delivery wherever possible. To ensure a prompt response to your enquiries and orders, we offer e-mail, fax and 24 hour telephone services. We aim to provide the best possible service to all our customers, with delivery from stock within a few days. However we cannot be held responsible for delays beyond our control. Due to increasing fuel prices, special”one off” delivery charges may apply.

8. CONTRACT TERMSThis company shall supply goods only on the condition that our terms and conditions, as stated above, represent the entire agreement between ourselves and our customers and that these terms and conditions supersede any prior agreement.

9. STOCK ROTATION AND RETURNS.It is the purchaser’s responsibility to rotate products so that the oldest is sold first. No credit will be given for out of date products nor will they be exchanged. No returns of wines or spirits will be accepted other than in exceptional circumstances. In the case of authorisation from Castang Wine Shippers being granted for the return of goods, due to overstocking, closing down or change of ownership, we reserve the right to charge 10% of the value of the goods to cover the cost of collection and administration.

10. EXCLUSION OF LIABILITYCastang Wine Shippers shall be under no liability whatsoever for loss or damage, death or personal injury howsoever arising other than for death or personal injury sustained by any person arising from the negligence of Castang Wine Shippers or under the Consumer Protection Act 1987.

11. INSOLVENCY.Either party may immediately terminate trading by written notice if other becomes insolvent or is deemed to be insolvent within the meaning of section 123 of the Insolvency Act 1986.
