We have a Retention Agreement in order to protect your interest as well as ours.

If I want to begin utilizing your services for collections, how do I get started?

You must execute our Company’s Retention Agreement and fax said Agreement to our office at (954) 424-0500.

Once you have faxed the executed Retention

Agreement, cases can be placed through our website, in excel format at www.ycscollects.com, fax or U.S. mail.

Does Your Collection Solution, Inc. charge an annual fee?

No, there are no annual or monthly fees. We are paid only when we recover your money. You have nothing to lose and everything to gain.

Are there any up front costs for collections?

No. There are no up front costs to collect your delinquent accounts. In the event that you do not have the individuals social security number or corporation’s federal identification number there will be a nominal cost.

You will be responsible to pay all out of pocket expenses associated with the filing of a lawsuit if necessary.

If you have obtained a judgment and require the

services of our independent asset investigator there are costs associated with their investigative services. Our office works exclusively on a contingency fee. “If we don’t collect we don’t get paid”.

What debts can be placed for collections?

We will accept debts for collections that are less than two years old. There is a minimum of two hundred dollars ($200.00) on files placed for collection.

Does Your Collection Solution require a certain number of accounts to be placed for collections?

No, we have no requirements on the amount of cases that are placed for collections.

How long can you pursue a debt?

We can pursue outstanding debts as long as they are within the Statute of Limitations. (Note that each state has its own statue.)

Is there any involvement or requirement of the client?

Once you place a case for collections we ask that you stop all in house collection activities and cease all communications with the debtor as this will only compromise our collection efforts. All offers of settlements will be presented for your approval. Furthermore, you must report all debtor payments to us. It is illegal to continue collections efforts and report a debtor to the credit bureaus when they have paid their account.

What is the process for collections?

Once you have placed an account with us we will send an initial collection validation letter to the debtor advising them that the account has been placed with our firm for collections, who the creditor is and the amount of the debt. We advise the debtor that if they have a dispute it must be made in writing.

Our collectors will attempt to contact the debtor to discuss

the case within hours of placement. However, when pursuing a consumer collection matter during the initial thirty day validation period our collectors cannot make any demands for payment or reference the credit bureau. After the thirty day validation period, we can demand payment and place the debtor into the credit bureau.

When pursuing collections on a commercial case our collectors can be more aggressive. Typically we will fax our demand letter to the debtor within twenty four hours and begin demanding payment in full. In the event that the debtor is not responsive we can place the debtor into the credit bureau and or file a lawsuit immediately.

How soon can you collect our money?

We are able to collect payment in full on some cases within seven days. Cases of bankruptcy or business closure are usually uncollectible. The age of the debt will also play a part in our success rate. Most successful collections occur once the debtor is placed into the credit bureau and or when a lawsuit is filed.

Will Your Collection Solution, Inc. compromise or negotiate my settlement?

No, only you can approve a compromise. We will do our best to negotiate the best settlement. All settlement offers will be approved by you the client.

Does Your Collection Solution, Inc. accept payments?

Yes, we demand all payments be made directly to our office or our attorney’s office. Occasionally a debtor will pay you directly. It is imperative that you report any and all payments that you receive so that we may credit the subjects file accordingly and report to the credit bureaus.

How often does Your Collection Solution, Inc. disburse payments?

All payments are deposited into our trust account and are disbursed biweekly after said funds have cleared our account. We ask that you remit our fee on payments paid directly to you within twenty days.

What if you can’t collect for me?

If we are unable to collect on your case within thirty days we will place the debtor into the credit bureau and/suggest that you file a lawsuit.

Are you able to find people and corporations?

Yes. Our firm utilizes independent private investigators. They are able to locate most individuals and corporations. Our investigators are equipped with the latest software to track down individuals and corporations when they relocate. Successful collection on a delinquent account requires locating the debtor. It is helpful to have the last known address, social security number or federal identification number.

Is Your Collection Solution, Inc. able to locate debtor’s assets?

Our independent private investigators specialize in locating hidden assets such as bank accounts and brokerage accounts. The Gramm Leach Bliley Act requires that all financial investigations have a permissive purpose. Our searches are performed legally; therefore our firm requires the requesting party to have a valid need for this type of information.

Is there a guarantee to make a recovery when I place an asset investigation?

There are some cases that will prove to be uncollectible. Therefore, there is no guarantee that the information we obtain through our asset search will automatically translate into a recovery of your judgment.

How long does it take to collect on a judgment?

This varies depending on the financial conditions of the debtor. Once our investigators have determined that there are assets such as bank accounts, brokerage accounts or real property it typically will take forty five to sixty days for our attorneys to enforce the collection of the judgment.

RETENTION AGREEMENTThis agreement is made by and between Your Collection Solution, Inc., a Florida Corporation (hereinafter referred to as

AGENCY) ___________________________________ (hereinafter referred as CLIENT) this_____ day of _________, 20____

The AGENCY and CLIENT hereby agree as follows:

1. AGENCY will perform collection services for CLIENT and CLIENT will pay AGENCY a contingency fee on any amounts recovered as follows: Commercial Contingency Fee Schedule (Business to Business)

a. $250.00 - $1,000.00 35%

b. $1,001.00 - $ 6,000.00 28%

c. Over $6,000.00 18%

Consumer Contingency Fee Schedule (Individuals)

d. Flat Rate 35%

e. A contingency fee of 35% will apply to all files that require legal action and are forwarded to our attorneys. Furthermore, the client is responsible for filing fees, service of process and all court costs, which are associated with litigation.

f. All International Collection placements are an additional 10% fee to the above rates. Furthermore due to the complexity of these claims there is an upfront processing fee of $150.00 U.S. Dollars. The fee will be credited against all monies that are collected.

g. The return of merchandise ½ of regular contingency fee. h. Agency will perform skip trace address locating whenever necessary. There will be an upfront fee of $35.00 for this

service.

