NOTE: The term 'you" and its derivatives, as used in this permit, means the permiltee or any futuretransferee. The term "this office" refers to the appropriate district or division office ofthe u.s. ArmyCorps ofEngineers (Corps) having jurisdiction over the permitted activity or the appropriate officialofthai office, acting under the authority a/the commanding officer.

You are authorized to perform work in accordance with the terms and conditions, as specified below:

WORK DESCRIPTION: Discharge an average of 1000 cubic yards of woody debris along the bankfull channel annually. This amount may vary year to year depending upon the spring high flow. Atracked excavator will walk the river channel picking up downed trees and other woody debris withinthe bank full channel and re-depositing this material along the river bank. Cottonwood trees standingon the river bank and leaning 30 degrees or more over the river channel; willow trees standing on theriver bank and leaning 45 degrees or more over the river channel; and beaver damaged trees standingon the river bank may be cut and re-deposited along the bank. Standing trees that are removed wouldbe cut down within a few feet of the ground with the root balls left to maintain bank stability. Woodydebris removed from the river will be placed onto existing woody debris piles, placed into areaspreviously impacted or piled to create new waste piles. Single trees encountered in the channel will becut into tcn foot lengths and left in place where appropriate. An additional 0.5 acres of riparian forestmay be temporarily filled over the five year period as a result of the disposal method.

Implementation of the woody pile reduction mitigation plan consists of a tracked excavator workingfrom the river bed, removing woody material previously placed along the river channel and relocatingthis material to exposed dry river bed locations to be burnt in place. Wood ash would not be recoveredfrom the river bed. This work would occur at the same time as the above described channel cleaningactivities.

THE PROJECT SHALL BE CONSTRUCTED ACCORDING TO THE ENCLOSED PLANS ANDORAWINGS titled "Boise River Flood Control District, drawings I and 2, dated July 2012.

I. The time limit for completing the work authorized ends on December 5, 2017. If you find thatyou need more time to complete the authorized activity, submit your request for a timeextension to this office for consideration at least 60-days before the above date is reached.

2. You must maintain the activity authorized by this permit in good condition and in conformancewith the terms and conditions of this permit. You are not relieved of this requirement if youabandon the permitted activity; although you may make a good faith transfer to a third party incompliance with General Condition 4 below.

Should you wish to cease to maintain the authorized activity or should you desire to abandon itwithout a good faith transfer, you must obtain a modification of this permit from this office,which may require restoration of the area.

3. ffyou discover any previously unknown cultural material or historic or archeological remainswhile accomplishing the activity authorized by this pennit, you must immediately SlOp all workactivities and immediately notify this office of what you have found by calling (208) 345-2154.

Our office will initiate the required Federal and State coordination to determine if the remainswarrant a recovery effort or if the site is eligible for listing in the National Register ofHistodcPlaces.

4. If you sell the property associated with this permit, you must obtain the signature of the newowner, in the space provided (see attached) and forward a copy of the permit to this office tovalidate the transfer of this authorization.

5. If a conditioned water quality certification has been issued for your project, you must complywith the conditions specified in the certification as special conditions to this permit. A copy ofthe certification will be provided to you by Idaho Department of Water Quality.

6. You must allow representatives from this office to inspect the authorized activity at any timedeemed necessary to ensure that it is being or has been accomplished in accordance with theterms and conditions of your permit.

SPECIAL CONDITIONS:

Special Condition I: Woody debris removed from the waterway shall be placed into uplands to theextent practicable. If it is determined that the debris cannot be removed immediately to an uplanddisposal site, then the Permittee shall, to the extent possible, place debris on top of the existing wooddebris piles or in locations where wood piles have been previously removed so as to avoid the impactto new wetland areas. [fnew wetland areas are impacted by the discharge of temporary woody debris,these locations shall be mapped using a Global Positioning System (GPS), and the lat/long provided inan annual monitoring report to the Corps by May 1 of each year, following the construction season.The annual monitoring report shall also include the estimated total volume of material removed fromthe river.

Special Condition 2: Starting with the 2013-2014 construction seasons and for the life of the pennit,woody debris excavated during the prior year shall be either removed from adjacent wetlands or offsetby removal of an equal amount from existing woody debris piles. Methods of removal shall includeburning, chipping or completely removing the woody debris from wetlands to reduce the overallfootprint of woody debris storage within waters of the U.S. I[the material is chipped, the wood chipsshall be either burned on site or deposited into a truck and hauled away for disposal at an upland

location. Work shall be done in accordance nith the mitigation plan described in Block 25b of the July2. 2012joint application for permit.

Special Condition 3: Permittee shall remove at least 20 percent of the existing woody debris piles.identified in the Boise River Flood Control District #10 Habitat Pile list dated July 2, 2012, before theexpiration of this permit. Permittee shall submit a target area list of "'OOdy debris piles identified to beremoved, no later than 30 days prior to the stan ofeach of the annual work seasons. These piles shallbe identified by Number, Class (A or B) and Location (latllong). Permittee shall also identify a list ofalternate target areas. should piles identified on the prim8.l)' list not be removed. After each workseason, by May 1, Permittee shall provide the Corps a list of the debris piles by Number, Class andLocation (Iatl1ong). which have been removed and shall identify the method of removal, i.e. burning.chipping or complete removal. This information shall be incorporated into the annual repon.

