Dear Ms. Rhodes:
The purpose of this letter is to outline the applicant's request for a variance for the abovereferenced property. The property is located at 200 Avondale Circle m the Sevema Parksubdivision in Sevema Park, MD. It consists of 22, 847 square feet. The site is partially locatedin the LDA, the Limited Development Area of the Chesapeake Bay Critical Area. The site iszoned R-5. The site is currently developed with a house and driveway and is served by publicwater and sewer. The site is served by an existing driveway to Lennox Avenue.
The site consists of two lots, Lot 5 and 6 of Block C ofSevema Park. They are both buildablelots, and as demonstrated on the site plan, can be developed in a manner to all setbackrequirements per the County Code. The small portion of the existing house currently straddlesthe lot line between lots 5 and 6. The owner would like to raze the dwelling and constmct adwelling on each lot. This site would meet the criteria to 'unmerge' the two lots by razing thedwelling; however, portions of both lots are in the Critical Area. As such, the owner is askingfor a variance to:
Article 18, Subtitle 4, Subsection 203 which states: all or part of any lots in the criticalarea were part of a subdivision approved on or after August 22, 1988
The removal of the dwelling and the submission of an amended plat showing the lots as theywere in the original Sevema Park subdivision would allow for the two original building lots tore-exist as they were prior to the construction of the house. These original lots are consistentwith the development patterns of the Sevema Park subdivision. The minimum lot area for anR5 lot is 7,000 square feet. Lot 5 would return to the original 11,405 s.f. and Lot 6 wouldreturn to 11,442 s. f. The layout of the building restriction lines shown on the site plandemonstrate that a dwelling can be placed on either lot if the variance would be granted.
In closing, the variance requested is the minimum necessary to afford relief and is not basedon conditions or circumstances that are a result of actions by the applicant. This variance willprovide the owner with dwellings that are in harmony with this existing pattern ofdevelopment.