2. CLIENT agrees to notify AGENCY immediately of all direct payments received after an account has been forwarded to AGENCY. CLIENT understands that AGENCY is entitled to a full contingency fee on all monies recovered whether paid to AGENCY or to the CLIENT directly. Failure to pay the fee to AGENCY within thirty (30) days of receipt of the payment may result in an interest fee being assessed at the legal statutory rate.

3. AGENCY agrees to remit to CLIENT, on a monthly basis, all monies due to CLIENT on accounts that have been collected during the preceding month. AGENCY will furnish an appropriate statement, which will reflect the collected monies less the contingency fee.

4. CLIENT shall not terminate AGENCY’S authority to handle their business for a ninety (90) day period from the date of this agreement. However, in those instances where a payment agreement has been made between AGENCY and CLIENT’S debtors, AGENCY shall not return the account until the debtor has paid in full. In the event that AGENCY places a debtor into the credit bureau and said debtor pays CLIENT directly, CLIENT is responsible to remit to AGENCY the agreed contingency fee upon receipt of payment from the debtor or any party who paid on behalf of the debtor. Debtor accounts remain in the credit bureau for a period of seven (7) years. Debtor accounts that have been placed into the credit bureau remain the property of AGENCY for seven (7) years from date of placement in the credit bureau.

5. While AGENCY is working an account, CLIENT shall have no contact with their debtor and shall refer all communication from debtor to AGENCY.

6. It is understood by both parties that should legal action be recommended by AGENCY on any account, CLIENT will be notified and CLIENT will acknowledge confirmation of same in writing prior to any legal action being instituted. In cases where litigation is instituted, CLIENT agrees to forward all out of pocket costs associated with legal action. NO account will go to litigation until receipt of said out of pocket costs. In the event that a third party lawsuit or a counterclaim is filed CLIENT will be responsible to hire an attorney to defend the legal action. CLIENT will have the option of retaining AGENCY’S attorney or any attorney of their choice. In either event CLIENT will be responsible for retainer and for hourly attorney’s fees and costs with regard to defense of third party lawsuit and or counterclaim.

7 AGENCY will determine when it is necessary to report a debtor to the credit bureau to aid of collection efforts. There is no fee for this service. The CLIENT is responsible for the accuracy of all information they have provided to AGENCY and agrees to indemnify and hold harmless AGENCY from any inaccurate information. Once AGENCY places a debtor into the credit bureau CLIENT is responsible to remit AGENCY the agreed upon contingency fee on any and all monies which CLIENT may collect for the seven (7) year period as AGENCY continues to work accounts in the credit bureau.

9. In the event that litigation is necessary in remedying any breach of this Retention Agreement, all cost and expenses of litigation, including attorney fees, will be borne by the non prevailing party.

10. Each agrees and acknowledges that the laws of Florida shall govern the validity construction, interpretation and effect of this Agreement. This agreement shall be binding upon the parties.

JUDGMENT RETENTION AGREEMENT

 This agreement is made by and between Your Collection Solution, Inc. a Florida Corporation (hereinafter referred to as AGENCY and____________________________ thereinafter referred as CLIENT) this_____ day of ___________, 201___.

The AGENCY and CLIENT hereby agree as follows:    AGENCY will utilize the services of independent private investigators to perform asset investigation services. Furthermore AGENCY will have legal

counsel prepare all necessary documents including all garnishment proceedings to collect the subject judgment for CLIENT. Fees are calculated on the amount of the judgment as collected. CLIENT agrees to pay AGENCY a contingency fee on any amounts recovered as follows:

  

A contingency fee of 35% applies to any and all monies recovered up to $50,000. 

A contingency fee of 25% applies to any and all monies recovered, between $50,000 and $75,000.  

A contingency fee of 15% applies to any and all monies recovered over $75,000.   

The AGENCY’S independent investigators will conduct a comprehensive asset investigation which is inclusive of the following: bank accounts one state, safety deposit boxes, nationwide real property and credit analysis for a fee of $475.00.

In the event that the CLIENT elects to conduct a nationwide asset investigation which is inclusive of the following: nationwide bank accounts, safety deposit boxes, money markets,

certificates of deposits, brokerage accounts, nationwide real property, credit profile, motor vehicles, liens & judgments for a fee of $900.00.  

The contingency fee schedule includes all necessary attorney fees to effectuate a garnishment. Once garnishable assets are identified, the client will be responsible for a fee of $400.00 for the cost associated with the garnishment.

In the event that your judgment debtor has moved from the state that issued your judgment, said judgment must be domesticated to the state in which the debtor currently resides before any garnishment activities can commence. In such case, Client must provide AGENCY with an exemplified copy of the judgment and pay an out of pocket cost of $950.00.

In the event that litigation is necessary in remedying any breach of this Retention Agreement, all costs and expenses of litigation, including attorney fees, incurred by AGENCY will be borne by the non prevailing party. Each agrees and acknowledges that the laws of Florida shall govern the validity construction, interpretation and effect of this Agreement.