Special Condition 4: Permittee shall conduct work when river flows arc 350 cfs or less (winter flows)as measured at the USGS river gage at the Glenwood Bridge.

Special Condition 5: Permittee shall notify the Boise Regulatory Office at 208-345·2154 three daysprior to start of channel cleaning activities in the Boise River. Notification shall include the locationof the channel cleaning work.

the active channel of the River to areas outside of the active channel. Some of theseareas outside of the active channel may be jurisdK:oonal wetlands adjacent to the river.

Where feasible. trees cut or otherwise removed as described above will be removedfrom the riparian forest and wetlands areas adjacent to the river. In the event that thetrees cannot be removed outside of the riparian forest due to equipment accesslimitations. the material will be utilized to add onto existing habitat enhancementstructures for the upland game and non-game wildlife species that inhabit the area.

In locations where an isolated tree is removed from the channel and removal from theadjacent riparian forest is not feasible, the stem will be cut into lengths of 10 feet or lessand the pieces may be scattered on lands above the OHWM.

Block 258. Mealure. Taken to Avoid, Minimize, Compen.ate for Impacts to Waters of theU.S., Including Wetlands

The river maintenance project is proposed to be completed during the low water periodof the water year (350 cfs or less at Glenwood). By working during this period, activitiesthat may have an effect on turbidity or other water pollution probfems are anticipated tobe minimal. Further, the maintenance is anticipated to help stabilize the banks of theBoise River, improve channel stability and decrease the risk during high water forturbidity or other problems associated with high water flows.

Where practical. wetlands will be avoided by equipment and for placement ofconcentrations of woody debris removed from the river channel.

Where practical, work will be conduded from the banks of the river or on dry gravel bars.Operating equipment in the active channel will be minimiZed to the extent feasible.

Existing routes will serve as accesses to conduct maintenance activities. No newaccess routes or new gravel roads are anticipated to be constructed.

Block 25b. Proposed Mttlgatlon PlanThe centerpiece of the mitigation plan under this application will be a net 20-percentoverall reduction in the existing inventory of Class A and B piles within FCD10.According to FCD10 records. at the date of application there are approximately 215Class A and B piles wfthin the District. A detailed description of each HES is included inthe attached "Boise River Flood Control District #10 Habitat Piles" document.

A 2G-percent reduction over 5 years equates to the removal of 43 piles. Where feasible.FCD10 emphasize the removal of the largest Class A piles over Class B piles.

As mitigation fO( the relocation of material from within the active river channel to adjacentregulated areas along the river corridor. FCD10 will remove a commensurate volume ofmaterial by buming, chipping. hauling Of otherwise removing existing HES from withinthe riparian COrridOf. The net 2G-perc:ent reduction (43 piles) over 5 years serves as acommensurate volume reduction over the term of the permit. Removal activities on landmay occur throughout the year.

Where allowed, during the winter operations. FCD10 anticipates moving a number ofexisting debris piles from the riparian forest and burning the material on exposed gravelbars atong the river. This activity will be conducted in accordance with applicable IDEO

regulations. Annually, ash remaining after burning operations will be buried with localriver cobble, prior to the annual runoff season. Unburned material will be hauled fromthe exposed gravel bars prior to the annual runoff season.

A number of piles presently exist that can only be reached either by constructing anaccess road through the existing riparian forest or directly from the river channel, belowthe OHWM. Provided that an approval from IDEa is received to allow burning of thesepiles in place, piles'Nith poor access woukt also be subject to removal under thisapplication. Only piles that are readily accessible through minimal resource disturbanceare contemplated to be removed as mitigation under this application.

The proposed activity is anticipated to improve the safety along the Boise River forrecreational users, as ·strainers· and the number other river risks can be reduced.Removal of trees in the river channel and those that appear to be in imminent danger offalling into the channel will eliminate obstacles that could pose a threat to recreationalusers (i.e. fishermen, hunters, etc.) and wi"U eliminate potential ·strainers- from the waterthat can continue to coilect more trees and other floating objects. Overall, the generalsafety for recreational users should be improved as mitigation activities are com~ted.

FC010 may need to revisit HES sites, following removal of piles and may need to utilizethese same sites for Mure temporary storage of river debris. FC010 will maintain aninventory of these sites for future temporary storage and mitigation use. Piles that havebeen previously burned are inventoried in the attached "Boise River Flood ControlDistrict #10 Habitat Piles" document.

Prior to commencing maintenance activities, FCD10 wilt also submit Flood PlainDevelopment Permit applications to the various jurisdictions that will be affected by thispermit. FC010 INiIl only operate within those jurisdtctions that provide approved FloodPlain Development Permits. The approval entities include: Ada and Canyon Counties,Boise City, Garden City, Eagle. Star, Middleton and Caldwell.
