country as those alleged in this lawsuit by Plainti

c lls o Pl inti s cellu r telephone by the use of n utom tic tele hone di ling system

or a pre-recorded or ifici l voice rior to Defen nt s l cement of the c lls

28. None of Defend n s telephone c lls pl ced to Pl inti were for

"emergency purposes s specified in 7 U S 7(b)( )(A)

29. Defendant willfully and/or knowingly violated the TCPA with respect to the

P aint f .

COUNT I(iolation of the TCPA)

WHEREFORE, Plainti respec ully demands a trial by ury on all issues so

triable and udgment against Defendant for statutory damages punitive damages

pa s and any other such relief the cou may deem ust and proper

33. At all times relevant to this action Defendant is s bject to and m st abide

by t e law of Florida, incl ding Florida Stat te 559 72.

34. Defendant has violated Florida Stat te 559.72(7) by willf lly

comm nicating with t e debtor or any member of her or his family with s ch freq ency

as can reasonably be expected to harass the debtor or her or his family.

35. Defendant has violated Florida Stat te 559. 72(7) by willf lly engaging in

cond ct w ich can reasonably b expected to ab se or harass the debtor or any

member of her or h s family

36. Defendant has violated Florida Stat te 559.72(9) by claiming, a empting or threatening to enforce a debt when s ch person knows that the debt is not legitimate.
