Stelios Kiliaris

Mr. Stelios Kiliaris, a Chartered Accountant by qualification has over 27 years of experience in international taxation, accounting, legal and investment advisory services focusing on emerging markets. From 1986 to 1992, he worked with KPMG focusing on taxation. In 1992, he left KPMG to set up his own business, focusing on international tax planning, accounting, auditing and legal advice. In 1994, his business was merged into a partnership with AntonisPartellas named Partellas and Kiliaris. In 2004, the partnership was registered as a company, Alliott Partellas KiliarisLtd., of which he is a director. The company is licensed by the Institute of Certified Public Accountants in Cyprus to act as a licensed auditor.

Mr. Kiliaris has been a member of the Association of Chartered Certified Accountants in UK since July, 1990. He has been licensed by Cyprus Stock Exchange to act as a broker since 1999 and he has been licensed by the Cyprus Securities and Exchange Commission to carry on, amongst other things, portfolio management and investment advisory business since 2005.

Mr. Kiliaris has since May 2008 also been a director of Prochoice Chrimatistiaki Ltd. which is a member of the Cyprus Stock Exchange and the Athens Stock Exchange.

Praveen Challa

Praveen Challa is a finance professional with over 20 years of post-qualification experience in Financial Services, Asset Management, Capital markets and Corporates. He has functional experience in Investor Relations, M&A, Strategy, Business Planning, Budget, International taxation, Regulations, Treasury, Investment management and MIS reviews.

A Chartered Accountant (from India) by qualification, he has worked in a senior position with Global Group (India’s leading network engineering and infrastructure group), Reliance Capital (One of India’s largest non-banking financial services company), Benchmark Asset Management Company and Niche group of companies.

During his career, he established the office of Investor Relations at Reliance Capital and UK office of Global Holding Corporation. He was a lead member for driving key initiatives like strategic transactions across various lines of businesses at Reliance Capital and Global Group. He has vast experience in due diligences & management negotiations, setting up operations and complying with regulatory requirements.

He also has experience in advisory & consultancy services such as industry research & analysis, preparation of project reports, corporate disclosure practices, introduction & implementation of corporate governance and other areas. He was part of the Founding team of Benchmark Mutual Fund, India’s first fund house to focus on passive and quantitative investments (subsequently acquired by Goldman Sachs). He was the project leader for the initial IPOs of Benchmark Mutual Fund. Also has experience of capital markets – managing broking operations – dealing, client management, risk management, legal compliance and finance.

Roshan Nathoo

Roshan Nathoo has been working in the financial services industry in Mauritius for more than 20 years. Roshan is the Managing Director of Globefin Management Services. He was the Managing Director of Standard Bank Trust (Mauritius) for 4 years from 2002 to 2006. During that time, he contributed to making Mauritius a hub for the Standard Bank Group for businesses from South Africa, Sub-Sahara Africa Region as well as from the Middle East. The Standard Bank Trust Mauritius business doubled in size over the last three years of his tenure.

Roshan was Chief Operating Officer of the Standard Bank Group in Mauritius (which comprised both Banking operations as well as Corporate and Fiduciary Services operations) from 2006 to 2008 with specific responsibility for Banking Operations, IT, Treasury Back Office and Trade Services.

Roshan was formerly a Senior Manager at the representative of Arthur Andersen in Mauritius where he worked for 8 years from 1994 to 2002 in the Offshore Business Department. He was responsible for a portfolio of clients with primary interests in the Emerging Markets of India, China, South East Asia and South Africa.

Roshan is a Fellow of the Association of Chartered Certified Accountants (UK), a member of the Chartered Institute of Management Accountants (UK) and a member of the Society of Trust and Estate Practitioners (UK).

