The pistols are of good although plain manufacture and interesting in them selves. So is the inscription on the butt cap and the date 1857. They were prob-ably given as a token of esteem and for protection to His Highness Maharajadhiraja Raj Rajeshwar Sawai Shri Sir Tukojirao II Holkar XI Bahadur, Maha-raja of Indore, who wisely and fortunately remained true to the British as troops belonging to his state, Indore, joined the Indian mutiny in 1857. Thepurchasepriceisthehammerpriceplus25%inbuyer’spremium,includingVAT,for lotssoldsubjecttothespecialVATschemeforsalesofWorksofArt,Collectors’itemsandAntiques,andsecondhandgoodsbyPublicAuction(herein-aftercalledSpecialVAT).Certain lots are sold in accordance with specific rules onnormalVATarrangement(hereinaftercallednormalVAT),sothat the purchase price is the hammer price plus an addi-tional 20% inbuyer’s premiumandVATof25% leviedonboth the hammer price and the buyer’s premium. Under all circumstances payment must be made nolaterthaneightdaysfromthedateoftheinvoice.Shouldthepurchasepricenotbepaidbytheduedate,inter-estat1.5%pernewmonthwillbecharged.If thepurchasepriceand interestarenotpaidwithineightdaysafterBruunRasmussenhassentitsdemandtothebuy-er,BruunRasmussenshallbeentitledtorescindthesaleandresellthegoodsataBruunRasmussenauctionorprivately,andtodemandreimbursementofanyrelatedlossesfromthedefaultingbuyer.Anyfurtherprofitonthesaleshallbepay-abletothepersonwhohaddepositedthegoodsforsalebyauction.If the defaulting buyer is entitled to proceeds from a saleof goods by Bruun Rasmussen, Bruun Rasmussen shall beentitledtosetoff its receivablesagainst itspayablestothedefaultingbuyer.If the defaulting buyer has deposited other goods for sale,Bruun Rasmussen shall be entitled to sell such goods at aBruunRasmussenauctionwithoutbeingboundbythereservestipulatedbythedefaultingbuyer.Thedefautlingbuyershallnotbeentitledtodemandthesurrenderofgoodsdeposited

forsaleaslongasthedebtpayabletoBruunRasmussenhasnotbeendischarged,regardlessofwhetherthevalueofsuchgoodsmaybedeemedtoexceedthedebtpayable.BruunRasmussenshallbeentitledtorefuseabidmadebyabuyerwhoisindefaultinrespecttohispaymentobligationstoBruunRasmussen,aswellasabidmadebyathirdpartyonbehalfofsuchadefaultingbuyer.BruunRasmussenshallfurther be entitled to demand a deposit as a condition ofacceptinganyfuturebidsfromsuchapurchaser.

throughaforwardingagentapprovedbyBruunRasmus-senareexemptfromVAT.

2 Exportaspersonalluggage:GoodsmaybeexemptfromDanishVATwhen thebuyer personally takes thegoodsout of the country as luggage, provided the followingconditionshavebeenmet:

TheinvoicemusthavebeenpaidandtheDanishdutyof25% of the invoice amount must have been depositedwithBruunRasmussen.

b Buyers residing in other countries outside the EU willbe refunded theDanishVATafter thegoodshavebeenpresented for customs clearance in connectionwith thedepartureofthebuyerfromtheEU.Theexporter’sformshould be returned to Bruun Rasmussen after beingendorsedwiththecustomsauthorities’exportcertificateif thepurchasepriceexceedsDKK300ThisalsoappliestotheFaroeIslandsandGreenland.

§ 4. payment of taxes and duties

A. BuyerswithVAT-registrationinotherEUmemberstateswhodonotwish tomakeuseofArticle3may insteadchoosetopurchaseitemssubjecttoSpecialVAT/NormalVAT in the samemanner as private buyers. BruunRas-mussenmust be notified of this before 10 a.m. on thefollowingauctionday.

B. BuyerswithVAT-registrationinDenmarkmaychoosetopurchasesubjecttoNormalVATat25%ofthehammerpricepluspremium.BruunRasmussenmustbenotifiedofthisbefore10a.m.onthefollowingauctionday.

§ 5. collection of purcHases

Thepurchasepricemustbepaidinfullbeforethepurchasedlotcanbepassedovertothebuyer.Fromthetimeofthelotbeingknockeddowntothebuyer,untilitscollection,thepur-chasedlotwillbeheldatthebuyer’sownexpenseandrisk.Astoragefeewillbechargedfor lotswhichhavenotbeencollected within 14 days after the time of the lot beingknockeddown.Goodswhichhavebeenpaidforbutnotcol-lectedwithin1yearwillberesoldatauctionorprivatelyatthebuyer'sexpense.

