    Ward 5 Highlights

    Dear Ward 5,

    On Tuesday, November 11, we honor the 37,000 veterans who call theDistrict of Columbia home. As Chair of the Committee on GovernmentOperations, which has oversight of the Office of Veterans Affairs, I want tocommend Mayor Gray and all participating stakeholders in the VeteransNOW Initiative, which has placed 531 veterans in permanent housing sincethe beginning of the campaign and aims to find housing for the remainderof the District of Columbia's veteran homeless population by 2016. Inrecognition of the holiday, the District of Columbia government will beclosed.

    With the District of Columbia's general election behind us, the Council isfocused once again on the remainder of Council Period 20. Next week, Iam co-chairing a hearing with Councilmember Bowser on the surplus anddisposition of the McMillan Sand Filtration Site. The details of the hearingcan be found below. The Council will also convene a Legislative Meetingon Tuesday, November 18.

    Councilmember McDuffie announces a joint publicroundtable on the surplus and disposition of the McMillan

    Sand Filtration Site

    On Wednesday, November 12, 2014, Councilmember McDuffie,Chairperson of the Committee on Government Operations andCouncilmember Muriel Bowser, Chairperson of the Committee onEconomic Development, will convene a joint public roundtable on PR20-1081 the McMillan Surplus Declaration and Approval Resolution of 2014;PR20-1082 the McMillan- Residential Townhomes Parcel Disposition

    Approval Resolution of 2014; PR20-1083 the McMillan ResidentialMultifamily Parcels Disposition Approval Resolution of 2014; and, PR20-1084 the McMillan Commercial Parcels Disposition Approval Resolutionof 2014.

    This joint public roundtable will be held in Room 412 of the John A. WilsonBuilding, 1350 Pennsylvania Ave, NW at 10:00 AM.

    The purpose of this joint roundtable is to give the public the opportunity tocomment on these measures.

    The stated purpose of PR20-1081 the McMillan Surplus Declaration andApproval Resolution of 2014 is to declare and approve as surplus theDistrict-owned real property located at 2501 1st Street, N.W., formerly theMcMillan Sand Filtration Site.

    The stated purpose of PR20-1082 the McMillan- Residential TownhomesParcel Disposition Approval Resolution of 2014, PR20-1083 the McMillan

    Residential Multifamily Parcels Disposition Approval Resolution of 2014,

    and, PR20-1084 the McMillan Commercial Parcels Disposition ApprovalResolution of 2014 is to approve the disposition of the District-owned realproperty at the McMillan Sand Filtration Site with a plan that includes:

    (a) 350,000 square feet for residential townhomes (Townhomes Parcel).Other components of the Project will be developed into approximately (a)1,030,000 square feet of healthcare facilities (b) 41,250 square feet of retail( c) 50,000 square feet of parks, landscaping or open area, (d) 52,920square feet intended to be a full-service grocery store, (e) 566,930 squarefeet of gross floor area devoted to multi-family residential units.

    Additionally, a significant portion of the Property will be retained by theDistrict of Columbia Government and the proposed uses will includeapproximately 17,500 square feet of gross floor area devoted to a

    community center and a major feature of the site is an extensive amount ofopen space: approximately 444,056 square feet of land area devoted toparks and landscaped areas.

    Finally, the redevelopment will preserve the North and South ServiceCourts, including all 20 sand storage bins, all four regulator houses, atleast one sand washer, eleven filter bed portals and extended portions ofthe service court walls, and the preservation of approximately two acres ofunderground filterbeds, Cells 14 and 28. The redevelopment will re-establish the Olmsted Walk around the perimeter of the Property.

    witnesses in order to permit all witnesses to testify. Witnesses shouldbring 10 copies of their written testimony and if possible also submit a copyof their testimony electronically [email protected].

    If you are unable to testify at the hearing, written statements areencouraged and will be made a part of the official record.     Councilmember McDuffie attends Potomac PreparatoryPublic Charterl School's Dedication Celebration

    On October 30, 2014, Councilmember McDuffie joined Ward 5's PotomacPreparatory Public Charter School and more than 100 guests for theschool's Dedication Celebration. Potomac Preparatory Charter School,formerly Potomac Lighthouse Public Charter School, emphasizes the artsand character development in its curriculum. The Councilmember extendedgreetings and wished the attendees good luck as Potomac Preparatorybegins a fresh start under the school's new administration.

    Veterans Day 2014

    Veterans Day is Tuesday, November 11. The District of Columbiagovernment will be closed, and most city services will be suspended.

    City Services

    Trash and recycling collection will be suspended on Tuesday, November11, as will street and alley cleaning. Parking enforcement will besuspended, except around the National Mall where all parking regulations,

    including Emergency No Parking will be enforced and vehicles may betowed. Services will resume Wednesday, November 12.

    Parks and Recreation

    All DPR facilities will be closed on Veterans Day. All permitted events willtake place, and all playgrounds and fields will be open.

    The Department of Motor Vehicles: New Adjudication Lawsin Effect

    Customers Can Submit Request for Reconsideration

    There are new adjudication laws in effect under the Traffic Adjudication

    Amendment Act of 2014, which changes the process for how customersadjudicate tickets. On October 1, 2014, theDistrict of ColumbiaDepartment of Motor Vehiclesimplemented two significant changes to theadjudication process: submittingrequests for reconsiderationand filing amotion to vacate.

    Customers who contest aparking,photo enforcementticket, or aminormoving violation,and are held liable now have 30 days to submit arequestfor reconsiderationand include new evidence\documentation to supporttheir case. The hearing examiner will evaluate the new evidence and makea final decision. If the liable decision is upheld, then customers have theoption to appeal the decision. Arequest for reconsiderationis requiredbefore an appeal can be filed.

    By implementing the request for reconsideration process, customers havethe opportunity to submit documentation that they may not have submittedinitially. For example, customers often write letters stating that the vehicleon the ticket is not their vehicle; however, they do not submit a copy of theirregistration for the hearing examiner to view. Now, they will have 30additional days to do so, said DC DMV Director, Lucinda Babers.

    If a ticket has not been answered within 60 calendar days and a deemedadmission has been entered, or the ticket was answered and the customerfailed to appear at an in-person hearing and a default judgment wasentered, the customer may file aMotion to Vacate.Customers have 60calendar days from when the deemed admission was entered to file aMotion to Vacateunless the violation falls under one of the threecategories: i) distracted driving, ii) operating without insurance, and iii)

    defense to parking or photo enforcement ticket is that the vehicle is nottheirs, or the tags were lost or stolen when the ticket was issued. Then,they will have 365 days to file aMotion to Vacate.