Manesha Ragoobeer

Manesha Ragoobeer started her career at the representative of Arthur Andersen in Mauritius. She worked for that organization from 2000 to 2005 and during that period she and the team reporting to her, were responsible for the administration and preparation of accounts for a portfolio of clients involved in the Global Business sector in Mauritius. For 3 years subsequently, Manesha was a team leader at Standard Bank Trust in Mauritius within the outsourced business section. In that capacity she was responsible for all the bookkeeping and accounting of all Jersey (Channel Islands) based clients of the Standard Bank Offshore Trust Group. During that period, Manesha was also seconded to the Funds Department of the Standard Bank Group in Jersey where she was responsible for the bookkeeping and preparation of accounts for several client groups of Standard Bank. She also undertook Funds Administration and Accounting roles in Mauritius.Manesha is a Fellow of the Association of Chartered Certified Accountants (UK).

Know Your Customer

Why is KYC important?

KYC policies are essential to any financial institution. Knowing who you are doing business with can prevent a bank from inadvertentlyfacilitating money laundering. An inadequate or nonexistent Know Your Customer system can result in the firm, as well as individualemployees, being subject to civil and/or criminal penalties.

“Customer” refers to any person or entity that opens or maintains an account, as well as beneficial owners, beneficiaries of transactionsperformed by intermediaries, and entities or persons connected with high-risk financial transactions.

While it has always been important for financial institutions to be aware of whom they are doing business with, the USA Patriot Act madesuch due diligence even more paramount. Passed in October 2001, it required all financial service providers to establish Anti- MoneyLaundering programs in order to catch potential cases of terrorism financing.

Section 326 holds institutions accountable for their ongoing Know Your Customer screening and initial customer screening. Federalregulators require that financial institutions such as banks perform due diligence in verifying the identities of potential clients and keepdetailed records of the process used. In the case that your institution does accidentally fund terrorists, proof of ongoing due diligence canpotentially mitigate the degree of any civil or criminal charges levied against you.

One aspect of the KYC process is to verify that the customer is not listed as a known fraudster, terrorist or money launderer, e.g. by crosschecking with the Office of Foreign Assets Control (OFAC) Specially Designated Nationals list. This list contains thousands of entries and isupdated at least monthly. In addition to the above mentioned sanctions lists, there are lists of third party vendors that track links betweenpersons regarded as high-risk due to negative reports in the media or in public records. Beyond name matching, a key aspect of KYCcontrols is to monitor transactions of a customer against their recorded profile, the history of the customer’s account(s) and theirtransaction with peers in order to identify money laundering schemes. The KYC process is not solely focused on risk rating and controllingof transactions. Another important aspect is the customer identification process (CIP). To verify collected identification documents thirdparty vendors provide software to scan and check their authenticity.

Know Your Customer processes are also employed by regular companies of all sizes, for the purpose of ensuring their proposed agents,consultants or distributors anti-bribery compliance. Banks, insurers and export credit agencies are increasingly demanding that customersprovide detailed anti-corruption due diligence information, to verify their probity and integrity.

What are the essential elements of a KYC solution?

Customer Acceptance Policy

Must be clear, with explicit criteria. Perform due diligence with background checks to ensure that customer/entity is using their real name and not involved in terrorism or other illegalactivities.

Customer Identification Procedures

Must be clearly outlined for and performed at every stage of the banking relationship: establishing an account, carrying out a transaction, resolving doubts about the authenticity of previously obtained identification, etc. Identify and verify all customers’ identities and purposes (using reliable, independent data, information, and/or source documents) to the bank’s satisfaction.

Monitoring of Transactions

Effective KYC procedures require continuous monitoring of your customer base and its normal behavior to reduce risk. High-risk accounts (classified based on country of origin, fund sources, etc.) or activities (such as complex or unusually large transactions and those with no visible lawful purposes) should undergo extra scrutiny. Banks can set thresholds for transaction amounts that warrant enhanced due diligence.

Risk Management

All banks and other financial institutions should establish internal audit and compliance functions to ensure adherence with Know Your Customer guidelines; this includes establishing a company-wide training program regarding policies and procedures. Responsibility for these functions should be explicitly outlined and allocated within the bank–taking into account segregation of duties, and management oversight is essential. Accounts should be subject to risk categorization, and banks may create risk profiles with accompanying procedures for each category.