Theartisticroyaltywillbecalculatedasfollowsforeachworkofart,whenthehammerpriceexceedsDKK1,863:

• 5%ofthepartofthehammerpricerangingfromDKK0to DKK 310,596 plus the buyer’s premium (20% excl.VAT)

• 3% of the part of the hammerprice ranging from DKK310,596 to DKK 1,242,383 plus the buyer’s premium(20%excl.VAT)

• 1% of the part of the hammerprice ranging from DKK1,242,383 to DKK 2,174,171 plus the buyer’s premium(20%excl.VAT)

• 0.5%ofthepartofthehammerpricerangingfromDKK2,174,171 to DKK 3,105,958 plus the buyer’s premium(20%excl.VAT)

• 0.25%ofthepartofthehammerprice lyingaboveDKK3,105,958plusthebuyer’spremium(20%excl.VAT)

§ �. export licence

Applications for an export licence must be made to theDanishCulturalAssetsCommitteewhenrequired inaccord-ancewith currentDanish legislation on the protection andpreservation of cultural assets in Denmark. Where sucha licence has not been obtained, the foreign buyerwill beinformedthereofimmediatelyafterthelothasbeenknockeddowntothebuyer.AnotherapplicationwillsubsequentlybesenttotheDanishCulturalAssetsCommitteebyBruunRas-mussenonbehalfofthebuyer,nowthatthepriceisknown.Shouldanexportlicencenotbegranted,theDanishCulturalAssetsCommitteewouldbeobligedtoacquirethepurchasedlotatthepurchaseprice,andthebuyerwouldthusnotbeboundtothepurchase.

§ �. cataloguing

All lots are sold in the condition in which they are foundwhenknockeddownandasdescribedinthecataloguewithsubsequently published changes and modifications. Cata-loguingisdoneaccordingtothebestofBruunRasmussen’sknowledgeandonthecataloguingprinciplesstated.

Thelotsauctionedareoftenofsomeageorofakindwhichmakes it possible that they may contain defects, deficien-cies,ormayhavebeensubjecttorestorationordamagenotnecessarilystatedinthecatalogue.Cataloguepicturesareforidentificationonlyandcannotbeusedforanevaluationoftheconditionofthegoods.

Anypersonwhowishes tobid at an auction should there-foresatisfyhimselfoftheconditionofthelotsforwhichheintendstobidbypersonalinspectionatthepreviewheldpri-ortotheauction.Thecataloguedescriptionisanindicationoftheprevailingoppinionofscholarsandexpertatthetimeoftheprintingofthecatalogue.Ifanydoubtsshouldariseafter the purchase regarding the genuineness of the pur-chasedlotoritsconformancewiththecataloguedescription,BruunRasmussenshouldimmediatelybeinformedthereof.

Shouldthepurchasedlotbeprovedtobeaforgery,orifthecataloguedescriptioncontainsmaterialerrorswhichleadtoaconsiderablyhigherhammerprice thanthatwhichacor-rect catalogue description would presumably result in, the

buyer shall be entitled to cancel the purchase, after whichthe buyer shall be reimbursed for the total purchase pricepaid, up till a maximum amount of the highest estimatedpricestatedinthecatalogueplusbuyer'spremiumandVAT,whenapplicable.

Formaterialerrorsinthecataloguedescriptioninrespecttomeasurementsorweight,compensationshallonlybepaidonapercentagebasisinproportiontothedifference.

Therightofcancellationofapurchaseinpursuanceofthepresent conditions can only be exercised by the partywhohasboughtthelotinquestionatBruunRasmussenandshallbesubjecttothepresentationofaclaimforcancellationinwritingtoBruunRasmussenwithin2yearsofthepurchasedateandtothepurchasedlotbeingreturnedtoBruunRas-musseninthesameconditioninanyandallrespectswhichthepurchasedlotwasinatthetimeofthelotbeingknockeddowntothebuyer.

Intheeventofcancellationthebuyershallnotbeentitledtoclaimpaymentofinterestonthepurchasepricenorshallthebuyerbeentitledtoclaimcompensationforanyotherexpen-sesor loss incurred, includinganypossible lossofprofit inconnectionwithreselling.

Itshallnotbepossibletostatecancellationofapurchaseinpursuanceoftheaboveprovisionsif:

a thecataloguedescriptiononthedaythelotwasknockeddown to the buyer was in accordance with the thengenerallyacceptedopinionofscholarsandexperts;

b theonlywayofestablishingwhetherthe lotwasafor-geryatthetimeofthepublicationofthecataloguewastheimplementationofscientificprocesses,thevalidityofwhichwasonlyacknowledgedafterthetimeofpublica-tion of the catalogue, or which would have required adisproportionate amount of cost, or which would havebeen impossible to carry outwithout damaging the lotinquestion.
